Robert Alexy has argued that the democratic objection to judicial review of legislation can be successfully addressed by assuming that judges exercise a special form of argumentative representation. In this article we argue that Alexy does not explain (as he should) under what circumstances judicial review tends to produce better decisions than parliamentary procedure, nor does he explain how judicial review can have a greater intrinsic value than parliamentary procedure. Subsequently, we argue that the intrinsic value of argumentative representation depends (...) on the promotion of citizen deliberation, whereas its instrumental value depends on judges being committed to the rights of discrete and insular minorities in the face of hostile majorities. En este artículo exploro algunos de los tópicos vinculados tradicionalmente con el problema de la normatividad del derecho: autonomía, racionalidad, relevancia práctica, razones para la acción y autoridad. Trataré de construir un marco conceptual que refleje la complejidad teórica del problema y las posiciones filosóficas desde los cuales puede ser abordado. Particularmente, me centraré en el análisis de las asunciones filosóficas relacionadas con ciertas posturas y la revisión de su coherencia mutua.

Philosophers of mind and epistemologists are increasingly making room in their theories for epistemic emotions (E-emotions) and, drawing on metacognition research in psychology, epistemic – or noetic or metacognitive – feelings (E-feelings). Since philoso- phers have only recently begun to draw on empirical research on E-feelings, in particular, we begin by providing a general characterization of E-feelings (section 1) and reviewing some highlights of relevant research (section 2). We then turn to philosophical work on E-feelings and E-emotions, situating the contributions (...) to the focus section (two articles devoted to E-feelings and two devoted to E-emotions) with respect to both the existing literature and each other (section 3). Among the phenomena that make up the mind, cognitive psychologists and philosophers have postulated a puzzling one that they have called ?epistemic feelings.? This paper aims to (1) characterize these experiences according to their intentional content and phenomenal character, and (2) describe the nature of these mental states as nonconceptual in the cases of animals and infants, and as conceptual mental states in the case of adult human beings. Finally, (3) the paper will contrast three accounts of the causes and (...) mechanisms of epistemic feelings: the doxastic account; the mental scanner account; and the heuristic mechanism account. Recent debates on mental extension and distributed cognition have taught us that environmental resources play an important and often indispensable role in supporting cognitive capacities. In order to clarify how interactions between the mind –particularly memory– and the world take place, this paper presents the “selection problem” and the “endorsement problem” as structural problems arising from such interactions in cases of mental scaffolding. On the one hand, the selection problem arises each time an agent is confronted with a cognitive problem, (...) since she has to choose whether to solve it internally or externally. How does she choose? On the other hand, when confronted with the internally or externally retrieved solution to a cognitive task, the subject has to decide whether to endorse the information. How does the subject decide whether to endorse it or not? The last section proposes a solution to each problem in terms of metamemory and metacognitive feelings. Metamemory evaluates memory each time the subject is confronted with a memory task and elicits either a positive or negative metacognitive feeling that guides the decision. (shrink)

Two main theories about metacognition are reviewed, each of which claims to provide a better explanation of this phenomenon, while discrediting the other theory as inappropriate. The paper claims that in order to do justice to the complex phenomenon of metacognition, we must distinguish two levels of this capacity—each having a different structure, a different content and a different function within the cognitive architecture. It will be shown that each of the reviewed theories has been trying to explain only one (...) of the two levels and that, consequently, the conflict between them can be dissolved. The paper characterizes the high-level as a rationalizing level where the subject uses concepts and theories to interpret her own behavior and the low-level as a controlling level where the subject exploits epistemic feelings to adjust her cognitive activities. Mind-wandering seems to be paradigmatically unintentional. However, experimental findings have yielded the paradoxical result that mind-wandering can also be intentional. In this paper, we first present the paradox of intentional mind-wandering and then explain intentional mind-wandering as the intentional omission to control one’s own thoughts. Finally, we present the surrealist method for artistic production to illustrate how intentional omission of control over thoughts can be deployed towards creative endeavors.

Many philosophers consider that memory is just a passive information retention and retrieval capacity. Some information and experiences are encoded, stored, and subsequently retrieved in a passive way, without any control or intervention on the subject’s part. In this paper, we will defend an active account of memory according to which remembering is a mental action and not merely a passive mental event. According to the reconstructive account, memory is an imaginative reconstruction of past experience. A key feature of the (...) reconstructive account is that given the imperfect character of memory outputs, some kind of control is needed. Metacognition is the control of mental processes and dispositions. Drawing from recent work on the normativity of automaticity and automatic control, we distinguish two kinds of metacognitive control: top-down, reflective control, on the one hand, and automatic, intuitive, feeling-based control on the other. Thus, we propose that whenever the mental process of remembering is controlled by means of intuitive or feeling-based metacognitive processes, it is an action. (shrink)

The cognitive phenomenology thesis claims that “there is something it is like” to have cognitive states such as believ- ing, desiring, hoping, attending, and so on. In support of this idea, Goldman claimed that the tip-of-the-tongue phe- nomenon can be considered as a clear-cut instance of non- sensory cognitive phenomenology. This paper reviews Goldman's proposal and assesses whether the tip-of-the- tongue and other metacognitive feelings actually constitute an instance of cognitive phenomenology. Proponents of enactivism should be interested in exploring what notion of action best captures the type of action-perception link that the view proposes, such that it covers all the aspects in which our doings constitute and are constituted by our perceiving. This article proposes and defends the thesis that the notion of sensorimotor dependencies is insufficient to account for the reality of human perception, and that the central enactive notion should be that of perceptual practices. Sensorimotor enactivism is insufficient because (...) it has no traction on socially dependent perceptions, which are essential to the role and significance of perception in our lives. Since the social dimension is a central desideratum in a theory of human perception, enactivism needs a notion that accounts for such an aspect. This article sketches the main features of the Wittgenstein-inspired notion of perceptual practices as the central notion to understand perception. Perception, I claim, is properly understood as woven into a type of social practices that includes food, dance, dress, music, etc. More specifically, perceptual practices are the enactment of culturally structured, normatively rich techniques of commerce of meaningful multi- and inter-modal perceptible material. I argue that perceptual practices explain three central features of socially dependent perception: attentional focus, aspects’ saliency, and modal-specific harmony-like relations. (shrink)

First, we argue that, given a relatively weak conception of episodicity, certain small-scale groups display a form of emergent (i.e., genuinely collective) episodic memory, while large-scale groups, in contrast, do not display emergent episodic memory. Second, we argue that this form of emergent memory presupposes (high-level and possibly low-level) metamemorial capacities, capacities that are, however, not themselves emergent group-level features but rather strictly individual-level features. The form of (...) shared agency that we delineate is thus revealed as being minimal in three senses. First, the relevant groups are themselves minimal in terms of their size. Second, the form of memory in question is minimally episodic. And finally, the cognitive capac- ities attributed to the relevant groups are minimal, in the sense that they need not themselves be capable of metacognition. (shrink)

The main aim of this paper is to clarify the relation between epistemic feel- ings, mental action, and self-ascription. Acting mentally and/or thinking about one’s mental states are two possible outcomes of epistemic or metacognitive feelings. Our men- tal actions are often guided by our E-feelings, such as when we check what we just saw based on a feeling of visual uncertainty; but thought about our own perceptual states and capacities can also be triggered by the same E-feelings. The first (...) section of the pa- per presents Dokic’s argument for the insufficiency of the “ascent routine” to account for non-transparent cases of self-ascription, as well as his account of E-feelings. The second section then presents a two-level model of metacognition that builds on Dokic’s account and my own view of the issue. The two-level model links E-feelings to a min- dreading capacity in order to account for non-transparent self-ascriptions. Finally, the third section develops a deeper characterization of the relation among E-feelings, mental action, and self-ascription of mental states based on epistemic rules. In the context of self-knowledge, these remarks suggest the existence of means of forming self-ascriptions other than the ascent routine. (shrink)

The purpose of this essay is to articulate a specific desideratum for any theory of Latinidad, namely, that there is no adequate conception of Latinx without an attendant conception of Afro-Latinx. In order to be reflective of those whom it purports to describe in the U.S. and elsewhere in the hemisphere, the term Latinx must be plastic enough to encompass the many internal differences, and even antagonisms, between its different constituent parts. Within it, we argue here in particular, it must (...) include its Afro-descended history, which includes not just African-descended people but also a denial of the influences of African-descended culture writ large. Our central claim here, then, is that a certain African-descendedness is constitutive of Latinidad in multiple registers, including history, cultural practices, and social identificatory processes despite Latinidad’s pernicious exclusionary history. I argue that Husserl’s concept of position-taking, Stellungnahme, is adequate to understand the idea of second nature as an issue of philosophical anthropology. I claim that the methodological focus must be the living subject that acts and lives among others, and that the notion of second nature must respond to precisely this fundamental active character of subjectivity. The appropriate concept should satisfy two additional desiderata. First, it should be able to develop alongside the biological, psychological, and social individual development. Second, (...) it should be able to underlie the vast diversity of human beings within and across communities. As possible candidates, I contrast position-taking with two types of habit-like concepts: instinct and habitus, on the one hand, and customary habits, on the other. I argue that position-taking represents the active aspect of the subject while the habit-like concepts are passive. A subject’s position-takings and ensuing comportments are tied together by motivations, which evince a certain consistency, and for this reason are expression of the subject’s identity. I conclude by nuancing the relation between Stellungnahme and passivity. Passivity is deemed necessary to action but subservient to it; position-taking is thought to be prior to passivity. (shrink)

The debate about the definition of Latinidad as a social identity has fluctuated between accounts that put it closer to ethnicity or closer to race. We present and defend the claim that the multiplicity of features and experiences of Latinxs in the United States is best accounted for by placing Latinidad in a different theoretical space. We draw from the ecological psychology and enactive literature on affordances to argue that Latinidad can be better understood as a social identity affordance: a (...) multifaceted landscape of possibilities for interaction, to do and to be done unto. We then focus on four areas that are part of the objective factors that have come to constitute Latinidad and which provide reasons to shy away from both race and ethnicity: the facts of mestizaje and hybridization, a vexed relation to the land, the political horizons and histories of this population, and the multiplicity of sensory-based cultural practices of Latinxs. It is precisely the many and deep variations across Latinxs that make social affordances an apt way to conceptualize a social identity whose reality is asserted pragmatically in many aspects of social life in the U.S. (shrink)

This article proposes that social identities are best understood as a kind of affordance, a “social identity affordance.” Social identity affordances are possibilities for action and interaction between persons, within a social niche, based on perceived and self-perceived social group identification. First, the view presented captures and articulates the basic structure of social identities. Second, it explains the multifaceted interplay of such an item in the social field, including not only the complexity of the interpersonal dimensions, but also the multiplicity (...) of registers in which social identities vibrate (ethical, political, psychological, geographical, affective, epistemic). Third, by doing good on (i) and (ii), the view makes social identities intelligible, helping preclude reductive misinterpretations of social identities, either subjective-only or public-only. The view has robust descriptive and explanatory power in concrete social contexts and retains the openness of a historically bound type of formation whose specific meanings change over time. Applied behavior analysis (ABA) has featured an increasing concern for understanding and considering the cultural diversity of the populations behavior analysts serve in recent years. As an expression of that concern, the new BACB’s Ethics Code for Behavior Analysts is more explicit and comprehensive in its inclusion of ethical obligations concerning cultural diversity. The purpose of this paper is to offer a discussion on the limitations of both our capacity and willingness to know and overcome our ignorance about our own (...) and other cultures. We examine different ways in which our ignorance of other cultures plays out even in willful compliance with the BACB ethics code. We suggest part of the problem is that the BACB ethics code seems to operate under the assumption that practitioners are always aware or can be aware of what they do not know and their biases. In contrast, we offer a reflection on a more complex picture of our understanding of ourselves and other cultures where we cannot assume people are aware of what they ignore and of their biases. Ethically, we find that in some cases these blindspots are accounted for by the BACB ethics code and should be foreseen and addressed by the behavior analyst (BA). But in other cases, when a person is not aware of what they ignore, understanding the connection between cultural diversity ignorance and professional behavior requires a different approach. Our analysis suggests an attitude of being thoughtfully diligent and humble while learning about cultural diversity issues and examining the areas where we might be ignorant and not aware of our ignorance. We argue that BAs’ obligations to respect the dignity of clients and their families and to provide effective treatment call for this attitude of diligence and humility that goes beyond mere compliance. In his comment, McGann argues that in my “From Sensorimotor Dependencies to Perceptual Practices: Making Enactivism Social,” I have overlooked a group of enactivist theories that can be grouped under the participatory sense-making label. In this reply, I explain that the omission is due to the fact that such theories are not accounts of perception. It is argued that, unlike participatory sense-making, the approach of the “From Sensorimotor Dependencies to Perceptual Practices” article does not focus on the perceptual aspects of (...) things social, but on the social aspects that are constitutive of perception in general. I conclude by underscoring the central argument of the original article: that the adequate notion to make enactivism about perception social is that of “perceptual practices,” a social practices-based notion of perception. Este artículo presenta y defiende una concepción expresiva del mundo perceptual que depende de la intersubjetividad. En un primer momento se muestra el desarrollo del concepto de expresión en Husserl y en Merleau-Ponty. El punto central de este desarrollo es que, en contraste con la concepción tradicional del concepto de expresión que es lingüística y consiste en el manifestarse exteriormente de algo interno, se propone ahora una idea de expresión que ya no separa radicalmente lo expresado de la expresión, no (...) se concibe como traducción, y se aplica a la relación entre subjetividad y corporalidad. Para ajustar la aplicación de la expresión a la percepción, se argumenta que las apariencias perceptuales requieren de una cualificación en términos de la posición o perspectiva del sujeto que percibe. Esta “posición” o perspectiva no es únicamente espacio-temporal, sino que también es pragmática. Finalmente, se introduce la intersubjetividad, entendida pragmáticamente, a través de la idea de que hay maneras de explorar el mundo con los sentidos que son constituidas socialmente por los diferentes grupos sociales de los que hacemos parte. Se argumenta que esta concepción pragmatista, diferente a la ruta predominante en fenomenología basada en el significado como un asunto de conciencia de la experiencia, también es defendible en el terreno fenomenológico, particularmente a través de la noción husserliana de toma de posición (Stellungnahme) y la idea merleau-pontiana de las maneras de interrogar el mundo perceptualmente. -/- This article presents and defends an expressive and intersubjectively dependent conception of the perceptual world. The first section deals with the phenomenological development of the concept of expression in Husserl and Merleau-Ponty. In this development, and in contrast with the traditional conception of expression –a linguistic conception based on the external manifesting of something inner–, a new conception appears: one that doesn’t keep a hard separation between the expression and what is expressed, is not modeled after translation, and can be applied to the relationship between subjectivity and corporeality. To further precise the way expression and perception fit together, I argue that perceptual appearances require being qualified in terms of the position or perspective of the perceiving subject. This “position” or perspective is not only spatiotemporal but also pragmatic. Lastly, a pragmatically understood intersubjectivity is brought into play. I look at the fact that there are different ways of exploring the world with our senses that are socially constituted. This constitution takes places in and through the different social groups to which we belong. I argue that this pragmatist conception, while different from the dominant phenomenological understanding that takes meaning to be about the consciousness of experiences, is also defensible on phenomenological grounds. This alternative understanding finds support in Husserl’s idea of position-taking (Stellungnahme) and Merleau-Ponty’s claim that there exist different ways of interrogating the world perceptually. What is a philosophy class like? What roles do teachers and students play? Questions like these have been answered time and again by philosophers using images and metaphors. As philosophers continue to develop pedagogical approaches in a more conscious way, it is worth evaluating traditional metaphors used to understand and structure philosophy classes. In this article, we examine two common metaphors—the sage on the stage, and philosophy as combat—and show why they fail pedagogically. Then we propose five metaphors—teaching philosophy as (...) world-traveling, wondering, conducting an orchestra, storytelling, and coaching—that can better respond to the needs of increasingly diverse student bodies. Further, these metaphors find their ground in long-standing beliefs about what philosophy is, how it is done, and what it can do for those willing to engage in it. While no single one of them is comprehensive, we think that these models can help us enliven our own thinking about our teaching and the roles we and our students play in our classrooms. (shrink)

RESUMEN La presente reflexión tiene como punto de partida la noción de antropotécnica desarrollada por el filósofo Peter Sloterdijk. El autor asume que los humanos somos seres ejercitantes en tanto día a día ejecutamos una serie de rutinas diarias que nos permiten modelar nuestra existencia. En dicho proceso nos encontramos con instituciones sociales que orientan tales ejercicios antropotécnicos. A partir de una caracterización exhaustiva del planteamiento de Sloterdijk, proponemos la noción de antropotécnica negativa, como envés de la antropotécnica, para referirnos (...) a una comprensión alternativa de las ejercitaciones contraindicadas que se realizan en oposición a valores legitimados e idealizados cutralmente sobre cómo modelar la existencia. Concluimos que la antropotécnica negativa puede ser un recurso analítico para aproximarnos a la mala ejercitación como fenómeno histórico y a la potencia existencial de algunas vidas que se expresan privilegiadamente como negatividad, abyección o marginalidad. ABSTRACT This analysis uses the notion of anthropotechnics developed by the philosopher Peter Sloterdijk as its starting point. The author assumes that humans are exercising beings in that day by day we carry out a series of diary routines that allow us to shape our existence. Within this process, we encounter social institutions that guide those anthropotechnics exercises. From an exhaustive characterization of Sloterdijk's approach, we propose the notion of negative anthropotechnics (as the inverse of anthropotechnics) to refer to an alternative understanding of the counterindicated exercises that are performed in opposition to legitimized and idealized values of how to shape existence. We conclude that negative anthropotechnics can be an analytical resource to approach malpractice as a historical phenomenon and to the existential potency of some lives that are expressed as privileged negativity, abjection, or marginality. And what would this clumsiness look like if we could transfer it to the moral sense? The article expounds an interesting analogy between the sense of touch, loosely construed, and the moral sense: just as a sort of consistency is necessary for the sense of touch to do its job, so it is for the moral sense to play (...) its part. Touch enables us to navigate the everyday world of coffee pots and staircases; our moral sensibility comes into play when we act or when we judge our actions and those of others, and plays a directive role in what we feel, how we feel it, and how we react to it. Taking the analogy further, I will suggest that inconsistency causes, in both cases, a certain clumsiness, and that clumsiness is linked to arbitrariness – like the person that helps others in dire need, but only does so on some rainy days. La ilusión de profundidad explicativa (ipe) es uno de los fenómenos que ha despertado gran interés en la ciencia cognitiva en los últimos veinte años. Sucede cuando la persona cree poder explicar un fenómeno mejor de lo que realmente puede explicarlo. A continuación, se hará una reconstrucción histórica de los estudios de la IPE a lo largo de las últimas décadas, dando cuenta de su actualidad e importancia. Primero se presentarán los antecedentes y los estudios fundantes de este tema de (...) investigación. A continuación, se expondrán las investigaciones iniciales (años 2002-2015), y la manera como prosiguió la indagación con cuestionamientos y soluciones a la IPE (años 2016-2021). Perú es indiscutiblemente un país multilingüe, con 48 lenguas habladas en diferentes grados de uso y dominio. En Ayacucho, uno de los departamentos de Perú, se hablan tanto el quechua como el español, lo que resulta en un alto grado de bilingüismo en la población. El objetivo de este estudio fue analizar la estrategia de la gramática contrastiva quechua-castellano en los niveles fonológicos, morfológicos, sintácticos y semánticos en la población de Ayacucho. Para ello, se adoptó un enfoque cualitativo y se (...) utilizaron técnicas de entrevista y revisión documental. Los resultados indican que la gramática contrastiva entre el quechua y el castellano a nivel fonológico, morfológico, sintáctico y semántico es altamente efectiva para el aprendizaje tanto de la primera como de la segunda lengua. Pretendo mostrar en este escrito cómo para desarrollar su teoría del derecho Hart estuvo influenciado por diferentes problemas filosóficos como: 1. La importancia que le da al lenguaje ordinario, influencia que recibió tanto de Austin como de Wittgenstein II; 2. La noción de textura abierta de Waisman que Hart aplica al derecho; 3. La noción de comportamiento social la cual se encuentra regida por reglas como lo concibe tanto Searle como Winch.

Through a critical engagement with Merleau-Ponty’s discussion of the concepts of nature, life, and behavior, and with contemporary accounts of animal groups, this article argues that animal groups exhibit sociality and that sociality is a fundamental ontological condition. I situate my account in relation to the superorganism and selfish individual accounts of animal groups in recent biology and zoology. I argue that both accounts are inadequate. I propose an alternative account of animal groups and animal sociality through a Merleau-Pontian inspired (...) definition of behavior. I criticize Merleau-Ponty’s individualistic prejudice, but show that his philosophy contains the resources necessary to overcome this bias. I define behavior as a holistic, ongoing, meaningful and Umwelt-oriented intrinsically configured expression of living forms of existence. By looking at cases of animal groups drawn from contemporary studies in zoology and behavioral ecology, I show that animal groups, in the fact that they behave, manifest themselves to be a fundamental form of existence, namely, the social form of existence. En este trabajo de investigación se recoge y analiza una información bibliográfica valiosa sobre la inmortalidad del alma en el Estagirita según Suárez. Es sorprendente la amplitud de conocimiento sobre la historia de la filosofía del Doctor Eximio, que le sirve de inspiración y apoyo en el análisis de las fuentes, ya sea directa o indirectamente por referencia de otros. Así, hay tres referencias indirectas: Eusebio de Cesarea, Agustín Eugubino y Agustín Nifo. Las fuentes de inspiración del filósofo español sobre (...) el status quaestionis son treinta autores en total. De ellos, dieciséis autores a favor de la mortalidad del alma en Aristóteles; once autores a favor de la inmortalidad en el Estagirita y tres que mantienen una posición ambigua o dudosa en Aristóteles. En efecto, el pensamiento de este elenco de pensadores –desde la antigüedad hasta el siglo XVI– citados por el jesuita, forma realmente una historia de la inmortalidad del alma humana. (shrink)

Después de discutir diversas hipótesis acerca de la especificidad de la poesía, se reivindican sus posibilidades relativas a la expresión de lo paradójico. Ello se ejemplifica en cuatro poemas del libro La línea del tiempo de Luis Fernando Macías. Y a partir de la estructura paradójica del tiempo se realizan algunas consideraciones relativas a la condición paradójica de la existencia y a los orígenes del conflicto trágico.

Nunca, como en nuestros días, han sido tan abundantes y prominentes las políticas de inmigración, y nunca se ha vivido ésta con tanta y tan generalizada insatisfacción. El artículo pretenden explicar las razones que subyacen a tal paradoja, con especial atención a las dificultades a las que se enfrentan las políticas de inmigración en nuestros días y los dilemas que las atenazan, en particular en el ámbito de la Unión Europea.

La fundamentación de la física clásica llevó a Descartes a encontrar en el "ego cogito" la condición necesaria de todas las representaciones posibles: los conceptos de materia y de movimiento, tal como los exigía la nueva ciencia fueron concebidos por él inicialmente en una forma extremadamente racionalista, lo cual convirtió al "yo pienso" en el sujeto, en el fundamento de todo lo que puede ser real. Algunos científicos han sostenido que el "yo" según Descartes supone una tal preeminencia de la (...) epistemología, que impide pensar la moral y la situación del hombre frente a la incertidumbre de la vida. Se verá en el artículo que el sujeto hace de la naturaleza un mero objeto, pero mantiene su propia esfera, la de la libertad, hacia la cual estará dirigida toda la admiración después de que Descartes lograra resolver el enigma del universo. El artículo esboza algunos hitos fundamentales del desarrollo de las ciencias sociales en el siglo XX que dieron cabida al interés por las vidas ordinarias, en disputa con el privilegio de atención concedido entonces a las élites y los grandes personajes, de donde se configura un marco epistemológico que acoge el estudio de los individuos y grupos sociales subordinados en la modernidad, dotado de un nuevo arsenal de métodos y técnicas basados en los testimonios orales y documentos personales. A través (...) del seguimiento de dicha ruta, condicionada por los múltiples tributos de las ciencias de la cultura, la literatura, la sistematización del pensamiento pedagógico y la variopinta experiencia histórica global, se comprenden las condiciones de emergencia del paradigma biográfico narrativo en educación. Background The American Society for Bioethics and Humanities (ASBH), a professional organization that certifies ethics consultants who pass the qualifying examination, published standards for the conduct of ethics consultations (EC). A national survey of adult hospital ethics consultants identified adherence to these standards, but no assessment of pediatric hospitals’ adherence has been done.Methods In this cross-sectional study, a national questionnaire was distributed electronically in 2022 to pediatric ethics consultants at children’s hospitals, collecting information about adherence to the ASBH standards. Hospital (...) characteristics were extracted from the Children’s Hospital Association Annual Benchmark Report. Quantitative analysis included descriptive statistics to assess adherence and analyses of variance to investigate associations between hospital characteristics and the time taken to respond to consultations.Results Of the 181 eligible pediatric hospitals, we received 104 completed surveys (57%) from 45 states. Pediatric EC have similar adherence rates to ASBH standards as adult hospitals. High-adherence (>75%) areas included having an expert available for EC and permitting any staff member to request EC. Low-adherence areas included having comprehensive policies covering all aspects of EC activities, having a response plan for egregious violations, and the elicitation of formal feedback after EC. There is an increased average response time for ethics consultation services in smaller pediatric hospitals and church-operated hospitals.Conclusions Pediatric hospitals overall have moderate adherence to the ASBH EC standards, with the highest rates occurring for standards that are shared by the American Academy of Pediatrics. Additional research into the barriers to standard adherence and the effectiveness of standards is warranted with emphasis on the impact of adherence on consultation quality. (shrink)
