Moral encroachment states that moral factors can make a difference to what we are epistemically justified in believing. I present two motivating cases that resemble a common example in the moral encroachment literature to show that the agent's commitments and beliefs, and not the moral factors of the situation, influence epistemic justification. I call this view Structural Encroachment.

The rejection of beauty from a political standpoint is a significant part of the legacy of avant-gardism in contemporary art. In particular, Arthur Danto signaled that artistic activism should avoid beauty simply because beauty induces the wrong perspective on whatever it is desired to have an impact upon. While artistic beauty’s tendency would be to heal, he claimed, political protest needs anger as its trigger. This article challenges such an argument that opposes beauty’s emotional effects on political action by examining (...) the complex nature of both beauty and anger. I contest a mere contemplative view of beauty and, using Carolyn Korsmeyer’s account of “terrible beauties,” bound up with discomforting emotions, I defend that beauty can be compatible with anger albeit, in order to be politically truly effective, anger must move from the wish to punish toward more productive forward-looking thoughts. Though often being necessary as a source of motivation to fight for justice, I believe, with Martha Nussbaum and Myisha Cherry, that anger is truly politically effective and keeps its noble side when detached from revenge and directed by hope, a value related to beauty. Hinge epistemology is a family of views that offers a novel approach to avoiding skeptical conclusions about the possibility of a posteriori justification of our empirical beliefs. They claim that at the basis of our empirical beliefs lie certain commitments whose rational status is not determined by our evidence. These are called hinge commitments. Prominent hinge epistemologists have claimed that hinge commitments are either rational or arational but yet not beliefs. I argue that such views are subject to decisive objections. (...) I then offer what I consider to be the best version of hinge epistemology. On this view, hinge commitments are best understood as arational beliefs that contingently inform our worldview. Se enfatizó en la importancia de la medicina preventiva, además de poner en evidencia la necesidad de reconceptualizar la investigación en las ciencias médicas sobre la base de una visión interdisciplinaria que permita revelar fenómenos no explicados hasta el momento, aspecto que necesita del enfoque desde la perspectiva de la ciencia, tecnología y sociedad como complemento esencial. We conducted a bibliographic review of materials available in electronic journals in SciELO base aiming to substantiate the contribution of Natural and traditional medicine to the Cuban public health and the interrelationships of science-technology - society. Science, technology and society perspective contributes to build a scientific culture so the population can in general get to feel it as their own, which requires to prioritize the application of traditional medicine and Natural, socially useful and culturally relevant social commitment based on the eradication of poverty, the harmony with nature and sustainable development. Emphasized the importance of preventive medicine, as well as highlight the need to reconceptualize the research in the medical sciences on the basis of an interdisciplinary view that reveal phenomena not explained so far, issue that needs the approach from the perspective of science, technology and society as essential complement. Arthur Danto's The Abuse of Beauty was a significant contribution to the acclaimed return of beauty that had been taking place since Dave Hickey's 1993 manifesto announced that beauty would be the defining problem of the next decade. One of the most original and important aspects of Danto's look at beauty is that he thought about it as a contribution to art criticism. External aesthetic qualities would be as meaningless as natural beauty intended to play role in conveying a work (...) 's meaning, constitute the aesthetic dimension of the work. For Danto, elegiac beauty can provide political role for the aesthetic quality, but the impossibility of what could be termed an “angry beauty,” capable of outraging people, seriously limits the option of beauty in “angrily political” contemporary art. Danto thought that activist art will try to inflect works with an angry mood in order to turn people against what they are about. (shrink)

In this article, I seek to outline a theoretical framework to critically assess as artistic the aesthetic value of participatory art, namely, art where the audience’s activity is constitutive of the artwork proper. I depart both from the idea that, in participatory art, aesthetic qualities emerge in the participants’ performances, and from a functional account of art criticism that assesses works in terms of the kinds of objects they are, the goals they pursue, and manners in which they do so. My paper raises the issue of whether and how a functional account of art criticism, which makes artistic value dependent on the artist’s intentions can apply to the criticism of participatory art, whose aesthetic qualities arise in the activity performed by the audience detached from the specific artefacts designed by artists. Depuis les années soixante les plus représentatives des productions artistiques rejetant la théorie esthétique moderniste, la question se pose de savoir si l’esthétique n’a vraiment plus rien à voir avec l’art. En philosophie de l’art différents courants cognitivistes ont accompagné le conceptualisme qui, grosso modo, a été au cœur de la plupart des pratiques néo-avant-gardistes, et qui affirme que l’art est contre, ou au moins au-delà, de l’esthétique. Cependant, il existe d’autres manières de définir l’art, l’esthétique et leurs relations, qui (...) se fondent sur d’autres bases. Cet article en considère quelques-unes, et tout particulièrement « l’esthétique de la signification » du dernier Danto, afin de réfuter les thèses conceptualistes selon lesquelles l’esthétique serait impropre à évaluer l’art d’aujourd’hui. Sin embargo, la relación entre el arte y la estética ha sido redefinida sobre distintas bases. To carry out an ethnographic study on the work process in the sterilization unit of a hospital in Catalonia, we found the socially distributed cognition approaches of Hutchins and Kirsh useful. However, these approaches lack sufficient explanation on three important issues: the pragmatic criteria for identifying and delimiting a relevant unit of analysis and therefore the setting and contexts of the work process; the mechanisms and results of reciprocal influences between these levels of analysis; and the relation between these levels. Therefore, we added several new elements to these approaches, in addition to Layder's model of contexts with some important modifications, with the aim of offering an interactive, cognitive and social proposal of analysis that clarifies these three issues, allowing a more exhaustive and broader empirical analysis that captures better the ‘social’ dimension embedded in the work processes. Este artículo se fundamenta en una teoría pragmático-cognitiva del eufemismo y explica los efectos que produce en la mente de los hablantes un conjunto de expresiones eufemísticas empleadas en el discurso político español durante (...) los últimos años. En concreto, se propone la existencia de tres fenómenos que influyen en la representación mental de la realidad que construye el intérprete: el encuadre léxico, la obstrucción del acceso al referente y la estigmatización de conceptos. ObjectiveThe literature has shown the relevance of certain psychological variables in adjustment to cancer. However, there is a great variability, and these features could be modified through the disease process. The aim of this study is to provide an integrated and global perspective of the importance of variables such as coping, resilience, emotional control, social support, affect, and others in cancer patients through a longitudinal study, with the objective of exploring their associations and underlying interactions.MethodsThe sample was composed of 71 (...) people diagnosed with cancer who were attending psychological support at the Spanish Association Against Cancer. We assessed the following variables in two periods of 6 months: perceived stress, emotional control, resilience, coping strategies, personality, social support, affect, emotional distress, quality of life and visual-analogic scales.ResultsResults showed predictive effects of perceived stress on physical health perception. Mental health perception was influenced by almost all the psychological variables. Consciousness at baseline, change in Extraversion and Resilience had significant effects on perceived mental health.ConclusionThis study provides a global health model that integrates and explores associations between psychological variables related to cancer disease. This information could be useful for guiding personalized psychotherapeutic interventions, with the aim of increasing adjustment to disease. (shrink)

La conclusión a la que llega es que todavía hoy es necesario discutir sobre la universalidad, la participación,las desigualdades, la degradación de los derechos sociales, el papel de los derechos en las relaciones internacionales y el medio ambiente. Además, a los anteriores, se suman la amenaza del (...) terrorismo y la respuesta a esta amenaza, así como el auge de los populismos de extrema derecha, y el impacto de la revolución tecnológica.En la actualidad, un contexto marcado por el Antropoceno, el cambio climático y el impacto de las nuevas tecnologías convierte en perentorio el discurso de los derechos y, sobre todo, la extensión de este más allá de los entornos académicos a través de la educación en derechos. RESUMEN. El presente trabajo trata de mostrar cómo algunos de los presupuestos teóricos de una concepción tradicional de los derechos, como el modo en el que operan la autonomía y la racionalidad y la forma en la que se articula la separación entre lo público y lo privado, han permitido que resulte fácilmente justificable que las corporaciones y, entre ellas, las empresas transnacionales, sean titulares de derechos humanos, pero también han operado como obstáculos para atribuirles obligaciones. Tales presupuestos han de (...) revisarse para que los derechos humanos sirvan efectivamente para proteger a los seres humanos y no tanto a las ‘personas’ en el sentido jurídico. ABSTRACT. This work is aimed to show how some of the theoretical premises of a traditional conception of rights (such as autonomy, rationality or the public/private separation) have allowed an easy justification of the human rights for corporations, and for transnational enterprises as corporations. However, these assumptions have also hampered the justification of human rights duties for these entities. RESUMEN: Este trabajo considera la conceptualización y aplicación de la figura de los ajustes razonables en Qatar tras nueve años desde la ratificación de la Convención sobre los Derechos de las Personas con Discapacidad (CDPD). En él se trata de analizar la situación de igualdad y no discriminación de las personas con discapacidad utilizando como medida de impacto la figura de ajustes razonables. El artículo destaca las principales fallas y virtudes del Estado de Qatar respecto a esta figura y traza (...) un camino a fin de poder avanzar en la inclusión de las personas con discapacidad a la luz de la CDPD. ABSTRACT: This paper considers the conceptualization and application of reasonable acommodation in Qatar after nine years since the ratification of the Convention on the Rights of Persons with Disabilities (CRPD). It analyzes the situation of equality and non-discrimination of people with disabilities using the figure of reasonable adjustments as an impact measure. The article highlights the main failures and virtues of the State of Qatar regarding reasonable accommodation and draws a path to move forward in the inclusion of people with disabilities in the light of the CRPD. The United States is one of the most charitable nations, yet comprises some of the most materialistic citizens in the world. Interestingly, little is known about how the consumer trait of materialism, as well as the opposing moral trait of gratitude, influences charitable giving. We address this gap in the literature by theorizing and empirically testing that the effects of these consumer traits on charitable behavior can be explained by diverse motivations. Professional musicians are expected to perform at a very high level of proficiency. Many times, this high standard is associated with perfectionism, which has been shown to prompt both adaptive and maladaptive motivational dynamics and outcomes among music students. The question about how perfectionism interplays with motivational dynamics in music students is still unanswered and research within this line is scarce, especially in Latin America. In the light of Self-Determination Theory, this cross-sectional study investigated the relationship between the perceptions of (...) motivational context, basic psychological needs, perfectionism, and flourishing in University music students from Lima, Peru. We performed a path analysis testing a model in which motivational teaching styles predicted both, perfectionism and flourishing via need satisfaction and frustration. The model's fit indices were ideal [χ2 = 7.48, p = 0.300, CFI = 0.998, TLI = 0.992, RMSEA = 0.021, SRMR =0.040]. In this model, perceived autonomy supportive style predicted need satisfaction positively and need frustration negatively; perceived controlling teaching style did not predict need satisfaction nor frustration. In turn, need satisfaction positively predicted adaptive perfectionism and flourishing; whereas, need frustration predicted maladaptive perfectionism. These results shed light on the relevance of perfectionism in the psychology of higher music education students. Lastly, we highlight the importance of autonomy support in fostering adaptive high standards and flourishing in music learning. (shrink)

Notwithstanding universities’ many laudable aims, incidents of serious bullying, academic harassment and sexual harassment in academic settings are reported with increasing regularity globally. However, the human rights violations involved in bullying and academic harassment have not received attention by the literature. In this article, we pierce the veil of silence surrounding university environments and provide a systematic account of the breaches of international and European human rights law involved in academic bullying and harassment. By adopting a socio-legal lens, we shed (...) light onto such practices and tactics, the breaches of specific human rights and norms and the reluctance of states and regulators to intervene in what is perceived to be universities’ ‘sovereign’ sphere of jurisdiction in order to prevent human rights’ violations and to protect the victims of human rights abuse. We call for a multi-faceted and multi-agency approach to tackle academic bullying and harassment, and make a number of institutional and policy recommendations to ensure universities’ compliance with human rights standards and the effective protection of academics under attack. The relationship between food and religion is a lived activity formed by the dynamics of both tradition and adaption. Religious commitments to food are influenced by various factors, ranging from personal spirituality and experiences to social patterns of belonging, ethical, polit­ical and doctrinal convictions. _Challah_, _gefilte_ _fish_, _blintzes_ – these are just a few of the traditional Finnish Jewish meals that are still prepared by members of the community. The originally Eastern European dishes are one of the last living links (...) that connect assimilated Finnish Jews with their Orthodox Jewish ancestors mainly from Russia, Poland, Belarus, and Lithuania. The current paper aims to present the conceptions and reflections relating to boundaries of identity connected with the multi-ethnic culinary traditions of Jews living in Finland as well as their ways of coping with the requirements of _kashrut_. The article is based on ethnographic data from interviews as well as personal encounters, informal conversations and home visits. (shrink)

This book proposes a new institutional constructivist model, for social scientific and legal enquiries, based on the interrelations within the social and political world and the application of change in EU laws and politics. Much of the research conducted in social sciences and law examines the diverse activities of individuals and collectivities and the role of institutions in the social and political world. Although there exist many vantage points from which one can gain entry into understanding how agents in the (...) world act, interact, shape and bear the world, socio-legal scientific epistemology has found monism and dualism to be convincing models. This book argues that current models do not capture the complexity of our micro-worlds, macro-worlds and meso-worlds. Nor can they account for the forms and patterns of socio-legal change. Mind, time and change are brought together in an attempt to contribute to socio-legal epistemology and to enhance its toolkit. (shrink)

The ‘reinvention’ of nationhood in theory and the reform of British naturalization rules in praxis have been unable to address satisfactorily the issue of unjust exclusion and to make naturalization law and citizenship more compatible with democratic ideals. This has much to do with the fact that the discourse of new patriotism and the reconfiguration of national citizenship have inbuilt limits. In examining the ‘new’ discourse of patriotism in its various shades, I argue that it is inconsistent and unpersuasive. Neither (...) the rehabilitation of civic nationalism under ‘republican patriotism’, nor ‘constitutional patriotism’, nor ‘rooted patriotism’ succeed in transforming the nationality model of citizenship in order to render it more compatible with contemporary developments and with cultural pluralism. Similarly, the three models of citizenship developed by the literature, namely, postnational, transnational and multicultural citizenship remain rooted within the civic nationalist trajectory. Instead of arguing for the liberalization of naturalization requirements and the ensuing pluralization of citizenship, I put forward an argument as to how the nationality model of citizenship might be transcended by developing a model of civic registration. By contrasting this model with the Labour Government’s reforms in the fields of naturalization and citizenship, I argue that the Nationality, Immigration and Asylum Act 2002 places too much emphasis on social cohesion, thereby overlooking that a sense of belonging to community develops with inclusion in society and politics rather than as a result of citizenship ceremonies and language proficiency tests. The framing of the debate concerning sovereignty in terms of the dualism of retention or rejection conceals the floating character of sovereignty and constrains the capacity of the state to mutate, adapt and respond adequately to the diverse and complex processes which range in, through and above it. The paper develops the idea of floating sovereignty by putting forward four main propositions: (i) sovereignty's historical entanglement with statehood makes it unsuitable for non‐state political organisations; (ii) although the state has been (...) the necessary condition for sovereignty, the latter is no longer necessary for the evolution of the state; (iii) the traditional ideological function performed by sovereignty, namely the legitimation of state power, could be performed by other organizing principles which prioritize governmental efficiency over territorial extent and democratic criteria over nationalist ones; (iv) this means that the state will no longer be in a position to command the loyalty of its citizens but it would have to purchase it through its capacity to meet social needs, to fulfil its basic functions and through the normative qualities of its institutions and policies. Three institutional designs in core areas of ‘high politics’, that is, the fields of determination of nationality, immigration policy and foreign and security policy show how floating sovereignty could be implemented. Artificial intelligence is a general-purpose technology (GPT), term given to technologies that shape an entire era and reorient innovations by reconfiguring the economy’s logic and functioning and bringing in new business models. AI offers unprecedented opportunities and risks. The benefits of AI are extraordinary, as are its potential harms. Potential damage does not have the same degree of problematization, since the intensity and extent of the damage varies according to the domain and the object of application. To address the scale (...) of this challenge, regulation is necessary but not sufficient. Standards, unwritten codes of compliance and arbitration procedures, supervision and auditability, AI governance, international agreements, compliance with current local and global standards and laws. All of this needs to be integrated. Society seems to have no alternative to facing the challenges of at least mitigating the damage already identified and trying to predict future damage in advance. The purpose of this article is to encourage reflection regarding the main initiatives that are available to society to protect its citizens and organizations from the potential harm caused by AI models, vis-à-vis the technology’s own limits to act in ethical and legal compliance. Vaccines and vaccination are richly explored areas of study within the history of science and medicine, connecting related fields of the history of science and technology, and spanning across subfields such as biomedical sciences, animal studies, colonial and postcolonial history, and the history of global health. Vaccination is a thoroughly political act that is at once an intimate and local issue and a transnational one, with its particular set of politics connecting stakes for the individual and the community. Vaccination also (...) maps on narratives and temporal frameworks of disease with an ultimate goal of ending epidemics. Therefore, the essay takes these three analytical entry points to discuss the historiography of vaccination: the geographical, the political, and the temporal. We argue that through these lenses we can gain a more nuanced understanding of historical narratives we privilege, and in return, this understanding can enable us to explore past and current questions of health inequalities, validation practices, power relations and resistance and vaccine diplomacy. Populistic political discourse often portrays ethnic minorities as threats to the majority society. However, the deeper characteristics of perceived threats have not been sufficiently empirically investigated. The goal of this study is to identify the similarities and differences in intergroup threats perceived by Slovak majority from Roma, Muslims, and ethnic Hungarian minorities. The participants included 1244 adults who were instructed to write the first five associations that came to mind when thinking about one of the minorities. Our findings indicate that (...) power threat was dominant from the Hungarian minority and safety threat from the Roma and Muslim minorities. Moreover, the safety threat from the Roma minority related mainly to theft and violence, while from Muslims it was terrorism. Mapping and addressing specific threats associated with different minorities can help explain misperceptions and reduce prejudice against them. (shrink)

Whereas literature on satellites and outer space exploration has usually been dominated by vision, humankind’s initial encounter with the Earth’s first artificial satellite, Sputnik I, was overwhelmingly sonic. Tracking was originally enabled by the signal continuously transmitted by its radio beacon. Embedded in the International Geophysical Year (IGY) citizen science programs, radio amateurs played a crucial role in receiving the signal and assisting professional scientists in tracking the satellite in its initial phases. Their established existence as a distinctive worldwide community (...) of skilled operators and experimenters made hams special allies to IGY scientists and, in many respects, set them apart from other groups of amateur scientists. This essay focuses on radio amateurs’ practices and spaces of listening to Sputnik within the wider framework of the IGY. In transcending national and terrestrial boundaries, Sputnik’s signal shaped new spatialities at a variety of scales: from the macroscales of the globe and outer space to the intimate microscale of the domestic radio shack. Focusing on radio amateurs’ personal experiences and on the invisible agencies of Sputnik’s signal, the essay uses sound as a way into the sociocultural, political, and scientific importance of the IGY. More broadly, it contributes to a multisensory history (and geography) of science. (shrink)

In this piece, I propose a reading of Plato’s Gorgias that pays special attention to the role that the fictional audience plays in the unfolding of the dialogue. To this end, I use some of the insights that Chaïm Perelman and Lucie Olbrechts–Tyteca conveyed in their seminal work, The New Rhetoric: A Treatise on Argumentation in order to argue that thinking about the way in which Socrates’ arguments are shaped by the different audiences that Gorgias, Polus, and Callicles aim to (...) address and represent provides us with a new hermeneutical understanding of what is at stake in each of the different interactions Socrates engages in throughout the dialogue. In unpacking the way in which Socrates appropriates Gorgias’ particular audience, transforms Polus’ universal audience, and challenges Callicles’ elite audience, I provide an outline of the difficulties that Plato’s Socrates has to overcome in order to achieve the ‘community of minds’ that Perelman and Olbrechts–Tyteca identify as the bedrock of fruitful argumentation. Having done this, in the last section I turn to Plato’s Phaedrus, for the purpose of making evident that thinking about Plato’s deployment of rhetorical audiences is a crucial step in the effort to expose the implicit continuity that links the discussion of rhetoric delivered by the Gorgias to that of the Phaedrus.
