The deconstruction of the subject associated with postmodernism cannot be said to have simply carried the day. Opponents and critics of postmodernism have held that we must return to the subject and to autonomy as a necessary condition of thinking about ethics, politics, agency and responsibility. Indeed, Peter Dews has recently argued that efforts to displace the subject repeat rather than dissolve the problems generated by subject-centered theories, a charge he takes to be devastating. The implications of this return to (...) the subject, and the power of the critique which motivates it, will be my focus here. I consider especially Judith Butler's performative account of agency and her recent discussion of reflexivity, and argue that they afford us a means of obviating the critique while providing for the reflexive agency that proponents of the return to the subject think necessary. The aim of this article is twofold. First, it is argued that while the principle of ‘ought implies can’ is certainly plausible in some form, it is tempting to misconstrue it, and that this has happened in the way it has been taken up in some of the current literature. Second, Kant's understanding of the principle is considered. Here it is argued that these problematic conceptions put the principle to work in a way that Kant does not, so that there (...) is an important divergence here which can easily be overlooked. Schupbach and Sprenger introduce a novel probabilistic approach to measuring the explanatory power that a given explanans exerts over a corresponding explanandum. Though we are sympathetic to their general approach, we argue that it does not adequately capture the way in which the causal explanatory power that c exerts on e varies with background knowledge. We then amend their approach so that it does capture this variance. Though our account of explanatory power is less ambitious than Schupbach and Sprenger’s in (...) the sense that it is limited to causal explanatory power, it is also more ambitious because we do not limit its domain to cases where c genuinely explains e. Instead, we claim that c causally explains e if and only if our account says that c explains e with some positive amount of causal explanatory power. (shrink)

This volume presents a selection of Robert Stern's work on the theme of Kantian ethics. It begins by focusing on the relation between Kant's account of obligation and his view of autonomy, arguing that this leaves room for Kant to be a realist about value. Stern then considers where this places Kant in relation to the question of moral scepticism, and in relation to the principle of 'ought implies can', and examines this principle in its own right. In this article, I want to argue that scepticism for Kant must be seen in ancient and not just modern terms, and that if we take this into account we will need to take a different view of Kant's response to Hume from the one that is standardly presented in the literature. This book explores the nature of meaning, primarily through readings of the work of Walter Benjamin and Ludwig Wittgenstein. Alexander Stern offers a critical analysis of Benjamin's philosophy of language, finding in it a common root with Wittgenstein's thought on language, and traces the historical foundation of both accounts of meaning to eighteenth- and nineteenth-century German philosophy. Benjamin's theory of language is notoriously dense and obscure. In elucidating it, Stern emphasizes Benjamin's attempt to reorient the Kantian project around (...) language-the medium in which knowledge is expressed-and his concern with the logical understanding of language gaining credence in the work of Bertrand Russell and Gottlob Frege. The result is a radical model of the relationship between language, experience, and the world that sees "absolutely everything" as linguistic in a broadened sense and which sees the logical or designative capacities of language as grounded in an aesthetic foundation. Wittgenstein and Benjamin are read in the book as complementary to one another, sharing comparable critiques of empiricism and comparable accounts of concept use, linguistic understanding, and the relation between experience and language. Although this similarity breaks down over Wittgenstein's account of the "experience of meaning," which is subordinated to his account of meaning as use, Stern argues that Benjamin's theory of language can productively address some unresolved issues in Wittgenstein's understanding of meaning. Auch unter Befürwortern der Zulässigkeit einer Suizidassistenz durch Ärzte unter bestimmten Bedingungen besteht weitgehendes Einverständnis darüber, dass kein Arzt zu einer Suizidassistenz rechtlich oder berufsrechtlich verpflichtet sein sollte. Auch das Bundesverfassungsgericht hat in seinem Urteil vom Februar 2020 Suizidwilligen unter bestimmten Bedingungen nicht mehr als ein ungerichtetes in rem-Recht auf Suizidhilfe zugesprochen, das keinen Anspruch gegen einen einzelnen Arzt begründet. Mit dem letzten Satz seines Urteils hat es vielmehr die Freiheit jedes einzelnen Arztes – wie auch jedes anderen potenziellen Helfers (...) –, Nein zu sagen, nachdrücklich bekräftigt. Auf dem Hintergrund einer empirischen Untersuchung der Gründe, die in der Schweiz für die Ablehnung entsprechender Patientenanfragen gegeben werden, untersucht und gewichtet der Beitrag die Gründe, die für diese Freiheit sprechen, unter ethischen Gesichtspunkten und verteidigt ein bedingtes Recht auf Ablehnung gegen dessen jüngste Kritiker. In Fällen, in denen die Bedingungen erfüllt sind, durch die das Bundesverwaltungsgericht in seinem Urteil vom März 2017 „extreme Notlagen“ definiert hat, sollte jedoch zumindest eine moralische Pflicht anerkannt werden, den Patienten an einen Arzt zu verweisen, der zu einer Unterstützung bereit ist. : This paper offers a distinctive interpretation of Hegel's Doppelsatz from the Preface to the Philosophy of Right: 'What is rational is actual; and what is actual is rational'. This has usually been interpreted either conservatively (as claiming that everything that is, is right or good) or progressively (that if the world were actual, it would be right or good, but that there is a distinction that can be drawn between existence and actuality). My aim in this paper is to (...) argue against both interpretations, so that the position I offer is neutral between the two. My claim is that when Hegel identifies what is actual with what is rational in the Doppelsatz, his intention is not to offer a normative assessment of what is actual; rather, it is to suggest that genuine philosophy must be committed to reason in its methods of inquiry, if it is to properly undertake an investigation into the "spiritual universe" as well as the "natural" one. The Doppelsatz is thus a defence of philosophical rationalism, rather than a normative claim about "was ist wirklich". (shrink)

Ethics in the 21st century is threatened by a split between practical philosophy as a full-blown academic discipline and applied ethics as pragmatic problem-solving inside the political process. The place of the professional philosopher sitting on medical and other 'ethics committees' as an 'ethical expert' is somewhere in between. But where exactly? How is his role defined? Is the expertise he brings to bear on practical decisions of a purely technical or of a substantially moral kind? These issues are discussed (...) both 'from the outside' and 'from the inside'. First, some of the theoretical controversies surrounding 'ethical expertise' are discussed on the background of a rapidly growing literature in the field. Gadamer elaborates on his experiences in education and politics, touching on the collapse of the Weimar Republic, the early Frankfurt School, Heidegger and the Nazis, university life in East Germany, and the prospects (...) for Europe in the coming years. Hans-Georg Gadamer was probably Heidegger’s leading interpreter in Germany, and in the 1950s and 1960s he became the world’s leading exponent of hermeneutics. His hermeneutical theory explains how it is that ancient art and philosophy still speak to us today. Ziel der Untersuchung ist zu zeigen, inwiefern Hegels Charakterisierung des Schönen als ‚das sinnliche Scheinen der Idee‘ auch für die Deutung des Naturschönen Erklärungswert hat. Vorausgesetzt ist die für den Idea- lismus Hegelscher Prägung zentrale Doktrin, derzufolge der Natur Ideel- les zugrunde liegt. Schön sind dann Naturphänomene, in denen jener ideelle Grund der Natur durchscheint. Das Erfassen von Ideellem scheint ein Privileg geistiger Wesen zu sein. Dem stehen evolutionsbiologische Argumente entgegen, die dem Schönen einen positiven Selektionswert, etwa bei der sexuellen (...) Partnerwahl, zusprechen. Auch der Mensch hat stammesgeschichtliche Wurzeln, die in ihm weiter wirken. Doch sobald der Geist auf der evolutionären Bühne erscheint, herrscht das Biologische nicht länger mit der uneingeschränkten Macht, die es im Rahmen natürli- cher Selektion hat. Hegels Deutung des Schönen, auch des Naturschönen, ist wesentlich bezogen auf den Geist. Ich verdeutliche dies an einigen Exempeln (Schneekristall, musikalische Harmonie, Abendhimmel, Ge- birgslandschaft, organische Blüten- und Körperformen). Aber wodurch sind Naturschönheit und Kunstschönheit dann voneinander unterschie- den? Die Hervorbringungen der Natur sind lediglich Zufallskonstellatio- nen. Allerdings, so Hegel, hat der Zufall es ‘recht’ gemacht, d.h. hat er etwas reizend Stimmiges gefügt, gewahrt der Geist darin das im Sinnli- chen durchscheinende Ideelle. Eben darin wird, mit Adorno gesprochen, die gemeinsame Wurzel des Kunstschönen und des Naturschönen erkennbar. Wer das Naturschöne preist, begebe sich „an den Rand der Afterpoe- sie“, des Kitsches, meint Adorno. Gleichwohl sei es wahr zu sagen, „die Landschaft der Toscana sei schöner als die Umgebung von Gelsenkirchen“ (Adorno 1993, 110, 112). In der Tat. Doch was meinen wir, wenn wir Landschaften, Blumen, Sonnenuntergänge ‘schön’ nennen, und welche Kriterien bringen wir dafür in Anschlag? Im Folgenden möchte ich darle- gen, inwiefern Hegels Charakterisierung des Schönen als „das sinnliche Scheinen der Idee“ diesbezüglich erhellend und klärend ist. Hinweise auf Adornos ästhetische Theorie ergänzen diese Überlegungen. Dem stehen evolutionsbiologische Argumente entgegen, die zunehmend Einfluss auf die ästhetische Diskussion gewinnen. (shrink)

This paper is focused on F. W. J. Schelling's view of freedom during the period of the Freiheitsschrift (1809) and related works. It is argued that the standard way this has been understood may be too simplistic. On this standard interpretation of his view, evil is made a matter of free choice by the agent, but where the choice does not concern individual actions, but the choice of the agent's essence in an atemporal act. As a result of this choice, (...) it is argued, Schelling can then make evil imputable. By contrast, I argue that for Schelling freedom does not involve choice, but necessity, but in a way that is still internal to the agent and hence non-coercive, and thus in a way that remains free and makes evil imputable. How Schelling comes to have this view is considered, and some responses are given to ways it might be challenged both interpretatively and philosophically. (shrink)

Dass Kunst Sinnliches zu vergeistigen und Geistiges zu versinnlichen vermag, macht ihren Wesenskern und zugleich Rätselcharakter aus. Dass dieses Rätsel immer erneut als unaufgelöst erscheint, bedeutet auch, dass eine fortdauernde Irritation von Kunst ausgeht. Das Bestürzende der Kunst ist dies, dass sie den scheinbar unversöhnlichen Gegensatz des Geistigen und Sinnlichen zugleich als versöhnt erscheinen lässt: als Ver-Sinnlichung von Ideellem. Hegels These, dass die Kunst, eben durch diese Bindung an Sinnliches, 'ihrer eigentlichen Bestimmung nach für uns ein Vergangenes' sei, erscheint so (...) gesehen problematisch. Hat die geistesgeschichtliche Entwicklung die Kunst ihrer Irrelevanz überführt im Vergleich mit den nach Hegel höheren Formen des Geistigen, der Religion und der Philosophie? Entscheidend ist die Bewertung des sinnlichen Elements – dies näher zu klären wird hier in der Konfrontation der Hegelschen These mit den Kunstdeutungen Heideggers und Adornos unternommen. (shrink)

The nature of Hegel’s idealism has been much disputed, and this chapter offers an account of it that is distinctive. Against recent commentators such as Robert Pippin, it is argued that Hegel was not a Kantian or transcendental idealist; it is also argued that Hegel was not a mentalistic idealist, offering a kind of ‘spirit monism’ that reduced the world to mind. It is argued instead that Hegel understood idealism to be the view that ‘the finite has no veritable being’, (...) where this leads to a position according to which thought cannot grasp what truly exists through experience but only through a kind of rationalist theorizing, and that this in turn requires us to accept a form of realism about concepts. It is therefore argued that this conceptual realism makes up the core of Hegel’s idealism, understood as the anti-nominalist doctrine that reality is structured by concepts that render it accessible to thought. Why is social bias and its depressing effects on low-status or low-performing groups exaggerated? We show that the higher intelligence of academics has at best a very weak effect on reducing their bias, facilitates superficially justifying their biases, and may make them better at understanding the benefits of social conformity in general and competitive altruism specifically. We foresee a surge in research examining these mechanisms and recommend, meanwhile, reviving and better observing scientific ideals.

Adapting a terminology introduced by Brian Barry, I make a distinction between want-regarding and ideal-regarding principles and apply it to the norms and criteria put forward in environmental ethics. I argue that priority should be given to want-regarding principles over ideal-regarding ones because the former are universalizable while the latter are not, universalizable being understood in the sense ofappealing to value premises for which universal assent can be secured. This sense is different both from R. M. Hare's metaethical concept of (...) universalizability and J. L. Mackie’s “three stages of universalisation.”. (shrink)

Growing from the author's matrix operator formalization of logic, this work pursues a synthesis of physics and logic methods, leading to the development of the concept of infophysics. The experimental verification of the proposed quantum hypothesis of the brain is presently in preparation in cooperation with the Cavendish Laboratory, Cambridge, UK, and, if proved positive, would have major theoretical implications. Even more significant should be the practical applications in such fields as molecular electronics and computer science, biophysics and neuroscience, medicine and education. The new possiblities that could be opened up by quantum level computing could be truly revolutionary. The book aims at researchers and engineers in technical sciences as well as in biophysics and biosciences in general. Did Wittgenstein consider himself a Jew? Should we? Wittgenstein repeatedly wrote about Jews and Judaism in the 1930s, and biographical studies make it clear that this writing about Jewishness was a way in which he thought about the kind of person he was and the nature of his philosophical work. Those who have written about Wittgenstein on the Jews have drawn very different conclusions. But much of this debate is confused, because the notion of being a Jew, of Jewishness, is (...) itself ambiguous and problematic. The paper provides a close reading of leading passages in which Wittgenstein discusses Jews and Jewishness, and argues that previous interpreters have been too quick to condemn or defend him. If we consider what it could mean to say that Wittgenstein was, or was not, a Jew, we will see that Wittgenstein's problems with 'Jewishness' arise out of the philosophically problematic nature of the concept, a philosophical problem he was unable to resolve. The present paper focuses on the sociological model of man (also denoted as homo sociologicus or normative paradigm). It is discussed to what extent three problems limit its explanatory value: (1) behavior which is not normatively regulated and (2) behavior deviating from norms cannot be explained. (3) In case of norm conflicts it cannot be explained which of the normative expectations is followed. It is further discussed to what extent another model of man - which is called the “utilitarian”, “economic” (...) or rational choice model - is able to solve these problems. It is shown that the sociological model in fact consists of two different “utilitarian” models with very restrictive assumptions. Some of the problems of the sociological model are demonstrated by applying it to a well-known theory of role conflict. In the final section we discuss some consequences of the sociological model for the utilitarian approach. (shrink)
