This article is an attempt to examine Christoph Menke’s critical theory of modern bourgeois law through the lenses of analytic jurisprudence. We therefore scrutinize some core concepts from his Critique of Rights in order to gain a better understanding of the so-called “new law” which is presented as a theoretical alternative to the allegedly defective law of ius proprium-rights [Eigenrechte]. In the first part, we sharpen Menke’s concept of normativity with a reason-based approach and by using the metaethical notions of (...) formal and robust normativity. This sets the stage for analyzing his brand-new concept of counter-rights [Gegenrechte] in the second part. We identify a whole archipelago of meanings for it and group them by considering potential mereological relations between ius proprium-rights and counter-rights. Our mapping turns out to be fruitful in shedding new light on an already known dilemma for the concept of counter-rights. The final section delivers a sketch of the implementation challenge for counter-rights: How can we achieve a “new law”? We distinguish several conceptions of a corresponding utopia and criticize Menke for resorting to a construction that is based on a fiction. (shrink)

In this paper I will give a systematic account of Husserl's notion of the natural attitude in the development from its first presentation in Ideas I (1913) until Husserl's last years. The problem of the natural attitude has to be dealt with on two levels. On the thematic level, it is constituted by the correlation of attitude and horizon, both stemming from Husserl's theory of intentionality. On the methodic level, the natural attitude is constituted by three factors: naturalness, naivety and (...) normality. This paper offers a further look at Husserl’s late thought on the transcendental subject and the Husserl–Heidegger relationship. It attempts a reconstruction of how Husserl hoped to assert his own thoughts on subjectivity vis-à-vis Heidegger, while also pointing out where Husserl did not reach the new level that Heidegger attained. In his late manuscripts, Husserl employs the term ‘transcendental person’ to describe the transcendental ego in its fullest ‘concretion’. I maintain that although this concept is a consistent development of Husserl’s (...) earlier analyses of constitution, Husserl was also defending himself against Heidegger, who criticized him for framing the subject in terms of transcendental ego rather than as Dasein. Husserl was convinced that he could successfully respond to Heidegger’s critique, but he did not grasp that Heidegger’s fundamental ontology was an immanent development, rather than a scathing criticism, of his own phenomenology. This paper takes a fresh look at a classical theme in philosophical scholarship, the meaning of transcendental idealism, by contrasting Kant's and Husserl's versions of it. I present Kant's transcendental idealism as a theory distinguishing between the world as in-itself and as given to the experiencing human being. This reconstruction provides the backdrop for Husserl's transcendental phenomenology as a brand of transcendental idealism expanding on Kant: through the phenomenological reduction Husserl universalizes Kant's transcendental philosophy to an eidetic science of subjectivity. (...) He thereby furnishes a new sense of transcendental philosophy, rephrases the quid iuris-question, and provides a new conception of the thing-in-itself. What needs to be clarified is not exclusively the possibility of a priori cognition but, to start at a much lower level, the validity of objects that give themselves in experience. The thing-in-itself is not an unknowable object, but the idea of the object in all possible appearances experienced at once. In spite of these changes Husserl remains committed to the basic sense of Kant's Copernican Turn. I end with some comments on how both Kant and Husserl view the relation between theoretical and moral philosophy. (shrink)

This paper pursues the double task of presenting Cassirer’s Philosophy of Symbolic Forms as a systematic critique of culture and assessing this systematic approach with regards to the question of reason vs. relativism. First, it reconstructs the development of his theory to its mature presentation in his Philosophy of Symbolic Forms. Cassirer here presents a critique of culture as fulfilling Kant’s critical work by insisting on the plurality of reason as spirit, manifesting itself in symbolic forms. In the second part, (...) the consequences of this approach will be drawn by considering the systematics Cassirer intended with this theory. As can be reconstructed from his metaphilosophical reflections, the strength of Cassirer’s philosophy is that it accounts for the plurality of rational-spiritual activity while at the same time not succumbing to a relativism. In this article, I deal with the phenomenon, known to today’s philosophers, as the split between analytic and continental philosophy. I provide a historical-institutional explanation for this split and then a propose a type of doing philosophy beyond the divide, which I call “synthetic philosophy.” Synthetic philosophy should take and synthesize the best of both traditions into a new form of philosophy, which I recommend for the future.

In this article, we present two accounts of intersubjectivity in Jaspers and Husserl, respectively. We argue that both can be brought together for a more satisfying account of empathy and communication in the context of psychiatric praxis. But while we restrict ourselves for the most part to this praxis, we also indicate the larger agenda that drives Jaspers and Husserl, despite all disagreement. Here we spell out, in particular, how a phenomenologically inspired account of empathy and intersubjectivity can have larger (...) ramifications for a theory of social life and interaction. Finally, we argue for a ‘relaxed' view concerning the relation between pure and applied phenomenology, such that both can mutually benefit from one another. (shrink)

In this paper I compare and contrast Natorp’s and Husserl’s philosophies as to their programmatic and systematic profiles. I will begin by giving an assessment of their relationship and mutual influence, something that many scholars believe had been done exhaustively in Kern’s initial study of 1964 on the relation between Husserl and Kant and the neo-Kantians. Indeed, this topic – in general, the relation between phenomenology and „critical“ philosophy – deserves a new look now that more material has appeared in (...) the Husserliana, forcefully demonstrating the „transcendental Husserl“ and the Kantian influence on his phenomenology, and given the overall growing interest in neo-Kantianism. I will show that, despite fundamental differences in their philosophical outlooks, Natorp and Husserl share the same principal premise as to the relation between life, science and philosophy, and thus the role of philosophy itself in the midst of „culture“ and „lifeworld“ respectively. Hence, the similarities between Natorp’s Marburg School neo-Kantianism and Husserl’s transcendental phenomenology outweigh the differences, opening up new avenues to pursue transcendental philosophy. This paper takes a renewed look at Husserl's method of the phenomenological reduction. It interprets "the reduction" as shorthand for the meaning of Husserl's entire phenomenology in its mature stage. In the same way, the method of reduction might have different manners of execution but they are nevertheless guided by a common intent. The text takes its starting point by considering the different metaphors Husserl uses - the "flatland creatures" and the reduction as akin to a religious conversion - and (...) spells out their implications, which lead me to consider their metaphilosophical significance. In this way, this article attempts a metaphilosophical reading of the meaning of the reduction in Husserl, which is equal to considering the meaning philosophy has for Husserl in the most general terms. In this way, some unorthodox reflections are carried out that shed new light on central phenomenological concepts, such as evidence and eidetic variation, phenomenology as a form of transcendental idealism, and the notorious problem of the lifeworld. In this way, Husserl's phenomenology is interpreted as a peculiar representative of Enlightenment philosophy that restitutes a special notion of responsibility. (shrink)

When Edmund Husserl retired in 1928, ceding his chair at the University of Freiburg to his successor Martin Heidegger, he again began working intensively on synthesizing his philosophical efforts into a new “system of phenomenology.” This new presentation could, hopefully, displace his earlier presentation of 1913 in the Ideas Pertaining to a Pure Phenomenology and Phenomenological Philosophy, Book I, a work with which he had become dissatisfied in the meantime.

A liberdade pessoal na Internet guarda traços em comum com a liberdade pessoal que cada um tem, e deve ter, na sociedade real, mas como mostraremos depois, há também sutis diferenças entre ambas, com forte impacto na Teoria do Direito. What does it mean to be a community and to be in a community? Can this social phenomenon be analogized to an individual person with her interwoven opinions, wants, and desires? Or is a community a phenomenon sui generis that requires its own methods and tools for research? Concretely: What does it mean that a community may achieve certain acts? And what about the intentional object of such an act, which has also been referred to as “social act”? These questions (...) raise the methodological ones: how is it even possible to characterize a community, such that it can be said to issue social acts? And how can such an inquiry be carried out, does it require an outside perspective or one from within a community, or can it be done by both? (shrink)

In this essay, I will attempt a systematic reconstruction of the general shape of Husserl's late philosophy, insofar as it centers on the concept of personhood. The systematic concatenation of this and other themes in Husserl's late work - the method of epoché and reduction, ethics, personhood, and teleology - has only recently begun to be explored in Husserl scholarship, and this article is a modest contribution to the further e1ucidation of their mutual relationship. One of the most striking results (...) of this reconstructive analysis is Husserl's final concept of "person", which goes beyond the traditional distinctions, such as "heart" and "mind" or "reason" and "emotion". For Husserl to conceive of the subject as moral person implies, then, the demand to not only conduct oneself morally, but also to have an ethical view of the world as a world that bears meaning and harbors values despite its apparent absurdities. O presente estudo tem por objetivo contribuir para o projeto de reatualização da Filosofia do Direito hegeliana inaugurado por Axel Honneth, mas de um modo indireto: meu interesse aqui não é investigar tópicos específicos da Filosofia do Direito, nem mesmo examinar a teoria do reconhecimento como proposta por Honneth, mas iniciar uma caminhada no sentido de tornar explícitos os pressupostos ontológicos carregados por tal projeto de reatualização.

In this chapter, I present some systematic thoughts on a phenomenology of attention. There are two angles from which I will approach this topic. For one, the phenomenon in question is quite important for Husserl, but his thoughts on the topic have not been known to the public until recently through a new volume of the Husserliana (Hua XXXVIII) that presents the only analyses in Husserl’s entire oeuvre dealing with this phenomenon. As it turns out, attention, as located between passive (...) perception and active, synthetic consciousness, plays a key role in genetic phenomenology and its attempt to work out the levels of consciousness from passivity to activity. Hence, one part of this paper has the intention of presenting some of Husserl’s thoughts on attention and the systematic role it plays in his phenomenology of constituting consciousness. Secondly, in order to further the systematic point of the phenomenon, I turn to Goethe’s reflections on the primal phenomenon (Urphänomen) that can, I believe, be brought to bear on attention. Indeed, the primal phenomenon as a phenomenon that immediately and forcefully seizes our attention Goethe once compares to “the most beautiful pearls” in a chain of related phenomena. Among the phenomena appearing to us, some “simply” have a special quality in that they beckon us to investigate them, very much in the way in which Husserl describes the manner in which some phenomena lure us to focus our attention on them. Finally, if it is the world which “chooses,” as it were, certain phenomena for us to be drawn into their meaningful contexts, this observation has serious consequences for phenomenology as transcendental idealism. I want to put it as a question: What does it mean for a theory of world-constitution through consciousness that the world is “designed” such that certain phenomena are privileged from within the world to leap out at us, enticing us to explore it? Does attention bring us before the limits of phenomenology as transcendental idealism? (shrink)

Cloth, $39.95.Much ink has been spilled on the dispute between Ernst Cassirer and Martin Heidegger that took place in the Swiss resort town Davos in 1929—famous since Thomas Mann staged his Magic Mountain there—and which has since been referred to as the “Davos Dispute.” While the debate (...) itself and accounts accompanying it have been widely known to historians [End Page 508] of philosophy, Harvard historian Peter E. Gordon shows in this marvelous new book how memory has shaped the event into something much larger than anyone could have foreseen. It is, Gordon claims, the silent work of memory that has made this debate, rather innocuous at the time, into what can be retrospectively be considered the truly earth-shattering philosophical event of the twentieth century.In hindsight, the symbolism of the debate between a German who became a leading Nazi philosopher in 1933 and a Jew who, in the same year, was dismissed from his professorship and forced to flee Germany, could not be greater. It only grows if one connects the historic events with their respective philosophies: on the one side the liberal modern Cassirer, whose philosophy allegedly glorified the Weimar stalemate, and on the other side the radical Heidegger, whose call for “authentic existence” took on a bone-chilling reality as he embraced Hitler in 1933 as the führer to lead Germany back to its authentic roots.Two volumes—the 1999 collection, 70 Jahre Davoser Disputation, edited by E. Rudolph and D. Kaegi, and, in 2000, A Parting of the Ways by Michael Friedman—were the first to delve into the debate’s symbolic meaning. It was Friedman’s thesis that the fateful “parting of the ways” between Continental and Analytic philosophy could be traced to this meeting, which was also attended by Rudolf Carnap. Despite these studies, there has until now not been a comprehensive treatment that pulls together all threads into one narrative, covering the entire intellectual, historical, cultural, and philosophical landscape of the time. Gordon’s book achieves just that and will be, for years to come, the landmark work on this encounter.The book begins from the background in post-World War I philosophy in Germany, which was perceived, along with culture, as being in crisis (ch. 1), to “set the stage” on the “Magic Mountain” (ch. 2). It proceeds to summarize the individual lectures by Cassirer and Heidegger, giving a detailed interpretation of the protocol prepared by students of the interlocutors (chs. 3–4). The author then takes a deep breath in chapter 5 to place the debate in the larger context of Cassirer’s and Heidegger’s philosophies. But the story does not end there, as chapter 6 examines the relation between both thinkers after the debate. Finally, in chapter 7, Gordon assesses the newer debates concerning this dispute up to the debate between Bourdieu and Habermas concerning Heidegger’s Nazi involvement, though it does not re-engage with Friedman’s thesis, as might have been desired.Regarding his interpretation, Gordon juxtaposes Cassirer’s and Heidegger’s philosophies along the Kantian distinction between spontaneity and receptivity, where both paradigms make different claims on the “normative image of humanity” (5 ff.). Whether humanity is interpreted as spontaneous and world-creating, in optimistic Enlightenment terms (Cassirer), or as receptive and open to the world, i.e. as the “shepherd” rather than the “lord of being” (Heidegger), both are answering the fourth of Kant’s questions, “What is man?” While this distinction is useful for understanding the basic relation between them, it is also—as the author would concede—somewhat too coarse to do justice to their mutual differences and commonalities. Were one to assert a systematic critique, Gordon does not really make up his mind as to the true significance of these paradigms: are they mutually exclusive oppositions or, as he implies elsewhere, two alternative versions of philosophical modernism with a common ground? This chapter offers a reassessment of the relationship between Kant, the Kantian tradition, and phenomenology, here focusing mainly on Husserl and Heidegger. Part of this reassessment concerns those philosophers who, during the lives of Husserl and Heidegger, sought to defend an updated version of Kant’s philosophy, the neo-Kantians. The chapter shows where the phenomenologists were able to benefit from some of the insights on the part of Kant and the neo-Kantians, but also clearly points to the differences. This essay attempts to spell out what might be left of Husserlian phenomenology when one leaves behind Husserl's own grounding ambitions. Husserl construes transcendental phenomenology as first philosophy. In a pragmatist vein of leaving it behind in the interest of something other, I discuss what would happen if one were to 'pragmatize' phenomenology. After first laying out Husserl's vision, in a second part I reconstruct the motives that led to it in reaction to a 'Cartesian anxiety' of not securing an (...) indubitable ground of knowledge. After that, the article spells out some pragmatic reflections on what phenomenology would be, without the need to secure foundations of knowledge. Such a liberation would in effect enable phenomenology to more fully make true on the ideals of the Enlightenment (which Rorty, too, underwrites) of emancipating oneself of one of the last vestiges of a dogmatic slumber.
