La presente traduction comprend donc les lecons eponymes du volume qui remontent au semestre d'ete 1925, ainsi que differents textes non traduits jusqu'alors dont, en particulier, la quatrieme version de l'article pour l'Encyclopedia Britannica et les Conferences d'Amsterdam. Le statut de la psychologie dans l'economie de (...) la demarche phenomenologique apparait au premier abord extremement embrouille, et il semble difficile de conferer un sens univoque a l'idee de psychologie phenomenologique. Aussi l'un des merites des lecons de 1925 reside-t-il sans doute dans la presentation systematique de cette psychologie dont Brentano et Dilthey sont pour Husserl les precurseurs. A quels traits distinctifs reconnait-on la psychologie phenomenologique? Celle-ci repose-t-elle sur la seule analyse eidetique des vecus intentionnels? This volume of The Writings and Speeches of Edmund Burke continues the story of Edmund Burke, the Rockingham party in British politics, and the American crisis. By 1774 Burke was already recognized as a master of parliamentary debate and an accomplished writer. By 1780, however, his reputation was to have risen substantially. Probably the most important single reason was his Speech on Conciliation with America, which was presented to the House of Commons in March 1775, published, and circulated (...) to a wide audience on both sides of the Atlantic. In that speech, Burke used the full force of his intellect and eloquence to set out the Rockinghams' first comprehensive plan for achieving lasting peace in the Empire. The public commendation he received helped him to gain recognition for offerings such as his second conciliation proposal in November 1775, and his Letter to the Sheriffs of Bristol in 1777. It also gave him some of the confidence he needed to announce the Whig party's historic conversion to a moderate reform programme in his celebrated speeches on economical reform in 1779 and 1780. Numerous writings and speeches in this volume are transcriptions of previously unpublished manuscripts from the collections at Sheffield and Northampton. These allow the reader new insights into the workings of Burke's mind not just in relation to the major political issues, but also to a multitude of engaging subjects such as education, capital punishment, religious dissent, and the return of the Rockingham Whigs to government power. This key volume specifically completes the collection of Edmund Burke's Indian Writings and Speeches which is set within the series, and is both an exposition of Burke's views on India from his coverage of the Hastings trial, and his views on maintaining the rule of a universal justice. The texts for the items, which have appeared in previous editions of Burke's Works, have been reconstructed, largely by the use of manuscripts. Indeed many of the shorter speeches appear here in (...) print for the first time. The volume includes a key speech which introduced one of the main charges in the trial of Warren Hastings on an impeachment from 1789-1794, and an important report on the conduct of the trial. It closes with the enormously lengthy and significant speech in which Burke summed up the prosecution's case over nine days. However, this volume is not only a full exposition of Burke's views on India but contains much of great interest about other aspects of his thought. In particular, Burke saw himself in these years as being engaged in a battle against the lawless disruption of society, both in Europe and in Asia, in order to maintain the rule of a universal justice, a main theme of this volume. The Phenomenology of Internal Time-Consciousness is a translation of Edmund Husserl's Vorlesungen zur Phänomenologie des inneren Zeitbewußtseins. The first part of the book was originally presented as a lecture course at the University of Göttingen in the winter semester of 1904–1905, while the second part is based on additional supplementary lectures that he gave between 1905 and 1910. In these essays and lectures, Husserl explores the terrain of consciousness in light of its temporality. He identifies two categories of temporality—retention (...) and protention—and outlines how temporality provides the form for perception, phantasy, imagination, memory, and recollection. He demonstrates a distinction between cosmic and phenomenological time and explores the relevance of phenomenological time for the constitution of temporal objects. Bei der Grundfragestellung Descartes’ einsetzend, entfaltet Husserl die transzendentale Phänomenologie als »Umbildung und Neu­bildung« des Cartesischen Programms der prima philosophia im Sinne einer Reform der Philosophie zu einer absoluten Wissenschaft aus absoluter Begründung. Eine französische Ausgabe, in der Übersetzung von Emmanuel Levinas und Gabrielle Pfeiffer, erschien 1931 bei A. Colin in Paris. Husserls Arbeiten an dem Manuskript für die deutsche Ausgabe, die (...) gegenüber der französischen erheblich erweitert werden sollte, blieben, nicht zuletzt wegen der 1933 veränderten politischen Situation, unvollendet. So erschien die erste deutschsprachige Ausgabe der Cartesianischen Meditationen erst postum in dem von Stephan Strasser herausgegebenen Band 1 der Husserliana , Den Haag 1950.Die Studienausgabe basiert auf dem Text der zweiten Auflage des Bandes in den Husserliana von 1963, hg. von Rudolf Boehm. The "Cartesian Meditations" translation is based primarily on the printed text, edited by Professor S. Strasser and published in the first volume of Husserliana: Cartesianische Meditationen und Pariser Vorträge, ISBN 90-247-0214-3. Most of Husserl's emendations, as given in the Appendix to that volume, have been treated as if they were part of the text. The others have been translated in footnotes. Secondary consideration has been given to a typescript (cited as "Typescript C") on which Husserl wrote in 1933: "Cartes. Meditationen (...) / Originaltext 1929 / E. Husserl / für Dorion Cairns". Its use of emphasis and quotation marks conforms more closely to Husserl’s practice, as exemplified in works published during his lifetime. In this respect the translation usually follows Typescript C. Moreover, some of the variant readings n this typescript are preferable and have been used as the basis for the translation. Where that is the case, the published text is given or translated in a foornote. The published text and Typescript C have been compared with the French translation by Gabrielle Pfeiffer and Emmanuel Levinas (Paris, Armand Collin, 1931). The use of emphasis and quotation marks in the French translation corresponds more closely to that in Typescript C than to that in the published text. Often, where the wording of the published text and that of Typescript C differ, the French translation indicates that it was based on a text that corresponded more closely to one or the other – usually to Typescript C. In such cases the French translation has been quoted or cited in a foornote. (shrink)

This volume continues the story of Burke and the affairs of the East India Company which was begun in Volume V. By 1786, Burke had fixed on Warren Hastings as the main culprit for the abuses that seemed to him so glaring. He greeted Hastings's return to Britain with a parliamentary attack which culminated in a trial by impeachment in the House of Lords. This was to be one of Burke's major preoccupations for the rest of his life. The material (...) presented in this volume covers two years of proceedings in the House of Commons and the first session of the trial in the Lords. Its highlights are two great set-piece speeches delivered to the Commons, which can be reconstructed from manuscript material as well as from contemporary reports; and the four-day oration with which Burke opened the prosecution before the Lords: for this a complete verbatim shorthand record exists. The material in these and other speeches is not only central to an understanding of Burke and India, but to his moral and political thought as a whole in the years immediately before the outbreak of the French Revolution. THE TEXT In the summer semester of 1925 in Freiburg, Edmund Husserl delivered a lecture course on phenomenological psychology, in 1926127 a course on the possibility of an intentional psychology, and in 1928 a course entitled "Intentional Psychology. " In preparing the critical edition of Phiinomeno logische Psychologie (Husserliana IX), I Walter Biemel presented the entire 1925 course as the main text and included as supplements significant excerpts from the two subsequent courses along with pertinent selections from various research (...) manuscripts of Husserl. He also included as larger supplementary texts the final version and two of the three earlier drafts of Husserl's Encyclopedia Britannica article, "Phenomenology"2 (with critical comments and a proposed formulation of the Introduction and Part I of the second draft by Martin Heidegger3), and the text of Husserl's Amsterdam lecture, "Phenomenological Psychology," which was a further revision of the Britannica article. Only the main text of the 1925 lecture course (Husserliana IX, 1-234) is translated here. In preparing the German text for publication, Walter Biemel took as his basis Husserl's original lecture notes (handwritten in shorthand and I Hague: Nijhoff, 1962, 1968. This volume presents, for the first time in English, Husserl’s seminal 1923/24 lecture course First Philosophy together with a selection of material from the famous research manuscripts of the same time period. The lecture course is divided into two systematic, yet interrelated parts. It has long been recognized by scholars as among the most important of the many lecture courses he taught in his career. Indeed it was deemed as crucially important by Husserl himself, who composed it with a view (...) toward eventual publication. It is unsurprising, then, that First Philosophy is the only lecture course that is consistently counted among his major works. In addition to furnishing valuable insights into Husserl’s understanding of the history of philosophy, First Philosophy is his most sustained treatment of the phenomenological reduction, the central concept of his philosophical methodology. The selection of supplemental texts expands on the topics treated in the lectures, but also add other themes from Husserl’s vast oeuvre. The manuscript material is especially worthwhile, because in it, Husserl offers candid self-criticisms of his publicly enunciated words, and also makes forays into areas of his philosophy that he was loath to publicize, lest his words be misunderstood. As Husserl’s position as a key contributor to contemporary thought has, with the passage of time, become increasingly clear, the demand for access to his writings in English has steadily grown. This translation strives to meet this demand by providing English-speaking readers access to this central Husserlian text. Their analysis, which is grounded in a thorough-going philosophy of medicine, addresses a wide array of practical and ethical concerns that are a part of health care decision-making today. Among these issues are the withdrawing and withholding of nutrition and hydration, competency assessment, the requirements for valid surrogate decision-making, quality-of-life determinations, (...) the allocation of scarce health care resources, medical gatekeeping, and for-profit medicine. The authors argue for the restoration of beneficence to its place as the fundamental principle of medical ethics. They maintain that to be guided by beneficence a physician must perform a right and good healing action which is consonant with the individual patient 's values. In order to act in the patient 's best interests, or the patient 's good, the physician and patient must discern what that good is. This knowledge is gained only through a process of dialogue between patient and/or family and physician which respects and honors the patient 's autonomous self-understanding and choice in the matter of treatment options. This emphasis on a dialogical discernment of the patient 's good rejects the assumption long held in medicine that what is considered to be the medical good is necessarily the good for this patient. In viewing autonomy as a necessary condition of beneficence, the authors move beyond a trend in the medical ethics literature which identifies beneficence with paternalism. In their analysis of beneficence, the authors reject the current emphasis on rights- and duty-based ethical systems in favor of a virtue-based theory which is grounded in the physician- patient relationship. This book's provocative contributions to medical ethics will be of great interest not only to physicians and other health professionals, but also to ethicists, students, patients, families, and all others concerned with the relationship of professional to patient and patient to professional in health care today. An important philosophical issue in the study of addiction is what difference the fact that a person is addicted makes to attributions of autonomy (and responsibility) to their drug-oriented behavior. In spite of accumulating evidence suggesting the role of emotional dysregulation in understanding addiction, it has received surprisingly little attention in the debate about this issue. I claim that, as a result, an important aspect of the autonomy impairment of many addicted individuals has been largely overlooked. A widely shared assumption (...) in the philosophical literature is that for addiction to impair a person’s autonomy it has to make them (in some sense) take drugs against their will. So-called “willing addicts” are therefore usually seen as exempted from the autonomy impairment believed to characterize “unwilling addicts”, the latter being those who ‘truly want’ to stop using drugs but find their attempts repeatedly derailed by failures of self-control. In this article, I argue that the association between addiction and emotional dysregulation shows why this assumption is false. Emotional dysregulation is not only consistent with the possibility that many addicts take drugs ‘willingly’, it supports the hypothesis that they use drugs because they truly want to. The article proposes an explanation for why emotional dysregulation should nevertheless be seen as an aspect of their loss of control and an important reason why they have impaired autonomy. I end by exploring some implications of this account for addict’s decision-making capacity when they are prescribed the drugs to which they are addicted. -/- . (shrink)

Recently clinicians have become more reliant on technologies such as artificial intelligence (AI) and machine learning (ML) for effective and accurate diagnosis and prognosis of diseases, especially mental health disorders. These remarks, however, apply primarily to Europe, the USA, China and other technologically developed nations. Africa is yet to leverage the potential applications of AI and ML within the medical space. Sub-Saharan African countries are currently disadvantaged economically and infrastructure-wise. Yet precisely, these circumstances create significant opportunities for the deployment of (...) medical AI, which has already been deployed in some places in the continent. However, while AI and ML have come with enormous promises in Africa, there are still challenges when it comes to successfully applying AI and ML designed elsewhere within the African context, especially in diagnosing mental health disorders. We argue, in this paper, that there ought not to be a homogeneous/generic design of AI and ML used in diagnosing mental health disorders. Our claim is grounded on the premise that mental health disorders cannot be diagnosed solely on ‘factual evidence’ but on both factual evidence and value-laden judgements of what constitutes mental health disorders in sub-Saharan Africa. For ML to play a successful role in diagnosing mental health disorders in sub-Saharan African medical spaces, with a precise focus on South Africa, we allude that it ought to understand what sub-Saharan Africans consider as mental health disorders, that is, the value-laden judgements of some conditions. Normative thinking about addiction has traditionally been divided between, on the one hand, a medical model which sees addiction as a disease characterized by compulsive and relapsing drug use over which the addict has little or no control and, on the other, a moral model which sees addiction as a choice characterized by voluntary behaviour under the control of the addict. Proponents of the former appeal to evidence showing that regular consumption of drugs causes persistent changes in the brain structures (...) and functions known to be involved in the motivation of behavior. On this evidence, it is often concluded that becoming addicted involves a transition from voluntary, chosen drug use to non-voluntary compulsive drug use. Against this view, proponents of the moral model provide ample evidence that addictive drug use involves voluntary chosen behaviour. In this paper we argue that although they are right about something, both views are mistaken. We present a third model that neither rules out the view of addictive drug use as compulsive, nor that it involves voluntary chosen behavior. -/- . (shrink)

Techno-colonialism, which I argue here to specifically mean the transfer of technology and its values and norms from one locale to another, has become a serious concern with the advancement of socially disruptive technologies1 of the Fourth Industrial Revolution (4IR), like artificial intelligence and robots. While the transfer of technology from one locale, especially economically advanced countries, to developing countries comes with economic benefits for both regions, it is important to understand that technologies are not value- neutral; they come with (...) the values, cultures, and worldviews of their designers. However, despite the nonvalue-neutrality of the technologies of the 4IR, they are still relevant for subSaharan Africa’s development. Thus, using a phenomenological approach, especially the sub-Saharan African experiences of past histories of colonialism, I prescribe cautionary measures that sub-Saharan Africans ought to take in approaching the current industrial revolution and its technologies. The stated subject of these lecture courses given by Husserlbetween 1910 and 1918is ‘reason, the word for the mental activities and accomplishments that govern knowledge, give it form and supply it with norms.’ They show their author still pursuing the course set out in the Logical Investigations up to the end of the second decade of the century and displaying utter consistency with stands that he began taking on meaning, analyticity, Platonism, manifolds, mathematics, psychologism, etc. in the 1890s. Thus, they (...) undermine many idées reçues about the development of his thought. The centerpiece of this work is an exploration of the realm of meaning. Moreover, they add new dimensions to standard discussions by taking readers back to the place where phenomenology and analytic philosophy diverged. They show that Husserl tangled long and hard with the very ideas that went into the making of the latter and offer a wealth of interesting insights into sense and meaning, theory of judgment, complete and incomplete meanings, states of affairs, extensional logic, the relationship between logic and mathematics, functions and arguments, propositional functions, quantification, existential generalization, the word ‘all,’ number theory, sets, modality, deductive theory, ideas that are still under discussion today. Prepared for oral delivery in the classroom, they are refreshingly lively and spontaneous. They are clearer, more explicit, and readable than the books Husserl published during his lifetime. Does addiction to heroin undermine the voluntariness of heroin addicts' consent to take part in research which involves giving them free and legal heroin? This question has been raised in connection with research into the effectiveness of heroin prescription as a way of treating dependent heroin users. Participants in such research are required to give their informed consent to take part. Louis C. Charland has argued that we should not presume that heroin addicts are competent to do this since heroin (...) addiction by nature involves a loss of ability to resist the desire for heroin. In this article, I argue that Charland is right that we should not presume that heroin addicts are competent to consent, but not for the reason he thinks. In fact, as Charland's critics correctly point out, there is plenty of evidence showing that heroin addicts can resist their desire for heroin. These critics are wrong, however, to conclude from this that we should presume that heroin addicts are competent to give their voluntary consent. There are, I shall argue, other conditions associated with heroin addiction that might constrain heroin addicts' choice in ways likely to undermine the voluntariness of their consent. In order to see this, we need to move beyond the focus on the addicts' desires for heroin and instead consider the wider social and psychological circumstances of heroin addiction, as well as the effects these circumstances may have on the addicts' beliefs about the nature of their options. What is self-control and how does the concept of self-control relate to the notion of will-power? A widespread philosophical opinion has been that the notion of will-power does not add anything beyond what can be said using other motivational notions, such as strength of desire and intention. One exception is Richard Holton who, inspired by recent research in social psychology, has argued that will-power is a separate faculty needed for persisting in one's resolutions, what he calls 'strength of will'. However, (...) he distinguishes strength of will from self-control. In this paper I argue that will-power is essential also to a certain form of self-control. I support this claim by arguments showing that the traditional philosophical accounts of self-control run into difficulties because they pay insufficient attention to will-power as an independent source of motivation. Daniel Davis (bio)Approximately two weeks before what was to have been its final meeting, the White House dissolved the President’s Council on Bioethics by terminating the appointments of its 18 members. The letters of dismissal, dated 10 June 2009, informed the members that their service on the Council would end with the close of business the next day.The Council’s term (...) was set to expire on 30 September 2009. After President Obama’s election in November and during the transition, we were advised to proceed on the assumption that the Council would be permitted to cease on that date. Reasons for the abrupt move to disband the Council are unknown. We have accepted the fact that we Council members served at the pleasure of the President and that he simply exercised his rightful prerogative. No explanation is therefore required.Some observers have speculated that the action was retaliatory. They related to the fact that several members of the Council disagreed with the President’s stem cell policy in a signed statement published in the Hastings Center’s Bioethics Forum. Others have speculated that the move was pre-emptive. At its final meeting, scheduled for 25–26 June, the Council was set to sign-off on two of its final publications. One was a comprehensive report on the ethics of organ transplantation, and the other a white paper entitled Health Care and the Common Good. The aim was immediately to release the latter as a contribution to the intensifying debate about health care reform. Health Care and the Common Good could well have aided rather than impeded the President’s drive to better control health care costs and achieve universal coverage. The Council report attempted to ground both goals in the ethical framework of, as the title indicates, the common good of all Americans.In his letter terminating the members’ appointments, Assistant to the President for Presidential Personnel Don Gips said that the President “recognizes the values of having a commission of experts in bioethical issues to provide objective and non-ideological bioethics advice to his administration.” Gips went on to say that the President is “currently rethinking the purposes and goals of such a bioethics commission, and is carefully considering a revitalized mission and mandate.” And, [End Page 309] responding to media enquiries, White House press officer Reid Cherlin explained that the President’s Council was terminated because it was a “philosophically leaning advisory group” and, according to a New York Times account by Nicholas Wade, “because it favored discussion over developing a shared consensus.” As for the ultimate outcome of the President’s “rethinking,” Cherlin indicated that President Obama will appoint a new commission with the mandate of offering “practical policy options” in bioethics.In the light of our experiences with the Council, we leave it with hopes that certain questions of national importance will be addressed. In light of the nature of federal advisory commissions, what is or are the proper roles of a national bioethics commission? If the aim is to provide advice and counsel to the President or, perhaps to the U. S. Congress, is that advice best rendered as a group consensus or as an in-depth exploration of the inevitably conflicting ethical perspectives on a given issue? How should such a commission be constituted—with what sorts of individuals? And what is the nature of the expertise that they individually and collectively bring to the commission’s functions? If the commission is to promote public debate and discussion, how exactly should it go about that task? And how is the efficacy of a commission to be assessed?
