But as an ontological entity, woman is the real First Mover. The pregnant woman is devilishly complete. ABSTRACT Human cloning has been simultaneously a running joke for massive worldwide publicity of fringe groups like the Raelians, and the core issue of an international movement at the United Nations in support of a treaty to ban the use of cloning techniques to produce a child (so called reproductive cloning). Yet, even though debates on human cloning have greatly increased since the birth of Dolly, the clone sheep, in 1997, we continue to wonder whether cloning is after all any (...) different from other methods of medically assisted reproduction, and what exactly makes cloning an ‘affront to the dignity of humans.’ Categories we adopt matter mightily as they inform but can also misinform and lead to mistaken and unproductive decisions. And thus bioethicists have a responsibility to ensure that the proper categories are used in the cloning debates and denounce those who try to win the ethical debate through well‐crafted labels rather than well‐reasoned argumentations. But it is as important for bioethicists to take a position on broad issues such as human cloning and species altering interventions. AbstractEnduring unethical behavior in trading has generated much research interest, and scholars disagree on the reasons for this situation. According to MacIntyre (2015), this has to do with the personal traits of traders, whereas Rocchi and Thunder (2019) argue this is due to permissive work environment that can potentially be changed to favoring ethical trading. We contribute to this debate by exploring how interactions between organizational culture and management control systems (MCSs) may affect the enduring unethical behaviors of traders. We (...) conceptualize this with the concepts of organized hypocrisy (Brunsson 1986, 1989, 1993) and decoupling (Meyer and Rowan 1977). An in-depth case study of fraud (Jerome Kerviel at Societe Generale), informs the empirical inquiry. We develop the concept of organized decoupling to characterize how the MCSs are articulated with the organizational culture favoring unethical behavior, while being used as a ‘safety mechanism’ to manage the legal and reputational risk of the bank. The analysis highlights three key features of the organized decoupling of MCS: physical distance, technical distance and social distance. The study contribution lies in showing that decoupling is not only emergent but might be intended and therefore organized. The findings also raise doubts on the role of MCSs in monitoring trading activities as presented by investment banking institutions and regulators, suggesting more organized hypocrisy, and raising significant concerns regarding the creation of tolerable work environment welcoming ethical behaviors in the investment banking sector. Dobbs v. Jackson Women’s Health continues a trajectory of U.S. Supreme Court jurisprudence that undermines the normative foundation of public health — the idea that the state is obligated to provide a robust set of supports for healthcare services and the underlying social determinants of health. Dobbs furthers a longstanding ideology of individual responsibility in public health, neglecting collective responsibility for better health outcomes. Such an ideology on individual responsibility not only enables a shrinking of public health infrastructure for reproductive (...) health, it facilitates the rise of reproductive coercion and a criminal legal response to pregnancy and abortion. This commentary situates Dobbs in the context of a long historical shift in public health that increasingly places burdens on individuals for their own reproductive health care, moving away from the possibility of a robust state public health infrastructure. I argue that Theodor W. Adorno is best understood as a moral perfectionist thinker in the stripe of Stanley Cavell. This is significant because Adorno’s moral philosophy has not received serious interest from moral philosophers, and much of this has to do with difficulties in situating his thought. I argue that once Adorno is situated in this way, then, like Cavell, he offers an interesting moral perspective that will be of value to a variety of moral theorists. My argument proceeds (...) in two broad steps: first, I show that Cavell and Adorno share a distinct epistemological orientation, one that centers around the impossibility of knowledge in certain situations, and trades on a Kantian and post-Kantian picture. When we conceptualized this symposium, Roe v. Wade1 was still the law of the land, albeit precariously. We aimed to commemorate its fiftieth anniversary by exploring historical, legal, medical, and related dimensions of access to abortion as well as the challenges ahead to secure reproductive justice. With the leak of the U.S. Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization on May 2, 2022, we shifted to mark the dawn of a new era. This paper examines the impact of environmental, social and governance (ESG) disclosure scores on the firm value of European listed companies before, during and after the COVID-19 pandemic. Using a two-level model and a unique dataset of 264 multinational firms covering the period 2019–2022, we find a negative relationship between ESG disclosure scores and firm value. Nevertheless, the effect of the social and environmental disclosure scores disappears during the crisis, and returns negative during the recovery period. Almost all empirical studies (...) to date have found the inverse effect, suggesting that even though ESG transparency can improve firm reputation, it can also damage it and reduce firm value. We also show that firm-specific factors remain the biggest source of variability in firm value, even during the crisis. Thus, this paper contributes to the existing literature by suggesting that the impact of ESG disclosure on firm value may vary depending on the economic and financial context in which firms operate. More specifically, it shows that the benefits of ESG disclosure, namely the reduction of agency costs, stakeholder trust, and firm legitimacy, which are expected to increase firm value, may not have the predicted effect in a crisis context. Consequently, these findings provide both an empirical and a theoretical contribution to the existing literature on agency theory, signal theory, and legitimacy theory. (shrink)

Inhibition involves the withholding or suppressing of attention or responses to irrelevant or distracting stimuli. We examined the relationship between five experimental tasks of inhibition, represented by two measures of executive, intentional control inhibition and three measures of motivational inhibition characterized by bottom-up interruption of affective and reward/punishment sensitive mechanisms. Associations between these experimental tasks with three self-report measures related to inhibition were also examined. Correlational analyses indicated a small but significant association between the measures in the executive domain , (...) but a lack of associations between the measures in the motivational domain . Both measures of executive and motivational inhibition entered as significant predictors on the self-report measures related to inhibition in simultaneous regression analyses, but not consistently in the expected direction. The results suggest that inhibition is not a unitary construct, and demonstrate an association between experimental measures of inhibition and self-report measures related to inhibition. (shrink)

The OECD Guidelines for Multinational Enterprises have become increasingly relevant in the debate on the role of business in society. This instrument for responsible business conduct (RBC) is considered to be unique due to its implementation mechanism, the National Contact Point (NCP) procedure. The NCP procedure applies a pragmatic stakeholder engagement approach to contribute to the effectiveness of the OECD Guidelines. However, little is known about the effects of the NCP procedure. To fill this gap, this study provides insights into (...) the ex‐post effects of the Dutch NCP procedure on solving non‐compliance issues, the RBC performance of MNEs, and societal impact. This study developed a framework of different layers of effects. It used this framework to gather and analyze empirical data through interviews with parties that have participated in non‐compliance procedures. The effects found are mainly related to solving issues, while the effects on RBC within MNEs and their societal impact seem limited. Based on the findings, this study concludes that the full potential of the OECD Guidelines remains unrealized in most of the investigated cases. (shrink)

Well characterized databases used for experimental purposes with extensive meta-data are essential for conducting meaningful and comparable studies. The Food-pics_extended database is one example for a widely used food stimulus database. Indeed, meta-data on low level and high level image characteristics is broad, yet fiber ratings are not included, limiting its use in diet-related studies. Therefore, we developed fiber ratings per item, based on mean values of four non-expert raters. Ratings show good reliability and meaningful ranges per food type. What does it mean to wonder in awe or terror about the world? How do you philosophically understand Judaism? In How to Measure a World?: A Philosophy of Judaism, Martin Shuster provides answers to these questions and more. Emmanuel Levinas suggested that Judaism is best understood as an anachronism. Shuster attempts to make sense of this claim by alternatively considering questions of the inscrutability of ultimate reality, of the pain and commonness of human suffering, and of the ways (...) in which Judaism is entangled with the world. Drawing on phenomenology and Jewish thought, Shuster offers novel readings of some of the classic figures of Jewish philosophy while inserting other voices into the tradition, from Moses Maimonides to Theodor W. Adorno to Walter Benjamin to Stanley Cavell. How to Measure a World? examines elements of the Jewish philosophical record to get at the full intellectual scope and range of Levinas's proposal. Shuster's view of anachronism thereby provokes an assessment of the world and our place in it. A particular understanding of Jewish philosophy emerges, not only through the traditions it encompasses, but also through an understanding of the relationship between humans and their world. Amidst the misinformation climate about trans people and their health care that dominates policy and social discourse, autonomy‐based rationales for gender‐affirming care for trans and nonbinary youth are being called into question. In this commentary, which responds to “What Is the Aim of Pediatric ‘Gender‐Affirming’ Care?,” by Moti Gorin, we contextualize the virulent ideas circulating in misinformation campaigns that have become weaponized for unprecedented legal interference into standard health care. We conclude that the current legal justifications for upending gender‐affirming care (...) gloss over how this health care field meets conventional evidentiary standards and aligns protocols with most other fields of medicine. Refusal to offer gender‐affirming care is more harmful than centralizing trans and nonbinary people's health autonomy. (shrink)

What do biologists want? If, unlike their counterparts in physics, biologists are generally wary of a grand, overarching theory, at what kinds of explanation do biologists aim? A history of the diverse and changing nature of biological explanation in a particularly charged field, "Making Sense of Life" draws our attention to the temporal, disciplinary, and cultural components of what biologists mean, and what they understand, when they propose to explain life.

Ever since Kant and Hegel, the notion of autonomy—the idea that we are beholden to no law except one we impose upon ourselves—has been considered the truest philosophical expression of human freedom. But could our commitment to autonomy, as Theodor Adorno asked, be related to the extreme evils that we have witnessed in modernity? In Autonomy after Auschwitz, Martin Shuster explores this difficult question with astonishing theoretical acumen, examining the precise ways autonomy can lead us down a path of (...) evil and how it might be prevented from doing so. Shuster uncovers dangers in the notion of autonomy as it was originally conceived by Kant. A health justice approach requires a progressive critique of expertise. This article considers two recent high-profile cases – the mask mandate and medication abortion -- to understand how we should think the mobilization of expertise in the context of public health law. Following from this, the article offers news ways to better understand how to think of the relationship between health law, expertise, and politics.

Muslim women and Muslim members of the Lesbian, Gay, Bisexual, and Transgender (LGBT) community face a specific form of dual subordination in relation to their gender and sexuality. A Muslim woman might seek solace from India's patriarchal religious judicial structures only to find that the secular system's patriarchal structures likewise aid in their subordination and create a space for new forms of such subordination. Similarly, a marginalized LGBT Muslim might attempt to reject an oppressive religious formulation only to come to (...) find that the secular Indian state might criminalize a particular form of sexuality. This analysis explores how Indian laws "give meaning" to sexuality through the legal structures manifested by state and religious regulatory bodies and argues that both religious and state legal institutions need to be reformed to create a legal environment that furthers rather than inhibits a full realization of sexual rights. Shifting laws and regulations increasingly displace the centrality of women's health concerns in the provision of abortion services. This is exemplified by the growing presence of deceptive Crisis Pregnancy Centers alongside new informed consent laws designed to dissuade women from seeking abortions. Litigation on informed consent is further complicated in the clinical context due to the increased mobilization of facts – such as the gestational age or sonogram of the fetus – delivered with the intent to dissuade women from accessing (...) abortion. In other words, factual information utilized for ideological purpose. To preserve a woman's autonomy and decision-making capacity, there must be a concerted effort on the part of legislators and courts to place a woman's health at the center of abortion law and policy. In _Beyond Prejudice_, Evelyn B. Pluhar defends the view that any sentient conative being—one capable of caring about what happens to him or herself—is morally significant, a view that supports the moral status and rights of many nonhuman animals. Confronting traditional and contemporary philosophical arguments, she offers in clear and accessible fashion a thorough examination of theories of moral significance while decisively demonstrating the flaws in the arguments of those who would avoid attributing moral rights to nonhumans. Exposing the traditional (...) view—which restricts the moral realm to autonomous, fully fledged "persons"—as having horrific implications for the treatment of many humans, Pluhar goes on to argue positively that sentient individuals of any species are no less morally significant than the most automomous human. Her position provides the ultimate justification that is missing from previous defenses of the moral status of nonhuman animals. In the process of advancing her position, Pluhar discusses the implications of determining moral significance for children and "abnormal" humans as well as its relevance to population policies, the raising of animals for food or product testing, decisions on hunting and euthanasia, and the treatment of companion animals. In addition, the author scrutinizes recent assertions by environmental ethicists that all living things or that natural objects and ecosystems be considered highly morally significant. This powerful book of moral theory challenges all defenders of the moral status quo—which decrees that animals decidedly do not count—to reevaluate their convictions. (shrink)

Assistive technology has great potential to contribute to health, functioning, and quality of life. To date, as exemplified in the Canadian context, variations and inequities in access to assistive technology are evident; the development of legislation, policies, and programs has not kept up with the increasing use of assistive technology. In this article, we apply ;Daniels’s (2008) theory of just health to argue that equitable access to assistive technology funding and services is necessary for justice.
