The integrative memory model combines five core memory systems with an attributional system. We agree with Bastin et al. that this melding is the most novel aspect of the model. But we await further evidence that the model's substantial complexity informs our understanding of false memories or of the development of recollection and familiarity.

The last decade or so has seen an explosion of scholarship by American law professors on what has become known as administrative constitutionalism. Administrative constitutionalism is a catchphrase for the role of administrative agencies in influencing, creating, and establishing constitutional rules and norms, and governing based on those rules and norms. Though courts traditionally get far more attention in the scholarly literature and the popular imagination, administrative constitutionalism scholars show that administrative agencies have been extremely important participants in American constitutional (...) development. Section I of this essay identifies three different versions of administrative constitutionalism—(1) Engagement with Existing Constitutional Doctrine; (2) Resolving Questions of Statutory Meaning that Implicate Constitutional Questions; and (3) Shadow Administrative Constitutionalism—and provides examples from the scholarly literature to illustrate these distinct manifestations of administrative constitutionalism. Section II of this essay discusses the normative turn in administrative constitutionalism scholarship. Much of this normative literature is implicitly or explicitly premised on the notion that agencies are more likely to pursue progressive goals than are other government actors. Section III of this essay disputes the notion that agency constitutional decision-making is “democratic” and that agencies are naturally inclined to serve progressive goals. Finally, Section IV of this essay notes that scholars who support broad agency autonomy to work out and enforce their own constitutional visions have failed to consider how their work fits in with the economic and political science literature on agency behavior. One can predict, based on that literature, that agencies given broad autonomy under the guise of administrative constitutionalism will primarily be inclined to expand their scope and authority at the expense of countervailing considerations. ABSTRACTPrevious research suggests that labelling emotions, or describing affective states using emotion words, facilitates emotion regulation. But how much labelling promotes emotion regulation? And which emotion regulation strategies does emotion labelling promote? Drawing on cognitive theories of emotion, we predicted that labelling emotions using fewer words would be less confusing and would facilitate forms of emotion regulation requiring more cognitively demanding processing of context. Participants mentally immersed themselves in an emotional vignette, were randomly assigned to an exhaustive or minimal emotion (...) labelling manipulation, and then completed an emotion regulation strategy planning task. Minimal emotion labelling promoted higher subjective emotional clarity. Furthermore, in terms of specific emotion regulation strategies, minimal emotion labelling prompted more plans for problem solving and marginally more plans for reappraisal, but did not affect plans for behav... The right to join with other people to promote a particular outlook, known as the right of expressive association, is a necessary adjunct to the right of freedom of speech, which is protected by the First Amendment of the United States Constitution. Freedom of speech would be of little practical consequence if the government could suppress ideas by bluntly prohibiting individuals from gathering with others who share their perspective. A Conversation with Claire Katz about her book, Levinas and the Crisis of Humanism.

Various approaches have emerged over the last several decades to meet the challenges and complexities of anticipating and responding to the potential impacts of emerging technologies. Although many of the existing approaches share similarities, they each have shortfalls. This paper takes as the object of its study Anticipatory Ethics for Emerging Technologies (ATE) to technology assessment, given that it was formatted to address many of the privations characterising parallel approaches. The ATE approach, also in practice, presents certain areas for retooling, (...) such as how it characterises levels and objects of analysis. This paper results from the work done with the TechEthos Horizon 2020 project in evaluating the ethical, legal, and social impacts of climate engineering, digital extended reality, and neurotechnologies. To meet the challenges these technology families present, this paper aims to enhance the ATE framework to encompass the variety of human processes and material forms, functions, and applications that comprise the socio-technical systems in which these technologies are embedded. Ayn Rand's first novel, We the Living, offers an early form of the author's nascent philosophy—the philosophy Rand later called Objectivism. Robert Mayhew's collection of entirely new essays brings together pre-eminent scholars of Rand's writing. In part a history of We the Living, from its earliest drafts to the Italian film later based upon it, Mayhew's collection goes on to explore the enduring significance of Rand's first novel as a work both of philosophy and of literature.

BackgroundAs a number of commentators have noted, SARS exposed the vulnerabilities of our health care systems and governance structures. Health care professionals (HCPs) and hospital systems that bore the brunt of the SARS outbreak continue to struggle with the aftermath of the crisis. Indeed, HCPs – both in clinical care and in public health – were severely tested by SARS. Unprecedented demands were placed on their skills and expertise, and their personal commitment to their profession was severely tried. Many were (...) exposed to serious risk of morbidity and mortality, as evidenced by the World Health Organization figures showing that approximately 30% of reported cases were among HCPs, some of whom died from the infection. Despite this challenge, professional codes of ethics are silent on the issue of duty to care during communicable disease outbreaks, thus providing no guidance on what is expected of HCPs or how they ought to approach their duty to care in the face of risk.DiscussionIn the aftermath of SARS and with the spectre of a pandemic avian influenza, it is imperative that we (re)consider the obligations of HCPs for patients with severe infectious diseases, particularly diseases that pose risks to those providing care. It is of pressing importance that organizations representing HCPs give clear indication of what standard of care is expected of their members in the event of a pandemic. In this paper, we address the issue of special obligations of HCPs during an infectious disease outbreak. We argue that there is a pressing need to clarify the rights and responsibilities of HCPs in the current context of pandemic flu preparedness, and that these rights and responsibilities ought to be codified in professional codes of ethics. Finally, we present a brief historical accounting of the treatment of the duty to care in professional health care codes of ethics.SummaryAn honest and critical examination of the role of HCPs during communicable disease outbreaks is needed in order to provide guidelines regarding professional rights and responsibilities, as well as ethical duties and obligations. With this paper, we hope to open the social dialogue and advance the public debate on this increasingly urgent issue. (shrink)

The INBIOSA project brings together a group of experts across many disciplines who believe that science requires a revolutionary transformative step in order to address many of the vexing challenges presented by the world. It is INBIOSA’s purpose to enable the focused collaboration of an interdisciplinary community of original thinkers. This paper sets out the case for support for this effort. The focus of the transformative research program proposal is biology-centric. We admit that biology to date has been more fact-oriented (...) and less theoretical than physics. However, the key leverageable idea is that careful extension of the science of living systems can be more effectively applied to some of our most vexing modern problems than the prevailing scheme, derived from abstractions in physics. While these have some universal application and demonstrate computational advantages, they are not theoretically mandated for the living. A new set of mathematical abstractions derived from biology can now be similarly extended. This is made possible by leveraging new formal tools to understand abstraction and enable computability. [The latter has a much expanded meaning in our context from the one known and used in computer science and biology today, that is "by rote algorithmic means", since it is not known if a living system is computable in this sense (Mossio et al., 2009).] Two major challenges constitute the effort. The first challenge is to design an original general system of abstractions within the biological domain. The initial issue is descriptive leading to the explanatory. There has not yet been a serious formal examination of the abstractions of the biological domain. What is used today is an amalgam; much is inherited from physics (via the bridging abstractions of chemistry) and there are many new abstractions from advances in mathematics (incentivized by the need for more capable computational analyses). Interspersed are abstractions, concepts and underlying assumptions “native” to biology and distinct from the mechanical language of physics and computation as we know them. A pressing agenda should be to single out the most concrete and at the same time the most fundamental process-units in biology and to recruit them into the descriptive domain. Therefore, the first challenge is to build a coherent formal system of abstractions and operations that is truly native to living systems. Nothing will be thrown away, but many common methods will be philosophically recast, just as in physics relativity subsumed and reinterpreted Newtonian mechanics. -/- This step is required because we need a comprehensible, formal system to apply in many domains. Emphasis should be placed on the distinction between multi-perspective analysis and synthesis and on what could be the basic terms or tools needed. The second challenge is relatively simple: the actual application of this set of biology-centric ways and means to cross-disciplinary problems. In its early stages, this will seem to be a “new science”. This White Paper sets out the case of continuing support of Information and Communication Technology (ICT) for transformative research in biology and information processing centered on paradigm changes in the epistemological, ontological, mathematical and computational bases of the science of living systems. Today, curiously, living systems cannot be said to be anything more than dissipative structures organized internally by genetic information. There is not anything substantially different from abiotic systems other than the empirical nature of their robustness. We believe that there are other new and unique properties and patterns comprehensible at this bio-logical level. The report lays out a fundamental set of approaches to articulate these properties and patterns, and is composed as follows. -/- Sections 1 through 4 (preamble, introduction, motivation and major biomathematical problems) are incipient. Section 5 describes the issues affecting Integral Biomathics and Section 6 -- the aspects of the Grand Challenge we face with this project. Section 7 contemplates the effort to formalize a General Theory of Living Systems (GTLS) from what we have today. The goal is to have a formal system, equivalent to that which exists in the physics community. Here we define how to perceive the role of time in biology. Section 8 describes the initial efforts to apply this general theory of living systems in many domains, with special emphasis on crossdisciplinary problems and multiple domains spanning both “hard” and “soft” sciences. The expected result is a coherent collection of integrated mathematical techniques. Section 9 discusses the first two test cases, project proposals, of our approach. They are designed to demonstrate the ability of our approach to address “wicked problems” which span across physics, chemistry, biology, societies and societal dynamics. The solutions require integrated measurable results at multiple levels known as “grand challenges” to existing methods. Finally, Section 10 adheres to an appeal for action, advocating the necessity for further long-term support of the INBIOSA program. -/- The report is concluded with preliminary non-exclusive list of challenging research themes to address, as well as required administrative actions. This essay originated as a reply to Richard Rorty's ”Habermas, Derrida, and the Functions of Philosophy“. In it, I contest Rorty's deployment of the categories of private selfcreation and the collective political enterprise of increasing freedom, first developed in Contingency, Irony and Solidarity, to demonstrate that the philosophical projects of Habermas and Derrida are complementary rather than antagonistic. The focus of my critique is two-fold: firstly, I contend that so-called critiques of metaphysics are always simutaneously engaging with some form of (...) social domination or disintegration (e.g. nihilism or societal rationalization); secondly, I argue that the fault-line in Rorty's thought that structures his categories is his, Davidson inspired, naturalized philosophy of language. This philosophy of language falls afoul of Heidegger's analysis of the present-to-hand. (shrink)

This paper attempts to explore the problem of collective identity and its subsequent historical legacies through a reading of Spinoza’s and Freud’s respective accounts of Moses. In working their way through the aggadah (i.e., legend) of Moses, both Spinoza and Freud find the halakhic (i.e., legal) core of collectivity to be expressed in and as social mediation. Moreover, both thinkers discover that the occlusion of this core leads to a collective trauma (in Freud’s sense), the symptom of which is the (...) formation of the ‘theological-political’ (in Spinoza’s sense). In reflecting on them Bernstein has played an intermediary role between the most recognizable product of American philosophical tradition, i.e. Pragmatism, and such central trends in European 20th century thought as Marxism, Psychoanalysis, Critical Theory, and Hermeneutics. States, Europe, and Latin America pays tribute to Bernstein's lifelong reflection on such present human problems as: the achievements and the dilemmas of modern societies, the legitimation crisis of democracy, the uses and abuses of public space, the role of scientific knowledge and technology in shaping the modern life, the ethical and political interplay between identity and community, and the preconditions and limits of understanding in multicultural contexts. More like a reenactment of the possibilities of performative poetics as improvisatory, open-ended.As a way to engage the relation of poetics to poetry and by implication differentiate poetics from literary theory and philosophy, although not necessarily from poetry.As a way to extend the ideas about closure—the rejection of closure—into the discussion of essays and critical writing.To eject, that is, the idea that there is something containable to say: completed saying.So that poetics becomes an activity that (...) is ongoing, that moves in different directions at the same time, and that tries to disrupt or make problematic any formulation that seems too final or preemptively restrictive.Speaking at the Buffalo conference, Linda Reinfeld pointed to the wedding that was being enacted between critical theory and poetry as a kind of subtext of that gathering. Hearing Rosmarie Waldrop read, in that context, from Reproduction of Profiles suggested something very much along these lines: Waldrop has created a literary wedding, in the sense of wedding together, or fusing, of philosophy and poetry. In this work, she has taken phrases from Elizabeth Anscombe’s translation of Ludwig Wittgenstein’s Philosophical Investigations and added—weaved in—phrases of her own making. The structure of Reproduction of Profiles provokes a number of questions, including the status of Wittgenstein’s original text, which may itself be taken as a poetic work, and also the status of the Reproduction of Profiles—what kind of a work is that? Charles Bernstein is the author of a number of books of poetry, including Rough Trades, The Nude Formalism, The Lives of the Toll Takers, The Sophist, and Controlling Interests. The origin of homochirality in molecules characterizing living systems has remained a mystery since Pasteur's recognition of the problem some 150 years ago.2-5 Most theories also assume that homochirality emerged in one class of molecules (e.g. ribose) from which it was enriched in other molecules (e.g. amino acids) as well.2-5 I propose a novel, experimentally testable hypothesis describing a process by which selective chirality in amino acids and ribonucleotides emerged simultaneously and hand-in-hand with the origin and directionality of the genetic (...) code within a system of interactions involving amino acids, peptides, nucleotide bases, their sugars and polynucleotides. The US neutrino community gathered at the Workshop on the Intermediate Neutrino Program at Brookhaven National Laboratory February 4-6, 2015 to explore opportunities in neutrino physics over the next five to ten years. Scientists from particle, astroparticle and nuclear physics participated in the workshop. The workshop examined promising opportunities for neutrino physics in the intermediate term, including possible new small to mid-scale experiments, US contributions to large experiments, upgrades to existing experiments, R&D plans and theory. The workshop was organized into (...) two sets of parallel working group sessions, divided by physics topics and technology. Physics working groups covered topics on Sterile Neutrinos, Neutrino Mixing, Neutrino Interactions, Neutrino Properties and Astrophysical Neutrinos. Technology sessions were organized into Theory, Short-Baseline Accelerator Neutrinos, Reactor Neutrinos, Detector R&D and Source, Cyclotron and Meson Decay at Rest sessions.This report summarizes discussion and conclusions from the workshop. This article discusses ethical questions in neurosurgery as falling into two categories, namely those surrounding what neurosurgeons are currently doing, i.e. their current practices, and those surrounding what neurosurgeons will, theoretically, be capable of doing in the future, i.e. their future practices. It reveals the current and emerging applications of functional neurosurgery as well as the future controversies that will stem from them. It focuses on psychosurgery, enhancement and the brain–machine interface, in order to illustrate the pertinent ethical challenges and (...) the role of the neurosurgeon in helping to address them. These three applications represent natural extensions of each other, as an exploration of the underlying mechanisms of psychopathology will ultimately provide insight into normal brain function. Concerns about the future of implantable technology, and the neurosurgeon's role in installing it, need to be addressed. (shrink)

ABSTRACT This article deals with the economic foundation of the critical theory presented by Guy Debord in “The society of the spectacle” (1967). At this point, the fundamental thesis of this theory is that advanced capitalism would have dominated the crisis tendencies through State action. This action would not express the autonomy of politics over the economy, but rather the autonomous movement of the fetishist economy acting consciously in the State. Following Debord, the article tries to show how this theoretical (...) conception retakes the philosophical terms of Rosa Luxemburg and Eduard Bernstein’s debate on the capitalist crisis, in the beginning of the 20th century, positioning itself in regard to this issue in a very unique way. Hermeneutics, as a discipline of the humanities, is often assumed to be in thrall to the same subjectivity of every interpretive method, in direct contract to the objectivity prized by the natural sciences. This book argues that there is a false dichotomy here, and that ancient and modern ideas of knowledge can be utilized to create a new active form of hermeneutics. One capable of creating a standard by which to judge better and worse models of understanding. This book explores (...) decisive aspects over which the future of hermeneutics-a future inexplicably tied to a history of hermeneutics-will continue to struggle, namely the limits and possibilities of situated human understanding. This book is located in the middle of a number of major, converging discussions within contemporary intellectual discourse. Drawing upon a wide range of ancient and modern hermeneutical thought, including Aristotle, Bernstein, Heidegger, Kant, and Gadamer, the result is a hermeneutical approach that pushes beyond the traditional limits of human understanding. This is a bold attempt to move hermeneutics into a new phase. As such, it will be of significant interest to scholars and academics working in General Hermeneutics, Theology, and the Philosophy of Religion. (shrink)

Cognition means different things to different psychologists depending on the position held on the mind-matter problem. Ecological psychologists reject the implied mind-matter dualism as an ill-posed theoretic problem because the assumed mind-matter incommensurability precludes a solution to the degrees of freedom problem. This fundamental problem was posed by both Nicolai Bernstein and James J. Gibson independently. It replaces mind-matter dualism with animal-environment duality -- a better posed scientific problem because commensurability is assured. Furthermore, when properly posed this way, a (...) conservation law is suggested that encompasses a psychology of transactional systems, a biology of self-actional systems, and a physics of interactional systems. For such a solution, a theory of cognition for goal-directed behaviour is needed. A sketch is supplied for how such a theory might be pursued in the spirit of the new physics of evolving complex systems. (shrink)
