Compare your pain when immersing your hand in freezing water and your pleasure when you taste your favourite wine. The relationship seems obvious. Your pain experience is unpleasant, aversive, negative, and bad. Your experience of the wine is pleasant, attractive, positive, and good. Pain and pleasure are straightforwardly opposites. Or that, at any rate, can seem beyond doubt, and to leave little more to be said. But, in fact, it is not beyond doubt. And, true or false, it leaves a (...) good deal more to be said: about the nature of sensory affect; its relations to perception, motivation, and rationality; its value; and the mechanisms underlying it. This is an obituary for Michael H. Robins.

We discuss focus sensitivity in English, the phenomenon whereby interpretation of some expressions is affected by placement of intonational focus. We concentrate in particular on the interpretation of always and only, both of which are interpreted as universal quantifiers, and both of which are focus sensitive. Using both naturally occurring and constructed data we explore the interaction of these operators with negative polarity items, with presupposition, with prosodically reduced elements, and with syntactic extraction. On the basis of this data we (...) show that while only lexically encodes a dependency on the placement of focus, always does not. Rather, the focus sensitivity of always results from its dependency on context, and from the fact that focus also reflects what is given in the context. We account for this split using an analysis couched in event semantics. (shrink)

This article is an attempt to understand ethical theory not just as a set of well-developed philosophical perspectives but as a range of moral capacities that human beings more or less grow into over the course of their lives. To this end, we explore the connection between formal ethical theories and stage developmental psychologies, showing how individuals mature morally, regarding their duties, responsibilities, ideals, goals, values, and interests. The primary method is to extract from the writings of Kohlberg and his (...) students the cues that help to flesh out a developmental picture of a wide range of ethical perspectives. Thus, developmental psychology benefits from gaining a broader understanding of “morality” and “ethics,” and ethical theory benefits from a richer understanding of how moral maturity arises from youthful beginnings in juvenile and adolescent thinking. Results of this study offer insight into the difficulty of teaching ethics and a refined ability to assess moral maturity in business activity. (shrink)

One of the most dominant approaches to semantics for relevant (and many paraconsistent) logics is the Routley-Meyer semantics involving a ternary relation on points. To some (many?), this ternary relation has seemed like a technical trick devoid of an intuitively appealing philosophical story that connects it up with conditionality in general. In this paper, we respond to this worry by providing three different philosophical accounts of the ternary relation that correspond to three conceptions of conditionality. Abstract:Spirituality is an undeniable human need and is thus the subject of increasing interest among management scholars and practitioners. In this article, we propose using archetypal psychology as a framework for understanding the human need for spirituality more clearly because it provides important insights into spirituality and organizational life. Because most spiritual needs reside in the deepest aspects of the self, an archetypal approach helps us recognize not only that we have spiritual needs but alsowhywe have them. We present three (...) common archetypes and their implications in a management context. That is followed by an application of the archetypal approach to some of the more spiritually corrosive aspects of organizational life and a discussion of the implications of archetypes as a source of motivation. Deep brain stimulation of the subthalamic nucleus is a clinically effective tool for treating medically refractory Parkinson’s disease, but its neural mechanisms remain debated. Previous work has demonstrated that STN DBS results in evoked potentials in the primary motor cortex, suggesting that modulation of cortical physiology may be involved in its therapeutic effects. Due to technical challenges presented by high-amplitude DBS artifacts, these EPs are often measured in response to low-frequency stimulation, which is generally ineffective at PD symptom management. This (...) study aims to characterize STN-to-cortex EPs seen during clinically relevant high-frequency STN DBS for PD. Intraoperatively, we applied STN DBS to 6 PD patients while recording electrocorticography from an electrode strip over the ipsilateral central sulcus. Using recently published techniques, we removed large stimulation artifacts to enable quantification of STN-to-cortex EPs. Two cortical EPs were observed – one synchronized with DBS onset and persisting during ongoing stimulation, and one immediately following DBS offset, here termed the “start” and the “end” EPs respectively. The start EP is, to our knowledge, the first long-latency cortical EP reported during ongoing high-frequency DBS. The start and end EPs differ in magnitude and latency, and the end, but not the start, EP magnitude has a significant relationship to ongoing high gamma power during the EP. These contrasts may suggest mechanistic or circuit differences in EP production during the two time periods. This represents a potential framework for relating DBS clinical efficacy to the effects of a variety of stimulation parameters on EPs. (shrink)

Processing information in the context of personal survival scenarios elicits a memory advantage, relative to other rich encoding conditions such as self-referencing. However, previous research is unable to distinguish between the influence of survival and self-reference because personal survival is a self-referent encoding context. To resolve this issue, participants in the current study processed items in the context of their own survival and a familiar other person’s survival, as well as in a semantic context. Recognition memory for the items revealed (...) that personal survival elicited a memory advantage relative to semantic encoding, whereas other-survival did not. These findings reinforce suggestions that the survival effect is closely tied with self-referential encoding, ensuring that fitness information of potential importance to self is successfully retained in memory. On 18–19 May 2018, a symposium was held in the Research Institute of Irish and Scottish Studies at the University of Aberdeen to commemorate the tenth anniversary of the death of Ronald W. Hepburn (1927–2008). The speakers at this event discussed Hepburn’s oeuvre from several perspectives. For this book, the collection of the revised versions of their talks has been supplemented by the papers of other scholars who were unable to attend the symposium itself. Thus this volume contains contributions from (...) eighteen notable scholars of different disciplines, ranging from contemporary aesthetics and art theory through to philosophical approaches to religion, education and social anthropology. It also includes a bibliography of Hepburn’s writings. The essays were first published in two special issues of the Journal of Scottish Thought, vols. 10–11 (2018–2019). -/- Ronald William Hepburn was born in Aberdeen on 16 March 1927. He went to Aberdeen Grammar School, then he graduated with an M.A. in Philosophy (1951) and obtained his doctorate from the University of Aberdeen (1955). His tutor at Aberdeen was Donald MacKinnon (1913– 1994), a Scottish philosopher and theologian, the author of A Study in Ethical Theory (1957) and The Problem of Metaphysics (1974). Hepburn taught as Lecturer at the Department of Moral Philosophy at Aberdeen (1956–60), and he was also Visiting Associate Professor of Philosophy at New York University (1959–60). He returned from the United States as Professor of Philosophy at Nottingham University. In 1964, he was appointed as a Chair in Philosophy at the University of Edinburgh and between 1965 and 1968 he was also Stanton Lecturer in the Philosophy of Religion at the University of Cambridge. From 1975 until his retirement in 1996, he held the Professorship of Moral Philosophy at Edinburgh. He died in Edinburgh on 23 December 2008. His philosophical interests ranged from theology and the philosophy of religion through moral philosophy and the philosophy of education to art theory and aesthetics. Notably, Hepburn is widely regarded as the founder of modern environmental and everyday aesthetics as a result of the influence of papers in the 1960s which pioneered a new approach to the aesthetics of the natural world. BRADY University of St. Thomas St. Paul, Minnesota CONTEMPORARY CATHOLIC social thought, both in official documents and in commentaries, has focused quite extensively on describing the use, meaning and justification of human rights. Indeed, as one significant contributor has suggested, human rights have become, since the Second Vatican Council, the "central norms of (...) social morality." 1 In all of this concern for the place of rights within Catholic thought, however, very little work has been done to explore the pre-modern roots of this moral category. This essay attempts to address this issue. The essay has three parts. The first section considers characteristics of rights language within the thought of Thomas Aquinas. The second section looks at the use of rights within the intriguing controversy of the late thirteenth century surrounding apostolic poverty. Finally, developments in Catholic rights language found in the work of the Renaissance figures Vitoria and Suarez are studied. The essay narrates the development in the use of rights within the tradition while suggesting certain threads of consistency. BRADY Generally, ius suggests an objective reality, as when it is used in the concept of ius naturale, yet Thomas often uses the word interchangeably with "lex", or "law", a word fundamentally referring to the rational expression of such an objective reality.2 Most significantly from a modern perspective, Thomas also describes this objective reality of ius within the context of personal relations. Specific persons have specific rights in accord with their position within society. This section will examine the meaning of the term ius in Thomas. It will be shown that Thomas used ius primarily in an objective sense, that is, in terms of "that which is right," or " that which is fitting." It will also be suggested that Thomas used ius in something of a subjective sense as referring to personal moral claims. This latter use was, however, dependent on a prior understanding of "that which is right." "Right,'' says Thomas, "is the object of justice." 3 Operating from the principle that if one knows the end or the object of a thing one can know the reality of that thing, Thomas introduces his treatise on justice 4 with a consideration of the reality toward which justice tends-the right. As with the other cardinal virtues, justice seeks to actualize the right or the fitting as it orders a person in relation to some object. David Brady argues that low European poverty rates are a result of the welfare state. His finding relies on a relative measure of poverty, according to which the threshold for being poor differs across countries. Using the American poverty threshold as a fixed measure, though, Western Europe has a poverty rate of 18 percent, higher than that of the United States. Moreover, Brady's thesis that welfare-state spending explains cross-country differences in inequality does not take account of the (...) problem of reverse causality. Historically, welfare states developed in homogeneous nations that started out with higher levels of social capital and lower inequality. Scandinavia, for example, had unusually low poverty rates a century ago, and even today Americans with Scandinavian ancestry exhibit a poverty rate no higher than that in Scandinavia. Since poverty, social capital, population homogeneity, and the size of the welfare state relate in multiple ways to each other, we cannot rely on cross-country correlations to isolate the causal effect of the welfare state on poverty rates. Derek Parfit's “reductionist” account of personal identity (including the rejection of anything like a soul) is coupled with the rejection of a commonsensical intuition of essential self-unity, as in his defense of the counter-intuitive claim that “identity does not matter.” His argument for this claim is based on reflection on the possibility of personal fission. To the contrary, Simon Blackburn claims that the “unity reaction” to fission has an absolute grip on practical reasoning. Now David Lewis denied Parfit's claim (...) that reductionism contravenes common sense, so I revisit the debate between Parfit and Lewis, showing why Parfit wins it. Is reductionism about persons then inherently at odds with the unity reaction? Not necessarily; David Velleman presents a reductionist theory according to which fission does not conflict with the unity reaction. Nonetheless, relying on the distinction between person level descriptions of first-person states and the first-person perspective itself, I argue that Velleman's theory does not eliminate fission-based conflict with the unity reaction. The authors use empirical research into the environmental practices of 31 manufacturing small and medium-sized enterprises (SMEs) to show that ‚business performance’ and ‚regulation’ considerations drive behaviour. They suggest that this is inevitable, given the market-based decision-making frames that permeate and dominate the industry in which manufacturing SMEs operate. Since the environment is a pillar of corporate social responsibility (CSR), the findings have important implications for CSR policy, which promotes voluntary actions predicated on a business case. It is argued that (...) this approach will not alter the behaviour of manufacturing SMEs significantly because CSR practice will be regarded as an optional and costly ‚extra’ affecting core business activity. Consequently, the use and development of existing regulatory structures, providing minimum standards for many activities covered by CSR, remains the most effective means through which the behaviour of manufacturing SMEs will be changed in the short to medium-term. Another feature of the paper is the distinction made between ‚business performance’ and the ‚business case’ argument. Business performance emphasises cost reductions and efficiency whereas the business case accentuates the benefits to shareholders of good practices as their firms become more attractive to stakeholders and society. Manufacturing SMEs␣try to improve business performance because of the pressures placed on them by market-dominated decision-making frames. These frames do not encourage manufacturing SMEs to undertake voluntary actions for the benefit of wider stakeholders and society. (shrink)

I develop an account of naturalness in physics which demonstrates that naturalness assumptions are not restricted to narrow cases in high-energy physics but are a ubiquitous part of how interlevel relations are derived in physics. After exploring how and to what extent we might justify such assumptions on methodological grounds or through appeal to speculative future physics, I consider the apparent failure of naturalness in cosmology and in the Standard Model. I argue that any such naturalness failure threatens to undermine (...) the entire structure of our understanding of intertheoretic reduction, and so risks a much larger crisis in physics than is sometimes suggested; I briefly review some currently-popular strategies that might avoid that crisis. I develop an account of how mathematized theories in physics represent physical systems, in response to the frequent claim that any such account must presuppose a non-mathematized, and usually linguistic, description of the system represented. The account I develop contains a circularity, in that representation is a mathematical relation between the models of a theory and the system as represented by some other model --- but I argue that this circularity is not vicious, in any case refers in linguistic accounts (...) of meaning and representation, and is simply a consequence of the fact that we have no unmediated, representation-independent access to the world. The important recent book by Schurz ( 2019 ) appreciates that the no-free-lunch theorems (NFL) have major implications for the problem of (meta) induction. Here I review the NFL theorems, emphasizing that they do not only concern the case where there is a uniform prior—they prove that there are “as many priors” (loosely speaking) for which any induction algorithm _A_ out-generalizes some induction algorithm _B_ as vice-versa. Importantly though, in addition to the NFL theorems, there are many _free lunch_ theorems. (...) In particular, the NFL theorems can only be used to compare the expected performance of an induction algorithm _A_, considered in isolation, with the expected performance of an induction algorithm _B_, considered in isolation. There is a rich set of free lunches which instead concern the statistical _correlations_ among the generalization errors of induction algorithms. As I describe, the meta-induction algorithms that Schurz advocates as a “solution to Hume’s problem” are simply examples of such a free lunch based on correlations among the generalization errors of induction algorithms. I end by pointing out that the prior that Schurz advocates, which is uniform over bit frequencies rather than bit patterns, is contradicted by thousands of experiments in statistical physics and by the great success of the maximum entropy procedure in inductive inference. Moral Rights and Their Grounds offers a novel theory of rights based on two distinct views. The first--the value view of rights--argues that for a person to have a right is to be valuable in a certain way, or to have a value property. This special type of value is in turn identified by the reasons that others have for treating the right holder in certain ways, and that correlate with the value in question. David Alm then argues that (...) the familiar agency view of rights should be replaced with a different version according to which persons' rights, and thus at least in part their value, are based on their actions rather than their mere agency. This view, which Alm calls exercise-based rights, retains some of the most valuable features of the agency view while also defending it against common objections concerning right loss. This book presents a unique conception of exercise-based rights that will be of keen interest to ethicists, legal philosophers, and political philosophers interested in rights theory. (shrink)

In this paper I defend epistemic circularity by arguing that the “No Self-Support” principle (NSS) is false. This principle, ultimately due to Fumerton ( 1995 ), states that one cannot acquire a justified belief in the reliability of a source of belief by trusting that very source. I argue that NSS has the skeptical consequence that the trustworthiness of all of our sources ultimately depends upon the trustworthiness of certain fundamental sources – sources that we cannot justifiably believe to be (...) reliable. This is a problem, I claim, because if the trustworthiness of all of our sources depends upon sources that we should not believe to be reliable, then a reflective individual should not trust any of his sources at all. The hidden cost of rejecting epistemic circularity is thus the unacceptable skeptical thesis that reflective individuals like you and I have no justified beliefs whatsoever. (shrink)

I distinguish between two conceptually different kinds of physical space: a space of ordinary material bodies, which is the space of points at which I could imaginably place the tip of my finger, or the center of a billiard-ball, and a space of elementary physical determinables, which is the smallest space of points such that stipulating what is happening at each one of those points, at every time, amounts to an exhaustive physical history of the universe. In all classical physical (...) theories, these two spaces happen to coincide – and what we mean by calling a theory “classical”, and all we mean by calling a theory “classical”, is precisely that these two spaces coincide. But once the distinction between these two spaces in on the table, it becomes clear that there is no logical or conceptual reason why they must coincide – and it turns out that a very simple way of pulling them apart from one another gives us quantum mechanics. Inferential Internalists accept the Principle of Inferential Justification (PIJ), according to which one has justification for believing P on the basis of E only if one has justification for believing that E makes probable P. Richard Fumerton has defended PIJ by appeal to examples, and recently Adam Leite has argued that this principle is supported by considerations regarding the nature of responsible belief. In this paper, I defend a form of externalism against both arguments. This form of externalism recognizes what (...) I call the phenomenon of reflective defeat: if one is justified in not believing that E makes probable P, then this defeats whatever justification one has for believing P upon the basis of E. I argue that this modified version of externalism has the virtue of accommodating the intuitions that motivate internalism, without the cost of the vicious regress that makes internalism so unattractive. When patients are admitted to the hospital, they are generally expected to remain in or within close proximity to their assigned rooms in order to promote their safety and appropriate medical care. Although there are circumstances when patients may safely leave their hospital room or floor, guidance within the medical literature for the management of patient movement within the hospital are lacking. Excessive restrictions on patient movement may be seen as overly paternalistic, while lax requirements may interfere with high quality (...) care, patient safety and efficient hospital practice. As a result, guidance in the form of institutional policy is warranted. Such policy development should take into consideration the potential clinical, legal, and ethical concerns in balancing the competing values of patients’ preferences and respect for autonomy, while ensuring high quality, safe, and efficacious medical care. This paper will provide a framework for hospitals to create institution-specific patient movement policies that are fair, systematic, and transparent. (shrink)

While the public forum's legal contours have been examined, the ethical foundation of the public forum has not. Relying on archival research, this article argues that ideas about the public forum can be traced to the pragmatism of Grenville Clark, who influenced ideas about the public forum through his work on the American Bar Association's Bill of Rights Committee.

Its publication in 2021 coincided with the fiftieth anniversary of the first publication of David Ireland’s The Unknown Industrial Prisoner (...) (1971). This experimental novel, centered on a “kaleidoscopic vision” of its characters and their lives, tells the story of a group of workers at the Puroil refinery in a fictionalized part of Sydney. In Heino’s own words, this project emerged from a desire to write about industrialization and representation in Australian fiction. Working primarily as a legal scholar and historian, this work represents his first foray into literary geography.At the heart of Heino’s argument is a question: What does literature know about space? In his pursuit of a spatially-directed reading of The Unknown Industrial Prisoner, Heino eschews work in literary geography that cultural geographers might recognize— particularly the writings of Sheila Hones, the doyenne of an emerging interdiscipline of literary geography, whose practitioners work at the interstices between literary studies and geography. Heino criticizes this interdisciplinary literary geography as being too focused on establishing the “sovereignty” or “imperialism” of fictional space at the expense of recognizing the [End Page 132] role of literature in the world. Arguably, such a stance is a misreading of the thinking within literary geography that “reading literature is essentially an experimental process in which the categorical distinction between the frames of ‘fact’ and ‘fiction’ become blurred,”1 and where the “ontological distinction between literary and non- literary spaces” is undermined.2 Neither of these statements supposes that reading literature is a practice by which the world falls away and nothing remains but the book. Instead, following Doreen Massey’s idea that space is a complicated process of events and happenings, literary geographers in this mold argue that fiction is a part of life as it happens, and reading is a constitutive practice in the co- production of space.In its place, Heino emphasizes a form of literary geographical thinking that understands literature’s role as being separate from, but intimately connected to, the actual world. His theoretical framework is multi-layered, borrowing from Marxist literary scholars, including Terry Eagleton and Fredric Jameson, and Marxist geographers, including Henri Lefebvre. In essence, however, it can be expressed neatly in the following quotation from geocritic Bertrand Westphal:Fiction does not reproduce the real, but actualises new virtualities that had remained unformulated, and then goes on to interact with the real according to the hypertextual logic of interfaces... fiction detects possibilities buried in the folds of the real, knowing that these folds have not been temporised.3I think that Heino’s rejection of what he characterizes as poststructural literary geography, of the kind represented in his analysis of Sheila Hones’s work, misses some opportunities. First, there are similarities between his conception of literary geography and those he leaves aside— not least, their shared acceptance of the productive tension that sits between literature as text and world as practical, non- representational, and exceeding narrative. Secondly, the shared aim of both approaches is to understand how “representation ‘takes place’ and precisely how texts are part of what happens.”4 This is particularly powerful in the light of Heino’s aim to understand the development and contents of literary texts in materialist terms. The chapter focusses on the Scottish natural philosophy of the late eighteenth century represented by John Anderson (1726–1796) and John Robison (1739–1805), which is considered a link between Newton’s natural philosophy and nineteenth-century physics in Britain (Kelvin and Maxwell). Anderson and Robison have to be seen in a tradition of Scottish Newtonians established in the seventeenth century by David Gregory and John Keill and specifically shaped in the Mid-eighteenth century through the chemical-physical work of Joseph Black and the common-sense (...) philosophy of Thomas Reid. These latter Newtonians built on Newton’s theory of matter and short-range forces as indicated in Query 31 of his Opticks (Black) but also on his Rules of Reasoning of the second edition of his Principia (Black and Reid) and in this way created the theoretical framework in which Anderson and Robison developed their natural philosophy. In the center of their natural philosophy, which was oriented on experimental investigations, were the manifold open questions of the Baconian sciences of that time - theories of heat, light, electricity, magnetism as well as the understanding of the phlogiston. The chapter thus provides insight into the specific way in which the Newtonian camp participated in early modern natural philosophical speculations about minute particles of matter, fluids, or the propagation of light and heat. In this paper, I consider the question of whether crime victims can be said to have a moral right to see their victimizers punished that could explain why they often feel wronged or cheated when the state fails to punish offenders. In the first part, I explain what I mean by a “right to punishment” and what it is for such a right to “explain” the frustrated crime victim’s reaction. In the second part, I distinguish such a right from a (...) Lockean-style right to punish, which is also shown incapable of providing the needed explanation. In the third part I argue that it is difficult to identify any benefit such that the right to punishment could plausibly be understood as a right to that benefit. I discuss two main candidates here: the vaguely Hegelian idea that punishment is itself some sort of restitution for the wrong done to the victim; and the idea, due to Victor Tadros, that punishment is a form of compensation for wrongdoing by contributing indirectly to protecting victims from future harm. In the final section, I suggest instead that the frustrated crime victim’s reaction, when justified, is best explained, not by the violation of any right to punishment, but rather by the state’s failure to treat the victim as an equal. According to the self-defense view, the moral justification of punishment is derived from the moral justification of an earlier threat of punishment for an offense. According to the forfeiture view, criminals can justly be punished because they have forfeited certain rights in virtue of their crimes. The paper defends three theses about these two views. (1) The self-defense view is false because the right to threaten retaliation is not independent of the right to carry out that threat. (2) A more (...) plausible account of the right to threaten says instead that the right to retaliate is primary to the right to threaten, and that the former right in turn arises because aggressors forfeit the right not to suffer retaliation. (3) The ?fair warning thesis,? according to which just punishment must be preceded by a threat, is less plausible than first appearances suggest and is therefore no serious obstacle to the view of threats described above. In this paper I criticize the standard argument for deontological egalitarianism, understood as the thesis that there is a moral claim to have an equal share of well-being or whatever other good counts. That argument is based on the idea that equals should be treated equally. I connect the debate over egalitarianism with that over comparative justice. A common theme is a general skepticism against comparative claims. I argue (i) that there can be no claim to equality based simply on (...) the fact of equal worth as that fact itself does not have any value for the supposed claim holder; and (ii) intuitions that suggest otherwise can be explained away without appealing to comparative claims. Terry Eagleton is the foremost Marxist cultural theorist of our time. In the first book-length study of this highly influential figure, David Alderson provides detailed discussions of Eagleton's Marxism and his engagements with postmodernism, as well as an evaluation of his interventions in Irish Studies. Each of the chapters in this important intervention in current theoretical debates offers accessible contextualization of the key issues and provides detailed analyses of Eagleton's literary criticism. Alderson shows that the complex relations between nature, (...) culture and ideology, body, subjectivity and authority are at the heart of Eagleton's ethical and political concerns.
