Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Er sollte in der kommenden Legislaturperiode ein umfassendes Fortpflanzungsmedizingesetz schaffen. (shrink)

Ethical approval must be obtained before medical research can start. We describe the differences in EA for an pseudonymous, non-interventional, observational European study. Sixteen European national coordinators of the international study on very old intensive care patients answered an online questionnaire concerning their experience getting EA. N = 8/16 of the NCs could apply at one single national ethical committee, while the others had to apply to various regional ECs and/or individual hospital institutional research boards. The time between applying for (...) EA and the first decision varied between 7 days and 300 days. In 9/16 informed consent from the patient was not deemed necessary; in 7/16 informed consent was required from the patient or relatives. The upload of coded data to a central database required additional information in 14/16. In 4/16 the NCs had to ask separate approval to keep a subject identification code list to de-pseudonymize the patients if questions would occur. Only 2/16 of the NCs agreed that informed consent was necessary for this observational study. Overall, 6/16 of the NCs were satisfied with the entire process and 8/16 were unsatisfied. 11/16 would welcome a European central EC that would judge observational studies for all European countries. Variations in the process and prolonged time needed to get EA for observational studies hampers inclusion of patients in some European countries. This might have a negative influence on the external validity. Further harmonization of ethical approval process across Europe is welcomed for low-risk observational studies. Emergence of the novel pathogenic coronavirus SARS‐CoV‐2 and its rapid pandemic spread presents challenges that demand immediate attention. Here, we describe the development of a semi‐quantitative high‐content microscopy‐based assay for detection of three major classes (IgG, IgA, and IgM) of SARS‐CoV‐2 specific antibodies in human samples. The possibility to detect antibodies against the entire viral proteome together with a robust semi‐automated image analysis workflow resulted in specific, sensitive and unbiased assay that complements the portfolio of SARS‐CoV‐2 serological assays. Sensitive, specific (...) and quantitative serological assays are urgently needed for a better understanding of humoral immune response against the virus as a basis for developing public health strategies to control viral spread. The procedure described here has been used for clinical studies and provides a general framework for the application of quantitative high‐throughput microscopy to rapidly develop serological assays for emerging virus infections. Opposition to physician-assisted suicide is widespread in Christian ethics. However, on a topic as controversial as physician-assisted suicide, no one can reasonably speak for “the Christian” perspective. Natural-law and, specifically, just-war thinking are claimed in the Christian tradition, yet the natural-law contribution to a Christian ethical analysis of physician-assisted suicide requires explanation and defense. Natural-law ethical theory affirms the central role of reason in moral thinking and provides a theoretical resource in contemporary ethics to assist in (...) analyzing specific moral issues, problems, and conflicts. This essay seeks to demonstrate how just-war thinking, derived from natural-law tradition, allows movement from the theoretical world of natural-law theory to the practical world of normative ethics. Here the case is made that the just-war model of ethics helps elucidate the moral problematic involved in physician-assisted suicide while clarifying direction on this particularly thorny and controversial problem. Our ability to select relevant information from the environment is limited by the resolution of attention – i.e., the minimum size of the region that can be selected. Neural mechanisms that underlie this limit and its development are not yet understood. Functional MRI was performed during an object tracking task in 7- and 11-year-old children, and in young adults. Object tracking activated canonical fronto-parietal attention systems and motion-sensitive area MT in children as young as 7 years. Object tracking performance improved (...) with age, together with stronger recruitment of parietal attention areas and a shift from low-level to higher-level visual areas. Increasing the required resolution of spatial attention – which was implemented by varying the distance between target and distractors in the object tracking task – led to activation increases in fronto-insular cortex, medial frontal cortex including anterior cingulate cortex (ACC) and supplementary motor area, superior colliculi, and thalamus. This core circuitry for attentional precision was recruited by all age groups, but ACC showed an age-related activation reduction. Our results suggest that age-related improvements in selective visual attention and in the resolution of attention are characterized by an increased use of more functionally specialized brain regions during the course of development. ArgumentLambert ten Kate (1674-1731), the scholar of language, religious writer, art theoretician and collector, and natural philosophy enthusiast, was part of an informal network of Amsterdam-based mathematics and natural philosophy enthusiasts who played a pivotal role in the early diffusion of Newton’s natural philosophical ideas in the Dutch Republic. Because Ten Kate contributed to several areas of research, it is worth asking whether connections can be found between his different scholarly activities and, more specifically, whether his oeuvre as a whole (...) was shaped by his religious views, as has been suggested. In this essay, I shall argue that his oeuvre was indeed shaped by his religious beliefs, which reflect elements typical of Dutchdoperdom, but also reflect a more general Christian orientation that transcends confessional divides. More particularly, I aim to show that, if we want to understand why Ten Kate was drawn to the natural philosophy of his day, and especially to Isaac Newton’s (1642-1727), and why he sought to promote it, we also need to pay attention to this broader Christian orientation in his thought. Along the way, I shall add nuance to earlier characterizations of how ten Kate mobilized Isaac Newton’s natural philosophy according to his own agenda. (shrink)

ABRAHAM LINCOLN'S UNORTHODOX RELIGIOUS VIEWS CONNECTED TO AN ethical stance that is not reducible to any single overarching philosophical theory. By attending to virtue cultivation, a rational utilitarianism, and a divinely grounded natural law commitment to human equality, Lincoln devised a principled yet flexible ethic that addressed the complexity of the moral life. Despite apparent philosophical difficulties, Lincoln's "hybrid ethic" nonetheless coheres to reveal familiar features of ordinary moral thinking while illuminating moral judgments in the face of dilemmas. Crow: Mass Incarceration in the Age of Colorblindness. Alexander showed how policies grounded in the war on drugs have disproportionately distressed racial and ethnic minorities—African Americans and Latinos—and the poor, destroying lives and communities. Incarceration in the United States is today a system that perpetuates what Alexander called a “caste” system from which escape is, especially among black males, virtually impossible. In this informed and well-presented study, Levad takes up Alexander’s social justice analysis, extending it in new directions, offering a creative theological contribution to the mass incarceration crisis in the world’s first “genuine prison society.”Levad observes that a limitation in the Christian response to mass incarceration is the “lack of Catholic voices” (47), which her book makes an effort to correct. She draws on core insights of Catholic tradition to address conditions that foster crime while also responding “to the ways in which the criminal justice crisis both reflects and sustains social injustices” (48). Her book offers a wonderfully clear analysis of mass incarceration and related issues such as recidivism strategies and policing policies. She advocates “pulling levers,” policing policies that aim at avoiding prison, versus harsh “window-breaking” policies that for deterrence reasons criminalize even minor offences. Levad addresses theories of punishment, proposes ideas for prison reform, and, while acknowledging a limited need for prisons, sets forth constructive suggestions for how best to decarcerate society through restorative justice and rehabilitation practices that reintegrate offenders into society.The study is a provocative interdisciplinary conversation between criminology and theology. Levad’s focus is on liturgy and sacrament, the central resources of Roman Catholic theology, finding in the Eucharist the theological [End Page 204] model for inviting the marginalized and dispossessed into the common fellowship of human dignity. She then argues that penance and reconciliation yield attitudes and behaviors that parallel secular restorative justice efforts. Spatestens seit dem emotional turn in den Kulturwissenschaften zu Anfang dieses Jahrhunderts ist die Leibphanomenologie von Hermann Schmitz kein Geheimtipp mehr. Die Zahl der Studien, die sich mit ihr auseinandersetzen, ist heute kaum uberschaubar. Der Band versucht nach knapp einem halben Jahrhundert Wirkungsgeschichte eine Art Zwischenbilanz zu ziehen. Er fragt, inwiefern und in welchen Kontexten sich die von Schmitz erarbeiteten Kategorien des eigenleiblichen Spurens bewahrt haben. Die Beitrage erortern die gespurte Leiblichkeit in ihrer Verflechtung mit Sachverhalten wie Geschichte, Kultur, Person, (...) Geschlecht sowie als Aktionsfeld leiblicher Kommunikation und zeugen davon, dass das von Schmitz begonnene Projekt uber die Philosophie hinaus auch von anderen Wissenschaften stetig erganzt und weiterentwickelt wird. Vor dem Hintergrund eines sich am Leitmodell des sicht- und tastbaren Korpers orientierenden Denkens konnten sprachliche Ausdrucke fur leibliches Erleben nur als Skandal der Metapher (Strub) begriffen werden. Die Leibphanomenologie bietet dagegen einen alternativen Zugang, dem aber der Korper, wie Schmitz sagt, zum Skandal wird. Diesem schwierigen Verhaltnis von Leib und Korper geht der Band nach, um das Skandalose theoretisch einzuholen. Apologists for Christianity and Judaism have argued that their religions do not support an exploitative attitude towards the environment. L.H. Steffen, in particular, argues that it is the Hellenic rather than the (Judaeo-Christian tradition which promotes the instrumentalist view of nature. In contrast, I argue that Christianity is and has been an amalgam of the Hellenic and Hebrew traditions. In the course of this paper I indicate certain salient Hellenic influences which were prominent in medieval Christianity. I subsequently (...) point out that, contrary to Steffen's allegations, these influences originally contributed to a non-exploitative attitude to the natural world by the very nature of their anti-materialist prescriptions. However, with the Renaissance and the Reformation, religious attitudes shifted and a new religious morality was generated, one which associated morality and spiritual achievement with intense engagement in the material world and the exploitation of this world in the end of personal prosperity. In part I demonstrate this alteration in perspective by reference to the shifting religious attitudes towards ownership and property. (shrink)

The phenomenon of twinning in early fetal development has become a popular source for doubt regarding the ascription of moral status to early embryos. In this paper, the possible moral basis for such a line of reasoning is critically analysed with sceptical results. Three different versions of the argument from twinning are considered, all of which are found to rest on confusions between the actual division of embryos involed in twinning and the property of early embryos to be divisible, be (...) based on highly questionable ethical assumptions, or to imply inconsistent claims regarding the moral importance of potentiality and/or the moral status of embryos. This is taken to expose a number of related inconsistencies in the moral basis of pro-life positions. In particular, ascribing moral significance to the property of being (in)divisible is found to be incompatible with the claim that human individuals possess unique values which could underpin an absolute moral ban on murder. The ideal of scientific openness — i.e. the idea that scientific information should be freely accessible to interested parties — is strongly supported throughout the scientific community. At the same time, however, this ideal does not appear to be absolute in the everyday practice of science. In order to get the credit for new scientific advances, scientists often keep information to themselves. Also, it is common practice to withhold information obtained in commissioned research when the scientist has agreed with his (...) or her employer to do so. The secrecy may be intended for ever, as in the military area, but also temporarily until a patent application has been made. The paper explores to what extent such secrecy is undesirable, as seems to be suggested by the ideal of scientific openness. Should this ideal be interpreted as having certain exceptions which make the above-mentioned practices acceptable? Are there, on closer inspection, good arguments for the ideal of scientific openness, and for officially upholding it? Possible versions of the ideal of scientific openness are explored and the issue is found to be rather complex, allowing for wide variations depending on the acting parties, beneficiaries, types of information and moral requirements involved. We conclude that the arguments usually given in favour of this ideal are weaker than what seems to be generally believed, and that, on closer inspection, they leave plenty of room for exceptions to it. These exceptions only partly cover the actual practice of withholding scientific information, and there may still be good reason to advocate, teach and enforce the ideal of scientific openness within the scientific community. John Searle''s hypothesis of the Background seems to conflict with his initial representationalism according to which each Intentional state contains a particular content that determines its conditions of satisfaction. In Section I of this essay I expose Searle''s initial theory of Intentionality and relate it to Edmund Husserl''s earlier phenomenology. In Section II I make it clear that Searle''s introduction of the notion of Network, though indispensable, does not, by itself, force us to modify that initial theory. However, a comparison (...) of this notion to the notion of horizon from Husserl''s later phenomenology and an interpretation of Husserl''s conception of the determinable X as providing a solution to the problem of perceptual misidentification lead me to conclude that in his discussion of ''twin examples'' Searle had better modified his initial theory. Finally, I critically examine Searle''s claim that anyone who tries seriously to follow out the threads in the Network will eventually reach a bedrock of non-Intentional capacities. In Section III I show in detail, partly in a rather Husserlian vein, that Searle''s four official arguments for the Background thesis, though containing some very valuable contributions to a theory of linguistic skills, are not convincing at all if they are to be understood as going beyond the scope of Searle''s ''content-cum-Network'' picture of Intentionality. The upshot of these considerations is that the Background thesis should be read as a thesis concerning the causal neurophysiological preconditions of human Intentionality rather than concerning the logical properties of Intentional states in general. Recently Searle himself has come to the same result, but he does not say for which reasons. The present essay makes it clear why Searle just had to arrive at this important result. (shrink)

Could computers ever be conscious? Will they ever have ideas that one could attribute to them and not to the programmer? Will robots be able to 'feel pain', instead of processing bits from sensors informing about danger? Will they have true emotions? These questions may never be answered, but it makes sense to ask whether humans will ever attribute mind to artifacts. This paper suggests introducing a third level of claims regarding artificial intelligence (AI), which is in between 'weak AI' (...) and 'strong AI', the so-called 'attributed AI'. This level requires more than weak AI ('behave as if', which could be said of any desktop calculator), but is less presumptuous than strong AI ('computers that think', a claim that is hard to prove). Attributed AI can be measured. This paper discusses behavioral paradigms for measurements of attributed AI and presents first experimental data. (shrink)

The standard of proof in criminal trials should require that the evidence presented by the prosecution is robust. This requirement of robustness says that it must be unlikely that additional information would change the probability that the defendant is guilty. Robustness is difficult for a judge to estimate, as it requires the judge to assess the possible effect of information that the he or she does not have. This article is concerned with expert witnesses and proposes a method for reviewing (...) the robustness of expert testimony. According to the proposed method, the robustness of expert testimony is estimated with regard to competence, motivation, external strength, internal strength and relevance. The danger of trusting non-robust expert testimony is illustrated with an analysis of the Thomas Quick Case, a Swedish legal scandal where a patient at a mental institution was wrongfully convicted for eight murders. Cette opération ne saurait simplement coïncider avec une revalorisation " irrationnelle " du mythe, car elle procède d'abord d'une mise en question, non moins problématique, de la dualité supposée entre muthos et logos pour culminer dans ce qu'une note des années 1950 appellera la " mytho-logie de l'événement ". La réélaboration de la notion de mythe s'accomplit à partir du poème de Hölderlin (...) qui doit préfigurer les dieux de l'" autre commencement " post-judéo-chrétien, selon le projet spéculatif d'une " religion " censée relier le peuple à ses dieux nouveaux via l'être comme événement. L'hypothèse d'une remythologisation théologico-politique doit ainsi permettre d'éclairer non seulement le rôle matriciel de Hölderlin pour la pensée de l'être, mais aussi le surinvestissement illusoire du national-socialisme censé donner lieu au " peuple de Hölderlin ". Pour interroger cette réactualisation théologico-politique du mythe, l'étude se concentre sur les cours que Heidegger consacra à Hölderlin, tout en sollicitant l'intégralité du corpus des années 1933-1945, c'est-à-dire les cours fribourgeois, les traités inédits rédigés dans le sillage des Contributions (Beiträge) et les Cahiers noirs (Schwarze Hefte). This article introduces to a wider public a hitherto unknown report written by the “Romantic” natural philosopher and mineralogist Henrik Steffens (1773–1845). In the 1811 report Ideas on Medical Meteorology, commissioned by the Prussian Ministry of the Interior via the physician Johann Christian Reil (1759–1813), Steffens argued for a new, “organic” perspective on meteorology focusing on interrelations between the atmosphere and diseases among humans and animals. This new outlook, he argued, was to be realized via a series of observations (...) directed by the state administration. Excerpts from the report are translated and commented upon in order to illuminate their context. These show the report to be part of a significantly older European tradition of inquiry into the connection between changes in the atmosphere and health. A speculative variation of this tradition, for which the general term “Organic Meteorology” is introduced here, was ignited in German-speaking regions through Schelling’s natural philosophy. The report and its context show that the Prussian state was willing to engage with “Romantic” natural philosophy, that Steffens gladly provided expertise for this purpose, and that this was part of a more general effort to professionalize medicine. When can we say that a debt crisis has been resolved fairly? An often overlooked but very important effect of financial crises and the debts that often engender them is that they can lead the crisis countries to increased dependence on international institutions and the policy conditionality they require in return for their continued support, limiting their capabilities and those of their citizens to exercise meaningful control over their policies and institutions. These outcomes have been viewed by many not merely (...) as extremely unfortunate and regrettable, but also as deeply unfair. And indeed, increasingly potent popular movements have pressured governments, financial institutions, and the financial community to seek what they take to be fairer solutions to debt crises. The merits of these programs and proposals for dealing more fairly with sovereign debt remain hotly disputed. In this essay, we try to take a step back from the political fray and examine some more fundamental considerations that seem relevant to assessing the fairness of current arrangements governing economic exchanges related to debt contracts and alternatives that have been proposed to them.Our discussion is organized into seven sections. First, we characterize briefly the concept of fairness and its role in social evaluation. Second, we clarify what sovereign debt is, and, third, the ethical statuses that particular sovereign debts can have. Fourth, we identify and describe the main features of current practices related to sovereign debt. Fifth, we describe an "ideal picture" of creditor/debtor relations. We argue that in such a scenario a broad range of ethical considerations can plausibly be invoked in support of practices that closely resemble those presently governing sovereign debt. Sixth, we draw attention to the many ways in which in reality the relations between sovereign debtors and their creditors differ markedly from the relationships between the creditor and debtor in the ideal picture. Because of this, many of the ethical considerations that would support present practices were relations between sovereign debtors and their creditors to resemble more closely those depicted in the ideal picture fail to do so under present circumstances. We conclude, moreover, that the remaining ethical considerations that might be advanced in support of the present system are at best quite inconclusive. Finally, we describe briefly specific reform proposals to current practices. While we will not attempt to show that these proposals would necessarily make the rules governing economic exchanges relevant to sovereign debt more fair, we conclude, in light of our earlier analysis, that they must be given much more serious consideration than they have so far received in policy circles. Indeed, there are strong prima facie reasons to believe that some combination of these proposed policies might prevent or mitigate some of the most ethically regrettable outcomes of present practices and norms by changing the incentives of sovereign borrowers and those who lend to them. Most accounts of welfare aggregation in the tradition of Arrow's and Sen's social-choice-theoretic frameworks represent the welfare of an individual in terms of a single welfare ordering or a single scalar-valued welfare function. I develop a multidimensional generalization of Arrow's and Sen's frameworks, representing individual welfare in terms of multiple personal welfare functions, corresponding to multiple 'dimensions' of welfare. I show that, as in the one-dimensional case, the existence of attractive aggregation procedures depends on certain informational assumptions, specifically about the (...) measurability of welfare and its comparability not only across individuals but also across dimensions. I state several impossibility and possibility results. Under Arrow-type conditions, insufficient comparability across individuals leads to dictatorship of a single individual, while insufficient comparability across dimensions leads to dominance of a single dimension. Given sufficient comparability both across individuals and across dimensions, a range of possibilities emerges. I discuss the substantive implications of the results. (shrink)

Before crystallizing into works, music as a field of sensible organization of sound poses a problem: how is it possible that something audible is set apart from the acoustic world to constitute a distinct sphere of sense, holding people′s attention in an unparalleled way? To deal with this question, the text proceeds in three steps: using a concept from art theory, Boehm′s “iconic difference”, music is conceptualized as an ongoing differentiation within the audible; the means that accomplish this differentiation, namely (...) musical tone and the tonal system, are investigated; and finally the gestural element in music is introduced as the form these means take on in the musical process. Throughout, the text draws on classical philosophical resources such as Hegelian dialectics, current research in parallel fields like language development, psychological insights into the structure of perception in early infancy, and various examples from contemporary music and art.
