A number of Artificial Intelligence (AI) ethics frameworks have been published in the last 6 years in response to the growing concerns posed by the adoption of AI in different sectors, including healthcare. While there is a strong culture of medical ethics in healthcare applications, AI-based Healthcare Applications (AIHA) are challenging the existing ethics and regulatory frameworks. This scoping review explores how ethics frameworks have been implemented in AIHA, how these implementations have been evaluated and whether they have been successful. (...) AI specific ethics frameworks in healthcare appear to have a limited adoption and they are mostly used in conjunction with other ethics frameworks. The operationalisation of ethics frameworks is a complex endeavour with challenges at different levels: ethics principles, design, technology, organisational, and regulatory. Strategies identified in this review are proactive, contextual, technological, checklist, organisational and/or evidence-based approaches. While interdisciplinary approaches show promises, how an ethics framework is implemented in an AI-based Healthcare Application is not widely reported, and there is a need for transparency for trustworthy AI. Method: 80 study participants from Toulouse and 124 from Metz judged the acceptability of abortion in 64 vignettes composed of five factors: 1) the adolescent's age (15 or 17.5 years), 2) the adolescent's plans to continue schooling or not, 3) the fetus' age (1, 2, 3, or 4 months), 4) the adolescent's parents' agreement or not, and 5) the agreement or not of baby's father. Results: Three clusters (...) were noted: 1) abortion is never acceptable (8% of participants), 2) abortion is always acceptable (23%), and 3) acceptability of abortion depends on the circumstances (63%). In the majority cluster (3), all five factors had significant effects, but the fetus's age accounted for most of the variance (78%). Conclusion: Most subjects in this study judged, in accordance with French law, that the acceptability of induced abortion in minors depends on the circumstances and, in particular, on the fetus' age. Ethical business practices have been widely prescribed, but why? Consumers views on unethical business practices have been studied, but possibly more important to marketers and researchers are consumer actions and reactions to unethical business practices and the businesses themselves. Do consumers react negatively, or in such a way as to "punish" the unethical business? If so, what is the nature and extent of the punishment? This research seeks answers to these questions by examining consumer reactions, such as complaining and switching, (...) to instances of unethical business practices. Using equity theory, this research proposes that consumers should be willing to tolerate some unethical behavior as long as they feel their investments and outcomes remain proportionately equal. Consumers who perceive that their outcome/investment ratio is proportionately unequal to their comparison other will respond by switching or complaining. In this research consumers were exposed to two types of service failures with different levels of service recovery in vignettes. Costs incurred by the consumer during the service transaction were also manipulated in the vignettes. Significant differences were found for complaint behavior in the failure recovery vignettes tested. Specifically, voice complaint was higher in the high cost service encounters in both types of services tested. The recovery attempt used (ethical, unethical, or none) led to significance differences in the variables of complaint, voice complaint, satisfaction, and quality. Higher satisfaction and quality ratings were found for the ethical recovery attempt and higher intentions to use complaint and voice complaint in the unethical recovery attempts. One significant interaction between cost and recovery attempt was found. Intentions to use voice complaint were higher in the high cost situations of ethical and unethical recovery, while approaching equality at the no recovery attempt. (shrink)

Women's small share of professional and managerial occupations compared with their share of the total labor force is examined for the 11 largest racial and ethnic minorities in the United States. Gender-related characteristics—women's labor force participation rates, marital status, and the sex ratio—influence women's share of the top jobs, as do class and ethnic variables such as place of birth, population size, and class of worker. Labor market gender inequality is greatest among the smaller, more affluent minorities, many of whom (...) are recent immigrants to this country. The larger, frequently indigenous, minority groups exhibit less of this kind of inequality. Minority and gender status intersect, so that men monopolize surplus resources among the more affluent minority groups and use these resources to secure a more advantaged labor market position. The association of poetry and femininity … excluded women poets. For the female figures onto whom the men projected their artistic selves—Tennyson’s Mariana and Lady of Shalott, Browning’s Pippa and Balaustion, Arnold’s Iseult of Brittany—represent an intensification of only a part of the poet, not his full consciousness: a part, furthermore, which is defined as separate from and ignorant of the public world and the great range of human experience in society. Such figures could not write their own poems; the (...) male poet, who stands outside the private world of art, has to do that for them. The Lady of Shalott could not imagine someone complex and experienced enough to imagine the world beyond range of her windows, or to imagine her. A woman poet who identified herself with such a stock figure of intense and isolated art would hardly be able to write at all. Or, like the Lady of Shalott preparing her death-ship, she could write only her own name, only herself. For a man, writing poetry meant an apparent withdrawal from the public sphere , but for a woman it meant just the opposite: a move toward public engagement and self-assertion in the masculine world. She could not just reverse the roles in her poetry and create a comparable male self-projection, since the male in this set of opposites is defined as experienced, complexly self-conscious, and part of the public world and therefore could not serve as a figure for the poet. We can formulate the problem like this: a man’s poem which contains a female self-projection shows to distinctly different figures, poet and projection; in a woman’s poem on the same model, the two would blur into one.Furthermore, it’s not really poets that are women, for the Victorians: poems are women. The cliché that style is the man arises more readily and with much greater literalness and force when the stylist is a woman, and it is often charged with erotic intensity. The young lovers in Gilbert and Sullivan’s Iolanthe describe their perfect love by singing that he is the sculptor and she the clay, he the singer and she the song. Ladislaw in Middlemarch tells Dorothea that she needn’t write poems because she is a poem. Edgar Allan Poe remarks in a review of Barrett Browning’s works that “a woman and her book are identical.” In her love letters Barrett Browning herself worried about the problem of her identity—was she her poems, were they she, which was Browning in love with? “I love your verses with all my heart, dear Miss Barrett,” he had written disconcertingly in his first letter, “… and I love you too.” […] As we can see in Tennyson’s The Princess, the lyric in particular seemed female to Victorians—private, nonlogical, purely emotional—and it is surely no accident that large numbers of English and American women began to publish poetry in the nineteenth century, when the lyric established its dominance. Victorian poems like Victorian women were expected to be morally and spiritually uplifting, to stay mostly in the private sphere, and to provide emotional stimulus and release for overtasked men of affairs.9 All this may have encouraged women to write poetry, but at the same time it made writing peculiarly difficult because it reinforced the aspects of conventional Victorian femininity—narcissism, passivity, submission, silence—most inimical to creative activity. I argue that our traditional conception of the duties imposed by human rights is unable to acknowledge the nature of many contemporary human rights violations. The traditional conception is based on a broadly deontological view according to which human rights impose primarily negative and perfect duties, and these duties are held to be specific prohibitions on certain kinds of actions . I argue that given this conception of the nature of the duties imposed by human rights, not only claims to (...) aid, but in addition, claims against many of the most serious and prevalent contemporary active harms will not count as genuine human rights claims. These harms increasingly result from extremely complex causal chains involving the behaviour of a huge number of agents, few or none of whom can be singled out as responsible for a serious harm to any specific victim. Institutional structures can have just as central a role to play in specifying and allocating responsibility for fulfilling many of the negative duties imposed by human rights as the positive duties. These structures can therefore be equally important in the realisation of both kinds of rights. Before the necessary institutional reforms have taken place, both kinds of rights are equally genuine, and ground the imperative of justice to reform existing social institutions. (shrink)

People with disabilities are often denied equal access to organ transplantation despite long‐standing federal nondiscrimination mandates. Under the Americans with Disabilities Act and the Rehabilitation Act, people cannot be excluded from consideration for organ transplantation because of disability itself, or because of stereotypes or assumptions about the value or quality of life with a disability. Instead, decisions concerning whether an individual is a candidate for organ transplantation should be based on an individualized assessment of the patient and on objective medical (...) evidence. Recent legal developments underscore these basic guarantees and signal a new focus on the policies, practices, and attitudes that continue to compromise equal access to life‐saving organ transplants for people with disabilities. “Philosophers,” Dewey writes, “are parts of history, caught in its movement; creators perhaps in some measure of its future, but also assuredly creatures of its past”. The question of the philosopher’s embeddedness in either her own or some earlier historical moment constitutes an important theme in Dewey’s account of pragmatism, in particular his account of politics. In lieu of a formal treatise on history, this paper focuses on Dewey’s claims about history as they are enacted in his political analyses. Drawing (...) on texts such as Liberalism and Social Action and Freedom and Culture as well “The Role of Philosophy in the History of Civilization”, I hope to elucidate in greater depth the function and meaning of the term “historic relativity” as a central concept in Dewey’s philosophy of history. Further, I evaluate Dewey’s criticisms of both classical liberalism and Marxism on historical grounds, where he employs what I call political obsolescence claims. From these texts I reconstruct and critically assess what I refer to as Dewey’s implicit philosophy of history. I conclude that the presuppositions of Dewey’s political reconstruction represent the very mode of uncritical historical reproduction which his philosophy ostensibly cautions against. To suggest one possibility for addressing these tensions, I gesture toward non-coincidence as a critical historical category through which we might articulate the historic present with the hope of transforming it. Pharmacists with religious or ethical objections to prescribing emergency contraception won the latest round in the fight over conscience clauses in a case that could have broader implications for attempts to restrict access to contraception. In Stormans, Inc. v. Selecky, a federal District Court in Washington State granted an injunction to block the enforcement of regulations that would have forbidden pharmacists to refuse to dispense emergency contraception on the grounds of religious or ethical objections. In its decision, the court applied (...) Supreme Court abortion precedent without explicitly ruling whether emergency contraception should be legally categorized as a form of abortion or as contraception. However, the legal status of emergency contraception affects the strength of the defendants’ claims that the law was justified on the grounds of preventing sex discrimination. In neglecting to rule one way or the other, the court not only failed to adequately consider the sex discrimination claim but also may have opened the door to more restrictive regulation on contraceptives generally. Turning to Georg Simmel’s Philosophy (...) of Money for an alternative, non-psychoanalytic account of unconscious purpose as a trans-individual, cultural phenomenon, it arrives once again at the hypertrophic life-technologies of the modern—and at Simmel’s account of money as the ultimate being without qualities, “the most extreme … configuration of Geist” itself, which so thoroughly underpins ways of living that, obscuring dimensions of value that cannot be quantified, silently hum on in the face of catastrophe. Amartya Sen’s ethical theorizing helps feminists resolve the tensions between the claims of women’s particular perspectives and moral objectivity. His concept of ‘‘positional objectivity’’ highlights the epistemological significance of value judgments made from particular social positions, while holding that certain values may become widely shared. He shows how acknowledging positionality is consistent with affirming the universal value of democracy. This article builds on Sen’s work by proposing an analysis of democracy as a set of institutions that aims to intelligently utilize (...) positional information for shared ends. This epistemological analysis of democracy offers a way to understand the rationale for reserving political offices for women. From a political point of view, gendered positions are better thought of as an epistemological resource than as a ground of identity politics – that is, of parochial identification and solidarity. How is the ethics of abortion related to the non-identity problem? Some cases of deciding whether to abort turn out to raise the non-identity problem: for the same reasons that it is morally required to wait to conceive in some temporary condition non-identity cases, it is also morally required to abort some pregnancies. This implies that the following surprising claim is true: sometimes it is morally required to kill a being for its own sake, although continuing to live would be (...) better for it. The paper defends this surprising claim. The paper also argues that we should understand non-identity phenomena more broadly, to encompass cases of affecting what the moral status facts are. Its contributors include senior scholars as well as those at the beginning of their careers. Each essay, arising from some aspect of Novak's vast corpus, is replied to by Novak himself. These replies are instructive, for they show a great teacher at work, responding with nuance and charity to criticisms and always moving the conversation forward in illuminative ways.Levering opens the volume with a contribution about Novak as a master of Jewish–Christian dialogue, indeed, "the greatest master of Jewish–Christian dialogue who has ever lived" (1).
