I argue for a novel answer to the question “What is hope?”. On my view, rather than aiming for a compound account, i.e. analysing hope in terms of desire and belief, we should understand hope as an irreducible concept. After criticizing influential compound accounts of hope, I discuss Segal and Textor's alternative of describing hope as a primitive mental state. While Segal and Textor argue that available developments of the standard definition do not offer sufficient conditions for hope, I question (...) the deep‐seated idea that desire and belief are even necessary conditions for hope. My suggestion is that we should take seriously the fact that we hope in a great variety of ways and should question the search for elements that are common to all cases. A promising alternative follows the Wittgensteinian idea that cases of hope are related in terms of family resemblance, i.e. are multiply realizable on the ontological level while falling under the non‐definable concept of hope. The language of hope is a ubiquitous part of political life, but its value is increasingly contested. While there is an emerging debate about hope in political philosophy, an assessment of the prevalent scepticism about its role in political practice is still outstanding. The aim of this article is to provide an overview of historical and recent treatments of hope in political philosophy and to indicate lines of further research. We argue that even though political philosophy can draw on recent (...) analyses of hope in analytic philosophy, there are distinct challenges for an account of hope in political contexts. Examples such as racial injustice or climate change show the need for a systematic normative account that is sensitive to the unavoidability of hope in politics as much as its characteristic dangers. This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher than (...) without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. Music performance anxiety is a commonly present topic among musicians. Most studies on MPA investigated effects of a more general occurrence of MPA on performances. Less is known about individual variations of MPA within a performance, more specifically at the times before, during, and after the performance. This study used a questionnaire to investigate these performance times in order to find out if there occur different types in the variation of the perceived MPA across the performance. The study was performed (...) with 532 musicians; 27% of them being professional orchestra musicians, 45% non-professional orchestra musicians, and 28% non-professional choir singers. The musicians were asked to fill in the Performance-specific Questionnaire for Musicians immediately after a performance. The questionnaire contains three scales regarding symptoms of MPA, functional coping with MPA and performance-related self-efficacy. A cluster analysis was performed on the PQM scales to identify systematic variations. Findings indicate that there are three different types of MPA in the sample studied. Type 1 describes musicians who have few symptoms of MPA throughout the performance, show functional coping with MPA, and have a stable and well-developed self-efficacy. Type 2 describes musicians who begin their performance with rather high symptoms of MPA but can positively reduce these by the end of the performance and show high values in self-efficacy and in functional coping. Type 3 contains musicians who begin their performance with some symptoms of MPA, which increase to the end of the performance. The values of self-efficacy and functional coping in this type are rather low. Of the total sample, half of the musicians were assigned to Type 1 and approximately a quarter each to Type 2 and Type 3. In accordance with the literature, the results confirm the importance of self-efficacy and functional coping for a positive performance experience. (shrink)

Global health conditions are marked by inequities due mostly to poverty and lack of access to healthcare services. In a Pandemic setting, Mayan Communities in the Quintana Roo State in Mexico are a good example of how these disparities are exacerbated. First, they may have difficulty in adhering to directives to stay home from work because of the nature of their job, and the necessity to work, their living conditions are marked by crowding and sometimes lack of basic sanitation. Other (...) susceptibilities generally considered are the underlying host factors and medical conditions that may increase the risk of disease or of complications of disease. In general, our native communities experience a high degree of socio-economic marginalization and are at disproportionate risk in public health emergencies, becoming even more vulnerable during this global pandemic, owing to factors such as their lack of access to effective monitoring and early-warning systems, and adequate health and social services. The precautionary principle (PP) aims to anticipate and minimize potentially serious or irreversible risks under conditions of scientific uncertainty. Thus it preserves the potential for future developments. It has been incorporated into many international treaties and pieces of national legislation for environmental protection and sustainable development. In this article, we outline an interpretation of the PP as a framework of orientation for a sustainable information society. Since the risks induced by future information and communication technologies (ICT) are social risks for (...) the most part, we propose to extend the PP from mainly environmental to social subjects of protection. From an ethical point of view, the PP and sustainability share the principle of intergenerational justice, which can be used as an argument to preserve free space for the decisions of future generations. Applied to technical innovation and to ICT issues in particular, the extended PP can serve as a framework of orientation to avoid socio-economically irreversible developments. We conclude that the PP is a useful approach for: (i) policy makers to reconcile information society and sustainability policies and (ii) ICT companies to formulate sustainability strategies. Clinical Ethics Consultation (CEC) has grown significantly in the last decade, and efforts are being made to professionalize the practice. The American Society for Bioethics and Humanities (ASBH) has been instrumental in this process, having published the _Code of Ethics and Professional Responsibilities for Healthcare Ethics Consultants_ and founded and endorsed the creation of the _Healthcare Ethics Consultant Certified (HCEC) Certification Commission._ The ASBH also published “core competencies” for healthcare ethics consultants and has delineated a clear identity and role of (...) such consultants distinct from that other healthcare professionals. In addition, more enter the field armed with advanced degrees (MA and PhD) or certification in clinical ethics consultation. While some have questioned the trend toward professionalization, the momentum is clearly in its favor. This paper explores three questions: Does the professionalization of healthcare ethics consultation expose those engaged in the field to the types of liability claims faced by professionals in other fields? What specific liabilities could affect a healthcare ethics consultant? And finally, what should healthcare ethics consultants do to protect themselves against liability claims? We conclude that while the risk of liability remains low, those engaged in the field should accept that risk just as part of their status as professionals and, like those in allied professions, seek appropriate protection in the form of liability insurance. Although the exclusion of LGBTs from the rites and rights of marriage is arbitrary and unjust, the legal institution of marriage is itself so riddled with injustice that it would be better to create alternative forms of durable intimate partnership that do not invoke the power of the state. Card's essay develops a case for this position, taking up an injustice sufficiently serious to constitute an evil: the sheltering of domestic violence.

For music students, the COVID-19 pandemic has had a great impact, forcing them to adapt to certain coronavirus regulations laid down by the state. In this study, the experiences of music students in three consecutive semesters under different coronavirus-related conditions are investigated. At the end of three semesters, the lockdown semester [SS 2020: April – July], a partially opened semester [WS 2020/21: October – February] and a mostly opened semester, a total of 152 music students at the University of Music (...) Freiburg were asked to fill in an online survey. A mixed-methods approach was used, with results showing that the qualitative statements of the students support the quantitative data. The results of the cross-sectional study demonstrate that self-regulated learning improved during the lockdown semester, through new time management and focused practice with regular breaks. During the partially opened semester, the use of blended learning formats led to organizational problems, such as travel time and change of locations. Furthermore, music students were challenged by the social distancing, which improved during the partially opened, and mostly opened semester. New technologies regarding digital communication formats were emerged, which have evolved over the course of the three semesters. Concerning the overall experience, students stated that the partially-opened semester was most challenging, since distances and change of locations had to be combined with quickly changing public COVID-19-regulations. These findings during different stages of the COVID-19 pandemic provide constructive starting points for future teaching. (shrink)

The biopsychosocial model is characterized by the systematic consideration of biological, psychological, and social factors and their complex interactions in understanding health, illness, and health care delivery. This model opposes the biomedical model, which is the foundation of most current clinical practice. In the biomedical model, quest for evidence based medicine, the patient is reduced to molecules, genes, organelles, systems, diseases, etc. This reduction has brought great advances in medicine, but it lacks a holistic view of the person. To solve (...) the problem, we propose an early team based approach where the primary care physician leads a group of people that can help her/him address the psychosocial issues while she/he attends to the biomedical issues. This article addresses one case where the clinical ethicist facilitating a team based biopsychosocial model for the care of a patient worked as a bridge between the primary team, the critical care team, and the psychosocial team to advance the argument that good communication among the groups can lead to a true biopsychosocial model where the collaboration of the social worker, psychologist, chaplain, ethicist and the different medical teams can improve the overall patient experience. Resumo:Neste artigo pretendemos aproximar reflexões sobre a linguagem apresentadas pelo filósofo Friedrich Nietzsche em seu texto Sobre verdade e mentira no sentido extramoral, e a filosofia pagã do heterônimo de Fernando Pessoa, Alberto Caeiro. Utilizaremos no corpus desta análise o texto de Nietzsche já citado, a obra O Guardador de Rebanhos de autoria de Caeiro, e alguns textos em prosa de Fernando Pessoa, António Mora, Ricardo Reis e Álvaro de Campos. O artigo está dividido em três partes: na primeira, mostraremos (...) as leituras que Pessoa realizou sobre a obra de Nietzsche, no segundo momento mostraremos a dinâmica de linguagem que envolve a filosofia pagã de Alberto Caeiro e suas possíveis relações com a crítica realizada pelo jovem Nietzsche sobre a linguagem e no terceiro momento a relação entre o paganismo de Nietzsche e do mestre Caeiro à luz dos escritos de António Mora, Fernando Pessoa e Ricardo Reis.:In this article we intend to establish the relation between the meditations about language presented by the philosopher Friedrich Nietzsche in his text On Truth and Lie in an Extra-Moral Sense and the pagan philosophy of Alberto Caeiro, an heteronym of Fernando Pessoa. We will use in the body of this analysis the text of Nietzsche already referred, the work The Keeper of Sheep by Alberto Caeiro and some prose texts of Fernando Pessoa, António Mora, Ricardo Reis and Álvaro de Campos. This article is divided in three parts: in the first part, we'll show Pessoa's readings about the work of Nietzsche, in a second moment we'll elucidate the dynamic of language concerning the pagan philosophy of Alberto Caeiro and its possible relations with the criticism about language in the early work of young Nietzsche and in a third moment the relation between the paganism of Nietzsche and the one attributed to master Caeiro in the light of the writings of António Mora, Fernando Pessoa and Ricardo Reis. Neste texto, procuro encontrar as origens de um dos mais importantes conceitos de Gilles Deleuze, o conceito de Imagem-tempo. Este conceito remete-nos para os primeiros textos de Deleuze dedicados à filosofia de Espinosa e ao problema do autómato espiritual e relaciona-se directamente com o problema da passividade/actividade do espectador. Ou seja, o conceito crucial na sua filosofia do cinema, a Imagem-tempo, esconde uma importante reflexão sobre a Imagem cinematográfica como arte de massas, os (im)poderes do pensamento e o modo fascista (...) de se pensar. This text seeks to find the origins of one of the most important of Gilles Deleuze's concepts, the concept of Time-image. This concept leads us to his first texts regarding Spinoza's philosophy and the problem of the spiritual automaton, and concerns directly with the problem of passivity/activity of the film goer. That is to say that the crucial concept of his film philosophy, Time-image, hides a fundamental consideration on the cinematic image as a mass art, the (un)powers of thinking and the fascist way of thought. El aumento de la complejidad sintáctica evidencia el desarrollo lingüístico de los niños. El uso de ciertas medidas de lenguaje permite dar cuenta de dicho proceso, lo que ha sido corroborado en niños preescolares hispanohablantes y en niños en etapas tardías de desarrollo. Este trabajo propone explorar dicho desarrollo contrastando a un grupo de niños chilenos con desarrollo típico que asisten a preescolar con un grupo de primer año básico. Las medidas incluyeron índices primarios y secundarios de complejidad y se (...) obtuvieron a partir de recontados narrativos producidos por los niños. En los resultados se observa que no todos los índices aumentan al contrastar los dos grupos. Solo aumenta un índice primario de densidad clausular dentro de las oraciones complejas y el número de subordinadas sustantivas, particularmente en las etapas narrativas de presentación y final; en paralelo, disminuye el número de subordinadas adverbiales en la fase de final. Estos resultados evidencian que, si bien se observa un aumento en algunas medidas de complejidad al contrastar los grupos, el desarrollo de estas habilidades no presenta un mismo patrón en todas las dimensiones, lo que puede deberse a factores discursivos o del propio proceso de desarrollo lingüístico. Rather than emphasizing the tension between the individual and community, and far from understanding the political on the ground of instinctual sacrifice, Greek thought illuminates the interdependence of ethics and politics, and situates the human being in a cosmos in which the human is neither central nor prominent. Das Aufgreifen tradierter Motive, speziell des frühneuzeitlichen Vanitas-Topos, lässt sich in zeitgenössischer Literatur, Theater und bildender Kunst beobachten. Insbesondere die Videokunst weist dabei eine Affinität zum malerischen Genre des Stilllebens auf, welches im Kontext des Topos mit moralisch-religiösen und philo- sophischen Fragen verbunden ist und eine Integration unterschiedlicher Zeitmodi ermöglicht. In Anlehnung sowohl an frühneuzeitliche Zeitkonzepte als auch an aktuelle Theorieansätze werden Gestaltungsformen von Zeitlichkeit untersucht, die durch Film- und Videotechnik entstehen, dabei die innerbildlichen Tempora- litäten statischer Stillleben erweitern und (...) die Symbolik der Vanitas resemantisieren, verfremden oder negieren. Es wird nicht nur gezeigt, wie diese Symbole in der Gegenwartskunst eingesetzt werden, um über Vergänglichkeit und Tod zu reflek- tieren, sondern insbesondere, welche Möglichkeiten neue Technologien aufweisen, das Vergehen von Zeit ästhetisch zu gestalten. Der Beitrag präsentiert eine erste Systematisierung von Vanitas-Stillleben in der Videokunst und gibt einen Einblick in facettenreiche Auseinandersetzungen mit einem klassischen Genre. (shrink)

Resumo: Este artigo busca dizer da multiplicidade que povoa a escola: de corpos, de acontecimentos, de vida. Busca com base na leitura Deleuze-Guattariana de instrumentos conceituais de Spinoza, na afirmação da multiplicidade que habita a docência, dar-lhes novos sentidos, nas redes de conversações nas veredas de afetos que atravessam o cotidiano escolar. Utiliza, como metodologia, redes de conversações, modos de dizer das experiências vividas, estabelecidas com professoras em encontros quinzenais realizados em escolas públicas situadas em bairros periféricos. A noção spinozana (...) de afeto nos remete à noção de encontro. Assim, conclui que as conversações apontam para a necessária composição de um corpo múltiplo escolar, onde a criação se faça pela abertura à liberdade; pela superação do dogmatismo, normatização e hierarquização; pelos tempos livres para que os encontros sejam possíveis; enfim, pelo encontro nos entremeios de uma educação que una o inteligível ao sensível e o conhecimento se teça pelos afetos e afecções experimentados. Spinoza and the paths of affection in teaching as multiple bodies in school daily life Abstract: This article seeks to talk about the multiplicity that populates the school: of bodies, of events, of life. Based on Deleuze-Guattarian's reading of Spinoza's conceptual instruments, in the affirmation of multiplicity that inhabits teaching, to give them new meanings, in the networks of conversations in the paths of affections that cross everyday school life. It uses, as a methodology, conversation networks, ways of talking about lived experiences, established with teachers in fortnightly meetings held in public schools located in peripheral neighborhoods. Spinoza’s notion of affection takes us to the notion of encounter. Thus, he concludes that the conversations point to the necessary composition of a multiple school body, where creation takes place through openness to freedom; by overcoming dogmatism, normalization and hierarchization; for free time so that meetings are possible; finally, through the encounter during an education that unites the intelligible with the sensitive and knowledge is woven through the affections and affections experienced. A reputation for being a "badass" in this context is a source of self‐esteem and of others' respect. But self‐esteem and respect, unqualified, are thought to be goods. Immanuel Kant analyzes human moral psychology, first, in terms of three predispositions, all basically good, which he calls the predispositions to animality, to humanity, and to personality. Animality is a predisposition to be motivated by "physical or merely mechanical self‐love", for self‐preservation, propagation of the species, and even for "community with other human (...) beings". There is a kind of self‐interest more basic than the prudence that Kant usually has in mind when he refers to self‐interest or self‐love. Christine Korsgaard develops a Kantian view of the sources of normativity that locates their roots in one's self‐conception. Interpersonal psychology lends support and amplification to Korsgaard's view that normativity is rooted in one's self‐concept. (shrink)

Marilyn Frye's first book, The Politics of Reality: Essays in Feminist Theory, presents nine philosophical lectures: four on women's subordination, four on resistance and rebellion, one on revolution. Its approach combines a lesbian perspective with analytical philosophy of language. The major contributions of the book are its analysis of oppression, highly suggestive discussions of the roles of attention in knowledge and ignorance and in arrogance and love, a defense of political separatism not based on female supremacism, and a development of (...) the idea of lesbian epistemology. Its proposal for resisting White racism will be controversial. Its treatment of gay rights is not balanced by an acknowledgement that drag queens, like “totaled women,” are products of oppression, not simply of intolerance. The most philosophically problematic aspect of the book is its analysis of coercion and of the roles of coercion in women's subordination. This creates an unresolved tension with the positive message of the second half of the book. Despite this difficulty, these essays are an outstanding contribution to contemporary feminist theory. En 2011 el señor Mario Posada Ochoa donó a la Universidad EAFIT una extensa y poco conocida colección de arte; acaso unos cuantos amigos habrían visto de cerca las 480 obras que recibió la Universidad, de artistas como Segundo Angelvis, Inés Acevedo Bernal, Sergio Trujillo Magnenat, Luis A. Rengifo y Ramón Vásquez, entre otros. Algunas de ellas carecían de la firma del autor o de un dato que comprobara la autoría, y estaban deterioradas, más que por el tiempo, por el (...) improvisado bodegaje: don Mario las había guardado durante cuarenta años en su hermosa casa de Maracaibo, en el centro de la ciudad. En Extensión Cultural de EAFIT han procurado, desde entonces, conservar este legado. (shrink)

ADHD is a psychiatric disorder characterised by persistent and developmentally inappropriate levels of inattention, impulsivity and hyperactivity. It is known that children with ADHD tend to produce incoherent discourses, e.g. by narrating events out of sequence. Here the aetiology of ADHD becomes of interest. One prominent theory is that ADHD is an executive function disorder, showing deficiencies of planning. Given the close link between planning, verb tense and discourse coherence postulated in van Lambalgen and Hamm (The proper treatment of events, (...) 2004), we predicted specific deviations in the verb tenses produced by children with ADHD. In this article, I respond to David McIvor’s and Lars Rensmann’s discussion of my recent book, The Politics of Repressed Guilt: The Tragedy of Austrian Silence (2018, Edinburgh University Press). Both invited me to clarify my use of Arendt in my conception of embodied reflective judgment. I argue for a stronger connection between judgment and emotions than Arendt because one can effectively shut down critical thinking if one uses defense mechanisms to repress feelings of guilt. In response to McIvor, I (...) discuss the idea of the “subject-in-outline” and “embodied reflective spaces” to overcome the guilt/defense complex to engender a reparative politics of justice. Finally, in response to Rensmann, I point out that the lingering culture of repressed guilt helps us explain the general conditions that contributed to the rise of the far and extremist right in Austria, which I develop further in my new book Analyzing the Far Right. Louis Althusser is the blemish on the field of political theory. His barely explored and partly forgotten contributions are nonetheless formative for contemporary critical thought. Interestingly, at their very core his interventions are based on his own extensive readings of early modern political thought. Therefore, this study traces Althusser's readings of Machiavelli, Hobbes, Locke, Rousseau and Montesquieu and is the first to do so. Building on this, the study demonstrates how Althusser's new foundation of Marxism, which is very much alive (...) today, arises from this part of his work. Thereby, it becomes visible how the post-Marxist paradigm, which Althusser's many important students further developed, is formed through his readings of the classic thinkers of the bourgeois state. This article contains an analysis of Warren Neidich’s early photographic work of 1997 until 2002. These works are linked to the extensive theoretical production of the artists who connect them to the concepts of the dispositif and apparatus respectively. The article provides a close description of the parameters of four pivotal work groups of Neidich’s early practice, Brain Wash (1997), Double Vision (1997—2000), Shot Reverse Shot (2001) and Law of Loci (1998—9). These works were realized with the aid of low-tech (...) devices stemming from neuro-ophthalmology, marking the interface between current neuro-philosophical discourses such as the plasticity of the brain, the apparati of visual, i.e. analog and digital, culture and the philosophy of memory. It is suggested that Neidich, even though he intervenes and contributes importantly to these intermingling discourses in a broad manner, is particularly interested in the degraded and infirm implementations of human vision in order to explore new sensations and habits of perception.
