In his famous lecture on ‘Politics as a Vocation’, Max Weber coined and elaborated on the antithesis between the ethics of conviction and the ethics of responsibility, which has had a far-reaching impact on the ethics discussions, particularly in German-speaking countries. The article explores what Weber himself meant with this distinction and what implications result from it. As an interesting historical observation, Weber's interpretation of ‘Do not resist an evildoer’ in the (Christian) New Testament is contrasted (...) with Mahatma Gandhi's diametrically opposed interpretation. After criticizing Weber's position, the article outlines how today's business ethics can be based on a new and different foundation that overcomes the ‘profound antithesis’ between the ethics of conviction and the ethics of responsibility without disregarding the tensions between internal attitudes and external action results. In the following pages, the main proposal is to indicate how Max Weber has dialogued directly with some prerogatives from Kant’s Critic of practical Reason, following the reception of Wilhelm Windelband’s concept of “responsibility” (Verantwortlichkeit) and his theory of values. In this paper, I explore and probe Joseph Carens’ remarks, in his recent book The Ethics of Immigration, on the immigration status of foreign convicted criminals who have served their sentence, and who wish either to immigrate into our country or who are already here. Carens rejects deportation when it is not called for by considerations of national security, and agrees that considerations of public order can justify barring convicted foreign criminals from entering the country. I broadly agree with (...) his arguments against deportation: my remarks in this respect are clarificatory and exploratory as much as anything else. But both his argument for open borders and his scepticism with respect to radical cosmopolitanism are in tension with his claim that past criminal convictions can act as a bar to entry. (shrink)

Person‐centred care is founded on ethics as a basis for organizing care. In spite of healthcare systems claiming that they have implemented person‐centred care, patients report less satisfaction with care. These contrasting results require clarification of how to practice person‐centred ethics using Paul Ricoeur's ‘Little ethics’, summarized as: ‘aiming for the good life, with and for others in just institutions’. In this ethic Kantian morality is at once subordinate and complementary to Aristotelian ethics because the ethical (...) goal needs to be critically assessed and passed through the examination of the norm in each care situation. This paper presents examples that describes a person‐centred care practice that balance a critical review of care activities based on a conviction of aiming for patients' wellbeing. In contrast to patients' experiences of person‐centred care in real life, research projects have shown that if the clinical performers comprehend and apply the practice of person‐centred ethics, patients report positive outcomes. The implementation of person‐centred care therefore demands that stakeholders and managers enables and requires that healthcare staff study ethics in the same way as studying for example pharmacology is required when handling patients' medicines. What should we do when faced with powerful theoretical arguments that support a severe change in our personal beliefs and commitments? For example, what should new parents do when confronted by unanswered anti-natalist arguments, or two lovers vexed by social theory that apparently undermines love? On the one hand, it would be irrational to ignore theory just because it’s theory; good theory is evidence, after all. On the other hand, factoring in theory can be objectifying, or risks unraveling one's life, (...) fracturing one's identity or social relations. Sometimes, then, following the evidence where it apparently leads would mean not merely changing what we think but who we are. Some might say that there’s something right about the thought that theory can bear on what we ought to believe, it’s just that when we work with full beliefs, only then do we seriously risk having to substantially alter our doxastic economy when pressed by exceptional theoretical arguments. When we work with partial beliefs, however, this risk is greatly diminished. Others will say that we can advocate or champion revisionary positions whilst rationally retaining our pre-theoretical personal convictions. Still others will argue that we should adopt a Moorean posture towards the revisionary arguments. I argue that each response is inadequate, and argue instead that we are permitted to bracket certain kinds of theoretical evidence against our beliefs because of the personal and ethical risks born out of giving them serious consideration. In turn, some of philosophy's doxastic influence is constrained by its attendant ethical risks: the personal enjoys a partial insulation from the theoretical. Readers of The Protestant Ethic and the Spirit of Capitalism recognize that Weber attempts to provide an ideal account of development of modern rational capitalism. What readers apparently do not realize is that Weber believes that there is a political development that is parallel to this economic development. Weber believed that Luther’s passive theology and doctrine of two kingdoms lead to quiet resignation in earthly matters. Luther advises shunning politics and avoiding political confrontation. In contrast, Weber held that Calvin’s theology (...) of awe and his doctrine of predestination lead to active political stances and even imply a duty to resist tyranny. However, Weber rejects both Luther’s and Calvin’s political stances because both believed in a divinely ordered world and held that the consequences of their actions were ultimately left to God. Weber contends that only those people who have the proper understanding of the nature of power and have a real appreciation for the ‘diabolic’ nature of politics are suitable to be political actors. Thus, Weber insists that only those people who will take responsibility for their own political actions have the right to ‘stick their hands in the wheels of history’. (shrink)

This book addresses the fundamental ethical and legal aspects, penal consequences, and social context arising from a citizen's acceptance of guilt. The focus is upon sentencing people who have pleaded guilty; in short, post-adjudication, rather than issues arising from discussions in the pretrial phase of the criminal process. The vast majority of defendants across all common law jurisdictions plead guilty and as a result receive a reduced sentence. Concessions by a defendant attract more lenient State punishment in all western legal (...) systems. The concession is significant: At a stroke, a guilty plea relieves the State of the burden of proving the defendant's guilt beyond a reasonable doubt, and in open court. Plea-based sentencing has become even more visible in recent years. The book provides insightful commentary on the following questions: - If an individual voluntarily accepts guilt, should the State receive this plea without further investigation or any disinterested adjudication? - Is it ethically acceptable to allow suspects and defendants, to self-convict in this manner, without independent confirmation and evidence to support a conviction? - If it is acceptable, what is the appropriate State response to such offenders? - If the defendant is detained pretrial, the ability to secure release in return for a plea may be particularly enticing. In this article, I maintain that the anti-theoretical spirit which pervades Williams's ethics is close to the Humean project of developing and defending an ethics based on sentiments which has its main focus in the virtues. In particular, I argue that there are similar underlying themes which run through the philosophies of Hume and Williams, such as the view that a correct ethical perspective cannot avoid dealing with a broader theory of human nature; the conviction that this (...) inquiry cannot be developed in abstraction from the contingencies which are distinctive of the lives of flesh-and-blood human beings driven by passions; and the belief that the notion of character plays a key role in identifying and morally evaluating such lives. Finally, Williams' account of the psychological mechanism of shame in explaining character formation bears a strong resemblance to Hume's treatment of the passion of humility. A recent essay by Jürgen Habermas revisits political liberalism and takes up the question of the extent to which democratic citizens and officials should rely on their religious convictions in publicly deliberating about and deciding political issues. With his institutional translation proviso, a proposed alternative to Rawls' idea of public reason, Habermas hopes to dodge familiar (and often overstated) criticisms that liberal requirements of citizenship are unfair or disproportionately burdensome to religious believers. I argue that, due in part to its (...) sharp contrast between the obligations attributed to political officials and those attributed to ordinary citizens, Habermas' position is beset by additional, quite considerable difficulties. A guest edited volume of the Journal of Applied Philosophy devoted to topics regarding the ethics of nudges, particularly those that have received little or no treatment up to now. Since the publication of Nudge in 2008, nudges have become widely used tools in policymakers' toolbox. Concurrently, ethicists have discussed which conditions, if any, ensure the fair and ethically legitimate implementation of such untraditional policy techniques. The debates have focused primarily on the alleged intrusiveness of nudges and their lack (...) of factual transparency. The special issue is intended to enrich the debate in the conviction that the clarity of the terms adopted within the debate could be improved and that some relevant ethical perspectives have been left out in assessing the morality of nudges. Specifically, the aims of this special issue are twofold, normative and conceptual. On the one side, we delve into the concepts on which the evaluation of nudging hinges, such as "preferences", "resistibility", and "libertarianism". Since the meanings assigned to such concepts drive our evaluation of nudging, their comprehension is critical. On the other side, the acceptability of nudges has been extensively assessed in the light of ethical theories developed within Western philosophy, and not with alternative but promising ethical frameworks from the Global South. Relatedly, some values implicated in nudging, such as the ethics of nudging vulnerable populations, have been overshadowed by scholars' attention to decisional autonomy. A Bioética Clínica é aqui uma particularização temática que ajuda uma concentração do discurso, ao mesmo tempo em que permite o aproveitamento desta reflexão para outras esferas. Entre seus resultados, este ensaio ressalta que os conflitos de convicções podem ser fonte de benefícios para a convivência na sociedade plural. Religious convictions are not the only in this sense. This essay uses an interdisciplinary method in order to clarify some concepts and criteria underlying this issue, which can help in ethical discernment of such conflicts. Clinical Bioethics is a particularization theme here that helps a concentration of discourse, while allowing the use of this reflection to other spheres. It also helps to understand the close relationship of personal convictions with the public sphere around vital issues. Among their results, this paper points out that conflicts of convictions can be a source of benefits to living in a plural society. His ethical challenges are mainly pointed to a necessary openness to dialogue with the different. In exercising this dialogue, reflection of Bioethics is distinguished from Biopolitics and suggests that the subjective convictions sometimes find themselves contradicted by legal before they ripen consensus on ethical criteria.Key words: Convictions - Clinical Bioethics - Ethical Conflicts. Purpose This article aims to describe the personal experience and ethical dilemmas that the author encountered when conducting qualitative research on a highly sensitive topic, i.e. interviews with offenders convicted of child pornography. Design/methodology/approach This study uses an autoethnographic approach to describe and reflect on my personal experience, emotions and ethical dilemmas when undertaking sensitive research that examines illegal acts. Findings Ethical dilemmas and emotional challenges highlighted refer to the issue of access to useful empirical material, conducting interviews with convicted (...) offenders in prison environments, the complexity surrounding confidentiality when interviewing offenders about their criminal activities, vulnerability and insecurity for the researcher and emotional challenges for the researcher when listening to the offenders’ stories describing serious crimes against children. Originality/value This article contributes with insights and reflections on conducting qualitative research with a marginalized and stigmatized group in prison environments. (shrink)

Democratic societies that separate church and state face major challenges in accommodating religious convictions. This applies especially to determining healthcare policies. Building on our prior work on the demands and limits of religious accommodation in democratic societies, we propose a set of ethical standards that can guide societies in meeting this challenge. In applying and defending these standards, we explore three topics: vaccine resistance, abortion, and concerns about rights to healthcare. The biobank consent debate is one with deeply held convictions on both the ‘broad’ and ‘specific’ side with little sign of resolution. Recently, Thomas Ploug and Soren Holm have developed an alternative to both specific and broad consent: a meta‐consent framework. The aim here is to consider whether meta‐consent provides a ‘solution’ to the biobank consent debate. We clarify what ‘meta‐consent’ actually is (arguing that the label is a misnomer and ‘consent à la carte’ is more accurate). We identify problems (...) with Ploug and Holm's arguments, and some challenges for meta‐consent. We focus on whether there is any ethical obligation to provide consent à la carte. There may seem to be so, especially if we draw upon an unclear appeal to the ethical significance of ‘respect for autonomy’. Similarly, there might seem to be an intuitive inference from the fact that ethically legitimate research requires informed consent to the conclusion that it thereby requires consent à la carte. Most accounts of Kant's epistemology focus narrowly on cognition and knowledge . Kant himself, however, thought that there are many other important species of assent : opinion, persuasion, conviction, belief, acceptance, and assent to the deliverances of common sense. ;My goal in this dissertation is to isolate and motivate the principles of rational acceptability which, for Kant, govern each of these kinds of assent, instead of focusing merely on cognition and knowledge. Some of the principles apply in the context (...) of everyday assent-formation; others apply in more specific contexts . ;The project is worthwhile for at least two reasons. First, it highlights issues that are both neglected in the literature and yet crucial for understanding Kant's famous claims about the nature and limits of our epistemic access to appearances and things-in-themselves. ;Second, it lays out Kant's sophisticated and largely plausible account of our intellectual obligations and of the various roles that "subjective" considerations play in our practices of assent-formation. Kant charts a viable middle course between the epistemic abstemiousness of Cliffordian evidentialists and the epistemic excess of Jamesian pragmatists. ;I begin with an overview of Kant's pre-critical epistemology, and then provide a broad survey of the ethics of assent in the critical period, noting in particular the way Kant allows for exceptions to his First Principle---the principle that it is rational to assent to proposition only on the basis of sufficient objective grounds. Having sketched the whole picture, I turn to the principles governing knowledge and use a new account of Kant's concepts of objective and subjective justification to solve a perennial interpretive problem regarding the nature of our epistemic access to material objects. Among the various contemporary schools of moral thinking, consequence-based ethics, as opposed to rule-based, seems to have a good acceptance among professionals such as software engineers. But naïve consequentialism is intellectually too weak to serve as a practical guide in the profession. Besides, the complexity of software systems makes it very hard to know in advance the consequences that will derive from professional activities in the production of software. Therefore, following the spirit of well-known codes of ethics such (...) as the ACM/IEEE’s, we advocate for a more solid position in the ethical education of software engineers, which we call ‘moderate deontologism’, that takes into account both rules and consequences to assess the goodness of actions, and at the same time pays an adequate consideration to the absolute values of human dignity. The wounds of political injustice include the following: violation of the victim’s human (...) rights, harms to the victim’s person, the victim’s ignorance of the source and circumstances of political injustices, the lack of acknowledgment of the suffering, the standing victory of the wrongdoer’s political injustice, and harm to the person of the wrongdoer. In such situations, Philpott argues, “what the government and community withhold is... an acknowledgment not only that a victim has rights but also that his rights were violated and that he suffered because of this violation” (37).The definition of justice in this context of wounds is reconciliation. It “encompasses peace settlements, human rights, democracy, and other key goals of negative and positive peace [as well as]... a broad restoration of right relationship involving a multiplicity of practices that each redress wounds of injustice in a particular way” (48–49).Daniel Philpott affirms peace as human rights, equality, and the rule of law, plus actors and institutions like the United Nations that spread this justice. This review of Hoskins’ book on the collateral legal consequences of a criminal conviction focuses on some of the consequences of his concept of collateral legal consequences for our understanding of justifications of criminalization, the theory of punishment and incapacitation upon which it rests, and the implications for the prosecutor’s role that goes beyond Hoskins’ suggestions in the last part of the book. The review particularly engages with Hoskins’ distinction between punishment and incapacitation, which forms the core of his (...) defense of collateral sanctions as in principle capable of moral justification and his excellent discussion of contemptuous punishment, which he uses to sketch out the limits of both direct and indirect criminal sanctions. Max Weber's distinction in "Politics as a Vocation" between the ethic of conviction and the ethic of responsibility is best understood as a distinction between mutually exclusive ethical worldviews. Interpretations that correlate the two ethics with Weber's distinction between value-rational social action and instrumental-rational social action are misleading since Weber assumes that both types of rational social action are present in both ethics. The ethic of conviction recognizes a given hierarchy of values as the context for (...) moral endeavor. The ethic of responsibility acknowledges value obligations, but assumes the absence of any given hierarchy of values and the inevitability of value conflict as the context for moral endeavor. When interpreted in the context of his multilayered understanding of value conflict, Weber's ethic of responsibility emerges as a coherent ethical perspective. (shrink)

Section 75 of the Criminal Justice Act (CJA) of 2003 overturned the principle in English law that a person cannot be retried for an offense of which he has been acquitted, recognizing advances in forensic science that uses modern analysis of DNA in adducing in evidence. The special plea of autrefois acquit can be overturned based on finding of compelling evidence after a previous acquittal of a suspect who can now be tried again for the same offense. The double jeopardy (...) arises only after a lawful acquittal or autrefois convict of the accused for the first offense and these principles have allowed exceptions to the rule against double jeopardy developed by the courts. There is an analogous rule in common law courts based on the unreasonable splitting of the case when there is a severing of indictments which overrides the bar on the accused being retried for the same offense. This paper examines the difficulty of trying a defendant fairly in the English courts when the defense has pleaded an abuse of process and there is no clear overall argument for trial. This question needs an appraisal of legal ethics in criminal courts because a retrial of the accused on the same charge breaches the autrefois acquit doctrine, and severing of an indictment can cause the fair trial process to be undermined. While a definitive answer must be case by case, some scholars have offered sharply opposed general answers: a skeptical versus an optimistic. The article addresses this basic conflict, arguing that a satisfactory answer requires a first-order engagement in judging the claims of experts which both skeptics and optimists rule out in taking the issue to be one of second-order assessments only. Having argued that such first-order judgments are necessary, (...) it then considers how they are possible, outlining a range of practices and virtues that can inform their success and likelihood, and drawing throughout on ancient Greek insights as well as contemporary social psychology and sociology of knowledge. Drawing from the group engagement model and the moral conviction literature, we propose that perceived leader ethical conviction moderates the relationship between ethical leadership and employee OCB as well as deviance. In a field study of employees from various industries and a scenario-based experiment, we revealed that both the positive relation between ethical leadership and employee OCB and the negative relation between ethical leadership and employee deviance are more pronounced when leaders are perceived to have weak rather than (...) strong ethical convictions. Further, we argued and showed that employees’ feelings of personal control and perceived voice opportunity mediated the interactive effect of ethical leadership and perceived leader ethical conviction on OCB and deviance. van der Pijl et al 1 argue that if ‘stakes are high’ and there is ‘clear conviction by the care provider’ that it is ‘necessary’, episiotomy may be given after ‘opt-out consent’. Here I caution against the applicability of their approach to vaginal examination (VE): another routine intervention in birth to which they suggest their discussion may apply. I highlight three concerns: first, the subjective and unjustified nature of assessments of ‘necessity’; second, the inadequacy of current consent practices in (...) relation to VE; and third, the significant risk of perpetuating under-recognised harms associated with unwanted or unconsented VE. I argue that opt-out consent cannot be ethically justified for VE. Its use would result in further weakening of consent practices, circumvention of individuals’ autonomy, and greater harm for women and birthing people. At the outset, it is important to recognise that the authors do not claim that their approach should be applied to VE, merely that their discussion may have relevance to consent for other interventions beyond episiotomy ‘where consent is also frequently lacking, and which are under-researched’, including VE.1 Nonetheless, it is easy to assume that episiotomy and VE are sufficiently similar that their analysis might be transferred wholesale. In addition, he turns to the early church fathers to contend that, prior to Constantine, “without exception, the church strongly condemned the taking of human life in any form whatsoever”—thus rejecting abortion and infanticide, the blood sport of the Roman games, suicide, and killing in war (120). This was because the New Testament witness to Jesus and his death on the cross required early Christians to view “the means as just as important, if not more important, than the ends” (xiii).Arner supplements this deontological argument for Christian pacifism, which he learned from John Howard Yoder, with a brief consideration of the virtue of patience cultivated in the early churches, reflecting the influence of Stanley Hauerwas on his thought. This “cardinal virtue” connoting “longsuffering, forbearance, patient endurance”—as found in Jesus’s teaching in the Sermon on the Mount (Mt 5:38–48)—enabled early Christians to practice non-violent resistance “deferring personal revenge in favor of God’s vindicating justice” (98). If Christians were to adopt this same consistently pro-life ethic today, argues Arner, it would “lead to greater healing and peace in our blood-soaked world” (121). Almost all of the contributors to this volume—including biblical scholars, theologians, ethicists, pastors, activists, and others—criticize the ideology of Christian Zionism and its support of a theology of dispensationalism that, in their view, distorts the scriptures and fosters violence rather than reconciliation between the Israelis and the Palestinians. In his own presentation titled “What Can Pentecostals and Charismatics Do for Peace with Justice in Israel and Palestine?,” Alexander—who describes himself as a former “one-sided” Christian Zionist who later discovered the writings of Yoder and Hauerwas—appeals to Jesus’s teaching in the Sermon on the Mount and urges Pentecostals to create church communities “that cultivate persons of character and conviction, who through habits, practices, and action live out the core of our faith” (69). SUMMARYCultural and religious differences often lead to conflicts, which sometimes even degenerate into violence. This situation has triggered a debate among universalists and particularists on the possibility of a global ethic. This article does not repeat the discussion here between universalism and particularism as such. Rather, its aim is to shed new light on this discussion by turning to the French philosopher Paul Ricœur, one of the great minds of the twentieth century.My starting point is Ricœur's discussion with Hans Küng (...) on the ‘Declaration Towards a Global Ethic’. This discussion is not very well known and has, to my knowledge, not been commented upon by a third party. In this discussion Ricœur immediately signals his “inner resistance” to Küng's project. First, Ricœur states that the global ethic amounts to a “disembodied formalism” because it is founded on too radical a distinction between universal formal norms and particular religious convictions. Moreover, Küngs global ethic also neglects the challenge posed by the application of these formal principles to the ethical complexities with which people are confronted in life. After having explored these objections, I will examine how Ricœur develops an original perspective concerning the contemporary challenge of ethical diversity and the tension between particularity and universality. In this regard, especially his so-called little ethics deserves our attention.In unpacking and analyzing Ricœur's ethical reflections and elaborating on them in view of the context of diversity, I hope not only to argue how this Ricœurian perspective sheds new light on the discussion concerning the possibility of a global ethic but also to contribute in a very specific way to Ricœur studies. In this sense, the following article can also be read as an intercultural or interreligious appropriation of Ricœur's ethical reflections. (shrink)

Christian Ethics Introduced asks why humans count as ends in themselves. The biblical answer was/is that humans have standing--inherent worth--as creatures in the image of God. This traditional answer yielded to seventeenth and eighteenth century enlightenment secularism. To these secularists, human reason promised to be a surer and more peaceable foundation for a just culture than religion. Human rationality--the light of human reason--would enlighten and improve the human condition. Two world wars and more realistic trends in new social sciences (...) created not just awareness of human irrationality but fostered skepticism of sound foundations for morality and justice. It seemed that both traditional religion and enlightened reason fell short of what had been hoped. And the cause of failure may not lie in traditional religion or in human irrationality. Rather, the problem might lie in human conduct. Specifically, it may lie in the human inclination to favor self over others, of the "me" outranking the "we." Christian responses to the human failure to live a moral and just life recognize the persistence of immoral conduct, acknowledge it in regard to oneself, ask for forgiveness, and make amends and peace with God and with those wronged. This dissertation is a constructive interpretation of the significance of French philosopher Paul Ricoeur's work for ethical theory. It argues that Ricoeur provides a concept of moral meaning which addresses more adequately than major contemporary alternatives, particularly Hebermas, MacIntyre, and Levinas, the problem of moral pluralism. Specifically, moral meaning for Ricoeur is a dialectical term which mediates the teleological good and the deontological right of tradition-interpreting selves. It renders productive these two poles of moral life, one Aristotelian and the other (...) Kantian, in the formation of critical teleological goods which recognize each self's distinct otherness as an interpreter of their own moral being in the world even as their otherness is projected into provisional and imaginatively mediated aims in common. ;This thesis is made in four steps. First, the dissertation argues that any concept of tradition-constituted moral life implies a tradition-interpreting self capable of forming its given and plural background linguistically into appropriated meaning for its own being in the world. Second, this interpreting self is constituted ethically by a dialectical relation between on the one hand the narrative teleological goods it forms in time out of its interpretations of tradition, and on the other its deontological otherness as capable of forming these narrative goods for itself. Third, this dialectical relation is rendered productive in a critical teleology of moral meaning, which can be broken down into criteria of subjective conviction, interpersonal promising, and third-party community, each of which involves plural and other interpreting selves' mutual recognition. Fourth, this dialectical interpretive ethics is shown to be grounded in, and in the face of evil liberated by, its implied religious limits, specifically a dialectical economy of the gift expressed in the terms faith, love, and hope. The article explicates the significance of M. Weber’s works for understanding of calling as an important world view idea of the European culture. The author observes Weber’s analysis of forming of the notion of calling in the times of ancient Egypt state and Judaic captivity as well as in the Old Testament and its interpretations by M. Luther. Particularly significant for the understanding of social processes during the Reformation in Europe and then in America became Weber’s analysis of the transformation (...) of the religious meaning of calling as “task” and “mission” of a man in the world into the motivation for a practical professional activity. The study shows the ways of implementation of Weber’s theory of social action and political leadership within the concept of calling. The internal collision of the experience of calling is explicated by the examples of charismatic leadership, responsibility of a politician and ethos of a scientist. Combination of affective motivation, value and target oriented rationality in the calling forms the problem for a decision, although this complexity is a driving force of the realization of calling by a person. The philosophical and theological substratum of the Weber’s concept of calling is his looking for the integration of temporal and eternal dimensions in human existence. Calling as an idea of postreformational European culture serves for finding and realization of the meaning of personal life as well as for legitimation of social action. Especially this idea grounds the possibility and necessity of conciliation of the ethics of conviction and the ethics of responsibility in individual as well as in social existence and morality. The current linkages between ethical theory and management behavior are investigated in the wake of the much-publicized convictions of Enron executives. The vignettes used in this investigation represent ethical dilemmas in the areas of coercion and control, conflict of interest, physical environment, and personal integrity. Since 2003, and after the successful prosecution of Enron executives, the link between ethical philosophy and management behavior has shifted somewhat dramatically. There has been a significant change in the rational basis for managerial decision making. (...) In 2003, even after the Enron scandal was publicized, practitioners still relied heavily on both act and rule utilitarian ethical philosophies when making business decisions. Currently, the majority of respondents are likely to select ethically appropriate actions based on either rule utilitarian or rights rationales. It appears that ethical behavior is now more in line with ethical rhetoric, which may positively impact the ethical climate of business decision making. Apparently, business scandals of the past did not really impact actual ethical behavior much, but the high-profile prosecutions, convictions, and jail sentences may have impressed on managers that now is the time to incorporate ethics into business decisions. Corruption in the construction industry is a serious problem in China. As such, fighting this corruption has become a priority target of the Chinese government, with the main effort being to discover and prosecute its perpetrators. This study profiles the demographic characteristics of major incidences of corruption in construction. It draws on the database of the 83 complete recorded cases of construction related corruption held by the Chinese National Bureau of Corruption Prevention. Categorical variables were drawn from the database, and (...) ‘association rule mining analysis’ was used to identify associations between variables as a means of profiling perpetrators. Such profiling may be used as predictors of future incidences of corruption, and consequently to inform policy makers in their fight against corruption. The results signal corruption within the Chinese construction industry to be correlated with age, with incidences rising as managers’ approach retirement age. Moreover, a majority of perpetrators operate within government agencies, are department deputies in direct contact with projects, and extort the greatest amounts per case from second tier cities. The relatively lengthy average 6.4-year period before cases come to public attention corroborates the view that current efforts at fighting corruption remain inadequate. (shrink)

In the final pages of Politik als Beruf Max Weber introduces his now famous distinction between two types of ethics: the “ethics of conviction” ( “Gesinnungsethik”) and the “ethics of responsibility” ( “Verantwortungsethik”). Neither of these is simple to translate and neither of these is easy to understand. What makes it even more difficult to comprehend Weber’s two types of ethics is the absence of a sufficient context. In the following piece I will try to (...) address this problem. In the first part I set out the nineteenth century notion of “conscience”, in the second I address the Protestant Ethic with the particular emphasis on Calvin’s theology, and in the third I lay out the political and ethical demands of some of the Old Testament Prophets. The people’s appeals to conscience, Calvin’s convictions, and the beliefs of Old Testament prophets were all predicated on a sense of devotion to God. Weber’s “modern politician” shared many of their ethical convictions but was no longer able to appeal to the authority of God. Instead, the modern political actor has to have a sense of responsibility and a belief in the accountability for the future. By providing this theological context one will have a fuller background for understanding of Weber’s two types of ethics. (shrink)

Doing Ethics in a Pluralistic World is an apt title for this collection of essays in honour of Roger C. Hutchinson who, over many decades, has encouraged and participated in shaping a Canadian contextual social ethics. His abiding interest in social ethics and in religious engagement with public issues is reflected in his life’s work — seeking the consensus and self-knowledge required to achieve cooperation in the search for a just, participatory, and sustainable society. One of Roger (...) Hutchinson’s many notable accomplishments is his development of a method of dialogue for ethical clarification in situations of diversity. Some of the essays collected here apply this method to specific issues, while others discuss how religious persons and organizations can and do co-operate in a pluralistic world to achieve social and ecological well-being. All essays are of keen interest to those concerned with the role and function of ethics at the matrix of religious conviction and social transformation. For nearly three decades Roger Hutchinson has been based at Victoria University in Toronto, first in religious studies, then at Emmanuel College, where he completed his teaching career as professor of church and society while serving as principal from 1996 to 2001. This paper argues that Aristotelian practical wisdom (phronêsis) is a state of conviction (pistis) in the goodness of our goals based on proper grounds. This state of conviction can only be achieved if rational arguments and principles agree with how things appear to us. Since, for Aristotle, passions influence appearances, they can support or undermine our conviction in the goodness of ends that are worth pursuing. For this reason, we cannot be practically wise without virtuous dispositions to (...) experience appropriate passions. Background The aim of this study was to describe the kinds of ethical dilemmas surgeons face during practice. Methods Five male and five female surgeons at a University hospital in Norway were interviewed as part of a comprehensive investigation into the narratives of physicians and nurses about ethically difficult situations in surgical units. The transcribed interview texts were subjected to a phenomenological-hermeneutic interpretation. Results No gender differences were found in the kinds of ethical dilemmas identified among male and female surgeons. (...) The main finding was that surgeons experienced ethical dilemmas in deciding the right treatment in different situations. The dilemmas included starting or withholding treatment, continuing or withdrawing treatment, overtreatment, respecting the patients and meeting patients' expectations. The main focus in the narratives was on ethical dilemmas concerning the patients' well-being, treatment and care. The surgeons narrated about whether they should act according to their own convictions or according to the opinions of principal colleagues or colleagues from other departments. Handling incompetent colleagues was also seen as an ethical dilemma. Prioritization of limited resources and following social laws and regulations represented ethical dilemmas when they contradicted what the surgeons considered was in the patients' best interests. Conclusion The surgeons seemed confident in their professional role although the many ethical dilemmas they experienced in trying to meet the expectations of patients, colleagues and society also made them professionally and personally vulnerable. The South African government announced the much-discussed stay-at-home order between March 27 and April 30, 2020, during what was known as lockdown level 5, which meant that citizens were not allowed to leave their homes. The objective of this study is to assess the stay-at-home order against the global principles of the UDBHR. It is deducible that, in reference to the UDBHR, the government possessed the right to curtail individual liberty, thereby not infringing on Article 5 of the UDBHR and (...) therefore, in this context, passes the test of the UDBHR. However, it remains uncertain at present whether the limitation of freedom imposed by the South African stay-at-home order was successful in controlling the spread of COVID-19 and protecting individuals from harm. Initial investigations also indicate that individuals who are particularly vulnerable may not have received equitable treatment in accordance with the principle outlined in Article 10, therefore, it can be cautiously and modestly argued that the stay-at-home order does not withstand scrutiny when assessed against the UDBHR. Given the continued discussion about the efficacy of limiting freedom to control the spread of COVID-19, and the growing conviction that the advancement of justice is being called into question, the notion of least restriction ought to be considered seriously. Ten Have (2022) is correct in asserting that global bioethics should also seriously consider other principles beyond an almost exclusive focus on limiting individual freedom. The preliminary conclusion is that the potential implementation of the stay-at-home order in the future must be seriously reconsidered. (shrink)

We typically think of prosecutorial ethics as encompassing a special set of obligations for prosecutors during the pretrial and trial stages of a criminal case. In the literature and in rules of professional responsibility much attention is paid to the charging function, contact with unrepresented persons, plea negotiations, discovery, and courtroom decorum. Our concern with prosecutorial ethics at these stages is rooted primarily in due process and fairness to the accused. [W]hile he may strike hard blows, the Supreme (...) Court wrote in Berger v. United States, [a prosecutor] is not at liberty to strike foul ones. Whether it is a recognition that the prosecutor acts as a representative of the sovereign or that he or she possesses extraordinary power over people's lives, we speak about the prosecutor's ethical duties as special or additional to those of ordinary lawyers. By preventing a prosecutor from litigating unfairly, the aim is to protect a criminal defendant from an unjust or unwarranted conviction. What, then, are the ethical duties of prosecutors after the defendant has had his fair shot at trial, but lost? The literature and standards are surprisingly silent, with rare exception, on the post-conviction ethics of prosecutors. Constraints on the prosecutorial function seem to reach their apex at trial. Why? Are the reasons for special or additional ethics for prosecutors non-existent on appeal? Is the vast discretion, present at the pretrial and trial stages and thought by some to justify special ethical duties, absent on appeal? As a recent case from Texas illustrates, ethical issues still abound even after a jury returns a verdict of guilty. Nevertheless, the traditional discourse on pre-conviction duties can help us determine how prosecutorial discretion should be exercised after a conviction has been obtained. (shrink)
