Medical complicity in torture is prohibited by international law and codes of professional ethics. But in the many countries in which torture is common, doctors frequently are expected to assist unethical acts that they are unable to prevent. Sometimes these doctors face a dilemma: they are asked to provide diagnoses or treatments that respond to genuine health needs but that also make further torture more likely or more effective. The duty to avoid complicity in torture then comes into conflict with (...) the doctor’s duty to care for patients. Sometimes the right thing for a doctor to do requires complicity in torture. Whether this is the case depends on: the expected consequences of the doctor’s actions; the wishes of the patient; and the extent of the doctor’s complicity with wrongdoing. Medical associations can support physicians who face this dilemma while maintaining a commitment to clear principles denouncing torture. (shrink)

Clinical Ethics Committees (CECs), as distinct from Research Ethics Committees, were originally established with the aim of supporting healthcare professionals in managing controversial clinical ethical issues. However, it is still unclear whether they manage to accomplish this task and what is their impact on clinical practice. This systematic review aims to collect available assessments of CECs’ performance as reported in literature, in order to evaluate CECs’ effectiveness. We retrieved all literature published up to November 2019 in six databases (PubMed, Ovid (...) MEDLINE, Scopus, Philosopher’s Index, Embase and Web of Science), following PRISMA guidelines. We included only articles specifically addressing CECs and providing any form of CECs performance assessment. Twenty-nine articles were included. Ethics consultation was the most evaluated of CECs’ functions. We did not find standardized tools for measuring CECs’ efficacy, but 33% of studies considered “user satisfaction” as an indicator, with 94% of them reporting an average positive perception of CECs’ impact. Changes in patient treatment and a decrease of moral distress in health personnel were reported as additional outcomes of ethics consultation. The highly diverse ways by which CECs carry out their activities make CECs’ evaluation difficult. The adoption of shared criteria would be desirable to provide a reliable answer to the question about their effectiveness. Nonetheless, in general both users and providers consider CECs as helpful, relevant to their work, able to improve the quality of care. Their main function is ethics consultation, while less attention seems to be devoted to bioethics education and policy formation. (shrink)

Between the radical, creative capacity of our imagination and the social imaginary we are immersed in is an intermediate space philosophers have termed the imaginal, populated by images or (re)presentations that are presences in themselves. Offering a new, systematic understanding of the imaginal and its nexus with the political, Chiara Bottici brings fresh perspective to the formation of political and power relationships and the paradox of a world rich in imagery yet seemingly devoid of imagination. Bottici begins by defining (...) the difference between the imaginal and the imaginary, locating the imaginal's root meaning in the image and its ability to both characterize a public and establish a set of activities within that public. She identifies the imaginal's critical role in powering representative democracies and its amplification through globalization. She then addresses the troublesome increase in images now mediating politics and the transformation of politics into empty spectacle. The spectacularization of politics has led to its virtualization, Bottici observes, transforming images into processes with an uncertain relationship to reality, and, while new media has democratized the image in a global society of the spectacle, the cloned image no longer mediates politics but does the act for us. Bottici concludes with politics' current search for legitimacy through an invented ideal of tradition, a turn to religion, and the incorporation of human rights language. (shrink)

This essay explores Werner Hamacher’s suggestion that the realm of “philology” lies epékeina tes ousías. I suggest that for him “philology” is concerned with what, according to Plato, generates meaning without itself being generated, and that in his work this “beyond being” is often mediated in terms of caesura. After a brief engagement with a conversation of sorts between Hamacher and Jacques Derrida, in which the view of his “philology” as mostly derivative of Derrida’s work is rejected, the essay returns (...) to Hamacher’s discussion of caesura as what constitutes the very possibility of language. The final section focuses on Hamacher’s engagement with Walter Benjamin and Paul Celan and his suggestion that Dichtung (poetry) is the first philology. The essay concludes by arguing that Hamacher’s philology opens up new ways of thinking about thinking, as well as about the relationship between literature and philosophy. (shrink)

In contemporary science uncertainty is often represented as an intrinsic feature of natural and of human phenomena. As an example we need only think of two important conceptual revolutions that occurred in physics and logic during the first half of the twentieth century: (1) the discovery of Heisenberg’s uncertainty principle in quantum mechanics; (2) the emergence of many-valued logical reasoning, which gave rise to so-called ‘fuzzy thinking’. I discuss the possibility of applying the notions of uncertainty, developed in the framework (...) of quantum mechanics, quantum information and fuzzy logics, to some problems of political and social sciences. Friedrich Albert Lange is usually regarded as a representative of physiological neo-Kantianism or as a forerunner of the Marburg school of neo-Kantianism. Whereas “professional vision” has been mostly analyzed in apprenticeship and other settings where knowledge is made explicit or reflected upon, I focus on how expertise tacitly plays out in task-oriented interaction among practitioners. The paper considers orientation both to the coworker’s and one’s own expertise in the collaborative accomplishment of airport security work. I show how screeners recruit action from colleagues in largely underspecified ways, based on shared access to the visibility field and expected professional vision. Requesting is tacitly accomplished (...) via “highlighting,” which also accounts for one’s request. Accepting is silently achieved via locomotion, which also serves as a display of understanding. Embodied action is systematically preferred to verbal one. Talk is employed in larger proportions when the domain of scrutiny is not equally accessible to interactants, and when “face-work” is required. (shrink)

Introspection has traditionally been defined as a privileged way of obtaining beliefs about one’s occurrent mental states, and the idea that it is psychologically and epistemically different from non-introspective belief formation processes has been widely defended. At the same time, philosophers and cognitive scientists alike have pointed out the unreliability of introspective reports in consciousness research. In this paper, I will argue that this dissonance in the literature can be explained by differentiating between infallible and informative introspective beliefs. I will (...) argue that the latter are formed similarly to beliefs about the external world, and are therefore susceptible to similar success and failure conditions. Understanding introspection as belief-like will help to locate possible sources of error in regular as well as in pathological cases, carrying relevant implications for the relationship between experience, belief, and delusion. : Autonomous driving systems promise important changes for future of transport, primarily through the reduction of road accidents. However, ethical concerns, in particular, two central issues, will be key to their successful development. First, situations of risk that involve inevitable harm to passengers and/or bystanders, in which some individuals must be sacrificed for the benefit of others. Secondly, and identification responsible parties and liabilities in the event of an accident. Our work addresses the first of these ethical problems. We are (...) interested in investigating how humans respond to critical situations and what reactions they consider to be morally right or at least preferable to others. Our experimental approach relies on the trolley dilemma and knowledge gained from previous research on this. More specifically, our main purpose was to test the difference between what human drivers actually decide to do in an emergency situations whilst driving a realistic simulator and the moral choices they make when they pause to consider what they would do in the same situation and to better understand why these choices may differs. Inevitably, there are areas of disagreement and bones to pick. However, our primary concern in this reply will be to press, with their assistance, the more positive agenda.

After initially emerging in China, the coronavirus (COVID-19) outbreak has advanced rapidly. The World Health Organization (WHO) has recently declared it a pandemic, with Europe becoming its new epicentre. Italy has so far been the most severely hit European country and demand for critical care in the northern region currently exceeds its supply. This raises significant ethical concerns, among which is the allocation of scarce resources. Professionals are considering the prioritisation of patients most likely to survive over those with remote (...) chances, and this news has triggered an intense debate about the right of every individual to access healthcare. The proposed analysis suggests that the national emergency framework in which prioritisation criteria are currently enforced should not lead us to perceive scarce resources allocation as something new. From an ethical perspective, the novelty of the current emergency is not grounded in the devastating effects of scarce resources allocation, which is rife in recent and present clinical practice. Rather, it has to do with the extraordinarily high number of people who find themselves personally affected by the implications of scarce resources allocation and who suddenly realise that the principle of ‘equals should be treated equally’ may no longer be applicable. Along with the need to allocate appropriate additional financial resources to support the healthcare system, and thus to mitigate the scarcity of resources, the analysis insists on the relevance of a medical ethics perspective that does not place the burden of care and choice solely on physicians. In this book, originally published in 2007, Chiara Bottici argues for a philosophical understanding of political myth. Bottici demonstrates that myth is a process, one of continuous work on a basic narrative pattern that responds to a need for significance. Human beings need meaning in order to master the world they live in, but they also need significance in order to live in a world that is less indifferent to them. This is particularly true in the realm of politics. (...) Political myths are narratives through which we orient ourselves, and act and feel about our political world. Bottici shows that in order to come to terms with contemporary phenomena, such as the clash between civilizations, we need a Copernican revolution in political philosophy. Drawing on philosophy, law and political science, and on a wealth of practical experience delivering emergency medical services in conflict-ridden settings, Lepora and Goodin untangle the complexities surrounding compromise and complicity.

The article examines the ethics of musical interpretation, focusing on the performer’s responsibility in faithfully recreating a work from the score. Drawing inspiration from conductor Daniel Barenboim’s reflections (2016), it analyzes the delicate balance between personal expression and fidelity to the work, highlighting how interpretation involves not only technical skill but also moral responsibility. This notion develops through the importance attributed to history, authenticity, and the present in interpretation. These concepts are explored in the relationship between the score and the (...) performer, addressing the ethical challenges involved in balancing fidelity and creativity. The study of Historically Informed Performance (HIP) demonstrates how it serves as the foundation of the ethics of musical interpretation, due to its attempt to recreate the original conditions of performances. However, it is also noted that HIP embodies an overly rigid fidelity, thus requiring a more balanced approach that views musical practice as an ongoing dialogue between past and present. Finally, since the rules of musical practice are not enough for performers to interpret ethically, as they need to be internalized, the role of Aristotelian phronesis is explored as an internal guide for performers in interpretative practice. Phronesis aids the performer in mediating between past and present and in making interpretative decisions that are both ethically and musically appropriate. (shrink)

I argue that an agent can be appropriately blamed for failing to assist someone in need, even if her failure to assist is not wrong, and that an agent can be morally required to assist even if assisting is overly costly for her—more costly than what the relevant moral baseline is ordinarily taken to allow. Whether this is the case depends on whether the agent has previously failed to discharge her “prospective duties.” Once these duties are taken into consideration, even (...) apparently moderate accounts of beneficence appear to be not very moderate after all. In light of recent developments that have occurred in the domestic sector in Europe and the debate on the externalisation of domestic and care activities, this article explores the impact of the gender regime on paid domestic work. The gender regime is defined here as the combination of two dimensions: gender equality outcomes and the ‘gender contract’. The aim is to investigate whether the gender regime can contribute to explaining cross-national similarities and differences, in terms of the size of the (...) domestic sector, its workforce composition—with a focus on the proportion of women and migrants—and its working conditions. The article shows the results of quantitative analyses conducted at the European level, which include the construction of a typology of gender regimes, based on selected indicators, and a descriptive comparative analysis of the domestic sector at national level, based on data from the 2015 European Union Labour Force Survey (EU-LFS). The findings suggest that the use of this typology of gender regimes can be a useful tool to explain cross-European differences in the domestic sector, but only regarding the size of the sector and the feminisation of the workforce. Concerning the proportion of migrants and working conditions in the domestic sector, no clear pattern emerges that can explain cross-national differences based on this typology. (shrink)

Parent-teacher conferences (PTCs) are important institutional encounters to promote a constructive dialogue and alliance between the school and the family system. However, cooperation between parents and institutional actors is not always straightforward, especially in the case of foreign parents. Because of the unequal familiarity of the latter with the institutional frameworks and language resources needed to participate effectively in PTCs, foreign parents risk having less communicative resources to rely on in the joint construction of the interaction. In this paper we (...) focus on eight PTCs with foreign parents, paying attention to occurrences where children's learning difficulties are linked by teachers to their language skills. Using a conversation analysis framework, we will observe how language issues are intertwined with cultural, identity, and moral aspects that need special attention in order to enhance and support the effective construction of educational alliances between schools and families. This article seeks to extend existing models of argumentation by considering an important dimension of real-life argumentative discourse: how complex argumentative discussions evolve over time. We define a complex argumentative discussion as a multi-issue discussion, in which the different issues are interrelated in the form of a hierarchy. We claim that justified reframing might be used to transform a single-issue argumentative discussion into a complex argumentative discussion. To illustrate this, we examine the Facebook discourse of the Rhodes Must Fall movement (...) in South Africa. We analyse how reframing is justified by means of arguments, allowing the protagonists to claim as legitimate their reframing of a single issue into a complex argumentative discussion. Our findings complement existing sociological research on social movements by highlighting how their goals are achieved by means of argumentative discourse. (shrink)

This study offers a new interpretation of the poem of the founder of Western philosophy: Parmenides. It shows that there is more in his poem than the description of Being by means of negative adjectives such as ingenerated and immobile. His words ask his audience to question their habits, to modify their goals, to engage in new enterprises and to look with a critical eye at their previous attempts to get knowledge. It operates as a travel guide that leads the (...) audience on a journey that will educate them and help them to gradually become philosophically mature, to become true themselves, which can also be described as the encouragement to become Being. The exponential accumulation, processing and accrual of big data in healthcare are only possible through an equally rapidly evolving field of big data analytics. The latter offers the capacity to rationalize, understand and use big data to serve many different purposes, from improved services modelling to prediction of treatment outcomes, to greater patient and disease stratification. In the area of infectious diseases, the application of big data analytics has introduced a number of changes in the information accumulation models. These are (...) discussed by comparing the traditional and new models of data accumulation. Big data analytics is fast becoming a crucial component for the modelling of transmission—aiding infection control measures and policies—emergency response analyses required during local or international outbreaks. However, the application of big data analytics in infectious diseases is coupled with a number of ethical impacts. Four key areas are discussed in this paper: automation and algorithmic reliance impacting freedom of choice, big data analytics complexity impacting informed consent, reliance on profiling impacting individual and group identities and justice/fair access and increased surveillance and population intervention capabilities impacting behavioural norms and practices. Furthermore, the extension of big data analytics to include information derived from personal devices, such as mobile phones and wearables as part of infectious disease frameworks in the near future and their potential ethical impacts are discussed. Considered together, the need for a constructive and transparent inclusion of ethical questioning in this rapidly evolving field becomes an increasing necessity in order to provide a moral foundation for the societal acceptance and responsible development of the technological advancement. What are the most detailed descriptions under which subjects intend to perform bodily actions? According to Pacherie (2006), these descriptions may be found by looking into motor representations—action representations in the brain that determine the movements to be performed. Specifically, for any motor representation guiding an action, its subject has an M‐intention representing that action in as much detail. I show that some M‐intentions breach the constraints that intentions should meet. Disagreement among philosophers over the proper justification for political institutions is far from a new phenomenon. Thus, it should not come as a surprise that there is substantial room for dissent on this matter within democratic theory. As is well known, instrumentalism and proceduralism represent the two primary viewpoints that democrats can adopt to vindicate democratic legitimacy. While the former notoriously derives the value of democracy from its outcomes, the latter claims that a democratic decision-making process is inherently valuable. This (...) article has two aims. First, it introduces three variables with which we can thoroughly categorise the aforementioned approaches. Second, it argues that the more promising version of proceduralism is extrinsic, rather than intrinsic, and that extrinsically procedural accounts can appeal to other values in the justification of democracy without translating into instrumentalism. This article is organised as follows. I present what I consider to be the ‘implicit view’ in the justification of democracy. Then, I analyse each of the three variables in a different section. Finally, I raise an objection against procedural views grounded in relational equality, which cannot account for the idea that democracy is a necessary condition for political legitimacy. (shrink)

The present paper focuses on a specific aspect of Michel Foucault’s interest in literature, addressing his study on the French poet and novelist Raymond Roussel. Published only few days before The Birth of the Clinic: An Archaeology of Medical Perception (1963), Death and the Labyrinth (1963) provides a philosophical reading of some Roussel’s writings, in a constant confrontation with the posthumous essay How I Wrote Certain of My Books (1935) in which Roussel explains his peculiar process of composition. Here, I (...) propose considering that Death and the Labyrinth offers not only a critical account on the relationship between philosophy and literature, but it also displays the significance of philosophy towards the study of literature. From this perspective, I will mainly focus on three themes – the death of the language; the repetition of the language; the duality of the language –, showing also that the first source of the Foucauldian further interest on the relationship between “words” and “things” has been Roussel’s oeuvre. Why government outsourcing of public powers is making us less free Many governmental functions today—from the management of prisons and welfare offices to warfare and financial regulation—are outsourced to private entities. Education and health care are funded in part through private philanthropy rather than taxation. Can a privatized government rule legitimately? The Privatized State argues that it cannot. In this boldly provocative book, Chiara Cordelli argues that privatization constitutes a regression to a precivil condition—what philosophers centuries ago called "a (...) state of nature." Developing a compelling case for the democratic state and its administrative apparatus, she shows how privatization reproduces the very same defects that Enlightenment thinkers attributed to the precivil condition, and which only properly constituted political institutions can overcome—defects such as provisional justice, undue dependence, and unfreedom. Cordelli advocates for constitutional limits on privatization and a more democratic system of public administration, and lays out the central responsibilities of private actors in contexts where governance is already extensively privatized. Charting a way forward, she presents a new conceptual account of political representation and novel philosophical theories of democratic authority and legitimate lawmaking. The Privatized State shows how privatization undermines the very reason political institutions exist in the first place, and advocates for a new way of administering public affairs that is more democratic and just. This paper focuses on a specific aspect of political imaginaries: political myth. What are political myths? What role do they play within today commoditised political imaginaries? What are the conditions for setting up a critique of them? We will address these questions, by putting forward a theory of political myth which situates itself between psychoanalysis and political philosophy, in line with the tradition of critical theory that many still associate with the name of the Frankfurt School. We will first discuss (...) the notion of political myth by illustrating the contribution of both disciplines to its understanding and then, through a discussion of the notion of social unconscious, we will apply this analysis to a contemporary example of political myth, that of a clash of civilisations. What happens to women who are denied abortions? Abortion is a very controversial issue, and there are many attemps to restrain or ban safe and legal access to it. A few studies claim to demonstrate a connection between abortion and mental - and even physical - health. Politicians and pro-lifers use this kind of misleading arguments to justify unfair limitations to abortion access. Not many people ask themselves what happens to those women who would want to get an abortion but (...) are turned away. The Turnaways Study is the first study on the consequences of denied abortions. This paper focuses on the presumed existence of two versions of Medea and Heracles in the Euripidean corpus that circulated in antiquity. After a brief review of the main papyrological evidence, namely P.Oxy. LXXVI 5093 for the Medea and P.Hibeh II 179 for the Heracles, I discuss the implications of adding another Medea and another Heracles to the Euripidean corpus in the light of the extant ancient testimonies on the number of works in Euripides’ oeuvre. Moreover, I examine the clues (...) provided by the headings of the hypotheses of the extant Medea and the extant Heracles as preserved in P.IFAO inv. PSP 248 and P.Oxy. LXXXI 5284. On these grounds, I argue that the supposed evidence for the existence of two distinct Medea and two distinct Heracles plays should not be interpreted as evidence of double authorial versions.
