Se apuesta por una reforma a la Carta, la que actualmente opera fuera de los fines de toda Constitución, (...) restringiendo la participación ciudadana. Particular atención merecen las manifestaciones que tienen lugar hoy y que reflejan cómo el régimen constitucional impide poner sobre la mesa de discusión con el Gobierno un ideal de educación que abandone una democracia instrumental y que recoja principios republicanos. The generation of evidence is integral to the work of public health and health service providers. Traditionally, ethics has been addressed differently in research projects, compared with other forms of evidence generation, such as quality improvement, program evaluation, and surveillance, with review of non-research activities falling outside the purview of the research ethics board. However, the boundaries between research and these other evaluative activities are not distinct. Efforts to delineate a boundary – whether on grounds of primary purpose, temporality, underlying (...) legal authority, departure from usual practice, or direct benefits to participants – have been unsatisfactory. BackgroundThe amount of research utilizing health information has increased dramatically over the last ten years. Many institutions have extensive biobank holdings collected over a number of years for clinical and teaching purposes, but are uncertain as to the proper circumstances in which to permit research uses of these samples. Research Ethics Boards (REBs) in Canada and elsewhere in the world are grappling with these issues, but lack clear guidance regarding their role in the creation of and access to registries and (...) biobanks.MethodsChairs of 34 REBS and/or REB Administrators affiliated with Faculties of Medicine in Canadian universities were interviewed. Interviews consisted of structured questions dealing with diabetes-related scenarios, with open-ended responses and probing for rationales. The two scenarios involved the development of a diabetes registry using clinical encounter data across several physicians' practices, and the addition of biological samples to the registry to create a biobank.ResultsThere was a wide range of responses given for the questions raised in the scenarios, indicating a lack of clarity about the role of REBs in registries and biobanks. With respect to the creation of a registry, a minority of sites felt that consent was not required for the information to be entered into the registry. Whether patient consent was required for information to be entered into the registry and the duration for which the consent would be operative differed across sites. With respect to the creation of a biobank linked to the registry, a majority of sites viewed biobank information as qualitatively different from other types of personal health information. All respondents agreed that patient consent was needed for blood samples to be placed in the biobank but the duration of consent again varied.ConclusionParticipants were more attuned to issues surrounding biobanks as compared to registries and demonstrated a higher level of concern regarding biobanks. As registries and biobanks expand, there is a need for critical analysis of suitable roles for REBs and subsequent guidance on these topics. The authors conclude by recommending REB participation in the creation of registries and biobanks and the eventual drafting of comprehensive legislation. (shrink)

There are broad commonalities between the projects of Donald MacKinnon (1913–1994) and Stanley Cavell (1926–) sufficient to make the claim that they struck an analogous pose in their respective contexts. This is not to discount their manifest differences. In the milieu of 1960s and 1970s Cambridge, MacKinnon argued in support of a qualified language of metaphysics in the service of a renewed catholic humanism and Christian socialism. At Harvard, Cavell articulated commitments that made him more at home in the (...) world of North American secular political liberalism. Where Nietzsche, Hume, Freud, Heidegger, Emerson and Thoreau were Cavell’s inspirations, Butler, Kant, G. E. Moore, Collingwood and the New Testament were MacKinnon’s. For all the stark differences, commonalities abound and the reason for this can be traced to a shared appreciation of Austin’s contribution to the ‘lingusitic turn’ together with Wittgenstein’s later work. They both developed projects obsessed with the problem of scepticism together with a commitment to a creative re-animation of moral discourse in light of it, with MacKinnon defending a qualified ‘moral realism’, and Cavell, ‘moral perfectionism’. Seen together, a distinctive post-Kantian and post-Wittgensteinian therapeutic moral philosophy is in evidence. (shrink)

Charles Hartshorne by manner of contrast has not had such a towering presence. Part of the reason this is the case is due to a paucity of introductory literature on the thought of Charles Hartshorne—literature that might contribute to a “starter kit” so to speak in mastering Hartshorne’s massive oeuvre. The Mind of Charles Hartshorne: A Critical Examination by Donald Wayne Viney and George W. Shields, both former students of Hartshorne and experts in process philosophy themselves, have authored a welcome contribution to an introductory literature that will most certainly elevate awareness of Hartshorne’s importance to its rightful place alongside that of Whitehead. The book is successful in its aims of “giving a reasonably comprehensive account of Hartshorne’s philosophy with an eye of presenting his best arguments...” (the “correcting what we see as misunderstandings of his views appearing in the critical literature” part may have been best left out) and “updating Hartshorne scholarship” (viii). There are ten chapters in total, appendix essays, the aforementioned bibliography, endnotes, and name and subject indexes.The Preface situates the mind of Charles Hartshorne as spanning the twentieth century and engaging metaphysics even when it was unfashionable to do so. Hartshorne thought about a wide-ranging and diverse range of subjects in both philosophy and science, aesthetics, metaphysics, applied philosophy, and theology. He never questioned modern science or evolution and believed that while metaphysics and empirical science have different methods each ensures its own way to objectivity. One learns that Hartshorne’s process metaphysics is also called “neo-classical” philosophy or speculative philosophy. His thought “gave full weight to the dynamic, relational, processive temporal and creative, affective dimensions of the universe” (vi). Hartshorne was known as much for his “panentheism,” or view that God transcends nature but also may be found immanently within it, as he was for his critique of traditional or scholastic classical theology—especially in his logic of theism where he recreates a modal version of the ontological argument. [End Page 94]Chapter 1, “The Career and Personality of Charles Hartshorne,” discusses just that. What seemed most important to me was the discussion of Hartshorne’s formative background of reading novels and poetry by Emerson, Melville, or Camus as a way of intensely living, his studying under William Ernest Hocking, and his Sheldon Traveling Fellowship where he studied for a time with Husserl and read and reviewed Heidegger. Probably the most important biographical details are that Hartshorne was given the assignment of editing the Peirce papers along with Paul Weiss as a Research Fellow while at Harvard University and he also met and graded for Whitehead, who along with C.S. Peirce, would become the twin pillars of all his thinking as a “Peircean and Whiteheadian” (11). From Peirce, we learn that Hartshorne took “possibility is best conceived of as a continuum with no least member” and from Whitehead, “actuality is discrete and discontinuous (atomistic), composed of momentary flashes of experiences” (11). For Hartshorne process and relativity are metaphysically basic.Chapter 2 begins with Hartshorne’s idea that, “Nature comes to us as constituted by feelings, not as constituted by lifeless, insentient matter” (28). Reality has an affective tone in which there is a layered complexity of feeling and social relation. In other words, contra Locke or Hume, feeling is objectively part of an objective affective continuum and is not nominalistically “painted on bare sense impressions” (46). Such might be described as a doctrine of “panexperientialism”— “the view that the basic constituents of reality are flashes of experience” (46). Experience and feeling stretch in their continuity to meet the bounds of nature. On the other hand, reference is more remote than truth from the evidence in behavior on which a radical theory of language must depend, since words refer only in the context of sentences, and it is sentences which are needed to promote human purposes. The solution which is proposed is to treat (...) reference as a theoretical construct whose sole function is to serve a theory of truth. Multinational corporations (MNCs) are the frequent target of nongovern-mental organizations (NGOs) in their advocacy efforts. In this article, the author examines NGO advocacy as it occurs in the NGO network and, using insights from the political science literature in conjunction with the resourcebased view of the firm, posits that NGO intranetwork conflict will result in a skewing of corporate social responsibility practices by the multinational corporation toward the MNC's developed country stakeholders. This skewing is a product of the asymmetric accountability (...) of NGOs (upwardly accountable to donors, downwardly accountable to recipients). The Forest Stewardship Council (FSC) is a global private governance system overseeing the sustainability and biodiversity of the world forestry system through certification of forests and forestry processes and products, and is perceived as the strongest of the various certification schemes available (Domask, Globalization and NGOs: Transforming Business, Government, and Society , 2003 ; Gulbrandsen, Global Environmental Politics , 2004 ). It has seen more success in developed than developing countries in terms of amount of forest certified and number of (...) chain-of-custody certificates issued, raising questions as to its ability to promote biodiversity Gulbrandsen, Global Environmental Politics , 2004 ). A number of challenges have risen to the pragmatic and moral legitimacy of the FSC as a global governance system: alternative certification schemes, output and market access, cost of certification, plantations, and illegal logging. I examine each of these challenges as they pertain to the dimensions of pragmatic and moral legitimacy of the FSC. I conclude with a discussion of theoretical implications for global governance systems using ecolabel schemes, as well as a discussion of practical implications for the FSC in particular. (shrink)

As the accompanying articles in the Special Issue on Semiotic Scaffolding will attest, my colleagues in biosemiotics have done an exemplary job in showing us how to think about the critically generative role that semiotic scaffolding plays “vertically” – i.e., in evolutionary and developmental terms – by “allowing access to the upper floors” of biological complexity, cognition and evolution.In addition to such diachronic considerations of semiotic scaffolding, I wish to offer here a consideration of semiotic scaffolding’s synchronic power, as well (...) – and in particular the ability that it can afford its users to access new and other sign relations “horizontally” as a function of the way that multiple semiotically scaffolded relations intertwine to result in a “definite semantic topology that determines the ways that symbols modify each other’s referential functions in different combinations”.Taking up, in turn, Terrence Deacon’s later challenge that what the sciences of cognition – and biology more generally – needs to “come to grips with [is] the process of semiosis; the dynamic of interpretive activity by which semiotic relationships emerge from other semiotic relationships [as] intrinsically dynamic phases in a generative process”, I attempt here to show how Deacon’s own Peirce-inspired matrix of referential sign relations as presented in The Symbolic Species, when viewed as a semiotic scaffold of interactional constraints and possibility biases, provides the key to understanding the essentially thirdness-manifesting nature of symbol reference, formation and growth. The author criticizes ways in which academic disciplines can be viewed as skewed toward bureaucratized intellect and its requirements and rewards, rather than toward scholarly intellectual life and research. Drawing from the Chicago traditions of sociology and philosophical pragmatism, as well as his own experience of them, Halton goes on to appraise ways in which these traditions have tended to become contracted to limited textbook canons. Donald Levine’s Visions of the Sociological Tradition provides a case in which the broad (...) influences of European intellectual traditions, for example, Nietzsche, are included in his sociological history of European sociological traditions, whereas similar influences, such as Ralph Waldo Emerson, Thorstein Veblen, Jane Addams, Lewis Mumford, or even C. Wright Mills, are excluded from his account of the American and Chicago traditions. Admitting that academic disciplines represent skewed forms of bureaucratized intellect rather than progressive traditions allows one to admit those who are not members of the club into the dialogue of social thought and the social sciences. In Riches and Poverty, Donald Winch explores the implications of a fundamental and influential idea in political economy. Adam Smith's science of the legislator provided a key to studying the rich and poor in commercial societies, transformed an ancient debate on luxury and inequality, and furnished a basis for assessing the American and French revolutions. Against this background, Britain embarked on its career as the first manufacturing nation, and Malthus made his first contributions to a debate which concluded with (...) the Poor Law Amendment Act of 1834. Malthus provoked fierce opposition from the Lake poets, opening an intellectual rift that persisted throughout the nineteenth century and continues to influence our perceptions of cultural history. This study seeks to examine the mechanisms by which a corporation’s use of philanthropy affects its reputation for corporate social performance (CSP), which the authors conceive of as consisting of two dimensions: CSP awareness and CSP perception. Using signal detection theory (SDT), the authors model signal amplitude (the amount contributed), dispersion (number of areas supported), and consistency (presence of a corporate foundation) on CSP awareness and perception. Overall, this study finds that characteristics of firms’ portfolio of philanthropic activities are a (...) greater predictor of CSP awareness than of CSP perception. Awareness increases with signal amplitude, dispersion, and consistency. CSP perception is driven by awareness and corporate reputation. The authors’ contention that corporate philanthropy is a complex variable is upheld, as we find that CSP signal characteristics influence CSP awareness and perception independently and asymmetrically. The current study sought to determine research scientists’ sensitivity to various justifications for engaging in behaviors typically considered to be questionable research practices by asking them to evaluate the appropriateness and ethical defensibility of each. Utilizing a within-subjects design, 107 National Institutes of Health principal investigators responded to an invitation to complete an online survey in which they read a series of research behaviors determined, in prior research, to either be ambiguous or unambiguous in their ethical defensibility. Additionally, each behavior (...) was paired with either an ostensibly sound or unsound reason for the behavior. Consistent with hypotheses, the results indicated that scientists perceived QRPs as more appropriate and defensible when paired with a justifiable motive relative to when paired with a clearly unethical motive, particularly for QRPs that are more ambiguous in their ethicality. In fact, ambiguous QRPs were perceived as categorically defensible when given a justifiable motive. This suggests scientists are sensitive to contextual factors related to QRPs’ appropriateness, which could inform how institutions develop appropriate training modules for research integrity. Research has found that academic dishonesty is common among college and university undergraduate students worldwide. Two variables found to have a significant effect on student cheating were students’ attitudes toward AD and perceptions of peer engagement in AD. This quantitative research study examined preservice teachers’ attitudes and behaviors related to academic dishonesty. Utilizing three parts of the Academic Integrity Survey, this study analyzed data from 62 preservice teachers enrolled at a university in the Mid-Atlantic Region of the United States that (...) were preparing to teach students in pre-kindergarten through twelfth grades in both public and private schools. Data analyses examined the frequency rates at which preservice teachers self-reported engaging in academic dishonesty, as well as the relationships that existed between preservice teachers’ attitudes toward academic dishonesty, perceptions of peer engagement in AD, and self-reported engagement in AD. Results showed that rates for self-reported engagement in academic dishonesty among preservice teachers were similar to those found for undergraduates in other majors, with attitude toward behavior found to be significantly associated with and predictive of self-reported engagement in academic cheating among this group of preservice teachers. Leibniz raises three main objections to the doctrine of occasionalism: (1) it is inconsistent with the supposition of finite substances; (2) it presupposes the occurrence of "perpetual miracles"; (3) it requires that God "disturb" the ordinary laws of nature. At issue in objection (1) is the proper understanding of divine omnipotence, and of the relationship between the power of God and that of created things. I argue that objections (2) and (3), on the other hand, derive from a particular conception (...) of the intelligibility of nature, a conception to which Leibniz is firmly committed and that occasionalists like Malebranche no less firmly reject. Viewing workplace deviance within a victim precipitation framework, we explore how abusive supervisors target subordinates low in core self-evaluations to explain when such employees respond by engaging in workplace deviance. We theorize that employees who are lower in CSE receive more abusive supervision, which generates subsequent harmful reactions toward supervisors, peers, and the organization. This occurs primarily when employees lack sufficient cognitive resources in dealing with supervisor abuse. We test, replicate, and extend our theoretical model in three empirical studies. Results (...) demonstrate that lower employee CSE drew more abusive supervision and led low-CSE employees to exhibit workplace deviance. This abusive supervision mediation effect was stronger for employees with comparatively lower cognitive ability levels. The state that we inhabit plays a significant role in shaping our lives. For not only do its institutions constrain the kinds of lives we can lead, but it also claims the right to punish us if our choices take us beyond what it deems to be appropriate limits. Political philosophers have traditionally tried to justify the state's power by appealing to their preferred theories of justice, as articulated in complex and wide-ranging moral theories—utilitarianism, Kantianism, and the like. One of (...) John Rawls's greatest contributions to political philosophy has been his recognition that this is the wrong way for this field to approach its task. He points to what he calls “the fact of reasonable pluralism,” which is the incontestable fact that in a free society people striving to lead their lives ethically will subscribe to conflicting moral and religious doctrines, many of which will be “reasonable” in the special sense of leaving their adherents willing to cooperate with those with whom they have moral disagreements. And this means that political philosophers can no longer rely on any particular “comprehensive” doctrine in their attempts to justify the state. For doing so would be unfair to those who subscribe to a conflicting reasonable doctrine; it would mean that the coercive power of the state would not be justified to them in terms they can accept, even while they were forced to abide by its terms. This article explores the use of intoxicants by a community of Kulina Indians in western Brazil. I suggest that Kulina intoxication through alcohol, tobacco, and ayahuasca is best understood as a form of semiotic appropriation of the identity of cosmological “others,” including animal spirits, creator beings, other Indian groups, and Brazilians. I consider how embodying practices, such as song and physical movement, enhance the experience of being an “alter,” facilitated by the alterations in consciousness produced by intoxicants.

It is proposed that the physical structure of an observer in quantum mechanics is constituted by a pattern of elementary localized switching events. A key preliminary step in giving mathematical expression to this proposal is the introduction of an equivalence relation on sequences of spacetime sets which relates a sequence to any other sequence to which it can be deformed without change of causal arrangement. This allows an individual observer to be associated with a finite structure. The identification of suitable (...) switching events in the human brain is discussed. A definition is given for the sets of sequences of quantum states which such an observer could occupy. Finally, by providing an a priori probability for such sets, the definitions are incorporated into a complete mathematical framework for a many-worlds interpretation. At a less ambitious level, the paper can be read as an exploration of some of the technical and conceptual difficulties involved in constructing such a framework. (shrink)

It has frequently been recognized that the collection and use of accurate military intelligence was of fundamental importance for the success of Alexander's campaigns. No intelligent strategic or tactical decision can be made by any commander without advance knowledge of an enemy's location, strength, his capabilities and weaknesses, and the geography of the projected campaign. However, an analysis of the procedures Alexander used to obtain and evaluate intelligence has never been undertaken. This article proposes a solution to the ‘paradox of normalcy’, a problem raised by the early Frankfurt Sehool in its questioning of basic concepts of psychoanalysis. After reviewing the different definitions of normalcy put forward by Freud, the paradoxical character of the concept of normalcy, as perceived by the various members of the Frankfurt School, will be made explicit. The solution to the paradox will take the form ofa practical ‘dis-solution’, and will bring to the fore a fundamental principle of (...) Critical Theory identified as the ’banning of graven images’, which will be shown to operate even in the contemporary work of Habermas.Cet artiele propose une solution au ‘paradoxe de la normalité’ qui émergea lors des analyses psychanalytiques de I’École de Francfort de première heure. This paper sets out to give sufficient detail to the notion of mental simulation to allow an appraisal of its contribution to ‘mindreading’ in the context of the ‘false-belief tasks’ used in developmental psychology. We first describe the reasoning strategy of ‘modified derivation’, which supports counterfactual reasoning. We then give an analysis of the logical structure of the standard false-belief tasks. We then show how modified derivation can be used in a hybrid strategy for mindreading in these tasks. We then (...) formulate the hypothesis that children become able (around the age of 4 years) to pass these tasks when they acquire the counterfactual reasoning ability required in this strategy. We find this to be consistent with various empirical findings. We then discuss the implications for the theory/simulation debate, meta-representation and pretence. (shrink)

Corporate entrepreneurs -- described in the academic literature as those managers or employees who do not follow the status quo of their co-workers -- are depicted as visionaries who dream of taking the company in new directions. As a result, though, in overcoming internal obstacles to reaching their professional goals they can often walk a fine line between clever resourcefulness and outright rule breaking. A framework is presented as a guideline for middle managers and organizations seeking to impede unethical behaviors (...) in the pursuit of entrepreneurial activity. This paper examines the barriers middle managers face in trying to be entrepreneurial in less supportive environments, the ethical consequences that can result, and a suggested assessment and training program for averting such dilemmas. We advise companies that embrace corporate entrepreneurship: (1) establish the needed flexibility, innovation, and employee initiative and risk-taking; (2) remove the barriers that the entrepreneurial middle manager may face to more closely align personal and organizational initiatives and reduce the need to behave unethically; and (3) include an ethical component to corporate training which will provide guidelines for instituting compliance and values components into the state-of-the-art corporate entrepreneurship programs.
