The purpose of this article is to advance a new understanding of gender as a routine accomplishment embedded in everyday interaction. To do so entails a critical assessment of existing perspectives on sex and gender and the introduction of important distinctions among sex, sex category, and gender. We argue that recognition of the analytical independence of these concepts is essential for understanding the interactional work involved in being a gendered person in society. Humans, more than any other species, have been altering their paths of development by creating new material forms and by opening up to new possibilities of material engagement. That is, we become constituted through making and using technologies that shape our minds and extend our bodies. We make things which in turn make us. This ongoing dialectic has long been recognised from a deep-time perspective. It also seems natural in the present in view of the ways new materialities and digital (...) ecologies increasingly envelop our everyday life and thinking. Still the basic idea that humans and things are co-constituted continues to challenge us, raising important questions about the place and meaning of materiality and technical change in human life and evolution. This paper bridging perspectives from postphenomenology and Material Engagement Theory is trying to attain better understanding about these matters. Our emphasis falls specifically on the human predisposition for technological embodiment and creativity. We re-approach the notion Homo faber in a way that, on the one hand, retains the power and value of this notion to signify the primacy of making or creative material engagement in human life and evolution and, on the other hand, reclaims the notion from any misleading connotations of human exceptionalism. In particular, our use of the term Homo faber refers to the special place that this ability has in the evolution and development of our species. The difference that makes the difference is not just the fact that we make things. The difference that makes the difference is the recursive effect that the things that we make and our skills of making seem to have on human becoming. We argue that we are Homo faber not just because we make things but also because we are made by them. (shrink)

What is commonly known as the Copenhagen interpretation of quantum mechanics, regarded as representing a unitary Copenhagen point of view, differs significantly from Bohr's complementarity interpretation, which does not employ wave packet collapse in its account of measurement and does not accord the subjective observer any privileged role in measurement. It is argued that the Copenhagen interpretation is an invention of the mid‐1950s, for which Heisenberg is chiefly responsible, various other physicists and philosophers, including Bohm, Feyerabend, Hanson, and Popper, having (...) further promoted the invention in the service of their own philosophical agendas. This paper examines the content of the Watson-Glaser Critical Thinking Appraisal exam. (1980) Our report is not a statistical review. We find the content of this exam defective in a number of areas. The exam consists of five “tests” of 16 questions for a total of 80 questions. Of these, we cannot recommend test 1, test 2, test 4, and test 5; and, we cannot recommend questions 4, 5, 14, 16,37, 45, 60, 63, 64, 65, 66, and 67. As shown (...) in this report, the exam creates confusion and makes basic errors in critical thinking in a number of areas, and therefore, lacks content quality in these areas, Hence, no statistical results pertaining to the administration of these areas to students can be informative. We find the remaining areas acceptable as to content. But until the problems are corrected, we can only recommend that those who may use the exam remove the defective parts from test administration or from data collection and reporting. We recommend the former, because of the wasted time involved in the latter. This would amount to administering only 14 questions, i.e. test 3 with questions 37 and 45 eliminated.We also find the scope of the exam to be quite limited, but allow that this may be unavoidable for any instrument designed to be completed in about an hour. We further recommend the use of several tests, rather than one; and, that any such results be understood only as a measure of minimal competency (below which remediation likely is needed) for the skills tested, but not as an adequate measure of critical thinking. This essay presents a critical analysis of Sen's theory of human rights. I pay particular attention to his attack on Jeremy Bentham's denunciation of natural rights and the charge that preexisting universal rights are without foundation. I begin by providing some context for understanding Sen's approach to the debate about human rights. I then present a brief overview of rights theory and define the important terms, and also present Bentham's understanding of the 'foundational problem' and why he regards it as (...) a dangerous problem. I offer a short overview of the human rights movement that covers its progress since Bentham's time. I then present a critique of Sen's defense of human rights and conclude that Sen's efforts to invalidate Bentham do not succeed. Bentham's contribution to the debate over human rights remains relevant. (shrink)

Pierre Duhem's often unrecognized influence on twentieth-century philosophy of science is illustrated by an analysis of his significant if also largely unrecognized influence on Albert Einstein. Einstein's first acquaintance with Duhem's La Théorie physique, son objet et sa structure around 1909 is strongly suggested by his close personal and professional relationship with Duhem's German translator, Friedrich Adler. The central role of a Duhemian holistic, underdeterminationist variety of conventionalism in Einstein's thought is examined at length, with special emphasis on Einstein's deployment (...) of Duhemian arguments in his debates with neo-Kantian interpreters of relativity and in his critique of the empiricist doctrines of theory testing advanced by Schlick, Reichenbach, and Carnap. Most striking is Einstein's 1949 criticism of the verificationist conception of meaning from a holistic point of view, anticipating by two years the rather similar, but more famous criticism advanced independently by Quine in Two Dogmas of Empiricism. What is Albert Einstein’s place in the history of twentieth-century philosophy of science? Were one to consult the histories produced at mid-century from within the Vienna Circle and allied movements (e.g., von Mises 1938, 1939, Kraft 1950, Reichenbach 1951), then one would find, for the most part, two points of emphasis. First, Einstein was rightly remembered as the developer of the special and general theories of relativity, theories which, through their challenge to both scientific and philosophical orthodoxy made vivid the (...) need for a new kind of empiricism (Schlick 1921) whereby one could defend the empirical integrity of the theory of relativity against challenges 1 coming mainly from the defenders of Kant. Second, the special and general theories of relativity were wrongly cited as straightforwardly validating central tenets of the logical empiricist program, such as verificationism, and Einstein was wrongly represented as having, himself, explicitly endorsed those same philosophical principles. As we now know, logical empiricism was not the monolithic philosophical movement it was once taken to have been. Those associated with the movement disagreed deeply about fundamental issues concerning the structure and interpretation of scientific theories, as in the protocol sentence debate, and about the overall aims of the movement, as in the debate between the left and right wings 2 of the Vienna Circle over the role of politics in science and philosophy. Along with such differences went subtle differences in the assessment of Einstein’s legacy to logical empiricism. The ethical issues in conducting research on preventing HIV infection are among the most complex of any area of human subjects research. This article is an update of a 1987 article that addressed potential conflicts between research design and ethics with respect to AIDS prevention among injecting drug users. The present article reviews current ethical issues that arise in the design and conduct of HIV/AIDS prevention research focused on injecting drug users.

This commentary suggests an alternate definition for metacognition, as well as an alternate basis for the relation in representation. These together open the way for an understanding of mindreading that is significantly different from the one advocated by Carruthers.

Bayesians take “definite” or “single-case” probabilities to be basic. Definite probabilities attach to closed formulas or propositions. We write them here using small caps: PROB(P) and PROB(P/Q). Most objective probability theories begin instead with “indefinite” or “general” probabilities (sometimes called “statistical probabilities”). Indefinite probabilities attach to open formulas or propositions. We write indefinite probabilities using lower case “prob” and free variables: prob(Bx/Ax). The indefinite probability of an A being a B is not about any particular A, but rather about the (...) property of being an A. In this respect, its logical form is the same as that of relative frequencies. For instance, we might talk about the probability of a human baby being female. That probability is about human babies in general — not about individuals. If we examine a baby and determine conclusively that she is female, then the definite probability of her being female is 1, but that does not alter the indefinite probability of human babies in general being female. Most objective approaches to probability tie probabilities to relative frequencies in some way, and the resulting probabilities have the same logical form as the relative frequencies. That is, they are indefinite probabilities. The simplest theories identify indefinite probabilities with relative frequencies.3 It is often objected that such “finite frequency theories” are inadequate because our probability judgments often diverge from relative frequencies. For example, we can talk about a coin being fair (and so the indefinite probability of a flip landing heads is 0.5) even when it is flipped only once and then destroyed (in which case the relative frequency is either 1 or 0). Cosmopolitanism is often adrift in a sea of interpretations. As such, it is frequently conflated with related terms like globalism, multiculturalism, and internationalism, just as it is unfittingly juxtaposed with concepts like nationalism and patriotism. Cosmopolitanism thus risks becoming a concept so fluid as to lose all meaning. While cosmopolitanisms’ conceptual ambiguity and definitional fluidity has provided inspiration for over two millennia of debate, it has also contributed to the lack of a grounded and accessible conceptual framework from which today’s (...) students, educators, and cosmopolitanism-minded practitioners can build. This article seeks to address that deficit by introducing an original conceptual framework from which modern cosmopolitanism, as an ethical project, might be succinctly identified, understood, and evaluated. This framework forwards that modern notions of cosmopolitanism rest on three primary pillars: respect, responsibility, and rootedness, each of which must be simultaneously realized for cosmopolitanism to exist. In the cosmopolitan context, respect prioritizes unconditional respect for free rational beings even as it conditionally assesses how cultural practices uplift the individual. Concurrently, cosmopolitan responsibility is recognizing and fulfilling one’s inexorable moral obligation to others. Finally, cosmopolitan rootedness is creating and maintaining conditions where social justice and human flourishing may thrive within one’s own traditions, cultures(s), and society. (shrink)

This article aims to explain the declining efficacy of California’s Agricultural Labor Relations Act over the past quarter century. It argues that the origins, terms, and outcomes of the Act emerged from an interplay between state and society: between the capacity of the state to initiate and implement social reform policy and the capacities of key social classes to tilt outcomes to their benefit. In contrast to both “state-centered” and “society-centered” views of the relationship among social classes, state structures, and (...) public policies, an historical-institutional theoretical frame reveals that social forces and political institutions are reciprocally constitutive, and that policy outcomes emerge from their interaction. Whereas labor union decline and policy failure are usually attributed to shifts in the political climate, in this case shifts in class leverage effected by the strategic choices of the farm labor union movement were at certain points more influential. Alternative displays of effect size statistics can enhance the understandability and impact of validity evidence in a variety of applied settings. Arguably, the proliferation of alternative effect size statistics has been limited due to the lack of user-friendly tools to create them. Common statistical packages do not readily produce these alternative effect sizes and existing tools are outdated and inaccessible. In this paper, I introduce a free-to-use web-based calculator (https://dczhang.shinyapps.io/expectancyApp/) for generating alternative effect size displays from empirical data. This calculator (...) requires no mathematical or programming expertise, and therefore, is ideal for academics and practitioners. I also present results from an empirical study that demonstrates the benefits of alternative effect size displays for enhancing lay people’s perceived understandability of validity information and attitudes toward the use of standardized testing for college admissions. Environmental holism has been accused of being totalitarian because it subsumes the interests and rights of individuals under the good of the whole biosphere, thus rejecting humanistic ethics. Whether this is true depends on the type of holism in question. Only an extreme form of holism leads to this totalitarian approach, and that type of holism should be rejected, not alone because it leads to unacceptable practices, but because it is too abstract and reductionistic to be an adequate basis for (...) ethics.
