Dennis Porter argues in Rousseau's Legacy that this cultural idea of the writer - as distinct from the more traditional "man of letters" - first emerged in France in the decades preceding the French revolution, and has continued to exercise a nominative power over intellectual life well into our own day. In Porter's paradigm, Jean-Jacques Rousseau serves as a seminal figure who combined radical critique of existing institutions with a new form of confessional writing and a suspicion of the (...) art of literature. At a time when a "return to Sartre" is being heralded in France and elsewhere in preparation for the celebration of the centennial of his birth, it seems appropriate to ponder the nature and tenor of this renewal. To which aspects of Sartre's work are we returning as the centennial approaches, and are we doing so with fresh eyes or with the same critical prejudices that have obscured our appreciation of this work in the past? If one looks for answers (...) to Bernard-Henri Lévy (aka BHL), the principal instigator of this current renewal, with specific regard to the genre that interests us in these pages—the theater—one is going to be sorely disappointed. For while Lévy considers Sartre "the first [writer]—the only [writer]—to know how to split himself equally well between being a theoretician and an accomplished storyteller," he lavishes this praise solely on the theory and practice of Sartre's novels: "The concept of engagement is not a political concept stressing the social duties of the writer; it is a philosophical concept highlighting the metaphysical powers of language. … Sartre … has never really written a novel with a [totalizing] thesis or message" (BHL 85, 86). Although never an easy feat, tracing the connections between sounds, spaces and objects becomes easier the higher up the social scale one goes in the Early Modern period. The survival of documentary and material evidence helps to identify musical repertories that were known to have been performed in specific spaces on particular instruments. Given the lack of comparative sources at lower social levels, is it possible to establish relationships between these three elements in non-courtly contexts? This chapter considers non-courtly ‘music-rooms’, (...) addressing how practical material and conceptual motivations forged links between music and domestic space in this period. In 2001, France became one of the few countries to require corporate social responsibility reporting through its Nouvelles Régulations Économiques #2001-420. However, initial compliance with the statute was low, a factor implying the law lacked normativity. In this exploratory study, we attempt to determine whether there is movement toward normativity by examining the change in CSR disclosure from 2004 in comparison to 2010 for a sample of 81 publicly traded French firms. We measure both the space and the quality of (...) CSR disclosures, including in the latter a measure based on informational quality attributes as discussed by the International Accounting Standards Board, the Financial Accounting Standards Board, and the Global Reporting Initiative. We find significant increases in the space allocated to CSR disclosure, as well as some evidence of increased quality; although the informational quality of the disclosures remains quite low and fewer firms are including negative performance information in their reports. Finally, we document that differences in disclosure space and quality in 2004 appeared to be associated with legitimacy-based variables and that those relations remain largely unchanged in 2010. As such, it appears that the NRE’s goals of increased transparency remain unmet. (shrink)

In the history of philosophy, Jacques Rohault and Pierre-Sylvain Régis bear a twofold burden. They are professed followers, epigones. Worse yet, the natural philosophy they teach has been consigned to the Tartarus of fable: not a theory that failed, but something that failed even to be a theory. In the years in which they were turning Cartesianism into a system, Newton and Huygens were preparing its demise. Its empirical claims were refuted, its mathematics was rendered obsolete by the calculus, its (...) vortices and channelled magnetic particles met with the same rough justice Descartes meted out to Scholastic forms and qualities. Canonical history has little use for such figures. It prefers originals. Yet if ideas and arguments are not to seem to pass magically from one great mind to the next, we must have some account of the channels through which what was once novel and unique sediments into cliché and common ground. Those channels are not without bias and noise. Inevitably, currents from different streams meet and mix more or less coherently in the works of secondary figures, especially in the competitive intellectual world of the later seventeenth century, with its sometimes ferocious polemics fuelled by religious and political opposition. Cartesianism became a movement and—to use Leibniz’s word—a sect, divided within by disputes over the legacy of its founder, and facing opposition without from steadfast Aristotelians, pious theologians, and the avant garde of the new science. In Régis and Rohault Descartes’ legacy took the outward form of “system”. They present themselves as reworking Cartesian concepts and arguments into something coherent and comprehensive. Rohault, the more modest of the two, aims to reform the teaching of physics, still weighed down by the dead hand of Aristotle. He retains for the old philosophy only what is true and conjoin it with the new physics of Descartes, in whom France is no less fortunate than Greece once was in Aristotle (Rohault 1718, “Præfatio”).. Rasmussen has produced an excellent account of “the greatest of all philosophical friendships” between two of the great thinkers of the underappreciated “Scottish Enlightenment”, Adam Smith, Chair of Moral Philosophy at the University of Glasgow, and, in his The Wealth of Nations, often seen as the founder of capitalism and creator of the modern science of economics, and David Hume, who never became an academic but who took “British Empiricism” to its logical sceptical conclusion and is often (...) seen as the most influential philosopher ever to write in the English language. -/- The book covers the span between Smith’s and Hume’s first meeting in 1749 until Smith’s eulogy upon Hume’s death in 1776. Kamm continues her development of a non-consequentialist ethical theory and its application to practical ethical problems. She looks at the distinction between killing and letting die, and between intending and foreseeing, and also at the concepts of rights, prerogatives, and supererogation. Since DNA has replaced blood as the medium through which we establish kinship, how do we determine with whom we are kin? Who counts among those we care for? The distinction between these categories is constantly in flux. How do we come to decide those we may kiss and those we may kill? Focusing on narratives of kinship as they are defined in contemporary film, literature, and news media, Frances Bartkowski discusses the impact of "stories of origin" on our (...) regard for nonhuman species. She locates the role of "totems and taboos" in forming and re-forming kinship categories-groupings that enable us to tie the personal to the social-and explores the bestiary, among the oldest of literary forms. The bestiary is the realm in which we allegorize the place of humans and other species, a menagerie encompassing animals we know as well as human-animal chimeras and other beings that challenge the "natural" order of the world. Yet advances in reproductive technologies, the mapping of genomes, and the study of primates continually destabilize these categories and recast the dynamic between the natural and the cultural. Bartkowski highlights the arbitrariness of traditional kinship arrangements and asks us to rethink our notions of empathy and ethics. She shows how current dialogues concerning ethics and desire determine contemporary attitudes toward issues of care, and suggests a new framework for negotiating connection and conflict. (shrink)

Morality, Mortality as a whole deals with certain aspects of ethical theory and with moral problems that arise primarily in contexts involving life‐and‐death decisions. The importance of the theoretical issues is not limited to their relevance to these decisions; however, they are, rather, issues at the heart of basic moral and political theory. This first volume comprises three parts. Part I, Death: From Bad to Worse, has with four chapters, and an appendix, discussing death and why it is bad for (...) the person who dies. Part II, Saving Lives: General Issues, has six chapters, and explores a cluster of moral problems that arise in saving lives. The general question raised is whether we should always, in aiding life, act so as to save the greater number of lives or to produce the greatest amount of good. Part III, Scarce Resources: Theoretical Issues, Specific Recommendations, and Organ Transplants, has five chapters, and deals with the problem of the acquisition and distribution of organs for transplantation. It allows us to apply the theoretical discussion of saving lives and relevant/irrelevant utilities presented in the previous parts. However, the discussion can be understood independently of the first two parts, and the conceptual issues and procedures on which it focuses are relevant to dealing with any scarce resource, including money and time, which are needed to use other plentiful resources. Although the book contains much theoretical and methodological argument, it is firmly grounded in practical ethical issues, and is illustrated throughout by examples. (shrink)

Adaptation to the impacts of climate change is a rapidly emerging, new area of knowledge and policy that is coevolving with political negotiations in the UN Framework Convention on Climate Change. As such, it offers the opportunity to study the coproduction of knowledge and social order within the climate change regime. A subset of adaptation knowledge relates to cost estimates of adaptation policy. Here the methodology of the adaptation cost studies are reviewed and compared to economic theory. Although presented as (...) technical and apolitical applications of economic theory, this analysis shows that these studies in fact differ significantly and consistently from theory in that they largely ignore autonomous adaptation and almost universally cost complete adaptation rather than an efficient level of adaptation. It is suggested that these differences are related to the political nature of adaptation cost estimates, which are closely connected with normative claims for both adaptation funding for developing countries and compensation for the unavoidable climate change impacts. As such, adaptation cost estimates are an example of boundary objects, used to manage normative and highly politicized claims for restitution using scientific and therefore apolitical language and framings. This essay discusses criminal law theories in late Imperial Russia. It argues that, although the political climate of Reform and Counter Reform effectively undermined attempts to implement new legislation premised on the idea of the 'rights-enabled person', paradoxically, it fostered the growth of juridical scholarship. Russian criminal law theorists engaged critically with Western juridical science, which, beginning in the 1870s, witnessed a shift away from absolutist theories inspired by the classics of philosophical idealism towards various strains of positivism arguing for (...) the restoration of the person as a concrete, physiological being. However, while Russian scholars were drawn to these new trends of criminal anthropology and the sociology of crime, they were also obliged to take stock of an indigenous legal culture that scarcely differentiated between pravo and zakon, together with a long tradition of customary practices that equated crime and punishment with sin and redemption. The idea that similar selective processes operate in gene-based evolution, immunology, and operant psychology provides an intuitively appealing metaphor. This idea also isolates questions that operant psychologists should ask and makes some empirical predictions. However, the idea currently lacks the detail needed to precisely separate it from some plausible alternatives. This sort of thinking is the kind that operant psychologists should do if operant theorizing is to survive the competition among ideas.
