Science is not taken for granted any longer. Society, politics and the media pose critical questions tending to censorship or at least control of science. How does science respond? It cannot exist and develop without freedom, but this does not mean freedom to amass knowledge and apply technological applications at any price and without restrictions. Science should be autonomous, but is not value-free. A distintion is made between external and internal social/ethical problems. The former refer to questions of the (...) social/ethical context and consequences of scientific research, and the latter to the rules of ‘good practice’ and scientific integrity. The role of academies of science, and of associations of such academies (e.g. All European Academies (ALLEA)) in developing codes of good scientific practice and fostering a proper sense of scientific values and standards is further discussed. We are printing, by kind permission of the Law Commission, two sections of the report of the Law Commission on injuries to unborn children. This report was the result of a request to the Law Commission by the Lord Chancellor at the time (Lord Hailsham of Saint Marylebone) to advise on `what the nature and extent of civil liability for antenatal injury should be'. The Law Commission followed its usual practice in such circumstances of consulting various bodies and obtaining expert (...) advice on the subject and then embodying the results in a working paper (Working Paper No. 47 - injuries to unborn children) published on 19 January 1973, which preceded their report (Cmnd 5709). Meanwhile a Royal Commission is considering much wider issues of civil liability for injury (including antenatal injury) but the terms of reference for the Law Commission were much narrower and confined to the position of children injured before birth. In the section relating to the present law the report makes it clear that it is probable that liability under the common law already exists. The Scottish Law Commission has also issued a report (Cmnd 5371). They were given different terms of reference and came to somewhat different conclusions. We are printing from this long report the paragraphs discussing the medical background and the summary of recommendations. As will be evident on reading the paragraphs on the medical background to injuries to the unborn child, events are moving very rapidly, particularly in the study of congenital defects and the effects of drugs but the problems of proof present great difficulty. Other causes of injury to the unborn child are better known to the general public: for example, those following the illness, infection and disease of the mother during pregnancy, injury caused in attempted termination of pregnancy and the risks resulting from the mother's condition. The summary of the recommendations sets out very clearly the legal position of the unborn child, as the Law Commission sees it, arising from injury before birth, the final conclusion being that `legislation is desirable'. These extracts from the report, apart from their intrinsic interest, lead on to the paper by Mr Kennedy and Dr Edwards in which they set out their criticisms of it, and provide quick references to the original document. In late August 2002, a general practitioner in London, Dr Bhagat Singh Makkar, 62, was struck off the medical register after he was discovered to have bragged to an undercover journalist about being able to obtain a kidney from a live donor in exchange for a fee. He told the journalist, who posed as the son of a patient with renal failure: “No problem, I can fix that for you. Do you want it done here, do you want it done (...) in Germany or do you want it done in India?” The price he quoted included payment to the donor and “my administration costs”. Dr Makkar said he regretted giving “stupid answers” to the journalist. He had been “tired, confused, and upset after a long day dealing with emotional patients”.1Deliberation about ethics is often muddied by the personalities involved in a particular issue. Many people are uninspired by Richard Seed or Jack Kevorkian. This paper examines the impact that recent advances in clinical neurology, introspectionist psychology and neuroscience have upon the philosophical psycho?neural Identity Theory. Topics covered include (i) the nature and properties of phenomenal consciousness based on a study of the ?basic? visual field, i.e. that obtained in the complete dark, the Ganzfeld, and during recovery from occipital lobe injuries; (ii) the nature of the ?body?image? of neurology and its relation to the physical body; (iii) Descartes? error in choosing extension in space (...) as the criterion for distinguishing the physical and the mental; (iv) the technical distinction between sensing and perceiving; (v) why phenomenal Direct Realism is incorrect whereas epistemic DR and the representative theory are correct; (vi) the ontological and topological status of phenomenal space and physical space. This leads to considerations of the current ?binding problems? in neuroscience; the role of the brain mechanisms that construct the sensory fields of phenomenal consciousness; the ?homunculus? fallacy; the key difference between epistemic and non?epistemic perception as revealed by brain injury studies; and how the brain codes information, contrasting topological and vectorial coding, with particular reference to the binding problem. My conclusion is that the Identity Theory is incompatible with the scientific evidence from an integrated approach to modern introspectionist psychology, clinical neurology, and neuroscience. However, Cartesian Dualism is even more incompatible with the evidence. This leaves only two viable theories. The first is Bohr's theory of brain?consciousness complementarity. The second is the Broad?Price?Smythies theory of extension, which is a topological theory of the relation between phenomenal space and physical space. (shrink)

Ever since the publication of Dieu sans l’être in 1982, Jean-Luc Marion’s various pronouncements on the status and meaning of esse in Aquinas have excited a good deal of interest and controversy among Thomists. Marion’s evolving understanding of Thomistic metaphysics in general, and of Thomistic analogy in particular, has been commended for its openness to correction even as it has been criticized for what many still regard as its residual deficiencies. All such criticisms, however, neglect to take account of the (...) phenomenological provenance of Marion’s concerns, and to this extent they risk misunderstanding them. Ironically, Marion’s phenomenological approach to Aquinas intends to safeguard precisely what his Thomist critics think he has jettisoned: namely, our ability to speak about God in a way that says something meaningful—or perhaps better, reveals something meaningful—about God to us. The apophatic language Marionuses to make this point should be taken as a reminder to his fellow Christians who rightfully desire to speak of God about the danger that is involved in doing so. If we interpret Aquinas’s use of the divine names according to the phenomenological horizon of distance and thus think the various names of God “according to truly theological determinations,” Marion suggests, we can avoid the danger of lapsing into a conceptual idolatry of univocal predication that occludes their phenomenological disclosiveness. The recent translation into English of Jean-Luc Marion’s essay “Saint Thomas Aquinas and Onto-Theo-Logy” provides an opportunity to re-examine the significance of Marion’s earlier criticisms of Aquinas in the light of his most current position on Aquinas. Toward this end, I discuss the role that the doctrine of analogy plays in Marion’s reassessment, and partial retraction, of the controversial indictment of Aquinas that was presented in God without Being. Marion’s claim that the Thomistic conception of God as ipsum esse should (...) be understood by “starting from the distance of God” is highlighted in order to elucidate how, for Aquinas, the doctrine of analogy functions phenomenologically, as do the divine names generally, to manifest the character of God as infinite goodness and excessive givenness. Can non-human animals think, or arc they mindless automatons? The question is an ancient one, but as we enter the new millennium its answer is of increasing importance to both ethics and the philosophy of mind. Donald Davidson is perhaps the best known contemporary proponent of the claim that animals cannot think. His argument is characteristically systematic and far-reaching. He claims that the capacity for surprise is a necessary condition for thought, and that such a capacity presupposes complex attitudes involving (...) sophisticated concepts and higher-order beliefs. He argues that only creatures with a fully developed language could reasonably be said to be capable of such attitudes, and as such, he concludes that humans are the only animals that can think. I argue against Davidson along both positive and negative dimensions. First, I develop a simple argument designed to show that we have good reason to believe that even with several important Davidsonian assumptions in place, animals can think. Second, I argue that Davidson has failed to provide plausible support for his assumption that the capacity to be surprised is anything other than a sufficient condition for thought. Finally, I suggest that we distinguish between thought and rationality in the hopes of better capturing the wide diversity of mental landscapes. (shrink)

The case law surrounding surrogacy, in vitro fertilization, genetic donation, and legal parenthood is notoriously confused. Yet the issues involved in these cases are of fundamental importance to our most basic rights. To make matters worse, ongoing developments in technology continue to push the conceptual limits of both our legal and moral schemes. In this paper I argue that the concept of ‘parenthood’ is deeply ambiguous and attempt to carefully untangle the notion into two distinct concepts – one biological and (...) largely descriptive, and the other social and profoundly normative. I argue that the social notion of parenthood is a complex function of intentions, actions, and emotional states. It is a concept both defined and constrained by social norms. The biological notion of parenthood, for its part, cannot be understood in strictly genetic terms. I offer, instead, a more fleshed out view that treats biological parenthood as a family resemblance concept. Finally, I discuss the role of gestation in the context of a powerful feminist critique and argue that although gestation is a biological phenomenon, it is a mistake to think that its relevance is limited to biology. In fact, what is special about gestation, in the context of parenthood and obligation, is its distinctly social role. By shifting the discussion of gestation away from biology and toward the realm of the social, we can make better sense of the disputes that manifest themselves in the literature and in the law. Objectives - To explore the wvay ethical principles develop during a medical education course for three groups of medical students - in their first year, at the beginning of their penultimate (fifth) year and towards the end of their final (sixth) year. Design - Survey questionnaire administered to medical students in their first, fifth and final (sixth) year. Setting - A large medical school in Queensland, Australia. Survey sample - Approximately half the students in each of three years (first, fifth (...) and sixth) provided data on a voluntary basis, a total of 385 students. Results - At the point of entry, minor differences were found between medical students and first year law and psychology students. More striking were differences between male and female medical students, suggesting early socialization had a substantial impact here. Conclusions - Results indicate that substantial changes in attitude have developed by the beginning of fifth year with little change thereafter. Gender difference persisted. Some difference in ethical attitudes were found when groups of different ethnic backgrounds were compared. The impact of a move to a graduate medical course, which gives high priority to ethics within a professional development domain, can now be evaluated. (shrink)

The issue of directed donation of organs from deceased donors for transplantation has recently risen to the fore, given greater significance by the relatively stagnant rate of deceased donor donation in the UK. Although its status and legitimacy is explicitly recognized across the USA, elsewhere a more cautious, if not entirely negative, stance has been taken. In England, Wales and Northern Ireland, the Human Tissue Act 2004, and in Scotland the Human Tissue (Scotland) Act 2006, are both silent in this (...) regard. Although so-called conditional donation, donation to (or perhaps withheld from) a specific class, has been outlawed as a product of guidance issued by the Secretary of State for Health issued in the wake of the controversial incident occurring in the North of England in 1998, its intended application to ‘directed’ donation is less certain. Directed and conditional donations challenge the traditional construct of altruistic donation and impartial (equitable) allocation in a very immediate and striking fashion. They implicitly raise important questions as to whether the body or parts of the body are capable of being owned, and by whom. This paper attempts to explore the notion of donor ownership of body parts and its implications for both directed and conditional donation. (shrink)

Historically, scientists in training have learned the rules of ethical conduct by the example of their advisors and other senior scientists and by practice. This paper is intended to serve as a guide for the beginning scientist to some fundamental principles of scientific research ethics. The paper focuses less on issues of outright dishonesty or fraud, and more on the positive aspects of ethical scientific behavior; in other words, what a scientist should do to maintain a high level of ethical (...) conduct in research.There are a number of fairly specific rules, guidelines, or commonly accepted operating principles that have evolved for the ethical conduct of science. In order to discuss this code of ethics, this paper is divided into sections dealing with specific areas of scientific ethics. These areas are: data collection and storage, ownership of data, confidentiality, communication, authorship, collaboration, the peer review system, and rules of dealing with ethical complaints. Illustrative case histories are presented to provide examples of the type of ethical dispute or problem being discussed. If scientific trainees learn the accepted rules of behavior that govern the conduct of science, ethical problems that arise out of ignorance, misunderstanding, or poor communication can be avoided. Manipulations that draw attention to extensional or set-based considerations are neither sufficient nor necessary for enhanced use of base rates in intuitive judgments. Frequency formats are only one part of the puzzle of base-rate use and neglect. The conditions under which these and other manipulations promote base-rate use may be more parsimoniously organized under the broader notion of case-based judgment.
