Zusammenfassung Lebensweltliche Bedingungen können sich als Barrieren in Hinblick auf die Durchführung einer von den Patient*innen gewählten – beispielsweise onkologischen – Therapie erweisen und den Therapieerfolg gefährden. Solche lebensweltlichen Herausforderungen lassen sich als Schichten sozialer Vulnerabilität begreifen. In dieser Arbeit wird untersucht, ob es geboten ist, herausfordernde soziale Lebensbedingungen von Patient*innen systematisch bei Therapieentscheidungen zu berücksichtigen. Hierfür wird der Befähigungsansatz nach Martha Nussbaum herangezogen, der die Achtung der Patient*innenautonomie mit der Möglichkeit der Unterstützung durch Dritte zusammenbringt. Anschließend werden anhand des (...) Schichten-Konzeptes von Florencia Luna Vorschläge dafür formuliert, wie soziale Vulnerabilitäten in der Praxis erfasst werden könnten. Obwohl die Überlegungen zum vorliegenden Text aus Beobachtungen der onkologischen Behandlungssituation heraus entstanden sind, lassen sie sich auch auf andere Therapiefelder, die lange Behandlungsdauern mit regelmäßigen Anwesenheiten verlangen, übertragen. Die vorliegende Untersuchung kommt zu dem Ergebnis, dass die ethische Pflicht besteht, lebensweltliche Faktoren in gemeinsame Therapieentscheidungen miteinzubeziehen und den Patient*innen ggf. Unterstützung anzubieten, um den Zugang zu der von ihnen gewählten Therapie zu ermöglichen. (shrink)

Die in diesem Sammelband vereinigten Überlegungen stehen unter der zweiteiligen übergreifenden Überschrift "Deliberative Kritik – Kritik der Deliberation", die in einem Zug den kritischen Sinn der Deliberation und die Notwendigkeit einer reflexiven Kritik am Konzept der Deliberation selbst deutlich macht. Neben Erkundungen der Ideengeschichte und der normativen Grundlagen der Deliberation geht es um eine (...) Auseinandersetzung mit alternativen Konzeptionen und institutionellen Kontexten. ABSTRACT Truth-conditions are systematically determined when they are the output of an algorithmic procedure that takes as input a set of semantic and contextual features. Truth-conditional sceptics have cast doubts on the thesis that truth-conditions are systematic in this sense. Against this form of scepticism, Schoubye and Stokke : 759–793) and Dobler : 451–474.) have provided systematic analyses of utterance truth-conditions. My aim is to argue that these theories are not immune to the kind of objections raised by truth-conditional sceptics. (...) Many scholars in the area of citizenship education take deliberative approaches to democracy, especially as put forward by John Rawls, as their point of departure. From there, they explore how students’ capacity for political and/or moral reasoning can be fostered. Recent work by political theorist Chantal Mouffe, however, questions some of the central tenets of deliberative conceptions of democracy. In the paper I first explain the central differences between Mouffe’s and Rawls’s conceptions of democracy and politics. To this end I (...) take Eamonn Callan’s Creating Citizens as an example of Rawlsian political education and focus on the role of conflict and disagreement in his account. I then address three areas in which political education would need to change if it were to accept Mouffe’s critiques of deliberative approaches to democracy and her proposal for an agonistic public sphere. The first area is the education of political emotions; the second is fostering an understanding of the difference between the moral and the political; the third is developing an awareness of the historical and contemporary political projects of the “left” and “right.” I propose that a radical democratic citizenship education would be an education of political adversaries. Presenting real life cases from clinical practice, this book claims that children can be conceived of as moral equals without ignoring the fact that they still are children and in need of strong family relationships. Drawing upon recent advances in childhood studies and its key feature, the ‘agentic child’, it uncovers the ideology of adultism which has seeped into much what has been written about childhood ethics. However, this book also critically examines those positions that do accord moral equality to (...) children but on grounds not strong enough to support their claim. It lays the groundwork for a theory of moral equality by assessing the concepts of parenthood, family, best interest, paternalism, and, above all, autonomy and trust which are so important in envisioning what we owe the child. It does not only show how children – like adults – should be considered moral agents from infancy but also how ethical theories addressing adults can significantly profit from recognizing this. The analysis takes into account contributions from European as well as American scholars and makes use of a wide range of ethical, psychological, cultural, and social-scientific research. (shrink)

In the present interview, Jürgen Habermas answers questions about his wide-ranging work in philosophy and social theory, as well as concerning current social and political developments to whose understanding he has made important theoretical contributions. Among the aspects of his work addressed are his conception of communicative rationality as a countervailing force to the colonization of the lifeworld by capitalism and his understanding of philosophy after Hegel as postmetaphysical thinking, for which he has recently provided a comprehensive historical grounding. The article introduces the problematics of the classical two-valued logic on which Western thought is generally based, outlining that under the conditions of its logical assumptions the subject I is situated in a world that it cannot address. In this context, the article outlines a short history of cybernetics and the shift from first- to second-order cybernetics. The basic principles of Gordon Pask’s 1976 Conversation Theory are introduced. It is argued that this second-order theory grants agency to others through a (...) re-conception of living beings as You logically transcending the I. The key principles of Conversation Theory are set in relation to the poetic forms of discourse that played a key role in art as well as philosophical thinking in China in the past. Second-order thinking, the article argues, is essentially poetic. It foregoes prediction in favour of the potentiality of encountering tomorrow’s delights. (shrink)

In the last twenty years, recorded messages and written notes have become a significant test and an intriguing puzzle for the semantics of indexical expressions (see Smith 1989, Predelli 1996, 1998a,1998b, 2002, Corazza et al. 2002, Romdenh-Romluc 2002). In particular, the intention-based approach proposed by Stefano Predelli has proven to bear interesting relations to several major questions in philosophy of language. In a recent paper (Saul 2006), Jennifer Saul draws on the literature on indexicals and recorded messages in order to (...) criticize Rae Langton's claim that works of pornography can be understood as illocutionary acts – in particular acts of subordinating women or acts of silencing women. Saul argues that it does not make sense to understand works of pornography as speech acts, because only utterances in contexts can be speech acts. More precisely, works of pornography such as a film may be seen as recordings that can be used in many different contexts – exactly like a written note or an answering machine message. According to Saul, bringing contexts into the picture undermines Langton's radical thesis – which must be reformulated in much weaker terms. In this paper, I accept Saul's claim that only utterances in contexts can be speech acts, and that therefore only works of pornography in contexts may be seen as illocutionary acts of silencing women. I will, nonetheless, show that Saul's reformulation doesn't undermine Langton's thesis. To this aim, I will use the distinction Predelli proposes in order to account for the semantic behaviour of indexical expressions in recorded messages – namely the distinction between context of utterance and context of interpretation. In recent times, phenomena of conversational asymmetry have become a lively object of study for linguists, philosophers of language and moral philosophers—under various labels: illocutionary disablement and silencing, discursive injustice :440–457, 2014; Lance and Kukla in Ethics 123:456–478, 2013), illocutionary distortion. The common idea is that members of underprivileged groups sometimes have trouble performing particular speech acts that they are entitled to perform: in certain contexts, their performative potential is somehow undermined, and their capacity to do things with words is (...) distorted or even annulled. In this paper I will assess this idea, focusing on Rebecca Kukla’s and Rae Langton’s accounts; in particular, I will criticize the role the notion of uptake plays in their accounts, and claim that it may ultimately undermine the very idea of discursive injustice. While, according to Kukla and Langton, members of disadvantaged groups are victims of a kind of uptake failure, leading to illocutionary disablement and even silencing, in the account I present they are victims of a kind of communicative disablement. My overall aim is to develop a notion of discursive injustice that is more plausible and more effective for our broader purposes of criticising the structures of power and oppression. (shrink)

One way to silence the powerless, Langton has taught us, is to pre-emptively disable their ability to do things with words. In this paper I argue that speakers can be silenced in a different way. You can let them speak, and obscure the meaning of their words afterwards. My aim is to investigate this form of silencing, that I call retroactive distortion. In a retroactive distortion, the meaning of the words of a speaker is distorted by the effect of a (...) subsequent speech act by a different speaker. After introducing this notion, I explore some reasons why retroactive distortions can be difficult to challenge and argue that, besides constituting a communicative injustice, they can eliminate topics from public consideration and therefore erode public debate. According to Mitchell Green, speech act theory traditionally idealizes away from crucial aspects of conversational contexts, including those in which the speaker’s social position affects the possibility of her performing certain speech acts. In recent times, asymmetries in communicative situations have become a lively object of study for linguists, philosophers of language and moral philosophers: several scholars view hate speech itself in terms of speech acts, namely acts of subordination. The aim of this paper is to address one of the (...) main objections to accounts of hate speech in terms of illocutionary speech acts, that is the Authority Problem. While the social role of the speaker is the focus of several approaches, the social role of the audience has too often been neglected. The author will show that not only must the speaker have a certain kind of standing or social position in order to perform speech acts of subordination, but also the audience must typically have a certain kind of standing or social position in order to either license or object to the speaker’s authority, and her acts of subordination. Social death, central to the evil of genocide, distinguishes genocide from other mass murders. Loss of social vitality is loss of identity and thereby of meaning for one's existence. Seeing social death at the center of genocide takes our focus off body counts and loss of individual talents, directing us instead to mourn losses of relationships that create community and give meaning to the development of talents.

Statements such as “X is beautiful but I don’t like how it looks” or “I like how X looks but it is not beautiful” sound contradictory. How contradictory they sound might however depend on the object X and on the aesthetic adjective being used (“beautiful”, “elegant”, “dynamic”, etc.). In our study, the first sentence was estimated to be more contradictory than the latter: If we describe something as beautiful, we often intend to evaluate its appearance, whereas it is less counterintuitive (...) to appreciate an appearance without finding it beautiful. Furthermore, statements including “beautiful” appeared more contradictory than those including “elegant” and “dynamic”, pointing to its greater evaluative component. When related to artworks, sentences could appear less contradictory due to readers’ consideration of the divergence between conventional beauty and art-related sensory pleasures that can even include negative valence. Such ambivalence might be more frequent in art-objects than in other artefacts. Indeed, in our study, sentences referring to artworks were estimated to be less contradictory compared to sentences referring to other artefacts. Meanwhile, an additional small group of graphic design students showed a less clear difference between art-related and non-art-related sentences. We discuss the potential influence of art experience and interest as well as theoretical and methodological challenges like the conceptualization of beauty. (shrink)

Die vorliegende Studie erschließt erstmals umfassendden Zurechnungsbegriff in Kants praktischer Philosophie. Ein Zurechnungsurteil bringt zum Ausdruck, dass eine Handlung auf den freien Willen einer bestimmten Person zurückgeführt wird. Zurechnung ist ein zentraler Begriff des Rechts und von grundlegender Bedeutung für unsere alltägliche Praxis, wenn wir andere Personen loben, tadeln oder dankbar sind. Eine fundamentale Relevanz des Zurechnungsbegriffs zeigt die Autorin auch für Kants praktische Philosophie auf. Ausgehend von Kants Definition des Zurechnungsbegriffs in der Metaphysik der Sitten wird deutlich, wie Zurechnung (...) mit anderen zentralen Begriffen von Kants Handlungs- und Moraltheorie verknüpft ist: sowohl für die Auflösung der Freiheitsantinomie als auch für den Begriff der Person als freiem, moralischem Subjekt und Träger eines Gewissens ist Zurechnung ein Schlüsselbegriff. Am Leitfaden des Zurechnungsbegriffs entsteht ein differenziertes Bild der praktischen Philosophie Kants, das diese auch aus heutiger Sicht attraktiv und tragfähig erscheinen lässt. In systematischer Hinsicht schlägt die Arbeit einen Bogen zu aktuellen Debatten und zeigt, dass Kants Theorie in zentralen Punkten anschlussfähig ist. (shrink)

There is widespread agreement that an adequate understanding of the nature of science (NOS) is a critical component of scientific literacy and a major goal in science education. However, we still do not know many specific details regarding how students and teachers learn particular aspects of NOS and what are the most important feature traits of instruction. In this context, the main objective of this review is to analyze articles from nine main science education journals that consider the teaching of (...) NOS to K-12 students, pre-service, and in-service science teachers in search of patterns in teaching and learning NOS. After reviewing 52 studies in nine journals that included data regarding participants’ views of NOS before and after an intervention, the main findings were as follows: (1) some aspects of NOS (empirical basis, observation and inference, and creativity) are easier to learn than others (tentativeness, theory and law, and social and cultural embeddedness), and subjective aspects of NOS and “the scientific method” seemed to be difficult for participants to understand; (2) the interventions most frequently lasted 5 to 8 weeks for students, one semester for pre-service teachers, and 1 year for experienced teachers; and (3) most of the interventions incorporated both decontextualized and contextualized activities. Given the substantial diversity in the methods and intervention designs used and the variables studied, it was not possible to infer a pattern of more-effective NOS teaching strategies from the reviewed studies. Future investigation should focus on (a) disentangling whether a difference exists between the easy and difficult aspects of learning NOS and formulating a theoretical explanation for distinguishing the two types of aspects and (b) assessing the effectiveness of different kinds of courses (e.g., history of science, NOS or informal) and strategies (e.g., hands-on vs. drama activities; SSI vs. HOS). It has been argued that Kants actions. However, it would be uncompromising to allow for only two possibilities: either full responsibility or none. Moreover, in the Metaphysics of Morals Kant himself claims that there can be degrees of responsibility, depending on the magnitude of the obstacles that have to be overcome when acting. I will show that this claim is consistent with Kant’s theory as a whole and thereby make transparent how degrees of responsibility are possible for Kant. The solution (...) is based on the distinction between two senses of responsibility: taking oneself to be an accountable person is an all-or-nothing affair, whereas praise- or blameworthiness for a particular action can still be a matter of degree. An increasing amount of research has examined the management of competing logics, and possible tensions arising between them, within “hybrid organizations.” However, the ways in which the relationships of hybrids with other organizations shape the conciliation of these logics and tensions have received limited attention so far. In this theoretical paper, we examine how hybrid organizations deal with interorganizational collaboration, in particular whether and how their hybridity can be maintained when they partner with “dominant-logic organizations.” Drawing on empirical literature on (...) social enterprise–corporate collaborations, we develop a framework and several propositions on how competing logics and their balancing within hybrid organizations may be affected by interactions with organizations underpinned by one dominant logic. We suggest that influences will mostly depend on the type of collaboration pursued. A collaboration based on a lower level of engagement and interaction between the two partners is likely to give precedence to one logic over the other, reducing inter-logic tensions but possibly compromising organizational hybridity. By contrast, a collaboration featuring numerous interactions and mission compatibility may facilitate sustained hybridity if tensions are acknowledged and managed. Our propositions contribute to the literatures on hybrid organizations, interorganizational collaboration, and social enterprise. (shrink)

Pragmatic modulation makes contextual information necessary for interpretation. This poses a problem for homophonic reports and inter-contextual communication in general: of co-situated interlocutors, we can expect some common ground, but non-co-situated interpreters lack access to the context of utterance. Here I argue that we can nonetheless share modulated contents via homophonic reports. First, occasion-unspecific information is often sufficient for the recovery of modulated content. Second, interpreters can recover what is said with different degrees of accuracy. Homophonic reports and inter-contextual communication (...) are often successful because the reporting context does not demand full accuracy. (shrink)

Scientists engaged in global health research are increasingly faced with barriers to access and use of human tissues from the developing world communities where much of their research is targeted. In part, the problem can be traced to distrust of researchers from affluent countries, given the history of 'scientific-imperialism' and 'biocolonialism' reflected in past well publicized cases of exploitation of research participants from low to middle income countries. To a considerable extent, the failure to adequately engage host communities, the opacity (...) of informed consent, and the lack of fair benefit-sharing have played a significant role in eroding trust. These ethical considerations are central to biomedical research in low to middle income countries and failure to attend to them can inadvertently contribute to exploitation and erode trust. A 'tissue trust' may be a plausible means for enabling access to human tissues for research in a manner that is responsive to the ethical challenges considered. Preventing exploitation and restoring trust while simultaneously promoting global health research calls for innovative approaches to human tissues research. A tissue trust can reduce the risk of exploitation and promote host capacity as a key benefit. (shrink)

Implicating, as it is conceived in recent pragmatics, amounts to conveying a (propositional) content without saying it – a content providing no contribution to the truth-conditions of the proposition expressed by the sentence uttered. In this sense, implicating is a notion closely related to the work of Paul Grice (1913-1988) and of his precursors, followers and critics. Hence, the task of this article is to introduce and critically examine the explicit/implicit distinction, the Gricean notion of implicature (conventional and conversational) and (...) its recent developments and connections with the speaker's intentions, communicative responsibility and rationality. This short paper responds to the essays by Shilpi Sinha, Shaireen Rasheed, and Lyudmila Bryzzheva. It considers how racial inequality between teachers and students affects the possibilities of educational hospitality, both in cases of white teachers teaching racialized students and in cases of racialized teachers teaching white students. The response takes a phenomenological turn, considering the relative vulnerability of bodies that encounter each other in educational spaces which, themselves, are not neutral.

Contextualism is a view about meaning, semantic content and truth-conditions, bearing significant consequences for the characterisation of explicit and implicit content, the decoding/inferring distinction and the semantics/pragmatics interface. According to the traditional perspective in semantics (called "literalism" or "semantic minimalism"), it is possible to attribute truth-conditions to a sentence independently of any context of utterance, i.e. in virtue of its meaning alone. We must then distinguish between the proposition literally expressed by a sentence ("what is said" by the sentence, its (...) literal truth-conditions) and the implicit meaning of the sentence ("what is implicated" by a speaker uttering the sentence). Over the past forty years, however, an increasing number of linguists and philosophers have begun to underline the phenomenon of semantic underdetermination: the encoded meaning of the sentence employed by a speaker underdetermines the proposition explicitly expressed by an utterance of that sentence. According to the extreme version of this perspective – labelled "radical contextualism" - no sentence of a natural language expresses a complete proposition, or has fixed truth-conditions, even when unambiguous and devoid of indexicals. A sentence expresses a proposition only when completed and enriched with pragmatic constituents that do not correspond to any syntactic element of the sentence and yet are part of its semantic interpretation. More broadly, "contextualism" may be used to refer to a family of views which includes moderate contextualism (also called "indexicalism"), radical contextualism and non-indexical contextualism – and which contrasts with semantic minimalism. The notion of politicization has been often assimilated to that of partisanship, especially in political and social sciences. However, these accounts underestimate more fine-grained, and yet pivotal, aspects at stake in processes of politicization. In addition, they overlook cognitive mechanisms underlying politicizing practices. Here, we propose an integrated approach to politicization relying on recent insights from both social and political sciences, as well as cognitive science. We outline two key facets of politicization, that we call partial indetermination and contestability, and (...) we show how these can be accounted for by appealing to recent literature in cognitive science concerned with abstract conceptual knowledge. We suggest that politicizing a concept often implies making its more abstract components more salient, hence legitimating its contestable character. Finally, we provide preliminary suggestions to test our proposal, using the concept of gender as case study. (shrink)

Although the exclusion of LGBTs from the rites and rights of marriage is arbitrary and unjust, the legal institution of marriage is itself so riddled with injustice that it would be better to create alternative forms of durable intimate partnership that do not invoke the power of the state. Card's essay develops a case for this position, taking up an injustice sufficiently serious to constitute an evil: the sheltering of domestic violence.

Over the last decades, various predictors have proven relevant for job performance [e.g., general mental ability, broad personality traits, such as the Big Five]. However, prediction of job performance is far from perfect, and further potentially relevant predictors need to be investigated. Narrower personality traits, such as individuals' character strengths, have emerged as meaningfully related to different aspects of job performance. However, it is still unclear whether character strengths can explain additional variance in job performance over and above already known (...) powerful predictors. Consequently, the present study aimed at examining the incremental validity of character strengths as predictors of job performance beyond GMA and/or the Big Five traits and identifying the most important predictors of job performance out of the 24 character strengths, GMA, and the Big Five. Job performance was operationalized with multidimensional measures of both productive and counterproductive work behavior. A sample of 169 employees from different occupations completed web-based self-assessments on character strengths, GMA, and the Big Five. Additionally, the employees' supervisors provided web-based ratings of their job performance. Results showed that character strengths incrementally predicted job performance beyond GMA, the Big Five, or GMA plus the Big Five; explained variance increased up to 54.8, 43.1, and 38.4%, respectively, depending on the dimension of job performance. Exploratory relative weight analyses revealed that for each of the dimensions of job performance, at least one character strength explained a numerically higher amount of variance than GMA and the Big Five, except for individual task proactivity, where GMA exhibited the numerically highest amount of explained variance. The present study shows that character strengths are relevant predictors of job performance in addition to GMA and other conceptualizations of personality. This also highlights the role of socio-emotional skills, such as character strengths, for the understanding of performance outcomes above and beyond cognitive ability. (shrink)

"What do grown children owe their parents?" Over two decades ago philosopher Jane English asked this question and came up with the startling answer: nothing (English 1979). English joins many contemporary philosophers in rejecting the once-traditional view that grown children owe their parents some kind of fitting repayment for past services rendered. The problem with the traditional view, as argued by many, is, first, that parents have duties to provide fairly significant services to their growing children, and persons do not (...) owe repayment for others' mere performance of duty; second, even where parents go above and beyond duty in their loving and generous rearing of their children, the benefits are bestowed, at least on young children, without their voluntary acceptance and consent, and so, again, fail to generate any obligation of subsequent repayment on their part (see Blustein 1982: 182-3). Moreover, the entire idiom of obligation and repayment, in English's 1 words, "tends to obscure, or even to undermine, the love that is the correct ground of filial obligation" (352). English's alternative, however -- that children strictly "owe" their parents nothing except what flows naturally from whatever love and affection exist between them -- also strikes many as problematic. Christina Hoff Sommers offers examples of what seem to be clearly delinquent adult children, who simply don't "feel" like sharing their lives with their aging parents, or providing any emotional or financial support to them, and so don't (Sommers 1986: 440-41). Sommers points out that we need some talk of obligations in order to fill in the cracks in human relationships where love and affection fail: "The ideal relationship cannot be 'duty-free,' if only because sentimental ties may come unraveled, often leaving one of the parties at a material disadvantage'" (450-51). Sommers proposes as her alternative to English that legitimate duties arise out of special relationships defined by social roles: being a father or mother, a son or a daughter, "is socially as well as biologically prescriptive; it not only defines what one is; it also defines who one is and what one owes" (447).. The aim of this paper is to evaluate which context determines the illocutionary force of written or recorded utterances—those involved in written texts, films and images, conceived as recordings that can be seen or heard in different occasions. More precisely, my paper deals with the “metaphysical” or constitutive role of context—as opposed to its epistemic or evidential role: my goal is to determine which context is semantically relevant in order to fix the illocutionary force of a speech act, as distinct (...) from the information the addressee uses to ascertain the semantically relevant context. In particular I will try to assess two different perspectives on this problem, a Conventionalist Perspective and an Intentionalist Perspective. Drawing on the literature on indexicals in written texts and recorded messages, I will argue in favor of the Intentionalist Perspective: the relevant context is the one intended by the speaker. Bringing intentions into the picture, however, requires qualification; in particular, I will distinguish my Weak Intentionalist proposal from a Strong Intentionalist one. I will show that the Weak Intentionalist Perspective is flexible enough to deal with cases of delayed communication, but not so unrestricted as to yield counter-intuitive consequences. (shrink)

In my paper, I present two competing perspectives on the foundational problem (as opposed to the descriptive problem) of quantifier domain restriction: the objective perspective on context (OPC) and the intentional perspective on context (IPC). According to OPC, the relevant domain for a quantified sentence is determined by objective facts of the context of utterance. In contrast, according to IPC, we must consider certain features of the speaker’s intention in order to determine the proposition expressed. My goal is to offer (...) a plausible and fair reconstruction of IPC. Drawing a parallel between quantifier domain restriction and standard cases of context dependence as indexicality, I argue that the speaker’s intentions can play a semantic role only if they satisfy an Availability Constraint: an intention must be made available or communicated to the addressee, and for that purpose the speaker can exploit any feature of the objective context (words, gestures, relevance or uniqueness of either the quantificational domain or of the referent in the context of utterance). An intention satisfying the Availability Constraint must be something that a hearer in normal circumstances is able to work out by relying on the physical surroundings of the utterance situation, on utterances exchanged during the previous conversation, and on background knowledge shared by speaker and addressee. Paulo Freire consistently upheld humanization and mutuality as educational ideals. This article argues that conceptualizations of knowledge and how knowledge is sought and produced play a role in fostering humanization and mutuality in educational contexts. Drawing on Mary Shelley’s novel Frankenstein, this article focuses on the two central characters who ‘ardently’ pursue knowledge at all costs. It will be argued that the text suggests two possible outcomes from the pursuit of knowledge. One is mutuality; the other is social disconnectedness.
