Frege claims that the laws of logic are characterized by their “generality,” but it is hard to see how this could identify a special feature of those laws. I argue that we must understand this talk of generality in normative terms, but that what Frege says provides a normative demarcation of the logical laws only once we connect it with his thinking about truth and science. He means to be identifying the laws of logic as those that appear in every (...) one of the scientific systems whose construction is the ultimate aim of science, and in which all truths have a place. Though an account of logic in terms of scientific systems might seem hopelessly antiquated, I argue that it is not: a basically Fregean account of the nature of logic still looks quite promising. Garfinkel’s Ethnomethodology (EM) at its core involves a praxeological, or interactional, respecification of Gestalt phenomena. In early EM, this is pursued through the development of a category of praxeological Gestalten in which social facts (or social units) are respecified as Gestalt phenomena, where members are the constituents and the social unit is the whole or Gestalt, produced praxeologically by the methodic work of its members. In later work, Garfinkel would praxeologically transpose traditional perceptual Gestalt phenomena, such as music, to explore (...) the interactional work done in the production and perception of those phenomena. In developing EM by praxeologically reconfiguring Gestaltism, Garfinkel drew on the constitutive phenomenology of Aron Gurwitsch, wherein Gurwitsch sought to integrate Gestalt Psychology and phenomenology. In drawing on Gurwitsch, while also being informed by the work of Schütz and, later, Merleau-Ponty, EM is often depicted as either heavily indebted to phenomenology or as a distinct type of phenomenology: praxeological phenomenology, perhaps. At the same time, parallels have been drawn between Ludwig Wittgenstein’s later work and EM, since Garfinkel’s Studies in Ethnomethodology was published in 1967. The parallels drawn have often centred on the treatment of rules and rule-following and on the similarities in the treatment of meaning in EM and in Wittgenstein’s later work. However, given the centrality of Gestalt psychology to the development of EM, it is worth noting that in his later manuscripts Wittgenstein discussed Gestalt phenomena and Gestalt Psychology extensively and in ways that often anticipate what Garfinkel would do with Gestaltist ideas. It is, therefore, worth exploring the similarities and differences between Wittgenstein’s, Gurwitsch’s and Garfinkel’s engagement with Gestaltism. This is what I seek to do in this article. In conclusion, I propose that EM should be seen, like Wittgenstein, as post-phenomenological. (shrink)

At the conclusion of his De lege naturae apodictica methodus, a treatise on the law of nature, how it is grasped by the human mind, and how it coheres with the Decalogue, Niels Hemmingsen claims to have eschewed the use of theological sources in his argument, claiming instead to have demonstrated ‘how far reason is able to progress without the prophetic and apostolic word’. Yet the reader of the treatise will notice several citations of theologians alongside those of pagan poets (...) and philosophers. This essay demonstrates that there is less here than meets the eye, that is, that Hemmingsen quotes theologians only to buttress what one can know from natural reason or the classical tradition, even when he is discussing God, and thus he does not violate his own stated principle. Dr Schildkrout probes questions of ethnicity, religion, cultural change and the African national identity in this study of the immigrant community of Kumasi, Ghana's second largest city. She compares first- and second-generation immigrants - those born in their rural homelands, and those born in Ghana - in terms of their orientation to politics, to kinship, and to community participation. The author explores the meaning of ethnic identity for rural- and urban-born immigrants, and establishes certain generalizations about ethnicity based on these (...) comparisons. The book discusses the issues of migration, particularly interregional migration; the position of the 'stranger'; questions of cultural change in modern Africa; the 'generational gap' in the African context; the questions of citizenship and national identity in Africa today, and the emergence of new identities, regional, national and religious. This book has importance not only as a local case study that gives a full description of West African urban life, but also as a theoretical reconsideration of ethnicity that has application outside the African context. This reading group has its origins in Wes Sharrock’s weekly discussion groups, which have taken place in Manchester (UK) since the early 1970s. As the global Covid-19 pandemic hit in early 2020, the reading group moved online, facilitated by Phil Hutchinson and Alex Holder. Being an online reading group opened up participation to people beyond Northwest UK (...) and within weeks the group became global, with the membership including participants logging on from Canada, Czech Republic, Finland, France, Germany, Greece, Hong Kong, Japan, Macau, New Zealand, Spain, Sweden, and the USA. Why does Frege claim that logical axioms are ‘self‐evident,’ to be recognized as true ‘independently of other truths,’ and then offer arguments for those axioms? I argue that he thinks the arguments provide us with the justification that we need for accepting the axioms and that this is compatible with his remarks about self‐evidence. This compatibility depends on philosophical considerations connected with the ‘critical method’: an interesting approach to the justification of axioms endorsed by leading philosophers at the time.

Commentators regularly attribute to Frege realist, idealist, and quietist responses to metaphysical questions concerning the abstract objects he calls ‘thoughts’. But despite decades of effort, the evidence offered on behalf of these attributions remains unconvincing. I argue that Frege deliberately avoids commitment to any of these positions, as part of a metaphysical separatist policy motivated by the fact that logic is epistemologically autonomous from metaphysics. In this paper, I discuss stigma, understood as a category which includes acknowledged, enacted degradation, discreditation and discrimination. My discussion begins with an analysis of HIV stigma, as discussed in a social media post on Twitter. I then analyse a fictionalized clinical stigma scenario. These two analyses are undertaken to highlight aspects of the conceptual anatomy and interactional dynamics of stigma and by extension shame. Brief social media declarations and short, fictionalized clinical interactions are rich with information which helps us (...) understand how stigma—degradation, discreditation and discrimination—is operationalized in interaction. In this paper I focus on four varieties of shame absence. My hope is that re-flection on these varieties of shame-absence will go some way to giving us a more complete picture of the role that shame plays in our moral character and in discussions of atrocity. I note that the shame that emerges from an exposure to atrocity can be in part what leads us to identify the event as atro-cious. I progress to argue that when shame is absent, (...) this absence can serve to blind us to the atrocity that is before us and that is ours to work to prevent. Feeling shame is part of seeing the atrocity for what it is in an appropriate emotionally-engaged manner. It is thus a vital part of being human, and its absence in certain cases is an all-too-human failure of humanity. (shrink)

The only definitive survey of the entire Australian judiciary, this text describes and evaluates the work, techniques, problems and the future of the different tiers of courts and judges. It discusses the role of the judiciary as the third sector of government and analyses and comments on judicial conduct, judicial independence and impartiality, the work of judges beyond the courts, the accountability of (...) judges and the dangers to judicial institutions. Based upon the work of C. H. Douglas, this paper explores the role of debt in the economy. In the 1920s Douglas observed the workings of financial mechanisms within the real economy, noting that they could be modified to achieve a socially and ecologically sustainable economics of sufficiency. Douglas' exploration of the role of debt in the economy accords well with Veblen's institutional analysis, while his writing reverberates with Veblenian terminology. As an economist, Douglas is both intuitive and eclectic, and, (...) as Mehta observes, ‘no writer in economics has made his thought so opaque to the reader.’ Nevertheless, Douglas' rejection by orthodoxy was due in no small measure to the impracticality of tailoring his theoretical observations within the constraints of neo-classical general free market equilibrium theory. Although they gave rise to a widespread popular movement, Douglas' proposals for debt-free finance of production could not be accommodated within economic orthodoxy. (shrink)

ABSTRACT The article examines Old English claims to catholic ‘liberty of conscience’ and the way in which this engendered a discussion of English liberties in Ireland. Old English representatives sought to ground their claims to ‘liberty of conscience’ in established practice, custom and law. Their claims to ‘liberty of conscience’ also brought into play the vocabulary of corporate and parliamentary liberty. In response, New English protestants turned to ideas of duty and citizenship, which were equally embedded in conceptions of English (...) liberties. They argued that a catholic ‘conscience’ sat in opposition to ideas of duty to the king and the commonwealth. In doing so, the New English questioned both the basis and extent of the liberties possessed by the Old English. Such an exchange, this article argues, is illustrative of the way in which an English pairing of liberties, with ideas of duty and active citizenship, opened up an area of dispute involving a shared set of political concepts and vocabulary. The recent publication of a lost essay by Herbert Hart is important for an historical appreciation of his work, but its likely celebration is a sad testament to the poverty and lethargy of contemporary legal thought. I use this occasion to review the state and condition of contemporary legal theorising. After positioning Hart's essay in the prevailing jurisprudential milieu, I highlight the thrust and the failings of the three main traditional approaches to contemporary legal theorising in regard to the nature (...) and operation of 'judicial discretion'. Then, I suggest an alternative approach to legal theorising that recommends a more satisfying way of proceeding. (shrink)

This book examines the origins and boundaries of Japanese digital role-playing games. A geographically diverse roster of contributors introduces English-speaking audiences to Japanese video game scholarship and applies postcolonial and philosophical readings to the Japanese game text.

In this article, I perform an aesthetic analysis of the intuition of phenomenal consciousness, redescribing this intuition as the result of a creative activity affirming of the uniqueness and value of human engagements with the world rather than the result of an activity of self-knowing through which phenomenal awareness becomes aware of itself. During this analysis, I analogize the construction of the intuition of phenomenal consciousness to the construction of religious intuitions for sophisticated believers and the construction of aesthetic intuitions (...) for sophisticated aesthetes. I find accounts of the 'mistake' of the intuition of phenomenal consciousness by authors such as Dennett are overly reductive and simplistic, even though I agree that phenomenal consciousness is a created illusion rather than a natural kind. The intuition of phenomenal consciousness is a sophisticated formation which testifies to the commitment of certain naturalistically inclined theorists to the inestimable value of private experience. In recent decades, debate on the quality and safety of healthcare has been dominated by a measure and manage administrative rationality. More recently, this rationality has been overlaid by ideas from human factors, ergonomics and systems engineering. Little critical attention has been given in the nursing literature to how risk of harm is understood and actioned, or how patients can be subjectified and marginalised through these discourses. The problem of assuring safety for particular patient groups, and the dominance of technical (...) forms of rationality, has seen the word ‘unavoidable’ used in connection with intractable forms of patient harm. Employing pressure injury policy as an exemplar, and critically reviewing notions of risk and unavoidable harm, we problematise the concept of unavoidable patient harm, highlighting how this dominant safety rationality risks perverse and taken‐for‐granted assumptions about patients, care processes and the nature of risk and harm. In this orthodoxy, those who specify or measure risk are positioned as having more insight into the nature of risk, compared to those who simply experience risk. Driven almost exclusively as a technical and administrative pursuit, the patient safety agenda risks decentring the focus from patients and patient care. (shrink)
