We often do not blame mentally disordered persons for these actions, however, because we regard mental disorders, at least in some circumstances, as an excuse from moral responsibility. For moral philosophy and the law, the challenge is to understand the specific circumstances under which a mental (...) disorder should excuse an offender from responsibility for his or her actions. Because different types of psychopathology influence a person’s intentions and character in very different ways, judgments of responsibility crucially depend upon the specific nature of a mental disorder. This has long been recognized, by both morality and the law. But just which mentally ill persons should be excused, and under what circumstances, is an altogether more complicated affair.In the Nicomachean Ethics, Aristotle distinguishes two types of involuntary actions, for which (by implication) a person might be excused from responsibility: those done in ignorance, and those that were compelled. Both excuses are variations on the theme of non-intention. If a person did not intend to act as he did—either because he did not know what he was doing, or because he could not help acting as he did—then he is not responsible for the action. Intention is also a key point for the law, which traditionally has said that for a crime to have been committed, it must be accompanied by evil intent, or mens rea (literally, “guilty mind.”)The problem comes in saying how these distinctions play out for the mentally ill offender. The most widely used standards for determining criminal (legal) responsibility are based on the M’Naghten Rules, which excuse a person from responsibility for an act if, as a result of a mental disorder, he did not know the nature and quality of the act, or did not know that the act was wrong. This standard works nicely for the paradigmatic cases of mentally ill offenders; it would excuse, for example, the person with paranoid schizophrenia who strikes out violently at a person he falsely believes is threatening his life. However, it is unclear on several other points, the most famous of which relates to Aristotle’s excusing condition of compulsion. How should we regard those people, for example, whose psychosis impairs their ability to control their behavior, or whose mental disorders involve the control of their unusual desires, such as kleptomania, pyromania, pedophilia and voyeurism? Many of the [End Page 305] latter such persons are aware of the nature and quality of what they desire to do, and they are aware that it is wrong, but they find great difficulty in resisting their desires.One well-known effort to remedy this deficiency was the “irresistible impulse” test, which excused those persons who as a result of their condition had acted on desires that were irresistible. This study consists of two parts. The first is an examination of the hermeneutical presuppositions underlying the theory of models that Moshe Idel has applied to the study of Jewish mysticism. Idel has opted for a typological approach based on multiple explanatory models, a methodology that purportedly proffers a polychromatic as opposed to a monochromatic orientation associated with Scholem and the so-called school based on his teachings. The three major models delineated by Idel are the theosophical-theurgical, the ecstatic, and the (...) magical or talismanic. Idel’s hermeneutic rests on the assumption that the phenomenon of Jewish mysticism (as the phenomenon of religion more generally) cannot be essentialized, and therefore no one methodological approach should be privileged as the exclusive means to ascertain it. In the second part of this study, I raise the possibility that affirming set patterns of thought and a unified system of symbols that link together kabbalists from different historical periods might not inevitably implicate the scholar in a methodological reductionism. Moving beyond a binary logic, which is still operative in the postmodern dichotomy of truth and dissimulation, I surmise that the polysemic nature of the text that may be elicited from kabbalistic sources is not dependent on the rejection of laying claim to an inherent and original intent that is recoverable through proper philological attunement. Multivocality and essentialism are not mutually exclusive. Kabbalah, I submit, is a cultural-literary phenomenon that illustrates an open system in which each moment is a mix of newness and repetition, each event a renewed singularity. The hermeneutical praxis appropriate to this system displays a temporality linked to the conception of time in its most rudimentary form as an instant of diremptive reiteration, the repetition of the same as different in the renewal of the different as same. The tendency to generalize, therefore, should not be misconstrued as viewing the variegated history of Jewish mystical doctrines and practices monolithically. (shrink)

Here I argue that wild nature has intrinsic value, which gives rise to obligations both to preserve it and to restore it. First, an account of intrinsic value, which permits core environmentalist claims, is outlined and defended. Second, connections between intrinsic value and obligation are discussed. Third, it is argued that wild nature has intrinsic value, in part, in virtue of its naturalness.

In contrast to other treatments of practical reasoning, Elliot D. Cohen not only teaches students how to identify and refute irrational premises_he also teaches them how to construct rational antidotes to combat the personal, social, and political obstacles they confront in everyday life.

Encouraging students to apply classroom knowledge in their personal, everyday life is a major problem confronting many teachers of critical thinking. For example, while a student might recognize an ad hominem argument in a classroom exercise, it is quite another thing for him or her to avoid the same in interpersonal relations, say with parents, siblings, and peers. One approach to this problem is the creation of interaction software to which students can turn for input on the rationality of their (...) own thinking. Students can then speak to computers rather than instructors about their private lives without having to share confidential information with any other human being, yet still receive relevant feedback. I discuss software technology that actually performs this function. The software in question is an interactive, artificial intelligence program that checks beliefs for faulty thinking, including inductive and deductive errors. The system "scans" student essays for possible fallacies; asks questions at relevant junctions; provides individualized feedback on fallacies committed; provides summaries of fallacies found; diagnoses thinking problems; issues recommendations; and provides other pertinent information. It has been argued for example by Ingmar Persson, that genetic therapy performed on a conceptus does not alter the identity of the person that develops from it, even if we are essentially persons. If this claim is true then there can be person-regarding reasons for performing genetic therapy on a conceptus. Here it is argued that such person-regarding reasons obtain only if we are not essentially persons but essentially animals. This conclusion requires the defeat of the origination theory, which (...) says that personal identity is determined by the identity of the foetus from which one originates. The Body in French Queer Thought from Wittig to Preciado: Queer Permeability identifies a common concern in French queer works for the materiality of the body, and argues for a return to the body as fundamental to queer thought and politics, from HIV onwards.

The fundamental aim of this study will be to offer a precise account of the meaning of Hegel's concept of recognition as it is found in the early Jena-Schriften and the Phenomenology of Spirit . However, in locating the origins of the concept in Greek tragedy, we will also be led beyond the meaning of the concept to its significance. Its significance is established most clearly insofar as the concept can be used to form the basis of an overall interpretation (...) of the PhG as resembling a tragedy. The contemporary influence and relevance of the concept is presented in the Introduction. ;Part I traces the emergence of the concept of recognition out of the concept of love in the Frankfurt-Schriften; it then treats the subsequent development of the concept in the early systematic efforts of the Jena era. Part II focuses upon the distinctive and detailed treatment of the concept as it is portrayed in the PhG. Part III locates the origins of Hegel's concept in Greek tragedy, i.e., tragic recognition, and moves on to consider recognition within the structure of the wholes in the PhG and Greek tragedy. ;The concept of recognition has been seen as Hegel's attempt to come to terms with the individual's lack of integration in modern society. It is employed as a critique of social contract theory in the sense that recognition demands more from individuals in a society than the "merely external bonding" of a contract. The self-knowledge sense of recognition, as opposed to the social and interpersonal senses, has not been given sufficient attention. This can be explained somewhat by the fact that this sense is not featured in the early Jena-Schriften. The relation between knowledge and recognition becomes a pressing issue in the PhG. The self-knowledge sense does not supplant the other senses; rather, it supplements them and thus enriches the concept. The self-knowledge sense of recognition, and even the relation between the different senses is best explicated by reference to tragic recognition. (shrink)

Language evolution has long been researched. I will review a number of broad, emerging research directions which arguably have the potential to contribute to our understanding of language evolution. Emerging topics in genomics and neurolinguistics are explored, and human-specific levels of braincase globularity – and the broader process of self-domestication within which globularity seems capable of being encapsulated – will be argued to be the central pillars of any satisfactory and interdisciplinary model of language evolution.

Zeev Sternhell and Hans Sluga show that fascism and Nazism were part of an early twentieth?century intellectual rebellion against universalism, liberalism, and Enlightenment rationalism. Western technology, values, and political institutions were seen as outmoded, but instead of wanting to return to the traditions of the past, as conservatives wished, these intellectuals thought that fascism could transcend modernity. Sorel, Heidegger, and other fascist modernists offered different radical solutions to what was conceived of as the decadence of liberal Western civilization. Thomas Aquinas describes the Christian as homo viator: the "human wayfarer" or pilgrim journeying through this world to the heavenly city. This journey is vulnerable to "worldly sin" or "worldliness": an excessive attachment to wealth, status, honors, prestige, and power. A major cause of apathy to the poor and the underprivileged, worldliness treats our identity as purely this-worldly and therefore shuts the door to eschatological hope through subtle forms of presumption and despair. Drawing upon Aquinas and other sources in the (...) Western theological tradition, this essay argues that Christians should retrieve worldliness as a moral category to better understand threats to hope. As a remedy to worldliness, Elliot proposes hope's beatitude of poverty of spirit, suggesting that it both increases solidarity with the poor and helps one grow in the theological virtue of hope. Clear and distinct perception is the centrepiece of Descartes’s philosophy — it is the source of all certainty — but what does he mean by ‘clear’ and ‘distinct’? According to the prevailing approach, what it means for a perception to be clear is that its content has a certain objective property, like truth. I argue instead that clarity is at least partly a subjective, phenomenal quality whereby a content is presented as true to the perceiving subject. Clarity comes in degrees. (...) Any weak degree of clarity, available to the senses, can be merely subjective, since what it presents as true may not actually be true. But complete clarity, available to intellectual perception, has an objective dimension, since what it presents as true is always some truth, some bit of reality. Further, I argue that the other perceptual qualities that Descartes identifies — obscurity, confusion, and distinctness — are all defined in terms of clarity. Of particular note is the fact that distinctness is not a positive feature to be added to clarity: a distinct perception is just a completely clear perception. (shrink)

This article first describes some of the chief contrasts between Judaism and American secularism in their underlying convictions about the business environment and the expectations which all involved in business can have of each other—namely, duties vs. rights,communitarianism vs. individualism, and ties to God and to the environment based on our inherent status as God’s creatures rather than on our pragmatic choice. Conservative Judaism’s methodology for plumbing the Jewish tradition for guidance is described and contrasted to those of Orthodox and (...) Reform Judaism.One example of how Conservative Judaism can inform us on a current matter is developed at some length—namely, privacy in the workplace. Dreams have attracted the curiosity of humankind for millennia. In A Dream Interpreted Within a Dream, Elliot Wolfson guides the reader through contemporary philosophical and scientific models to the archaic wisdom that the dream state and waking reality are on an equal phenomenal footing--that the phenomenal world is the dream from which one must awaken by waking to the dream that one is merely dreaming that one is awake. By interpreting the dream within the dream, one ascertains the wakeful (...) character of the dream and the dreamful character of wakefulness. Assuming that the manner in which the act of dreaming is interpreted may illuminate the way the interpreter comprehends human nature more generally, Wolfson draws on psychoanalysis, phenomenology, and neuroscience to elucidate the phenomenon of dreaming in a vast array of biblical, rabbinic, philosophical, and kabbalistic texts. To understand the dream, Wolfson writes, it is necessary to embrace the paradox of the fictional truth--a truth whose authenticity can be gauged only from the standpoint of its artificiality. The dream, on this score, may be considered the semblance of the simulacrum, wherein truth is not opposed to deception because the appearance of truthfulness cannot be determined independently of the truthfulness of appearance. Descartes holds that when you perceive something with perfect clarity, you are compelled to assent and cannot doubt. (This is a psychological claim.) Many commentators read him as endorsing Psychologism, according to which this compulsion is a matter of brute psychological force. I show that, in Descartes’s view, perfect clarity provides a reason for assent—indeed a perfect reason, which precludes any reason for doubt. (This is a normative claim.) Furthermore, advancing a view I call Rational Force, he holds that the (...) normative claim explains the psychological one: since your will is naturally responsive to reasons, you are compelled to assent because you have a perfect reason to assent. This coheres with his view that will is essentially active, self-determined, and free. The force that clarity exerts on the will is not the brute push of an efficient cause, but the rational pull of a final cause. (shrink)
