La crise sanitaire et sociale provoquée par la Covid-19 a été surmontée par des dispositions qui relèvent autant d’une logique de précaution que de prévention. En effet, la certitude liée à l’existence de ce virus n’a pas suffi à lever toutes les zones d’ombre sur son traitement. Au moins au début de la crise, c’est l’existence même d’un risque qui pouvait être discutée. En conséquence, les dispositions adoptées, sous la menace de sanctions pénales, relèvent en partie d’une logique de précaution (...) dont l’analyse appelle des commentaires mitigés. Il en va a fortiori de même pour l’usage des qualifications de droit commun qui s’avèrent inadaptées. (shrink)

This paper contrasts the Hegelianism of contemporary neo-pragmatism and the Hegelianism of classical pragmatism as it has been reassessed in contemporary Deweyan scholarship. Drawing on Dewey’s interpretation of Hegel, this paper argues that Hegel’s theory of the spirit is in many aspects more akin to Dewey’s pragmatism than Brandom’s. The first part compares Dewey’s pragmatism with Hegel’s conceptions of experience and the theory/practice relation. The second part compares Dewey’s naturalism with Hegel’s theory of the relation between nature and spirit.

The precise meaning of “human dignity” is increasingly being questioned in ethics and law. Is human dignity an adequate guide to policymaking in today’s biotechnological era? This article is an attempt to answer this thorny issue. The emergence of the concept of human dignity as a key point of reference for the regulation of modern science and technology in the European Union is evaluated. The main contribution of this article is to prove that in EU Directives and Recommendations, human dignity (...) is not an elusive concept but rather a regulatory restraint in European public policies on biotechnology, particularly through the influence of the European Group on Ethics in Science and New Technologies. Two examples will be elaborated to prove this claim: first, the issue of intellectual property in biotechnological inventions, and secondly the funding of research proposals involving the use of human embryonic stem cells. These examples prove that the principle of human dignity is not an empty concept as some philosophers and bioethicists claim but rather a normative guideline that is shaping European policies on biotechnology. This paper tests whether individual perceptions of markets as good or bad for a public good is correlated with the propensity to report gaps in willingness to pay and willingness to accept revealed within an incentive compatible mechanism. Identifying people based on a notion of market affinity, we find a substantial part of the gap can be explained by controlling for some variables that were not controlled for before. National conscripts and their quest for closure:A Pastoral challenge. During the apartheid era, young white men were conscripted for military service in the South African Defence Force. After the demise of apartheid, these military veterans became part of the transformation process in the country. They were often not prepared for the emotional and psychological impact of the political, economic and social changes. Many of them found and still find it difficult to take their place among the citizenry of the country. (...) The post-apartheid government provided no support for them to reintegrate into the community or to process the often long-lasting effects of war related trauma and moral injury. For many, this resulted in a lack of healing and closure on a psychological, moral and spiritual level. This article aims to contribute from a pastoral care perspective to the process of healing, closure and reintegration of this specific group. A holistic narrative approach integrates the contextual approach of Charles Gerkin, the philosophical counselling of Daniel Louw and the insights of Neil Anderson with regard to the connection between spirituality and identity. A contextual approach promotes a deeper understanding of the veterans and their needs in the context of their local communities, including faith communities. In these local communities, resources are available and should be utilised. Such a constructive engagement between veterans, local communities and faith communities can contribute to healthier individuals, families and communities as well as to a healthier society. Guidelines for pastoral support of these veterans that can contribute to their social and personal transformation and process of psychological closure are proposed. (shrink)

The concepts of globalisation and of neoliberalism are symptomatic of the transformations which have taken place in the way the question of social critique has been addressed. The contemporary period has witnessed the emergence of a protocol of social analysis in which political inquiry is linked to historical diagnosis, drawing on the categories of historical periodisation and of economic analysis. In 1978, treatment and vaccination programs were recommended to control bovine trypanosomiasis and brucellosis in Ivory Coast. A single trypanocidal treatment of young calves dramatically reduced their mortality rate. A preliminary demonstration project was carried out in a limited area by the government agency SODEPRA, followed by demonstrations on nearly all the farms. The costs were covered by SODEPRA as one of their development projects. Over a period of time the farmers took charge of the treatments, both financially and physically. (...) In 1992, the trypanocidal treatments were still widely used. The reasons for this success could be its dramatic efficacy, the simple technology employed, the low cost that was progressively charged to the farmers, and the fact that this was a long term extension project with continuous farmer training. The brucellosis control program started with an initial vaccination of 1 to 10 year old females followed by an annual vaccination of 1 to 2 year old heifers. One year later, a 37% reduction in the abortion rate was observed. The vaccination were paid for and carried out by SODEPRA. The control program then stopped but, because of growing problems with brucellosis, vaccinations started again in 1992. There is still a question of how vaccinations will be accepted when the farmers are required to share the cost for the control of a largely inconspicuous disease. (shrink)

This is a translation of ‘Socialité et argent’, a text by Emmanuel Levinas originally published in 1987. Levinas describes the emergence of money out of interhuman relations of exchange and the social relations – sociality – that result. While elsewhere he has presented sociality as ‘nonindifference to alterity’ it appears here as ‘proximity of the stranger’ and points to the tension between an economic system based on money and the basic human disposition to respond to the face of the (...) other person. Money both encodes and effaces sociality, both designates and disguises social relations. It arises from the way that needs and interests are manifested in exchange relations, in what he calls the ‘interestedness’ of economic life. But interests are always already cut through by the fact that being is always ‘being with others’. Being is always ‘interbeing’. Interestedness is always confronted by disinterestedness, that is, by a sociality marked by the ‘goodness of giving’, attachment to and concern for the poverty of the other person. Levinas concludes with a discussion of sociality and justice, posing questions about the tension between the demand to respond to an Other immediately before me and at the same time to respond to the demands of an other Other (the third person) who also invites a response. A simplistic image of twentieth century French philosophy sees Merleau-Ponty’s death in 1961 as the line that divides two irreconcilable moments in its history: existentialism and phenomenology, on the one hand, and structuralism on the other. The structuralist generation claimed to recapture the dimension of objectivity and impersonality, which the previous generation was supposedly incapable of. As a matter of fact, in 1962, Derrida’s edition of Husserl’s The Origin of Geometry was taken to be a turning point that announced the (...) structuralist revolution by introducing a reflection on the historicity and the materiality of impersonal idealities. And yet, the 1998 publication of Merleau-Ponty’s notes from his Collège de France lecture course on the same topic make manifest that he was already taking phenomenology in another direction. His 1959 reading of The Origin of Geometry shows how unexpectedly close the early Derrida is to the late Merleau-Ponty. By identifying the tension between archaeology and teleology as the basic problem of Husserlian phenomenology, Merleau-Ponty and Derrida each disclose the fundamental importance of history and of writing. Comparing the two readings in their specific context not only brings about a more complex picture of the intellectual debates of the time, but also shows how, with Merleau-Ponty’s interpretation of The Origin of Geometry, Derrida’s “différance” predates itself and receives another genealogy. Construction process stages are argued to be vulnerable to the prevalence of corrupt practices. However, the validity of this argument has not been empirically explored in the extant literature of construction management. Therefore, this study examines the stages of the construction process susceptibility to corruption and its most prominent forms of corrupt activities. A total of forty-four project-related professionals were involved in an expert survey to assess such susceptibilities and the criticality of the identified corrupt activities at each stage. A (...) comparative study of expert views from developing regions against experts from developed regions is conducted. Expert scoring results revealed that three stages are most susceptible, namely: project execution, pre-qualification and tender stages. Such results were confirmed by application of the Mann–Whitney U test statistics tool, showing wide disparities in seven out of eleven identical stages. This study is intended to incite polemic discussions and greater empirical, evidence-based research from scholars in both developed and developing countries. This study adds to the extant literature corruption-related works on the construction process through deeper understanding of the dynamic nature of corrupt practices involved in the stages of the construction process in developing countries. Practically, it intends to offer a veritable plethora of information on the critical stages of the construction process for industry practitioners, policymakers and anti-corruption bodies to careen their attention towards the fight against corruption.
