James cornman and r routley and v macrae have argued that the principle of identity (alias leibniz's law) is inconsistent with certain plausible and widely accepted identity statements; e.G., "the temperature of a gas is identical with the mean kinetic energy of the molecules of the gas." they argue on this ground that the principle of identity should be modified to remove this appearance of inconsistency. The requisite modification however, Removes whatever "metaphysical teeth" the unmodified version might have had. The Earlier Letters of John Stuart Mill, published in two volumes in 1963, were well received by critics and scholars alike. The publication of these four volumes of later letters completes this edition of Mill's personal correspondence. These volumes contain over 1,800 letters, most never before published, and some sixty earlier letters that have come to light since the publication of the first two volumes of correspondence. The letters have been assembled from widely dispersed collections in the libraries of (...) fifty-eight institutions and of some thirty private collections in Britain and in other countries of the Commonwealth, Europe, and North America. In addition, many personal letters of which no originals sirvived have been located in contemporary periodicals or biographies of Mill's correspondence. (shrink)

BackgroundCentral to ethically justified clinical trial design is the need for an informed consent process responsive to how potential subjects actually comprehend study participation, especially study goals, risks, and potential benefits. This will be particularly challenging when studying deep brain stimulation and whether it impedes symptom progression in Parkinson’s disease, since potential subjects will be Parkinson’s patients for whom deep brain stimulation will likely have therapeutic value in the future as their disease progresses.MethodAs part of an expanded informed consent process (...) for a pilot Phase I study of deep brain stimulation in early stage Parkinson’s disease, an ethics questionnaire composed of 13 open-ended questions was distributed to potential subjects. The questionnaire was designed to guide potential subjects in thinking about their potential participation.ResultsWhile the purpose of the study (safety and tolerability) was extensively presented during the informed consent process, in returned responses 70 percent focused on effectiveness and 91 percent included personal benefit as potential benefit from enrolling. However, 91 percent also indicated helping other Parkinson’s patients as motivation when considering whether or not to enroll.ConclusionsThis combination of responses highlights two issues to which investigators need to pay close attention in future trial designs: (1) how, and in what ways, informed consent processes reinforce potential subjects’ preconceived understandings of benefit, and (2) that potential subjects see themselves as part of a community of Parkinson’s sufferers with responsibilities extending beyond self-interest. More importantly, it invites speculation that a different paradigm for informed consent may be needed. (shrink)

The author proposes a neural-network-based explanation of how a brain might acquire intuitive expertise. The explanation is intended merely to be suggestive and lacks many complexities found in even lower animal brains. Yet significantly, even this simplified brain model is capable of explaining the acquisition of simple skills without developing articulable rules for behavior or a model of the skill domain or an explicit identification of which observables in the environment are necessary for skillful behavior. Furthermore, no memories of prior (...) experiences during the learning phase are explicitly stored and accessed during behavior. The explanation thus calls into doubt many conventional and intuitively reasonable assumptions concerning the learning and production of intuitive expertise. (shrink)

Background Institutional Review Boards (IRBs) are federally mandated to include both nonscientific and unaffiliated representatives in their membership. Despite this, there is no guidance or policy on the selection of unaffiliated or non-scientist members and reports indicate a lack of clarity regarding members’ roles. In the present study we sought to explore processes of recruitment, training, and the perceived roles for unaffiliated and non-scientist members of IRBs.Methods We distributed a self-administered REDCap survey of members of the Association for the Accreditation (...) of Human Research Protection Programs familiar with IRB member recruitment. The survey included closed and open-ended questions regarding: the operation of the HRPP/IRB(s), how unaffiliated and non-scientist members are recruited, whether they had faced challenges recruiting for these roles, and training and mentorship offered. The survey also collected information regarding the perceived value and roles of unaffiliated and non-scientist members.Results 76 responses were included in the analysis (38% completion rate). The most common approach for recruitment was referral from current IRB members, with almost half of respondents indicating challenges recruiting unaffiliated members. Over 75% indicated no additional training was provided to unaffiliated or non-scientist members compared to affiliated or scientist members. Most common supports provided were travel/parking expenses and honoraria. Commonly perceived roles were to provide an independent voice from the participant perspective, notably regarding consent processes and materials.Conclusions Respondents indicated challenges in defining unaffiliated and non-scientist members and limited practices toward recruitment and support. Future work should more closely examine the challenges in defining these roles and applying the definitions in practice, as well as strategies that may improve recruitment and retention of unaffiliated and non-scientist members. These volumes of Mill's letters have been awaited eagerly by all scholars in the field of nineteenth-century studies. They inaugurate most auspiciously the edition of the Collected Works of John Stuart Mill planned and directed by an editorial committee appointed from the Faculty of Arts and Science of the University of Toronto and from the University of Toronto Press. In this collection of 537 letters and excerpts of letters are included all the personal letters available. It contains 238 hitherto (...) unpublished letters and 72 letters with previously unpublished passages. Letters previously published have been recollated whenever possible. The issue of apologising to patients harmed by adverse events has been a subject of interest and debate within medicine, politics, and the law since the early 1980s. Although apology serves several important social roles, including recognising the victims of harm, providing an opportunity for redress, and repairing relationships, compelled apologies ring hollow and ultimately undermine these goals. Apologies that stem from external authorities’ edicts rather than an offender’s own self-criticism and moral reflection are inauthentic and contribute to a “moral (...) flabbiness” that stunts the moral development of both individual providers and the medical profession. Following a discussion of a recent case from New Zealand in which a midwife was required to apologise not only to the parents but also to the baby, it is argued that rather than requiring health care providers to apologise, authorities should instead train, foster, and support the capacity of providers to apologise voluntarily. The following is a summary of the author’s five-stage model of adult skill acquisition, developed in collaboration with Hubert L. Dreyfus. An earlier version of this article appeared in chapter 1 of Mind Over Machine: The Power of Human Intuition and Expertise in the Era of the Computer (1986, Free Press, New York).

We assume that acting ethically is a skill. We then use a phenomenological description of five stages of skill acquisition to argue that an ethics based on principles corresponds to a beginner’s reliance on rules and so is developmentally inferior to an ethics based on expert response that claims that, after long experience, the ethical expert learns to respond appropriately to each unique situation. The skills model thus supports an ethics of situated involvement such as that of Aristotle, John Dewey, (...) and Carol Gilligan against the detached, rationalist ethics of Kant, John Rawls, Lawrence Kohlberg, and Jürgen Habermas. We conduct an experiment with 459 nonprofessional investors to examine whether they evaluate companies differently based on management’s stated purpose for undertaking corporate social responsibility activities in the presence versus absence of a company-specific negative event. Specifically, we vary whether or not management intends to achieve financial returns from CSR activities in addition to promoting social good. We address investors’ decision processes by investigating whether their judgments are mediated by perceptions of future cash flows and/or the underlying ethical culture of (...) the company. Results show that absent a negative event, investment judgments are stronger when CSR activities are intended to achieve financial returns, through expectations of higher future cash flows. However, when a negative event occurs, we find a moderating effect of independent assurance of CSR disclosures. When disclosures are not assured, investors prefer CSR undertaken only for societal benefit, mediated by perceptions of a stronger ethical culture. However, when disclosures are assured, ethical culture is viewed similarly regardless of management’s intention to achieve financial returns from CSR activities. This suggests that management’s willingness to obtain independent assurance on disclosures is viewed as a positive ethical signal. Thus, assurance complements disclosure of CSR activities by contributing to protection against the impact of negative events. (shrink)

Randomized controlled trial trial designs exist on an explanatory-pragmatic spectrum, depending on the degree to which a study aims to address a question of efficacy or effectiveness. As conceptualized by Schwartz and Lellouch in 1967, an explanatory approach to trial design emphasizes hypothesis testing about the mechanisms of action of treatments under ideal conditions, whereas a pragmatic approach emphasizes testing effectiveness of two or more available treatments in real-world conditions. Interest in, and the number of, pragmatic trials has grown substantially (...) in recent years, with increased recognition by funders and stakeholders worldwide of the need for credible evidence to inform clinical decision-making. This increase has been accompanied by the onset of learning healthcare systems, as well as an increasing focus on patient-oriented research. However, pragmatic trials have ethical challenges that have not yet been identified or adequately characterized. The present study aims to explore the views of key stakeholders with respect to ethical issues raised by the design and conduct of pragmatic trials. It is embedded within a large, four-year project that seeks to develop guidance for the ethical design and conduct of pragmatic trials. As a first step, this study will address important gaps in the current empirical literature with respect to identifying a comprehensive range of ethical issues arising from the design and conduct of pragmatic trials. By opening up a broad range of topics for consideration within our parallel ethical analysis, we will extend the current debate, which has largely emphasized issues of consent, to the range of ethical considerations that may flow from specific design choices. Semi-structured interviews with key stakeholders, across multiple jurisdictions, identified based on their known experience and/or expertise with pragmatic trials. We expect that the study outputs will be of interest to a wide range of knowledge users including trialists, ethicists, research ethics committees, journal editors, regulators, healthcare policymakers, research funders and patient groups. Though antiretroviral therapy is the standard of care for people living with HIV, its treatment limitations, burdens, stigma and costs lead to continued interest in HIV cure research. Early-phase cure trials, particularly those that include analytic treatment interruption, involve uncertain and potentially high risk, with minimal chance of clinical benefit. Some question whether such trials should be offered, given the risk/benefit imbalance, and whether those who choose to participate are acting rationally. We address these questions through a longitudinal decision-making study (...) nested in a Thai acute HIV research cohort. In-depth interviews revealed central themes about decisions to join. Participants felt they possessed an important identity as members of the acute cohort, viewing their bodies as uniquely suited to both testing and potentially benefiting from HIV cure approaches. While acknowledging risks of ATI, most perceived they were given an opportunity to interrupt treatment, to test their own bodies and increase normalcy in a safe, highly monitored circumstance. They were motivated by potential benefits to themselves, the investigators and larger acute cohort, and others with HIV. They believed their own trial experiences and being able to give back to the community were sufficient to offset participation risks. These decisions were driven by the specific circumstances experienced by our participants. Judging risk/benefit ratios without appreciating these lived experiences can lead to false determinations of irrational decision- making. While this does not minimise vital oversight considerations about risk reduction and protection from harm, it argues for inclusion of a more participant-centered approach. (shrink)

Leo indeed professed to deny all authority to the evidence of A, even where E is manifestly corrupt. But we should be justified in doing this only if the interpolator of A had based his edition on the text of E, and the (...) text of E had suffered no corruptions subsequent to the making of the A edition. That this is so there is not the least reason to suppose. Peiper therefore was right in requiring for his apparatus criticus an account of the pure A text, though neither he nor Richter took the trouble to search out the oldest and best MSS of the A tradition out of the three hundred or more available. The argument of the paper is that there is a simple principle about denotation--Called "the principle of the use of inter-Denoting terms"--Which can be seen to be clearly and necessarily true, And also to be inconsistent with the theory of eliminative materialism.

Human intuition and perception are basic and essential phenomena of consciousness. As such, they will never be replicated by computers. This is the challenging notion of Hubert Dreyfus, Ph. D., archcritic of the artificial intelligence establishment. It's important to emphasize that he doesn't believe that AI is fundamentally impossible, only that the current research program is fatally flawed. Instead, he argues that to get a device (or devices) with human-like intelligence would require them to have a human-like being in the (...) world, which would require them to have bodies more or less like ours, and social acculturation (i.e. a society) more or less like ours. This helps to explain the practical problems in implementing artificial intelligence algorithms. (shrink)

National Institutes of Health’s policies for Responsible Conduct of Research (RCR) instruction for individual career development awards (K-awards) stress appropriateness to the career stage and tailoring to the individual’s needs. Early-career faculty have unique needs for RCR instruction. While our institution requires RCR education for ALL graduate students and postdoctoral trainees, we found that many K-awardees 1) are early-career faculty not eligible to participate in postdoc programs, and 2) many had received formal RCR instruction at only basic or intermediate levels. (...) We identified 45 K-award recipients with active grants, 26 of whom needed RCR instruction. We developed a program specifically designed for early-career faculty researchers. Through the first three iterations of the course, we had a total of 24 participants, ranging from senior postdoctoral and clinical fellows to instructor-level and assistant professors. This paper describes our experience and challenges in developing and conducting this course. (shrink)

Theory of mind (ToM) and executive function (EF) have traditionally been measured starting in preschool and share a similar developmental progression into childhood. Although there is some research examining early ToM and EF in the first 3 years, further empirical evidence and a theoretical framework for a ToM-EF relationship from infancy to preschool are necessary. In this paper we review the ToM-EF relationship in preschoolers and provide evidence for early development in ToM, EF, and the ToM-EF relationship. We propose that (...) models of cognitive control (i.e., Hierarchical Competing Systems Model: Marcovitch & Zelazo (Journal of Cognition and Development 7:477–501, 2006), (Developmental Science 12:1–25, 2009)); and Levels of Consciousness Model: Zelazo (Trends in Cognitive Science 8:12–17, 2004) account for the ToM-EF relationship across childhood through domain-general developments in the ability to form and reflect on relevant representations that can guide behavior in both ToM and EF situations. The combination of these models also presents unique, domain-general considerations for interpreting early ToM from infancy to preschool. (shrink)

This paper discusses the extent to which books about business ethics are purchased or read outside of tertiary institutions in Australia, whether the subject is commonly perceived as business, philosophy or both, what range of business ethics books is commonly offered for purchase, and what conclusions might be drawn from the above considerations. Investigation shows that the range and availability of business ethics books is quite limited outside of tertiary institutions, and that the general perception is that business ethics is (...) something which pertains specifically to business rather than to moral philosophy. It is likely that this tends to isolate the subject from philosophy as broadly conceived in the minds of business practitioners. (shrink)
