This paper assesses the role of shadow education (SE), i.e., organised learning activities outside formal schooling, in the lives of secondary school students of different social backgrounds and in different school settings, in a high-stakes context. It draws on multilevel analysis of longitudinal Growing Up in Ireland data, alongside narratives from in-depth case study research in 10 schools. Framed within a social reproduction approach, we show how access to SE as an educational resource is socially stratified, accessible to those with (...) greater levels of family resources, and those attending schools with higher socio-economic student intakes. SE is viewed as an investment, particularly among students with average and above average levels of prior attainment, while high attaining students are less likely to use SE. Perhaps reflecting the normalisation of SE in the Irish context, students do not directly link engagement in such tuition to their socio-emotional wellbeing. (shrink)

This book presents an alternative to conventional ideas about the evolution of the human intellect.

You know what someone else is thinking and feeling by observing them. But how do you know what you are thinking and feeling? This is the problem of self-knowledge: Alex Byrne tries to solve it. The idea is that you know this not by taking a special kind of look at your own mind, but by an inference from a premise about your environment.

ABSTRACT:This paper analyzes how national institutional factors affect the adoption of the international environmental management standard ISO 14001, using a panel of 139 countries from 1996 to 2006. The analysis emphasizes that during the emerging phase of the standard, the potential lack of consensus within the constituents of the national institutional environment concerning the value of a new standard could send mixed signals to firms about the standard. The results show that in the early phase of adoption, regulative and normative (...) forces within the institutional environment can work against each other. Results also show that regulative or coercive forces play a relatively more important role in the early phase of adoption of the standard than in the subsequent phases of diffusion. In the later phases of diffusion of ISO 14001, normative forces, such as the diffusion of other management standards, as well as factors related to trade, play a more important role. Because of the similarities between environmental management standards and corporate social responsibility standards, this study can help identify some of the challenges for diffusion of ISO management standards in the area of social responsibility. The Dangerous Book for Boys Abstract: Seventeenth and eighteenth century discussions of the senses are often thought to contain a profound truth: some perceptible properties are secondary qualities, dispositions to produce certain sorts of experiences in perceivers. In particular, colors are secondary qualities: for example, an object is green iff it is disposed to look green to standard perceivers in standard conditions. After rebutting Boghossian and Velleman’s argument that a certain kind of secondary quality theory is viciously circular, we discuss (...) three main lines of argument for the secondary quality theory. The first is inspired by an intuitively compelling picture of perception articulated by Reid; the second is that the secondary quality theory is a conceptual truth; the third line of argument is presented in Johnston’s influential paper ‘How to speak of the colors’. By entering positive law, human rights reveal not only internal contradictions, but also external conflicts between the practical reasons which inspire them. These contradictions and conflicts could pull us in the doldrums (Pot au noir), this mythical place where ships, caught in violent storms and world winds, could shipwreck.

What are our responsibilities in the face of injustice? How far should we go to fight it? Many would argue that as long as a state is nearly just, citizens have a moral duty to obey the law. Proponents of civil disobedience generally hold that, given this moral duty, a person needs a solid justification to break the law. But activists from Henry David Thoreau and Mohandas Gandhi to the Movement for Black Lives have long recognized that there are times (...) when, rather than having a duty to obey the law, we have a duty to disobey it. -/- Taking seriously the history of this activism, A Duty to Resist wrestles with the problem of political obligation in real world societies that harbor injustice. Candice Delmas argues that the duty of justice, the principle of fairness, the Samaritan duty, and political association impose responsibility to resist under conditions of injustice. We must expand political obligation to include a duty to resist unjust laws and social conditions even in legitimate states. -/- For Delmas, this duty to resist demands principled disobedience, and such disobedience need not always be civil. At times, covert, violent, evasive, or offensive acts of lawbreaking can be justified, even required. Delmas defends the viability and necessity of illegal assistance to undocumented migrants, leaks of classified information, distributed denial-of-service (DDoS) attacks, sabotage, armed self-defense, guerrilla art, and other modes of resistance. There are limits: principle alone does not justify law breaking. But uncivil disobedience can sometimes be not only permissible but required in the effort to resist injustice. (shrink)

Peter Byrne presents a detailed study of the role of the concept of God in Kant's Critical Philosophy. After a preliminary survey of the major interpretative disputes over the understanding of Kant on God, Byrne explores his critique of philosophical proofs of God¿s existence. Examining Kant¿s account of religious language, Byrne highlights both the realist and anti-realist elements contained within it. The notion of the highest good is then explored, with its constituent elements - happiness and virtue, (...) in pursuit of an assessment of how far Kant establishes that we must posit God. The precise role God plays in ethics according to Kant is then examined, along with the definition of religion as the recognition of duties as divine commands. Byrne also plots Kant¿s critical re-working of the concept of grace. "Intelligence" has long been considered to be a feature unique to human beings, giving us the capacity to imagine, to think, to deceive, to make complex connections between cause and effect, to devise elaborate stategies for solving problems. However, like all our other features, intelligence is a product of evolutionary change. Until recently, it was difficult to obtain evidence of this process from the frail testimony of a few bones and stone tools. It has become clear in the last 15 (...) years that the origins of human intelligence can be investigated by the comparative study of primates, our closest non-human relatives, giving strong impetus to the case for an "evolutionary psychology", the scientific study of the mind. Hunger strikes are commonly repressed in prison and seen as disruptive, coercive, and violent. Hunger strikers and their advocates insist that incarcerated persons have a right to hunger strike, which protects them against repression and force-feeding. Physicians and medical ethicists generally ground this right in the right to refuse medical treatment; lawyers and legal scholars derive it from incarcerated persons’ free speech rights. Neither account adequately grounds the right to hunger strike because both misrepresent the hunger strike as noncoercive and (...) nonviolent. I articulate an alternative, dual account of the right to hunger strike. On the remedial argument, the right to hunger strike should be legally protected as a right to petition for redress, in light of incarcerated people’s structural vulnerability to abuse and given inadequate grievance mechanisms. The constructive argument derives the right to hunger strike from the right to resist oppression and stresses the normative permissibility of the use of coercive tactics to defend one’s liberty interests in the face of carceral oppression. -/- . I know various contingent truths about my environment by perception. For example, by looking, I know that there is a computer before me; by hearing, I know that someone is talking in the corridor; by tasting, I know that the coffee has no sugar. I know these things because I have some built-in mechanisms specialized for detecting the state of my environment. One of these mechanisms, for instance, is presently transducing electromagnetic radiation (in a narrow band of wavelengths) coming from (...) the computer and the desk on which it sits. How that mechanism works is a complicated story—to put it mildly—and of course much remains unknown. But we can at least produce more-or- less plausible sketches of how the mechanism can start from retinal irradiation, and go on to deliver knowledge of my surroundings. Moreover, in the sort of world we inhabit, specialized detection mechanisms that are causally affected by the things they detect have no serious competition—seeing the computer by seeing an idea of the computer in the divine mind, for example, is not a feasible alternative. The author presents a deduction system for Quantum Logic. This system is a combination of a natural deduction system and rules based on the relation of compatibility. This relation is the logical correspondant of the commutativity of observables in Quantum Mechanics or perpendicularity in Hilbert spaces. Contrary to the system proposed by Gibbins and Cutland, the natural deduction part of the system is pure: no algebraic artefact is added. The rules of the system are the rules of Classical Natural Deduction (...) in which is added a control of contexts using the compatibility relation. The author uses his system to prove the following theorem: if propositions of a quantum logical propositional calculus system are mutually compatible, they form a classical subsystem. (shrink)

From the viewpoint of the constitutional crisis in Europe, slow UN reforms, difficulties implementing the Kyoto Protocol and the International Criminal Court, and tensions between human rights and trade, Mireille Delmas-Marty's 'journey through the legal landscape' of the early years of the 21st century shows it to be dominated by imprecision, uncertainty and instability. The early 21st century appears to be the era of great disorder: in the silence of the market and the fracas of arms, a world overly fragmented (...) by anarchical globalisation is being unified too quickly through hegemonic integration. How, she asks, can we move beyond the relative and the universal to build order without imposing it, to accept pluralism without giving up on a common law? Neither utopian fusion nor illusory autonomy, Ordering Pluralism is her answer: both an epistemological revolution and an art, it means creating a common legal area by progressive adjustments that preserve diversity. Since an immutable world order is impossible, the imaginative forces of law must be called upon to invent a flexible process of harmonisation that leaves room for believing we can agree on - and protect - common values. Nursing Inquiry 2012; 19: 357–367 Nomadic sexualities: an in‐depth case study about unsafe sexIn an era when researchers are identifying increased rates of unsafe sex among gay and bisexual men, it is important that the practice of unsafe sex be adequately explored. While much literature is already dedicated to this topic, only recently have researchers begun to develop in‐depth understandings of the personal meanings that people ascribe to unsafe sex. This study continues such explorations by examining (i) (...) why one self‐defined gay man engaged in unsafe sex, and (ii) how he defined unsafe sex. The findings suggest that, for this man, his sexuality is nomadic and that what he feels is unsafe sex is the outcome of his nomadic sexuality conflicting with social imperatives for sexual stratification. Lonergan’s written reflections on the notion of form span almost thirty years. Beginning with his 1930s manuscripts on the philosophy of history, Lonergan returned again and again to the problem of clarifying that metaphysical concept. His thought on the issue of form reached its mature stage in 1957 with the publication of Insight. This article first presents an account of the mature, Insight stage of Lonergan’s notion of form. It then shows how Lonergan arrived at that position from his interpretation (...) of Aristotle as set forth in Verbum: Word and Idea in Aquinas. It concludes with some remarks in response to a criticism of Lonergan, commonly leveled by certain Thomist thinkers, according to which Lonergan’s effort to ground philosophy in self-appropriation rather than metaphysics condemns him to a subjectivist or idealist position. Such a critique, I argue, fails to take into account what Lonergan actually held. Indeed, the preference for a metaphysical point de départ is itself vulnerable to a reverse criticism on Lonergan’s part. (shrink)

Although there is increasing use of eco-labeling, conditions under which eco-labels can command price premiums are not fully understood. In this article, we demonstrate that the certification of environmental practices by a third party should be analyzed as a strategy distinct from—although related to—the disclosure of the eco-certification through a label posted on the product. By assessing eco-labeling and eco-certification strategies separately, researchers can identify benefits associated with the certification process, such as improved reputation in the industry or increased product (...) quality, independently from those associated with the actual label. In the context of the wine industry, we show that eco-certification leads to a price premium while the use of the eco-label does not. (shrink)

The 21st International Climate Conference (COP21) demonstrated that a global consensus is possible among 195 countries. For this reason, we could say that climate change is a chance (perhaps the last) for humanity.It is indeed the only area where worldly governance now seems possible, although it also is needed to fight, for example, against global terrorism or to regulate international migration. - Through the ongoing experience concerning climate policy, a triple dynamic, which would establish a genuine global governance, can be (...) drawn: recognizing interdependencies, regulating contradictions, making actors aware of their responsibilities. Anything is similar to anything, provided the respects of similarity are allowed to be gerrymandered or gruesome, as Goodman observed.2 But similarity in non-gruesome or—as I shall say—genuine respects is much less ecumenical. Colors, it seems, provide a compelling illustration of the distinction as applied to similarities among properties.3 For instance, in innumerable gruesome respects, blue is more similar to yellow than to purple. Is the civic duty to report crime and corruption a genuine moral duty? After clarifying the nature of the duty, I consider a couple of negative answers to the question, and turn to an attractive and commonly held view, according to which this civic duty is a genuine moral duty. On this view, crime and corruption threaten political stability, and citizens have a moral duty to report crime and corruption to the government in order to help the government’s law enforcement (...) efforts. The resulting duty is triply general in that it applies to everyone, everywhere, and covers all criminal and corrupt activity. In this paper, I challenge the general scope of this argument. I argue that that the civic duty to report crime and corruption to the authorities is much narrower than the government claims and people might think, for it only arises when the state (i) condemns genuine wrongdoing and serious ethical offenses as “crime” and “corruption,” and (ii) constitutes a dependable “disclosure recipient,” showing the will and power to hold wrongdoers accountable. I further defend a robust duty to directly report to the public—one that is weightier and wider than people usually assume. When condition (ii) fails to obtain, I submit, citizens are released of the duty to report crime and corruption to the authorities, but are bound to report to the public, even when the denunciation targets the government and is risky or illegal. What is wrong with government whistleblowing and when can it be justified? In my view, ‘government whistleblowing’, i.e., the unauthorized acquisition and disclosure of classified information about the state or government, is a form of ‘political vigilantism’, which involves transgressing the boundaries around state secrets, for the purpose of challenging the allocation or use of power. It may nonetheless be justified when it is suitably constrained and exposes some information that the public ought to know and deliberate about. Government whistleblowing (...) should then be viewed, along the lines of civil disobedience, as a collective cognition- and legitimacy-enhancing device. (shrink)

When one visually hallucinates, the object of one’s hallucination is not before one’s eyes. On the standard view, that is because the object of hallucination does not exist, and so is not anywhere. Many different defenses of the standard view are on offer; each have problems. This paper defends the view that there is always an object of hallucination—a physical object, sometimes with spatiotemporally scattered parts.

Recognizing that probability (the Greek doxa) was understood in pre-modern theories as the polar opposite of certainty (episteme), the author of this study elaborates the forms which these polar opposites have taken in some twentieth century writers and then, in greater detail, in the writings of Thomas Aquinas. Profiting from subsequent more sophisticated theories of probability, he examines how Aquinas’s judgments about everything from God to gossip depend on schematizations of the polarity between the systematic and the non-systematic: revelation/reason, science/opinion, (...) saints/philosophers, Aristotle/others. Post-medieval developments have provided the means to discern within Thomas’s thought both a logical theory and a kind of relative frequency theory of probability. The former depends on Aristotle’s theory of demonstration, the latter on his theory of an orderly cosmos; but each as used by Thomas lead to convictions that are sometimes naive, sometimes amusing or even terrifying. Dembroff’s “Escaping the natural attitude about gender” replies to my “Are women adult human females?”. This paper responds to Dembroff’s many criticisms of my arguments, as well as to the charge that “Are women...” “fundamentally is an unscholarly attempt to vindicate a political slogan that is currently being used to undermine civic rights and respect for trans persons”. I argue that Dembroff’s criticisms fail without exception, and explain why the claims about my motives are baseless.

Three arguments for the thesis that sex is socially constructed are examined and rejected. No such argument could succeed, because sex is not socially constructed.

What I dub the “worst-result” principle is a criterion that identifies civil war and tyranny as the worst evils that could befall a state, and prescribes their prevention. In this thesis, I attempt to define the worst-result principle’s concrete prescriptions and institutional arrangements to meet these. To do so, I explore different understandings of the worst-result principle, that each contributes to the general argument. Montesquieu’s crucial insight concerns the separation of powers to prevent the state from collapsing into despotism. Judith (...) Shklar shows that ‘damage control’ needs to be constantly performed so as to minimize chances of governmental brutality. Roberto Unger points at the importance of encouraging citizens’ involvement in the political process to safeguard freedom. I finally argue, in the light of historical evidence, that it would be unreasonable to think that the task of preventing tyranny can be effectively performed in the absence of courts entrusted with checking powers. The first half of Mark Quentin Gardiner’s recent book, Semantic Challenges to Realism: Dummett and Putnam, is a sustained, systematic, and, for the most part, novel attempt to demolish the case against semantic realism instigated by Michael Dummett. In this article I reply on the anti-realist’s be-half. I aim to demonstrate that none of Gardiner’s main anti-Dummettian arguments are successful, and moreover that his errors are, in the main, consequences of serious misconstruals of vital aspects of the semantic realist and (...) anti-realist positions. In this paper I discuss recent scholarly work on ideology, mostly by Europeans, that exposes a secularist bias in current political theory, invites a nonderogatory concept of religion, and justifies more flexible church/state relations. This work involves redefining ideology as any action-oriented ideas, whether destructive or ameliorative, including both secular theory and religion, then drawing on hermeneutical and critical studies of the power/ideology relationship to rediscover a role for ‘utopia’ as a social catalyst for amelioration. I then call attention to (...) the relevance of ‘mission’ to this work. For in both secular and sacred contexts, missions are defined and assigned to individuals or groups to enhance some aspect of the organizing entity’s sense of purpose and possibility. What stands out in each instance is that the sense of mission is not passively epistemic but actively project-oriented, goal-directed. It can be used with reference to any end or goal that is at least implicitly normative and which people seek to attain. A mission moves people, however, only if it is tied to some belief-based social identity which can be interpreted as oriented to that end. A case can be made, accordingly, for accommodating religious views in our political discourse, for they have a history of directing people’s thinking beyond what is to what ought to be, and without them we are ever more inclined to tolerate mediocrity in ourselves and despair in others.
