Work on 'can' in Action Theory is dichotomized into two styles of analysis: (1) what I call the indeterministic analysis, whereby for x to be able to do A means that there is no obstacle to x's doing A, and (2) the hypothetical analysis, which asserts that x is able to do A if and only if x will do A if x tries (wants, wills, chooses, etc.). This paper explores the general hypothesis that 'can' is two-ways ambiguous, that a (...) sense of opportunity corresponds to (1) and a sense of ability to something after the pattern of (2), and that a general concept of 'can' of the kind often sought after by action theorists requires a certain kind of integration of both concepts into a unified definition. The two previous most well-worked-out attempts to lay out a program along these lines, those of Sellars and Chisholm, are analyzed in detail in the hope of smoothing out some of the technical differences to provide foundations for further work of this type. An attempt is made to integrate the program with some recent developments in the concept of ability in the social sciences. The applicability of this work to some very vexing and significant problems in the social sciences is suggested. (shrink)

This issue includes a number of papers on reproductive ethics, broadly construed. In a recent book, Anja Karnein proposed that embryos created in vitro should be offered up for adoption before being discarded or used in research;1 here Timothy Murphy offers a critical response . Elsewhere, Tak Chan and Stark & Delatycki debate the role of medical professionals in providing parentage determination. Chan argues that doctors are obliged to provide parentage tests when this is requested by parents, provided there is (...) a low risk that the child will be abandoned . Stark & Delatycki discuss some difficulties raised by the ‘risk of abandonment’ condition . Finally, papers by Kate Greasley and David Lang discuss the controversy surrounding the criminal prosecution of abortion doctor Kermit Gosnell. Greasley criticises the way in which some commentators capitalised on horror at Gosnell's extreme practices to advance more general anti-abortion objectives . Lang argues, against Greasley, that the dominant pro-life response to the case was neither self-contradictory nor intellectually dishonest .The issue is dominated, however, by discussions of ‘bioenhancement’ – the use of biomedical technologies to augment human capacities. A common criticism of bioenhancements is that they are anti-social: though they may benefit the user, they will have a negative effect on society-at-large. Such concerns are perhaps well placed in relation to the most obvious contemporary examples of bioenhancement: doping in sport, aesthetic medicine, and the use of stimulants to enhance examination performance. This article is featured in a special issue dedicated to theme, "the human being in the digital era: awareness, critical thinking and political space in the age of the internet and artificial intelligence." In this article, I consider the way that social-media companies nudge us to spend more time on their platforms, and I argue that, in principle, these nudges are morally permissible: they are not manipulative and do not violate any obvious moral rules. The moral problem, I argue, is (...) not with nudging in principle but is instead with the fact that users are being nudged towards something bad for them. In practice, this often involves being nudged to spend an unhealthy amount of time using a social-media app or being nudged towards content that is bad for us, such as by promoting eating-disorder content to young girls. Since nudging is morally permissible, it is open to these companies to use the same technologies to nudge us towards the good. (shrink)

This article explores the integrity of the discourse in the Anglican eucharistic tradition by considering the philosophical assumptions that underlie eucharistic theology. It argues that where the conversation of the Anglican eucharistic tradition is open and unfinished then the integrity of the discourse is facilitated as opposed to the conversations of party positions and particular interests which suggest exclusive versions of truth. The conversation or dialogue of Anglican eucharistic theology is seen to be enhanced through the consideration of the philosophical (...) assumptions of realism and nominalism to both the moderate and immoderate degrees that underpin eucharistic theology as a state of affairs. The insights of contemporary philosophers are used as a way of conceptualising the discourse of the Anglican eucharistic tradition and a model of Anglican eucharistic theology is suggested as a means of facilitating the integrity of the discourse through the recognition of multiformity in the tradition and by distancing the discourse from the hermeneutic idealism of particular interest. The notion of entrepreneurship developed by Israel Kirzner has applications far beyond the market process. Legal entrepreneurs are lawyers, activists, and other participants in the legal process who are alert to opportunities to alter legal rules, thereby benefiting themselves or their clients. Legal entrepreneurship creates a dynamic that can generate virtually continuous change in the structure of legal rights and duties. On the one hand, the notion of legal entrepreneurship is a testament to the value of Kirzner’s project. But on (...) the other, it creates a serious problem for Kirzner’s conception of welfare economics, which depends on the existence of a stable background of property rights. If the notion of entrepreneurship implies continual change in property rights, then the power of Kirznerian welfare economics is substantially curtailed.La notion d’esprit d’entreprise développée par Israel Kirzner a des applications qui vont bien au-delà du processus de marché. According to Douglas Rushkoff, "presentism" is the new ethos of a society that's always on, in real time, updating live. Guided by neither history nor long term goals, we navigate a sea of media that blend the past and future into a mash-up of instantaneous experience. Rushkoff (...) shows how this trend is both disorienting and exhilarating. Without linear narrative we get both the humiliations of reality TV and the associative brilliance of The Simpsons. With no time for long term investing, we invent dangerously compressed derivatives yet also revive sustainable local businesses. In politics, presentism drives both the Tea Party and the Occupy movement. In many ways, this was the goal of digital technology--outsourcing our memory was supposed to free us up to focus on the present. But we are in danger of squandering this cognitive surplus on trivia. This article concerns the so-called irrigation system in the Timaeus' biology (77a–81e), which replenishes our body’s tissues with resources from food delivered as blood. I argue that this system functions mainly by the natural like-to-like motion of the elements and that the circulation of blood is an important case study of Plato’s physics. We are forced to revise the view that the elements attract their like. Instead, similar elements merely tend to coalesce with each other in virtue of their tactile (...) features as the atomists describe. The notion of attraction is replaced with this notion of mere coalescence. I begin by outlining how blood is made from food. I then argue that an understanding of health and disease compels us to read Plato as if he were an atomist and to abandon the popular scholarly interpretations according to which the elements attract each other. In 2016, this Journal published an article by Rob Lawlor1 on what we might call the acceptance-refusal asymmetry in competence requirements. This is the view that there can be cases in which a patient is sufficiently competent to accept a treatment, but not sufficiently competent to refuse it. Though the main purpose of Lawlor’s paper was to distinguish this asymmetry from various other asymmetries with which it has sometimes been confused,1 Lawlor also presented a brief case in favour of it. Developing an earlier argument of Ian Wilks’,2 3 Lawlor argued that, when the risks associated with refusing a treatment are graver than those associated with accepting it, a higher level of competence may be required to refuse a treatment than to accept it. This claim could have important implications for the law, since determinations of competence often play a central role in determining the lawfulness of refusing or imposing a treatment. Indeed, the acceptance-refusal asymmetry in competence requirements, or something close to it, has played an important role in court judgments.2 However, Lawlor himself suggests that his conclusion will have practical implications only in a narrow range of cases.3 In this issue, Pickering, Giles Newton-Howes and Simon Walker respond to Lawlor’s piece.4 They deny that competence requirements should depend on the level of risk associated with a decision, and thus that there is any basis for the acceptance-refusal asymmetry in competence requirements. In his article, ‘Recovering Humanity: Movement, Sport, and Nature’, Doug Anderson addresses the place of endurance sport, or more generally sport at large, as a potential catalyst for the good life. Anderson contrasts transcendental themes of Henry David Thoreau and Ralph Waldo Emerson with the pragmatic claims of William James and John Dewey, who focus on human possibility and growth. Our aim is to pursue the pragmatic line of thought championed by James and Dewey as a contrasting but not mutually (...) exclusive motive to Anderson’s analysis. We contend that movement can provide humanizing possibilities even more pronounced for those subscribing to pragmatic themes (i.e., growth and the strenuous mood). We will use running and cycling to demonstrate how the strenuous mood enhances the possibility for this humanizing condition. Specifically, we argue that moving in a committed fashion allows us to deepen our relationship with the respective practice and thus opens the possibilities for ‘recovering our humanity’. (shrink)

The nature of the relationship between early modern political philosophy and revealed religion has been much debated. The contributors to Piety and Humanity argue that this relationship is one of dissonance rather than concord. They claim that the early modern political philosophers found revealed religion—especially Christianity—to be a threat to the modern political project, and that these philosophers therefore attempted to transform revealed religion so that it would be less of a threat, and possibly even an aid. Each essay is (...) devoted to a particular work by a single political philosopher; the thinkers and works discussed include Machiavelli's Exhortation to Penitence, Francis Bacon's New Atlantis, Spinoza's Theologico-Political Treatise, and Locke's Reasonableness of Christianity. Each essay is followed by a brief selected bibliography. This book will be of great importance to philosophers, political theorists, and scholars of religion and early modern European history. Fraud in the reward-based crowdfunding market has been of concern to regulators, but it is arguably of greater importance to the nascent industry itself. Despite its significance for entrepreneurial finance, our knowledge of the occurrence, determinants, and consequences of fraud in this market, as well as the implications for the business ethics literature, remain limited. In this study, we conduct an exhaustive search of all media reports on Kickstarter campaign fraud allegations from 2010 through 2015. We then follow up until (...) 2018 to assess the ultimate outcome of each allegedly fraudulent campaign. First, we construct a sample of 193 fraud cases, and categorize them into detected vs. suspected fraud, based on a set of well-defined criteria. Next, using multiple matched samples of non-fraudulent campaigns, we determine which features are associated with a higher probability of fraudulent behavior. Second, we document the short-term negative consequences of possible breaches of trust in the market, using a sample of more than 270,000 crowdfunding campaigns from 2010 through 2018 on Kickstarter. Our results show that crowdfunding projects launched around the public announcement of a late and significant misconduct detection (resulting in suspension) tend to have a lower probability of success, raise less funds, and attract fewer backers. The speech Against Euergos and Mnesiboulos describes a dispute over some naval gear. The dispute occurred early in the year 357/6 b.c. π' γαθοκλους ρχοντος, Dem. 47.44), when the speaker was a trierarch and supervisor of his symmory , and he refers to ‘the law of Periandros, by which the symmories were organized’ . There is no other specific reference to the law of Periandros. If 357/6 was the first year of its operation, it was probably passed in 358/7, but (...) that is not known for certain. The identity of the man is likewise uncertain, though it has plausibly been suggested that he was Periandros son of Polyaratos and that he was the Periandros who proposed an alliance between Athens and Arkadia in 362/1 . However, his identity is of no importance for the present article. Here I am concerned only to try to reconstruct what the law said about the symmories. Despite a great deal of modern discussion this question has still not been satisfactorily solved. The word συμμορα means ‘group’ or ‘division’ and does not necessarily have a technical or legal sense. But most of the Attic instances do have the special sense of a group of persons formed for the purpose of making payments of a compulsory tax or levy: either the property tax called εσορ, which was imposed at irregular intervals, or payments towards the maintenance of ships in the Athenian navy, which were required every year. A fragment of Philokhoros says that Athenians were divided κατ συμμορας for the first time in 378/7, and it is generally agreed that this means that symmories were first formed in 378 for the payment of eisphora. For the navy, however, there is no trace of symmories before the 350s, and everyone agrees that it was the law of Periandros which introduced the use of symmories for maintaining ships, which had previously been the sole responsibility of one trierarch or a pair of syntrierarchs for each ship. Persons who dial 911 are often able to foresee that the subsequent levels of force police employ will be excessive, disproportionate, and therefore wrongful. This might seem to justify the provocative thesis that persons who call the police against suspected unlawful aggressors act impermissibly and deserve some quantum of blame for what they have done. In this paper, I critically examine and ultimately reject this thesis and discuss several possible grounds on which it might be false.
