Particular ethical tensions and dilemmas emerge when conducting qualitative educational research. This is further compounded where the predominant approach to research ethics is underscored by a dominant principalism which construes ethical rules as both universal and absolute. This article focuses on the ‘perfect ethical storm’ which is arguably created when ethnographic design, covert observation and practitioner research collide. Drawing on a doctoral study into therapeutic education, this analysis shows how such research may be ethically feasible when the qualitative researcher adopts (...) a more flexible approach to research ethics based on Aristotelian notions of virtue. In this article, I also demonstrate how the field diary can be a valuable tool in enabling the qualitative researcher to develop certain dispositions, notably reflexivity, which are central to becoming a virtuous researcher. In clinical ethics consultations, clinical ethicists bring moral reasoning to bear on concrete and complex clinical ethical problems by undertaking ethical deliberation in collaboration with others. The reasoning process involves identifying and clarifying ethical values which are at stake or contested, and guiding clinicians, and sometimes patients and families, to think through ethically justifiable and available courses of action in clinical situations. There is, however, ongoing discussion about the various methods ethicists use to do this ethical deliberation work. In this (...) paper, we make visible and accessible seven steps of facilitation used in the critical dialogue method of ethics consultation.We describe how the facilitation techniques serve two overall purposes. First, to identify ethically justified responses to ethical questions. Second, to assist participants to gain greater moral clarity, understanding and confidence to respond to ethical challenges as independent moral agents.By describing in detail facilitation steps for clinical ethics consultation, we aim to advance the scholarship of ‘clinical ethics facilitation methods’ and to demystify the ethical deliberation work undertaken by clinical ethicists. It is widely agreed that because animals feel pain we should not make them suffer gratuitously. Some ethical theories go even further: because of the capacities that they possess, animals have the right not to be harmed or killed. These views concern what not to do to animals, but we also face questions about when we should, and should not, assist animals that are hungry or distressed. Should we feed a starving stray kitten? And if so, does this commit us, (...) if we are to be consistent, to feeding wild animals during a hard winter? In this controversial book, Clare Palmer advances a theory that claims, with respect to assisting animals, that what is owed to one is not necessarily owed to all, even if animals share similar psychological capacities. Context, history, and relation can be critical ethical factors. If animals live independently in the wild, their fate is not any of our moral business. Yet if humans create dependent animals, or destroy their habitats, we may have a responsibility to assist them. Such arguments are familiar in human cases-we think that parents have special obligations to their children, for example, or that some groups owe reparations to others. Palmer develops such relational concerns in the context of wild animals, domesticated animals, and urban scavengers, arguing that different contexts can create different moral relationships. Some recent conservation proposals – including the Zoological Society of London’s (ZSL) EDGE of Existence programme – have focused on the value of protecting species with high evolutionary distinctiveness, a dimension of biodiversity conservation that’s not been much emphasized in conservation practice. In this paper we critically examine this strategy, investigating whether there are good reasons for prioritizing evolutionarily distinctive species, and the phylogenetic diversity to which they contribute, over other forms of biodiversity. We first discuss evolutionary distinctiveness, its relationship (...) to phylogenetic diversity, how phylogenetic diversity can be measured, and intuitive thoughts about its value. Then we consider five kinds of arguments about the value of phylogenetic diversity that might be made to support prioritizing it, given its current lack of emphasis in conservation practice. These are: arguments based on protecting biodiversity, arguments based on option value, arguments based on ecological resilience, arguments based on historical value, and arguments based on aesthetic value. We maintain that these arguments, taken individually, offer varying degrees of fairly weak support for valuing species with high evolutionary distinctiveness. Taken together, however, these arguments seem sufficiently strong to justify programs such as EDGE, insofar as such programs are framed as correctives to a past lack of emphasis on the protection of phylogenetic diversity. We suggest, however, that these arguments are not sufficiently strong to support an absolute prioritization of phylogenetic diversity over protecting other forms of biodiversity. (shrink)

This paper explores ethical issues raised by the application of non-surgical, pharmaceutical fertility control to manage reproductive behaviors in domesticated and wild animal species. We focus on methods that interfere with the effects of GnRH, making animals infertile and significantly suppressing sexual behavior in both sexes. The paper is anchored by considering ethical issues raised by four diverse cases: the use of pharmaceutical fertility control in male slaughter pigs, domesticated stallions and mares, male companion dogs and female white-tailed deer. Ethical (...) concerns explored include animals’ welfare, the possible violation of animals’ rights, including rights to life, reproduction and bodily integrity; and potential concerns about loss of wildness. We compare ethical concerns about pharmaceutical fertility control with alternative strategies for managing animals’ reproductive behavior including spaying and neutering, sex separation, sex sorting, culling, and doing nothing. The paper concludes that there are some cases where pharmaceutical fertility control is the best ethical choice in current circumstances; but that there are other cases where alternative choices, including doing nothing, would be ethically preferable. This suggests that in ethical terms a case-by-case approach should be taken to the use of pharmaceutical fertility control in animals. (shrink)

How do people understand questions about cause and prevent? Some theories propose that people affirm that A causes B if A's occurrence makes a difference to B's occurrence in one way or another. Other theories propose that A causes B if some quantity or symbol gets passed in some way from A to B. The aim of our studies is to compare these theories' ability to explain judgements of causation and prevention. We describe six experiments that compare judgements for causal (...) paths that involve a mechanism, i.e. a continuous process of transmission or exchange from cause to effect, against paths that involve no mechanism yet a change in the cause nevertheless brings about a change in the effect. Our results show that people prefer to attribute cause when a mechanism links cause to effect. In contrast, prevention is sensitive both to the presence of an interruption to a causal mechanism and to a change in the outcome in the absence of a mechanism. In this sense, ‘prevent’ means something different than ‘cause not'. We discuss the implications of our results for existing theories of causation. (shrink)

In his book Wild Animal Ethics, Kyle Johannsen argues that our duties of beneficence to help suffering wild animals require significant interventions into wild nature. In particular, he claims that the majority of wild animals lead miserable lives and that naturalness, or wildness, is not an intrinsically valuable property. In these comments, I question both these claims. First, I argue that a lot more evidence is needed than Johannsen provides to support the claim that most wild animal lives are terrible. (...) Then I suggest that Johannsen both mischaracterizes and fails to recognize the importance of wildness value, meaning that he doesn’t discuss some significant ethical worries about the kind of large-scale interventions into wild nature he proposes. While I don’t argue that wildness value necessarily trumps the disvalue of wild animal suffering. I maintain that there are genuine value conflicts here, and also that wildness value is just one example of such a conflict. If, as Johannsen claims, he wants to gain democratic legitimacy for large scale interventions to assist suffering wild animals, he needs to take such value conflicts much more seriously. (shrink)

For Aristotle, excellence is not an act but a habit, and Hume regards habit as ‘the great guide of life’. However, for Proust habit is problematic: ‘if habit is a second nature, it prevents us from knowing our first.’ What is habit? Do habits turn us into machines or free us to do more creative things? Should religious faith be habitual? Does habit help or hinder the practice of philosophy? Why do Luther, Spinoza, Kant, Kierkegaard and Bergson all criticise habit? (...) If habit is both a blessing and a curse, how can we live well in our habits? In this thought-provoking book Clare Carlisle examines habit from a philosophical standpoint. Beginning with a lucid appraisal of habit’s philosophical history she suggests that both receptivity and resistance to change are basic principles of habit-formation. Carlisle shows how the philosophy of habit not only anticipates the discoveries of recent neuroscience but illuminates their ethical significance. She asks whether habit is a reliable form of knowledge by examining the contrasting interpretations of habitual thinking offered by Spinoza and Hume. She then turns to the role of habit in the good life, tracing Aristotle’s legacy through the ideas of Joseph Butler, Hegel, and Félix Ravaisson, and assessing the ambivalent attitudes to habit expressed by Nietzsche and Proust. She argues that a distinction between habit and practice helps to clarify this ambivalence, particularly in the context of habit and religion, where she examines both the theology of habit and the repetitions of religious life. The philosophy of perception has been dominated by vision, with very little discussion of the chemical senses – olfaction and gustation. In this second entry of a pair on olfactory experience, I consider what olfaction has to tell us about two issues: the nature of perceptual objects and the nature of perceptual properties and, in particular, the secondary qualities. Given the scant work on olfaction in the philosophical literature, my discussion not only surveys what philosophers have said about olfaction so (...) far, but considers the most plausible views and/or most pressing questions in each area of inquiry. In _Considering Emma Goldman_ Clare Hemmings examines the significance of the anarchist activist and thinker for contemporary feminist politics. Rather than attempting to resolve the tensions and problems that Goldman's thinking about race, gender, and sexuality pose for feminist thought, Hemmings embraces them, finding them to be helpful in formulating a new queer feminist praxis. Mining three overlapping archives—Goldman's own writings, her historical and theoretical legacy, and an imaginative archive that responds creatively to gaps in those archives —Hemmings shows (...) how serious engagement with Goldman's political ambivalences opens up larger questions surrounding feminist historiography, affect, fantasy, and knowledge production. This case study details how and why integrating storytelling, empathy, and inclusive practice shifted QSuper, a large Australian finance organisation, from minimal awareness to moral awareness then moral capability in the delivery of services to Indigenous customers. During the Royal Commission into Misconduct in the Banking, Superannuation, and Financial Services Industry, QSuper were recognised for their exemplary service with Indigenous customers (Hayne, Interim report: Royal commission into misconduct in the banking, superannuation and financial services industry, Volume 1. Commonwealth of Australia, (...) 2018; _Transcript of Proceedings, 13 August_, Commonwealth of Australia, 2018). This position was in stark contrast to the inaccessible service offerings of other financial organisations where some used predatory practices to sell unethical financial products to Indigenous Australians (Hayne, Interim report: Royal commission into misconduct in the banking, superannuation and financial services industry, Volume 1. Commonwealth of Australia, 2018; Hayne, Final report: Royal commission into misconduct in the banking, superannuation and financial services industry, Volume 1. Commonwealth of Australia, 2019a). Storytelling garned from visiting customers in remote communities and other meaningful activities involving inclusive practice to facilitate ethical decision-making in finance is different to standard functionalist finance approaches (Schinckus, Int Rev Financ Anal 40:103–106, 2015). One of the most basic understandings of nursing is that a nurse is a caregiver for a patient who helps to prevent illness, treat health conditions, and manage the physical needs of patients. Nursing is often presented as a caring profession, which provides patient care driven by ideals of empathy, compassion and kindness. These ideals of care have further been foregrounded through the development and implementation of stress on patient centred care (PCC) and/or person‐centred practice (PCP). Although the idealisation of (...) nursing as a caring profession is common, and one certainly seen as integral by nurses and written into the heart of regulatory documentation, we contend that the actual delivery of care is being undercut by the very regulatory climate that strives to professionalise care. As we outline, with specific reference to the context of Australian Nursing, this transformation delivers a commodified, even McDonaldized, model of patient management rather than care. It seems that even with its explicit stress on PCC and PCP, Australian Nursing cannot live up to its own care ideals. Having outlined this problem, the paper then demonstrates the ways in which PCC is thwarted at the coal face of nursing practice and that there must be an institutionalised change to be able to provide genuine patient‐centred care. Social scientists have drawn attention to the role of hype and optimistic visions of the future in providing momentum to biomedical innovation projects by encouraging innovation alliances. In this article, we show how less optimistic, uncertain, and modest visions of the future can also provide innovation projects with momentum. Scholars have highlighted the need for clinicians to carefully manage the expectations of their prospective patients. Using the example of a pioneering clinical team providing deep brain stimulation to children and young (...) people with movement disorders, we show how clinicians confront this requirement by drawing on their professional knowledge and clinical expertise to construct visions of the future with their prospective patients; visions which are personalized, modest, and tainted with uncertainty. We refer to this vision-constructing work as recalibration, and we argue that recalibration enables clinicians to manage the tension between the highly optimistic and hyped visions of the future that surround novel biomedical interventions, and the exigencies of delivering those interventions in a clinical setting. Drawing on work from science and technology studies, we suggest that recalibration enrolls patients in an innovation alliance by creating a shared understanding of how the “effectiveness” of an innovation shall be judged. In this study, Clare Palmer challenges the belief that the process thinking of writers like A.N. Whitehead and Charles Hartshorne has offered an unambiguously positive contribution to environmental ethics. She compares process ethics to a variety of other forms of environmental ethics, as well as deep ecology, and reveals a number of difficulties associated with process thinking about the environment.

In a recent unit of study in an undergraduate Health Sciences pathway course, we identified a set of essays which exhibited similarity of content but demonstrated the use of bizarre and unidiomatic language. One of the distinct features of the essays was the inclusion of unusual synonyms in place of expected standard medical terminology.We suspected the use of online paraphrasing tools, but were also interested in investigating the possibility of the use of online language translation tools. In order to test (...) the outputs of these tools, we used as a seed document a corpus of text which had been provided to the students as prompt for the essay. This document was put through six free online paraphrasing tools and six separate iterative language translations through the online Google Translate™ tool.The results demonstrated that free online paraphrasing tools did not identify medical terminology as standardised or accepted nomenclature and substituted synonyms, whereas Google Translate™ largely preserved medical terminology.We believe that textual indicators such as the absence of standard discipline-based terminology may be of assistance in the identification of machine paraphrased text. Contract cheating is a major problem in Higher Education because it is very difficult to detect using traditional plagiarism detection tools. Digital forensics techniques are already used in law to determine ownership of documents, and also in criminal cases, where it is not uncommon to hide information and images within an ordinary looking document using steganography techniques. These digital forensic techniques were used to investigate a known case of contract cheating where the contract author has notified the university and the (...) student subsequently confirmed that they had contracted the work out. Microsoft Word documents use a format known as Office Open XML Format, and as such, it is possible to review the editing process of a document. A student submission known to have been contracted out was analysed using the revision identifiers within the document, and a tool was developed to review these identifiers. Using visualisation techniques it is possible to see a pattern of editing that is inconsistent with the pattern seen in an authentic document. (shrink)

Many have argued that that it is morally wrong to benefit from an agent's culpable wronging of a third party. This thought has formed the basis of some arguments that agents can have duties to make up for wrongful acts by others that they could not have stopped, or that occurred before they were born. For example, it has been argued that those who benefited from slavery, colonialism and other shameful events in their nation's history should surrender those benefits, their (...) equivalent value, or provide other forms of redress. Some have also argued that it is morally wrong to benefit from unjust situations caused by third parties even where there is no culpable element. These ideas have potential to be a principle of redress for harms that are caused by the working of very complex systems, such as the global climate system. Geoengineering, the intentional manipulation of the global climate, is a new development in climate science and policy — and one which raises many normative challenges. This article focuses on one specific challenge. The global climate is very complex and there is a real possibility that the best available science will not be able to account for all the consequences of deploying a geoengineering technique. Therefore, any governance regime that allows deployment will have to consider how to organise compensation or redress for any adverse impacts that could not have been predicted at the time of deployment. This article proposes that, with some modification, the principle that agents should surrender benefits that have accrued to them from using geoengineering techniques, can be a good basis for such a scheme. This article reflects on the problem of false belief produced by the integrated psychological and algorithmic landscape humans now inhabit. Following the work of scholars such as Lee McIntyre (Post-Truth, MIT Press, 2018) or Cailin O’Connor and James Weatherall (The Misinformation Age: How False Beliefs Spread, Yale University Press, 2019) it combines recent discussions of fake news, post-truth, and science denialism across the disciplines of political science, computer science, sociology, psychology, and the history and philosophy of science that variously address (...) the ineffectiveness, in a digital era, of countering individual falsehoods with facts. Truth and falsehood, it argues, rather than being seen as properties or conditions attached to individual instances of content, should now be seen as collective, performative, and above all persuasive phenomena. They should be practically evaluated as networked systems and mechanisms of sharing in which individually targeted actions are combining with structural tendencies (both human and mechanical) in unprecedented ways. For example, the persuasive agency of apparent consensus (clicks, likes, bots, trolls) is newly important in a fractured environment that only appears to be, but is no longer ‘public’; the control of narratives, labels, and associations is a live, time-sensitive issue, a continuous contest, or ongoing cusp. Taking a social approach to truth yields observations of new relevance; from how current strategies of negative cohesion, blame, and enemy-creation depend crucially on binary ways of constructing the world, to how the offer of identity/community powerfully cooperates with the structural tendencies of algorithm-driven advertiser platforms towards polarisation. Remedies for these machine-learned and psychological tendencies lie in end-user education. So the Arts and Humanities, whether via comparisons with previous historical periods, or via principles of critical thinking and active reading, offer crucial resources to help counter what since 1997 silicon valley executives and scholars have called ‘persuasive technology’ (Fogg in Persuasive Technology: Using Computers to Change What we Think and Do, Morgan Kaufmann, 2003; Hamari et al. (eds) in Persuasive Technology, Springer International Publishing, 2014; Harris in How a Handful of Tech Companies Control Billions of Minds Every Day, 2017; Lanier in Who Owns the Future? Simon & Schuster, 2014 and Ten Arguments for Deleting your Social Media Accounts Right Now, Picador, 2019). The article proposes a paradigm shift in public understandings of this new social environment: from a culture of discovery, where what matters is what exists or is in fact the case, to a culture of iteration, where what matters is what gets repeated. Many individual sentient wild animals are vulnerable to anthropogenic climate change. In this article, I suggest that animal ethicists who take sentient animals’ moral status seriously are likely to agree that, other things being equal, we have moral responsibilities to assist wild animals made vulnerable to climate change. However, I also argue that these ethicists are likely to diverge in terms of the strategies they believe would actually fulfil such moral responsibilities, depending on whether their primary concern is rectificatory justice (...) or duties of beneficence. To support this argument, I consider three plausible strategies for helping wild animals vulnerable to climate change: rescue and rehabilitation, habitat restoration, and assisted migration. I argue that different theoretical approaches to animal ethics are likely to diverge on aspects of all these strategies. These differences mean that the process of creating wide agreement among animal ethicists on climate adaptation strategies to assist vulnerable wild animals faces significant hurdles. (shrink)

Michel Clare est né le 21 février 1927 à Sceaux. Études secondaires, bachelier. Résistance et séjour au Maquis de Lorris à dix-sept ans. Puis sport pour guérir des déceptions d’après la Libération : athlétisme, champion de France du 800 mètres en 1949. De nombreuses fois international. Entre à l’Equipe en 1953 où il occupe les fonctions de grand reporter et spécialiste du ski. Auteur d’un livre sur le Ski (La table ronde). Lauréat de l’Académie des Sports pour une enquête (...) sur les universités américaines et du concours du meilleur article du journalisme sportif. In what sense does empty space feature in visual experience? In the first part of this essay I sketch a view advanced by Soteriou and Richardson on which one's visual awareness of empty space is explained by appeal to ‘structural’ features of the phenomenology of visual experience, in particular the phenomenology of experiencing one's visual field as bounded. I suggest that although this ‘structuralist’ view is silent on whether empty space has a phenomenal appearance, the very appeal to structural features (...) seems a natural foil to some such thought. In the second part, I outline a view on which it can be granted that empty space does, after all, have a phenomenal appearance and, so, is not best cast as a species of absence perception as the structuralist avows, at least on a certain construal of ‘absence perception’. After O'Shaughnessy , I contend that although some privations have a phenomenal appearance, ‘absence perception’ should single out the putative perception of phenomena that lack phenomenal reality. I finally consider how the descriptive phenomenology that the structuralist points to, and which I urge should be embraced, can nonetheless be reconciled with the view I spell out. (shrink)

This article attempts to question modes of sharing and watching to rethink political subjectivity beyond that which is enabled and enforced by the current data regime. It identifies and examines a ‘shareveillant’ subjectivity: a form configured by the sharing and watching that subjects have to withstand and enact in the contemporary data assemblage. Looking at government open and closed data as case studies, this article demonstrates how ‘shareveillance’ produces an anti-political role for the public. In describing shareveillance as, after Jacques (...) Rancière, a distribution of the sensible, this article posits a politico-ethical injunction to cut into the share and flow of data in order to arrange a more enabling assemblage of data and its affects. In order to interrupt shareveillance, this article borrows a concept from Édouard Glissant and his concern with raced otherness to imagine what a ‘right to opacity’ might mean in the digital context. To assert this right is not to endorse the individual subject in her sovereignty and solitude, but rather to imagine a collective political subjectivity and relationality according to the important question of what it means to ‘share well’ beyond the veillant expectations of the state. Since at least the 1970s, one of the stock standard tools in the animal protection movement’s arsenal has been illegal entry into factory farms and animal research facilities. This activity has been followed by the publication of images and footage captured inside those otherwise socially invisible places. This activity presents a conundrum: trespass is illegal and it is an apparent violation of private property rights. In this paper we argue that trespass onto private property can be justified as an act (...) of civil disobedience. We look at one particular type of justification: the use of information gathered through trespass in public policy formation. We then animate this analysis both with an historical overview of the effects of sharing information about animal agriculture, and with a specific case study of trespass undertaken recently. This book presents in-depth investigation of the language used about women and ageing in public discourse, and compares this with the language used by women to express their personal, lived experience of ageing. It takes a linguistic approach to identify how messages contained in public discourse influence how individual women evaluate their own ageing, and particularly their ageing appearance. It begins by establishing the wider cultural context that produces prevailing attitudes to women, before turning to an analysis of representations of (...) the ageing female body in beauty and cosmetic advertising and the lifestyle media. The focus then moves to a detailed investigation of women’s own perceptions of the process of ageing and of their ageing appearance as revealed through their personal narratives. The final chapters challenge dominant attitudes to women and ageing by presenting two case studies of women who for different reasons and in different ways refuse to conform to cultural expectations. This work provides a platform for further academic research in the fields of linguistics, gerontology, gender and media studies; as well as offering meaningful applications in the wider domains of business and advertising.
