But this, strangely enough, is why a little more needs to be written. For the book has been worked over so often that an obvious sign of fatigue has set in: critics are beginning to find such elementary flaws in the Republic that one wonders why he should (...) waste time on such a philosophically embarrassing work at all. It is to counter one of these recent criticisms and thus, hopefully, to help offset the fatigue, that this study is written. It purports not only to show the criticism mistaken, but also to sketch a way of looking at the Republic which should send the reader back for a further look at this incredibly rich work. The richness of the Republic is, indeed, a source of embarrassment for anyone writing on it. For because of its structure it is at least misleading to isolate one topic from the myriad others treated there, and because of its complexity, impossible to document interpretations of more than a few topics. I shall follow the time-honored practices here of merely expressing my bias on some topics (such as my non-political interpretation) and leaving it up to the reader to follow up hints of my interpretations of other topics (such as that of the Sun, Line, and Cave). II. Plato's Alleged Fallacy in the Republic David Sachs and A. W. H. Adkins have recently claimed that Plato commits the fallacy of equivocation in the Republic, not in the course of some minor argument, but in answering what is probably the central problem posed by the work: Why be just?1 Simply put, their objection goes like this: In the first book of the Republic, Socrates attempts to prove to Thrasymachus why justice is preferable to injustice. But even Socrates is dissatisfied with this answer and early in the second book, after a brilliantly fashioned defense of the Thrasymachean position by Glaucon and Adeimantus, the brothers ask for a more convincing demonstration from "You, [who have] passed your entire life in the consideration of this very matter." e Socrates seems to accept the challenge and proceeds to a search for the concept of justice writ large in the state. This essay explores different conceptions of freedom in Kant, Green, and their critics. Kant introduces three kinds of freedom—negative freedom, positive freedom or autonomy, and transcendental freedom. Sidgwick objects that Kant's conception of positive freedom is unable to explain how someone might be free and responsible for the wrong choices. Though Green rejects transcendental freedom, he thinks Kant's conception of practical freedom can be defended by identifying it with the capacity to be determined by practical reason. Green identifies his own (...) tripartite conception of freedom—juridical freedom, moral freedom, and real freedom. He thinks that these are stages in the perfection of freedom. Green's tripartite conception provides a principled reply to Berlin's doubts about positive freedom, explains Kant's claims that respect and esteem are fitting attitudes toward different aspects of freedom, and supports Schiller's criticisms of Kantian freedom and virtue. Green's conception of freedom defends the best elements of the Kantian perspective while addressing legitimate worries. Etymologies are often entertaining, but it is not always obvious what they mean. Take the case of Old Frankish *sal, meaning a single-roomed dwelling. The word was taken over by speakers of Vulgar Latin as sala, and by 1100 CE it had become a word of Anglo-Norman French, since in The Song of Roland it crops up as sale, meaning the living area of a castle. Some time later, it wandered into Italian. Renaissance architects wanted to make a new word (...) for the increasingly grandiose spaces they were designing, so they added an augmentative suffix, producing salone. In the seventeenth century, French translations of Italian works on architecture reproduced the new term, only dropping the final e so as to keep the masculine gender of the Italian. French salon came into English in the early eighteenth century, initially as a word for a large and lofty room; but as French speakers applied it more and more to social functions occurring in such spaces, English speakers did so too. Then came a fork: a phonological adaptation produced saloon, which drifted off as a fully naturalized word of English toward hotels, carriages, bars, and cars; but salon persisted nonetheless. By retaining the stress pattern and marginally nasal final vowel of its source language, the doublet has remained in use as a xenism—a word of English understood to be not English, but understood in English all the same.How many such words are there? Hundreds, maybe thousands. Coupé, du jour, fuselage, pizza, paparazzi, sauerkraut, Zeitgeist—all signal their foreignness either by nonstandard pronunciation of written consonants (s, g, j, z), the presence of foreign diacritics, or irregular tonic stress. These are the kinds of loanwords that Scholar calls “émigrés,” but he gives us not thousands or hundreds or even a dozen of them: his chapters deal only with four: à la mode, ennui, naïveté, and caprice. The histories of these words do not really teach us any more about the cultural, social, and political relations between England and France than do saloon and salon, which is not much at all, or any other set of loanwords that retain phonetic or orthographic signs of foreignness. Scholar nonetheless does his level best to put his favored four at the heart of early modern English culture. Lengthy accounts of a play by Dryden, a famous work of Schiller's, an essay by Raymond Williams, Caribbean notions of creolization, and a John le Carré novel, learned though they all may be, do not really make the argument more persuasive, or even clear. By the end of this beautifully produced and floridly written book, the reader (or at least this reader) is not quite sure what it was really about. The very title of Émigrés repurposes a xenism which in regular usage is associated with high social status (we never talk of émigré workers, for example), thus exhibiting what I suppose the whole field ought to demonstrate: the ways in which new, hard, or nonnative words are always used to establish pecking orders between speakers, between their interlocutors and between their worlds. Kant himself had praised his acumen,1 though later qualifying his regard decisively.2 Johann Gottfried Herder called * We have just learned of the death of the author. David Baumgardt, born in Germany on April 20, 1890, studied in Vienna and in Berlin and (...) taught philosophy at the University of Berlin from 1924 to 1935 as Privatdozent, Extraordinarius and Ordinarius, until he was forced by Germany's racial laws to resign, but after the end of the war the Free University of Berlin appointed him honorary professor. From 1935 to 1939 he taught at the University of Birmingham; after his arrival in the United States he first joined the staff of the Pendle Hill School and, from 1941 to 1954, he served with the Library of Congress as a consultant in the field of philosophy. In 1955-56 he was Visiting Professor of Philosophy at Columbia. After his retirement he continued to publish and at present there are five publications by him in the press. The number of books and articles written by him probably well exceeds two hundred. Just in the last months of his life he was presented with a Festschri[t (Horizons of a Philosopher), indicative of a wide range of friends, students, and fellow-scholars who wanted to express their appreciation of the man and his work. On the continent Baumgardt was perhaps best known for two books: Franz yon Baader (1927) and Der Kampf um den Lebenssinn unter den Vorliiufern der Modernen Ethik (1933). The former threw full light on an important but unduly neglected figure of the German romantic school of philosophy; the latter confronts Kant's rationalistic ethics with the irrationalism of a Herder, Hemsterhuis, and Jacobi. In the United States he published, among others, Bentham and the Ethics of Today (1952) and Great Western Mystics (1961), originally delivered as Matchette Lectures, but enriched, for publication, by voluminous notes containing a wealth of information on mystics, some of whom, especially Jewish ones, are familiar only to the expert. At the time of his death he was working on a book which would probably have become his opus magnum: an attempt to reconcile what he called the ethics of force with the ethics of love. Baumgardt described his own philosophic position as that of a Benthamian hedonist, asserting that only hedonism, when carried to its conclusions, would permit such a reconciliation. This is an original, ambitious, and provocative book. It argues that Wittgenstein’s later philosophy can best be understood as a response to two problems that animate post-Kantian idealism and romanticism, drawing primarily on the work of Fichte, Schiller, Schlegel, Hegel, Wordsworth, and Goethe. The first is the metaphilosophical problem of the “critique of critique,” the question of what basis can there possibly be for critical philosophy if Kant’s own appeal to the categories proves unacceptable. The second is the ethical (...) problem of expressive freedom, the question of the relationship between Willkür, volitional freedom, or the power to choose between alternatives, and Wille, rational freedom, that is, free choice informed by rational norms or laws. This paper presents an overview of my work in philosophy from my first book on Friedrich Schiller and the political sublime to my most recent project on listening to traumatic forms of violence. Starting with a reflection on the autobiographical character of philosophy, I propose to take up the question of an aesthetic dimension of philosophical critique, where aesthetics is understood as an always already embodied perspective on the world, on truth, and on philosophical activity, as well as an (...) always already political realm, where the distribution of sense pre-determines our approach and articulation of experience. Departing from aesthetics understood and deployed as critique, the paper moves on to ask about the specific frameworks of sense or grammars that determine in advance the conditions of audibility in the realms of memory-building and history-making—particularly in those contexts where historical, political, and institutional forms of violence produce silencing and erasure. Putting in dialogue the latter with decolonial studies, I (re)interpret “traumatic violence” as a colonizing form of violence, understanding that one of its central aspects is that it is not only an assault on life but on the conditions of production of sense that make life legible as such. In this context, my project on grammars of listening seeks to carefully unpack these complex intersections while also explaining why I believe that a radical form of listening is an essential subversive/imaginative strategy against traumatic/colonial violence. This book aims to present a richer alternative to the popular conception of freedom as the power to choose by giving an account of freedom in Schiller, Schelling, and Hegel. Despite my points of criticism (especially with regard to moral responsibility and the freedom to do evil), the contributions of the book are significant. By posing and developing the question of the relationship between freedom and actuality, Schindler introduces a problem that any complete account of freedom must address. "Kant, Kantianism and Idealism" presents an overview of German Idealism, the major movement in philosophy from the late 18th to the middle of the 19th Century. The period was dominated by Kant, Fichte, Schelling and Hegel, whose work influenced not just philosophy, but also art, theology and politics. The volume covers not only these major figures but also their main followers and interpreters. These include Kant's younger contemporary Herder, his early critics such as Jacobi, Reinhold, and Maimon, and his readers (...) Schiller and Schlegel - who shaped much of the subsequent reception of Kant in art, literature and aesthetics - as well as Schopenhauer, whose unique appropriation and criticism of theories of cognition later had a decisive influence on Nietzsche. In this article I take up a central question posed by the article jointly authored with Bill Winslade in this issue of JCE: What should be the role of clinical ethics consultants (CECs) in (what we call) an unsettled case: that is, a situation in which the range of allowable choices, among which the parties to a bioethical disagreement must select, cannot be clearly or completely specified? I argue here that CECs should, in such cases, guide the parties by presenting (...) their own reasoned conclusions about what the scope of allowable choices should be taken to include. Since this position challenges the received view that CECs must not express their own moral positions or conclusions in their role as ethicists, I try to defend my view of the CEC’s role in unsettled cases against several objections. His respect for the author notwithstanding, Mendelssohn has little sympathy for Lessing's view of human (...) progress. Opposing the attempt to force the entire species into a single framework of linear development, Mendelssohn claims that, as a species, humankind has always oscillated between cultivation and barbarism. Borrowing the "ages of man" metaphor that Lessing employed in his own discussion, he writes that at almost any point in human history, man is "child, adult, and old man at the same time, though in different places and regions of the world." 1 Against Lessing's concept of global progress Mendelssohn proposes a model in which each individual follows his own trajectory of self-cultivation, a trajectory that begins before birth, intersects more or less briefly with the plane of historical time, and then continues after death into eternity.Mendelssohn's resistance to the Geschichtsphilosophie articulated here by Lessing and later appropriated by Kant, Schiller, and Hegel has been subject to a variety of interpretations. Not surprisingly, more recent commentators have stressed the philosopher's defense of particularity, his opposition to a totalizing theory of history that threatens to grant the individual nothing more than a bit part in the realization of some future state of human perfection. Norbert Hinske, for example, has argued that Mendelssohn's late writings engage in a conscious confrontation with Kant's understanding of historical progress. 2 [End Page 83]According to Hinske, especially Mendelssohn's short text On the Ideal Constitution indicates that the author "must have recognized spontaneously that Kant's proposed solution, whether intentionally or unintentionally, degraded the individual to a mere means of social progress...." 3Mendelssohn's concern for the individual is certainly central to his rejection of a species-based historical teleology, but one should also keep in mind the ethnic and cultural implications of such a model. As both Kant's and Hegel's later writings reveal, any attempt to understand human history in terms of a coherent, linear narrative, especially one that culminates in the rise of Christian Europe, is necessarily troubled by the continued existence of Judaism. In other words it is not just the individual who suffers an implicit reduction in status in late eighteenth-century theories of progress; entire cultures become vestigial once their historical function has been fulfilled. 4 Although the texts containing the most striking hostility toward Judaism were published after the appearance of Jerusalem, a somewhat surprising anti-Jewish bias is already evident in Lessing's explorations of the topic. Lessing does after all refer to the Jews in the period of Egyptian exile as "the most rude and the most ferocious" people imaginable. 5 Moreover, although he grants them a crucial role as educators of humanity, this role lasts only until the appearance of Jesus Christ, an event that simultaneously marks the end of the childhood of humankind. The question of Voltaire’s belief in (or lack of belief in) God is a vexed one. René Pomeau’s classic study of 1956 argued that Voltaire believed in a God who would punish and reward in the next life. More recently Gerhardt Stenger has shown that, at least after 1764, Voltaire adopted a moderated form of Spinozism. He consistently rejected a materialist atheism on the grounds that the universe showed evidence of intelligent design, and appealed to Spinoza against d’Holbach. This article (...) studies the evolution of Voltaire’s philosophical account of the deity, showing that he moved from a belief in a Newtonian creator God to a Spinozist monopsychism at least by 1756. But, under the influence of Warburton, he had come to reject Bayle’s concept of a society of atheists, and consequently held that the wider public must be encouraged to believe in a providential God, a view he pretended to hold himself. Reading Voltaire after 1756 it is thus essential to understand that he held a double truth theory, so that it is sometimes necessary to ‘read between the lines’ to discover his meaning. (shrink)

Whose values should count – those of patients or the general public – when adopting the quality-adjusted life year framework for healthcare decision making is a long-standing debate. Specific disciplines, such as economics, are not wedded to a particular side of the debate, and arguments for and against the use of patient values have been discussed at length in the literature. In 2012, Sinclair proposed an approach, grounded within patient preference theory, which sought to avoid a perceived unfair discrimination against (...) people with disabilities when using values from the general public. Key assumptions about general public values that beget this line of thinking were that ‘disabled states always tally with lower quality of life’, and the use of standardised instruments means that ‘you are forced into a fixed view of disability as a lower value state’. Drawing on recent contributions to the health economics literature, we contend that such assumptions are not inherent to the incorporation of general public values for the estimation of QALYs. In practice, whether health states of people with disabilities are of ‘lower value’ is, to some extent, a reflection of the health state descriptions that members of the public are asked to value.
