A recent paper by Bullock (2018) raises a dilemma for proponents of epistemic paternalism. If epistemic paternalists contend that epistemic improvements contribute to one’s wellbeing, then their view conflates with general paternalism. Instead, if they appeal to the notion of a distinctive epistemic value, their view is unjustified, in that concerns about epistemic value fail to outweigh concerns about personal sovereignty. In this chapter, I address Bullock’s challenge in a way that safeguards the legitimacy of epistemic paternalism, albeit restricting (...) its scope to a limited range of cognitive projects. After shedding light on a problem with how Bullock singles out cases to which the dilemma applies, I argue that there is at least one reasonable way of interpreting the notion of ‘personal autonomy’ which legitimates and justifies undertaking epistemically paternalistic interferences for one’s epistemic good. This dissertation attempts to reconcile the apparent inconsistency between a strong view of divine sovereignty and human moral responsibility. God's absolute sovereignty over his creatures entails that human beings cannot do otherwise than they do. If so, then it would seem to follow that human beings cannot be held morally responsible for their actions. The notion that God has Middle Knowledge is often defended as a way out of this apparent inconsistency. It is argued, however, that counterfactuals of (...) freedom have no truth value. Thus, it is admitted that God's sovereignty is not compatible with human beings having indeterministic freedom. Nevertheless, two considerations motivate an attempt to find a plausible compatibilist theory of moral responsibility. First, a strong case can be made that moral responsibility does not require alternative possibilities. Second, it is unlikely that indeterminism can ground moral responsibility due to the arbitrariness of indeterministic actions. Building on the work of Susan Wolf, John Martin Fischer, and Eleonore Stump, a compatibilist theory of moral responsibility is offered based on a teleological view of human agency. If an agent has a will that is designed to pursue the good as the intellect represents it, and her will is not directly manipulated, then she is morally responsible for her actions as long as her intellect is functioning properly, she knows the difference between right and wrong, and she has values that developed naturally through cognitive interaction with the world. This "Teleological Compatibilism" is immune from the standard objections raised against other compatibilist theories of responsibility. Given the plausibility of this compatibilist account, divine sovereignty and human responsibility can be shown to be consistent. (shrink)

The international network of submarine cables plays a crucial role in facilitating global telecommunications connectivity, carrying over 99% of all internet traffic. However, submarine cables challenge digital sovereignty due to their ownership structure, cross-jurisdictional nature, and vulnerabilities to malicious actors. In this article, we assess these challenges, current policy initiatives designed to mitigate them, and the limitations of these initiatives. The nature of submarine cables curtails a state’s ability to regulate the infrastructure on which it relies, reduces its data (...) security, and threatens its ability to provide telecommunication services. States currently address these challenges through regulatory controls over submarine cables and associated companies, investing in the development of additional cable infrastructure, and implementing physical protection measures for the cables themselves. Despite these efforts, the effectiveness of current mechanisms is hindered by significant obstacles arising from technical limitations and a lack of international coordination on regulation. We conclude by noting how these obstacles lead to gaps in states’ policies and point towards how they could be improved to create a proactive approach to submarine cable governance that defends states’ digital sovereignty. Leibniz’ 1669-1671 manuscript “Elements of Natural Right” – first published in the 21st century – provides keen insights into problems of political philosophy and marks the outset of Leibniz’ engagement with the Hobbesian indivisible sovereignty idea. While concurring with the Sage of Malmesbury that any state worthy of the name is a security system, Leibniz – via reversal of Hobbes’ contention security produces happiness – throws open a series of questions related to “retrotraction” and the state legitimacy problematic. Citizens’ (...) cognitive capacity to link current state crisis manifestations to past ones - to “retrotract” - is seen as determining whether dissolution of the state is immanent, and the functioning of such capacity is described as intimately linked to self-perceived happiness of individuals. The plurality of happiness possibilities in various polities in turn is conceptualized by Leibniz as proof of degrees of state quality and sovereignty, degrees of sovereignty constituting Hobbes’ bête noire. A crucial problem of conflict management is that whatever happens in negotiations will be interpreted and framed by stakeholders based on their different belief-value systems and world views. This problem will be discussed in the first part of this article as the main cognitive problem of conflict management. The second part develops a general semiotic solution of this problem, based on Charles Peirce's concept of "diagrammatic reasoning." The basic idea is that by representing one 's thought in diagrams, the (...) conditions that determine interpretations can become visible, we can "experiment" with them, and we can change them eventually. The third part, finally, focuses on a concrete tool, called Logical Argument Mapping , that can be used in conflict management to perform such diagrammatic reasoning and to cope with the cognitive problems discussed in the first part. The application of constructivism to “nature” and “wilderness” is intellectually and politically objectionable. Despite a proclivity for examining the social underpinnings of representations, constructivists do not deconstruct their own rhetoric and assumptions; nor do they consider what socio-historical conditions support their perspective. Constructivists employ skewed metaphors to describe knowledge production about nature as though the loaded language use of constructivism is straightforward and neutral. They also implicitly rely on a humanist perspective about knowledge creation that privileges the cognitive (...) class='Hi'>sovereignty of human subject over nature. Politically, the constructivist approach fails to take the scientific documentation of the biodiversity crisis seriously; it diverts attention toward discourses about the environmental predicament, rather than examining that predicament itself; and it indirectly cashes in on, and thus supports, human colonization of the Earth. In the article the specificity of philosophy is considered as a path to spiritual-practical mastering of the world. The spiritual-practical structure of philosophy includes philosophic practice and philosophic consciousness. The latter actualizes in the forms of philosophic thinking and sensory-emotional reflection of reality. Philosophical sensuality has a wide range of manifestations, but its specificity is defined by the emotion of wonder. Wonder is a primal, basic emotion. Fear, curiosity, joy and a number of other emotions also belong to the category (...) of basic emotions. In religious studies the ’theory of fear’ attributes the origin of religion to experience of fear. In psychology of emotion the curiosity is considered as a source of cognitive interest and scientific cognition. Appropriately, it may be possible to propose the ’theory of curiosity’ and the ’theory of wonder’ to explain the origin of science and philosophy. In the context of the theories the science and the religion differ in their emotional sources from the philosophy. The status of wonder as a basic emotion defines the emotional sovereignty of philosophy, its independence from other ways of spiritual-practical mastering of the world. Author demonstrates the incapacity of interpretations of doubt and suffering as emotional origins of philosophy. Doubt as uncertainty is a derivative of faith and lacks the status of basic emotion. The suffering is an emotional tone of every sensation, a pair of the emotional tone of pleasure. It is impossible to consider the suffering as an origin of philosophy due to both the effect of twoness of pleasure and suffering and their status of emotional tones. In addition, suffering is an affect, the repetition and accumulation of which conduces to the emotional discharge, an affective explosion. Therefore, they cannot be the sources of cognitive motion. The cognitive potential of wonder is defined by its character as positive emotion allowing for accumulation of ’wonder points’. The wonder discovers cognitive dissonance and stimulates the cognition by means of expanding the subject field of philosophy and stating new questions. (shrink)

The design of collaborative robotics, such as driver-assisted operations, engineer a potential automation of decision-making predicated on unobtrusive data gathering of human users. This form of ‘somatic surveillance’ increasingly relies on behavioural biometrics and sensory algorithms to verify the physiology of bodies in cabin interiors. Such processes secure cyber-physical space, but also register user capabilities for control that yield data as insured risk. In this technical re-formation of human–machine interactions for control and communication ‘a dissonance of attribution’ :7684, 2019. https://doi.org/10.1073/pnas.1805770115) (...) is created between perceptions of phenomena, materials and decision-making. This reconfigures relations not only between humans and machines, objects and subjects, but possibly disrupts attributive functions in the social system of Law. What it requires is shifting a legal accountability for action from a sovereignty of the human to a new materialist account based on a ‘cognitive assemblage’ between physiological data, computation and algorithmic sensing. This paper investigates the function of law as a guidance system to acknowledge this account of sensory and algorithmic computation as autonomous ‘sensing agents’ that may be accountable in situations of risk. This assemblage of robotic computation and sensory determination requires a clearer legal differentiation across the current static terminologies of person, property, liability and rights that maintain strict separations of object from subject. To neglect this, we argue, law will solely impute attributions of error to humans despite evidence of operation via mutual control. (shrink)

This essay focuses on conceptual engineers who aim to improve other people's patterns of inference and attention by shaping their concepts. Such conceptual engineers sometimes engage in a form of epistemic paternalism that I call paternalistic cognitive engineering: instead of explicitly persuading, informing and educating others, the engineers non-consultatively rely on assumptions about the target agents’ cognitive systems to improve their belief forming. The target agents could reasonably regard such benevolent exercises of control as violating their sovereignty (...) over their own belief formation. This is a pro tanto reason against such engineering. In addition to the relevant projects of conceptual engineering, paternalistic cognitive engineering plausibly includes certain kinds of nudging and evidence suppression. I distinguish the sovereignty-based concern from other ethical worries about conceptual engineering and discuss how one might justify the relevant conceptual engineering projects despite the sovereignty-based reason against them. The present study is a corpus-assisted analysis of discourses on the Catalan movement of independence in the Catalan and Spanish press. A referendum for Catalan independence was held on 1 October 2017 but was not approved by the central Spanish government and was declared illegal. Spanish and Catalan newspapers differed considerably in their treatment and representation of the conflict, which also drew the attention of the international press to Catalonia. My analysis interconnects theoretical perspectives from linguistic critical discourse studies, (...) class='Hi'>cognitive linguistics, and media studies. The methodology is based on the analysis of two comparable corpora of journalistic texts. My aim is to identify and compare different features of the semantic prosody of words describing the event of geopolitical separation and the different narratives on this sociopolitical conflict that these prosodies contribute to producing. More specifically, I focus on a selection of keywords, like independence, secession, and sovereignty, that seem to be indicative of different discursive strategies consciously, and possibly unconsciously, chosen by a selection of national Catalan and Spanish newspapers. By carrying out a contrastive analysis of the two corpora, I am able to describe certain similarities, like the similar frequent use of the word independence, and differences, like the more frequent use of the word secession in the Spanish corpus, that indicate different framings of the same event and can be related to different ideological positionings against or in favor of Catalonia’s independence from Spain. For the last few years, the European Union has been experiencing a deep and prolonged institutional crisis. This has manifested itself, for instance, in the sovereign debt and Euro crises, the tension between national and transnational sovereignty, and tensions about the rule of law. This manifold crisis has dwarfed the enormous successes of integration and convergence that have been achieved over the past six decades in Europe. Crucially, this crisis has blinded many observers from being able to see how (...) and in what form European integration has managed in a successful way to connect the different parts of Europe with the whole over the last few decades. Our contribution is firstly aimed at showing how the European mechanism of integration of diversity in unity functions and why it has been so successful in many policy areas. We propose that, in order to get out of the present deadlock, the mechanism that has worked so well in some policy areas should be widened to all decision-making processes. Equally importantly, we argue that at its core the current crisis is a cognitive problem. We therefore argue that in order to recognize the institutional achievements as a positive common European experience, widening the general perception of "Unity in diversity" among Europeans, a new conceptual figure or interpretative scheme is needed for two reasons: first, in order to see how unity and diversity has already been dynamically harmonized in a directly recognizable way, and second, in order to provide a tool that creates further harmonization and enhances popular legitimacy for further European integration and convergence. In doing that, our proposal brings Nicholas of Cusa's (1401–1464) concept of spiritus conexionis into the fold. His concept, in our view, represents the dynamically integrative figure needed presently in Europe. As Cusanus lived in a historic period, in which the medieval interpretative schema to integrate diversity and unity was no longer tenable and the modern idea of nation state was not born yet, he conceived a new pattern of integration according to which any national identity – but even any culture or religion – in order to be aware of itself as a specific entity, has to be dynamically connected with a supranational identity that composes the different pieces in an harmonic whole; only in light of this identity that transcends individual identities, identity specificity for individual entities can be achieved. This dissertation evaluates the efforts of modern philosophers of aesthetics and politics to distinguish judgment from both cognition and volition. To see the rule under which any given particular is to be subsumed as a law fabricated and imposed by either God or reason is to characterize free judgment in terms of sovereignty. This generates the skeptical dilemma of an infinite regress of the legitimacy of the rule's application that can only be avoided by seeing the act of judgment (...) as an act of will. Such a voluntarist account of politics and judgment must in the end deny plurality for identity, and efface the categorical Aristotelian distinction between the public and the private. The rejection of the teleology of publicity is thus tied to the collapse of phronesis back into a Platonic techne that strives to produce society and man in the image of the eidos. ;Three "solutions" to this aporia are considered. The first is Hannah Arendt's appropriation for politics of Kant's aesthetic judgment, which allows for categorical distinctions between the public and the private and between judgment and the observance of rules. This project fails on account of the extreme formalism of that aesthetics. The second reads the third Critique as an allegory of politics. This too fails, as Kant's aesthetic community relies upon the productive legislation of the genius, a figure whose lineage reaches back to the half divine, half bestial figure of Machiavelli's founding prince. The third is a direct return to Aristotle. While his ethical philosophy offers us our best account of phronesis and epieikeia, it does not sufficiently engage the motivations for its own rejection. Hobbes, Locke, and Kant were not so taken with the model of mechanistic science that they simply forgot that in their common lives they regularly made judgments without the implicit or explicit guidance of a rule. The modern is better seen as a Weltanschauung, less a description that might be right or wrong than a desire. The alternative to the aporia of judgment is not found in the aesthetic but in a Wittgensteinian form of philosophical therapy. (shrink)

Jurisprudence is the prudence of jus, law's consciousness and conscience. Throughout history, when thinkers wanted to contemplate the organisation of society or the relationship between authority and the subject, they turned to law. All great philosophers, from Plato to Hobbes, Kant, Hegel, Marx and Weber had either studied the law or had a deep understanding of legal operations. But jurisprudence is also the conscience of law, the exploration of law's justice and of an ideal law or equity at the bar (...) of which state law is always judged. Jurisprudence brings together 'is' and 'ought', the positive and the normative, law and justice. But after a long process of decay, legal theory is today characterised by cognitive and moral poverty. Jurisprudence has become restricted and academically peripheral, a guidebook to technocratic legalism and a legitimation of the existent. Critical jurisprudence returns to the classical tradition of a general philosophy of law and adopts a much wider concept of legality. It is concerned both with posited law and with the law of the law. All legal aspects of the economic, political, emotional and physical modes of production and reproduction of society are part of critical jurisprudence. This widening of scope allows a radical rethinking of the nature of rights, justice, sovereignty and judgement. A political philosophy of justice today must examine the political economy of law; transitions from Empire to nation; ideological and imaginary constructions through which we understand ourselves and relate to others; ways in which gender, race or sexuality create forms of identity that both discipline bodies and offer sites of resistance. Law's complicity with political oppression, violence and racism has to be faced before it is possible to speak of a new beginning for legal thought, which in turn is the necessary precondition for a theory of justice. Critical Jurisprudence offers an ethics of law against the nihilism of power and an aesthetics of existence for the melancholic lawyer. (shrink)

This study explored the global cyberspace security issues, with the purpose of breaking the stereotype of people’s cognition of cyberspace problems, which reflects the relationship between interdependence and association. Based on the Apriori algorithm in association rules, a total of 181 strong rules were mined from 40 target websites and 56,096 web pages were associated with global cyberspace security. Moreover, this study analyzed support, confidence, promotion, leverage, and reliability to achieve comprehensive coverage of data. A total of 15,661 sites mentioned (...) cyberspace security-related words from the total sample of 22,493 professional websites, accounting for 69.6%, while only 735 sites mentioned cyberspace security-related words from the total sample of 33,603 non-professional sites, accounting for 2%. Due to restrictions of language, the number of samples of target professional websites and non-target websites is limited. Meanwhile, the number of selections of strong rules is not satisfactory. Nowadays, the cores of global cyberspace security issues include internet sovereignty, cyberspace security, cyber attack, cyber crime, data leakage, and data protection. (shrink)

Conscience can err. Yet erroneous conscience still seems binding in that it is likely to be morally wrong to ignore the call of conscience. Meanwhile, it seems equally wrong to act according to such a wrong judgment of conscience. The moral dilemma of erroneous conscience poses a challenge to any coherent theory of conscience. In light of this, I will examine Aquinas’s reflections on the psychological mechanism of erroneous conscience and reconstruct a sophisticated explanation of the obligatory force of erroneous (...) conscience, in which the conscientious integrity of the agent is intimately integrated with the sovereignty of divine law. Next, I will appeal to Aquinas’s distinction between the judgment of conscience (iudicium consentiae) and that of free decision (iudicium liberi arbitrii) to show that the judgments pertaining to conscience are purely cognitive rather than affective. This analysis will also help specify in what sense we can tolerate conscience’s wrong judgments. (shrink)

In this article I confront Jürgen Habermas' deliberative model of democracy with Claude Lefort's analysis of democracy as a regime in which the locus of power remains an empty place. This confrontation reveals several structural similarities between the two authors and explains how the proceduralization of popular sovereignty provides a discourse-theoretical interpretation of the empty place of power. At the same time, Lefort's insistence on the open-ended nature of the democratic struggle also points towards an unresolved tension at the (...) core of Habermas' model between the cognitive nature of deliberation on the one hand and the freedom of moral and political agents on the other. A proper solution of this tension requires a full appreciation of the ineliminable gap between actual and ideal deliberation. Because actual deliberation can never result in an ideal consensus, the actual exercise of democratic power should be understood as an unavoidable interruption of deliberation. How should common schools in a liberal pluralist society approach sex education in the face of deep disagreement about sexual morality? Should they eschew sex education altogether? Should they narrow its focus to facts about biology, reproduction, and disease prevention? Should they, in addition to providing a broad palette of information about sex, attempt to cover a range of alternative views about sexual morality in a “value-neutral” manner? Should they seek to impart a “thick” conception of sexual morality, which precisely (...) articulates how individuals should lead their sexual lives? In this essay, Josh Corngold cautions against the adoption of each of these various approaches. He argues that schools should instead adopt an “autonomy-promoting” approach, which will aim to empower students, cognitively and emotionally, to exercise sovereignty over their own sexuality. The rapidly advancing field of brain-computer (BCI) and brain-to-brain interfaces (BBI) is stimulating interest across various sectors including medicine, entertainment, research, and military. The developers of large-scale brain-computer networks, sometimes dubbed ‘Mindplexes’ or ‘Cloudminds’, aim to enhance cognitive functions by distributing them across expansive networks. A key technical challenge is the efficient transmission and storage of information. One proposed solution is employing blockchain technology over Web 3.0 to create decentralised cognitive entities. This paper explores the potential of a (...) decentralised web for coordinating large brain-computer constellations, and its associated benefits, focusing in particular on the conceptual and ethical challenges this innovation may pose pertaining to (1) Identity, (2) Sovereignty (encompassing Autonomy, Authenticity, and Ownership), (3) Responsibility and Accountability, and (4) Privacy, Safety, and Security. We suggest that while a decentralised web can address some concerns and mitigate certain risks, underlying ethical issues persist. Fundamental questions about entity definition within these networks, the distinctions between individuals and collectives, and responsibility distribution within and between networks, demand further exploration. Then, hermeneutically, we see Hundun instructing us against clarity toward unclarity—cosmological, self-composing, cognitive, and communal—of kindly humus, in cosmic confusion, sleep and idleness, mist and pond-dragonfly, and non-ruling people-sovereignty. Pan-hospitality is our Emperor Hundun’s non-arbitrary imperative to nurture life.

Alexander What does it mean to understand education as an art, to conceive inquiry in education aesthetically, or to assess pedagogy artistically? Answers to these queries are often grounded in Deweyan instrumentalism, neo-Marxist critical theory, or postmodern skepticism that tend to fall prey to the paradoxes (...) of radical relativism and extreme subjectivism. 1 This essay offers an alternative, communitarian account of education as an art and a neo-Kantian approach to aesthetic inquiry in education that avoids these difficulties.I begin by examining the emergence of aesthetic inquiry in education in the context of the larger qualitative revolution in educational research. The struggle to justify the qualitative turn in educational thought was initially framed in terms of two influential doctrines: that cognition and affect on the one hand, and truth, beauty, and goodness on the other, can be clearly distinguished from one another. Qualitative methods were conceived as an alternative research paradigm — a new epistemology — in keeping with Thomas Kuhn's influential book The Structure of Scientific Revolutions. 2 Qualitative research, on this account, is a cognitive endeavor aimed at discovering a form of knowledge no less valid and reliable than that produced by quantitative methodologies. This way of framing the discussion led to the dichotomizing of positivist and postpositivist epistemologies, one embracing absolutism, objectivism, and rationalism, the other relativism, subjectivism, and romanticism. 3 This approach succeeded in pointing to some serious flaws in the prevailing positivist account of social research, yet it left qualitative inquiry dependent on versions of epistemological relativism and subjectivism that philosophers of knowledge have shown to be self-contradictory and incoherent. 4 [End Page 1]Conceiving of pedagogy in aesthetic terms challenges the prevailing positivist epistemology on a deeper level because it questions the accepted distinctions between thinking and feeling, and between truth, beauty, and goodness. If art can be conceived as a form of cognitive inquiry in addition to affective expression, then the appreciation and assessment of education as art requires not merely a new research paradigm or an alternative epistemology. Rather, it entails a reshuffling of our very conception of the relations between science, art, and ethics.These concepts can be reconceived to avoid the paradoxes of radical relativism and extreme subjectivism if we recognize with Iris Murdoch that sovereignty belongs to communal conceptions of a transcendent good. Educational arts empower people to express, appreciate, and critique collective conceptions of goodness, and artistic criticism of pedagogy celebrates a sacred dimension in educational thought and practice. 5 This approach occasions a fresh look not only at the practice, appreciation, and assessment of pedagogy, but also at the very meaning of the concept of education and the sorts of inquiry that can fruitfully inform its practice. Two Dogmas of Educational Research Two dogmas have dominated educational research for most of this century: the idea that there exists a clear disjunction between the cognitive and affective domains; and the supposed radical independence from one another of truth, beauty, and goodness. 6 According to a popular view rooted in these doctrines, the search for truth is a cognitive affair governed by science, while ethics and the arts are tied to the emotions and the humanities. Inquiry into the former is objective — reliability depends on method not researcher — and into the latter, subjective — results can vary according to interpreter. In this attitude, the cognitive domain dominates the public arena through the influence and prestige of science and measurement. 7Until the middle 1970s, behavioral and social research in education expressed these dichotomies in the distinction made between quantitative and qualitative research. The former was thought to be scientific and objective, the latter, humanistic and subjective. It is often thought that the computational paradigm provides a supporting case for the theoretical autonomy of the science of mind. However, I argue that computation is in fact incompatible with this alleged aspect of intentional explanation, and hence the foundational assumptions of orthodox cognitive science are mutually unstable. The most plausible way to relieve these foundational tensions is to relinquish the idea that the psychological level enjoys some special form of theoretical sovereignty. So, in contrast to well (...) known antireductionist views based on multiple realizability, I argue that the primary goal of a computational approach to the mind should be to facilitate a translation of the psychological to the neurophysiological. Fullerar gues that political factors such as knowledge policy and a constitution play a primary role in the global legitimation of scientific knowledge, while Rouse holds that politics play a role on the local (practices) level but not on the global (metascientific) level of legitimation. Recent developments in artificial intelligence (AI) promise cognitive optimization in many areas of our lives, ranging from automated decision-making to superintelligence. In a predominant narrative, the black-box of machine learning systems is identified as one of the biggest obstacles from an epistemic point of view. The problem is expected to be solved by algorithmic counteractions emerging from the field of explainable artificial intelligence (XAI). However, deeper questions about a meaningful cognitive division of labor between AI algorithms and human (...) actors who use these systems are vastly ignored. The article aims to replace the dominant anthropomorphizing metaphors by a reconceptualization based on philosophy of technology. The new framework allows to interpret AI technology as an epistemic tool, which co-shapes a specific milieu of reflection and which is based on an epistemic model of automated knowledge production. This re-conceptualization offers a new perspective on AI technologies, where epistemic empowerment and epistemic sovereignty are in the center. (shrink)

In Tague's book, An Ape Ethic and the Question of Personhood, he presents his call for what he refers to as “Ape Forest Sovereignty” in three parts. In the first part of the book, he explores “The Case for an Ape Ethic.” Here he lays the groundwork for his call for Ape Forest Sovereignty, arguing that apes are ethical players in both their ecosystems and within their society's social structures. He explores this argument through the lens of “personhood,” (...) a concept that he recognizes as having multiple facets: legal, ethical, and metaphysical. He is clear that, in his exploration of the concept of personhood, “An Ape Ethic is not a legal argument but, nonetheless, a call for recognition of great apes as persons of tropical forests” (p. 4). This point is where I find the book somewhat lacking in ways that I will explore later in this review.Tague goes on in Part 2, which deals with cognition and environmental adaptation, and Part 3, which deals with the complex social interactions in ape societies, to build a convincing and extremely well-referenced argument, leaving the reader in little doubt as to his call that, if humans can be considered “persons,” there is very good reason to also consider apes as “persons,” too. These parts of the book will be useful for those interested in ape cognition and social structure as they bring together both historical and current work on this issue from a truly global perspective. It is perhaps the most current and comprehensive analysis of these points in print today and will serve students and those with an interest in those subjects extremely well.In addition to possessing the relevant cognitive and social attributes that would see them considered “persons,” Tague further argues that great apes—and he makes particular mention of orangutans throughout the book—operate in such a way that is intrinsically morally good in their interactions with their environment. Indeed, the existence of great apes in forest environments, says Tague, actively benefits those environments, particularly in their role as important seed dispersers. Tague argues that this establishes great apes as “moral eco-engineers” who, in stark contrast to the damaging capitalist social and political structures maintained by humans that have had such devastating impact on global forest environments, actively benefit their environment.Drawing together the various threads of his analysis, Tague argues that apes should be considered “forest persons” and be granted sovereignty over their forest land.Frustratingly, having laid an intricate groundwork as the basis of his call for ape personhood that, he says, is the rationale for the call for ape land sovereignty, Tague devotes very little of the book to his radical and compelling call. I had hoped that the final chapter of the book would explore exactly what ape sovereignty might look like in practice. The book left me with more questions than answers in this regard, and I would have liked Tague to explore the practical potential of his call in his concluding chapter.An exploration of the practical outcomes would be complex and could not help but become not just ethical, but also political and legal in nature. Land sovereignty cannot just be considered through an ethical lens, but must be addressed though the political and legal constructs upon which the principle of land sovereignty is based. For example, I would have liked to have seen Tague's work explore the following questions: How would nation states within whose jurisdiction these forests are located cede sovereignty to apes and how might it be maintained or managed?How would humans living or working in these forests, particularly those with long-standing ancestral land rights over the same land in question, interact with apes within these spaces?How would other nonhuman species who also share the environment engage and exist within these spaces? Would or could there be any feasible ceding of land sovereignty to nonhuman species when the principle of land sovereignty is based on human-made political and legal principles and, indeed, while indigenous human populations continue to struggle for their sovereignty to be recognized and respected?I was also left wondering how Tague's call might apply to captive apes. The theory espoused in the book relies heavily on land sovereignty being granted to apes on the basis of them being “moral eco-engineers” of their forest homes. I would be interested to understand where this might leave apes born or maintained in captivity who cannot, and will not, ever form part of free-living societies in those forest environments. If ape personhood and, by extension, the right to land sovereignty, is contingent on those apes playing a positive conservation role in their natural environment, one can perhaps conclude that captive apes are excluded from personhood recognition due to their inability to play this role. I would be interested to understand where Tague positions captive apes within his theory.Important work has been done in this academic area, most notably by Donaldson and Kymlicka (2013) in their book Zoopolis and, specifically, in the chapter “Wild Animal Sovereignty.” Tague does reference this work in parts of his text and it may be that An Ape Ethic and Zoopolis could be read together, with the arguments of one informing, and providing context, to the other. That said, I would have been interested to understand Tague's specific view on the practical implementation of his call for ape land sovereignty, perhaps in a volume of work to accompany the text currently under consideration.Tague's book presents an urgent and compelling argument that, under human management, forest habitats are under immediate threat of irreparable harm. His call to cede land to nonhuman “forest persons” who will better care for and maintain this land—which is vital for the health and welfare of all living beings on Earth—is a radical and important one. I hope Tague continues to develop and expand on this work in the near future to explore the way in which his call might be realized in practice. (shrink)

An ambitious proposal by Sue Donaldson and Will Kymlicka seeks to break out of an impasse that animal-rights advocacy seems to have reached. They divide the animal kingdom into three categories and distribute rights accordingly. Domesticated animals are to be treated as citizens, enjoying the same rights and duties as human citizens (adjusting for relevant differences in ability, just as we do for children and the severely cognitively handicapped). Wild animal species are to be treated as sovereign nations having rights (...) to their territories Liminal animals are to be treated as resident aliens. This article is a critique of this “Citizenship Theory” of animal rights. One theme of the critique questions whether citizenship and sovereignty are in fact doing the normative work that Citizenship Theory represents them as doing. The article will attempt to show that Velasquez's Las Meninas can be viewed as an allegorical enactment of some of the current debates and controversies in the philosophy of cognition and self-representation. I will focus on two very different philosophical trajectories, to which the allegory of the painting can be linked. The first, analytic, trajectory relates Las Meninas to the notion of representation and self-representation in the work of philosophers David Rosenthal, Robert Van Gulick, Uriah Kriegel and Bruce Mangan, and (...) neurologists Bernie Baars and Rodolfo Llinas. The second, continental, trajectory begins by relating to the painting Merleau-Ponty's phenomenological 'embodied self-representation'. This trajectory, which can be further linked to John Ziman's 'second person view' of reality, proceeds to relate Las Meninas to Lacan's 'object gaze' and the 'unbearable fragility of representation', ending with Bataille's (non)concept of 'sovereignty' as essential yet non-representable losses in representation. I will conclude by suggesting that the evolution of the cognitive state experienced by an observer of Las Meninas can be viewed as an 'ontogenetic' recapitulation of the more 'phylogenic' progression of the philosophical history of representation and self-representation alluded to by the canvas. This article discusses changes in post-apartheid South Africa’s economy and society in relation to the country’s re-insertion in the Empire. South Africa ’s specificity in the African context is largely related to the crucial role played in this case by the factory proletariat in defining the collapse of apartheid. Therefore, neoliberalism and the entry in the Empire in this case have to be understood in terms of state responses to a class composition that starting from workplace organisation has expressed a (...) resistance to the imposition of wage labour discipline. While the government of the African National Congress has successfully recodified its nationalist discourse to suit the requirements of capitalist globalisation and liberalization, this process has also been very contradictory. The adoption of a neoliberal agenda has, in particular, emphasized the ANC’s abdication from state sovereignty as a vehicle of strategies of control based on social citizenship. New movements, largely made of multitudes left out of waged employment, have therefore emerged to challenge the ANC’s pro-Empire choice. However, these movements are not based on a « souverainniste » agenda, or on delegation to the state of resistance to the Empire. Rather, in their conscious departure from nationalist and wage-based mythologies, they clarify the biopolitical nature of current processes of contestation and are able to combine grassroots struggles with cognitive abilities of reappropriation. The book consists of seven chapters introducing different aspects of the opposition of utopia and modernity as exemplified by various cultural productions and their impact on the social and political life of the country. Its publication has acquired a special relevance today not only due to China’s increasingly major role in the contemporary world, but also in connection with its official support of the [End Page 143] Russian invasion of Ukraine, contradicting its repeatedly declared adherence to the principles of international law and the ideals of national sovereignty, noninterference, and harmony in international affairs.Although the term utopia appeared in Chinese discourse only at the end of the nineteenth century, the idea of a radically better society has always existed in China, assuming different forms and shapes. The contributors to the volume trace the functioning of the broadly conceived phenomenon of utopian thinking in various domains of Chinese cultural, social, and political life, paying special attention to literary and cinematic works. The declared aims of the book are not only cognitive but also pragmatic as the editors believe that recent Chinese history involving “fundamental conflict of values,” the country’s experiences with economic systems that fail to supply the needs of the population, and the emergence of a society based on inequality, can be seen as highly relevant in the Western context also, to the extent that—as the editors convincingly argue—it “can provide English-language readers with a perspective useful for making sense of their own condition” (2).The editors see the opposition of utopia and modernity as less significant in the Western context than in China, where modernity became essential for preserving the integrity of the state torn by the conflict between the traditional values of nonconfrontation and continuity and the urgent need for significant change. Unlike in the West, where the dominant view of modernity was largely influenced by the Platonic model of the society in which the class of rulers was protected by the military class controlling the rest of the population, the Confucian model of social relations prevalent in China was based—at least in theory—on the principle of harmony rather than force. Other factors defining the Chinese variety of utopianism were Taoism, emphasizing the importance of nature and “The Way,” and Buddhism, advocating the limitation of needs and control of desires. The editors see this as “the reverse of the West’s view: for China, utopia (in the aspect of harmony) is the expectation, the desired normal, while modernity is the disrupter” (4) which is responsible for the predominance of the nostalgic utopia looking backwards to the idealized harmony of the past. The revolutions taking place in China in the twentieth century led to the decline of traditional ideals and brought with them experiments with the implementation of various Western ideologies, ranging from liberalism and democracy to socialism and communism. As a result, there are three main tendencies in the value system of contemporary China: orthodox communism, market-based liberalism, and [End Page 144] values derived from traditional Chinese culture. Light and darkness were central motives in the Bible and in the Platonic tradition . First and foremost light was the essential element and the basic principle of existence and cognition in the philosophy of Pseudo-Dionysius Aeropagite. His metaphysics of light contained imagery that inspired builders of French cathedrals and provided Christian thought with rich presuppositions and themes. Th e main purpose of the article is to highlight the Gnostic aspect of the refl ection on light in the writings of (...) Pseudo-Dionysius. Th e author of the Divine names speaks of light in a fi gurative sense and compares its physical properties to the process of transmission of knowledge. He uses the term “light” to describe the actualizing powers of God or God’s sovereignty over the world that he identifi es with goodness. Th is goodness is also described as “supersubstantial light” which as a transcendent Unity permits divine intellects to partake of the supreme knowledge about themselves. Th us light is shown as essential to the transmission of knowledge. It constitutes the process of enlightenment and supports the hierarchical process of transmissionof knowledge. Assuming that this is a correct reading of Pseudo-Dionysius Aeropagite theauthors conclude that contrary to the predominant interpretation his philosophy Pseudo-Dionysius did not describe emanations of beings but transmission of knowledge. Which in turn indicates that he developed his theory as a part of Christian philosophy rather than neoplatonic thought. (shrink)

The article is written on the basis of author’s paper at the panel discussion “How we un­derstand Russian philosophy” hold in the Institute of Philosophy, Russian Academy of Sciences. The article presents contemporary look on the problem based on the thesis of diversity as the central fundamental characteristic of the Russian philosophy. The di­versity must be acknowledged as the expression of it’s sovereignty opposed to the sole normative approach. Such kind of approach based on dogmatic Marxism had been spread (...) during Soviet period by authoritarian measures. The conception of diversity instead of Marxist oriented unification proposes variety of cognitive and hermeneutic means for knowing the treasury of Russian intellectual history. Another aspect of diversity includes multiplicity of languages used in philosophical texts besides proper Russian during the various periods. There are: Church Slavonic, Greek, Latin (XI–XVII centuries), French, English, German (XVIII–XX centuries) and various Slavic languages (XIX–XX centuries). Multiplicity of languages in Russian philosophical space could be explained mostly by political and censorial reasons. That multiplicity incorporates also high assortment of eth­nic groups that took part in the elaboration of various philosophical texts. It included Greeks, Ukrainians, Moldavians, Serbs etc. Many Russian thinkers had been exiled abroad or ought to leave home country to avoid political repressions: A.I. Herzen, M.A. Bakunin, P.A. Kropotkin, N.A. Berdyaev, S.L. Frank, S.L. Karsavin, S.N. Bulgakov and others. Therefore they created their writings in abroad. Needless to mark also that some Russian thinkers born in Russia, such as A. Koyre, A. Kozhev, I. Berlin, P. Sorokin, became famous Western philosophers in emigration. (shrink)

Recent interest in the evolution of the social contract is extended by providing a throughly naturalistic, evolutionary account of the biological underpinnings of a social contract theory of morality. This social contract theory of morality provides an evolutionary justification of the primacy of a moral principle of maximisation of the opportunities for evolutionary reproductive success, where maximising opportunities does not entail an obligation on individuals to choose to maximise their ERS. From that primary principle, the moral principles of inclusion, individual (...) sovereignty and equality can be derived. The implications of these principles, within contractevolism, are explored through an examination of patriarchy, individual sovereignty and copulatory choices, and overpopulation and extinction. Contractevolism is grounded in evolutionary dynamics that resulted in humans and human societies. The most important behavioural consequences of evolution to contractevolism are reciprocity, cooperation, empathy, and the most important cognitive consequences are reason and behavioural modification. The article describes the representation of St. Augustine's spirit and theological-historical implications of the law, its positive impact on the legitimization of European identity. Theologian distinguishes three types of law: a temporary, natural and eternal law. The latter is an all-encompassing force that controls all the processes of creation. It is implemented through the story and disclosed in the cognitive capabilities of a person to understand its course. Person of the eternal law is also the Holy Letter. It directs (...) the faithful to the divine essence and enables the implementation of the covenants of Christ - to search for individual mutual society. Realization of the Divine precepts creates two social practices: the legalization of individual and corporate rights of the defense of honor and collective property, as well as claims libertalny principle of law. Natural law comes from the eternal law, and there is a perfect synthesis of normal human relationships and the general laws of nature. Its key provisions are security and the continuation of life of the human race. Precept of natural law is the pursuit of a free implementation of the transcendent and the immanent levels of human existence. And at the same time the desire of people to be a single entity - to reach a general agreement (concordia), the order of love with all the elements of social life. Klyuchnym for achieving concordia is understanding people in the language that gives everyone in the communication process with the "neighbors" to reveal their natural essence and develop common criteria for the fair. Temporary law is a combination of the laws of the state and social control in the form of folk traditions and customs. It forms a unique socio-politic about individual people and determines its development. For Augustine, the temporary law is conscious norm overseas social elements of individual and corporate desires that can destroy people reached concordia. However, Augustine's interpretation of the law did not eliminate the temporary rule of the eternal law in the soul of man - his conscience and the right of free solutions. The human soul is a divine archetype, and therefore the individual acquires the status of an autonomous artist eternal and natural law. Thus, the Augustinian doctrine of the law legitimizes the human right to self-affirmation, the autonomic harmonization of all three levels of law. This aspect of the teaching of St. Augustine become the basis for the approval of the European individualism. (shrink)

In lieu of an abstract, here is a brief excerpt of the content: Michael Sohn's book The Good of Recognition: Phenomenology, Ethics, and Religion in the Thought of Lévinas and Ricœur explores the philosophical and religious writings of two of twentieth-century France's most significant thinkers, Paul Ricœur and Emmanuel Lévinas, "to gain, by thinking with and through them, an insight into the phenomenon of recognition" (128). Recognition, to these authors, is not merely an act of re-cognition (identifying something one already (...) knows), nor is it simple cognition (consciousness of something). For Lévinas, to whom Ricœur is indebted for his own work, recognition precedes ontological identification and is a "sensation of the infinite" in the Other (29). Recognition entails "a primordial ethical claim by the other" (57), up to and including self-sacrifice. For Ricœur, on the other hand, recognition of the other is situated in the "loving struggle for existence" between people seeking mutual recognition (72) and presents itself as "one among many sources of value and motivation" for moral decision (81). In other words, while recognition of the other is a central concept in both authors' ethical writings, Sohn notes that "Lévinas' phenomenological description of recognition emerges out of a fundamental project to uncover the principle of all principles," while "Ricœur's attention to the locus of will integrates passivity and activity as it is taken up within the dialectic of the voluntary and the involuntary," making recognition one value among others (127). In highlighting the different positions of each of these authors, Sohn structures his writing in a highly systematized and clear way. He first divides the book broadly by author, then for each author devotes a chapter each to philosophical and religious approaches to recognition. Within each chapter, he outlines the intellectual influences for the given author, then articulates in turn the phenomenon, the ethics, and the politics of recognition. This tactic serves as a helpful reference for readers interested in Sohn's comparative project, though it sometimes leads to repetition insofar as there are overlaps in how different thinkers, philosophical schools, or principles function for each area. The overall project is framed by an introductory chapter that briefly outlines the main points of discussion throughout the book and a conclusion that summarizes, compares, and contextualizes the significance of the project. Sohn offers this text as a clarifying study of the phenomenon of recognition, a term the application of which "touches upon a broad spectrum of issues ranging from battles over multiculturalism to questions of national sovereignty and from matters of international human rights to social movements within feminism and human rights" (135). En revanche, des acteurs privés, souvent criminels, exploitent les failles sécuritaires notamment des téléphones mobiles des nouvelles générations; truands ou officines peuvent souvent savoir ce que le juge d'instruction ne pourra découvrir, tandis que le matériel d'espionnage privé se banalise. Ce phénomène pose des questions politiques concernant la souveraineté et le contrôle des moyens de violer les secrets.In a context where digital technologies are making it easier to keep track of various types of communication, with attendant fears of globally expanding surveillance, citizens may well suspect that their telecommunications are, or are capable of, being monitored to a much greater extent by the Big Brother State than in the days when surveillance was limited to wiretaps on landlines. However, this nightmare "globalphone-tapping" scenario has to contend not only with advances in legal protection but also with the complexities of communication protocols and vectors and with the various counter-measures that have developed to secure anonymity against legal eavesdropping. However, private groups, often with criminal intent, are becoming adept at exploiting security loopholes, especially in late-generation mobile phone systems. Criminals and shady commercial establishments can often find information that no magistrate would have access to, while private surveillance equipment is becoming available practically over-the-counter. Les refuges des migrants expulsés à la frontière du Mali et de l’Algérie montrent comment, dans une situation extrême d’abandon et d’isolement, ceux-ci s’organisent pour survivre, mais mettent également en place des stratégies de dépassement de la coercition (...) exercée à leur endroit par les pouvoirs étatiques. Les murs de leurs abris précaires marquent l’amorce d’une opposition organisée contre les murs des États.Any thinking on the moment that follows expulsion has to cross the bounds of political sovereignty and the territories it governs, to move into the social and political effects of expulsion that arise in migrants’ countries of origin and/or transit. The shelters erected by migrants expelled at the frontier between Mali and Algeria show how, in a situation of extreme abandonment and isolation, migrants not only organise their own survival but also develop strategies to overcome the coercion that the State apparatus exerts upon them. The problem of intentional identity, as originally offered by Peter Geach, says that there can be an anaphoric link between an indefinite term and a pronoun across a sentential boundary and across propositional attitude contexts, where the actual existence of an individual for the indefinite term is not presupposed. In this paper, a semantic resolution to this elusive puzzle is suggested, based on a new quantified intensional logic and game-theoretic semantics (GTS) of imperfect information. This constellation leads to an expressive (...) intensional language with a property of informational independence, argued to produce a purely semantic explication to intentional identity statements. One consequence is that various extra-logical and pragmatic factors become of secondary concern; it is possible to solve the puzzle by logico-semantic methods, albeit somewhat radically renewed ones.
