This article is an attempt to examine Christoph Menke’s critical theory of modern bourgeois law through the lenses of analytic jurisprudence. We therefore scrutinize some core concepts from his Critique of Rights in order to gain a better understanding of the so-called “new law” which is presented as a theoretical alternative to the allegedly defective law of ius proprium-rights [Eigenrechte]. In the first part, we sharpen Menke’s concept of normativity with a reason-based approach and by using the metaethical notions of (...) formal and robust normativity. This sets the stage for analyzing his brand-new concept of counter-rights [Gegenrechte] in the second part. We identify a whole archipelago of meanings for it and group them by considering potential mereological relations between ius proprium-rights and counter-rights. Our mapping turns out to be fruitful in shedding new light on an already known dilemma for the concept of counter-rights. The final section delivers a sketch of the implementation challenge for counter-rights: How can we achieve a “new law”? We distinguish several conceptions of a corresponding utopia and criticize Menke for resorting to a construction that is based on a fiction. (shrink)

Explainable artificial intelligence (XAI) seeks to produce explanations for those machine learning methods which are deemed opaque. However, there is considerable disagreement about what this means and how to achieve it. Authors disagree on what should be explained (topic), to whom something should be explained (stakeholder), how something should be explained (instrument), and why something should be explained (goal). In this paper, I employ insights from means-end epistemology to structure the field. According to means-end epistemology, different means ought to be (...) rationally adopted to achieve different epistemic ends. Applied to XAI, different topics, stakeholders, and goals thus require different instruments. I call this the means-end account of XAI. The means-end account has a descriptive and a normative component: on the one hand, I show how the specific means-end relations give rise to a taxonomy of existing contributions to the field of XAI; on the other hand, I argue that the suitability of XAI methods can be assessed by analyzing whether they are prescribed by a given topic, stakeholder, and goal. In our lives, we aim to achieve welfare for ourselves, that is, to live good lives. But we also have another, more impartial perspective, where we aim to balance our concern for our own welfare against a concern for the welfare of others. This is a perspective of justice. Nils Holtug examines these two perspectives and the relations between them.

This chapter examines autonomism. Autonomism is roughly the view that an artwork’s ethical properties do not bear on its aesthetic or artistic value. The author sketches some of the view’s history before describing various versions of it defended over the last quarter-century. These are divided into ‘radical’, ‘robust’, and ‘moderate’ forms of autonomism. The author considers the strengths and weaknesses of each. The author also devotes some space to the ‘interactionist’ views against which contemporary autonomism is typically opposed. Summary This paper starts with a short review of recent developments in psychotherapy process research and analyzes that a medical, or better, technical approach in process research – using words such as ‘intervention’, ‘effect’ and ‘outcome’ – is gradually acknowledged as only one side of psychotherapy; the other, more human or ‘humanistic’ side, is ‘conversation’, described by prominent authors as ‘low technology’. Conversation analysis cannot study psychotherapy as a whole. Sessions are subdivided into ‘situations’. What are situations? I make a (...) proposal to answer this question by three components: open up, select and control options. Then, 11 transcribed extracts from psychoanalytical therapy sessions are used to describe three types of situations and the special kind of requirements they demand from a therapist. Obviously, such situations appear during a session, they can be handled if therapists are sensitized for certain difficulties to arise. Shift-of-situation and double meaning are new observations in this approach to define the situational gestalt and train ‘seeing’ it. (shrink)

Atomic individualism is embedded in most definitions of stakeholder theory, and as a result, stakeholders are not integral to the basic identity of the corporation which is considered to be independent of, and separate from, its stakeholders. Feminist theory has been suggested as a way of developing a more relational view of the corporation and its stakeholders, but it lacks a systematically developed conceptual framework for undergirding its own insights. Methods of machine learning (ML) are gradually complementing and sometimes even replacing methods of classical statistics in science. This raises the question whether ML faces the same methodological problems as classical statistics. This paper sheds light on this question by investigating a long-standing challenge to classical statistics: the reference class problem (RCP). It arises whenever statistical evidence is applied to an individual object, since the individual belongs to several reference classes and evidence might vary across them. Thus, the problem consists (...) in choosing a suitable reference class for the individual. I argue that deep neural networks (DNNs) are able to overcome specific instantiations of the RCP. Whereas the criteria of narrowness, reliability, and homogeneity, that have been proposed to determine a suitable reference class, pose an inextricable tradeoff to classical statistics, DNNs are able to satisfy them in some situations. On the one hand, they can exploit the high dimensionality in big-data settings. I argue that this corresponds to the criteria of narrowness and reliability. On the other hand, ML research indicates that DNNs are generally not susceptible to overfitting. I argue that this property is related to a particular form of homogeneity. Taking both aspects together reveals that there are specific settings in which DNNs can overcome the RCP. (shrink)

Ethicism is the most comprehensively defended answer to the question regarding whether ethical properties determine aesthetic properties in artworks. According to ethicism, aesthetically relevant ethical flaws in artworks count as aesthetic flaws and aesthetically relevant ethical merits count as aesthetic merits. In this paper, I argue that ethicism’s most significant argument, the Merited Response Argument suffers from an ambiguity that makes it either unsound or uninteresting. Specifically, the notion of an artwork’s ‘prescribing’ a response, central to MRA, is ambiguous between (...) merely attempting to elicit a response from appreciators as appropriate to a work, and endorsing a response as appropriate to relevant parts of the actual world. While the first sense of ‘prescribe’ does the aesthetic work, the second does the ethical. (shrink)

The strength of a slippery slope argument is a matter of some dispute. Some see it as a reasonable argument pointing out what probably or inevitably follows from adopting some practice, others see it as essentially a fallacious argument. However, there seems to be a tendency emerging to say that in many cases, the argument is not actually fallacious, although it may be unsubstantiated. I shall not try to settle this general discussion, but merely seek to assess the strength of (...) the slippery slope argument applied to human gene therapy. The structure of my argument will be the following. First, I shall distinguish between three different versions of the slippery slope argument; two logical versions and an empirical one. Next, I will address human gene therapy in terms of each of the three versions, partly relying on slippery slope arguments against this practice that have already surfaced in the literature. I shall argue that neither version pulls through. The logical versions fail primarily because relevant distinctions can be made between different uses of gene therapy, contrary to what the proponents of the arguments claim. The empirical version fails because there seems to be no evidence supporting the claim that we shall in fact slide down the slope if we engage in gene therapy, and because if we accepted the conclusion that we should not allow gene therapy on the basis of the empirical argument, we should have to make very far-reaching and undesirable modifications in health care in general, in order to be consistent. Unique in both perspective and approach, this is the first book to use classical American pragmatism as an ethical framework for dealing with ethical issues in business. The book first explores ethical theory from both the traditional and pragmatic perspectives. Then, using the pragmatic perspective, discusses the nature of the corporation and its relationship to society, the various environments in which business functions, and specific issues in the contemporary marketplace and workplace.

Dahlbäck, Forsblad and Hydén argue that conversational remembering in the real‐world must be acknowledged as an interactional practice grounded in and bound to the communicative actions produced by the interlocutors. They illustrate the complexity of those processes by referring to their own fieldwork examining older adults’ prospective memory within their homes (Dahlbäck, Kristiansson, & Stjernberg, 2013) and propose alternative methodologies (e.g., scenarios design) to increase collaborations between ethnographic and experimental memory researchers.

The Ethical Question asks whether ethical values in artworks determine their aesthetic value and, if so, how. I argue that the question is ambiguous between a direct and an indirect reading. I show how the indirect reading is philosophically uninteresting because it has an obvious answer: a view called ‘immoralism’. I also show how most of the significant figures in the relevant literature address the indirect form of the question anyway—needlessly, if I am right. Finally, I consider whether some version (...) of the indirect question is more philosophically interesting, connecting it to the so-called ‘qua problem’. I attempt to give clarity to the discussion by applying work on the virtues and vices of explanations. (shrink)

Corroborating upper echelons theory, this study picks up the notion that narcissistic chief executive officers take advantage of accounting choices to enhance their firms’—and inherently their own—personal track records. Using a set of 15 indicators, reflecting the narcissistic trait of 1126 CEOs for the period 1992 to 2012, we find evidence of highly narcissistic CEOs engaging in accrual-based earnings management. In contrast to prior research, the results show evidence not only for income-increasing but also for income-decreasing ABEM. This indicates that (...) highly narcissistic CEOs not only strive to influence stakeholders’ perception of current performance. We conclude that they also assess their potential to influence perception of current and future earnings. The results imply that highly narcissistic CEOs’ accounting choices are driven by self-serving behavior rather than by the intention to provide additional information to the market. When earnings management techniques are used to derive personal advantage from the presentation of a firm’s earnings, the literature refers to this as a case of low earnings quality reflecting unethical behavior. Accordingly, this study contributes to the field of business ethics by showing that CEO narcissism is related to low earnings quality in that it is associated to discretionarily decreasing accruals. At the heart of entrepreneurship are imagination, creativity, novelty, and sensitivity. It takes these qualities to develop a new product or service and bring it to market, to envision the possible impacts a new product may make and come up with novel and creative solutions to problems that may arise. These qualities go to make up what could be called the spirit of entrepreneurship, a spirit that involves the ability to handle the experimental nature of entrepreunerial activity. These same qualities (...) are crucial for moral decision making, and an ethical approach which emphasizes imagination, creativity, and has an experimental thrust is much better adapted to the entrepreneurial activity and much more relevant to the unique situations that entrepreneurs face. In this sense, the process approach to ethics developed in this article is a unifying framework that brings together the activity of entrepreneurship and moral decision making. (shrink)

Machine learning (ML) models recently led to major breakthroughs in predictive tasks in the natural sciences. Yet their benefits for the social sciences are less evident, as even high-profile studies on the prediction of life trajectories have shown to be largely unsuccessful – at least when measured in traditional criteria of scientific success. This paper tries to shed light on this remarkable performance gap. Comparing two social science case studies to a paradigm example from the natural sciences, we argue that, (...) in addition to explanation, prediction is an important goal of social science – and we identify constraints that impede pure ML prediction from being successful in that field. As a remedy, we outline elements of an integrative modelling approach that combines explanatory models and predictive ML models. (shrink)

In order to explain several discrepancies between the gene-recombination phenomena in phages and in higher organisms, we assume that theT 2 phage, after entering the bacterium, divides in three parts corresponding to the three “chromosomes' whichHershey andRotman have traced in this phage. The three parts are supposed to be able to divide further by rupture or by the action of other “chromosome fragments”. Each fragment is supposed able to reproduce inside the bacterium as a more or less independent unit and (...) before lysis of the bacterium the various parts are assumed to reunite in complete sets of genes each forming a new phage.After discussing the experimental facts supporting these assumptions, we show that the assumptions are in perfect agreement with the theory of the symbiosis of genes, a theory which seems necessary in order to explain the ability of the “chromosome-fragments” to reunite into complete phages.Also the problems arising with respect to the sexual reproduction in bacteria is discussed under the point of view of the symbiosis theory. The assumption is made that the hereditary material is transduced from bacterium to bacterium by ultramicroscopic virus-like particles “genophores”. In several lysogenic bacteria the genophores are supposed still able to act as parasites instead of symbiontes towards some other sensitive bacteria. The experimental facts supporting this assumption are analyzed, and new experimental tests suggested. (shrink)

Emergence is a universal phenomenon that can be defined mathematically in a very general way. This is useful for the study of scientifically legitimate explanations of complex systems, here defined as hyperstructures. A requirement is that the observation mechanisms are considered within the general framework. Two notions of emergence are defined, and specific examples of these are discussed.

Using the concept of notations for infinitary derivations we give an explanation of Takeuti's reduction steps on finite derivations (used in his consistency proof for Π1 1-CA) in terms of the more perspicious infinitary approach from [BS88].

This is a commentary on MM McCabe's "First Chop your logos... Socrates and the sophists on language, logic, and development". In her paper MM analyses Plato's Euthydemos, in which Plato tackles the problem of falsity in a way that takes into account the speaker and complements the Sophist's discussion of what is said. The dialogue looks as if it is merely a demonstration of the silly consequences of eristic combat. And so it is. But a main point of MM's paper (...) is that there is serious philosophy in the Euthydemos, too. MM argues that to counter the sophist brothers Euthydemos and Dionysodoros, Socrates points out that that there are different aspects to the verb 'to say' that run in parallel to the different aspects of the very 'to learn'. So just as there is continuity rather than ambiguity between 'to learn' and 'to understand', so there is continuity between the different aspects of saying. Thus Socrates puts forward a teleological account of both learning and meaning. Following up on some of MM's thoughts, I argue that the sophists subscribe, despite appearance, to a theory of meaning that respects serious and widely accepted philosophical theses on meaning. -/- Forthcoming in the Australasian Philosophical Review. The outcomes of sports and competitive games excite intense emotions in many people, even when those same people acknowledge that those outcomes are of trifling importance. I call this incongruity between the judged importance of the outcome and the intense reactions it provokes the Puzzle of Sport. The puzzle can be usefully compared to another puzzle in aesthetics: the Paradox of Fiction, which asks how it is we become emotionally caught up with events and characters we know to be unreal. In this article, I examine the prospects of understanding our engagement with competitive games on the model of our engagement with works of fiction, thus enabling analogous explanations for both puzzles. I show that there are significant problems with such an approach and offer an alternative, mobilizing ideas from David Velleman and Thomas Nagel, that appeals to the volatility of our motivational attitudes. Roughly, according to conditional egalitarianism, equality is non-instrumentally valuable, but only if it benefits at least one individual. Some political theorists have argued that conditional egalitarianism has the important virtue that it allows egalitarians to avoid the so-called objection. However, in the present article I argue that conditional egalitarianism does not offer the egalitarian a plausible escape route from this objection. First, I explain the levelling down objection and suggest some particular concerns from which it derives its force. Then I (...) provide a more precise definition of conditional egalitarianism. Finally, I give two arguments against this principle. According to the first, it violates the transitivity of the betterness relation (or more specifically, ). According to the second, there is no plausible explanation of why equality must benefit at least one individual in order to be non-instrumentally valuable. (shrink)

According to outcome welfarism, roughly, the value of an outcome is fundamentally a matterof the individual welfare it contains. I assess various suggestions as to how to spell out this idea more fully on the basis of some basic intuitions about the content and implications of welfarism. I point out that what are in fact different suggestions are often conflated and argue that none fully captures the basic intuitions. I then suggest that what this means is that different doctrines of (...) welfarism may be appropriate in different contexts and that when deciding on a particular doctrine, we need to consider which intuitions it does accommodate. Finally, I consider the issue of just how a benefit must be related to an outcome in order to contribute to its value. (shrink)
