The current debate over the global distribution of COVID-19 vaccines once again highlights the many shortcomings of the modern intellectual property system, especially when it comes to equitable access to medicines. This essay argues that the conceptual center of struggles over access to new pharmaceuticals rests in the IP system's colonial legacy, which perceives the world as uncharted territory that is ripe for discovery and ownership. This vision of the world as a blank canvas, or terra nullius, sets aside any (...) other models of ownership and devalues other traditional modes of relating to territory and nature. Several examples show the long-lasting exclusionary effects of this hidden legacy of colonial conquest in the field of public health, ranging from the spiraling price of insulin to the distribution of COVID-19 vaccines to the negotiation of sharing mechanisms for virus samples. In all of these cases, the continuing marginalization of other interests by the IP system can lead to exploitation, without either the “sources” of materials, such as those from whom the samples were taken, or the recipients of the eventual product having any say in matters of price and access. This legacy of fundamental exclusion needs to be recognized and addressed in order to arrive at more equitable solutions to public health emergencies such as the current pandemic. (shrink)

Does life have meaning? What is flourishing? How do we attain the good life? Philosophers, and many others of us, have explored these questions for centuries. As Eva Feder Kittay points out, however, there is a flaw in the essential premise of these questions: they seem oblivious to the very nature of the ways in which humans live, omitting a world of co-dependency, and of the fact that we live in and through our bodies, whether they are fully abled or (...) disabled. Our dependent, vulnerable, messy, changeable, and embodied experience colors everything about our lives both on the surface and when it comes to deeper concepts, but we tend to leave aside the body for the mind when it comes to philosophical matters. Disability offers a powerful challenge to long-held philosophical views about the nature of the good life, what provides meaning in our lives, and the centrality of reason, as well as questions of justice, dignity, and personhood. These concepts need not be distant and idealized; the answers are right before us, in the way humans interact with one another, care for one another, and need one another--whether they possess full mental capacities or have cognitive limitations. We need to revise our concepts of things like dignity and personhood in light of this important correction, Kittay argues. This is the first of two books in which Kittay will grapple with just how we need to revisit core philosophical ideas in light of disabled people's experience and way of being in the world. Kittay, an award-winning philosopher who is also the mother to a multiply-disabled daughter, interweaves the personal voice with the philosophical as a critical method of philosophical investigation. Here, she addresses why cognitive disability can reorient us to what truly matters, and questions the centrality of normalcy as part of a good life. With profound sensitivity and insight, Kittay examines other difficult topics: How can we look at the ethical questions regarding prenatal testing in light of a new appreciation of the personhood of disabled people? What do new possibilities in genetic testing imply for understanding disability, the family, and bioethics? How can we reconsider the importance of care, and how does it work best? In the process of pursuing these questions, Kittay articulates an ethic of care, which is the ethical theory most useful for claiming full rights for disabled people and providing the opportunities for everyone to live joyful and fulfilling lives. She applies the lessons of care to the controversial alteration of severely cognitively disabled children known as the Ashley Treatment, whereby a child's growth is halted with extensive estrogen treatment and related bodily interventions are justified. This book both imparts lessons that advocate on behalf of those with significant disabilities, and constructs a moral theory grounded on our ability to give, receive, and share care and love. Companies increasingly recognize the importance of communicating corporate social responsibility including their engagement toward employees, the community, the environment and other stakeholder groups to attract applicants. The positive findings on the effect of CSR on applicants’ reactions are commonly based on the assumption that companies send a clear signal about their commitment to CSR. However, communication is always contextualized and has become more ambiguous through the increased availability of information online. External stakeholders including actual and potential applicants are confronted with (...) inconsistencies between the way companies communicate CSR activities and their overall CSR performance. Drawing on signaling theory, this article raises the question of how the interaction between strong CSR communication and low CSR performance influences organizational attractiveness. We propose that low CSR performance dampens the effect of CSR communication on organizational attractiveness. Hence, the inconsistency between CSR communication and CSR performance decreases organizational attractiveness. To test our hypotheses, we scraped 67,189 posts published on corporate Facebook career pages by 58 Fortune 500 companies from the time they began their respective career page until June 2018. Surprisingly, our results show that a low CSR performance strengthens the effect of CSR communication on organizational attractiveness. Thus, inconsistencies between CSR communication and CSR performance seem to lead to positive evaluations among applicants. (shrink)

During the past few years, the IRBIT domain has emerged as an important add‐on of S‐adenosyl‐L‐homocystein hydrolase (AHCY), thereby creating the new family of AHCY‐like proteins. In this review, we discuss the currently available data on this new family of proteins. We describe the IRBIT domain as a unique part of these proteins and give an overview of its regulation via (de)phosphorylation and proteolysis. The second part of this review is focused on the potential functions of the AHCY‐like proteins. We (...) propose that the IRBIT domain serves as an anchor for targeting AHCY‐like proteins towards cytoplasmic targets. This leads to regulation of (i) intracellular Ca2+ via the inositol 1,4,5‐trisphosphate receptor (IP3R), (ii) intracellular pH via the Na+/HCO3− cotransporters (NBCs); whereas inactivation of the IRBIT domain induces (iii) nuclear translocation and regulation of AHCY activity. While we applaud the careful breakdown by Clark and Fischer of the representation of social robots held by the human user, we emphasise that a neurocognitive perspective is crucial to fully capture how people perceive and construe social robots at the behavioural and brain levels.

A growing number of multinational companies (MNCs) report on their progress toward contributing to the Sustainable Development Goals (SDGs) in their annual reports, yet the amount and quality of the information they disclose varies significantly. The aim of this study is twofold: First, we investigate how transparent MNCs report on their SDG engagement and second, we study how the reported SDG engagement changed over time due to major shifts in sustainability reporting requirements. Using a dataset of the largest German MNCs, (...) we analyze their disclosure of SDG contribution reporting practices. Our results show that, overall, between 2016 and 2021 all German MNCs increased their SDG reporting activity and that the MNCs adopted four different practices to report their SDG engagement. We also found that the largest MNCs were more transparent and systematic in their SDG reporting than smaller MNCs, whose reporting was more heterogeneous. Our study contributes to legitimacy research and the role of transparency in corporate reporting as well as the debates on the efficacy of sustainability reporting legislation in the context of SDG engagement. Our findings imply that regulations on environmental and social regulation increase the transparency of sustainability reporting. (shrink)

Este trabajo analiza documentos del D2 de la policía de Santiago del Estero y de la oficina de inteligencia de una Base Aeronaval en Chubut con el objetivo de identificar sus clasificaciones para la identificación de actores y preguntarse, a partir de allí, respecto del rol de los organismos de información e inteligencia durante los períodos democráticos. Este aspecto, que sigue siendo una de las deudas de la democracia argentina, fue materia de legislación en 2001 con la sanción de la (...) Ley de Inteligencia Nacional 25.520. Sin embargo, el hallazgo de archivos militares y policiales que ocupan a este artículo dan cuenta de la continuidad de la práctica de investigación de antecedentes, reunión de información y producción de inteligencia por razones políticas sobre ciudadanos e instituciones. Esto abre interrogantes en torno a la idea de que el sentido de los documentos responde exclusivamente a las funciones formales del organismo productor. Antes bien, deben ser considerados como artefactos sociales que encarnan y reproducen repertorios culturales políticos de largo aliento, que forman parte de la llamada “baja política” pero que inciden en los procesos, conflictos y decisiones que se despliegan en la dimensión institucional de la política. Health checks or health screenings identify disease in people without a specific medical indication. So far, the perspective of health check users has remained underexposed in discussions about the ethics and regulation of health checks. In 2017, we conducted a qualitative study with lay people from the Netherlands. We asked what participants consider characteristics of good and bad health checks, and whether they saw a role for the Dutch government. Participants consider a good predictive value the most important characteristic of (...) a good health check. Information before, during and after the test, knowledgeable and reliable providers, tests for treatable disease, respect for privacy, no unnecessary health risks and accessibility are also mentioned as criteria for good health checks. Participants make many assumptions about health check offers. They assume health checks provide certainty about the presence or absence of disease, that health checks offer opportunities for health benefits and that the privacy of health check data is guaranteed. In their choice for provider and test they tend to rely more on heuristics than information. Participants trust physicians to put the interest of potential health check users first and expect the Dutch government to intervene if providers other than physicians failed to do so by offering tests with a low predictive value, or tests that may harm people, or by infringing the privacy of users. Assumptions of participants are not always justified, but they may influence the choice to participate. This is problematic because choices for checks with a low predictive value that do not provide health benefits may create uncertainty and may cause harm to health; an outcome diametrically opposite to the one intended. Also, this may impair the relationship of trust with physicians and the Dutch government. To further and protect autonomous choice and to maintain trust, we recommend the following measures to timely adjust false expectations: advertisements that give an accurate impression of health check offers, and the installation of a quality mark. Because modern societies are built on elaborate divisions of cognitive labor, individuals remain laypersons in most knowledge domains. Hence, they have to rely on others' expertise when deciding on many science-related issues in private and public life. Even children already locate and discern expertise in the minds of others. This study examines how far university students accurately judge experts' pertinence for science topics even when they lack proficient knowledge of the domain. Participants judged the pertinence of experts from diverse disciplines (...) based on the experts' assumed contributions to texts adapted from original articles from Science and Nature. Subjective pertinence judgments were calibrated by comparing them with bibliometrics of the original articles. Furthermore, participants' general science knowledge was controlled. Results showed that participants made well-calibrated pertinence judgments regardless of their level of general science knowledge. (shrink)

The purpose of the study is to explore a new research methodology that will improve our understanding of “flow” through indicators of physiological and qualitative state. We examine indicators of “flow” experienced by musicians of a youth string quartet, two women (25, 29) and two men (23, 24). Electrocardiogram (ECG) equipment was used to record heart rate variability (HRV) data throughout the four movements in one and the same quartet performed during two concerts. Individual physiological indicators of flow were supplemented (...) by assessments of group “state flow” (means from standardized questionnaires) and a group interview in which the musicians provided qualitative data. A matrix was constructed for the characterization of different kinds of demands in the written music in each one of the four movements for each one of the musicians. HRV derived from ECG data showed non-significant trends for group state flow across the eight musical episodes. Individual-level analysis showed that compared to the other players the first violin player had the highest mean heart rate and the lowest increase in high frequency (HF) power in HRV during this particular movement, particularly during the second concert. The qualitative data illustrated how an interplay of synchronized social interactions between this player and their colleagues during the musical performance was associated with a feeling of group state flow and served to support the first violinist. The case illustrates that the proposed mixed methodology drawing on physiological and qualitative data, has the potential to provide meaningful information about experiences of a flow state, both at individual and group levels. Background: Conscience is an important concept in ethics, having various meanings in different cultures. Because a growing number of healthcare professionals are of immigrant background, particularly within the care of older people, demanding multiple ethical positions, it is important to explore the meaning of conscience among care providers within different cultural contexts. Research objective: The study aimed to illuminate the meaning of conscience by enrolled nurses with an Iranian background working in residential care for Persian-speaking people with dementia. Research design: (...) A phenomenological hermeneutical method guided the study. Participants and research context: A total of 10 enrolled nurses with Iranian background, aged 33–46 years, participated in the study. All worked full time in residential care settings for Persian-speaking people with dementia in a large city, in Sweden. Ethical considerations: The study was approved by the Regional Ethical Review Board for ethical vetting of research involving humans. Participants were given verbal and written study information and assured that their participation was voluntary and confidential. Findings: Three themes were constructed including perception of conscience, clear conscience grounded in relations and striving to keep a clear conscience. The conscience was perceived as an inner guide grounded in feelings, which is dynamic and subject to changes throughout life. Having a clear conscience meant being able to form a bond with others, to respect them and to get their confirmation that one does well. To have a clear conscience demanded listening to the voice of the conscience. The enrolled nurses strived to keep their conscience clear by being generous in helping others, accomplishing daily tasks well and behaving nicely in the hope of being treated the same way one day. Conclusion: Cultural frameworks and the context of practice needed to be considered in interpreting the meaning of conscience and clear conscience. (shrink)

I review Elizabeth Barnes, The Minority Body very favorably. I argue as well that the substance of the work applies not only to minority bodies but also to “minority minds”. I also argue that the “dis” in disability should be understood as the precarious of maintaining a good life, not to the ability to have a good life. This may be due to both social and medical concerns.

The late antique rabbis of Roman Palestine were seasoned jurists, experts on exegesis and legal interpretation. Yet rabbinic literature does not theorize. A positive account of rabbinic conceptions of language therefore remains a desideratum. I choose an alternative approach. Legal reasoning relies on language to ground the determinacy of the law. Jurists must thus confront language when it threatens to undermine the latter. Conversely, they may hold language to safeguard legal determinacy. Drawing on insights from legal theory, I turn to (...) an unusual rabbinic rule of inference. Its earliest attested version suggests a universal possibility of inference “from the category of yes that of no, from the category of no that of yes.” I show that the ever-evolving uses of this rule allow us to observe a shift in linguistic attitude, increasingly acknowledging linguistic uncertainty. My findings tie in with recent advances in the study of rabbinic exegesis. (shrink)

The COVID‐19 pandemic triggered an unprecedented health crisis that impacted healthcare systems worldwide. This study explores how Spanish healthcare workers learned, internalised and integrated values and work behaviours during the COVID‐19 pandemic and their impact on the personal sphere. This documentary research, using images, narratives and audiovisual content, was framed within the interpretative hermeneutic paradigm. Categories and subcategories emerged after a final theoretical sampling that focused on the analysis. Data triangulation between researchers favoured theoretical saturation. A total of 117 images (...) and 27 texts were selected. The analysis identified three stages: bewilderment, seeking functionality in the chaos and integrating chaos into care. The data reflects how the need for security and knowledge, and the exhaustion and frustration caused by the initial working conditions, prompted adaptive responses. These responses involved focusing on problem‐solving and strengthening group sentiments and solidarity. Subsequently, the data indicates the acceptance of new structural, organisational and communication aspects. The findings of the analysis will contribute towards finding a framework that can help understand community health crisis events. (shrink)

In his tragedy Philoctetes, Sophocles has firmly tied the fundamental conflicts to the characters, more precisely to the triangular relationship Ulysses - Neoptolemus - Philoctetes. In the prologue, he sets up the relationship of the older, designing Ulysses to the young, executive Neoptolemos as a problematic one through ambivalent formulations. These traces laid out by the poet are crucial for the interpretation of the entire tragedy. The connotation of the term ξυνεργάτης (v. 93), with which Neoptolemos describes the role Odysseus (...) has intended for him, has been rather neglected so far by scholars but appears to be of particular significance: Parallels in Euripides show that its divergent meanings ‘helper’ and ‘accomplice’ reflect the general conflict of the young hero in nuce. Nach der Skizze eines Kernverständnisses von Menschenwürdeverletzung werden vier Anwendungsgebiete von KI-Systemen exemplarisch erörtert. Es wird dafür argumentiert, dass Menschenwürdeverletzungen zwar weder mit extensiver Werbung und Überredungsstrategien noch mit der Nutzung von Daten über Menschen an sich verbunden sind, dass sie aber tatsächlich da drohen, wo Menschen nicht selbst darüber entscheiden können, welche ihrer Daten wofür verwendet werden und (...) wo ein KI-System selbstständig, ohne weiteres Zutun eines Menschen, über wichtige Belange von Menschen wie Leben und Tod entscheidet. Zu den Symptomen medizinisch depressiver Menschen gehört manchmal eine veränderte Zeiterfahrung, die als quälend empfunden wird. Die Zeit verlangsamt sich bis hin zum Eindruck des Stillstandes der Zeit. Diese Psychopathologie der Zeit wird hier als extremes Beispiel für etwas angesehen, das es in schwächerer Form auch nicht-pathologisch gibt und das als solches auch ein Thema für philosophische Theorien des guten Lebens darstellt. Die Untersuchung der pathologischen Störungen dient als Negativfolie, um zu zeigen, wie im Fall gelingenden Lebens menschliches Zeitbewusstsein verfasst (...) sein muss bzw. verfasst ist. Offenbar sind wir auf die Erfahrung einer fortlaufenden Zeit angewiesen. In diesem Aufsatz wird erörtert, welcher Art genau diese Erfahrung ist, auf welche verschiedenen Weisen sie gestört sein kann und inwiefern solche Störungen ein ethisches Problem sind, insofern sie die Lebensführung in grundsätzlicher Hinsicht beeinträchtigen. Dafür wird insbesondere zwischen einem basalen und einem personalen Zeitbewusstsein unterschieden und das Problem auf der zweiten Ebene verortet. (shrink)

Dieser Aufsatz untersucht einige Zusammenhänge zwischen der Zuschreibung von Intuitionen und intuitivem Wissen einerseits und epistemischen Ungerechtigkeiten andererseits. Der Aufsatz gliedert sich in zwei Teile. Ausgangspunkt ist im ersten Teil Frickers Theorie der epistemischen Ungerechtigkeit. Ich zeige auf, dass dem Verweis auf die „weibliche Intuition“ eine Schlüsselrolle in der Etablierung der Konzepte der testimonialen und hermeneutischen Ungerechtigkeit zukommt, da in ihm systematische Vorurteile über gender-codierte Denkmuster und Verhaltensweisen kulminieren, die paradigmatisch für strukturelle epistemische Ungerechtigkeiten sind. Allerdings gilt es zu betonen, (...) dass der Begriff der Intuition nicht nur im Sinne einer epistemischen Abwertung, sondern auch im Sinne einer Aufwertung höchst problematisch ist. Hierdurch wird eine Schwachstelle in Frickers Theorie deutlich, da diese durch die Annahme einer grundlegenden Asymmetrie zwischen Glaubwürdigkeitsdefiziten und -exzessen ihre Perspektive auf epistemische Ungerechtigkeiten zu weit einschränkt. Im zweiten Teil werde ich anhand zweier ausgewählter metaphilosophischer Debatten einige Verbindungen zwischen dem Intuitionsbegriff in der analytischen Philosophie und Fragen nach epistemischen Ungerechtigkeiten aufdecken. Hierbei werde ich in Bezug auf die Debatte um die sog. Expertise-Verteidigung dafür argumentieren, dass diese nicht auf epistemische Fragestellungen begrenzt werden kann, sondern auch auf eine ethische Dimension verweist. Mit Blick auf die Debatte um die Gender-Lücke in der akademischen Philosophie werde ich aufzeigen dass hier zwar epistemische und ethische Perspektiven zusammengeführt werden, dass bestimmte Argumentationsmuster aber so angelegt sind, dass sie sich implizit an eine problematische, dualistische Vorstellung von Intuition binden. The City is a dynamic living narrative, an unfolding autobiography, a melding of countless invisible stories; unravelling not in words but in movement, fear, desire, need, coupling the daily of living. The city seen is a narrative; meaning definition is found not in the narrative but in the illegible depths of the unseen city. Art practices of every kind are one fragment of the ever-unfolding narrative. New technological possibilities have also revolutionized the way the narrative of the City can be (...) ‘told’ and ‘reproduced’. Narrative is transcribed into a new cultural code through technological advances. Many works of art tell stories; indeed, most of the humanities involve stories. This article is going to study a number of innovative projects in digital art: locative media and interactive media. They all reveal how City is seen by them through their ‘stories’ and narratives. It will explore further the role of story-telling processes. All projects are site specific, participatory and interactive. They also have the capacity to map hybrid city in a mobilized and digital world. How do we picture urban life and formulate our experience of it? How can this experience be reflected via new technologies? Do new ways of narrative and story telling emerge through new technologies? How does audience respond to these practices? Can these practices be a cinematic means of digitalized story telling? These are some of the questions that will be answered in this article. (shrink)

The global economy has an impact on female beauty today, regardless of the multicultural and historical factors in its formation and construction, resulting in monolithic crazes in women's fashion and appearance. but female beauty in china has been greatly contested with China's turbulent modern history, and this contestation deserves serious consideration, together with the politics by which the Chinese state apparatus has promoted and regulated female beauty. I argue that certain factors have been constant in contemporary discourses of female beauty. (...) Ideal bodies, in all their specifics, are defined by physical standards very few women can attain. These standards are accompanied by demeaning characterizations of women who fail to achieve them, and who are therefore destined to be discontent. It is now necessary for feminist theorists to examine the social and cultural roles of the body in terms of gender, power, the established patriarchy, and its oppression of women. (shrink)
