Adults and children spontaneously produce gestures while they speak, and such gestures appear to support and expand on the information communicated by the verbal channel. Little research, however, has been carried out to examine the role played by gesture in the listener's representation of accumulating information. Do listeners attend to the gestures that accompany narrative speech? In what kinds of relationships between gesture and speech do listeners attend to the gestural channel? If listeners do attend to information received in gesture, (...) how is this information represented— is it 'tagged' as originating in the gestural channel? In this article research is described that addresses these questions. Results show that listeners do attend to information conveyed in gesture, when that information supplements or even contradicts the information conveyed by speech. And information received via gesture is available for retelling in speech. These results are taken to demonstrate that gesture is not taken by the listener to be epiphenomenal to the act of speaking, or a simple manual translation of speech. But they also suggest that the information conveyed in a discourse may be represented in a manner that is neither gesture nor language, although accessible to both channels. (shrink)

If group norms and decisions foster peace, then understanding how norms and decisions arise becomes important. Here, we suggest that neither norms nor other forms of group-based decision making (such as offering restitution) can be adequately understood without simultaneously considering (i) what individual psychologies are doing and (ii) the dynamics these psychologies produce when interacting with each other.

Psychologists' emerging interest in spirituality and religion as well as the relevance of each phenomenon to issues of psychological importance requires an understanding of the fundamental characteristics of each construct. On the basis of both historical considerations and a limited but growing empirical literature, we caution against viewing spirituality and religiousness as incompatible and suggest that the common tendency to polarize the terms simply as individual vs. institutional or ′good′ vs. ′bad′ is not fruitful for future research. Also cautioning against (...) the use of restrictive, narrow definitions or overly broad definitions that can rob either construct of its distinctive characteristics, we propose a set of criteria that recognizes the constructs' conceptual similarities and dissimilarities. Rather than trying to force new and likely unsuccessful definitions, we offer these criteria as benchmarks for judging the value of existing definitions. (shrink)

McCullough (bio)Those of us who work in the field of bioethics tend to think that, because the word “bioethics” is new, so too the field is new in all respects, but we are not the first to do bioethics. John Gregory (1724–1773) did bioethics just as we do it, at least two centuries (...) before we thought to do it (Gregory 1772). He deployed philosophical methods as sophisticated as our own. Indeed, Gregory took up the very best moral philosophy available to thinkers of the Scottish Enlightenment, namely, David Hume’s moral philosophy and its core concept of sympathy. Gregory also responded in a conceptually powerful and clinically applicable way to the problems of his time, just as we do. I want here to outline Gregory’s accomplishment and to identify some aspects of its importance for bioethics in the twenty-first century.Gregory’s “Problem List”Gregory wrote his medical ethics as a response to the then current state of medicine in Britain. We now follow Gregory in our writing of bioethics and clinical ethics in response to the problems of our time. A great deal that we now take for granted did not then exist. 1There was not, as there is now, any uniform pathway into medicine. Nor did there exist universal licensure. The Royal Colleges did attempt to assert, but failed to achieve, monopoly control of medical practice. The concepts of health and disease were themselves contested and therefore competed for their success in the market place. There was a marked oversupply of practitioners who competed fiercely—very fiercely indeed—in the medical market place for their concepts of health and disease, their treatments, and therefore their livelihoods. Patients had their own concepts of health and disease, engaged in “self-physicking” or self-care, and often traded physician’s prescriptions.Medicine exhibited little scientific discipline in its accounts of disease and in determining the efficacy of treatments, a fact that Gregory (1743) laments as a [End Page 329] medical student. There was no marked improvement when he began to give his medical ethics lectures nearly a quarter of a century later. Treatments failed as often, perhaps more often, than they succeeded in benefiting patients. The sick usually sought out the help of a physician after trying self-physicking.Physicians, Gregory taught, could not hope to control human biology, though they could aim to manage its processes well. When nature underresponds to disease the physician should assist her processes; when nature overresponds, the physician should tamp down nature’s responses, to lessen their “violence”—in both cases always attentive to the limits of medicine’s capacities in treating disease.Physicians attended the well-to-do sick at home, and the sick person summoned and dismissed physicians, surgeons, or apothecaries at will. A physician therefore might find himself—no women had yet been admitted to the ranks of university-trained physicians—summoned before, after, or simultaneously with a competitor, with his concepts and diagnosis and treatment put to the acid test. In this setting, there existed only a patient-physician relationship, not a physician-patient relationship.Physicians left off the care of dying patients, a practice that was made a matter of duty by Friederich Hoffmann (1749). One would suffer punishing economic consequences if one had a high mortality rate. Better, then, to label the patient incurable, withdraw, and turn matters over to clergy. Five previously unpublished manuscripts of Gregory's lectures are also included. An introduction places Gregory's medical ethics and philosophy of medicine in their eighteenth-century contexts of Scottish Enlightenment history and culture, Baconian science and (...) philosophy of medicine, medical practice, the feminine and feminist philosophy of the Bluestocking Circle, and moral sense philosophy, particularly David Hume's concept of sympathy, and provides a bibliography of primary and secondary sources as an aid to teaching and future scholarship. McCullough and Warren Thomas ReichThe past three decades have witnessed the emergence and remarkable success of the fields of bioethics and medical humanities. The intellectual landscape of medicine and that of the humanities have been remarkably altered in the process. Twenty-five to 30 years ago in the United States there existed but a few courses in what (...) came to be called “bioethics” in departments of philosophy, religious studies, and theology in colleges and universities, a handful of programs of teaching in medical schools such as the University of Texas Medical Branch at Galveston and Pennsylvania State University School of Medicine at Hershey, and but one independent research center (the Hastings Center) and one university-based research center (the Kennedy Institute of Ethics at Georgetown University). Articles on bioethics began to appear in the peer-reviewed medical, nursing, and humanities literature and some books were published. There was only one journal in bioethics, The Hastings Center Report (which consolidated two previously separate journals from the Hastings Center). Graduate programs in bioethics and medical humanities in colleges and universities and fellowship training in bioethics and medical humanities in medical schools did not exist. Very little existed in colleges, universities, and medical schools in other countries. Now, of course, everything is different.Teachers, scholars, and students of bioethics and medical humanities should not take these remarkable changes for granted, for they represent a sustained and innovative interaction between medicine and the humanities. We have chosen the metaphor of “laying medicine open” to characterize the history of bioethics and medical humanities of the past three decades. This surgical metaphor was used in eighteenth-century Britain by a number of writers who wanted to make medical science and practice more accessible to the sick and to the lay public more generally (Lawrence 1975). The purpose of this paper is to explore a possible resolution to one of the main objections to machine thought as propounded by Alan Turing in the imitation game that bears his name. That machines will, at some point, be able to think is the central idea of this text, a claim supported by a schema posited by Andy Clark and David Chalmers in their paper, “The Extended Mind” (1998). Their notion of active externalism is used to support, strengthen (...) and further what John Searle calls “the systems reply” to his objection to machine thought or strong Artificial Intelligence in his Chinese Room thought experiment. Relevant objections and replies to these objections are considered, then some conclusions about machine thought and the Turing test are examined. (shrink)

McCullough et al. suggest that revenge and forgiveness rest upon risk computation. Risk computation is implemented by emotions that evolved for additional functions, giving rise to phenomena such as betrayal aversion and taboo-tradeoffs, and specific patterns of forgiveness we have documented. A complete account of revenge and reconciliation should incorporate broader constructs from social psychology, including emotions and values hierarchies.

"The terrain of the self is vast," notes renowned psychiatrist Arnold Ludwig, "parts known, parts impenetrable, and parts unexplored." How do we construct a sense of ourselves? How can a self reflect upon itself or deceive itself? Is all personal identity plagiarized? Is a "true" or "authentic" self even possible? Is it possible to really "know" someone else or ourselves for that matter? Both the Kevelson Seminar topic, ‘Lawyers as Makers of Meaning,’ and the appearance of a highly-publicized television series in the United States dedicated to the life of President John Adams (1735–1826) invite inquiry into Adams’ role as a lawyer who shaped the meaning of the American Revolution (and his role in bringing it about). Three trials from Adams’ early legal career illustrate that he presented both himself and fellow resistance leader James Otis, Jr., as heroic loners struggling for the rights (...) of Americans against British injustice. Although he did not call it that, in 1970 lawyer and future Massachusetts Superior Court Justice Hiller Zobel, in his book The Boston Massacre, undertook what we would consider a semiotic approach that investigated the relevant codes and contexts—both the legal complexities and the audiences, other lawyers, judges, and posterity about which Adams spoke, simplifying and minimizing their roles as he maximized his own (and Otis’s). Zobel’s own relationship with Adams’ legal career appeared in his own tenure on the bench, especially in the famous ‘Nanny’ (discussed by Denis Brion, in this issue) case in which he explicitly presented the Boston Massacre Trials as a relevant precedent. Despite Adams’ willingness to subordinate his clients’ welfare to the patriot cause early in his career, it can be argued that HBO television and historian David McCullough, by presenting him to the public only flawed by his outspoken, stubborn honesty, have nevertheless performed a public service. Their version of Adams offers Americans in the twenty-first century an alternative role model to the dishonest, ill-informed politicians who use public opinion polls rather than political theory, moral philosophy, and historical knowledge as the basis of their decisions. Perfectionism is an underexplored tradition, perhaps because of doubts about the grounds, content, and implications of perfectionist ideals. Aristotle, J.S. Mill, and T.H. Green are normative perfectionists, grounding perfectionist ideals in a normative conception of human nature involving personality or agency. This essay explores the prospects of normative perfectionism by examining Kant’s criticisms of the perfectionist tradition. First, Kant claims that the perfectionist can generate only hypothetical, not categorical, imperatives. But insofar as the normative perfectionist appeals to the normative category (...) of personality or agency, rather than a biological category of humanity, it can represent perfectionist demands as categorical imperatives. Second, Kant accepts a moral asymmetry in which we aim at our own perfection but at the happiness, rather than the perfection, of others. However, the importance of autonomy in normative perfection explains why the perfectionist should recognize a self/other asymmetry. Indeed, when we see how the normative perfectionist can answer Kant’s criticisms while respecting Kant’s own claims about the connection between rational nature and moral requirements, we can see the basis for a normative perfectionist interpretation of Kant’s own ethical theory. Insofar as Kantians and normative perfectionists both base ethical demands on an appeal to rational nature, they face a common worry that the appeal to rational nature is empty or incomplete. Normative perfectionists have more and less concessive responses to this worry, providing perfectionist explanations of various apparently non-perfectionist goods. Even if we end up being pluralists about the good, perfectionist elements play an important role. Finally, because the normative perfectionist, like the Kantian, grounds its ideals and requirements in a conception of persons as rational agents, it provides a promising account of the rational authority of perfectionist demands. This comparison of normative perfectionist and Kantian essentials gives us reason to take the normative perfectionist tradition seriously. (shrink)

In an important departure from theories of causation, David Owens proposes that coincidences have no causes, and that a cause is something which ensures that its effects are no coincidence. In Causes and Coincidences, he elucidates the idea of a coincidence as an event which can be analysed into constituent events, the nomological antecedents of which are independent of each other. He also suggests that causal facts can be analysed in terms of non-causal facts, including relations of necessity. Thus, (...) causation is defined in terms of coincidence, and coincidence without reference to causation. David Owens challenges the ideas associated with Hume, Davidson and Lewis, constructing a theory which distinguishes nomological necessity and sufficiency from their logical counterparts. He is able to offer novel solutions to the major problems of causation, including the direction of causation, the logical form of causal statements, the distinction betwen causal connections and logical connections, and the relationship between psychological and physical causation. With respect to many, if not most issues, there exist significant differences of opinion among individuals who seem to be equally knowledgeable and sincere. Individuals who apparently have access to the same information and are equally interested in the truth affirm incompatible perspectives on, for instance, significant social, political, and economic issues. Such diversity of opinion, though, is nowhere more evident than in the area of religious thought. On almost every religious issue, honest, knowledgeable people hold significantly diverse, often incompatible (...) beliefs. -/- Religious diversity of this sort can fruitfully be explored in many ways — for instance, from psychological, anthropological, or historical perspectives. The current discussion, however, will concern itself primarily with those key issues surrounding religious diversity with which philosophers, especially analytic philosophers of religion, are most concerned at present. Specifically, our discussion will focus primarily on the following questions: How pervasive is religious diversity? Does the reality of this diversity require a response? Can a person who acknowledges religious diversity remain justified in claiming just one perspective to be correct? If so, is it morally justifiable to attempt to convert others to a different perspective? Can it justifiably be claimed that only one religion offers a path into the eternal presence of God? The answers to such questions are not simply academic. They increasingly have great impact on how we treat others, both personally and corporately. (shrink)

Building on prior research in Confucianism and business, the current study examines the effects of Confucianism on consumer trust of government involvement with products and company brands. Based on three major ideas of Confucianism – meritocracy, loyalty to superior, and separation of responsibilities – it is expected that consumers under the influence of Confucianism would perceive products from government-involved enterprises to have more desirable attributes and show preference for their company brands. Findings from an empirical study in the Chinese automobile (...) market support the hypotheses. The results suggest that small firms doing business in China would especially benefit from some association with the government. These results also provide managerial implications for enterprises in other countries with a Confucian cultural background. (shrink)

Taken in general terms, “hermeneutics” refers to the study of understanding and interpretation, and, traditionally, this study focuses on considerations of the art, method, and foundations of research in the arts and humanities. The study of hermeneutics has been developed and applied in a number of areas of scholarly inquiry, such as biblical exegesis, literary studies, legal studies, and the medical humanities. In the context of post-war Continental European thought, however, hermeneutics is brought into a novel philosophical context and, with (...) this, comes to designate a philosophical movement – or, at least, a number of related philosophers and themes – concerned with the scope and limits of phenomenology, the character of human existence, the relation of the natural sciences and humanities, as well as a range of interrelated matters in the philosophy of history, the philosophy of language, the philosophy of art and aesthetics, practical philosophy, as well as in epistemology and the theory of meaning. I take issue with several themes in Ted Toadvine’s lively paper, “Limits of the Flesh,” suggesting that he has significantly misread many of the arguments in The Spell of the Sensuous. I first engage his contention that I disparage reflection and denigrate the written word. Then I take up the assertion that I exclude the symbolic dimension of experience from my account, and indeed that I seek to eliminate the symbolic from our interactions with others. Finally, I refute his claim (...) that my ecophenomenological stance leaves no room for resistance, contradiction, and alterity—elements that are, in fact, central to my understanding of ethics. My reply leads directly into a discussion of one of the crucial concerns of my work: the manner in which the very style of our discourse—our way of wielding words—tacitly works to either enhance, or to stifle, the solidarity between the human community and the more-than-human earth. This article discusses academic work in relation to appellate courts. It concentrates on characterizing and explaining judicial decision-making and winning on an appeal. Furthermore, it raises questions about the nature and coverage of empirical legal research on appellate courts, and discusses general methodological questions. It also looks at rival approaches to describing what judges do in making decisions, and what motivational assumptions are most commonly made and finally indicates the broad outlines of how the field should develop methodologically in the (...) future. Empirical legal research suffers from the main weakness of the entire body of empirical research applied to appellate courts. This article concludes by mentioning that a shift of focus is needed to other aspects of law. To be forced into a choice, a judge must feel that what he regards as morally correct would be inconsistent with existing law. (shrink)

In this paper I offer a partial defense of a constitutivist view according to which it is possible to defend fundamental requirements of practical reason by appeal to facts about what is constitutive of rational agency. I show how it is possible for that approach to circumvent the ‘is’/’ought’ problem as well as the requirement that it be possible to act contrary to practical reason. But I do not attempt to establish any particular fundamental requirement. The key ideas are that (...) such a requirement is not genuine if it is arbitrary, and that it is arbitrary just in case (a) it needs explanation and (b) that explanation could not, even in principle, be provided. I am lucky to have two such penetrating commentators as Robert Kirk and Andrew Melnyk. It is also fortunate that they come at me from different directions, and so cover different aspects of my book. Robert Kirk has doubts about the overall structure of my enterprise, and in particular about my central commitment to a distinctive species of phenomenal concepts. Andrew Melnyk, by contrast, offers no objections to my general brand of materialism. Instead he focuses specifically on my discussion of (...) the anti-materialist 'intuition of distinctness', raising questions about my attempt to explain this intuition away, and offering alternative suggestions of his own. An introduction to propositional logical and first-order logic.

A central tenet of hermeneutics is the claim that dialogue is necessary for the full understanding of ourselves. It follows, then, that dialogue must be fruitful for understanding in a way in which no solitary activity can be. This dissertation provides a much needed defense of this claim by articulating and defending the essential parts of an account of intersubjectivity from which the claim follows. The dissertation is divided into three sections, each focusing on a specific part of the account (...) of intersubjectivity-- intersubjectivity and language, intersubjectivity and time-consciousness, and intersubjectivity and the body--through a careful consideration of the views of pairs of philosophers. I focus on J. G. Fichte and Wilhelm von Humboldt on the issue of intersubjectivity and language, on Edmund Husserl and Martin Buber on the issue of intersubjectivity and time-consciousness, and on Jean-Paul Sartre and Maurice Merleau-Ponty on the issue of intersubjectivity and embodied subjectivity. Through exposing the necessity of our intersubjective relations for the very possibility of language use, awareness of time, and embodied awareness of the world, I demonstrate the existence of a pre-reflective, intersubjective relation between embodied subjects. This intercoporeal intersubjectivity requires extending traditional hermeneutics through an account of the body and a broader account of both understanding and dialogue. (shrink)
