The traditional problem of free will and determinism is ostensibly about settling the relationship between free will and determinism. According to the standard narrative, this problem boils down to settling whether free will stands in a compatibility or incompatibility relation with determinism. Similarly, there is traditional debate over whether a compatibility or an incompatibility relationship holds between free will and indeterminism. Since indeterminism is simply the negation of determinism, anyone who holds that human free will is incompatible with both determinism (...) and indeterminism seems to be committed to free-will impossibilism, i.e. the view that free will is metaphysically impossible. We might summarize this constructive dilemma argument as follows: -/- The Standard Dilemma Argument 1. Necessarily, either determinism or its negation, i.e. indeterminism, is true. 2. Necessarily, determinism is incompatible with free will. 3. Necessarily, indeterminism is incompatible with free will. 4. Therefore, free will is metaphysically impossible; impossibilism is true. -/- In this essay, I argue that the term “incompatible” used in this argument is ambiguous. Since there are two fundamentally different ways to disamabiguate the term “incompatible”, there are at least four substantively different ways to disambiguate the Standard Dilemma Argument. Because these four arguments are typically conflated, the philosophically interesting differences between these four instances of the Standard Dilemma Argument are generally ignored. (shrink)

The author argues that simple constructive dilemma is a valuable argument form for reasoning under relative conditions of uncertainty. When applied to legal argument this value of simple constructive dilemma is shown in its political, strategic, rhetorical, and especially economic, uses by lawyers and judges. After considering some examples of the use of the form by trial lawyers, the author gives examples of the more interesting use of the form by appellate courts. Research into the use (...) of simple constructive dilemma by appellate courts helps us to understand how those courts distribute judicial resources. It also helps us to understand the political role of the appellate courts with respect to the doctrine of the separation of powers. Given some of the specific examples of legal reasoning used by the appellate courts presented in this article, and given the discussion of the doctrine of precedent, the article’s focus is on common law legal systems of the Anglo-American-type. Purpose This paper aims to evaluate a potential resolution to the gamer’s dilemma that arises from Gary Young’s metaethical theory of constructive ecumenical expressivism. Design/methodology/approach In this paper, the gamer’s dilemma is reformulated as a paradox and the potential resolution is evaluated in light of this new formulation. Findings The author argues that this resolution does resolve the dilemma, but CEE itself has limited appeal. Business ethics has gained much attention over the past decade in both work and educational settings. This study used a version of Lysonski and Gaidis' ethical vignettes to examine by gender the ethical views of 165 Canadian undergraduate management students, to examine the psychometric properties and construct validity of the instrument, and to determine if the instrument is a useful tool for introducing undergraduates to the topic of ethics in management practice. Results showed that while the instrument is a useful (...) teaching tool, it has psychometric and validity inadequacies that need to be corrected. (shrink)

The article discusses the problem of the possibility of knowing the future, especially the future of social phenomena compared with the future of natural ones. This problem is formulated as a dilemma: the future can be explored or can be only constructed. The idea of constructive character of knowledge of the future is viewed in two possible interpretations.The first one is a special case of the constructivist interpretation of knowledge, according to which different pictures of the future are (...) arbitrarily constructed on the basis of information about the past and current state. The second interpretaion can be presented in the form of a praxeological question: what should be an action in relation to the future, first and foremost to the future of social phenomena - cognitive or creative. It is shown that, in the first case, there is an ability to interpret knowledge of the future from the point of view of epistemological realism, in the second case, both cognitive and creative types of activity as a pragmatic position in relation to the future are necessary and cognitive activity cannot be reduced to creative one. It is also shown that forecaster’s dilemma reflects the problematic nature of forecasting under the conditions of transformation of scientific rationality and point of view of common sense, which is observed in recent decades. The following paper presents and discuses the epistemological premises of one of the relativistic expressions of the so-called constructivism i.e. the social constructionism. Firstly, we trace constructivism’s theoretical origins and later, we distinguish the main ideas of Kenneth Gergen’s social constructionist proposal. The analysis is done in the following way: (a) we analyse the epistemological premises and the philosophical problems arising from them, and (b) we analyse the problematic impact these premises have in the praxis of social sciences. El siguiente artículo presenta y discute los postulados epistemológicos de una de las expresiones relativistas del denominado constructivismo i.e. el construccionismo social. En primer momento, se rastrean los orígenes teóricos del constructivismo y, posteriormente, se distinguen los principales postulados del construccionismo social de Kenneth Gergen. El análisis se realiza del siguiente modo: (a) Se analizan los supuestos epistemológicos y los problemas filosóficos derivados de éstos, y (b) Se analizan las consecuencias que los postulados construccionistas tienen en la praxis que llevan a cabo las ciencias sociales. False dilemma is a specific form of reasoning : despite the fact that it is based on a deductively valid argument form, it is rightly depicted as fallacy. A systematic exposition of false dilemma is missing in theoretical approaches to fallacies. This article formulates six criteria for a well-grounded exposition of a fallacy, suggesting also a systematic exposition of false dilemma. These criteria can be used to both explain, and categorise, the various false dilemma fallacies. The (...) article introduces distinction between four types of false dilemma : False quandary, Defeasible sound quandary, False obstruction and Defeasible sound obstruction. The types of criticism appropriate for each variant of false dilemma are suggested. Being able to discover false dilemma in situations when it is important to make good and free choices is a significant dimension of critical thinking. It may liberate us from accepting the consequences that necessarily follow from prearranged alternatives, when these are not the only alternatives possible. It may also liberate us from refraining from actions on the basis of obstructive disjunctive statements. In that respect, the faculty of critical thinking directed at uncovering reasoning based on false dilemma may also initiate the discovery of new alternatives, or discover the ways of unifying seemingly opposing alternatives. Thus, a well-developed ability to understand the tricky argumentative moves of false dilemma may be a good step towards initiating some features of creative thinking. (shrink)

Faced with interminable combat over some piece of philosophical terrain, someone will inevitably suggest that the contested ground is nothing more than a philosophically manufactured mirage that is therefore not worth fighting for. Arthur Fine has long advocated such a response—the ‘Natural Ontological Attitude,’ or NOA—to the realism debate in the philosophy of science. Notwithstanding the prima facie incompatibility between the realist’s and anti-realist’s positions, Fine suggests that there is in fact enough common ground for NOA to stand on its (...) own as a minimal alternative, one that enjoys the advantage of being free of the philosophical burdens of its overweight contenders. Modest actual intentionalism is a major position on interpretation in contemporary analytic aesthetics. The position consists of a disjunctive formulation according to which work-meaning is determined by the author’s intention when such intention succeeds or by non-intentionalistic factors when it fails. I challenge the disjunctive view by presenting a constructive dilemma, the conclusion being that modest actual intentionalism ends up either making non-intentionalistic factors idle or making authorial intent superfluous.

The feminist movement remains fundamentally divided over the issue of surrogacy. Within the confines of this article it is argued that the inadequacy of positions on both sides of the debate rests upon their common tendency to deal with the ethical consequences of surrogacy for isolated agents, without sufficient concern for the broader social implications for all pregnant women in society. In order to clarify the issues involved, feminist theorists must consider the implications of surrogacy in a broader social spectrum. (...) Such an analysis will illustrate that the two-person dichotomous model of the maternal-foetal relationship proposed by the surrogacy arrangement has hugely prejudicial effects on the treatment received by non-contract mothers when they interact with agents of certain social institutions whose prior contact with surrogate mothers has made them more susceptible to conceiving the maternal-foetal relationship as fundamentally disconnected. In a climate of increased medical surveillance and intervention in the non-clinical context of pregnancy, the dangers of adopting this dichotomous model are palpable. Given the oppressive physical and psychological effect that this would have upon the liberty of the majority of pregnant women in society, this article argues that the feminist movement must abandon any promotion of the abstracted model of the mother-foetus relationship that is implicit in its arguments in favour of surrogacy. Knowledge about ethical judgments has not advanced appreciably after decades of research. Such research, however, has rarely addressed the possible importance of the content of such judgments; that is, the material appearing in the brief vignettes or scenarios on which survey respondents base their evaluations. Indeed, this content has seemed an afterthought in most investigations. This paper closely examined the vast array of vignettes that have appeared in relevant research in an effort to reduce this proliferation to a more concise (...) set of overarching vignette themes. Six generic themes emerged from this process, labeled here as Dilemma, Classic, Conspiracy, Sophie’s Choice, Runaway Trolley, and Whistle Blowing. Each of these themes is characterized by a unique combination of four key factors that include the extent of protagonist personal benefit from relevant vignette activities and victim salience in vignette descriptions. Theme identification enabled inherent ambiguities in vignettes that threaten construct validity to come into sharp focus, provided clues regarding appropriate vignette construction, and may help to make sense of patterns of empirical findings that heretofore have seemed difficult to explain. According to the Collingridge dilemma, technology is easy to control when its consequences are not yet manifest; once they appear, the technology is difficult to control. This article examines the development of keyboard layout design from the perspective of the Collingridge dilemma. For this purpose, unlike related studies that focus on a limited period of time, the history of keyboard development is explored from the invention of the typewriter and the QWERTY to brain–computer interfaces. Today, there is no (...) mechanical problem of the typewriter for which the QWERTY was designed. On the other hand, better layouts have been designed for various situations so far, that can be easily implemented especially on virtual keyboards, but QWERTY has not been replaced. The present study shows how various factors as heterogeneous engineering have shaped QWERTY, prevented the prevalence of superior layouts, and led to Lock-in. Then, unlike other studies related to the Collingridge dilemma, which provide a qualitative description of it, a quantitative description is proposed that helps to better understand the Collingridge dilemma and Lock-in. Finally, the case study of the QWERTY keyboard illustrates that the theory of human-technology co-construction can provide a more comprehensive explanation of technology development, while the Collingridge dilemma can better provide some details of technology development. Albert Casullo (2000, 2003) and Shane Oakley (2011) argue that dilemma arguments against epistemic naturalism, such as those offered by Laurence BonJour (1998) and Harvey Siegel (1984), are such that, whatever strength they have against naturalism applies equally to moderate rationalist accounts of a priori justification. They conclude that dilemma arguments are, therefore, insufficient for establishing an advantage for moderate rationalism over naturalized epistemology. I argue that both Casullo's and Oakley's criticisms depend on an illicit assumption, namely, that (...) dilemma arguments presuppose a meta-justificatory demand that naturalists provide non-circular support for their basic sources of evidence. I argue that this assumption is not necessary for the force of dilemma arguments, and I construct a version that avoids this misreading. I conclude that, although there remain strategies for responding to dilemma arguments, they constitute a challenge naturalists must take seriously. (shrink)

Psychiatrists working with war veterans have, in recent years, constructed ‘moral injury’ as a separate manifestation of war trauma that is distinct from Post-Traumatic Stress Disorder. This paper argues that for moral degradation to occur, it necessarily involves one’s commissions or omissions that transgresses one’s personal morality, and hence, distinguishes sufferers of moral injury from PTSD sufferers who were witnesses to traumatic and morally abhorrent events. To this end, it clarifies how some of the situations surrounding moral injury are misunderstood, (...) by discussing the process of moral reasoning in the context of moral dilemmas, dirty hands, and moral blind alleys. Finally, it concludes that when we conceptualise moral injury as being caused by one’s commissions and omissions in moral dilemmas, we find that shame and guilt are situation-appropriate responses with a role to play in what ethics mean. Ethical dilemmas raised by the use of nanotechnology in medical practice can be viewed from several perspectives: religious spiritualist perspective, the perspective of human dignity (nanotechnologies can be thought of as an affront to human dignity), the issue of controversial choice. The article aims to expose some bioethical dilemmas in using synthetic biology and nanotechnologies. Nowadays is often brought into discussion the fact it is possible to appear in the future new human species resulted not via natural selection and evolution, (...) but through the demiurgic effect of technology development in areas such as: synthetic biology, genetics, neurobiology and neurosciences, prosthesis technology and not least of artificial intelligence research. We will also refer into this paper at the possible raised challenges to ethicists who are oriented towards an ethics of species. Those challenges are raised right from the dawn of a consciousness of species, a social construction generated by changes of the meaning of belonging to humanity. During our article we argue that medical technology, especially genetics, medical assisted human reproduction and not least synthetic biology, require a rethinking ethical meanings of applying those technologies in everyday practices. The analysis carried out allowed us to develop a theoretical construct that approaches food morality from a holistic and interconnected perspective, providing us with a new way of understanding it. This new perspective on food morality will serve as an overarching framework for guiding individual choices, public policy making, and transformative actions needed to address the complex challenges facing food systems in the modern world. The aim of the consequentializing project is to show that, for every plausible ethical theory, there is a version of consequentialism that is extensionally equivalent to it. One challenge this project faces is that there are common-sense ethical theories that posit moral dilemmas. There has been some speculation about how the consequentializers should react to these theories, but so far there has not been a systematic treatment of the topic. In this article, I show that there are at least five (...) ways in which we can construct versions of consequentialism that are extensionally equivalent to the ethical theories that contain moral dilemmas. I argue that all these consequentializing strategies face a dilemma: either they must posit moral dilemmas in unintuitive cases or they must rely on unsupported assumptions about value, permissions, requirements, or options. The dual-use dilemma arises in the context of research in the biological and other sciences as a consequence of the fact that one and the same piece of scientific research sometimes has the potential to be used for bad as well as good purposes. It is an ethical dilemma since it is about promoting good in the context of the potential for also causing harm, e.g., the promotion of health in the context of providing the wherewithal for the (...) killing of innocents. It is an ethical dilemma for the researcher because of the potential actions of others, e.g., malevolent non-researchers who might steal dangerous biological agents, or make use of the original researcher’s work. And it is a dilemma for governments concerned with the security of their citizens, as well as their health. In this article we construct a taxonomy of types of “experiments of concern” in the biological sciences, and thereby map the terrain of ethical risk. We then provide a series of analyses of the ethical problems and considerations at issue in the dual-use dilemma, including the impermissibility of certain kinds of research and possible restrictions on dissemination of research results given the risks to health and security. Finally, we explore the main available institutional responses to some of the specific ethical problems posed by the dual-use dilemma in the biological sciences. (shrink)

This article addresses dilemmas of agency for feminism through reflections on social psychological research on the role of representations in the construction of identity by Muslim women. Engaging first with Saba Mahmood’s account of religious subjectivities in Politics of Piety, the author argues that feminist research requires a social conception of agency that addresses dialogical dynamics of representation and identity. Drawing on research concerning veiling and identity among Muslim women in the UK and Denmark, the author shows how a social (...) conception of agency may be elaborated through the analysis of how competing representations of gender are negotiated in the self–other encounter. The author argues that a dialogical approach to researching identity in context defies blunt political judgement while shedding light on the intersecting socio-cultural forces and relations of power that engage processes of resistance and re-presentation. Quentin Meillassoux has argued that lives irremediably ruined by injustice, suffering, and tragedy confront us with an irresolvable dilemma: either God exists to bring justice to the world, or God does not exist and true justice is an impossibility. He proposes to escape this dilemma by introducing the idea of a “virtual” God who does not exist now but who could unpredictably come into existence in the future. According to Meillassoux’s argument, such an event would entail a radical (...) break with the world as we know it; at the same time, Meillassoux avows a thoroughgoing dismissal of any thought that relies on appeals to transcendence. This paper argues that Meillassoux’s notion of the inexistent God betrays his own commitment to immanence, and that Bruno Latour offers a more consistent and more constructive way of understanding the divine on immanent terms. Israeli religious settlers live in contested territory that they claim is promised to them by God. The settlers are at the center of the Israeli–Palestinian dispute and are the recipients of international condemnation for their illegal behavior. Because the territories are neither sovereign nor legally recognized by Israel, their definition is open to construction. Religious settlers make arguments to satisfy three discursive dilemmas that must be solved in order to normalize their lives. They must 1) construct their own authenticity, 2) (...) marginalize the native others, and 3) establish cultural authority. These dilemmas are explicated in this essay. (shrink)

The article discusses the priority of belonging to a particular community and identification with it. The authors believe that among the entire set of communities, membership in political groups should be a priority, and their membership in state political communities should be higher than territorial, ethnic, religious, linguistic and other differences. However, the devotion of religious believers to an international religious community that does not know official state borders can exceed their devotion to the state as the main political institution. (...) Consequently, they can become a centrifugal force that threatens the solidarity of political unity. The authors define this conflict as the “believer-citizen” dilemma, which poses serious challenges in the field of nation building in China. Based on the concept of related identities, the article analyzes and explains the existing dilemma “believer – citizen” from the position of simultaneous inclusion in various social groups. The authors suggest that such an approach, involving the analysis of membership in several social groups, is useful for constructing solutions to this dilemma. In conclusion, the authors conclude that religion has many opportunities for the upbringing of civic virtues. Ethical principles such as kindness, tolerance, and empathy are widespread in various religions, and they have indeed become universally recognized human virtues. In this sense, believers can also be good citizens and at the same time fulfill their religious and civic duties, which will not contradict each other. For religious fundamentalists, on the other hand, an extreme form of religious identity can undermine their social life. How to create institutions based on honesty and justice, how to build reliable and correct strategies for constructing identities in order to promote self-identification from citizenships and reduce identification based on extreme religious movements, as well as how to use religious identity to create a civic identity on its basis – these are the biggest problems in state building. In this article we attempt to answer the question of how the ethical and conceptual framework (ECF) for a learning health‐care system (LHS) affects some of the main controversies in research ethics by addressing five key problems of research ethics: (a) What is the difference between practice and research? (b) What is the relationship between research ethics and clinical ethics? (c) What is the ethical relevance of the principle of clinical equipoise? (d) Does participation in research require a higher standard (...) of informed consent than the practice of medicine? and (e) What ethical principle should take precedence in medicine? These questions allow us to construct two opposite idealized positions on the distinction between research and practice: the integration model and the segregation model of research and practice. We then compare the ECF for an LHS with these two idealized positions. We argue that the ECF for a LHS does not, in fact, solve these problems, but that it is a third, separate position in the relationship between research ethics and clinical ethics. Moreover, we suggest that the ECF for a LHS raises new ethical problems that require additional ethical analysis and justification. Our article contributes to the discussion on the relationship between research ethics and clinical ethics, revealing that although a learning health‐care system may significantly change the landscape of health care, some ethical dilemmas still require resolving on both theoretical and policy‐making levels. Is freedom compatible with determinism? Davidson famously rephrased this question by replacing “freedom” with “anomaly of the mental”, that is, failure to fall under a law. In order to prove that the anomaly of the mental is compatible with other conjectures he makes, in particular that: there is psycho-physical causation; “where there is causality, there must be a law” ; and the mental supervenes on the physical, Davidson proposed a model, that came to be known as anomalous monism. Accepting all (...) of Davidson’s conjectures, we compare the structure of Davidson’s argument with that of Einstein’s argument for the special theory of relativity. This leads us to an exposition of Davidson’s ontology in terms that are inspired by recent results in the philosophy of physics, that is, in terms of fundamental ontology and high-level coarse-grained descriptions. We explain in what sense Davidson’s model is a principle theory and discuss some requirements that the constructive theory underlying Davidson's principle approach must satisfy. We propose two constructive theories of description that may underlie Davidson's approach and this deeper structure leads us to formulating a dilemma according to which Davidson's approach entails either a non-physicalist type-identity reductive and monistic structure of events; or else it entails a structure of events that requires what we call token-substance dualism. We consider some issues which seem to suggest that the first horn of this dilemma collapses into a reductive type-identity physicalist theory, contrary to Davidson's intent. Finally, we show how Davidson's achievement of accounting for some freedom of the mental from the physical and the anomaly of the mental within anomalous monism can be achieved in a fully reductive type-identity physicalist theory. Modern scientific theories of emotional behavior, almost without exception, trace their origin to Charles Darwin, and his publications On the Origin of Species (1859) and The Expression of the Emotions in Man and Animals (1872). The most famous evolutionary dilemma Darwin acknowledged as a challenge to his theory of natural selection was the incomplete sub Cambrian fossil record. However, Darwin struggled with two other rarely referenced theoretical and scientific dilemmas that confounded his theories about emotional behavior. These included (1) (...) the origin of social instincts (e.g., altruism, empathy, reciprocity and cooperation) and the reasons for their conservation in evolution and (2) the peripheral control of heart rate vis-a-vis emotional behavior outside of consciousness. Darwin acknowledged that social instincts are critical to the survival of some species, but had difficulty aligning them with his theory of natural selection in humans. Darwin eventually proposed that heart rate and emotions are controlled via one’s intellect and cortical mechanisms, and that instinctive behavior is genetically-programmed and inherited. Despite ongoing efforts, these two theoretical dilemmas are debated to this day. Simple testable hypotheses have yet to emerge for the biological mechanisms underlying instinctive behavior or the way heart rate is controlled in infants. In this paper, we review attempts to resolve ¬these issues over the past 160 years. We posit that research and theories that supported Darwin’s individualistic brain-centric and genetic model have become an “orthodox” Western view of emotional behavior, one that produced the prevailing behavioral construct of attachment as developed by John Bowlby. We trace research and theories that challenged this orthodoxy at various times, and show how these challenges were repeatedly overlooked, rejected, or misinterpreted. We review two new testable theories, emotional connection theory and calming cycle theory, which we argue resolve the two dilemmas We show emerging scientific evidence from physiology and a wide variety of other fields, as well from clinical trials among prematurely born infants, that supports the two theories. Clinical implications of the new theories and possible new ways to assess risk and intervene in emotional, behavioral and developmental disorders are discussed. (shrink)

Americans like ambiguity, that they function best amid flux; ambivalence becomes their proper medium. For this reason, I have accepted Nathaniel Hawthorne as our most central writer. He situates American questions within a landscape of chiaroscuro. The Jesuit experience in the United States belongs essentially to the same landscape. But today, as formerly, it remains a landscape of questions. McDonough, on the other hand, has too many certitudes, too many answers, too much high definition-what Henry Adams regards as "mere facts." Instead of illuminating the landscape from within, his study inevitably recedes into the larger ambiguity reserved for what Wallace Stevens has called, " Prologues to what is possible." As a Christian and a philosopher, Linda Trinkaus Zagzebski wants to understand why it is reasonable to affirm that we remain free despite God's infallible knowledge of our future acts. Moreover, she is not content simply to demonstrate that this affirmation involves no logical con· tradiction, for "reasonable people expect more" (p. 33) than a merely negative result. Hence the author sets herself the more ambitious task of working toward a positive solution that would explain why the compatibility of divine foreknowledge and human freedom is plausible and not a bare logical possibility. The hook sorts out recent opinions on the subject and sketches an original position that she hopes will advance the discussion. Zagzehski begins by constructing the most formidable version of the dilemma. Assuming that God is infallible and essentially omniscient, that the past has a kind of necessity that the future lacks ("accidental necessity"), and that this necessity can he transferred (in some sense) from the antecedent to the consequent of a conditional proposition, the dilemma may he stated as follows: BOOK REVIEWS (1) Necessarily, God believes at time t 1 that I will do S at t 3 if and only if I do S at t 3. (2) It is accidentally necessary at t 2 that God believes at t 1 that I will do S at t 3. (3) If (1) and (2) are true, then it is accidentally necessary at t 2 that I do Sat t 3. (4) It follows that it is accidentally necessary at t 2 that I do S at t 3. (5) But if it is accidentally necessary at t 2 that I do S at t 3, I do not do S at t 3 freely. (6) Therefore, I do not do S at t 3 freely. 715 Much of the first chapter is devoted to establishing that this form of the dilemma is more resistant to solution than any other, especially the so-called problem of future truth. Zagzebski goes on to evaluate three broad approaches to solving the dilemma. In Chapter 2 she takes up the " timelessness " solution. Its proponents, among whom the author numbers Boethius, Thomas Aquinas, Eleonore Stump, and Norman Kretzmann, negate premise (2) of the foreknowledge dilemma by contending that God is not in time. Zagzebski considers this an acceptable negative solution to the dilemma and sees in it the potential to ground a more comprehensive, positive solution. Nonetheless, she refrains from subscribing wholeheartedly to the timelessness solution because it confronts one with a dilemma at least as perplexing as the one it solves. She puts the problem this way: like the past, eternity is fixed, for it is constituted by a state of affairs about which we cannot do anything; therefore my future acts are determined no less by God's timeless knowledge than by God's foreknowing them in a strictly temporal sense. Infertility Accepted treatment is replete with bioethical dilemmas regarding the limits of available medical therapies. Poland has no legal acts regulating the ethical problems associated with infertility treatment and work on such legislation has been in progress for a long time, arousing very intense emotions in Polish society. The purpose of the present study was to find out what Polish women undergoing infertility treatment think about the most disputable and controversial bioethical problems of assisted reproduction. An Attitudes towards Bioethical Problems (...) of Infertility Scale was constructed specifically for this study. Items were taken from the Bioethics Bills currently under discussion in Polish Parliament (Seym). 312 women were enrolled in the study. Women experiencing infertility favoured more liberal legislation. Participants disagreed, for example, with the following regulations: prohibition of embryo freezing, prohibition of preimplantation genetic diagnosis of embryos, age limits for women using in vitro fertilisation and prohibition of in vitro fertilisation for single women. The opinions of patients undergoing infertility treatment are an important voice in the Polish debate on the Bioethics Bills. (shrink)

Bioethics journals have lagged behind medical and science journals in exploring the threat of conflict of interest (COI) to the integrity of publications. Some recent discussions of COI that have occurred in the bioethics literature are reviewed. Discussions of what has been termed the ?Healy affair? unintentionally demonstrate that the direct and indirect influence of undisclosed COI may come from those who call for protection from the undue influence of industry. Paradoxically, the nature and tone of current discussions may serve (...) to dull sensitivities to what is indeed a serious set of issues facing bioethics. Some proposals are presented to address COI and other challenges to the integrity of bioethics and its journals. COI is too important a topic to be left to ideologues, and there is no substitute for readers' caution and skepticism as tools in dealing with the full range of biases that exist in published papers. Among advocates and critics of the “extended evolutionary synthesis” (EES), “reciprocal causation” refers to the view that adaptive evolution is a bidirectional phenomenon, whereby organisms and environments impinge on each other through processes of niche construction and natural selection. I argue that reciprocal causation is incompatible with the view that natural selection is a metaphysically emergent causal process. The emergent character of selection places reciprocal causation on the horns of dilemma, and neither horn can rescue it. I conclude that (...) proponents of the EES must abandon the claim that the process of natural selection features in cycles of reciprocal causation. (shrink)

It is generally believed that, for a one-off Prisoner’s Dilemma game, it is logical to defect. However, both players cooperating is apparently a better choice than both defecting, hence the dilemma. In this paper, by resorting to Ramsey’s Test, Kripke’s possible world semantics, and Stalnaker/Lewis-style account of conditionals, I show that the first horn of the Prisoner’s Dilemma is an unsound argument. It originates from failing to differentiate between a possible world and a possible set of possible (...) worlds and failing to observe that the set of accessible possible worlds associated with a possible world in general varies from conditional to conditional. This phenomenon can also be illustrated in terms of the recently developed hi-world semantics. This article aims at examining the limits of change in the field of worship through a study on the origins of the ḥukm[religious ruling] of Shawwāl fasting that is widely practiced in the different parts of Muslim world. The study, firstly, deals with the evolution of the ḥukm of Shawwāl fasting chronologically among four sunnī schools of law, then analyzes the solitary reports on the topic. It concludes that in Mālikīand Ḥanefīschools, the ḥukm of this specific worship changed within the (...) limits of karāha [reprehensibility], ibāha [permissibility], and nadb [recommendation]. This ḥukm was constructed based on solitary reports which later became a paradigmatic source of religious legitimacy in the Ḥanbalīschool beginning with the eponymous Imām and in the Shāfiʿīlong after the founding authorities. It also claims that it is strongly probable that the solitary reports on the topic go back to a deduced opinion in the age of companions, but then reached to a form of prophetic solitary report in the corpus of hadīth reports. Ultimately, this specific worship that has restricted number of fasting was established with the paradigmatic effect of the approach to solitary reports as the only authentic way of transmitting the sunna, even though it is at odds with the fact that this worship had not been implemented in the first two centuries after hijra, i.e. contrary to the established practice [ʿamal]. Summary: The issue of change of rulings in Islamic law comes up frequently on various occasions, and an increasing number of academic studies are trying to determine the characteristics and limits of this change in numerous books, articles and papers. These studies mostly seem to focus on bringing together the arguments that can be compiled under the title of ‘the flexibility of Islamic law in response to the challenges of modernity’. Although the change of rulings in Islamic law is an undeniable fact, reading it only from the lens of the change in Islamic law depending on the requirements of time is an inadequate reading. The change of rulings in Islamic law has different motives; and the change of time, more precisely the change of custom, is only one of them.On the other hand, another issue that comes up in relation to the change of rulings is the claim that this change can only take place in terms of the rulings regulating the interpersonal relations, i.e. muʿāmalāt. In fact, this claim relies on the abovementioned approach that limits the change in Islamic law with the change of custom. Hence, because other two main areas of Islamic law, worships (ʿibādāt) and punishments (ʿuqūbāt) are not open to change through custom, their rulings will not change at all. This article will try to reveal that the change in rulings might reside in a sort of another change emerged in relation to the sources of these rulings, which is a neglected point. Thus, by exposing that the field of worships which is mostly considered as a closed area for change in rulings is actually open to it, this article will examine the limits of this change.For this analysis, the article deals with the fasting of six days in the month of Shawwāl as an example, which is widely practiced in various parts of the Islamic world. The main evidence on which this fasting is based on is a report transmitted in the considerably authentic hadith sources of Ahl al-Sunnah, which reads as follows “Whoever fasts the Ramaḍān and adds six days from Shawwāl, will get reward of the entire year”. This fasting, which is the subject of a great agreement on its ruling as recommended (mustaḥāb) practice today, was actually regarded as reprehensible (makrūh) by the two great eponymous jurists of the first two schools of law in the second Hijrī century, namely Mālik b. Anas and Abū Ḥanīfa. In his al-Muwaṭṭaʾ,Mālik clearly expresses that he did not recognize any scholar who keeps this fast, and that no [authentic] report has reached him on this. The fact that both Mālik b. Anas and Abū Ḥanīfa declared an opinion on the subject shows that this practice started to appear in the first half of the second ḥijrī century as a practice or as a solitary report (khabar al-wāḥid). However, both imāms have stated that such a specific worship would be makrūh. In spite of these very sharp expressions, the schools of law, which were founded by the followers of these two eponymous scholars, abandoned their views and widely accepted Shawwāl fasting as mustaḥāb. This article examines why this sharp change occurred in a worship in the schools of law and in which way it took place.Accordingly, the fundamental motive in this change is a paradigmatic transformation in understanding and identifying the sunna as a source of normativity. Although an agreement was formed on the validity of solitary reports as a source of knowledge in the second ḥijrī century, it was not yet accepted that these narrations are identical to sunna as a source of normativity. For that reason, both Abū Ḥanīfa and Mālik did not hesitate to reject any solitary report that contradicted a stronger evidence. However, as a result of the extraordinary efforts of Ahl al-Ḥadīth, the epistemic value of solitary reports has reached to an authority equating them to the sunna with a very rapid acceleration as of the end of the second century and throughout the third century. This situation led later scholars of schools to abandon the views of the eponymous scholars of these schools on certain topics in favor of certain solitary reports. This was also the process for the change in Shawwāl fasting.This thesis will be put under two headings, a section that tries to determine the periods and processes for the Sunnī schools of law in considering this fasting as mustaḥāb; and another section that provides an evaluation of transmitted reports in relation to the Shawwāl fasting. Accordingly, in the Mālikī and Ḥanafī schools, due to the effect of the reports, the ruling of Shawwāl fasting has been transformed from makrūh into the mustaḥāb as a result of the interpretational activities that started in the fourth ḥijrī century. Shawwāl fasting was accepted as mustaḥāb in the Shāfiʿī school, although there was no transmitted opinion on the subject from the founding imāms, in the fifth ḥijrī century; and in the Ḥanbalī school directly by the founding imām Aḥmad b. Ḥanbal, whose main aim was to follow a concept of religion that puts the transmitted reports at the center. When the reports on the subject are examined, it demonstrates that the mustaḥāb ruling is mainly rooted in a report by Saʿd b. Saʿīd transmitted in the famous hadīth compilations including Muslim’s Ṣaḥīḥ.Yet, this report was criticized in its both chain and text. Combining the facts that the same report with the same chain was also transmitted as the words of the companion in some sources and the verse that declares good deed will be rewarded ten times higher than what it deserves will make the following explanation a valid one: As Mālik put it such a fasting practice was commonly unknown to the Muslim society in the first two centuries after the ḥijra. Sometime after the death of the Prophet, an inference was made probably by a companion(s) as that it would be a good deed if someone who fasted an entire month already and got used to the fasting to fast six more days in order to get a reward of fasting for the entire year according to the verse that rewards good deeds with ten times higher. Since it is a recommended practice in essence, i.e. fasting for the sake of Allah, this inference transformed into a report and easily passed through the filters of hadīth scholars who are linked to a sort of piety promoting worships among people. After the solitary reports gained an authority to the extent that they can rarely be challenged, the followers of later schools of law preferred to get in a process of re-interpreting the opinions of their imāms in order either to reconcile them with the content of report, or at least to show why these imāms actually spoke against this fasting. Eventually, the later scholars of madhhab decided for the standard opinion of the madhhab depending on the reports in favor of the Shawwāl fasting rather than following their eponymous imāms. In this paper, I support a hybrid form of expressivism called constructive ecumenical expressivism (CEE) which I have previously used (to attempt) to resolve the gamer’s dilemma. (Young, 2016. Resolving the gamer’s dilemma. London: Palgrave Macmillan.) In support of CEE, I argue that the various other attempts at either resolving, dissolving or resisting the dilemma are consistent with CEE’s moral framework. That is, with its way of explaining what a claim to morality is, with how moral (...) norms are established, with the role intuition is able to play in establishing these norms, and therefore with how the gamer’s dilemma can be resolved. I also demonstrate, more broadly, how CEE advocates robust relativism as a means of justifying the constructed moral norm’s normative credentials, and therefore how one society’s norm can be judged morally superior to another’s. A currently popular view among legal positivists is that law is a social construction. Many of the same legal philosophers also argue that before one can study law empirically, one needs to know what it is. At the heart of this paper is the claim that these two propositions are inconsistent. It presents the following dilemma: if law is a social construction like all other social constructions, then legal philosophers have to explain what philosophers have to contribute to understanding (...) it. Studies of social constructions are typically conducted by historians, sociologists, and others, who explain them on the basis of empirical data. If, as legal philosophers claim, conceptual clarification must precede empirical work, then it follows that the lack of conceptual work on the nature of other social constructions renders suspect all empirical work on them. To avoid such a radical conclusion, legal philosophers may argue instead that law is a social construction of a special kind. But to say that is to undermine the premise with which the argument began. Moreover, this response to the dilemma collapses what is now taken to be what separates legal positivism from natural law theory, thus undermining the motivation for this view. I conclude the essay by offering a different solution to the dilemma by suggesting that it shows that the fundamental debates of legal philosophy are not conceptual but political. (shrink)

The construction industry is usually characterized as a fragmented system of multiple-organizational entities in which members from different technical backgrounds and moral values join together to develop a particular business or project. The greatest challenge in the construction process for the achievement of a successful practice is the development of an outstanding reputation, which is built on identifying and applying an ethical framework. This framework should reflect a common ethical ground for myriad people involved in this process to survive and (...) compete ethically in today’s turbulent construction market. This study establishes a framework for ethical judgment of behavior and actions conducted in the construction process. The framework was primarily developed based on the essential attributes of business management identified in the literature review and subsequently incorporates additional attributes identified to prevent breaches in the construction industry and common ethical values related to professional engineering. The proposed judgment framework is based primarily on the ethical dimension of professional responsibility. The Ethical Judgment Framework consists of descriptive approaches involving technical, professional, administrative, and miscellaneous terms. The framework provides the basis for judging actions as either ethical or unethical. Furthermore, the framework can be implemented as a form of preventive ethics, which would help avoid ethical dilemmas and moral allegations. The framework can be considered a decision-making model to guide actions and improve the ethical reasoning process that would help individuals think through possible implications and consequences of ethical dilemmas in the construction industry. Our study presents an overview of the issues that were brought forward by participants of a moral case deliberation (MCD) project in two elderly care organizations. The overview was inductively derived from all case descriptions (N = 202) provided by participants of seven mixed MCD groups, consisting of care providers from various professional backgrounds, from nursing assistant to physician. The MCD groups were part of a larger MCD project within two care institutions (residential homes and nursing homes). Care providers are (...) confronted with a wide variety of largely everyday ethical issues. We distinguished three main categories: ‘resident’s behavior’, ‘divergent perspectives on good care’ and ‘organizational context’. The overview can be used for agendasetting when institutions wish to stimulate reflection and deliberation. It is important that an agenda is constructed from the bottom-up and open to a variety of issues. In addition, organizing reflection and deliberation requires effort to identify moral questions in practice whilst at the same time maintaining the connection with the organizational context and existing communication structures. Once care providers are used to dealing with divergent perspectives, inviting different perspectives (e.g. family members) to take part in the deliberation, might help to identify and address ethical ‘blind spots’. This paper attempts to draw on management theory and practice and, more specifically, on know-how from the study of teamwork, to seek insights into enhancing the effectiveness of hospital ethics committees and clinical ethics committees (CECs), with the aim of contributing to heath-care organizations’ effective and efficient decision-making and operation. Based on an analysis of the obstacles that stand in the way of ethics committees’ (ECs’) efficient functioning, five specific conditions for EC success are brought forth. A couple of practical (...) tools for their attainment are proposed. The article suggests that the construction of those committees, as well as the working procedures that may render them effective, should be flexible and made adaptable to the specific assignment or case, which is dealt with by that committee, at the time; and that the optimal set of procedures to adopt, throughout the working sessions of ECs, are those which will gear the committee with the means to contribute to the eventual materializing and finalization of a quality and practical set of decisions; for the benefit of patients, their families, health-care organizations and the community, alike. What does the Kantian realm of ends look like? To partially answer that question, game theory will be used to analyse how Kantians would handle situations of strategic interaction. Starting from a thorough understanding of Kant's categorical imperative, three purportedly Kantian game theoretical models will be analysed and argued to be inconsistent with the categorical imperative. As these existing models are unfit for analysing strategic interaction in the realm of ends, a genuinely Kantian model will be constructed by adding the (...) concepts of ‘moral field’, ‘moral range’ and ‘Kantian utility function’ to the standard game‐theoretical model. Throughout the paper, the prisoner's dilemma will be used both as a case study and as a ground for argumentation. (shrink)

Scientifically derived environmental indicators are central to environmental decision analysis. This article examines the interface between science (environmental indicators) and policy, and the dilemma of their integration. In the past, science has been shown to dominate many policy debates, usually with unfavorable results. The issue, therefore, is not whether science can determine policy but how science can be part of a more holistic analysis that incorporates other critical perspectives. This article discusses the importance of considering alternative views (as represented (...) by different scientific indicators) within the policy debate. Six example ozone indicators, constructed from the same raw data, are used to illustrate this point. Two represent newly developed indicators that respond to present-day policy questions at theU.S. Environmental Protection Agency. The article concludes with a brief discussion of how such indicators can be used to better define a policy question, inform the policy debate, and evaluate policy alternatives. (shrink)

Health care professionals often face moral dilemmas. Not dealing constructively with moral dilemmas can cause moral distress and can negatively affect the quality of care. Little research has been documented with methodologies meant to support professionals in care for the homeless in dealing with their dilemmas. Moral case deliberation is a method for systematic reflection on moral dilemmas and is increasingly being used as ethics support for professionals in various health-care domains. This study deals with the question: What is the (...) contribution of MCD in helping professionals in an institution for care for the homeless to deal with their moral dilemmas? A mixed-methods responsive evaluation design was used to answer the research question. Five teams of professionals from a Dutch care institution for the homeless participated in MCD three times. Professionals in care for the homeless value MCD positively. They report that MCD helped them to identify the moral dilemma/question, and that they learned from other people’s perspectives while reflecting and deliberating on the values at stake in the dilemma or moral question. They became aware of the moral dimension of moral dilemmas, of related norms and values, of other perspectives, and learned to formulate a moral standpoint. Some experienced the influence of MCD in the way they dealt with moral dilemmas in daily practice. Half of the professionals expect MCD will influence the way they deal with moral dilemmas in the future. Most of them were in favour of further implementation of MCD in their organization. (shrink)

Constructive Deviant Behavior (CDB) raises an ethical dilemma that poses a significant challenge within the realm of business ethics. This ethical dilemma is the extent to which individuals should be allowed, or even encouraged, to challenge established norms in the name of organizational and stakeholder well-being before compromising ethical principles. Despite the growing body of research in this field, which highlights the emergence of a new domain, there remains a lack of a comprehensive framework to define and (...) understand CDB within organizational contexts. Therefore, the main objective of this study is to fill this gap by conducting a thorough analysis of the literature using the PRISMA methodology. In order to systematically review previous research, a sample of relevant articles was selected and analyzed in depth with the aim of defining a comprehensive framework clarifying the nature, forms, and dimensions of CDB. In addition, the relationships between CDB and its antecedents and outcomes were investigated from a business ethics perspective. Within this context, the study proposes a unified CDB framework while acknowledging and integrating the diverse perspectives that have emerged in past studies. Furthermore, this research reveals that individual and organizational characteristics are the predominant antecedents of CDB. Finally, as an emerging domain of increasing practical relevance within business ethics, this subject offers fertile avenues for future research, as delineated by the findings of this study. How should driverless vehicles respond to situations of unavoidable personal harm? This paper takes up the case of self-driving cars as a prominent example of algorithmic moral decision-making, an emergent type of morality that is evolving at a high pace in a digitised business world. As its main contribution, it juxtaposes dilemma decision situations relating to ethical crash algorithms for autonomous cars to two edge cases: the case of manually driven cars facing real-life, mundane accidents, on the one hand, (...) and the dilemmatic situation in theoretically constructed trolley cases, on the other. The paper identifies analogies and disanalogies between the three cases with regard to decision makers, decision design, and decision outcomes. The findings are discussed from the angle of three perspectives: aspects where analogies could be found, those where the case of self-driving cars has turned out to lie in between both edge cases, and those where it entirely departs from either edge case. As a main result, the paper argues that manual driving as well as trolley cases are suitable points of reference for the issue of designing ethical crash algorithms only to a limited extent. Instead, a fundamental epistemic and conceptual divergence of dilemma decision situations in the context of self-driving cars and the used edge cases is substantiated. Finally, the areas of specific need for regulation on the road to introducing autonomous cars are pointed out and related thoughts are sketched through the lens of the humanistic paradigm. (shrink)

Quinoa farmers in San Agustín, Bolivia face the dilemma of producing for a growing international market while defending their community interests and resources, meeting their basic household needs, and making a profit. Farmers responded to a changing market in the 1970s by creating committees in defense of quinoa and farmer cooperatives to represent their interests and maximize economic returns. Today farmer cooperatives offer high, stable prices, politically represent farmers, and are major quinoa exporters, but intermediaries continue to play an (...) important role in the local economy. Meanwhile, some farmers rebuff the national cooperatives and intermediaries in favor of a denomination of origin and closer association with local cooperatives. This article, based on 4 months of ethnographic research, explores the reasons for the continued presence of intermediaries on the market landscape and how farmers have worked to create a quinoa economy embedded with fair trade values. Farmers demand stable prices, flexible standards, provision of services, and promises of maintaining the distinctive qualities of San Agustín quinoa. They frame their trades in economic, utility, and solidarity terms to reflect their livelihood strategies, farming capabilities, and personal concepts of fair trade. Meanwhile cooperatives, development initiatives, and intermediaries each argue that their particular buying practices allow farmers to attain household goods, credit, and cash for food and economic security. The New Year’s Sacrifice" by Lu Xun, a celebrated exploration of his native Lu Town, provides a profound commentary on the paradoxes within rural Chinese society. This paper aims to reinterpret the novella through a philosophical and theological lens, leveraging a New Criticism framework alongside methodologies such as close reading, content analysis, psycholinguistics, and cognitive mapping. Our analysis reveals a deeply entrenched social hierarchy characterized by the senior/central class led by Master Lusi, a duplicitous middle class, and a marginalized lower (...) class epitomized by Xianglin Sao. Within this rigid social structure, Lu Xun crafts a narrative rich in paradoxical dynamics and carnivalesque contradictions, highlighting both the microcosmic personal paradoxes and the macrocosmic thematic ironies, particularly the ironic notion of “blessing” that infuses the narrative with a complex tension. Moreover, the text engages in a profound act of self-reflexive paradox where the narrator, as both a construct and a reflection of Lu Xun’s own decontextualized self, serves as a medium for exploring themes of existential alienation and self-denial. This reinterpretation posits Lu Xun’s work not merely as a social critique but as a spiritual and philosophical meditation on the nature of suffering, identity, and the human condition, inviting a deeper understanding of the existential and theological underpinnings of his literary expression.
