An important question regarding the use of neurointerventions in criminal justice systems relates to the ethics of offering neurointerventions in exchange for a sentence reduction or as a condition of parole – what has been termed the _neurocorrective offer_. In this paper, we suggest that neurocorrective offers may sometimes involve manipulative pressure. That is, in some cases these offers will involve a pressure to comply with the manipulators’ (i.e., the state’s) bidding that does not rise to the level of coercion, (...) but which cannot be considered an instance of persuasion. We then suggest that offenders may fall victim to this pressure due to general facts about human psychology and their situational vulnerability. We end the paper by identifying three reasons for thinking it prima facie morally wrong for the state to make neurocorrective offers involving manipulative pressure even if such offers do not undermine offenders’ consent to the offer. Specifically, we suggest that such offers are plausibly pro tanto harmful to some offenders and that they sometimes disrespect their autonomy and rationality. (shrink)

The aim of this article is to analyse the internal mechanisms of corporate governance (board of directors and ownership structure), which influence voluntary disclosure of intangibles. The results appear to corroborate the view that an increase in institutional investor shareholding has a negative effect on voluntary disclosure, supporting the hypothesis of entrenchment, whereas an excessive ownership by institutional investors may have adverse effects on strategic disclosure decisions. The results also indicate that an increase in the number of members of the (...) board to up to 15 has a beneficial effect on the disclosure of intangibles. However, as this number increases, the effect inverts and becomes adverse to improving the capacity for supervision and control in the decision-making process regarding the voluntary disclosure of intangibles. The findings endorse the recommendation of the most of the Corporate Governance Codes regarding an advisable maximum of 15 members on a board to ensure its effectiveness and internal cohesion. BackgroundSuicide research aims to contribute to a better understanding of suicidal behaviour and its prevention. However, there are many ethical challenges in this research field, for example, regarding consent and potential risks to participants. While studies to-date have focused on the perspective of the researchers, this study aimed to investigate the views and experiences of members of Human Research Ethics Committees (HRECs) in dealing with suicide-related study applications.MethodsThis qualitative study entailed a thematic analysis using an inductive approach. We conducted semi-structured (...) interviews with a purposive sample (N = 15) of HREC Chairs or their delegates from Australian research-intensive universities. The interview guide included questions regarding the ethical concerns and challenges in suicide-related research raised by HREC members, how they dealt with those challenges and what advice they could give to researchers.ResultsThe analysis identified four main themes: (1) HREC members’ experiences of reviewing suicide-related study applications, (2) HREC members’ perceptions of suicide, suicide research, and study participants, (3) Complexity in HREC members’ decision-making processes, and (4) HREC members’ relationships with researchers.ConclusionsReliance on ethical guidelines and dialogue with researchers are crucial in the assessment of suicide-related study applications. Both researchers and HREC members may benefit from guidance and resources on how to conduct ethically sound suicide-related studies. Developing working relationships will be likely to help HRECs to facilitate high quality, ethical suicide-related research and researchers to conduct such research. (shrink)

According to standard philosophical and clinical understandings, pain is an essentially mental phenomenon. In a challenge to this standard conception, a recent burst of empirical work in experimental philosophy, such as that by Justin Sytsma and Kevin Reuter, purports to show that people ordinarily conceive of pain as an essentially bodily phenomenon—specifically, a quality of bodily disturbance. In response to this bodily view, other recent experimental studies have provided evidence that the ordinary concept of pain is more complex than previously (...) assumed: rather than tracking only bodily or only mental aspects of pain, the ordinary concept of pain can actually track either of these aspects. The polyeidic analysis of the folk concept of pain, as proposed by Emma Borg et al., captures this complexity. Whereas previous empirical support for the polyeidic view has focused on the context-sensitivity of the folk concept of pain, here we discuss individual differences in people’s ‘pain priors’—namely, their standing tendencies to think of pain in relatively mind-centric or body-centric ways. We describe a preliminary empirical study and present a small number of findings, which will be explored further in future work. The results we discuss are part of a larger programme of work which seeks to integrate philosophical pain research into clinical practice. For example, we hypothesise that variations in how patients with chronic pain are thinking about pain could help predict their responses to treatment. (shrink)

To deal with the upcoming challenges and complexity of the nursing profession, it is deemed important to reflect on our current organization of care. However, before starting to rethink the organization of nursing care, an overview of important elements concerning nursing care organization, more specifically nursing models, is necessary. The aim of this study was to conduct a mapping review, accompanied by an evidence map to map the existing literature, to map the field of knowledge on a meta‐level and to (...) identify current research gaps concerning nursing models in a hospital setting. Next to nursing models, two other organizational correlates seem to be of importance when looking at the organization of nursing care: nurse staffing and skill mix. Although it seems that in recent research, the theoretical focus on the organization of nursing care has been left behind, the increasingly complex healthcare environment might gain from the use of nursing theory, or in this case, care delivery models. As almost no fundamental studies have been done toward the combination of care delivery models, nurse staffing, and skill mix, those elements should be taken into account to fully capture the organization of nursing care in future research. In many parts of sub-Saharan Africa, mothers impacted by the genetic condition of albinism, whether as mothers of children with albinism or themselves with albinism, are disproportionately impacted by a constellation of health-related stigma, social determinants of health, and human rights violations. In a critical ethnographic study in Tanzania, we engaged with the voices of mothers impacted by albinism and key stakeholders to elucidate experiences of stigma. Their narratives revealed internalized subjective stigma, social stigma such as being ostracized by family (...) and community, and structural stigma on account of lack of access to SDH. An analysis of health systems as SDH revealed stigmatizing attitudes and behaviours of healthcare providers, especially at the time of birth; a lack of access to timely quality health services, in particular skin and eye care; and a lack of health-related education about the cause and care of albinism. Gender inequality as another SDH featured prominently as an amplifier of stigma. The findings pose implications for research, policy, and practice. A concrete avenue to de-stigmatization of mothers impacted by albinism exists by the application of principles of human rights, particularly equality and non-discrimination; contextual analysis of cultural dynamics including relevant ontology; meaningful participation of rights-claimants, such as peer groups of mothers; and accountability of governments and their obligation to ensure access to health information as a key social determinant of the right to health. Emma Borg examines the relation between semantics and pragmatics, and assesses recent answers to fundamental questions of how and where to draw the divide between the two. She argues for a minimal account of the interrelation between them--a 'minimal semantics'--which holds that only rule-governed appeals to context can influence semantic content.

Minimal Semantics asks what a theory of literal linguistic meaning is for - if you were to be given a working theory of meaning for a language right now, what would you be able to do with it? Emma Borg sets out to defend a formal approach to semantic theorising from a relatively new type of opponent - advocates of what she call 'dual pragmatics'. According to dual pragmatists, rich pragmatic processes play two distinct roles in linguistic comprehension: as (...) well as operating in a post-semantic capacity to determine the implicatures of an utterance, they also operate prior to the determination of truth-conditional content for a sentence. That is to say, they have an integral role to play within what is usually thought of as the semantic realm. Borg believes dual pragmatic accounts constitute the strongest contemporary challenge to standard formal approaches to semantics since they challenge the formal theorist to show not merely that there is some role for formal processes on route to determination of semantic content, but that such processes are sufficient for determining content. Minimal Semantics provides a detailed examination of this school of thought, introducing readers who are unfamiliar with the topic to key ideas like relevance theory and contextualism, and looking in detail at where these accounts diverge from the formal approach. Borg's defence of formal semantics has two main parts: first, she argues that the formal approach is most naturally compatible with an important and well-grounded psychological theory, namely the Fodorian modular picture of the mind. Then she argues that the main arguments adduced by dual pragmatists against formal semantics - concerning apparent contextual intrusions into semantic content - can in fact be countered by a formal theory. The defence holds, however, only if we are sensitive to the proper conditions of success for a semantic theory. Specifically, we should reject a range of onerous constraints on semantic theorizing (e.g., that it answer epistemic or metaphysical questions, or that it explain our communicative skills) and instead adopt a quite minimal picture of semantics. Conversation-as-material is a language-based artistic research practice for attempting to speak from within the experience of collaborative artistic exploration, a linguistic practice attentive to the lived experience of aesthetic co-creation. The practice of conversation-as-material, which forms the basis of this article, has evolved through tentative exploration of the questions: How can the shared act of conversation bring into reflective awareness the live and lived, yet often hidden or undisclosed, experience of artistic practice and process, especially within collaboration? How can the (...) event of conversation be developed as an artistic research practice for attempting to give tangibility, whilst also remaining in fidelity, to the pre-reflective aspects of this lived experience? Considered less as a means for talking about, conversation-as-material may be understood as a practice for inviting immanent, inter-subjective modes of verbal-linguistic sense-making emerging through different voices enmeshed in live exchange. Conversation — from con- meaning ‘with, together’ and versare, ‘to turn, bend’; or else, from conversare — ‘to turn about, to turn about with’. Conversation-as-material has emerged as a practice of collaborative writing, which unfolds through the interplay of different voices ‘turning about’ together in conversation. In this sense, the practice can be differentiated from that of interview — for in the practice of conversation-as-material there is no researcher/researched dichotomy. Within the practice, an attempt is made to develop an approach to writing that finds expression first through verbal conversation, which is then subsequently distilled, even densified, towards poetic text. Conversation-as-material involves the gradual revelation of an artistic-poetic, perhaps even phenomenological, mode of emergent writing for speaking from the experience of collaborative co-creation, where linguistic content is not already known in advance, but rather emerges in and through the lived working-with of language. The practice of conversation-as-material thus comprises a quadripartite process of conversation, transcription, distillation, and presentation, where each part involves the activation of a particular aesthetic or poetic mode of attention, perhaps even a specific phenomenological attitude or disposition. This article explores predominant uses of theory in social science research in relation to the approach of phenomenological philosophy. While phenomenology is sometimes interpreted as one theoretical or methodological paradigm amongst others in the field of qualitative research, this article explores key thinkers within the philosophical tradition of phenomenology to argue that this tradition can raise challenges for predominant conceptions of research and theorizing in the social sciences and certain philosophical idea(l)s that can be connected to them. The distinctive nature (...) of phenomenological description is outlined, and new possibilities for qualitative research are sketched. Also considered is the question of whether qualitative research should seek to enshrine the intellectual virtues of the arts, and resist the inclination towards the scientific -- and scientistic -- drive to theorize. It is well established that the temporal proximity of two events is a fundamental cue to causality. Recent research with adults has shown that this relation is bidirectional: events that are believed to be causally related are perceived as occurring closer together in time—the so‐called temporal binding effect. Here, we examined the developmental origins of temporal binding. Participants predicted when an event that was either caused by a button press, or preceded by a non‐causal signal, would occur. We demonstrate for (...) the first time that children as young as 4 years are susceptible to temporal binding. Binding occurred both when the button press was executed via intentional action, and when a machine caused it. These results suggest binding is a fundamental, early developing property of perception and grounded in causal knowledge. (shrink)

A model-theoretic realist account of science places linguistic systems and their corresponding non-linguistic structures at different stages or different levels of abstraction of the scientific process. Apart from the obvious problem of underdetermination of theories by data, philosophers of science are also faced with the inverse (and very real) problem of overdetermination of theories by their empirical models, which is what this article will focus on. I acknowledge the contingency of the factors determining the nature – and choice – of (...) a certain model at a certain time, but in my terms, this is a matter about which we can talk and whose structure we can formalise. In this article a mechanism for tracing "empirical choices" and their particularized observational-theoretical entanglements will be offered in the form of Yoav Shoham's version of non-monotonic logic. Such an analysis of the structure of scientific theories may clarify the motivations underlying choices in favor of certain empirical models (and not others) in a way that shows that "disentangling" theoretical and observation terms is more deeply model-specific than theory-specific. This kind of analysis offers a method for getting an articulable grip on the overdetermination of theories by their models – implied by empirical equivalence – which Kuipers' structuralist analysis of the structure of theories does not offer. Artist, poet, educationalist and autobiographer, Marion Milner is considered one of the most original of psychoanalytic thinkers whose life spans a century of radical change. _Marion Milner: The Life_,_ _is the first biography of this extraordinary woman. It introduces Milner and her works to the reader through her family, colleagues and, above all through her books, charting their evolution and development as well as their critical reception and contribution to current twenty-first century debates and discourses. Further, _Letley _explores Milner's literary character from her very early diaries and narratives to her last book written in her 90's published in 2012. The biomedical industry relies on the skills of animal technologists to put laboratory animal welfare into practice. This is the first study to explore how this is achieved in relation to their participation in implementing refinement and reduction, two of the three key guiding ethical principles––the “3Rs”––of what is deemed to be humane animal experimentation. The interpretative approach contributes to emerging work within the social sciences and humanities exploring care and ethics in practice. Based on qualitative analysis of participant observation (...) within animal research facilities in UK universities, in-depth interviews with ATs, facility managers, and other stakeholders, and analysis of regulatory guidelines, we draw a contrast between the minimum required of ATs by law and how their care work not only meets but often exceeds these requirements. We outline how ATs constitute a key source of innovation and insight into the refinement of animal care and the reduction of animal use, hitherto not formally acknowledged. Exploring AT care work as an example of ethics in practice makes an original contribution to broader debates within health care and animal welfare about how technology, regulation, and behavior can foster and sustain a “culture of care”. Intuitively, what these expressions have in common is the central role they accord to perception of an object: you can see the book you want to talk about, there are (...) people around in our community who have bumped into Tony, and, although no one alive today perceived Aristotle directly, it seems plausible to claim that our ability to use the name now relies on the fact that someone, sometime, did perceive him directly. However, as anyone at all familiar with rigid designation knows, not all such expressions follow this model. Kripke himself stressed that certain definite descriptions have a constant extension across all possible worlds (for example, ‘the smallest prime number’, ‘the actual prime minister of Great Britain now’) and thus meet the criterion for being rigid designators; while Kaplan emphasized the role of a descriptive rule in determining the referent for a token utterance of an indexical, like ‘I’ or ‘tomorrow’. The article is a cultural-philosophical response to Ivan Gerát’s Legendary Scenes and his art history interpretation of the function of Slovak hagiographic pictorial art of the Late Middle Ages. The thrust is on paintings of Christian ethical extremism, reflected in the principle of imitatio Christi. It led to the deaths of martyrs and saints in the name of the Faith. The preponderance of brutal scenes involving the tortured human body in this period art is examined in detail and it is (...) suggested that these portrayals are disincentives that put off the mass culture beholder. The contextualist art history method employed in Gerát’s book is gradually explored, along with its potential to transform the uninterested postmodern beholder into an intelligent beholder and art tourist. Attention is paid to the educational and national branding aspects of Legendary Scenes. (shrink)

Polybios’ famous description of Philip V of Macedon as “the darling of the Greeks” (ἐρώμενος … τῶν Ἑλλήνων) comes about at a critical moment in the historian’s narrative of the king’s life: it appears at the end of a summary extolling all of the good characteristics and deeds Philip exhibited and achieved in his early years, when he had inspired great hopes of future magnanimity amongst his Greek allies (4.27.9, 77; 7.11); and just before the king takes a sudden turn (...) for the worse in 215 BC, when he incites revolution in the allied city of Messene and attempts to impose a Macedonian garrison on its citadel. This article sets out to break new ground not only in the study of the Macedonian king, but also in the study of the literary aspects of Polybios’ work, by exploring this statement in more depth and arguing that it retained its significance beyond the structural demarcation of Philip’s change. The imagery that such a title inherently possessed and conveyed helped to define and deepen understanding of the relationship between Philip and his Greek allies in his early years by evoking implicit connotations within the audience. Electronic surveillance of employees in the workplace presents both opportunities and risks to contemporary managers. Some of the moral risks associated with electronic workplace surveillance are well-known and discussed in the literature. A lesser-known risk, which is explored and addressed in this article, is the threat that electronic surveillance poses, when used inappropriately, to employees’ personal autonomy. This article elaborates the concept of personal autonomy, illustrates how electronic workplace surveillance might be used to violate personal autonomy, and suggests some management (...) strategies that could be used to avoid such violations. The paper is concerned with disputes over sovereignty and global commerce in the 1760s and 1770s. The eighteenth-century revolution in economic science has been identified with agricultural reforms, and with the definition of national economies. The economists of the time, including Turgot, Mirabeau, Dupont de Nemours, Baudeau and Adam Smith, were also intensely interested in the merchant sovereigns of the French, English and Dutch East India companies, and in the new colonial ventures of the post-Seven Years War period. Their writings (...) on global commerce were sometimes extraordinarily detailed (about herrings, for example, or bye-laws) and often untheoretical. Turgot was for a brief period minister of the navy and of the colonies. The older Mirabeau described the as and the cod of the North Atlantic as But the economists’ writings on global connections were the occasion for some of their most profound reflections on the political consequences of laissez-faire, on theories of sovereignty, on the difficulties of transporting information or instructions over very large distances, and on the changing relationships between power, law and commerce. The disputes over long-distance commerce provide an interesting insight, the paper suggests, into ways of thinking which were at the same time scientific and administrative, global and provincial. In this paper I want to explore the arguments for so-called ‘unarticulated constituents’ (UCs). Unarticulated constituents are supposed to be propositional elements, not presented in the surface form of a sentence, nor explicitly represented at the level of its logical form, yet which must be interpreted in order to grasp the (proper) meaning of that sentence or expression. Thus, for example, we might think that a sentence like ‘It is raining’ must contain a UC picking out the place at which (...) the speaker of the sentence asserts it to be raining. In §1 I will explore the nature of UCs a little further, and, in §2, suggest that we can recognise two different forms of argument for them.. (shrink)

It is often claimed that Margaret Cavendish was an anti-experimentalist who was deeply hostile to the activities of the early Royal Society—particularly in relation to Robert Hooke's experiments with microscopes. Some scholars have argued that her views were odd or even childish, while others have claimed that they were shaped by her gender-based status as a scientific ‘outsider’. In this paper I examine Cavendish's views in contemporary context, arguing that her relationship with the Royal Society was more nuanced than previous (...) accounts have suggested. This contextualized approach reveals two points: first, that Cavendish's views were not isolated or odd when compared with those of her contemporaries, and second, that the early Royal Society was less intellectually homogeneous than is sometimes thought. I also show that, although hostile to some aspects of experimentalism, Cavendish nevertheless shared many of the Royal Society's ambitions for natural philosophy, especially in relation to its usefulness and the importance of plain language as a means to disseminate new ideas. This essay explores the significant role that the writings and Stoic philosophy of Marcus Aurelius came to play in the life and work of William James. James’s correspondence reveals that he first read Aurelius’s Meditations during the troubled ‘crisis years’ of his twenties. Moreover, these writings were a source of solace for James and informed his personal life philosophy during this period. There is evidence that it was from a Stoic standpoint that he contested his father’s faith. And, in later (...) years, it is his interrogation of the experiential divide between a life lived under Stoicism and one lived as a ‘religious’ believer that lies at the heart of his Varieties of Religious Experience. Minimal semantics is sometimes characterised as a ‘neo-Gricean’ approach to meaning. This label seems reasonable since a key claim of minimal semantics is that the minimal contents possessed by sentences (akin to Grice’s technical notion of ‘what is said by a sentence’) need not be (and usually are not) what is communicated by a speaker who utters those sentences. However, given an affinity between the two approaches, we might expect that a well-known challenge for the Gricean – namely that their (...) account fails to fit with the psychological evidence concerning linguistic understanding – could also be levelled at the minimalist, and indeed this seems to be the basis of Recanati’s challenge to minimalism from his ‘availability principle’ (Recanati 2004). This paper aims to explore the relationship between semantics and psychology and show how both Gricean and minimalist approaches can avoid the challenge from psychological evidence. I conclude by suggesting that the way in which minimalism avoids this challenge also helps the account to defuse Clapp’s ‘naturalistic objection’ (Clapp 2007) that there are no grounds for selecting a correct minimal semantic theory.
