The dynamics of the "Etang de Berre", a brackish lagoon situated close to the French Mediterranean sea coast, is strongly disturbed by freshwater inputs coming from an hydroelectric power station. The system dynamics has been described as a sequence of daily typical states from a set of physicochemical variables such as temperature, salinity and dissolved oxygen rates collected over three years by an automatic sampling station. Each daily pattern summarizes the evolution, hour by hour of the physicochemical variables. This article (...) presents results of forecasts of the states of the system subjected to the simultaneous effects of meteorological conditions and freshwater releases. We recall the main step of the classification tree method used to build up the predictive model (Classification and Regression Trees, Breiman et al., 1984) and we propose a transfer procedure in order to test the stability of the model. Results obtained on the Etang de Berre data set allow us to describe and predict the effects of the environmental variables on the system dynamics with a margin of error. The transfer procedure applied after the tree building process gives a maximum gain in prediction accuracy of about 15%. (shrink)

In this article I take up a central question posed by the article jointly authored with Bill Winslade in this issue of JCE: What should be the role of clinical ethics consultants (CECs) in (what we call) an unsettled case: that is, a situation in which the range of allowable choices, among which the parties to a bioethical disagreement must select, cannot be clearly or completely specified? I argue here that CECs should, in such cases, guide the parties by presenting (...) their own reasoned conclusions about what the scope of allowable choices should be taken to include. Since this position challenges the received view that CECs must not express their own moral positions or conclusions in their role as ethicists, I try to defend my view of the CEC’s role in unsettled cases against several objections. Given a traditional intuitionist moral epistemology, it is notoriously difficult for moral realists to explain the reliability of our moral beliefs. This has led some to go looking for an alternative to intuitionism. Perception is an obvious contender. I previously argued that this is a dead end, that all moral perception is dependent on a priori moral knowledge. This suggests that perceptualism merely moves the bump in the rug where the reliability challenge is concerned. Preston Werner responds that my account (...) rests on an overly intellectualized model of perception. In this paper, I argue that though Werner may well be correct, my arguments, properly extended, still suggest that perceptualism leaves realists in no better position than intuitionism when it comes to the reliability challenge. Waldo (philosophy, Susquehanna U.) proposes that spiritual inquiry is not a matter of formulating and defending a theory of knowledge, but of cultivating a certain kind of character and style of thinking.

Inferential Internalists accept the Principle of Inferential Justification (PIJ), according to which one has justification for believing P on the basis of E only if one has justification for believing that E makes probable P. Richard Fumerton has defended PIJ by appeal to examples, and recently Adam Leite has argued that this principle is supported by considerations regarding the nature of responsible belief. In this paper, I defend a form of externalism against both arguments. This form of externalism recognizes what (...) I call the phenomenon of reflective defeat: if one is justified in not believing that E makes probable P, then this defeats whatever justification one has for believing P upon the basis of E. I argue that this modified version of externalism has the virtue of accommodating the intuitions that motivate internalism, without the cost of the vicious regress that makes internalism so unattractive. Throughout much of the world, universities have driven towards industrial partnerships. This collaboration, which, in the biochemical field at least, has to continue if potential benefits for patients are to be realised, has brought with it a number of problems. These include the neglect of long-term research in favour of short-term projects, the curtailing of free dissemination of research information within university departments and the biasing of results of clinical trials by the financial interests of the investigators. It is very (...) important that governments, universities, and industry itself address these problems. Universities should monitor the amount of basic, curiosity-driven research that is being carried on, compared with that which is more short-term goal orientated. PhD students and post-doctoral fellows should be exposed to the principles of bioethics early on in their careers. Further work is necessary on the terms of research contracts to protect, on the one hand, the rights of individual scientists and, on the other, industry from rogue scientists. Where problems arise, procedures should be in place for independent reviews to be conducted by bodies such as the Medical Research Council in the UK or the National Institutes of Health in the USA. The conflict-of-interest rules recently introduced for publication in medical journals should be extended to all branches of science. (shrink)

Jan Albert van Laar and Erik Krabbe’s paper “Splitting a difference of opinion” studies an important type of dialogue shift, namely that from a deliberation dialogue over action or policy options where critical and persuasive argumentation is exchanged about the rational acceptability of the policy options proposed by various parties, to a negotiation dialogue where agreement is reached by a series of compromises, or trade-offs, on the part of each side in the disagreement.

Human rights discourse has been likened to a global lingua franca, and in more ways than one, the analogy seems apt. Human rights discourse is a language that is used by all yet belongs uniquely to no particular place. It crosses not only the borders between nation-states, but also the divide between national law and international law: it appears in national constitutions and international treaties alike. But is it possible to conceive of human rights as a global language or lingua (...) franca not just in a figurative or metaphorical sense, but in a literal or linguistic sense as a legal dialect defined by distinctive patterns of word choice and usage? Does there exist a global language of human rights that transcends not only national borders, but also the divide between domestic and international law? Empirical analysis suggests that the answer is yes, but this global language comes in at least two variants or dialects. New techniques for performing automated content analysis enable us to analyze the bulk of all national constitutions over the last two centuries, together with the world’s leading regional and international human rights instruments, for patterns of linguistic similarity and to evaluate how much language, if any, they share in common. Specifically, we employ a technique known as topic modeling that disassembles texts into recurring verbal patterns. The results highlight the existence of two species or dialects of rights talk—the universalist dialect and the positive-rights dialect—both of which are global in reach and rising in popularity. The universalist dialect is generic in content and draws heavily on the type of language found in international and regional human rights instruments. It appears in particularly large doses in the constitutions of transitional states, developing states, and states that have been heavily exposed to the influence of the international community. The positive-rights dialect, by contrast, is characterized by its substantive emphasis on positive rights of a social or economic variety, and by its prevalence in lengthier constitutions and constitutions from outside the common law world, especially those of the Spanish-speaking world. Both dialects of rights talk are truly transnational, in the sense that they appear simultaneously in national, regional, and international legal instruments and transcend the distinction between domestic and international law. Their existence attests to the blurring of the boundary between constitutional law and international law. (shrink)

David Alexander has argued that “weak inferential internalism” (WII), a position which amounts to a qualified endorsement of Richard Fumerton’s controversial “principle of inferential justification,” is subject to a fatal dilemma: Either it collapses into externalism or it must make an arbitrary epistemic distinction between persons who believe the same proposition for the same reasons. In this paper, I argue that the dilemma is a false one, for weak inferential internalism does not entail internalism simpliciter. Indeed, WII is compatible (...) with modest externalism, and so is consistent with what Armstrong calls “Type II justification,” the rejection of which leads to the arbitrary epistemic distinctions to which he rightly objects. This is a comment on Tihamér Margitay’s “From Epistemology to Ontology,” where he criticizes Polanyi’s claim that there is a systematic correspondence between the levels of ontology and the levels of tacit knowing. Margitay contends that Polanyi supports this correspondence by appealing to a “purely ontological argument,” one which concludes that it is impossible to reduce machines to a singular, chemical-physical type, and criticizes this claim by pointing to industrial standards (machines that do reduce to singular physical-chemical type). I respond (...) to Margitay’s claim by distinguishing two different “purely ontological arguments” in Polanyi’s thought (one relying on the multi-realizability of a machine in different physical-chemical types, the other pointing to the inability of a purely physical-chemical ontology to account for the artificial shaping and functioning of machines). With these two arguments clarified, Margitay’s criticism by appealing to industrial standards loses much of its initial force. (shrink)

In God and Mystery in Words David Brown uses the way in which poetry and drama have in the past opened people to the possibility of religious experience as a launch pad for advocating less wooden approaches to Christian worship today. So far from encouraging imagination and exploration, hymns and sermons now more commonly merely consolidate belief. Again, contemporary liturgy in both its music and its ceremonial fails to take seriously either current dramatic theory or the sociology of ritual. (...) Yet this was not always so. Imagery and hymns mattered, liturgial msic encouraged a sense of drama, sermons required rhetoric. In a characteristically stimulatling and inspiringly expansive study, that ranges from ancient Greek drama to modern poetry, from the meaning of the Logos to the history of vestments, David Brown pleads for a much wider focus on the kind of factors that aid experience of God.
