Workplace‐collected blood spots deposited on filter paper were analysed with multiplexed affinity‐based protein assays and found to be suitable for proteomics analysis. The protein extension assay (PEA) was used to characterize 92 proteins using 1.2 mm punches in repeated samples collected from 20 workers. Overall, 97.8% of the samples and 91.3% of the analysed proteins passed quality control. Both within and between spot correlations using six replicates from the same individual were above 0.99, suggesting that comparable levels are obtained from (...) multiple punches from the same spot and from consecutive spots. Protein levels from dried blood and wet serum from the same individuals were compared and the majority of the analysed proteins were found to be significantly correlated. These results open up for simplified sample collection of blood in field conditions for proteomic analysis, but also highlight that not all proteins can be robustly measured from dried whole blood. In this article I examine the proposition that severe cognitive disability is an impediment to moral personhood. Moral personhood, as I understand it here, is articulated in the work of Jeff McMahan as that which confers a special moral status on a person. I rehearse the metaphysical arguments about the nature of personhood that ground McMahan’s claims regarding the moral status of the “congenitally severely mentally retarded” (CSMR for short). These claims, I argue, rest on the view that only intrinsic (...) psychological capacities are relevant to moral personhood: that is, that relational properties are generally not relevant. In addition, McMahan depends on an argument that species membership is irrelevant for moral consideration and a contention that privileging species membership is equivalent to a virulent nationalism (these will be discussed below). In consequence, the CSMR are excluded from moral personhood and their deaths are less significant as their killing is less wrong than that of persons. To throw doubt on McMahan’s conclusions about the moral status and wrongness of killing the CSMR I question the exclusive use of intrinsic properties in the metaphysics of personhood, the dismissal of the moral importance of species membership, and the example of virulent nationalism as an apt analogy. I also have a lot to say about McMahan’s empirical assumptions about the CSMR. (shrink)

The creation of increasingly complex artificial intelligence (AI) systems raises urgent questions about their ethical and social impact on society. Since this impact ultimately depends on political decisions about normative issues, political philosophers can make valuable contributions by addressing such questions. Currently, AI development and application are to a large extent regulated through non-binding ethics guidelines penned by transnational entities. Assuming that the global governance of AI should be at least minimally democratic and fair, this paper sets out three desiderata (...) that an account should satisfy when theorizing about what this means. We argue, first, that an analysis of democratic values, political entities and decision-making should be done in a holistic way; second, that fairness is not only about how AI systems treat individuals, but also about how the benefits and burdens of transformative AI are distributed; and finally, that justice requires that governance mechanisms are not limited to AI technology, but are incorporated into a range of basic institutions. Thus, rather than offering a substantive theory of democratic and fair AI governance, our contribution is metatheoretical: we propose a theoretical framework that sets up certain normative boundary conditions for a satisfactory account. On 11 September 2019, the verdict was read in the first prosecution of a doctor for euthanasia since the Termination of Life on Request and Assisted Suicide (Review Procedures) Act of 2002 was installed in the Netherlands. The case concerned euthanasia on the basis of an advance euthanasia directive (AED) for a patient with severe dementia. In this paper we describe the review process for euthanasia cases in the Netherlands. Then we describe the case in detail, the judgement of the (...) Regional Review Committees for Termination of Life on Request and Euthanasia (RTE) and the judgement of the medical disciplinary court. Both the review committees and the disciplinary court came to the conclusion there were concerns with this case, which mainly hinged on the wording of the AED. They also addressed the lack of communication with the patient, the absence of oral confirmation of the wish to die and the fact that the euthanasia was performed without the patient being aware of this. However, the doctor was acquitted by the criminal court as the court found she had in fact met all due care criteria laid down in the act. We then describe what this judgement means for euthanasia in the Netherlands. It clarifies the power and reach of AEDs, it allows taking conversations with physicians and the testimony of the family into account when interpreting the AED. However, as a practical consequence the prosecution of this physician has led to fear among doctors about prosecution after euthanasia. (shrink)

The central ideas coming out of the so-called pragmatic turn in philosophy have set in motion what may be described as a pragmatic turn in normative political theory. It has become commonplace among political theorists to draw on theories of language and meaning in theorising democracy, pluralism, justice, etc. The aim of this paper is to explore attempts by political theorists to use theories of language and meaning for such normative purposes. Focusing on Wittgenstein's account, it is argued that these (...) attempts are unsuccessful. It is shown that pragmatically influenced political theorists draw faulty epistemological, ontological and semantic conclusions from Wittgenstein's view in their normative theorising, and it is argued that pragmatically influenced theories of language and meaning, however full of insight, cannot be put to substantial normative use in political theory. The general scope of the thesis is motivated by pointing to the general form of the argument and by moving beyond Wittgenstein to other philosophers of mind and language, illustrating how similar overextensions are made with regard to Robert Brandom's theory of language and meaning. A shared presumption among practice-dependent theorists is that a principle of justice is dependent on the function or aim of the practice to which it is supposed to be applied. In recent contributions to this debate, the condition of epistemic uncertainty plays a significant role for motivating and justifying a practice-dependent view. This paper analyses the role of epistemic uncertainty in justifying a practice-dependent approach. We see two kinds of epistemic uncertainty allegedly playing this justificatory role. What we call ‘normative (...) epistemic uncertainty’ emerges from dealing with the problem of value uncertainty in justifying applied principles when our higher-level principles are open-textured, that is, when their content is too vague or unclear to generate determinate prescriptions. What we call ‘descriptive epistemic uncertainty’ emerges from dealing with uncertainty about empirical facts, such as the problem of moral assurance, that is, the problem that the requirements of justice cannot go beyond arrangements that we can know with reasonable confidence that we can jointly establish and maintain. In both cases, practice-dependent theorists conclude that the condition of epistemic uncertainty justifies a practice-dependent approach, which puts certain restrictions on theorizing regulative principles and has wide-ranging practical implications for the scope of justice. Our claim in this paper is that neither kind of epistemic uncertainty justifies a practice-dependent approach. (shrink)

It is common for religiously motivated actions to be specially protected by law. Many legal theorists have asked why: what makes religion special? What makes it worthy of toleration over and above other non-religious deeply held convictions? The answer I put forward is that religions’ alleged afterlife consequences call for a principle of toleration that warrants special legal treatment. Under a Rawlsian principle of toleration, it is reasonable for those in the original position to opt for principles of justice that (...) accommodate actions with alleged afterlife consequences. And, under a utilitarian principle of toleration, a greater psychological harm is eased by such accommodations. Additionally, this alleged afterlife consequence is found in most of the religions that are thought to warrant some level of special toleration—not only do the Abrahamic religions have alleged afterlife consequences, but many eastern religions do as well, e.g. reincarnation. In this paper we compare Kierkegaard’s and Marx’s views on social reform. Then we argue that Kierkegaard’s own reasoning is consistent with the expression of neighbor-love through collective action, i.e. social reform. However, Kierkegaard’s approach to social reform would be vastly different than Marx’s. We end by reviewing several questions that Kierkegaardian social reformers would ask themselves. Our hope is that this exploration will provide helpful insights into how those who genuinely love their neighbors ought to seek the common good (...) through collective action. (shrink)

During the past few years, the IRBIT domain has emerged as an important add‐on of S‐adenosyl‐L‐homocystein hydrolase (AHCY), thereby creating the new family of AHCY‐like proteins. In this review, we discuss the currently available data on this new family of proteins. We describe the IRBIT domain as a unique part of these proteins and give an overview of its regulation via (de)phosphorylation and proteolysis. The second part of this review is focused on the potential functions of the AHCY‐like proteins. We (...) propose that the IRBIT domain serves as an anchor for targeting AHCY‐like proteins towards cytoplasmic targets. This leads to regulation of (i) intracellular Ca2+ via the inositol 1,4,5‐trisphosphate receptor (IP3R), (ii) intracellular pH via the Na+/HCO3− cotransporters (NBCs); whereas inactivation of the IRBIT domain induces (iii) nuclear translocation and regulation of AHCY activity. Propongo dilucidar en la filosofía práctica madura de Kant la relevancia del cultivo de la virtud y de la educación para el progreso de las comunidades políticas y ética y muestro que ello puede abordarse de forma integrada desde el paralelo ético-político. Primero, explicaré que la tarea y el deber del ser humano de realizar el fin del bien supremo ético y político se puede esclarecer en relación con el destino de la humanidad. Después argumentaré que la tarea de los (...) seres humanos radica en el cultivo de la virtud, que es un deber que podemos llamar ético-político en el sentido de que las disposiciones morales de los individuos se desarrollan socialmente y sirven a fines comunitarios. Under what conditions do motherhood penalties emerge in countries undergoing transition from state socialism to capitalism? This analysis identifies the ways managers in global financial firms employ gendered assumptions in constructing and implementing labor practices among highly skilled professional workers in Hungary. Relying on 33 in-depth interviews with employers as well as interviews with headhunting firms, labor and employment lawyers, and analysis of antidiscrimination cases brought before Hungary’s Equal Treatment Authority between 2004 and 2008, we identify several strategies global employers (...) use to shed, demote, and marginalize professional mothers. By demonstrating the salience of motherhood as a status characteristic in the postsocialist labor market, our work contributes to existing scholarship on motherhood penalties. Our work also extends this scholarship by showing how the salience of motherhood is strongly conditioned by state-level arrangements that shape the opportunity context in which employers design and carry out employment practices. The marked intertextual patterning of Maryse Condé’s first novel Heremakhonon is a widely acknowledged feature, with the relationship between Condé’s novel and Aimé Césaire's Notebook of a Return to my Native Land attracting the bulk of critical attention. Through close readings of to date unexamined dramatic codes in Heremakhonon, this article proposes to extend the cultural context in which Condé’s text is traditionally read. Moving beyond the standard critical discussions of authenticity, I track Heremakhonon's mobile positionings in relation to polarizing (...) debates in the broader French literary-critical field between engagement and modernism. This focus allows for an exploration of the complex sets of relationships between the cultures of modernism and engagement that provide the conditions of possibility for Condé’s novel. (shrink)

There is an underlying idea of symmetry involved in most notions of rationality. From a dialogical philosophical standpoint, however, the symmetry implied by social contract theories and so-called Golden Rule thinking is anchored to a Cartesian subject–object world and is therefore not equipped to address recognition – at least not if recognition is to be understood as something happening between subjects. For this purpose, the dialogical symmetry implied by Habermas' communicative action does a much better job. Still, it is insufficient (...) to embrace those kinds of recognition that are dependent on asymmetry and concrete difference. This article explores how communicative action could meet the demand of recognition by investigating a complementary source of validity in communicative rationality, apart from Habermas' validity claims, in which ‘inter’ is better characterized as mutuality than as symmetry. By recognizing both sources of validity, communicative action can open the door more fully to all aspects of recognition without giving up its universal pragmatic core. Eva Brann, who has taught at St. John’s College, Annapolis, for sixty years, wrote these essays largely as clarifying incitements to students who were reading, or ought to have been reading, the works discussed. In her words: "The first essay looks at the 'Pre-Socratics' Heraclitus and Parmenides. They appear to be in radical opposition, but they are really doing the same, new thing: seeing the world as an intelligible whole. Both observe external nature, construing it in their minds—so, from the (...) outside in. The final essay again describes two ways of world-construing from the outside in—one by penetrating the surface of reality, the other by spinning a web of complexity over it. "The five essays in between focus on works by Kant and display the world as constituted from the human inside out. An appreciative review of the Critique of Pure Reason shows how Kant brilliantly justifies a science of nature by making nature itself the construct of our understanding. But he leads us to the abyss of more idealism; externality and realism escape him. The explication of his one absolute moral commandment similarly defines his morality entirely in terms divorced from objective good and concentrated on internal integrity. This paper investigates the relationship between the role that information technology (IT) has played in the development of women’s employment, the possibility of women having a significant influence on the technology’s development, and the way that the IT industry perceives women as computer scientists, users and consumers. The industry’s perception of women and men is investigated through the portrayal of them in computing advertisements. While women are increasingly updating their technological skills and know-how, and through this process are entering some (...) positions in the workplace traditionally occupied by men, these achievements are not mirrored in their social and occupational status. The computer industry and higher education have worryingly low numbers of women, while the possibility of women influencing the development of computer technology is just emerging in feminist research. This paper argues that, though the IT industry, through their self-regulatory codes, subscribes to equal treatment of sexes, races and persons with disabilities, the industry nevertheless paints a stereotyped picture of inequality when portraying men and women in computer advertisements. As long as such a perception of women prevails within the industry, it will stand as a barrier to women having equal access to computer technology. If advertisements influence the way society perceives major social constructs and issues, then the computing industry has a social responsibility to portray men and women in an equal and non-stereotypical fashion. Derrida’s highly personal mourning texts are collected and published in a unique book under the title The Work of Mourning edited by Pascale-Anne Brault and Michael Naas, two outstanding translators of Derrida’s works. The English collection is published in 2001, while the French edition came out later in 2003 titled Chaque fois unique, la fin du monde. In his deconstructed eulogies, Derrida, being in accordance with ‘the mission impossible’ of deconstruction, namely, ‘to allow the coming of the entirely other’ in (...) its otherness, seems to find his own voice. In my paper, I will focus on this special segment of Derrida’s death-work ; namely, on his mourning texts written for his dead friends, paying special attention to the rhetoric ‘circling around’ fidelity, friendship, and the other in his textual mourning. Jolles greift damit den morphologischen Gedanken einer Vielgestaltigkeit von Form vor dem Hintergrund der sprachwissenschaftlichen Debatten seines politisierten akademischen Umfelds in Leipzig auf, das den Saussure’schen Systemgedanken der Sprache unter Rückbezug auf Wilhelm von Humboldt holistisch umdeuten wollte. Der Aufsatz verortet Jolles’ Überlegungen in der formorientierten Literatur- und Kulturtheorie der Zeit. (...) Anhand seiner Zeitbegriffe und seines Formkonzepts wird gezeigt, wie er die zeitgenössischen Ideen der Ganzheit und der Verzeitlichung von Form im Ausgang morphologischer Fragen auf eigenwillige Weise interpretierte.In his book Einfache Formen André Jolles develops the idea of a special temporality of so-called »simple forms«, which he calls »Jedesmaligkeit«, referencing Goethe’s reflections on the ›versatile forms‹ of nature. Jolles adopted the morphological idea of a versatility of form against the background of the linguistic debates of his politicized academic environment in Leipzig. In accordance with contemporary holistic thinking his colleagues reinterpreted Saussure’s idea that language is a system, drawing in particular on Wilhelm von Humboldt. The essay situates Jolles’ reflections in the form-oriented literary and cultural theory of the time. On the basis of his concepts of time and his thinking in terms of form, the article shows how he adapted the contemporary ideas of the wholeness and temporalization of form in an idiosyncratic way in the wake of morphological questions. Introduction: Congenital myasthenic syndromes refer to a heterogenic group of neuromuscular transmission disorders. CMS-subtypes are diverse regarding exercise intolerance and muscular weakness, varying from mild symptoms to life-limiting forms with neonatal onset. Long-term follow-up studies on disease progression and treatment-response in pediatric patients are rare.Patients and Methods: We analyzed retrospective clinical and medication data in a cohort of 32 CMS-patients including the application of a standardized, not yet validated test to examine muscular strength and endurance in 21 patients at the (...) last follow-up. Findings obtained in our cohort were compared with long-term follow-up studies of CMS-cohorts from the literature by considering the underlying molecular mechanisms. Outcomes of CMS-ST were compared to results of normal clinical assessment.Results: Thirty-two pediatric patients with defects in eight different CMS-genes were followed by a median time of 12.8 years. Fifty-nine percentage of patients manifested with first symptoms as neonates, 35% as infants. While 53% of patients presented a reduced walking distance, 34% were wheelchair-bound. Even under adequate therapy with pyridostigmine and 3,4-diaminopyridine, CHAT-mutations led to the progression of muscular weakness partly in combination with persistent respiratory and bulbar symptoms. RAPSN, CHRND, and CHRNB1 patients with neonatal manifestation, early respiratory problems, and bulbar symptoms showed a good and maintained treatment response. CHAT and CHRNE patients required higher PS dosages, whereas RAPSN patients needed a lower mean dosage at the last follow-up. The benefits of short-term medication and long-term progression of symptoms were highly dependent on the specific genetic defect. CMS-ST was carried out in 17/21 patients, determined affected muscle groups including bulbar and ocular symptoms, some of which were not reported by the patients.Conclusions: Our findings and comparison with the literature- suggest a better treatment-response and less severe progression of symptoms present in patients suffering from mutations in CMS-genes directly associated with receptor deficiency, while patients with defects leading to synaptopathy and presynaptic defects tend to have worse outcomes. Assessment of affected muscular groups and clinical symptoms by CMS-ST may be a useful tool for optimal therapeutic management of the patients, especially for future clinical studies. (shrink)

Research question The secondary research use of treatment data has the potential to expand medical knowledge and improve patient care. Hospitals play an important role in systematic secondary research use: they generate large amounts of treatment data and are supposed to establish the necessary structures for their use in research. This raises the ethical question: do hospitals have a moral duty to support secondary research use of treatment data by establishing and operating the necessary resources and infrastructure? Procedure Our aim (...) is to outline a conceptual framework to discuss the question and to propose a first normative position. Building on insights from business and organizational ethics, we develop a conceptual framework in which we view hospitals as moral actors. Our normative-ethical analysis is based on a reconstructive stakeholder approach, in which we identify the following general duties of hospitals: orientation towards patient wellbeing; cost efficiency; enabling employees to act in accordance with professional ethical standards; supporting public health and research. We examine whether these general duties provide reasons for a specific duty of hospitals to support secondary research use of treatment data. We discuss potential objections to such a duty arising from other, potentially conflicting general duties of hospitals (e.g., data protection), from practice (e.g., costs/resources), or related discourses (data ownership). Conclusion Certain general duties (orientation towards patient wellbeing, cost efficiency, support of public health) justify a duty of hospitals to support secondary research use of treatment data. The duty to enable employees to act in accordance with professional ethical standards is only an indirect reason; the duty to support research applies solely to university hospitals. Potential objections apply to a certain extent but can be mitigated through targeted measures. (shrink)

Actualmente, «pensar la mujer» constituye una tarea inacabada y debatida. En pleno siglo XX, la fenomenóloga Edith Stein explora tal despliegue interrogándose por su naturaleza y valor propio. La presente investigación expone el itinerario que establece la filósofa desde la reflexión de la persona humana a la comprensión de la mujer. Para tal efecto, se articulan desde la obra steiniana los principales conceptos y matices que, mediante el análisis fenomenológico posibilita examinar las nociones constituyentes del sujeto en su dimensión corporal (...) y espiritual. Finalmente, se esboza la peculiaridad de la esencia femenina, cuya indagación permite detenerse en la pregunta esencial por la mujer. La conclusión avanza hacia un balance de los principales aspectos desarrollados como aporte al diálogo contemporáneo. (shrink)

Within liberal democratic theory, ‘democratic accountability’ denotes an aggregative method for linking political decisions to citizens’ preferences through representative institutions. Could such a notion be transferred to the global context of human rights? Various obstacles seem to block such a transfer: there are no ‘world citizens’ as such; many people in need of human rights are not citizens of constitutional democratic states; and the aggregative methods that are supposed to sustain the link are often used in favour of nation-state strategic (...) action rather than human rights. So what could accountability mean in relation to human rights? This article argues that discourse theory offers resources for approaching these problems and for rethinking a normative notion of accountability in relation to human rights. It is suggested that accountability should link political decisions to universal agreements through global rights institutions and that the link should be sustained by deliberative rather than aggregative procedures.
