What is the value of having medical students engage in creative production as part of their learning? Creating something new requires medical students to take risks and even to fail--something they tend to be neither accustomed to nor comfortable with doing. “Making stuff” can help students prepare for such failures in a controlled environment that doesn’t threaten their professional identities. Furthermore, doing so can facilitate students becoming resilient and creative problem-solvers who strive to find new ways to address vexing questions. (...) Though creating something new can be fun, this is not the main outcome of interest. Rather, the principle reason we recommend devoting precious curricular time to creative endeavors is because it helps medical students become better doctors. (shrink)

In this entry, I tackle the phenomenon known as "faultless disagreement", considered by many authors to pose a challenge to the main views on the semantics of subjective expressions. I first present the phenomenon and the challenge, then review the main answers given by contextualist, absolutist and relativist approaches to the expressions in question. I end with signaling two issues that might shape future discussions about the role played by faultless disagreement in semantics.

Rationing is the allocation of a good under conditions of scarcity, which necessarily implies that some who want and could be benefitted by that good will not receive it. One reflection of our ambivalence towards health care rationing is reflected in our resistance to having it distributed in a market like most other goods—most Americans reject ability to pay as the basis for distributing health care. They do not view health care as just another commodity to be distributed by markets. (...) Despite this widespread view, we are the only developed country without some form of universal health insurance, and so for the 46 million Americans without health insurance their access to health care often does depend on their ability to pay for it. Rationing largely remains a topic that the public, their elected leaders, and many health care professionals prefer to avoid. Ever-growing costs of health care will increasingly force the practice and issue of health care resource prioritization and rationing into the open for public, professional, and political attention. This paper explores some of the features of those practices and issues that make them especially ethically and politically difficult. Those issues will not be easily resolved, but avoiding them will not avoid the need or reality of rationing, it will only mean that it will go on covertly and unexamined. That will lead neither to better or more legitimate prioritization and rationing decisions. (shrink)

At common law, contributory infringement for copyright infringement requires "knowledge" of the infringing activity by a direct infringer before secondary liability can attach. In the USA, the "safe harbor" provisions of the Digital Millennium Copyright Act, that shield Internet Service Providers from secondary copyright liability, are concomitantly available only to ISPs that lack the common law knowledge prerequisites for such liability. But this leads to the question of when a juridical corporate entity can be said to have "knowledge" under the (...) statute. Legal institutions have well-established processes for inferring the knowledge state of natural persons, but corporations are complex sociotechnical networks of human and non-human elements whose information state does not map well onto such inferential methods. This question is of course not unique to copyright liability; corporate entities may be responsible for "knowing" actions under a variety of applicable legal provisions, and the question of corporate knowledge is generally under theorized. But consideration of ISP "knowledge" in this context points the way to consideration of corporate epistemology that must be foundational to determining corporate responsibility in copyright protection. © The Author 2011. Departing from a critical assessment of the most widespread and initiated definitions of Contemporary Art from the last decade and a half, sustaining a world-wide discourse on contemporary art and contemporaneity, this article will deal with two aspects of an immodest proposal captured by the keywords actualization and anachrony. While current discussions on contemporary art are arguably reproducing modernist assumptions on the primacy of innovation, bolstered by a veiled avant-garde logic, the proposal to regard contemporary art as actualized art upsets (...) not only ideas on what art after postmodernism might mean, but the whole edifice of historicist historiography. An anachronic perspective, a bi- or polychronic situatedness of the work of art, could be used to liberate art from being defined according to its unique descent, and to embrace, instead, a chronologic open to art’s continuous “life” through its successive aesthetic accessions and actualizations in time. This essay reconsiders Jean-Jacques Rousseau’s debt to Jean Bodin, on the basis of Daniel Lee’s recent revision of Bodin as a theorist of popular sovereignty. It argues that Rousseau took a key feature of his own theory of democratic sovereignty from Bodin—namely, the dual identity of political members as both citizens and subjects of the state. It further makes the case that this dual identity originates in medieval corporatist law, which Bodin was summarizing. Finally, it demonstrates the lasting impact of (...) corporatist law in eighteenth-century France, highlighting Rousseau’s direct borrowings from the corporatist language and logic of contemporary commercial societies. In this regard, the article revisits and updates Otto von Gierke’s classic argument about the origins of the state in corporatist thought. (shrink)

When someone believes something that is justified for her, what part does the subject play in her state of being justified? I will answer this question by developing a strong internalist account of justification according to which the justification of a believing for a subject consists in her having grounds for her belief, and holding the belief in recognition of those grounds. But the internalist theory I defend incorporates key elements of reliabilism into its account. Using perception as a model (...) for justification, I show how ordinary perceivers would appeal to external factors to support their perceptual beliefs, and normally suppose that their beliefs are reliably connected to the objects their beliefs are about. I find in this feature of our common justificatory practice a sufficient basis for positing an externalist condition on justification—namely that subjects are only justified if their beliefs are reliably connected to their objects. What kind of futures does agro-food imaginaries enable and who can get involved in the making of agro-food futures? In this respect, what can the increasingly influential idea of circular economy potentially offer in terms of enabling more sustainable agrofood futures? We approach this task by first outlining the interconnected challenges that the agro-food system is facing related to environmental degradation, economic crises and social problems. Then we consider the way these challenges are being addressed in agro-food studies. We argue (...) that agro-food research in recent years has seen important contributions in relation to studies of alternative food networks and the “quality” turn. These research agendas have challenged the current logic of the food system in terms of offering alternative visions of future development. We highlight two examples from the literature—the eco-economy and the integrated territorial agri-food paradigm—that develop broader frameworks for rethinking the future of the agro-food system and which have distinguished themselves in contrast to the industrialized and globalized conventional food system. We find that with respect to reorienting and reconfiguring economic structures and relations all three approaches share a common goal, but circular economy stands out in relation to the actors that are included by, for example, emphasizing collaborations and partnerships with extant agro-food businesses. Also with regards to scalar politics, it would be prudent to consider the potentials offered by the increasingly influential ideas around circular economy. (shrink)

Background Randomized controlled trials are central to generating knowledge about effectiveness of interventions as well as risk, protective and prognostic factors related to diseases in emergency newborn care. Whether prospective participants understand the purpose of research, and what they perceive as the influence of the context on their understanding of the informed consent process for RCTs in emergency obstetric and newborn care are not well documented. Methods Conceptual review. Discussion Research is necessary to identify how the illnesses may be prevented, (...) to explore the causes, and to investigate what medications could be used to manage such illness. Voluntary informed consent requires that prospective participants understand the disclose information about the research, and use this to make autonomous informed decision about participation, in line with their preferences and values. Yet the emergency context affects how information may be disclosed to prospective research participants, how much participants may comprehend, and how participants may express their voluntary decision to participate, all of which pose a threat to the validity of the informed consent. I challenge the claim that the ‘understanding’ of research is always necessary for ethical informed consent for research during emergency care. I argue for reconceptualization of the value of understanding, through recognition of other values that may be equally important. I then present a reflective perspective that frames moral reflection about autonomy, beneficence and justice in research in emergency research. Conclusion While participant ‘understanding’ of research is important, it is neither necessary nor sufficient for a valid informed consent, and may compete with other values with which it needs to be considered. This article deals with choice-inducing algorithms––algorithms that are explicitly designed to affect people’s choices. Based on an ethnographic account of three Israeli data analytics companies, I explore how algorithms are being designed to drive people into choice-making and examine their co-constitution by an assemblage of specifically positioned human and nonhuman agents. I show that the functioning, logic, and even ethics of choice-inducing algorithms are deeply influenced by the epistemologies, meaning systems, and practices of the individuals who devise and use them (...) and that such algorithms are similarly affected by interorganizational relationships, various nonhuman agents, and changing geopolitical contexts. I conclude by discussing the flexibility of choice-inducing algorithms and by arguing that such algorithms are not programmed to induce specific choices but to more generally convert people into choosers, and thus, to algorithmically create the modern need to choose. This article contributes to the growing literature on algorithms and culture and to our understanding of choice-making in contemporary life. At the same time, it provides a new vocabulary that offers to critically engage with algorithms and their power without losing sight of the often very specific contexts from which they arise. In his book Ethics J. L. Mackie says that moral facts would have to be queer facts. I argue that an act’s hurting somebody is necessarily a reason, though not necessarily a conclusive reason, not to do that act; and that such hurting is a natural fact, not a queer fact. I try to defend this externalist position about this particular reason against internalists such as Mackie, and in particular against the position of Stephen Darwall in Impartial Reason.

Our heads are full of representations, according to cognitive science. It might seem inevitable that conscious states are a type of brain-based representation, but in this paper I argue that representation and consciousness each form conceptually distinct domains. Representational content depends on context, usually causal, as shown by familiar cases in which context varies while brain states do not -- twin earth cases and brains-in-vats, for example. But these same cases show that conscious content does not depend on context. The (...) vatted brain, for example, enjoys the same experiences as its in vivo counterpart. The structure of experience -- its parts and their distinctive characters -- is the dynamic structure of the brain, viewed "from within." I call this position methodological phenomenalism (MP), and consider its prospects as a foundation for a science of consciousness. I close with a consideration of MP on the subjective "character" of conscious states. Turning away from representation dissolves the perplexity of subjectivity, leaving hopeful prospects for the scientific study of consciousness. (shrink)

Paul Taylor has argued that all living organisms have equal inherent worth. David Schmidtz objects, insisting that there is little to be gained by talk of “equality” in interspecific contexts. On Schmidtz’s view, ethicists should be satisfied simply to say that all organisms deserve respect, while leaving unspecified how such claims to respect measure up to one another. Yet in this paper, I contend that Schmidtz’s position cannot be sustained in the face of predictable and ongoing conflict between species. When (...) sacrifices of some organisms’ interests and lives are inevitable, it is facile to demand simply that all living things deserve respect. Ethicists must be able to say how such conflicts are to be resolved, which means that they must have something to say about how organisms and their interests compare to one another in their moral significance. Paul Taylor may be wrong to think that such questions should be answered by appeal to the moral equality of all living things, but his mistake lies in thinking that all beings’ natures as “teleological centers of life” captures all that is relevant from a moral point of view. Normative Subjects alludes to the fields of morality and law, as well as to the entities, self and collectivity, addressed by these clusters of norms. The book explores connections between the two. The conception of self that informs this book is the joint product of two multifaceted philosophical strands, the constructivist and the hermeneutical. Various schools of thought view human beings as self creating: by pursuing our goals and promoting our projects, and so while abiding by the various norms that (...) guide us in these endeavors, we also determine human identity. The result is an emphasis on a reciprocal relationship between law and morality on the one side and the composition and boundaries of the self on the other.
