Cet ouvrage rend hommage au Professeur Claude JOURNÈS, ancien Président de l'Université LUMIERE Lyon 2 et membre fondateur du mouvement Critique du droit. Les Mélanges offerts au Professeur Claude JOURNÈS ont retenu cette approche, utilisant le droit comme un outil de mise en perspective critique de l'ordre social et de l'ordre politique. Après un hommage au Doyen JOURNÉES (P. BLACHÈR) et l'évocation des ambitions et perspectives du mouvement critique Du droit (S. BASSET ou J. MICHEL), l'ouvrage se construit (...) en deux temps. La première partie, intitulée « Le droit critique de l'ordre social », regroupe des réflexions sur le pouvoir médical (F. DEMICHEL), sur les crimes coloniaux (A. MAHIOU), sur la dimension anthropologique du vocabulaire juridique (M.-C. HATTI) et sur le contrôle policier (M. SAOUDI), le tout ouvrant sur la possibilité d'un humanisme séculier (H. PUEL). La seconde partie, « Le droit critique de l'ordre politique », entend montrer comment le droit porte en lui une conception du pouvoir et de l'autorité. Les études explorent des pistes très diverses mêlant les finances publiques (J.-L. ALBERT), les renseignements (C. ARROUDJ), l'histoire du droit (J.-L. AUTIN, J.-C GENIN), l'histoire de la doctrine (H. GOURDON), les institutions politiques (P. BACOT, A.-S. MESCHERIAKOFF, R. CHARVIN), les institutions territoriales (J.-J. GLEUAL, H. OBERDORFF, R. PAVRE), la littérature (S. CAPORAL, G. HARE) ou les nouvelles technologies (G. PROTIÉRE). II ressort de l'ensemble que, loin d'être un simple outil technique, le droit est un puissant instrument de modélisation sociale et de justification du pouvoir. Inversant la logique dominante, la perspective critique du droit dévoile les limites d'une telle conception et rappelle que le droit, comme tous les construits sociaux, est le produit de luttes politiques et de rapports de force. En ce sens, à l'instar des valeurs défendues par le dédicataire de cet ouvrage, l'ordre critique du droit est un appel à contester les évidences, condition d'une conception plus ouverte et pluraliste de l'ordre juridique. Content externalism, as defended by Hilary Putnam, Tyler Burge and several others, is the thesis that the content of our thoughts at a given moment is not uniquely determined by our internal states at that moment. In its causalist version, it has often been presented as a deep revolution in philosophy of mind. Yet a number of medievalists (e.g. Peter King, Calvin Normore, Gyula Klima, and myself) have recently stressed the presence of significant externalist tendencies in late-medieval nominalism, especially in (...) William of Ockham. Now this interpretation has been cleverly challenged in the case of Ockham by Susan Brower-Toland in 2007, with arguments focusing upon Ockham’s theory of intuitive cognition (precisely where the externalist reading had seemed to be the most secured). The present paper is a reply to this challenge. I first summarize the case for seeing Ockham’s theory of intuitive cognition as a causal and externalist approach, and then critically review Brower-Toland’s arguments against it. The whole discussion, as it turns out, sheds new light upon Ockham’s conception of causality and natural order. (shrink)

Um 1800 verstärkt sich das Problembewusstsein für eine der wissenschaftlichen Reflexion adäquate Darstellung, da sich die Überzeugung durchsetzt, die Sprache sei nicht nur ein Werkzeug, sondern vielmehr ein »bildendes Organ des Gedankens«. Das enge Verhältnis von Aussage und Ausdruck rückt die Wissenschaft in der deutschen Tradition geradezu zwangsläufig in die Nähe zur Literatur. Dabei zeigt sich das wissenschaftliche Selbstverständnis dieser Jahre in der Frage v.a. seiner Adressierung von einer interessanten Paradoxie geprägt. So soll der jeweilige Sprachgebrauch überhaupt erst den szientistischen (...) Anspruch wissenschaftlicher Projekte beglaubigen und diese gleichsam als Spezialdiskurse legitimieren, zugleich muss der ideale Adressat der Wissenschaft solche Spezialdiskurse aber immer auch überschreiten. J. G. Fichte etwa weist den Vorwurf der »Unverständlichkeit« seiner »Wissenschaftslehre« als implizites Verlangen nach »Seichtigkeit« seitens der Leser zurück, zugleich aber erlegt er dem Wissenschaftler die Aufgabe auf, einen Beitrag zum »Fortgang des Menschengeschlechts« zu leisten. Derartigen Spannungen spürt der Band im Kontext vornehmlich des Niedergangs der Rhetorik und der Neubegründung der Universität nach. (shrink)

Volume 39 of the Tanner Lectures on Human Values includes lectures initially scheduled during the academic year 2019-2020. Owing to the global coronavirus pandemic, some were delivered at a later date. The Tanner Lectures are published in an annual volume. In addition to permanent lectures at nine universities, the Tanner Lectures on Human Values funds special one-time lectures at selected higher educational institutions in the United States and around the world.

Novel forms of matter, such as states made of gluons (glueballs), multiquark mesons or baryons and hybrid mesons are predicted by low energy QCD, for which several candidates have recently been identified. Searching for such exotic states of matter and studying their production and decay properties in detail has become a flourishing field at the experimental facilities now available or being built - e.g. BESIII in Beijing, BELLE II at SuperKEKB, GlueX at Jefferson Lab, PANDA at FAIR, J-PARC and in (...) the upgraded LHC experiments, in particular LHCb. A modern primer in the field is required so as to both revive and update the teaching of a new generation of researchers in the field of QCD. These lectures on hadron spectroscopy are intended for Master and PhD students and have been originally developed for a course delivered at the Stefan Meyer Institute of the Austrian Academy of Sciences. They are phenomenologically oriented and intended as complementary material for basic courses in particle and nuclear physics. The book describes the spectra of light and heavy mesons and baryons, and introduces the fundamental properties based on symmetries. Further, it derives multiplet structures, mixing angle, decay coupling constants, magnetic moments of baryons, and predictions for multiquark states and compares these with suitable experimental data. Basic methods of calculating decay angular distributions and determining masses and widths of resonances are also presented. The appendices provide students and newcomers to the field with the necessary background information, and include a set of problems and solutions. (shrink)

Critical ethical questions arise concerning whether studies among adolescents of new behavioral and biomedical HIV preventive interventions such as Pre-Exposure Prophylaxis should obtain parental permission. This paper examines the relevant regulations and ethical guidance concerning waivers of parental permission, and arguments for and against such waivers. Opponents of such waivers may argue that adolescent decision-making is “too immature” and that parents always have rights to decide how to protect their children. Yet requiring parental permission may put adolescents at risk, and/or (...) limit adolescent participation, jeopardizing study findings’ validity. This paper presents recommendations on when researchers and Institutional Review Boards should waive parental permission, and what special protections should be adopted for adolescents who consent for themselves, e.g., assuring adolescent privacy and confidentiality, screening for capacity to consent, and identifying adolescents who are at elevated risk from study participation. We also present a series of specific areas for future research to design tools to help make these assessments, and to inform researcher and IRB decisions. These recommendations can help ensure that research is conducted that can aid adolescents at risk for HIV, while minimizing risks and protecting these individuals' rights as much as possible. BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 participants (...) (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice. The article focuses on the renewal of Gramscian studies in Italy. It begins with a presentation of the criteria adopted for the new national edition of the complete writings of Antonio Gramsci, drawing on the significant philological progress made possible by the research of G. Francioni. It goes on to discuss recent historiography, based in particular on Soviet archives : these have enabled researchers to arrive at a better understanding of Gramsci’s intellectual path during his formative years and the question (...) of his links, when he was in prison, with the Italian party and with the International. It also draws on the studies carried out in the field of historical semantics on Gramsci’s language (in particular the Dizionario gramsciano) and on some of the most important theoretical works (notably those of G. Cospito and F. Frosini) which are grounded in current philological, semantic and historical research. A diachronic reading of the Quaderni, in which the writings are linked to the concrete political situations out of which they emerged, is now possible, and it may help us to understand better how Gramsci’s singular and innovative thinking can still be useful in the 21st century. Buffier, SJ (1661–1737) emerged as one of the most influential of the Parisian scriptores librorumin the first decades of the eighteenth century. (...) Buffier is perhaps best known as one of the founding editors of, and contributors to, the influential French Jesuit periodical Mémoires de Trévoux, but his works on general grammar, metaphysics, moral philosophy, and logic earned him widespread renown. His Grammaire françaiseachieved translation into Spanish, German, Italian, and English, and his Cours de sciences sur des principes nouveaux et simples pour former le langage, l'esprit, et le cœur dans l'usage ordinaire de la vie(1715) was widely adopted in France and Spain throughout the eighteenth century. Buffier's eclectic approach to philosophy, science, moral philosophy, and practical theology developed across several significant works: Principes du raisonnement(1714), Traité des premières vérités(1724), Éléments de métaphysique(1725), and Exposition des preuves les plus sensibles de la véritable religion(1732). In these works, Buffier was prescient in selectively adopting perspectives from Descartes, Malebranche, and Locke, evincing thereby his avid interest and participation in early Enlightenment discussions. Many of Buffier's texts proved to be influential on contributors to the Encyclopédie, on Voltaire, and perhaps later, as harbingers of Scottish Common Sense philosophy. Given the growing recognition of Buffier's importance thanks to the work of Kathleen Wilkins, Catherine Northeast, Jeffrey Burson, Katharine Hammerton, and others, Louis Rouquayrol's new critical edition of Buffier's most influential work, Traité des premières vérités( Treatise of First Truths) is most welcome. Rouquayrol's critical edition of the Traitéis replete with helpful [End Page 156]intertextual explanatory notes to the texts and debates that Buffier addressed, and it includes an insightful synthetic introduction, which summarizes the Traitéand addresses aspects of its philosophical and historical significance. The editor also helpfully includes a detailed chronology of Buffier's life and works, a note about the textual bases for the edition, several instructive appendices to later editions and related works by Buffier, and a profoundly helpful bibliography that includes existing editions, copies, and translations of the Traité, in addition to scholarly studies of Buffier's life and work. Rouquayrol's critical edition is, in short, the best one currently available, and it is likely to remain the standard published edition for some time.In the editor's view, Buffier's primary significance is as the inaugural eighteenth-century figure who attempted to redress the weaknesses at the heart of Cartesian "innate ideas" in ways that might have avoided Berkeley's or Malebranche's immaterialism or Hume's skepticism: "pour lutter contre les 'conséquences idéalistes du cartésianisme,'" Buffier "avait eu plutôt recours au sens commun comme à un 'complément nécessaire du sense intime, qui garantit l'existence du monde extérieur'" (13n2, quoting Étienne Gilson). This conciliation of Lockean empiricism and certain strands of Cartesianism found in Buffier was in fact a central point made by my earlier work on Buffier's contribution to eighteenth-century Enlightenment Catholicism (see Rise and Fall of Theological Enlightenment[South Bend, IN: University of Notre Dame Press, 2010]; also "Claude G. Buffier and the Maturation of the Jesuit Synthesis in the Age of Enlightenment," Intellectual History Review21 [2011]: 449–72). Rouquayrol's effort to revisit the complexities of this conciliation in his introduction is a welcome development. He explicitly reminds us that while Jesuits such as Buffier were prohibited from teaching particular theses associated with Descartes after 1706, they were nevertheless increasingly influenced by aspects of Cartesianism (15–17).
