Newborn infants are among those most severely affected by humanitarian crises. Aid organisations increasingly recognise the necessity to provide for the medical needs of newborns, however, this may generate distinctive ethical questions for those providing humanitarian medical care. Medical ethical approaches to neonatal care familiar in other settings may not be appropriate given the diversity and volatility of humanitarian disasters, and the extreme resource limitations commonly faced by humanitarian aid missions.In this paper, we first systematically review existing guidelines relating to (...) the treatment and resuscitation of newborns in humanitarian crises, finding little substantive ethical guidance for those providing humanitarian healthcare. We next draw on paradigm cases and published literature to identify and describe some of the major ethical questions common to these settings. We divide these questions into quality of life considerations, allocation of limited resources, and conflicting cultural norms and values. We finally suggest some preliminary recommendations to guide ethical decision‐making around resuscitation of newborns and withdrawal of treatment in humanitarian settings. (shrink)

Predictive processing accounts of neural function view the brain as a kind of prediction machine that forms models of its environment in order to anticipate the upcoming stream of sensory stimulation. These models are then continuously updated in light of incoming error signals. Predictive processing has offered a powerful new perspective on cognition, action, and perception. In this chapter we apply the insights from predictive processing to the study of emotions. Deciding to undergo a predictive genetic test is difficult. The patient has no symptoms that might tip the balance in favor of the test, and knowledge of the information might have significant implications for her physical and mental health, her family, and her financial position. Furthermore, although the decision to undergo many medical tests might reasonably be said to be the patient's own business, it could be argued that predictive genetic tests are different. Dean Bell and Belinda Bennett argue (...) that genetic information has a “shared” or “familial” character due to the likelihood of it affecting others. If others might be affected by the results of your test, then it is certainly plausible to suggest that they have an interest in knowing the information. If that is the case, then it could also be argued that they are entitled to be considered when you are deciding whether to undergo a test. (shrink)

In order to formulate hypotheses about the evolutionary underpinnings that preceded the first glimmerings of language, mother-infant gestural and vocal interactions are compared in chimpanzees and humans and used to model those of early hominins. These data, along with paleoanthropological evidence, suggest that prelinguistic vocal substrates for protolanguage that had prosodic features similar to contemporary motherese evolved as the trend for enlarging brains in late australopithecines/early Homo progressively increased the difficulty of parturition, thus causing a selective shift toward females that (...) gave birth to relatively undeveloped neonates. It is hypothesized that hominin mothers adopted new foraging strategies that entailed maternal silencing, reassuring, and controlling of the behaviors of physically removed infants (i.e., that shared human babies' inability to cling to their mothers' bodies). As mothers increasingly used prosodic and gestural markings to encourage juveniles to behave and to follow, the meanings of certain utterances (words) became conventionalized. This hypothesis is based on the premises that hominin mothers that attended vigilantly to infants were strongly selected for, and that such mothers had genetically based potentials for consciously modifying vocalizations and gestures to control infants, both of which receive support from the literature. The men and women who serve in the armed forces, in the words of Major General Joseph Caravalho, “sign a blank check, co-signed by their families, payable to the Army, Navy, Air Force, or Marines, up to and including their lives.” It is human nature to consider such a pact in polarized terms; the pact concludes in either a celebratory homecoming or funereal mourning. But in reality, surviving catastrophic injury may incur the greatest debt. The small but real possibility of (...) losing the ability to bear biological children due to genitourinary combat injury has been a topic of discussion in hushed tones, behind closed doors. But as policy changes move the conversation into the open, we must be fully aware of the far-reaching and long-term impacts of decisions on those who have sustained genitourinary injury. In January 2016, Secretary of Defense Ashton Carter outlined a set of reforms that would improve the quality of life for military families by recognizing the importance of maintaining fertility, even in the face of severe injury. This first promising step could build a solid foundation of insuring fertility preservation for wounded service members with genitourinary injury, and it could set a precedent beyond the military for insuring treatment for people who have lost their reproductive capacity. Thus, the ethical challenges raised by the new policy require careful analysis. (shrink)

This article details day-to-day ethics issues facing MBAs who occupy entry-level and mid-level management positions and offers defined examples of the stressors these managers face. The study includes lower-level managers, essentially excluded from extant literature, and focuses on workplace behaviors both undertaken and observed. Results indicate that pressures from internal organization sources, and ambiguity in letter versus spirit of rules, account for over a third of the most frequent unethical situations encountered, and that most managers did not expect to face (...) those issues. Various contextual factors accounted for 32% of the organizational factors that affected decisions. We discuss implications for the workplace, especially the unique ethics challenges for newer managers. (shrink)

This article outlines a training activity that can enable both business and governmental professionals to translate the principles in a code of ethics to a specific list of company-related behaviors ranging from highly ethical to highly unethical. It also explores how this list can become a concrete model to follow in making ethical decisions. The article begins with a discussion as to what will improve ethical decision making in business and government. This leads us to explore the factors that can (...) most easily lead to improvement, namely a comprehensive code of conduct and employee training. From there we look at the Critical Incident Technique as a training strategy that has the potential for identifying those behaviors that distinguish really outstanding behaviors from those that go by the book, and can be used to encourage more independent thinking and to set expectations for future decisions. If employees are given the skills and examples that will enable them to make better decisions, they can apply them to any situation. (shrink)

One of the most commonly referenced ethical principles when it comes to the management of dying patients is the doctrine of double effect (DDE). The DDE affirms that it is acceptable to cause side effects (e.g. respiratory depression) as a consequence of symptom‐focused treatment. Much discussion of the ethics of end of life care focuses on the question of whether actions (or omissions) would hasten (or cause) death, and whether that is permissible. However, there is a separate question about the (...) permissibility of hastening or causing unconsciousness in dying patients. Some authors have argued that the DDE would not permit end of life care that directly aims to render the patient unconscious. The claim is that consciousness is an objective human good and therefore doctors should not intentionally (and permanently) suppress it. Three types of end of life care (EOLC) practices will be explored in this article. The first is symptom‐based management (e.g. analgesia); the second is proportional terminal sedation as a means of relieving suffering (also referred to as palliative sedation or continuous deep sedation); and finally, deliberate and rapid sedation to unconsciousness until death (a practice we call terminal anaesthesia in this paper). After examining the common arguments for the various types of symptom‐based management and sedation, we apply the DDE to the latter two types of EOLC practices. We argue that aiming at unconsciousness, contrary to some claims, can be morally good or at least morally neutral in some dying patients. (shrink)

We welcome Cho and Wu’s suggestion that the study of auditory verbal hallucinations could be improved by contrasting and testing more explanatory models. However, we have some worries both about their criticisms of inner speech-based self-monitoring models and whether their proposed spontaneous activation model is explanatory.

abstract This paper examines, from a philosophical point of view, the ethics of the role of the family and the deceased in decisions about organ retrieval. The paper asks: Who, out of the individual and the family, should have the ultimate power to donate or withhold organs? On the side of respecting the wishes of the deceased individual, the paper considers and rejects arguments by analogy with bequest and from posthumous bodily integrity. It develops an argument for posthumous autonomy based (...) on the liberal idea of self‐development and argues that this establishes a right of veto over donation. It claims, however, that whether the family's power to veto would conflict with posthumous autonomy rights depends on how it comes about. On the side of respecting the family's wishes, the paper first considers an argument from family distress. This supports a contingent, non‐rights‐based reason for the family's power that is trumped by the deceased's rights. It then outlines and criticises an argument based on family autonomy. The conclusion is that the individual has the right to veto the family's wish to donate and that, while the family has no right to veto the individual's wishes to donate, it can legitimately acquire this power and has done so in practice. Disability might be relevant to decisions about life support in intensive care in several ways. It might affect the chance of treatment being successful, or a patient’s life expectancy with treatment. It may affect whether treatment is in a patient’s best interests. However, even if treatment would be of overall benefit it may be unaffordable and consequently unable to be provided. In this paper we will draw on the example of neonatal intensive care, and ask whether or when it is (...) justified to ration life-saving treatment on the basis of disability. We argue that predicted disability is relevant both indirectly and directly to rationing decisions. (shrink)

While this ‘extraordinary’ book appears as an intermezzo within the Homo Sacer series (Negri, 2008), it supports two fundamental theses with its own philological, epigraphic, liturgical and religious-historical research, and a close reading of figures such as Ernst Kantorowicz and Marcel Mauss. These theses concern political power first as an articulation of sovereign reign and economic government and, secondly, as constituted by acclamations and glorification. These can be approached theoretically through its author’s engagement with Michel Foucault’s genealogy of governmentality and (...) with the Erik Peterson/Carl Schmitt debate on the closure of political theology. Agamben’s reformulation of power and his derivation of liberal governmentality from the theological oikonomia prove convincing. A renewed analytics of power and politics of resistance should be possible, however, without recourse to a project seeking to deactivate all profane powers including those of public bureaucracies. Although the doctrine of divine simplicity has faced substantial criticism in recent years, Jeffrey Brower has recently offered a novel defense of the view by appealing to contemporary truthmaker theory. In this paper, I will argue that Brower’s defense of divine simplicity requires an implausible account of how truthmaking works for essential intrinsic predications. I will first argue that, unless Brower is willing to make an ad hoc exception for how truthmaking works in God’s case, he is committed to saying (...) that essential intrinsic predications about any object are made true by that object alone, not by its having essential properties. I will then argue that reflecting on cases where distinct essential intrinsic predications about an object have different causal explanations behind them shows that this general view of truthmaking is implausible. One formulation of the Categorical Imperative tells us to treat humanity as an end in itself. It has become common to think that ‘humanity’ (die Menschheit) here refers to some minimal power of rationality that is necessarily possessed by any rational agent, but I argue that this common reading is misguided. Instead, ‘humanity’ refers to a good will, the will of a being who is committed to moral principles. This good will reading of ‘humanity’ is not only suggested by passages (...) in which Kant specifically discusses humanity, but also is more consistent with the main ideas of Kant's ethics. (shrink)

This conceptual paper presents a radical humanist framing of the relationship between human needs and social welfare. It draws and develops its conceptualisation of radical humanism from the early philosophical writings of Marx in which he identified the radical constitutive needs of the human species. It seeks to translate the definitive characteristics of humanity's ‘species being’ – namely consciousness, ‘work’, sociality and historical development – into overarching claims or social rights to autonomous thinking, creative activity, mutual caring and human progress. Benjamin Franklin, the colonial American, maintained a now little-known interest in geological questions for more than sixty years. He began as a follower of English theorists, but soon assimilated some of their ideas with original speculations and discoveries, particularly regarding earthquakes. Though Franklin became famous for his experiments with electricity, he never attempted to explain earthquakes as if they were electrical phenomena; others, however, did. Through his access to American materials, Franklin contributed significantly to the work of several English and (...) French geological theorists. Though some of his own theories were ultimately of limited value, Franklin played an important role in the international science of his time. It was proposed that ethical evaluation of insurance claim padding behavior would be affected by characteristics of the policyholder, insurance agent, and company. These three factors were manipulated in written scenarios and the premise was tested in a factorial experimental design. No significant support was found for an effect of any of the three factors on ethical perceptions of claim padding. However, females found claims padding to be significantly less ethical than males. Given a claim scenario where the actual loss (...) was $500 and the claimed amount was $3000, subjects awarded an average of $986.91 on the claim. Many respondents were willing to compensate victims for intangible losses as well as tangible losses. (shrink)
