When information on a coma patient’s expected outcome is uncertain, a moral dilemma arises in clinical practice: if life-sustaining treatment is continued, the patient may survive with unacceptably poor neurological prospects, but if withdrawn a patient who could have recovered may die. Continuous electroencephalogram-monitoring is expected to substantially improve neuroprognostication for patients in coma after cardiac arrest. This raises expectations that decisions whether or not to withdraw will become easier. This paper investigates that expectation, exploring cEEG’s impacts when it becomes (...) part of a socio-technical network in an Intensive Care Unit. Based on observations in two ICUs in the Netherlands and one in the USA that had cEEG implemented for research, we interviewed 25 family members, healthcare professionals, and surviving patients. The analysis focuses on the way patient outcomes are constructed, the kind of decision support these outcomes provide, and how cEEG affects communication between professionals and relatives. We argue that cEEG can take away or decrease the intensity of the dilemma in some cases, while increasing uncertainty for others. It also raises new concerns. Since its actual impacts furthermore hinge on how cEEG is designed and implemented, we end with recommendations for ensuring responsible development and implementation. (shrink)

This article reviews the Dutch societal debate on euthanasia/assisted suicide in dementia cases, specifically Alzheimer's disease. It discusses the ethical and practical dilemmas created by euthanasia requests in advance directives and the related inconsistencies in the Dutch legal regulations regarding euthanasia/assisted suicide. After an initial focus on euthanasia in advanced dementia, the actual debate concentrates on making euthanasia/assisted suicide possible in the very early stages of dementia. A review of the few known cases of assisted suicide of people with so-called (...) early dementia raises the question why requests for euthanasia/assisted suicide from patients in the early stage of Alzheimer's disease are virtually non-existent. In response to this question two explanations are offered. It is concluded that, in addition to a moral discussion on the limits of anticipatory choices, there is an urgent need to develop research into the patient's perspective with regard to medical treatment and care-giving in dementia, including end-of-life care. Causality is without doubt one of the main topics of Hobbes's philosophy. Quite justifiably, F. Brandt stated that Chapters 9 and 10 of De Corpore, which expound Hobbes's doctrine of causality, are the most crucial ones ever written by Hobbes. According to Hobbes the quest for causes is the quintessence of all philosophical inquiry. "Philosophy is such knowledge of effects or appearances, as we acquire by true ratiocination from the knowledge we have first of their causes or generation. And again, (...) of such causes or generations as may be from knowing first their effects." Although this definition as such is quite peculiar and fraught with difficulties, the description of philosophy in terms of causal knowledge is in itself rather traditional. Hobbes himself admits that he follows the Aristotelian dictum scire est per causas scire. However, although Hobbes agrees with the Aristotelians that knowledge bears a causal character, he fundamentally disagrees with them as to "what he saw to be genuinely causative." Hobbes's doctrine of causes may be seen as a systematic attempt to discard the scholastic view on causality and replace it with strict mechanistic explanatory principles. Therefore, Hobbes's theory of causality can only be understood properly if we put it against its scholastic background, which is the line of interpretation followed in the present article. It will be made clear that Hobbes's relation to scholasticism is rather complex, ranging from downright rejection to the adoption of terminological distinctions as well as of specific arguments and doctrines. In recent years, the metaphysics of the young Leibniz has deservedly attracted a fair amount of scholarly attention. Among others, the collection of articles edited by Stuart Brown, Antognazza’s admirable book about Leibniz’ views on the relation between theology and philosophy and Philipp Beeley’s rich work on Leibniz’ physics have all significantly helped us understanding the complex mind of the young Leibniz. Nevertheless, no one has hitherto dared to face the huge task of giving a synthetic account of Leibniz’ metaphysics (...) in the period between 1661 and 1686, the year that Leibniz himself indicates as the start of his mature thought. With a courage nicely expressed by the rodeo yell of her book’s dedication, Mer cer plunges into the chaotic mass of notes, scribbles, letters and other materials of these years, especially of the pre-Hanover period, which fortunately are now all available in the Akademie Ausgabe. Mercer’s book is thus a reminder how important the painstaking philological work of the German editorial team actually is. Mercer’s work is the best possible proof that the thick Akademie volumes contain much more than just some moderately interesting additions to Leibniz’ known works. On the basis of an enormously diverse range of materials, Mercer offers a powerful image of the metaphysics of the young Leibniz that will doubtlessly affect our interpretation of the late and canonical Leibniz too. Since the Brexit Referendum in the United Kingdom and the election of Donald Trump as US President in 2016, the term ‘fake news’ has become a significant source of concern. Recently, the European Commission and the British House of Commons have condemned the phenomenon as a threat to their institutions’ democratic processes and values. However, political disinformation is nothing new, and empirical studies suggest that fake news has not decided crucial elections, that most readers do not believe the online fake (...) news stories they read, and that political polarization in Western democracies like the US began to increase long before online fake news existed. The question then is: how exactly does fake news threaten democracies? This paper argues that online fake news threatens democratic processes because it undermines citizens’ epistemic trust in each other. This in turn threatens to undermine the perceived legitimacy and the moral justification of democratic institutions as a whole. While online fake news is a symptom of a much larger issue (how has the Internet affected democracies, and how can we use its positive power while checking its negative effects?), it deserves particular attention given the potential danger it presents for the viability and the legitimacy of the democratic process. Immanuel Kant is recognized as one of the first philosophers who wrote systematically about global justice and world peace. In the current debate on global justice he is mostly appealed to by critics of extensive duties of global justice. However, I show in this paper that an analysis of Kant’s late work on rights and justice provides ample resources for disagreeing with those who take Kant to call for only modest changes in global politics. Kant’s comments in the Doctrine of (...) Right clarify that he thinks we need a coercively enforced global civil condition. But his work also contains ideas that imply that within such a global legal order there must be no extreme forms of poverty and inequality, and that the current holdings of states are by no means conclusive possessions without confirmation by the global legal order we have a duty to establish. Thus, this paper challenges the prevailing interpretation of Kant as a conservative thinker about global justice that is held, for instance, by the leading contemporary liberal thinkers such as John Rawls, Thomas Nagel, and Ronald Dworkin. In order to study “physics before Newton,” it is necessary to have at least a general idea what the terms ‘physics’ or ‘natural philosophy’ actually mean in a medieval and early modern context. Now, defining the medieval and early modern usage of the terms ‘physics’, ‘natural philosophy’, and their equivalents is no small beer. So far, the only scholar to have found the courage to embark upon this enterprise is Andrew Cunningham. He tries to make the case that natural philosophy (...) was an essentially “God oriented,” hence inherently theological discipline. Natural philosophy was “about God and His creation.” It did not promote knowledge of nature as a goal in itself, but as a means to acquire insight into God and His creation. According to Cunningham, this fundamentally religious agenda still dominated even Isaac Newton’s Principia Philosophiae Naturalis Mathematica, as is testified by passages such as the famous General Scholium to the second edition. In the contemporary philosophical literature, political legitimacy is often identified with a right to rule. However, this term is problematic. First, if we accept an interest theory of rights, it often remains unclear whose interests justify a right to rule : either the interest of the holders of this right to rule or the interests of those subject to the authority. And second, if we analyse the right to rule in terms of Wesley Hohfeld’s characterization of rights, we find disagreement (...) among philosophers about what constitutes the conceptual core of political authority: a power-right or a claim-right to rule. In this paper I show that both of these are problematic for a number of reasons. First, if we think that it is only the interests of the holders of a right to rule that justify the possession of authority, the conceptual core of authority must consist in a claim-right. However, this understanding of authority biases our thinking about legitimacy in favor of democratic exercises of power. Second, if we hold such a decisively democratic view of legitimacy, we confront an impasse with respect to addressing global collective action problems. Although it is clear that political authority is necessary or useful for solving these issues, it is doubtful that we can establish global institutions that are democratically authorized anytime soon. The paper suggests an alternative ‘Power-Right to Command View’ of political legitimacy that avoids the democratic bias and allows for thinking about solutions to global problems via global service authorities. A self-fulfilling prophecy in neuroprognostication occurs when a patient in coma is predicted to have a poor outcome, and life-sustaining treatment is withdrawn on the basis of that prediction, thus directly bringing about a poor outcome for that patient. In contrast to the predominant emphasis in the bioethics literature, we look beyond the moral issues raised by the possibility that an erroneous prediction might lead to the death of a patient who otherwise would have lived. Instead, we focus on the (...) problematic epistemic consequences of neuroprognostic SFPs in settings where research and practice intersect. When this sort of SFP occurs, the problem is that physicians and researchers are never in a position to notice whether their original prognosis was correct or incorrect, since the patient dies anyway. Thus, SFPs keep us from discerning false positives from true positives, inhibiting proper assessment of novel prognostic tests. This epistemic problem of SFPs thus impedes learning, but ethical obligations of patient care make it difficult to avoid SFPs. We then show how the impediment to catching false positive indicators of poor outcome distorts research on novel techniques for neuroprognostication, allowing biases to persist in prognostic tests. We finally highlight a particular risk that a precautionary bias towards early withdrawal of life-sustaining treatment may be amplified. We conclude with guidelines about how researchers can mitigate the epistemic problems of SFPs, to achieve more responsible innovation of neuroprognostication for patients in coma. (shrink)

This article advocates and explores a human rights method of ethics as a contribution to the process of moral decision-making. A human rights approach is richer than is often understood and can offer a practically relevant and emotionally well-grounded framework that is helpful for linking local situations and global concerns.

J’examine ce débat et conclus que les neurosciences n’ont pas de raisons méthodologiques, ontologiques ou théoriques convaincantes, pas plus que de raisons empiriques, pour rejeter la notion de libre arbitre. Parallèlement, je reconnais que la question est très controversée, à la fois en science et dans la société. Le problème se situe dans l’incompatibilité entre notions scientifiques du cerveau et notions pré-scientifiques de l’esprit. Par (...) conséquent, je propose d’envisager les relations esprit–cerveau sur une base empirique plus profonde et incontestée que l’on peut trouver dans la psychophysique. Je discute deux cas dans lesquels le contenu d’une expérience psychophysique, et sa dynamique, correspondent à la dynamique cérébrale. Dans un cas, la correspondance est une identité de type; dans l’autre, il s’agit d’une instanciation multiple : plusieurs types radicalement différents d’activités donnent lieu à la même dynamique perceptive. Ces deux exemples illustrent que, bien que l’identité des types soit possible, elle peut être souvent hautement contextualisée. Par conséquent, on doit appréhender les relations esprit–cerveau une par une plutôt que les fonder d’un seul bloc. (shrink)

Cees Leijenhorst’s essay is largely a response to two articles. The first is by Edwin Curley, I Durst not Write so Boldly or How to Read Hobbes’ Theological-Political Treatise, Scienza e Politica ed. by P. Bostreghi , 497-593. Leijenhorst goes through several of Curley’s arguments to show that the supposed atheism which is the logical outcome of Hobbes’s remarks, as read by Curley, in fact do not lead to that conclusion. The second article is Agostino Lupoli’s ‘Fluidismo’ e Corporeal (...) Deity nella Filosofia Naturale di Thomas Hobbes: A Proposito dell’hobbesiano ‘Dio delle Cause’, Rivista di Storia della Filosofia 54 n. s. : 573-610.) In broad agreement with Lupoli, Leijenhorst refines and somewhat revises the latter’s arguments to show greater consistency and continuity of thought in Hobbes. He concludes, There does not appear to exist any reason for doubting Hobbes’s sincerity with respect to his outspoken endorsement of the orthodox Christian creatio ex nihilo. (shrink)

Spirits and Clocks: Machine & Organism in Descartes. Ithaca, NY and London: Cornell University Press, 2001. Pp. xiii + 181. Cloth, $39.95. Confronted with the thousandth "entirely new" interpretation of the Cartesian mind-body union, one sometimes wonders whether anything new can in fact (...) be said about the great Descartes. Once again, after his invaluable and prize-winning Physiologia (Cornell University Press, 1996), Des Chene proves that a serious historian, with a keen awareness of historical context, actually can. Unlike the usual accounts of Descartes's animal-machine, Des Chene does not concentrate on the all too familiar set of questions whether or not machines can think, sense, etc. Instead, Des Chene interprets the machine-metaphor the way Descartes meant it to be, viz. as a model for explaining animal and human physiology instead of (cognitive) psychology. Des Chene's central claim is that the Traité de l'Homme and Descartes's later (unpublished) physiological tracts are an attempt to replace scholastic commentaries on Aristotle's De Anima, itself discussed in this book's companion volume Life's Forms (Cornell University Press, 2000). Spirits and Clocks investigates how Descartes's general mechanistic program (outlined in Physiologia) is applied to the field of animal and human life. This project in itself had a far more lasting influence than Descartes's specific and often bizarre physiological explanations. Therefore, Des Chene rightly concentrates on the philosophical aspects of Descartes's general project of "mechanizing" physiology. His short but illuminating book studies a wide range of ontological, epistemological, and even aesthetic aspects of the machine metaphor and, although this is not the express goal [End Page 122] of the book, it also sheds new light on the epistemology and metaphysics of the Meditations. In this sense Spirits and Clocks is not only a significant contribution to the history of biology but first and foremost a must for historians of philosophy.Des Chene explains that the use of a machine model in physiology was neither new nor entirely unacceptable to the Aristotelians. What is new is Descartes's use of it. His mechanistic understanding of the body as a machine is incompatible with accepting the soul as the source of life and the principle of all our physiological and psychological capacities, while Aristotelians had no problem in accepting both the soul and certain machine models of the body. (Aristotle himself uses the lever to explain animal motion.) Des Chene sketches Descartes's attempt to explain all physiological processes by means of the physical properties of material parts that obey the general laws of motion, excluding all talk of ends. In this context, the use of illustrations is of considerable importance: though they cannot per se convey a denial of a "soul-model" of physiology, they strongly suggest that the (mechanistically understood) machine is all there is to say about the functions of human and animal bodies. Des Chene offers an interesting, albeit sometimes somewhat speculative and ahistoric, discussion of the aesthetic aspects of the machine model.As Des Chene showed in his Physiologia, the rejection of teleology is one of the main goals of Descartes's physics. However, although Descartes may be successful in rejecting the view that stones fall down from some kind of desire to reach their final destiny, he is less successful in denying that the eye is meant for seeing (and hence for our self-preservation). Des Chene gives a truly fascinating account of the limits of Descartes's denial of teleology in physiology. This includes questions about the physical unity of the human body: how can I explain why I have this body and how can I even identify this body as a unit without invoking ends? Similarly, Descartes takes the healthy, "normally" functioning body as the norm of his investigations. But, again, can he do so without acknowledging some form of teleology? Building on her book, Forms Liberate, she seeks to bring Fuller’s legal theory into conversation with Arendt’s political theory. In this comment, I present some hesitations with regard to the fruitfulness of this conversation. This master thesis analyzes specific challenges concerning 'truth-telling' war reporters face when reporting on international conflict. For this purpose truth is examined in accordance with journalistic principles outlined in codes of ethics, with a focus on objectivity and fairness. The aim is to discover ways to improve the application of principles, in order to battle epistemic errors and the effects they entail: polarization, reductionism, and superficiality. The study concludes that providing context and nuance is crucial, but that codes - although (...) essential - are insufficient in helping journalists decide what is relevant and what is not. An approach in virtue ethics is recommended where phronesis (or practical wisdom) can inspire responsible journalists to comply with the spirit, rather than the letter of the principles. (shrink)

Although the concept of Responsible Innovation (RI) has been applied to different types of innovations, three common assumptions have remained the same. First, emerging technologies require assessment because of their radical novelty and unpredictability. Second, early assessment is necessary to impact the innovation trajectory. Third, anticipation of unknowns is needed to prepare for the unpredictable. I argue that these assumptions do not hold for liminal innovation practices in clinical settings, which are defined by continuous transition on both sides of the (...) threshold between experiment and implementation, and between research and care. First of all, technologies at the center of liminal innovation practices have different characteristics than those typically attributed to emerging technologies. Additionally, the innovation trajectory is significantly different allowing continuous assessment and shaping long after implementation. Finally, these differences demand a reorientation in RI approaches for these cases, away from anticipation of the unknown and uncertain, and returning to observation of the known and predictable. In this paper, we examine how organizations’ impression management evolves in response to rising stakeholder pressures regarding organizations’ corporate responsibility initiatives. We conducted a comparative case study analysis over a period of 13 years for two organizations—Exxon and BP—that took extreme initial stances on climate change. We found that as stakeholder pressures rose, their IM tactics unfolded in four phases: advocating the initial stance, sensegiving to clarify the initial stance, image repairing, and adjusting the stance. Taken together, our analysis of (...) IM over these four phases provides three key insights about the evolution of IM in the face of rising pressures. First, when faced with stakeholder pressures, it seems that organizations do not immediately resort to conforming but tend to give in gradually when pressures increase and start to come from relatively powerful stakeholders. Second, evolution of IM seems to be characterized by path dependence, i.e., even as organizations’ positions evolve, they continue to show their conviction in their initial positions and try to convey that their subsequent positions flow logically from the previous ones. Finally, IM involves navigation between symbolism and substance, and companies tend to strive toward harmonizing their symbolic and substantive actions as stakeholder pressure increases. (shrink)

The question whether distributive justice is at bottom practice-dependent or practice-independent has received much attention in recent years. I argue that the problem of intergenerational justice resolves this dispute in favor of practice-independence. Many believe that we owe more to our descendants than leaving them a world in which they can merely lead minimally decent lives. This thought is particularly convincing given the fact that it is us who determine to a significant extent what this future world will look like. (...) However, no practices that would trigger distributive obligations exist between distant generations. Thus, if we have to leave more than a minimum for future generations, we cannot conceive of distributive justice in terms of the justification of ongoing social interactions. Rather we have to think of the entire concept as an idea based on persons’ legitimate interests and capacity for well-being, and which abstracts from participation in particular practices. (shrink)

Hart's defense of the separation of law and morality is partly based on his refusal to accept Radbruch's solution of the well‐known grudge informer case, in his famous article “Statutory Injustice and Suprastatutory Law.” In this paper, I present a detailed reconstruction of the “debate” between Radbruch and Hart on this case. I reach the conclusion that Hart fails to address the issue that was Radbruch's primary concern, namely the legal position of the judiciary when dealing with criminal statutes. I (...) suggest that Hart's separation thesis cannot be upheld in the face of this concern. In my argument, Hart's mistaken understanding of the verdict of the Oberlandesgericht Bamberg that he refers to plays a crucial role. (shrink)

The typical outcome measure in infertility treatment is the (cumulative) healthy live birth rate per patient or per cycle. This means that those who end the treatment trajectory with a healthy baby in their arms are considered to be successful and those who do not are considered to have failed. In this article, we argue that by adopting the healthy live birth standard as the outcome measure that defines a successful fertility treatment, it becomes an interpretative self-fulfilling prophecy: those who (...) achieve the goal consider themselves successful and those who do not consider themselves failures. This is regardless of the fact that having children is only one out of many ways to alleviate the suffering related to infertility and that stopping fertility treatment can also be a positive decision to move on to other goals, rather than a form of “giving up,” “dropping out,” “nonadherence,” or failure. We suggest that those seeking fertility treatment would be served better by an alternative outcome measure, which can be equally self-fulfilling, according to which a successful treatment is one in which people leave the clinic released from the suffering that accompanied their status as infertile when they first entered the clinic. This new outcome measure still implies that walking out with a healthy baby is a positive outcome. What changes is that walking out without a baby can also be a positive outcome, rather than being marked exclusively as a failure. (shrink)

Since its formulation by Edmund Husserl, phenomenology has been regarded as a ‘method’. This is contested by Michel Henry, who speaks of the ‘question’ of phenomenology. This article traces Henry's objection to the classification of phenomenology as method, and considers both what he means by phenomenology being a question and what the answer to this question would be. To this end, the notions of ‘first givenness’ and ‘Life’ are explored, both of which are identified by Henry as being essential to (...) phenomenality. The single answer to the question of phenomenology is ‘first givenness’ or ‘Life’, as both are identical. Christianity speaks of God as Life, which is frequently referred to by Henry. The theological interest in this topic is therefore the question of whether God is, in the end, Henry's answer to the question of phenomenology. This article explores the way in which Henry cites from the Bible and expresses theological notions. It concludes that the Christian articulation of God as Life, and its approach to truth, are essentially phenomenological. Thus, for Henry, ‘God’ is not the answer to the question of phenomenology, rather the Christian notion of God as Life indicates the correct phenomenological answer. (shrink)

BackgroundNarrative reviews are the commonest type of articles in the medical literature. However, unlike systematic reviews and randomized controlled trials (RCT) articles, for which formal instruments exist to evaluate quality, there is currently no instrument available to assess the quality of narrative reviews. In response to this gap, we developed SANRA, the Scale for the Assessment of Narrative Review Articles.MethodsA team of three experienced journal editors modified or deleted items in an earlier SANRA version based on face validity, item-total correlations, (...) and reliability scores from previous tests. We deleted an item which addressed a manuscript’s writing and accessibility due to poor inter-rater reliability. The six items which form the revised scale are rated from 0 (low standard) to 2 (high standard) and cover the following topics: explanation of (1) the importance and (2) the aims of the review, (3) literature search and (4) referencing and presentation of (5) evidence level and (6) relevant endpoint data. For all items, we developed anchor definitions and examples to guide users in filling out the form. The revised scale was tested by the same editors (blinded to each other’s ratings) in a group of 30 consecutive non-systematic review manuscripts submitted to a general medical journal.ResultsRaters confirmed that completing the scale is feasible in everyday editorial work. The mean sum score across all 30 manuscripts was 6.0 out of 12 possible points (SD 2.6, range 1–12). Corrected item-total correlations ranged from 0.33 (item 3) to 0.58 (item 6), and Cronbach’s alpha was 0.68 (internal consistency). The intra-class correlation coefficient (average measure) was 0.77 [95% CI 0.57, 0.88] (inter-rater reliability). Raters often disagreed on items 1 and 4.ConclusionsSANRA’s feasibility, inter-rater reliability, homogeneity of items, and internal consistency are sufficient for a scale of six items. In editorial decision-making, SANRA may complement journal-specific evaluation of manuscripts—pertaining to, e.g., audience, originality or difficulty—and may contribute to improving the standard of non-systematic reviews. In, Kant defends a position that cannot be salvaged. The essay is nonetheless important because it helps us understand his philosophy of law and, more specifically, his interpretation of the social contract. Kant considers truthfulness a strict legal duty because it is the necessary condition for the juridical state. As attested by Kants arguments against the death penalty, not even the right to life has such strict unconditional status. Within the juridical state, established by the social contract, the innate right (...) to freedom is transformed into a bundle of merely positive rights, including the right to life. Understanding the reason for the rejection of thus helps us understand the, in a sense, character of Kant’s legal philosophy. In conclusion, some suggestions are made to bring his position closer to our common moral understanding. (shrink)

In the following ethnography of the California Coalition of Women Prisoners (CCWP), who exist at the forefront of feminist prison activism, I address canonical feminist debates focused on the relationship between subjectivity, experience, knowledge, and power by closely following an explicit attempt at political reform by and for women. I argue that feminist prison activists' attempts to reform the American prison system reveal why feminist theorists must remain committed to a specific, contextual, and localized analysis of the prospects for political (...) empowerment. We construct a model where every increasing ω-sequence of regular cardinals carries a mutually stationary sequence which is not tightly stationary, and show that this property is preserved under a class of Prikry-type forcings. Along the way, we give examples in the Cohen and Prikry models of ω-sequences of regular cardinals for which there is a non-tightly stationary sequence of stationary subsets consisting of cofinality ω_1 ordinals, and show that such stationary sequences are mutually stationary in the presence of interleaved (...) supercompact cardinals.
