Despite apparent political concern and action—often fuelled by high-profile cases and campaigns—legislative and institutional responses to image-based sexual abuse in the UK have been ad hoc, piecemeal and inconsistent. In practice, victim-survivors are being consistently failed: by the law, by the police and criminal justice system, by traditional and social media, website operators, and by their employers, universities and schools. Drawing on data from the first multi-jurisdictional study of the nature and harms of, and legal/policy responses to, image-based sexual abuse, (...) this article argues for a new joined-up approach that supports victim-survivors of image-based sexual abuse to ‘reclaim control’. It argues for a comprehensive, multi-layered, multi-institutional and multi-agency response, led by a government- and industry-funded online or e-safety organisation, which not only recognises the diversity of victim-survivor experiences and the intersection of image-based sexual abuse with other forms of sexual and gender-based violence and discrimination, but which also enables victim-survivors to reclaim control within and beyond the criminal justice system. In January 2004 Baroness Brenda Hale became the first woman to sit on the Appellate Committee of the House of Lords. Five years on, she has brought to her judicial role a lightness of touch that belies her increasingly significant impact on the court’s jurisprudence. Early forecasts that she would be “just a bit different” from her male companions have proved prophetic. However such assessments have stemmed primarily from a focus on her decision-making on a case-by-case basis. But what of (...) her jurisprudence as a whole? This paper considers arguments for a more sustained and coherent methodological approach to analyses of Baroness Hale’s (and other judges’) jurisprudence as a framework through which to better understand and explore the potential of judicial difference and to better inform current debates about increasing judicial diversity in England and Wales. In the last few years, many countries have introduced laws combating the phenomenon colloquially known as ‘revenge porn’. While new laws criminalising this practice represent a positive step forwards, the legislative response has been piecemeal and typically focuses only on the practices of vengeful ex-partners. Drawing on Liz Kelly’s pioneering work, we suggest that ‘revenge porn’ should be understood as just one form of a range of gendered, sexualised forms of abuse which have common characteristics, forming what we are conceptualising (...) as the ‘continuum of image-based sexual abuse’. Further, we argue that image-based sexual abuse is on a continuum with other forms of sexual violence. We suggest that this twin approach may enable a more comprehensive legislative and policy response that, in turn, will better reflect the harms to victim-survivors and lead to more appropriate and effective educative and preventative strategies. Rackley (bio)Fahrenberg and Cheetham have conducted an immensely thought-provoking study of the assumptions about human nature made by 800 students and pose a question about the future impact of these assumptions on individuals’ practice in professions including medicine and psychotherapy.This work represents a branch of “philosophical anthropology,” which considers assumptions people make about human nature. The authors used (...) a questionnaire, much of which was newly designed, to assess the assumptions made by university students studying psychology, philosophy, sciences, and other disciplines. Most of the respondents were studying at Freiburg, but some were sampled at several other universities in both the former East and West Germanies. Questions involved consciousness and the brain, evolution, free will, belief in God, the meaning of life, and theodicy.Given the importance of these beliefs and assumptions in so many peoples’ lives, it is quite surprising that there are so few modern data available, and this study ventures an important first step in assessing these assumptions. However, there are many problems inherent in this study (and any like it).The first, for us, is the validity of the questionnaire itself, an issue that was not specifically addressed in the paper. Face validity is a problem even in the few questions quoted directly in the paper. For example, some statements contain two clauses, and one could well agree with one without agreeing with another: “I do not know whether a God exists and I do not believe it is possible to know.” This is the most relevant answer for a true agnostic, but the assumption that “I do not know whether a God exists” does not necessarily link at all with “I do not believe it is possible to know.” Similarly, a theist might have trouble with the two clauses, “I know God really exists” and “I do not doubt this.” (Technically, knowledge does imply a lack of doubt, but belief certainly does not.) Particularly in the trilemmas, where various patterns of response were analyzed, these multiple-clause statements may have led students to respond in a manner inconsistent with their true beliefs and assumptions. Furthermore, many of the questions contain terms that may have been unfamiliar to first-year university students. The authors explain their rationale in not defining terms, but the lack of clarity about definitions may have led some of the students to not fully understand the questions asked and to perhaps influence the answers they chose.Misunderstanding of the questions may account for some of the disparities reported in the results. Other apparent inconsistencies, however, do not seem to be a result of unclear questions. For example, sixty percent of the students agreed with the statement that “I believe in … existence after death,” whereas forty-seven percent agreed with the statement that “when my brain is dead my consciousness and my person cease to be.” These [End Page 203] findings do not add up, and this study has several similar sets of data. People contradict themselves in long and complex questionnaires, and this may be a simple explanation for these findings, but is this the only explanation? How seriously did the students take the questionnaire, often given as part of their class? How honest were their responses?How generalizable are the findings of this study? It is very difficult even to speculate about this. The statistics are incomprehensible in light of the data given, and one must essentially take them on faith, wherever one falls on the God/theodicy questions. The design has many flaws, but we do learn how a subsample of German university students rate important factors about the meaning of life. Statements are made in the paper that the students’ results correlate with similar results for the general population, but this assertion seems to be based on a very few questions. One would like much more delineation of this apparent correlation, because we wonder about the juxtaposition of developmental factors with the answers the students gave to this questionnaire. First-year university students are at a critical developmental point, and it would be fascinating to follow this large cohort of students over time to see whether... (shrink)

Philippus Aureolus Theophrastus Bombastus von Hohenheim, or Paracelsus, was a renowned physician and naturalist, reformer of Galenic medicine, and violent opponent of scholasticism. His writings and teachings were contemporaneous with the Lutheran reformation and the northern Renaissance humanism of Cornelius Agrippa and Erasmus. Paracelsus’s rejection of ancient wisdom and the classicist philology of his day as viable avenues of knowledge, however, contradicts the Renaissance humanist epithet sometimes associated with him. Though traditionally painted as a “lonely genius” and a “martyr of (...) natural science” for his fractious relations with the medical establishments of his day, and thereby crowned as an agent of progress and a precursor of modern science, Paracelsian natural philosophy owes far more to mystical intuition than to any experimental scientific method currently understood. In this respect he was as much an influence on German mystics such as Jacob Boehme and later German Romanticism as he was on J. B. von Helmont, the seventeenth century Paracelsian chemist who first articulated the concept of ‘gas’. However, Paracelsian thought does not readily conform either to the Reformation or to Renaissance humanism, the two landmarks convenient to a general appreciation of the intellectual landscape in his day. Of course, such historical labels are the products of hindsight, and held little or no meaning among thinkers of the day: any attempt to define Paracelsus’ thought according to such a continuum is moot. He is best appreciated as an iconoclast: an eclectic non-partisan. As the author of the present study claims, Paracelsus was “an errant star in the firmament of sixteenth century aspirations” ; later in the work he emerges as “an idiosyncratic creature of the early Reformation”. It suggests thatPortia has both captured and is captured by thefeminist legal scholar's imagination, becomingat once an idol, myth and icon. She is to somethe personification of the woman lawyer'sperceived difference, a mouthpiece for mercyand `the different voice' and to others, a shamor myth, her idolised reputation sullied, her`difference' rejected. Yet ultimately thisconstant and simultaneous idolisation andvilification of Portia (...) threatens not only tosilence and constrain conversations about thewoman lawyer, but also to eclipse her promiseand potential. Thus in the final section of thepaper, Portia is established as an icon. Assuch her story, understood as a myth or fairytale, is seen to reveal previously unimaginedpossibilities for change, as an iconicunderstanding of Portia becomes a windowthrough which feminist legal scholars can lookonto alternative understandings of lawyeringand adjudication. Though available for some time, this specialized Encyclopedia has received relatively scant attention in the philosophical press. Husserl Studies and Alter have printed in-depth reviews, but the concision and probity of the 166 entries comprising the volume, authored by leading specialists from the increasingly international phenomenological movement, merits further assessment. Under the direction of chief editor Lester Embree of the Center for Advanced Research in Phenomenology and ten assistant editors, the Encyclopedia is the product of a five-year gestation period of (...) research, writing, and editing. Embree briefly details the history and structure of the volume in a two-page preface. In a ten-page introduction, Embree and J.N. Mohanty explain phenomenology through five broad tendencies common to all phenomenological schools, and acknowledge four primary fields of endeavor: realistic, constitutive, existential, and hermeneutical phenomenology. This is followed by a cursory history of phenomenology, its early relation to neo-Kantianism, and the three twentieth century philosophical movements with which phenomenology, in Husserl’s wake, has had fruitful encounter: Marxism, psychoanalysis, and analytic philosophy. Il est une caractéristique qui se trouve universellement (...) dans toutes les religions. Le sacré, être collectif et impersonnel, représente ainsi la société elle-même. Ensuite il argumente que la société a un impact majeur dans la genèse de la pensée logique. É bem conhecida a oposição estabelecida por Kant entre experiência possível e dialética, na medida em que esta última é caracterizada como a “lógica da ilusão”. Ao mesmo tempo, o modo de pensar metafísico, que ocorre dialeticamente, em sentido kantiano, é uma tendência inevitável da razão, expressa na exigência formal de completude das categorias. Como o pensar, enquanto exercício livre da razão, é em si mesmo mais amplo do que a atividade de conhecer, própria do entendimento, o pensar contém o (...) conhecimento, embora este se qualifique pelas regras e pelos limites determinantes da objetividade. A pergunta que tentaremos formular é se essa relação continente-conteúdo não poderia configurar também uma dependência da experiência em relação ao raciocínio dialético, que estaria de algum modo indicada na função reguladora das idéias da razão. Nesse caso, a oposição formal entre conhecer e pensar seria inseparável da inclusão estrutural (dependência) da experiência no âmbito da razão. Na raiz do problema estaria talvez a tensão (dialética) entre a aspiração subjetiva de totalidade e as exigências objetivas de limitação e segmentação da experiência e a forma da experiência teria de ser finalmente concebida a partir de um fundo de inteligibilidade problemática. Dialectics and experienceThe separation of possible experience as objective knowledge and dialetics as a non-objective or non-theoretical knowledge is one of the most important aspects of kantian critical philosophy. But Kant also says that the activity of reason, as a pure thinking, has more amplitude than understanding knowledge. So we could say that theoric knowledge would depend on rational ( and non-theoretical) knowledge, as something contained in it. If we accept that, the consequence would be a relation of dependence between the form of objective knowledge and the background of a problematic – even doubtful – inteligible knowledge. (shrink)

Em artigo inédito, Franklin Leopoldo e Silva desenvolve os sentidos da memória na produção da identidade, destacando as relações significativas do presente com o passado e o futuro na construção da história. Desse ponto, o autor acentua o papel das instituições nesse processo – um processo de exercício de poder, no qual se tem, na verdade, a institucionalização do poder – e, dentre elas, em particular a instituição universitária.

Revijo je izdajala Bromsgrove School, kjer se je šolal kot najstnik (1870–77); na šolo, ki je prva prepoznala njegov jezikovni in pesniški talent, se je za kratek čas (1881–82) vrnil kot pomožni učitelj po ne­pričakovanem študijskem porazu na Oxfordu. Kot ugotavlja Ralph Marcellino, ni naključje, da besedilo paro­dira predvsem Ajshila, ki je bil (...) Housmanov najljubši pesnik. V njem odzvanja Oresteja, zlasti drami Agamemnon in Prinašalke pitnih darov, verjetno zato, ker so ju dijaki na šoli, kjer je poučeval, pri pouku največ brali. Prav ta ciljna publika je znala ceniti norčevanje iz retoričnih figur ter sintaktičnih konstrukcij, ki jim jih je njihov pomožni učitelj vbijal v glavo. (shrink)

O presente artigo visa analisar, a partir do pensamento do filósofo Michel Foucault, o exercício da liberdade sob uma perspectiva ética, no âmbito do estoicismo tardio. Liberdade essa que se faz possível a partir do cuidado de si, por meio de exercícios regulares que possibilitam ao indivíduo viver a vida como arte. Com efeito, é na prática do cuidado de si, que o indivíduo se coloca como transformador do mundo e de si mesmo, o qual dá-se no encontro com o (...) outro, longe de ser uma experiência solitária com o próprio eu, realiza-se na associação com outrem. Todos os estudos aqui reunidos tratam de algo a que se pode chamar clima renascentista de opiniões sobre a arte, além da influência desse clima sobre a prática e a crítica da arte.

Wittgenstein’s concepts shed light on the phenomenon of schizophrenia in at least three different ways: with a view to empathy, scientific explanation, or philosophical clarification. I consider two different “positive” wittgensteinian accounts―Campbell’s idea that delusions involve a mechanism of which different framework propositions are parts, Sass’ proposal that the schizophrenic patient can be described as a solipsist, and a Rhodes’ and Gipp’s account, where epistemic aspects of schizophrenia are explained as failures in the ordinary background of certainties. I argue that (...) none of them amounts to empathic-phenomenological understanding, but they provide examples of how philosophical concepts can contribute to scientific explanation, and to philosophical clarification respectively. Los recientes desarrollos de la inteligencia artificial generativa suponen desafíos a conceptos tradicionales del Derecho, uno de ellos es el de autoría. El problema que aborda este trabajo es cómo concebir la autoría de una obra escrita por una inteligencia artificial generativa en la que la intervención humana, en cuestiones de estilo y contenido, es nula o mínima. Para ello se enumeran casos recientes en los que se plantea ese problema a partir de artículos escritos empleando ese tipo de tecnología. (...) Pero el objetivo del trabajo es la revisión de la concepción de autoría que subyace a las normativas internacionales que regulan la propiedad intelectual y los presupuestos éticos que las justifican (la concepción de Locke, la concepción romántica y la concepción utilitarista). Sobre la base de una lectura de “¿Qué es un autor?” de Michel Foucault se sostiene que la noción de autoría cumple una función social que, al menos al estado del arte de la inteligencia artificial generativa, esta no puede cumplir y, por tanto, no debe ser reconocida como autora de las obras mencionadas. Concluyendo que las obras literarias elaboradas por inteligencia artificial generativa multipropósito con nula o escasa intervención humana deben ser consideradas como obras de dominio público. O objetivo deste texto é explorar aproximações e divergências no pensamento de Paulo Freire e Ivan Illich na forma como eles vêem a relação entre educação e transformação social. Acredita-se que a retomada da polêmica Freire e Illich sobre o problema educação e transformação social pode contribuir para melhor compreender e esclarecer a verdadeira natureza desse problema, já clássico na história da educação moderna.
