Serious incident investigations—often conducted by means of Root Cause Analysis methodologies—are increasingly seen as platforms to learn from multiple perspectives and experiences: professionals, patients and their families alike. Underlying this principle of inclusiveness is the idea that healthcare staff and service users hold unique and valuable knowledge that can inform learning, as well as the notion that learning is a social process that involves people actively reflecting on shared knowledge. Despite initiatives to facilitate inclusiveness, research shows that embracing and learning (...) from diverse perspectives is difficult. Using the concept of ‘epistemic injustice’, pointing at practices of someone’s knowledge being unjustly disqualified or devalued, we analyze the way incident investigations are organized and executed with the aim to understand why it is difficult to embrace and learn from the multiple perspectives voiced in incident investigations. We draw from 73 semi-structured interviews with healthcare leaders, managers, healthcare professionals, incident investigators and inspectors, document analyses and ethnographic observations. Our analysis identified several structures in the incident investigation process, that can promote or hinder an actor’s epistemic contribution in the process of incident investigations. Rather than repeat calls to ‘involve more’ and ‘listen better’, we encourage policy makers to be mindful of and address the structures that can cause epistemic injustice. This can improve the outcome of incident investigations and can help to do justice to the lived experiences of the involved actors in the aftermath of a serious incident. (shrink)

The critical concern of the present volume is contemporary naturalism, both in its scientific version and as represented by newly emerging hopes for another, philosophically more liberal, naturalism.1 The papers collected here are state-of-the-art discussions that question the appeal, rational motivations, and presuppositions of scientific naturalism across a broad range of philosophical topics. As an alternative to scientific naturalism, we offer the outlines of a new non- reductive form of naturalism and a more inclusive conception of nature than any provided (...) by the natural sciences. Our authors collectively believe that holding scientific naturalism up for philosophical scrutiny and challenging its misconceptions is of the first importance both for understanding ourselves and our place in the world; and, also, for the future direction of philosophy itself. (Goethe, 1817) In der Epoche der klassischen deutschen Philosophie galt Kants 'Kritik der Urteilskraft' beim gelehrten Publikum als 'beliebteste' Kantschrift. Heute wird sie weitestgehend fragmentarisch und mit einem deutlichen Schwerpunkt auf der Kritik der ästhetischen Urteilskraft gelesen. Obwohl sich der vorliegende Sammelband der gesamten dritten Kritik widmet, versuchen die Autoren insbesondere einen verstärkten Diskurs über Kants Kritik der teleologisch reflektierenden Urteilskraft in Gang (...) zu setzen. The philosophical literature that tackles foundational questions about normativity often appeals to normative reasons—or considerations that count in favor of or against actions—and their interaction. The interaction between normative reasons is usually made sense of by appealing to the metaphor of (normative) weight scales. This paper substitutes an argumentation-theoretic model for this metaphor. The upshot is a general and precise model that is faithful to the philosophical ideas.

In this article we explore the ethical issues raised by permitting patients to pay for participation (P4) in clinical trials, and discuss whether there are any categorical objections to this practice. We address key considerations concerning payment for participation in trials, including patient autonomy, risk/benefit and justice, taking account of two previous critiques of the ethics of P4. We conclude that such trials could be ethical under certain strict conditions, but only if other potential sources of funding have first been (...) explored or are unavailable. (shrink)

In this paper, we will survey the different uses of the term algorithm in contemporary legal practice. We will argue that the concept of algorithm currently exhibits a substantial degree of open texture, co-determined by the open texture of the concept of algorithm itself and by the open texture inherent to legal discourse. We will substantiate our argument by virtue of a case study, in which we analyze a recent jurisprudential case where the first and second-degree judges have carved-out contrasting (...) notions of algorithm. We will see that, thanks to our analysis of the open texture of the notion of algorithm in legal language, we can make sense of the different decisions taken by the judges as different contextually-determined sharpenings of the concept of algorithm. Finally, we will draw some general conclusions concerning the use of technical terms in legal instruments that address new technologies, such as the EU AI Act. (shrink)

Tudo não passa, segundo esse filósofo, do desenrolar de forças em jogo agonístico por um algo a mais de poder. Neste artigo nós analisamos alguns aspectos da teoria da vontade de poder para mostrar como (...) Nietzsche faz uso de um mesmo arranjo conceitual para qualificar toda a existência. Ethics review committees have become a common institution in English-speaking research communities, and are now increasingly being adopted in a variety of research environments. In light of existing debates on the aptness of ethics review boards for assessing research work in the social sciences, this article investigates the ways in which researchers navigate issues of research ethics in the absence of a formal review procedure or of an ethics review board. Through the analysis of qualitative and quantitative data, the article (...) questions the overall utility of ethics review boards. Highlighting the importance of space for sharing, the authors argue for the development of a new type of structure that takes into account researchers’ ‘ethos of responsibility’ as an adequate ethical compass for research in the social sciences. The issue of trust has increasingly attracted attention in the business ethics literature. Our aim is to contribute further to this literature by examining how the use of the carbon copy function in email communication influences felt trust. We develop the argument that the use of cc enhances transparency—representing an important characteristic of workplace ethics—and hence promotes trust. We further argue that a downside of the cc option may be that it can also be experienced as a control mechanism, which (...) may therefore negatively affect trust. The results of our first study showed that the use of cc indeed enhances perceived transparency, but at the same time also leads to the experience of increased control. Building upon this insight, the findings of five subsequent studies consistently revealed that the use of cc negatively influences felt trust. More precisely, employees felt trusted the least when the supervisor was always included in cc. This effect on felt trust also negatively influenced how trustworthy the organizational climate was perceived. We further replicated these results in two field surveys, which showed that the negative effect of cc on felt trust lowered perceptions of psychological safety and contributed to a culture of fear. Taken together, our findings suggest that when transparency in email communications is experienced as a control mechanism, its use is perceived as unethical, rather than as ethical. Implications and recommendations for future business ethics research are discussed. (shrink)

Previous research has found that news coverage on immigration is often biased in negative ways and that it inspires the formation of negative attitudes towards immigrants. However, academic research about this link between news consumption and attitudes towards immigrants among adolescents remains limited. The current study aims to test this association from a media-exposure and intergroup-contact perspective using survey data from 875 adolescents in Flanders, Belgium. The findings show that only television news consumption, thus no other types of news consumption, (...) was associated with adolescents’ attitudes towards immigrants. Intergroup contact within the friend group, outside the school context, was linked to more positive attitudes. This study nuances earlier findings that news consumption predicts attitudes towards immigrants. Implications for future research are discussed. (shrink)

De ellos queremos rescatar su ética y estética, su condición de asumir la filosofía como un estilo de vida y su permanente cuestionamiento a la moral establecida dentro de la polis griega. No menos importante es presentar el tema de su sexualidad, su postura filosófica ante el dolor humano y su ataque a los convencionalismos. Se consideraron médicos del alma, permaneciendo (...) como una escuela inclasificable a lo largo de la historia de la filosofía. Presentamos su concepción del cuido de sí en tanto un apartarse de los demás, es decir, estableciendo un cuido contra los demás, sin obviar al otro sino enfrentándolo a su ignorancia. En su momento fueron llamados revolucionarios de la ética por su actitud insobornable frente a sus principios de autonomía y autosuficiencia. (shrink)

ArgumentSince the linguistic turn, the role of rhetoric in the circulation and the popular representation of knowledge has been widely accepted in science studies. This article aims to analyze not a textual form of scientific rhetoric, but the crucial role of materiality in scientific debates. It introduces the concept ofmaterial rhetoricto understand the promotional regimes in which material objects play an essential argumentative role. It analyzes the phenomenon by looking at two students of prehistory from nineteenth-century Belgium.In the study of (...) human prehistory and evolution, material data are either fairly abundant stone tools or very scarce fossil bones. These two types of material data stand for two different strategies in material rhetoric. In this article, the first strategy is exemplified by Aimé Rutot, who gathered great masses of eoliths. The second strategy is typified by the example of Julien Fraipont, who based his scientific career on only two Neanderthal skeletons. Rutot sent his “artifacts” to a very wide audience, while Fraipont showed his skeletons to only a few selected scholars. Unlike Rutot, however, Fraipont was able to monitor his audience's interpretation of the finds by means of personal contacts. What an archaeologist gains in reach, he or she apparently loses in control. In this article we argue that only those scholars who find the right balance between the extremes of reach and control will prove to be successful. (shrink)

Background:Evidence indicates that the processing of facial stimuli may be influenced by incidental factors, and these influences are particularly powerful when facial expressions are ambiguous, such as neutral faces. However, limited research investigated whether emotional contextual information presented in a preceding and unrelated experiment could be pervasively carried over to another experiment to modulate neutral face processing.Objective:The present study aims to investigate whether an emotional text presented in a first experiment could generate negative emotion toward neutral faces in a second (...) experiment unrelated to the previous experiment.Methods:Ninety-nine students (all women) were randomly assigned to read and evaluate a negative text (negative context) or a neutral text (neutral text) in the first experiment. In the subsequent second experiment, the participants performed the following two tasks: (1) an attentional task in which neutral faces were presented as distractors and (2) a task involving the emotional judgment of neutral faces.Results:The results show that compared to the neutral context, in the negative context, the participants rated more faces as negative. No significant result was found in the attentional task.Conclusion:Our study demonstrates that incidental emotional information available in a previous experiment can increase participants’ propensity to interpret neutral faces as more negative when emotional information is directly evaluated. Therefore, the present study adds important evidence to the literature suggesting that our behavior and actions are modulated by previous information in an incidental or low perceived way similar to what occurs in everyday life, thereby modulating our judgments and emotions. Punishment and forgiveness are two very different responses to a moral transgression that both have been argued to restore perceptions of moral order within an organization. Unfortunately, it is currently unclear what motivates organizational actors to punish or forgive a norm transgressor. We build on social cognitive theory to argue that punishment and forgiveness of a transgressor are both rooted in self-regulatory processes. Specifically, we argue that organizational actors are more likely to respond to intentional transgressions with punishment, and to (...) unintentional transgressions with forgiveness. However, these effects of transgressor intentionality should be found in particular among actors for whom moral identity is central. We find support for these predictions in a laboratory experiment and a field study among organizational leaders. By simultaneously studying punishment and forgiveness in organizational settings, we provide crucial insight in their shared motivational bases, as well as into important differences between the two. On many currently popular ontologies of material objects, we share our place with numerous shorter-lived things that came into existence after we did or will go out of existence before we will. Subpeople are intrinsically indistinguishable from possible people, and as several authors pointed out, this raises grave ethical concerns: it threatens to make any sacrifice for long-term goals impermissible, as well as to undermine our standard practices of punishment, reward, grief, and utility calculation. The aim in this paper is (...) to offer a unified set of solutions to these problems. The paper’s starting point is the "self-making view," according to which our de se beliefs help determine our own spatiotemporal boundaries. This paper argues that the self-making view also plays a key role in the best treatment of the moral problems of subpeople. (shrink)

Organ shortage constitutes an unsolved problem for every country that offers transplantation as a therapeutic option. Besides the largely implemented donation model and the eventually implemented market model, a theorized automatic organ procurement model has raised a rich debate in the legal, medical and bioethical community, since it could show a higher potential to solve organ shortage. In this paper, we study the main arguments for and against this model. We show how, in the light of empirical data extracted from (...) countries with a universal health care system, its implementation could lead to a positive impact on organ procurement rates. Three factors are envisioned as fundamental in the comprehension and a possible regulation of the automatic organ procurement model: the lack of recognition of the conscientious objection, the preservation of the right to choose end of life conditions, and the need to avoid incentives for families or healthcare professionals. Previous research has demonstrated the influence of emotions during linguistic processing, indicating the interactivity of both processes in the brain. However, little is known regarding such interplay in a second language (L2). This study addressed this question by examining the reading effects of syntactic violations while processing L2 emotional and neutral statements. Forty-six Spanish-English bilinguals with various levels of L2 proficiency and emotional resonance (i.e. capability for emotional experience in L2) were presented with a self-paced sentence reading task. Sentences contained (...) positive (16), neutral (16) and negative (16) verbs, half of them presented in agreement and half in disagreement with the preceding pronoun. Analysis of verb reading times using linear mixed effects modelling revealed a significant interaction between syntactic violation, verb valence and emotional resonance, suggesting that stronger emotional L2 experience results in a higher saliency of negative verbs, reducing the impact of syntactic violations. Ethical questions about information and communications technologies have been debated since World War II. Western democracies have had more than 50 years of experience in addressing and organising the ethical, social and legal aspects of scientific and technological developments. However, this expertise, tradition and experience are not enough to manage the most urgent ethical and social issues and contemporary challenges involving ICT. A systematic and institutional organisation of social values in the context of modern ICT tools is needed.This paper focuses (...) on four major areas: developing a specific approach to ethical issues raised by ICT; describing in more detail the age-related digital divide in Europe; identifying technology trends and emerging challenges; and defining the legal framework for inclusion of senior citizens in the digital society. The paper then concludes with a summary of its key points on the basis of which it makes three proposals as a contribution to efforts aimed at overcoming the exclusion of senior citizens from today's Information Society. Agents sometimes have a final, de dicto desire to do what is right. They desire to do what is right for its own sake and under this description. These agents have pure moral motivation (PMM). It is often surmised that PMM is in some sense defective. Most famously, it has been suggested that PMM manifests a kind of moral fetishism. However, it also seems defective if an agent shows no concern whatsoever for moral rightness in their motivations. In this paper, (...) I attempt to resolve this puzzling tension. I argue, first, that PMM is defective insofar as it manifests a failure to respond to reasons. I argue, second, that not every instance of PMM manifests a responsiveness failure. In particular, we need to distinguish between the de dicto final desire to do what is right and the de dicto final desire to do what is right for the right reasons. (shrink)

Así, indicaré las numerosas coincidencias que existen entre ambos y me detendré en la cuestión de la muerte mística, ámbito más problemático, donde sin embargo, puede apreciarse una comunión de espíritu entre el español y el portugués. ****************** [english] Firstly, the text offers an approach to the function of love and nostalgia in the poetry of Emilio Prados, as much as its intimate connection with death as mystical annihilation. As interpretive tool, I will use the poetic reason of María Zambrano, an author deeply linked, vital and theoretically, with pradian poetry. This focus will provide an overall view of Prado's work and the possibility of a comparison with Teixeira de Pascoaes's saudosism. Thus, I will point same coincidences between them and I will consider the question of mystical death. This sphere, although it is problematic, can show some kind of community of spirit between both. Why do artists, poets, philosophers, writers, and others who are usually classified as intellectuals leave the ivory tower to "dirty their hands" in the political arena? In an effort to illuminate the intellectual's struggle to come to grips with the issues raised by political involvement, David Schalk examines the life and thought of five intellectuels engagés in France during the period between 1920 and 1945. From communist to fascist, these figures—Paul Nizan, Jean-Paul Sartre, Emmanuel Mounier, Julien Benda, and Robert (...) Brasillach—cover the full political spectrum, and Professor Schalk studies their diverse reactions to the social, political, and economic tensions of the interwar period. Broadly defining "engagement" as political involvement that is voluntary, conscious, and freely chosen, usually by intellectuals, the author poses the intellectual's dilemma in the following terms: "When we are engagé," he writes, "we fear that we are debasing our highest values; when we are not, we worry that we have become, in Paul Nizan's trenchant phrase, mere chiens de garde [watchdogs]." He then investigates the origins and the popularization of the concept of engagement in the early 1930s, the arguments used to denounce it and to defend it, its different manifestations, and finally its effects on the socio-political actuality of the world. This paper seeks to reconstruct the role of schooling in a moment of accelerated social, political, economic, geo-political, climatic, indeed planetary crisis. It identifies the school as a potentially prefigurative institution, an evolutionary social frontier, capable of nurturing the democratic social character, a form of sensibility apart from which authentic political democracy is not possible. As theorized by Herbert Marcuse and Richard Hart and Antonio Negri, the “new sensibility” or “multitude” is characterized by greater psychological freedom, individuality, social creativity and (...) self-rule, comprising a “whole of singularities” that “acts in common”. It suggests a human subject with a vital, biological drive for liberation, with a consciousness capable of breaking through the material as well as ideological veil of a society based on hierarchy and domination, and is associated politically with democracy and social-anarchism, or what Murray Bookchin called “communalism”. This paper identifies three main characteristics of an institution informed by this form of modal subjectivity, all of them based on student-teacher dialogue: an emergent, project-based curriculum, whole-school direct democratic governance on all levels of the community, and the regular practice of communal philosophical inquiry, through which we problematize the concepts we live by, in the interest of their ongoing reconstruction. El presente artículo es un estudio teórico sobre las similitudes entre las doctrinas gnósticas, que florecieron alrededor del siglo ii de nuestra era, y el pensamiento estético del pintor ruso Vasili Kandinsky. El objetivo es analizar estos dos marcos de ideas filosóficas y espirituales para exponer sus similitudes y diferencias. De esta manera, se indagará si, pese a los siglos que las separan y la diferencia de contextos históricos que las rodean, pueden existir en los orígenes de ambas propuestas doctrinales (...) unas problemáticas existenciales y filosóficas comunes. El estudio buscará, con ello, dilucidar si es posible entender la estética de Kandinsky como una especial gnosis moderna estructurada a través de sus planteamientos conceptuales y artísticos. Los resultados de la investigación pretenden no solo dar luces sobre la originalidad de Kandinsky dentro de la historia del arte, sino que también llegar a ser útiles para resaltar y comprender algunos puntos importantes de la discusión cultural dentro de la cual se enmarca su obra. What has sometimes been called the "standard" argument for fatalism never achieved the critical popularity of Richard Taylor's (1962) infamous argument. But it has enjoyed far greater longevity. In De Fato Cicero (1960) tells us it was known in ancient Greece as the "idle argument", for it purports to show the futility of attempting to control one's fate and, hence, those persuaded by it could be led to a life of inaction and idleness. Even with such antiquated credentials, however, the (...) argument continues to exercise fine contemporary minds (e.g. Schlesinger 1993). (shrink)

The Ikhwan al-Safa (Brethren of Purity), the anonymous adepts of a tenth-century esoteric fraternity based in Basra and Baghdad, hold an eminent position in the history of science and philosophy in Islam due to the wide reception and assimilation of their monumental encyclopaedia, the Rasa'il Ikhwan al-Safa (Epistles of the Brethren of Purity). This compendium contains fifty-two epistles offering synoptic accounts of the classical sciences and philosophies of the age; divided into four classificatory parts, it treats themes in mathematics, logic, (...) natural philosophy, psychology, metaphysics, and theology, in addition to didactic fables. Epistles 32 to 36 comprise the first five treatises in the third division of the Rasa'il, on the sciences of the soul and intellect. Combining Islamic revelation with Hellenistic philosophy, the Ikhwan delineate herein their metaphysical system. Epistles 32 and 33 present adaptations of the Pythagorean doctrines, and of Neo-Platonist leitmotifs, whereby a numerical analogy is applied to the unique and transcendent God, or the One, from whom all existence emanates. Epistle 34 takes up the pervasive theme of the correspondence between microcosm and macrocosm, situating the human being as the central link between the celestial and terrestrial realms. In Epistle 35, we find an explanation of the intellectual faculties of the individual human soul, whose ultimate aim is ascension to the timeless reality of pure intellect. Finally, Epistle 36 presents itself as the astrological epistle par excellence of the Rasa'il; from the coming-to-be of worms, to the emergence of religions and empires, nothing in the sub-lunar sphere escapes the determining influence of the celestial cycles. Una perspectiva reciente sobre los fundamentos normativos del derecho público ha propuesto concebir las relaciones entre ciudadanía y Estado como una “relación fiduciaria”, usando deberes fiduciarios del ámbito iusprivado para justificar limitaciones jurídicas y morales al poder del Estado. La gobernanza fiduciaria también ha sido señalada como una característica distintiva del republicanismo y la soberanía popular, ya que sitúa a la comunidad política como fideicomitente y beneficiaria de cualquier acto administrativo. En este artículo se revisan algunas concepciones protomodernas del gobierno (...) considerando sus justificaciones explícitamente fiduciarias. Concluye con una interpretación fiduciaria del iusnaturalismo Leveller, especialmente necesario para entender la relación de la gobernanza fiduciaria con la democracia. A recent perspective on the normative foundations of public law has proposed to conceive citizen-state relationships as a “fiduciary relationship”, using private-law fiduciary duties to justify legal and moral constrains on state power. Fiduciary governance has also been pointed as a distinct feature of republicanism and popular sovereignty, since it places the political community as trustor and beneficiary of any administrative act. This paper reviews some early modern conceptions of government considering their explicit fiduciary justifications. It concludes with a fiduciary account of Leveller natural law, especially needed to understand the relationship between fiduciary governance and democracy. (shrink)

At the same time we also note an increasing polarization of Belgian public opinion on this subject. Among the main actors to shape this public opinion are news media, as they contribute to or combat stereotyping of (sub)groups in the population. The purpose of the current study is to analyze to which extent media consumption and trust have an impact (...) on public opinion on two minority groups – immigrants and refugees – in a representative sample of the Belgian adult population (n = 1500). We gathered data on Belgian news media consumption and trust, and attitudes on immigrants and refugees through an online questionnaire. The results indicate that Belgian adults hold more positive attitudes on immigrants than on refugees. The reading of quality online newspapers as well as high levels of trust in television and radio are correlated with a positive attitude towards both groups, whereas the consumption of commercial television and popular newspapers go along with a negative attitude. Fear of terrorism (negative relation) and a negative evaluation of media coverage of refugees (positive relation) also have a sizeable influence. In terms of regional differences within Belgium, we find that citizens in the Brussels Capital Region hold more positive attitudes towards both groups than those in Flanders and Wallonia. (shrink)
