The purpose of this paper is to present a new argument against so-called fitting attitude analyses of intrinsic value, according to which, roughly, for something to be intrinsically good is for there to be reasons to want it for its own sake. The argument is indirect. First, I submit that advocates of a fitting-attitude analysis of value should, for the sake of theoretical unity, also endorse a fitting-attitude analysis of a closely related but distinct concept: the concept of intrinsic value (...) for a person, i.e., the concept of welfare. Then I argue directly against fitting-attitude analyses of welfare. This argument, which is the focus of the paper, is based on the idea that whereas whether an event is good or bad for a person doesn’t change over time, the attitudes there is reason to have towards such an event can change over time. Therefore, one cannot explain the former in terms of the latter, as fitting-attitude analyses of welfare attempt to do. (shrink)

This paper seeks to apply some of the tools of analytic philosophy to a text written by a 'continental' philosopher, in order to evaluate the quality of its arguments. In 'On Forgiveness', Jacques Derrida seems to be making two different claims about forgiveness. First, he claims that an act of forgiveness is only truly meaningful as forgiveness when one is forgiving the unforgivable. Second, he is also recommending that we change our understanding of the concept of forgiveness for ethical reasons. (...) I examine three lines of argument used in the essay to support the first claim. I find each of these lines of argument problematic. Since these arguments are unconvincing, I argue that this leaves only the second claim for Derrida to defend. (shrink)

Evangelical Christian development organizations have long realized that mission effectiveness is largely contingent on the skills and abilities possessed by their human capital. A crucial way to create that human capital is through development-oriented academic programs, especially those focused on developing skills required by grassroots personnel and their support organizations. A review of Eastern University's MBA in economic development, celebrating its 25th anniversary, provides six conclusions and recommendations for implementing and assessing effective NGO management educational programs.

This paper proposes that the meanings of some natural language expressions should be thought of as functions on their own continuations. Continuations are a well-established analytic tool in the theory of programming language semantics; in brief, a continuation is the entire default future of a computation. I show how a continuation-based grammar can unify several aspects of natural language quantification in a new way: merely stating the truth conditions for quantificational expressions in terms of continuations automatically accounts for scope displacement (...) and scope ambiguity. To prove this claim, I exhibit a simple finite context-free grammar with a strictly compositional semantics in which quantificational NPs are interpreted in situ but take semantic scope over larger constituents. There is no Quantifier Raising (nor any use of a level of Logical Form distinct from overt syntax), no Cooper Storage (or similar mechanisms used in many recent HPSG, Categorial, or Type-logical treatments), and no need for type-shifting (as in Hendriks' Flexible Types account). Continuations also provide a natural account of generalized coordination that does not require either type-shifting or type polymorphism. Compositionality issues are discussed in some detail. Recent neo-Humean theories of laws of nature have placed substantial emphasis on the characteristic epistemic roles played by laws in scientific practice. In particular, these theories seek to understand laws in terms of their optimal predictive utility to creatures in our epistemic situation. In contrast to other approaches, this view has the distinct advantage that it is able to account for a number of pervasive features possessed by putative actual laws of nature. However, it also faces some unique challenges. First, (...) since the view tries to characterize the laws in terms of their predictive utility, any respects in which putative actual laws are sub-optimally predictively useful are inherently problematic. Such "predictive infelicities" can easily be found among our best physical theories. Second, in tying the laws to our epistemic situation, neo-Humeanism raises the possibility that by changing our epistemic situation, we can change the laws themselves, though it is hard to believe that we have such influence over the laws. This paper aims to address both of these challenges, first by presenting a variety of strategies for explaining away predictive infelicities, and then by developing a version of Lewis's "rigidification" strategy to preclude the possibility of our changing the laws. Jonathan Westphal's recent paper attempts to reconcile the view that propositions about the future can be true or false now with the idea that the future cannot now be real. I attempt to show that Westphal's proposal is either unoriginal or unsatisfying. It is unoriginal if it is just the well-known eternalist solution. It is unsatisfying if it is instead making use of a peculiar, tensed truthmaking principle.

A typical theorem of conaexive logics is Aristotle''s Thesis(A), (AA).A cannot be added to classical logic without producing a trivial (Post-inconsistent) logic, so connexive logics typically give up one or more of the classical properties of conjunction, e.g.(A & B)A, and are thereby able to achieve not only nontriviality, but also (negation) consistency. To date, semantical modellings forA have been unintuitive. One task of this paper is to give a more intuitive modelling forA in consistent logics. In addition, while inconsistent (...) but nontrivial theories, and inconsistent nontrivial logics employing prepositional constants (for which the rule of uniform substitution US fails), have both been studied extensively within the paraconsistent programme, inconsistent nontrivial logics (closed under US) do not seem to have been. This paper gives sufficient conditions for a logic containingA to be inconsistent, and then shows that there is a class of inconsistent nontrivial logics all containingA. A second semantical modelling forA in such logics is given. Finally, some informal remarks about the kind of modellingA seems to require are made. (shrink)

Overgeneralizations by psychologists of the research evidence on memory and eyewitness testimony, such as “memory decays with time” or “memories are fluid and malleable,” are beginning to appear in legal judgements and guidance documents, accompanied by unwarranted disparagement of lay beliefs about memory. These overgeneralizations could have significant adverse consequences for the conduct of civil and criminal law.

By reflecting upon ordinary morality, Aurel Kolnai observed that the constituents of human life are already valued pre-morally. Asking himself how morality could be understood against this background, Kolnai implicitly reflected about the question what makes us moral. By developing a neo-Kolnaian conception of ordinary morality and by making use of the phenomenological method, I argue that man’s moral consciousness is built on the foundation of primordial positive values but that it takes on its proper negative and emphatic character only (...) in the face of aggressive threat to those values. Ethical phenomenology, then, reveals that morality concerns the preservation, protection and improvement of this valuable mode of life. We emphatically experience the valuable when it is in need of protection. This also explains the primarily imperative or negative character of morality. Likewise, moral rules and principles primarily express the concern not to break or transgress them and this precisely because they say to uphold and thereby protect the existing good. Additionally, vice and virtue suitably fall within this view. As morality is about what we do and refrain from doing, thus about our actions and conduct, it is also about our moral character. Repeated compliance with the existing good results in the ascription of virtue, repeated noncompliance in vice. Thus, I argue, in the spirit of Kolnai, that ordinary morality should be, and earns to be, taken much more seriously and less sceptically. In particular, a phenomenology that tries to describe and learn from morality as it is, has much more to offer than is claimed by contemporary moral philosophy, all too often disregarding phenomenology and the search for relevant descriptions of ethical phenomena. In this article I assess the ability of motivational accounts of paternalism to respond to a particular challenge: can its proponents adequately explain the source of the distinctive form of disrespect that animates this view? In particular I examine the recent argument put forward by Jonathan Quong that we can explain the presumptive wrong of paternalism by relying on a Rawlsian account of moral status. I challenge the plausibility of Quong's argument, claiming that although this approach can provide a clear (...) response to the explanatory challenge, it is only successful in doing so when it relies on the strength of its rival: the argument from personal autonomy. In doing so I illustrate that such responses are conceptually dependent on an account of respect for persons, and thus much of the relevant controversy is actually disagreement over how we respect other individuals. What and how should individuals resist in political situations? While this question, or versions of it, recurs regularly within Western political philosophy, answers to it have often relied on dyads founded upon dogmatically held ideals. In particular, there is a strain of idealist political philosophy, inaugurated by Plato and finding contemporary expression in the work of Alain Badiou, that employs dyads (such as the distinction between truth and doxa or the privilege of thought over sense) that tend to reduce the (...) complexities of practices of resistance to concepts of commitment. Although these dyads have been challenged by, amongst others, poststructuralist theorists, this has often been at the cost of losing their structuralist heritage. This thesis develops an ontology proper to structuralism that engenders non-idealist and non-dogmatic, yet ethical, practices of resistance against commitment orientated accounts of resistance and the return of classical ontological dyads. The thesis begins with an examination of the extent to which a dogmatic use of idealism grounds the work of a prominent contemporary theorist, Alain Badiou. In developing his neo-Maoist metapolitics, Badiou follows both Platonic ontology and the Marxist tradition of dialectics by claiming that political practice can only be carried out in truth by paying fidelity to an event that ruptures the presented order of things. Chapter one opens with an exploration of Badiou's mathematic meta-ontology to draw out its three foundational dyads (truth/doxa; sense/intelligibility; is/is not). It is argued that although Badiou makes important criticisms of the preponderant trends of political philosophy, he is unable to support his own account of politics due to his dogmatic reliance on idealist principles. Chapter two begins by developing two accounts: first, of the relations between Badiou's work and that of his former teacher Louis Althusser and, secondly, the relations between Althusser's thought and that of Gilles Deleuze, in particular his reading of David Hume. Discussion centres around the importance of the role that time plays within the works of all three authors, particularly in regard to the idea of the void. The chapter concludes with the argument that Hume's temporal idea of human nature is the key to a symptomatic reading of Althusser that accounts for the persistence of ideas in the latter's social theory. In chapter three, Deleuze's reading of Hume's idea of relations is developed to take into account Bergson's theory of time. Read in contrast to Quentin Meillassoux's speculative realism, the chapter argues that Deleuze's account of temporal relations informs Althusser's social theory to create the ontological grounds for non-dogmatic and non-idealist practices of resistance. These practices are developed in chapter four with an unlikely turn to John Stuart Mill's idea of genius, the metaphysical property of the individual that signifies the discovery of new truth. The chapter begins with an argument that there is an under-developed account of ethics in Deleuze's work. Distinguishing the idea of genius from both Mill's moral philosophy, as well as from utilitarian thought more generally, the idea of genius is sutured onto Deleuze's ontological account of individuation. Read alongside Althusser's social theory, which accounts for the non-idealist conceptualisation of situations, this suture creates an ethically oriented structuralist ontology. The thesis concludes with the argument that the idea of genius is the ethical imperative that motivates practices of resistance. When individuals are understood as embodied within situations, practices of resistance are conceptualised not against other components of a situation, but contra them, taking them into account in order to amplify, multiply and transform the individual's potential within a situation. When the Radical Reformers demanded the separation of church and state, it was not to privatize their convictions or depoliticize the church, but rather an attempt to recognize Jesus as Lord over all. The theological movement known as Radical Orthodoxy is currently rethinking theology's influence by secular modernity, thereby making a bold critique of contemporary Christianity. In the light of requests from certain civil organisations in the Western Cape to the provincial government to establish a judicial commission of inquiry into child killings in this province because of the high incidence of killings, a research committee from three WC universities was put together to review existing research into this matter to determine a way forward. This committee looked at primary drivers of child murders in the WC, gaps in existing government services, the potential value of instigating (...) a commission of inquiry or some other mechanism, and recommending a way forward. A summary of its findings was presented to, among others, the provincial cabinet that adopted all its recommendations. Reflection on these final findings and recommendations forms the first part of the article. The second part focuses in more detail on the research data presented by experts and practitioners who informed the research committee. Important aspects discussed here are child death reviews, age- and sex-specific rates of child homicides, sexual killings of children, the possible influence of unfortunate, traumatic childhood experiences in becoming a violent adult, physical violence against children, children’s perception of their safety and risk factors for children specifically in the WC. The purpose of this article is to provide well-researched information to role-players and decision-makers regarding the lives of children to address the violence and its causes that so many children are exposed to. Although the focus is on the dire situation in the WC, the broader South African and international contexts will also be brought into play in the second part of the article in a way that will be helpful with regard to the crises and challenges the WC is struggling with in this respect. Over the first decades of the twentieth century, the fragmentary remains of a huge prehistoric ungulate were unearthed in scientific expeditions in India, Turkestan and Mongolia. Following channels of formal and informal empire, these were transported to collections in Britain, Russia and the United States. While striking and of immense size, the bones proved extremely difficult to interpret. Alternately naming the creature Paraceratherium, Baluchitherium and Indricotherium, paleontologists Clive Forster-Cooper, Alexei Borissiak and Henry Fairfield Osborn struggled over the reconstruction of this (...) gigantic fossil mammal. However, despite these problems, shared work on the creature served as a focus for collaboration and exchange rather than rivalry between these three scientific communities. Not only did the initial interpretation and analysis depend on pre-existing connections between British and American paleontological institutions, but the need for comparative material, recognition and contacts brought British and American scholars into communication and exchange with their counterparts in the Soviet Union. This article examines these processes. It first uses these excavations as a comparative case-study of different manifestations of colonial science in this period, examining how scholars in the Britain, the Russian Empire and the United States used formal and informal colonial links to Asia to pursue new research. It then moves to examine how the common problem of reconstructing this giant animal drew metropolitan scientific communities together, at least for a time. The construction of the Baluchitherium and Indricotherium illustrates the drives to expand research both imperially and internationally in the early-twentieth century, but also the continual problems in resources, institutionalization, transport and communication that could run up against scientific work. Tragic choices arise during the COVID-19 pandemic when the limited resources made available in acute medical settings cannot be accessed by all patients who need them. In these circumstances, healthcare rationing is unavoidable. It is important in any healthcare rationing process that the interests of the community are recognised, and that decision-making upholds these interests through a fair and consistent process of decision-making. Responding to recent calls (1) to safeguard individuals’ legal rights in decision-making in intensive care, and (2) for (...) new authoritative national guidance for decision-making, this paper seeks to clarify what consistency and fairness demand in healthcare rationing during the COVID-19 pandemic, from both a legal and ethical standpoint. The paper begins with a brief review of UK law concerning healthcare resource allocation, considering how community interests and individual rights have been marshalled in judicial deliberation about the use of limited health resources within the National Health Service (NHS). It is then argued that an important distinction needs to be drawn between procedural and outcome consistency, and that a procedurally consistent decision-making process ought to be favoured. Congruent with the position that UK courts have adopted for resource allocation decision-making in the NHS more generally, specific requirements for a procedural framework and substantive triage criteria to be applied within that framework during the COVID-19 pandemic are considered in detail. Popper's definition looked initially promising provided that the restriction of classical logic was removed. As we have seen, this promise is not fulfilled. The search for a satisfactory verisimilitude ordering must therefore be pursued along more mainstream lines. The present exercise ought, however, to make us aware of the possibility that breakdowns of proposed definitions might only occur because of strictly classical assumptions.

In this article we address the question of how many impossible images Escher produced. To answer requires us first to clarify a range of concepts, including content, ambiguity, illusion, and impossibility. We then consider, and reject, several candidates for impossibility before settling on an answer.

‘Deliberate self-harm’, ‘self-mutilation’ and ‘self-injury’ are just some of the terms used to describe one of the most prominent issues in British mental health policy in recent years. This article demonstrates that contemporary literature on ‘self-harm’ produces this phenomenon (to varying extents) around two key characteristics. First, this behaviour is predominantly performed by those identified as female. Second, this behaviour primarily involves cutting the skin. These constitutive characteristics are traced back to a corpus of literature produced in the 1960s and (...) 1970s in North American psychiatric inpatient institutions; analysis shows how pre-1960 works were substantially different. Finally, these gendered and behavioural assertions are shown to be the result of historically specific processes of exclusion and emphasis. (shrink)

‘Organisational failure’ is central to medical ethics. In the National Health Service (NHS), we usually examine failures at hospital level. We have had around 100 hospital inquiries since the first in 1969, into Ely Hospital, Cardiff. This year, we had the Ockenden Report into Shrewsbury and Telford Hospital. Last year, we had the Outram Inquiry into West Suffolk Hospital. In 2020, the James Inquiry into Ian Paterson. And, before that, Morecombe Bay, Gosport War Memorial, Mid Staffordshire, Liverpool Community Health, Winterbourne (...) View, Anthony Ledward, Stoke Mandeville, Bristol Royal Infirmary and so on. As Taylor says, these reports teach us clinical failure usually has an institutional setting and that blaming individuals overlooks working ‘culture’. They have also led to: (a) new regulatory bodies to manage, investigate and improve NHS standards, (b) new codes of conduct to mandate reporting of serious accidents—backed up by the Whistle-blower’s Act and explicit statutory duties of disclosure, (c) root cause analysis to encourage consistent investigations so we can learn from reliable data and (d) new ‘Speaking Up Guardians’ and a Patient Safety Commissioner to encourage informal discussion about patient safety. This paper offers an inconsistent model of motion perception. It was prompted by work on inconsistent motion due to Hegel and, following him, Priest. But the paper skirts Hegel's full scale idealism, by proposing that the inconsistency is with the cognitive contents of motion perception. The paper draws on work in the psychology of perception, and in the theory of inconsistency. I begin by noting the prima facie argument that temporal change threatens inconsistency, and canvassing ways in which this might (...) be avoided. The orthodox reply to the prima facie argument is that one and the same thing can have different incompatible properties at different times. This is plausible when applied to motion in the physical world. However, applied to cognition, it can be seen that the phenomenon of phi or beta, combined with the mechanism of a Reichardt detector, lends support to one key step in the prima facie argument, namely re-identification over time. The inconsistency of the model is then seen to follow from application of the Fade Principle. Advantages of the model are stressed: including a simple explanation of the debilitating condition of akinetopsia, that is, motion blindness; and a suggestion as to how to account for the “moving now.”. The biodiversity crisis should be a key issue within debates on global justice – but to date it has not been. This article aims to provide a stimulus to further engagement. First, it provides a brief introduction to the notion of a biodiversity crisis, and to its origins. Second, it distinguishes our various reasons for caring about the crisis. Third, it shows why the biodiversity crisis raises important – albeit hitherto neglected – issues of global justice. Fourth, it sketches some (...) of the most important questions scholars of global justice should be in a position to engage with, in order to move the debate forwards and help ensure that collective political responses to the crisis are just ones. Mobile phone-based applications (apps) can promote faster targeted actions to control COVID-19. However, digital contact tracing systems raise concerns about data security, system effectiveness, and their potential to normalise privacy-invasive surveillance technologies. In the absence of mandates, public uptake depends on the acceptability and perceived legitimacy of using technologies that log interactions between individuals to build public health capacity. We report on six online deliberative workshops convened in New South Wales to consider the appropriateness of using the COVIDSafe app to (...) enhance Australian contact tracing systems. All groups took the position (by majority) that the protections enacted in the app design and supporting legislation were appropriate. This support is contingent on several system attributes including: the voluntariness of the COVIDSafe app; that the system relies on proximity rather than location tracking; and, that data access is restricted to local public health practitioners undertaking contact tracing. Despite sustained scepticism in media coverage, there was an underlying willingness to trust Australian governing institutions such that in principle acceptance of the new contact tracing technology was easy to obtain. However, tensions between the need to prove system effectiveness through operational transparency and requirements for privacy protections could be limiting public uptake. Our study shows that informed citizens are willing to trade their privacy for common goods such as COVID-19 suppression. But low case numbers and cautionary public discourses can make trustworthiness difficult to establish because some will only do so when it can be demonstrated that the benefits justify the costs to individuals. Generalization does not come from repeatedly observing phenomena in numerous settings, but from theories explaining what is general in those phenomena. Expecting future behavior to look like past observations is especially problematic in psychology, where behaviors change when people's knowledge changes. Psychology should thus focus on theories of people's capacity to create and apply new representations of their environments.

We are witnessing a new space race. A half century after the last Moon landing, and after a decade during which the United States could not launch its own astronauts to Earth orbit, there is new energy in the space activity. China has huge ambitions to rival or eclipse America as the major space power, and other countries are developing space programs. However, perhaps the greatest excitement attaches to the entrepreneurs who are trying to create a new business model for (...) space travel based initially on tourism, and eventually, on colonizing the Moon and Mars and harvesting resources from asteroids. This paper presents a snapshot of the new space race and the rich men behind it, and it looks at some of the ethical and legal issues raised by this activity. The methodology is to consider the stated ambitions of the men leading private space companies, compare and contrast the space endeavor with earlier episodes of exploration and transportation innovation, review the regulatory environment for outer space, and consider two divergent scenarios for the future. Opinions are divided on whether commercial space flight is an expensive indulgence or potentially a way to find sustainability solutions for our life on Earth. It is concluded that the new space race can be characterized as unbounded: in ambition, in terms of laws and regulations, and in terms of ethical constraints on the activity. (shrink)
