Some recently-proposed counterexamples to the traditional definition of essential property do not require a separate logic of essence. Instead, the examples can be analysed in terms of the logic and theory of abstract objects. This theory distinguishes between abstract and ordinary objects, and provides a general analysis of the essential properties of both kinds of object. The claim ‘x has F necessarily’ becomes ambiguous in the case of abstract objects, and in the case of ordinary objects there are various ways (...) to make the definition of ‘F is essential to x’ more fine-grained. Consequently, the traditional definition of essential property for abstract objects in terms of modal notions is not correct, and for ordinary objects the relationship between essential properties and modality, once properly understood, addresses the counterexample. The author engages a question raised about theories of nonexistent objects. The question concerns the way names of fictional characters, when analyzed as names which denote nonexistent objects, acquire their denotations. Since nonexistent objects cannot causally interact with existent objects, it is thought that we cannot appeal to a `dubbing' or a `baptism'. The question is, therefore, what is the starting point of the chain? The answer is that storytellings are to be thought of as extended baptisms, and the details (...) of this response receive attention in the paper. Once the storytelling is complete, and the characters have been baptized, a priori metaphysical principles linking the storytelling with the realm of nonexistent objects provide the referential, non-causal connection between the names used in the storytelling and the objects denoted by such names. This essay explores the vexed issue of individual corporeal substance in Descartes' natural philosophy. Although Descartes' often referred to individual material objects as separate substances, the constraints on his definitions of matter and substance would seem to favor the opposite view; namely, that there exists only one corporeal substance, the plenum. In contrast to this standard interpretation, however, it will be demonstrated that Descartes' hypotheses make a fairly convincing case for the existence of individual material substances; and the key to (...) this new found individuation is a long neglected set of passages in the Principles of Philosophy. One of the strongest arguments for the incompatibility of divine foreknowledge and human free action appeals to the apparent fixity or necessity of the past. Two leading responses to the argument—Ockhamism, which denies a premiss of the argument, and the so-called “eternity solution”, which holds that strictly speaking God does not have foreknowledge—have both come under attack on similar grounds. Neither response, it is alleged, is adequate to the case of divine prophecy. In this paper I shall first state the (...) argument in question and the two responses to it. This paper discusses certain conceptual tensions in a set of archeological texts from the Warring States period, the Guodian corpus. One of the central themes of the Guodian corpus is the disanalogy between spontaneous, natural familial relationships and artificial political relationships. This is problematic because, like many early Chinese texts, the Guodian corpus believes that political relationships must come to be characterized by unselfconsciousness and spontaneity if social order is to prevail. This tension will be compared to my earlier work (...) on the “paradox of wu-wei (effortless action),” and the Guodian corpus’ “solution” to the problem of teaching spontaneity—drawing upon the transformative power of music—will be placed within the landscape of early “Confucian” and “Daoist” theories concerning human nature and self-cultivation. On January 1, 2006, Medicare Part D prescription drug coverage was initiated. Concern was immediately voiced by the American Association of Retired Persons (AARP) and Families USA that, in response to this program, the pharmaceutical industry may raise prices for drugs most often used by the elderly. This article examines the ethical implications of a revenue-maximizing pricing strategy in an industry in which third party financing mitigates an end product's true cost to the user. The perspectives of three stakeholder groups (...) are examined: the elderly, as consumers of prescription drugs, the pharmaceutical industry, as product manufacturer and beneficiary of derived profits, and the total U. S. population, as the ultimate payer for the program via tax revenues. Key questions explored include the relationships among price strategy and access to drugs at both the micro (Medicare cohort) and macro (total population) levels, and on drug development or enhancement. The role of profit in a capitalism-based health care system is also examined. Hospital industry impact on these same stakeholder groups in response to the original 1965 Medicare law is used to compare and contrast possible outcomes of the new drug program. It is predicted that pharmaceutical firms will mimic the hospital industry, adopting a price maximizing strategy for drugs covered by the program. In the process, a utilitarian effect occurs: the benefits of increased access and diffusion of drugs counterbalance inequities in financing Medicare Part D. (shrink)

Aiming to circumvent metaphor-prone properties of natural language, Chapman, Kim, Susskind, and Anderson (2009) recently reported evidence for morally induced activation of the levator labii region (manifest as an upper lip raise and a nose wrinkle), also implicated in responding to bad tastes and contaminants. Here we point out that the probative value of this type of evidence rests on a particular (and heavily contested) account of facial movements, one which holds them to be “expressions” or automatic read-outs of internal (...) states. We also observe a largely neglected difference between morally induced disgust and moral disgust proper, arguing that data such as Chapman et al.’s (2009) provide evidence only for the former. The project of “public reason” claims to offer an epistemological resolution to the civic dilemma created by the clash of incompatible options for the rational exercise of freedom adopted by citizens in a diverse community. The present Article proposes, via consideration of a contrast between two classical accounts of dialectical reasoning, that the employment of “public reason,” in substantive due process analysis, is unworkable in theory and contrary to more reflective Supreme Court precedent. Although logical commonalities might be available to (...) pick out from the multitude of particularized accounts of what constitutes “civic order,” no “public reason” so derived could adequately capture - and thus be able to secure in a practical sense - any single determinate civic order, much less one that would be consistent with all citizens' conceptions of public order. Part I of this Article raises a number of issues for consideration relating to the epistemology of law and focuses especially on the concept of public reason and its critique. Part II addresses alternative approaches to legal reasoning suggested by classical accounts of practical reasoning and virtue theory and considers the operation of such legal analysis outside the area of substantive due process; Part III analyzes post-Lawrence case law confirming the dilemma created by the Supreme Court's ambiguous approaches to substantive due process and concludes that only one interpretation - that articulated fully in Washington v. The modal object calculus is the system of logic which houses the (proper) axiomatic theory of abstract objects. The calculus has some rather interesting features in and of itself, independent of the proper theory. The most sophisticated, type-theoretic incarnation of the calculus can be used to analyze the intensional contexts of natural language and so constitutes an intensional logic. However, the simpler second-order version of the calculus couches a theory of fine-grained properties, relations and propositions and serves as a framework (...) for defining situations, possible worlds, stories, and fictional characters, among other things. In the present paper, we focus on the second-order calculus. The second-order modal object calculus is so-called to distinguish it from the second-order modal predicate calculus. Though the differences are slight, the extra expressive power of the object calculus significantly enhances its ability to resolve logical and philosophical concepts and problems. (shrink)

Many people believe that a person's sexual orientation is genetic. Given the widespread prejudice against, and hatred of, homosexuals in many societies, it seems likely that many parents will be interested in using genetic technologies to prevent the birth of children who will not be heterosexual. This paper considers the moral and legal implications of such procedures (whether or not they would work). It is argued that the availability of procedures to select the sexual orientation of children would contribute to (...) discrimination and prejudice against lesbians, gay men and bisexuals and, more generally, undermine the maintenance of a just society. These effects carry significant weight in determining whether genetic technologies should be developed and whether their use is, or should be, legally permissible and morally acceptable. (shrink)

In this paper, the author analyzes critically some of the ideas found in Karel Lambert's recent book, Meinong and the Principle of Independence (Cambridge: Cambridge University Press, 1983). Lambert attempts to forge a link between the ideas of Meinong and the free logicians. The link comes in the form of a principle which, Lambert says, these philosophers adopt, namely, Mally's Principle of Independence, which Mally himself later abandoned. Instead of following Mally and attempting to formulate the principle in the material (...) mode as the claim that an object can have properties without having any sort of being, Lambert formulates the principle in the formal mode, as (something equivalent to) the rejection of the traditional constraint on the principle of predication. The principle of predication is that a formula of the form Fa' is true iff the general term F' is true of the object denoted by the object term a'. The traditional constraint on this predication principle is that for the sentence Fa' to be true, not only must the object term have a denotation, but it must also denote an object that has being. According to Lambert, the free logicians violate this constraint by suggesting that Fa' can be true even if the object term has no denotation, whereas Meinong violates this constraint by proposing Fa' can be true even when the object term denotes an object that has no being. Lambert then tries to `vindicate' the Principle of Independence, thereby justifying both the work of the free logicians and Meinong. (shrink)

Many neuroimaging studies of semantic memory have argued that knowledge of an object's perceptual properties are represented in a modality-specific manner. These studies often base their argument on finding activation in the left-hemisphere fusiform gyrus-a region assumed to be involved in perceptual processing-when the participant is verifying verbal statements about objects and properties. In this paper, we report an extension of one of these influential papers-Kan, Barsalou, Solomon, Minor, and Thompson-Schill (2003 )-and present evidence for an amodal component in the (...) representation and processing of perceptual knowledge. Participants were required to verify object-property statements (e.g., "cat-whiskers?"; "bear-wings?") while they were being scanned by functional magnetic resonance imaging (fMRI). We replicated Kan et al.'s activation in the left fusiform gyrus, but also found activation in regions of left inferior frontal gyrus (IFG) and middle-temporal gyrus, areas known to reflect amodal processes or representations. Further, only activations in the left IFG, an amodal area, were correlated with measures of behavioural performance. (shrink)

The arguments of the dialetheists for the rejection of the traditional law of noncontradiction are not yet conclusive. The reason is that the arguments that they have developed against this law uniformly fail to consider the logic of encoding as an analytic method that can resolve apparent contradictions. In this paper, we use Priest [1995] and [1987] as sample texts to illustrate this claim. In [1995], Priest examines certain crucial problems in the history of philosophy from the point of view (...) of someone without a prejudice in favor of classical logic. For each of these problems, the logic of encoding offers an alternative explanation of the phenomena---this alternative is not considered when Priest describes what options there are in classical logic for analyzing the problem at hand. -/- The argument at heart of the case that Priest develops against the law of noncontradiction (i.e., the argument based on the paradoxes of self-reference) is then reanalyzed in light of encoding logic. After showing why the argument is inconclusive, the paper concludes both with a more general discussion of logic and predication and with the suggestion that there is no need to tamper with the logic of the traditional mode of predication if there is alternative mode of predication which is well-suited to the analysis of cases involving contradictory objects. The discovery, made in Oxford, that crude penicillin could cure systemic and life‐threatening bacterial infections was followed by attempts to purify penicillin, to determine its structure and then to produce it by total chemical synthesis. The β‐lactam structure of the molecule, first proposed in October 1943, was a source of controversy until 1945. However, no useful chemical synthesis was achieved and fermentation became the commercial source of the antibiotic.In 1953, one of the products of a Cephalosporium sp. from Sardinia was (...) shown to be a new and hydrophilic penicillin (penicillin N). This was contaminated with a substance having the same side‐chain but a characteristic absorption spectrum. The latter, cephalosporin C, showed antibacterial activity but was not inactivated by a penicillinase. The determination of its β‐lactam structure and isolation of its nucleus enabled pharmaceutical companies to produce many semisynthetic cephalosporins.A new tripeptide was later found to be an intermediate in the biosynthesis of both penicillin N and cephalosporin C, and this was followed by the complete elucidation of the biosynthetic pathways leading to these compounds and to benzylpenicillin. :In this essay, I critically engage with a methodological approach in contemporary political theory — unconstrained utopianism — which holds that we can only determine how we should live by first giving an account of the principles that would govern society if people were perfectly morally motivated. I provide reasons for being skeptical of this claim. To begin with I query the robustness of the principles unconstrained utopianism purportedly delivers. While the method can be understood as offering existence proofs, because (...) we can devise other situations in which morally flawless decision making would unearth alternative sets of principles, I argue that such proofs tell us surprisingly little about how we should live in general. Drawing on this point, I contend that normative models that wish away certain phenomena that are uncontroversially central to any account of politics cannot plausibly claim to tell us how we should live in political society. I conclude by offering a more positive sketch of why avoiding this brand of utopianism might not represent a problematic capitulation to the morally nonideal and suggest that theorizing in light of certain constraints may be a precondition of good normative theorizing itself. Liberation theology is in retreat. Once orthodox Catholics, starting with Pope John Paul II, recognized liberation theology's cultural challenge, they effectively countered it. They insisted on a traditional Catholic hierarchy of values. They undercut liberation theology's appeal by taking back key words and precepts that liberationists tried to appropriate. The Magisterium's sensus fidei included practical steps to demonstrate the weakness of liberation theology's hold, especially on poor people. Orthodox Catholics thus used the theological and practical weapons that the Church always (...) had at her disposal. The response of many liberation theologians has been to change some of liberation theology's precepts. (shrink)

In this paper I propose a fundamental modification of standard type theory, produce a new kind of type theoretic language, and couch in this language a comprehensive theory of abstract individuals and abstract properties and relations of every type. I then suggest how to employ the theory to solve the four following philosophical problems: the identification and ontological status of Frege's Senses; the deviant behavior of terms in propositional attitude contexts; the non-identity of necessarily equivalent propositions, and the paradox of (...) analysis. We can roughly describe these solutions as follows: the senses of English names and descriptions which denote individuals will be modelled as abstract individuals; the senses of English relation denoting expressions of a given type will be modelled as abstract relations of that type. Inside de dicto attitude contexts, these English expressions denote their senses. Relations and propositions will not be identified with their extensions, nor with functions or sets of any kind. They will be taken as primitive, and precise being and identity conditions will be proposed consistent with the view that necessarily equivalent relations and propositions may be distinct. With the modelling described in, the expressions being a brother and being a male sibling may both denote the same property, though their senses may differ. Just as Frege predicts, being a brother just is being a male sibling is an informative identity statement because the terms flanking the identity sign have the same denotation, though distinct senses.
