In this article, a paediatrician responsible for the paediatric hospital ofthe University ofTübingen, discusses the importance of ethical consultations in daily clinical practice. Unlike in the USA, where there are two kinds of institutional ethical advice (Ethical Review Boards take care of fundamental questions concerning medical research and Ethical Commitees handle problems which occur in medical practice), Germany's hospitals have only established Ethikkommissionen which deal with research involving human cell material, but no discussion boards for ethical issues relating to normal (...) medical treatment. The author describes the ad hoc consultations in bis hospital in which doctors and nursing staff can discuss those problems, from their own point of view, without either diminishing the physicians 's responsibility or patronizing the patient. The Christian does not live in a vacuum, says the author, but in a world of government, politics, labor, and marriage. Hence, Christian ethics cannot exist in a vacuum what the Christian needs, claims Dietrich Bonhoeffer, is concrete instruction in a concrete situation. Although the author died before completing his work, this book is recognized as a major contribution to Christian ethics. The root and ground of Christian ethics, the author says, is the reality of God as revealed in (...) Jesus Christ. This reality is not manifest in the Church as distinct from the secular world such a juxtaposition of two separate spheres, Bonhoeffer insists, is a denial of God's having reconciled the whole world to himself in Christ. On the contrary, God's commandment is to be found and known in the Church, the family, labor, and government. His commandment permits man to live as man before God, in a world God made, with responsibility for the institutions of that world. (shrink)

The widely discussed "discursive dilemma" shows that majority voting in a group of individuals on logically connected propositions may produce irrational collective judgments. We generalize majority voting by considering quota rules, which accept each proposition if and only if the number of individuals accepting it exceeds a given threshold, where different thresholds may be used for different propositions. After characterizing quota rules, we prove necessary and sufficient conditions on the required thresholds for various collective rationality requirements. We also consider sequential (...) quota rules, which ensure collective rationality by adjudicating propositions sequentially and letting earlier judgments constrain later ones. Sequential rules may be path-dependent and strategically manipulable. We characterize path-independence and prove its essential equivalence to strategy-proofness. Our results shed light on the rationality of simple-, super-, and sub-majoritarian decision-making. (shrink)

Why do some donor governments pursue international development through recipient governments, while others bypass such local authorities? Weaving together scholarship in political economy, public administration and historical institutionalism, Simone Dietrich argues that the bureaucratic institutions of donor countries shape donor–recipient interactions differently despite similar international and recipient country conditions. Donor nations employ institutional constraints that authorize, enable and justify particular aid delivery tactics while precluding others. Offering quantitative and qualitative analyses of donor decision-making, the book illuminates how donors with (...) neoliberally organized public sectors bypass recipient governments, while donors with more traditional public-sector-oriented institutions cooperate and engage recipient authorities on aid delivery. The book demonstrates how internal beliefs and practices about states and markets inform how donors see and set their objectives for foreign aid and international development itself. It informs debates about aid effectiveness and donor coordination and carries implications for the study of foreign policy, more broadly. (shrink)

One of the key challenges confronting cognitive science is to discover natural categories of cognitive function. Of special interest is the unity or diversity of cognitive control mechanisms. Evolutionary history is an underutilized resource that, together with neuropsychological and neuroscientific evidence, can help to provide a biological ground for the fractionation of cognitive control. Comparative evidence indicates that primate brain evolution has produced dissociable mechanisms for external action control and internal self-regulation, but that most real-world behaviors rely on a combination (...) of these. The archeological record further indicates the timing and context of distinctively human elaborations to these cognitive control functions, including the gradual emergence of increasingly complex hierarchical action control. I propose a relevance-based independence axiom on how to aggregate individual yes/no judgments on given propositions into collective judgments: the collective judgment on a proposition depends only on people’s judgments on propositions which are relevant to that proposition. This axiom contrasts with the classical independence axiom: the collective judgment on a proposition depends only on people’s judgments on the same proposition. I generalize the premise-based rule and the sequential-priority rule to an arbitrary priority order of the propositions, instead of a (...) dichotomous premise/conclusion order resp. a linear priority order. I prove four impossibility theorems on relevance-based aggregation. One theorem simultaneously generalizes Arrow’s Theorem (in its general and indifference-free versions) and the well-known Arrow-like theorem in judgment aggregation. (shrink)

Transcendental Pragmatics and Discourse Ethics. Elements and Perspectives of Apel's Discourse-Philosophy. The author follows Apel's intellectual biography and shows the conception of a critique of meaning qua ‘reflection upon the discourse within the discourse’ to be the centre of Apel's language-pragmatic ‘Transformation of Philosophy’. Beginning with an explication of the situation of a speaker/thinker, especially of the situation of a philosophising speaker/thinker, Apel reconstructs a two fold apriori of communication: Every thought is situated within the context of a particular, historically (...) evolved, community of language and interaction. At the same time, however, the validity-claims of thoughts transcend the context of their origin towards an unlimited community of argumentation. On the basis of the first apriori Apel criticises the methodical solipsism as well as the objectivism of modern philosophy and theory of science. Drawing upon the second apriori he develops a universalist critique of meaning of relativism and contextualism. In the sixties and seventies Apel worked out a differentiated theory of the – more or less – communicatively cognizing humanities and set it apart from the theory of the causal-explanatory natural sciences, thus challenging the objectivism of a Theory of Unified Science. Building upon this work Transcendental Pragmatics, as developed by Apel and others, sets philosophy primarily two tasks: firstly, a internal reconstruction of argumentative discourse as the situation of speech and thought which seeks to elucidate the conditions of the meaningfulness, i. e. the presuppositions, of discourse. These presuppositions comprise, thus Apel with Habermas, the four validity-claims to intelligibility, sincerety/credibility, truth and normative rightness/legitimacy. Their moral content consists, thus Apel, not only in the recognition of the equality of all beings capable of discursive reasoning but also in their recognition of a co-responsibility for the realizability of discourses and of responsibility. The author argues that the existence of a co-responsibility of this kind is indisputable because the discursive claims to validity are intertwined with a set of ‘primordial promises of dialogue’. Only with the elucidation and explication of these promises can the reconstruction of the internal conditions of discourse be completed.The second task of a pragmatics of argumentation isthe strict resp. actual reflection of the thinker upon the presuppositions of the discourse in which he currently engages. This reflection has a Socratic character and can only be done in the form of discussion and debate with critics of the reconstruction. In this context, the author proposes a method of Socratic reflection upon the presuppositions of dialogue which suspends the usual, theoretically oriented, attitude of the scientist and the philosopher in favour of an actual reflective attitude. Within a dialogue with a sceptic who doubts one of the results of the internal reconstruction of dialogical presuppositions, say X, it is tested whether his doubt as to the unrestricted validity of X can be understood as a sincere contribution to the current dialogue or whether this particular sceptical thesis does not make sense, because it is incompatible with the role of a sincere participant of argumentation which, after all, the sceptic cannot refuse to claim for himself.Finally the author explains Apel's characterization of the tension between “Discourse and Responsibility”. In the course of discussions with Max Weber, Lawrence Kohlberg, Hans Jonas et al., Apel formulates and justifies an ethics of responsibility and gives an affirmative answer to the crucial question of whether the fulfilment of the moral obligations connected with the recognition of co-responsibility can be demanded within the non-dialogical circumstances of social reality. Apel's answer employs the idea of counter-strategies which are morally legitimate in virtue of their being worthy of argumentative consensus. (shrink)

: Where there are cases of underdetermination in scientific controversies, such as the case of the molecular clock, scientists may direct the course and terms of dispute by playing off the multidimensional framework of theory evaluation. This is because assessment strategies themselves are underdetermined. Within the framework of assessment, there are a variety of trade-offs between different strategies as well as shifting emphases as specific strategies are given more or less weight in assessment situations. When a strategy is underdetermined, scientists (...) can change the dynamics of a controversy by making assessments using different combinations of evaluation strategies and/or weighting whatever strategies are in play in different ways. Following an underdetermination strategy does not end or resolve a scientific dispute. Consequently, manipulating underdetermination is a feature of controversy dynamics and not controversy closure. There are many possible ways to approach the topic of educational theory and critique. One could inquire into the meaning of critical phenomena and subject-matter in practical education and instruction, investigate the various forms of critique with the goal of determining the extent to which they assist in clarifying pedagogical action, or one could ask: ‘What is meant by critical educational research?’ and ‘How do the various approaches to this topic relate to one another?’. This article inquires into the relationship (...) between critique and negativity. Such a distinction is relevant for the practical, theoretical and research-oriented use of the various forms and subject matters of critique. This analysis of their relationship aims to clarify how the structure of human learning connects to that of pedagogical action; and, additionally, how the theoretical guidelines and orientation for pedagogical action relate to scientific analyses and research in education in a way that is productive. Distinctions made in thought, judgement and action are not simply delimiting positive characteristics. Such distinctions are at once mediated by the relations of knowledge and ignorance, ability and inability. Although ignorance and inability can be transformed into positive knowledge and ability, they are not superseded in the process. Ignorance and inability are, on the contrary, constitutive elements of learning. The possibility for transitions from ignorance and inability to knowledge and ability—a possibility that itself presupposes knowledge and ability—point to a form of negativity within the process of education (Bildung). This form of negativity relates to the human ability to learn (Bildsamkeit) and provides the definitive basis of human learning. A form of negativity constitutive of learning processes leads to one that grounds pedagogical processes. Pedagogical efficacy is mediated by a double negativity, comprised of both a universal and a particular form of negativity. The relation of negativity to learning and pedagogical efficacy, with specific reference to educational research studies on teaching and learning processes, is considered. A form of educational research that operates beyond fundamentalist criticisms—that is to say, criticisms based on unshakeable beliefs—and utilises issues arising from a pluralisation of critique to confront the pluralism of critical positions, is considered. While the importance of social norms for shaping and transforming communities is uncontested, their nature and normativity are controversial. Most recent theorists take social norms to arise if members hold certain attitudes, such as expectations on others, perhaps along with certain behaviours. Yet attitudes do not create norms, let alone social norms or social normativity. Social norms are instead ‘made’: through a social process. Social norming processes are special communication processes, often non-verbal and informal. We present different versions of a (...) process-based account of social norms and social normativity. The process-based view brings social norms closer to legal norms, as processes represent social ‘acts’, just as laws and contracts arise through acts rather than mere attitudes, for instances acts of voting or signing. This article offers three contrasting cases of the use of neutrality and drift in molecular evolution. In the first, neutrality is assumed as a simplest case for modeling. In the second and third, concepts of drift and neutrality are developed within the context of population genetics testing and the development and application of the molecular clock.

All existing impossibility theorems on judgment aggregation require individual and collective judgment sets to be consistent and complete, arguably a demanding rationality requirement. They do not carry over to aggregation functions mapping profiles of consistent individual judgment sets to consistent collective ones. We prove that, whenever the agenda of propositions under consideration exhibits mild interconnections, any such aggregation function that is "neutral" between the acceptance and rejection of each proposition is dictatorial. We relate this theorem to the literature.

It is the central hypothesis of this paper that the mental states commonly referred to as altered states of consciousness are principally due to transient prefrontal cortex deregulation. Supportive evidence from psychological and neuroscientific studies of dreaming, endurance running, meditation, daydreaming, hypnosis, and various drug-induced states is presented and integrated. It is proposed that transient hypofrontality is the unifying feature of all altered states and that the phenomenological uniqueness of each state is the result of the differential viability of various (...) frontal circuits. Using an evolutionary approach, consciousness is conceptualized as hierarchically ordered cognitive function. Higher-order structures perform increasingly integrative functions and thus contribute more sophisticated content. Although this implies a holistic approach to consciousness, such a functional hierarchy localizes the most sophisticated layers of consciousness in the zenithal higher-order structure: the prefrontal cortex. The hallmark of altered states of consciousness is the subtle modification of behavioral and cognitive functions that are typically ascribed to the prefrontal cortex. The theoretical framework presented yields a number of testable hypotheses. (shrink)

Chalmers' anti-materialist arguments are an interesting twist on a well-known argument form, and his naturalistic dualism is exciting to contemplate. Nevertheless, we think we can save materialism from the Chalmerian attack. This is what we do in the present paper.

Am Beispiel der Norm, dass Schmerzen zu lindern seien, und mit Hilfe eines allgemeinen Modells ethischer Urteilsbildung werden verschiedene Bedeutungen der Anwendung und der Kontextsensitivität unterschieden und es wird untersucht, welche Rolle deskriptive Annahmen hierbei jeweils spielen können. Richard Goldschmidt was one of the most controversial biologists of the mid-twentieth century. Rather than fade from view, Goldschmidt's work and reputation has persisted in the biological community long after he has. Goldschmidt's longevity is due in large part to how he was represented by Stephen J. Gould. When viewed from the perspective of the biographer, Gould's revival of Goldschmidt as an evolutionary heretic in the 1970s and 1980s represents a selective reinvention of Goldschmidt that provides a contrast to other (...) kinds of biographical commemorations by scientists. Ever since the Harsanyi-Sen debate, it is controversial whether someone's welfare should be measured by her von-Neumann-Morgenstern (VNM) utility, for instance when analysing welfare intensity, social welfare, interpersonal welfare comparisons, or welfare inequality. We prove that natural working hypotheses lead to a different welfare measure. It addresses familiar concerns about VNM utility, by faithfully capturing non-ordinal welfare features such as welfare intensity, despite resting on purely ordinal evidence such as revealed preferences or self-reported welfare comparisons. Using this welfare measure instead (...) of VNM utility alters social welfare analysis -- for instance, Harsanyi's `utilitarian theorem' now effectively supports prioritarianism. VNM utility is shown to be a hybrid object, determined by an interplay of two factors: welfare and attitude to intrinsic risk, i.e., to risk in welfare rather than outcomes. (shrink)

Group decisions must often obey exogenous constraints. While in a preference aggregation problem constraints are modelled by restricting the set of feasible alternatives, this paper discusses the modelling of constraints when aggregating individual yes/no judgments on interconnected propositions. For example, court judgments in breach-of-contract cases should respect the constraint that action and obligation are necessary and sufficient for liability, and judgments on budget items should respect budgetary constraints. In this paper, we make constraints in judgment aggregation explicit by relativizing the (...) rationality conditions of consistency and deductive closure to a constraint set, whose variation yields more or less strong notions of rationality. This approach of modelling constraints explicitly contrasts with that of building constraints as axioms into the logic, which turns compliance with constraints into a matter of logical consistency and thereby conflates requirements of ordinary logical consistency (such as not to affirm both a proposition and its negation) and requirements dictated by the environment (such as budgetary constraints). We present some general impossibility results on constrained judgment aggregation; they are immediate corollaries of known results on (unconstrained) judgment aggregation. (shrink)

We present an abstract model of rationality that focuses on structural properties of attitudes. Rationality requires coherence between your attitudes, such as your beliefs, values, and intentions. We define three 'logical' conditions on attitudes: consistency, completeness, and closedness. They parallel the familiar logical conditions on beliefs, but contrast with standard rationality conditions like preference transitivity. We establish a formal correspondence between our logical conditions and standard rationality conditions. Addressing John Broome's programme 'rationality through reasoning', we formally characterize how you can (...) (not) become more logical by reasoning. Our analysis connects rationality with logic, and enables logical talk about multi-attitude psychology. (shrink)

John Broome has developed an account of rationality and reasoning which gives philosophical foundations for choice theory and the psychology of rational agents. We formalize his account into a model that differs from ordinary choice-theoretic models through focusing on psychology and the reasoning process. Within that model, we ask Broome’s central question of whether reasoning can make us more rational: whether it allows us to acquire transitive preferences, consistent beliefs, non-akratic intentions, and so on. We identify three structural types of (...) rationality requirements: consistency requirements, completeness requirements, and closedness requirements. Many standard rationality requirements fall under this typology. Based on three theorems, we argue that reasoning is successful in achieving closedness requirements, but not in achieving consistency or completeness requirements. We assess how far our negative results reveal gaps in Broome's theory, or deficiencies in choice theory and behavioral economics. (shrink)

Behaviourism is the view that preferences, beliefs, and other mental states in social-scientific theories are nothing but constructs re-describing people's behaviour. Mentalism is the view that they capture real phenomena, on a par with the unobservables in science, such as electrons and electromagnetic fields. While behaviourism has gone out of fashion in psychology, it remains influential in economics, especially in ‘revealed preference’ theory. We defend mentalism in economics, construed as a positive science, and show that it fits best scientific practice. (...) We distinguish mentalism from, and reject, the radical neuroeconomic view that behaviour should be explained in terms of brain processes, as distinct from mental states. (shrink)

Replicating or exceeding human intelligence, not just in particular domains but in general, has always been a major goal of Artificial Intelligence (AI). We argue here that “human intelligence” is not only ill-defined, but often conflated with broader aspects of human psychology. Standard arguments for replicating it are morally unacceptable. We then suggest a reframing: that the proper goal of AI is not to replicate humans, but to complement them by creating diverse intelligences capable of collaborating with humans. This goal (...) renders issues of theory of mind, empathy, and caring, or community engagement, central to AI. It also challenges AI to better understand the circumstances in which human intelligence, including human moral intelligence, fails. (shrink)

This paper offers an explanation for why some parts of philosophy have made no progress. Philosophy has made no progress because it cannot make progress. And it cannot because of the nature of the phenomena philosophy is tasked with explaining—all of it involves consciousness. Here, it will not be argued directly that consciousness is intractable. Rather, it will be shown that a specific version of the problem of consciousness is unsolvable. This version is the Problem of the Subjective and Objective. (...) Then it is argued that the unsolvability of this latter problem is why there are other unsolvable philosophy problems. (shrink)

Comparative approaches to language evolution are essential but cannot by themselves resolve the timing and context of evolutionary events since the last common ancestor with chimpanzees. Archaeology can help to fill this gap, but only if properly integrated with evolutionary theory and the ethnographic, ethological, and experimental analogies required to reconstruct the broader social, behavioral, and neurocognitive implications of ancient artifacts. The current contribution elaborates a technological pedagogy hypothesis of language origins by developing the concept of an evolving human technological (...) niche and applying it to investigate two key transitions posited by Arbib’s Mirror System Hypothesis: from complex action recognition and imitation to proto-language, and from proto-language to language.
