This book is a provocative contribution to contemporary ethical theory challenging foundational conceptions of character that date back to Aristotle. John Doris draws on behavioral science, especially social psychology, to argue that we misattribute the causes of behavior to personality traits and other fixed aspects of character rather than to the situational context. More often than not it is the situation not the nature of the personality that really counts. __Demoralized: Why Teachers Leave the Profession They Love and How They Can Stay_ offers a timely analysis of professional dissatisfaction that challenges the common explanation of burnout. _Featuring the voices of educators, the book offers concrete lessons for practitioners, school leaders, and policy makers on how to think more strategically to retain experienced teachers and make a difference in the lives of students. Based on ten years of research and interviews with practitioners across the United States, the book theorizes the (...) existence of a “moral center” that can be pivotal in guiding teacher actions and expectations on the job. Codes of ethics and conduct typically demand the highest standard of ethical behaviour from every single employee. This implies a democratic or lobbyist understanding of ethics in business. The contrasting view would argue that business ethics is an elitist undertaking that can only be instigated from the top, by managing directors or owner managers. This article looks at three types of ethical businesses, three types of approaches to ethical problem‐solving, and three possible incentives for ethical business to see which of (...) the above is more convincing. It will be argued that the impulse for value‐driven business has to come from the top. Only top management and owner managers have the opportunity to foster major change in business practice. This open access book provides original, up-to-date case studies of “ethics dumping” that were largely facilitated by loopholes in the ethics governance of low and middle-income countries. It is instructive even to experienced researchers since it provides a voice to vulnerable populations from the fore mentioned countries. Ensuring the ethical conduct of North-South collaborations in research is a process fraught with difficulties. The background conditions under which such collaborations take place include extreme differentials in available income and power, as well (...) as a past history of colonialism, while differences in culture can add a new layer of complications. Parallels and differences are listed as to the Idealistic tradition in Germany preceding Bloch’s approach. In a recent work, we introduced a theoretical model for fulfillment in life that covers cognitive and affective components and distinguishes different time frames. The present study evaluates this model and describes the construction of the Fulfilled Life Scale to assess fulfillment regarding the whole lived life retrospectively. We investigated the scale in two samples. The model of the cognitive component combines three sources of fulfillment with three criteria, yielding nine facets. Employing hierarchical factor analysis, we inspected all solutions between (...) one and nine. We identified three optimal factors, which we labeled unfolded self and life, the worthwhile life, and positive impact and legacy. Next, we selected marker items and replicated the factor structure in Sample 2. The three scales were positively intercorrelated and showed good internal consistency in both samples. For the affective component, exploratory and confirmatory factor analyses established a one-factor structure in both samples, and high internal consistency was obtained. Across a range of related constructs, we demonstrated construct and criterion validity. Notably, cognitive and affective fulfillment incrementally predicted a global rating of a fulfilled life and mental well-being, even after controlling for subjective and eudaimonic well-being. Overall, the study proves that the FLS is necessary to capture people’s experience of a fulfilled life, which could not be assessed sufficiently with previous well-being measures. Both cognitive and affective fulfillment were able to predict additional variance in mental well-being. Moreover, the study reveals psychometric support for the FLS and presents the first evidence on its validity. Lastly, applications in research and practice are discussed, especially in the context of living and aging well in the second half of life. (shrink)

This paper connects to Jon Bing’s great vision of an integrated national legal information system. The intention of this paper is to variegate Bing’s vision of an integrated information system by shifting the focus to the lay users, thus to those, who are subject to the law. The modified vision is an integrated information system that supports intelligible access to law for the citizens. This presupposes however an unambiguous and transparent legal system. Accordingly, it is also stressed that intelligent legal (...) knowledge engineering has high potential to increase precision and rationality in law, and hence safeguard the predictability of law and legal certainty. The central hypothesis is that putting the person who is subject to the law at the centre provides more rational reason to aim for the greatest possible precision of law by exploiting the means and technologies of our time than to uphold strategic vagueness. On this basis, the paper proposes the development of a basic set of controllable and justiciable basic legal drafting standards on EU and on national level, and promotes a transparency by design approach for legal knowledge engineering in order to enhance precision, integrity, comprehensibility and accessibility of law. Similarly to Jon Bing’s vision, this modified vision of an integrated legal information systems is, most probably, also likely to remain unfulfilled. In 2006, the Indonesian government decided to withhold avian flu samples from the World Health Organization. They argued that even though Indonesian samples were crucial to the development of vaccines, the results of vaccine research would be unaffordable for its citizens. Commentaries on the case varied from alleging blackmail to welcoming this strong stance against alleged exploitation. What is clear is that the concern expressed is related to benefit sharing.Benefit sharing requires resource users to return benefits to resource providers in (...) order to achieve justice. One benefit sharing tool within health research is the duty to provide a health care intervention which has been proven to be beneficial (or alternative benefits) to research participants after a study has been concluded. This duty is generally known as a post-study obligation. It was enshrined in the Declaration of Helsinki in 2000 and re-emphasized in 2008. Yet, there are few, if any, examples of good practice.In this article, we analyse the obstacles to giving more bite to benefit sharing provisions in health research through ethical review. We conclude that the provision of post-study access to healthcare interventions is not a promising mechanism when monitored through research ethics committees. Alternative benefit provision is preferable if one focuses on achieving compliance. However, even the latter faces challenges, which we address in specific recommendations. (shrink)

In its essence, post-trial obligations describe a duty by research sponsors to provide a successfully tested drug to research participants who took part in the relevant clinical trials after the trial has been concluded. In some instances,this duty is extended beyond the research participants. This article is divided into three main parts. The first part outlines the legal basis for post-trial obligations by looking at international guidelines, including those issued by the World Medical Association. National legislation is exemplified through resolutions (...) and guidelines issued by Brazil and South Africa respectively. The second part analyses the ethical foundation for post-trial obligations, in particular the attempt to minimize exploitation of research subjects. The third part raises obstacles and challenges for the implementation of post-trial obligations. The jury is still out on whether post-trial obligations in the form of access to drugs for clinical trial participants is the best, or even a good way, to avoid exploitation in medical research. In this essay, Doris Santoro examines the discourse of “fidelity of instruction” to show how it is doublespeak for teacher compliance that is incompatible with democracy and education. Analyzing the distorted use of the term “fidelity” by market-based reformers, Santoro illustrates how it can be used as a weapon against teacher intelligence and moral response. She argues that John Dewey's philosophy provides conceptual resources to reframe some teacher infidelity as intelligent response, the moral agency required for pedagogical responsibility.

Increased complexity in society, economics, and technology requires a new and suitable organization and management. What are the consequences and results for project management? That is the theme of this article. First of all it will given a short introduction to project management, which will be later called "traditional project management" or "project management 1st order (PM-1)." Then, the challenges by the fundamental changes in sciences and the increased (...) complexity in society, economics, and technology will be discussed. It will state that traditional project management cannot solve these challenges. The widespread working-themes and results of the research program "Beyond Frontiers of Traditional Project Management" as an answer to these challenges will be presented at a glance. Subsequently, it will discuss some selected results of the research program: The principle-definition and foundation of "Evolution of 1st and 2nd Order." The Evolution of 1st Order and the impact on Project Management methods and processes. Evolution of 2nd Order and the Grand Evolutionary Systems Theory (GEST) of E. Laszlo as also the impact on Project Management methods and processes. Management of crisis: turn a change to advantage or risk-assurance? Thereafter, the concept of "Project Management Second Order (PM-2)" is presented as a highlighted result of the research program, as a new paradigm in project management, and as an answer to the challenges, described earlier will be explained in detail. Drawing on arguments in Doris (2002, 2022) [Lack of Character: Personality and Moral Behavior. Cambridge: Cambridge University Press; Character Trouble: Undisciplined Essays on Moral Agency and Personality. Oxford: Oxford University Press], this essay argues that good character is typically an insufficient “bulwark” against misconduct in military organizations, for two reasons: (1) the situational sensitivity of behavior and (2) the relatively small effect sizes associated with personality variables. Additionally, what is known about moral development and education gives limited reason to (...) think organizations are likely to have much success in inculcating reliably good character in their members. Instead, military organizations concerned to reduce misconduct should focus on developing organizational cultures structured by carefully crafted and assiduously enforced moral rules. (shrink)

Paradoxes are more than just intellectual puzzles - they raise substantive philosophical issues and offer the promise of increased philosophical knowledge. In this introduction to paradox and paradoxes, Doris Olin shows how seductive paradoxes can be, why they confuse and confound, and why they continue to fascinate. Olin examines the nature of paradox, outlining a rigorous definition and providing a clear and incisive statement of what does and does not count as a resolution of a paradox. Neste estudo, busca-se historicizar os primeiros tempos do Colégio de Aplicação, importante espaço educativo em Porto Alegre/RS, Brasil, considerando seus entrelaçamentos às Faculdades de Filosofia e de Educação, valorizando o papel de Graciema Pachedo e Isolda Holmer Paes, professoras idealizadoras da instituição na década de 1950. A produção de memórias de instituições de ensino permite que se teçam interconexões entre as diferentes histórias vividas pelos sujeitos em termos políticos, sociais e educacionais, fomentando assim reflexões sobre as condições materiais nas quais (...) se produziram determinados processos educativos. Duas instituições de ensino imbricadas, ocupando o mesmo prédio por muitos anos, uma formando crianças e adolescentes, a outra formando professores. As relações entre o Colégio de Aplicação e a Faculdade de Educação são fortes, aqueles que frequentaram a Faculdade nos anos 1980 ainda a reconhecem como o “Aplicação”. Atualmente, a “FACED”, expressão que identifica a instituição, constitui-se em um espaço ocupado por jovens e adultos, em que se estuda sobre infâncias, mas quase não se vê por lá crianças. A investigação insere-se no campo de pesquisas da História da Educação e identifica-se com os pressupostos teóricos da História Cultural, corrente historiográfica que valoriza os sujeitos em uma perspectiva que os coloca como partícipes e fazedores da História de seu tempo. Para desenvolver a pesquisa, elegeu-se a memória enquanto documento e, como metodologias, a História Oral e a análise de outros documentos relevantes para um maior entendimento dessas histórias. Em um processo de escavar camadas de memórias, entrevistaram-se professores que carregam as trajetórias da Faculdade e do Colégio de Aplicação. Entendemos que a produção desses testemunhos se faz necessária para evitar o apagamento das práticas relativas a um tempo e lugar. Portanto, investigar as memórias institucionais é uma forma de reconstruir os processos identitários dessas duas instituições de ensino. Palavras-chave: História de instituições educativas. RésuméEn ayant recours à la théorie relationnelle du droit et à l’étude de discours des requérants, des juges et des commissaires, cet article met en lumière le fait que la Commission et la Cour interaméricaine des droits de l’homme entretiennent la lutte sémiotique engagée par la colonisation, en consacrant uniquement la dimension collective du droit de propriété sur les terres ancestrales, alors que les systèmes de tenure des terres, tels que les requérants autochtones les décrivent, reconnaissent aussi des droits subsidiaires (...) d’occupation et d’utilisation à des individus et à des familles. Ce faisant, le droit interaméricain marginalise certaines entités morales pourtant titulaires de droits au sein des ordres juridiques autochtones, efface leurs responsabilités en matière d’occupation du territoire et bâtit une image homogène des règles et des pratiques d’occupation. Ethics dumping is a global phenomenon involving the ‘off-shoring’of research. Research that would be prohibited, severely restrictedor regarded as highly patronizing in high-income regions is instead conducted inresource-poor settings. Twenty-eight case studies of ethics dumping were examined through inductive thematic analysis to reveal predisposing factors from the perspective of researchers from high-income regions. Six categories were agreed and further illuminated: Patronizing conduct, unfair distribution of benefits and/or burdens, culturally inappropriate conduct, double standards, lack of due diligence and lack of transparency. This book offers a unique and insightful analysis of Western and Middle Eastern concepts of dignity and illustrates them with examples of everyday life. Dignity in the 21st Century - Middle East and West is unique and insightful for a range of reasons. First, the book is co-authored by scholars from two different cultures (Middle East and West). As a result, the interpretations of dignity covered are broader than those in most Western publications. Second, the ambition of the book is (...) to use examples from everyday life and fiction to debate a range of dignity interpretations supplemented by philosophical and theological theories. Thus, the book is designed to be accessible to a general readership, which is further facilitated because it is published with full open access. Third, the book does not defend one superior theory of dignity, but instead presents six Western approaches and one based on the Koran and then asks whether a common essence can be detected. -/- The answer to the question whether a common essence can be detected between the Koranic interpretation of dignity and the main Western theories (virtue, Kant) is YES. The essence can be seen in dignity as a sense of self-worth, which persons have a duty to develop and respect in themselves and a duty to protect in others. The book ends with two recommendations. First, given the 7 concepts of dignity introduced in the book, meaningful dialogue can only be achieved if conversation partners clarify which variation they are using. Second, future collaborations between philosophers and psychologists might be helpful in moving theoretical knowledge on dignity as a sense of self-worth into practical action. The “scourges” of a sense of self-worth and dignity are identified by psychologists as violence, humiliation, disregard and embarrassment. To know more about how these can be avoided from psychologists, is helpful when protecting a sense of self-worth in others. (shrink)

Doris (bio)With your spirit settled, accumulate practice day by day, and hour by hour.—Miyamoto MusashiLike many of my colleagues in moral psychology, I’ve focused almost exclusively on Western philosophy, so I was pleasantly surprised when practitioners of cross-cultural and comparative philosophy responded to character skepticism with resources drawn from Eastern traditions.1 [End Page 571]As a reminder: the (...) character skeptic asserts a descriptive claim, to the effect that traditional conceptions of character are empirically inadequate, accompanied by a prescriptive claim to the effect that, as a result of this inadequacy, traditional notions of character should receive considerably diminished emphasis in ethical thought (e.g., Doris 2022, p. 2).2 The antiskeptic rejects both claims: a suitably nuanced conception of character has nothing to fear from empirical moral psychology and may safely retain its focal role in ethical thought.Near as I can see, cross-cultural philosophers commenting on the issues have generally been anti-skeptical. This anti-skepticism might be either contrastive or complementary in tenor. In a contrastive approach, Eastern conceptions of character, while bearing some affinities to Western conceptions (if there are no affinities, we’d have a change of subject), are supposed to be substantially different than Western notions, so defending the West by way of the East marks a departure from the Western characterological tradition. In a complementary approach, the Eastern and Western conceptions are substantially similar, so defending the West by way of the East is fundamentally a continuation of the Western characterological tradition. (Though continuation can’t be quite the right word, since the referenced Eastern traditions are often older than the Western.)While this dichotomy, like most dichotomies, oversimplifies, my sense is that cross-cultural philosophy’s contributions have tended to be complementary: consideration of Eastern traditions, often times Confucian, is said to illuminate what’s valuable in Western, frequently Aristotelian, traditions.3 This circumstance is both surprising to, and convenient for, me. Surprising, for my reading of the one Eastern text I have studied closely,4 over my thirty-five-year avocation as a martial artist, the legendary swordsman Miyamoto Musashi’s Book of Five Rings (Musashi/Harris 1974), suggests a contrastive reading: courage seems nearly invisible in Musashi’s treatment of success in combat, while martial valor is central to Aristotle’s understanding of courage. In any case, that those with vastly more scholarly credibility than I have favored complementary projects is a welcome convenience for me, since it allows me to enter discussion of cross-cultural philosophy and character along my usual pathways in contemporary Western moral psychology.Paul Condon, Seth Robertson, and Matthew Spencer, the gracious and insightful commentators for this symposium on my essay collection, Character Trouble (2022), seem generally to favor a complementary approach: while careful to note the existence of differences, they find in Eastern traditions resources to blunt the force of character skepticism as applied to its usual target, virtue ethics in a broadly Aristotelian tradition.5 Quite expectedly, in my responses, I’ll beg to differ. Why should all human beings have certain rights simply by virtue of being human? One justification is an appeal to religious authority. However, in increasingly secular societies this approach has its limits. An alternative answer is that human rights are justified through human dignity. This paper argues that human rights and human dignity are better separated for three reasons. First, the justification paradox: the concept of human dignity does not solve the justification problem for human rights but rather aggravates it (...) in secular societies. Second, the Kantian cul-de-sac: if human rights were based on Kant’s concept of dignity rather than theist grounds, such rights would lose their universal validity. Third, hazard by association: human dignity is nowadays more controversial than the concept of human rights, especially given unresolved tensions between aspirational dignity and inviolable dignity. In conclusion, proponents of universal human rights will fare better with alternative frameworks to justify human rights rather than relying on the concept of dignity. (shrink)

There is a widespread view that well-learned skills are automated, and that attention to the performance of these skills is damaging because it disrupts the automatic processes involved in their execution. This idea serves as the basis for an account of choking in high pressure situations. On this view, choking is the result of self-focused attention induced by anxiety. Recent research in sports psychology has produced a significant body of experimental evidence widely interpreted as supporting this account of choking in (...) certain kinds of complex sensorimotor skills. We argue against this interpretation, pointing to problems with both the empirical evidence and the underlying theory. The experimental research fails to provide direct support for the central claims of the self-focus approach, contains inconsistencies, and suffers from problems of ecological validity. In addition, qualitative studies of choking have yielded contrary results. We further argue that in their current forms the self-focus and rival distraction approaches both lack the theoretical resources to provide a good theory of choking, and we argue for an expanded approach. Some of the elements that should be in an expanded approach include accounts of the features of pressure situations that influence the psychological response, the processes of situation appraisal, and the ways that attentional control can be overwhelmed, leading to distraction in some cases, and in others, perhaps, to damaging attention to skill execution. We also suggest that choking may sometimes involve performance-impairing mechanisms other than distraction or self-focus. (shrink)

Citizens' competence for democratic self‐government must be judged by their ability to perform the typical functions of modern citizenship, rather than by their scores on surveys of political information—which are flawed in a variety of important respects. The role requirements for effective citizenship have changed throughout American history because government has grown vastly in size, complexity, and the range of functions that it performs. Effective use of citizens’ political talents therefore requires limiting public surveillance and advice to broad overview aspects, (...) rather than to micro‐management.
