Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. The republican case for workplace democracy is presented and defended from two alternative means of ensuring freedom from arbitrary interference in the firm—namely, the right to freely exit the firm and workplace regulation. This paper shows, respectively, that costless exit is neither possible nor desirable in either perfect or imperfect labor markets, and that managerial discretion is both desirable and inevitable due to the incompleteness of employment contracts and labor legislation. The paper then shows that WD is necessary, from a (...) republican standpoint, if workers’ interests are to be adequately tracked in the exercise of managerial authority. Three important objections are finally addressed— that WD is redundant, that it is unnecessary provided that litigation and unionism can produce similar outcomes, and that it falls short of ensuring republican freedom compared to self-employment. Despite growing interest in workplace democracy, the question whether nonworker stakeholders, like suppliers and local communities, warrant inclusion in the governance of democratic companies, as workers do, has been largely neglected. We inspect this question by leaning on the boundary problem in democratic theory. We first argue that the question of who warrants inclusion in democratic workplaces is best addressed by examining why workplace democracy is warranted in the first place, and offer a twofold normative benchmark—addressing objectionable corporate power and (...) upholding efficiency—to assess the principles of democratic inclusion on offer. Against this benchmark, we next argue that the All-Affected Principle is unfit due to its over- and underinclusive extensional results, and that the All-Subjected Principle, whose variants we examine alongside their extensional results, holds more promise when coupled with independent considerations of justice or a constrained variant of the All-Affected Principle. These combinations need not entirely preclude, but speak against, nonworker stakeholder inclusion. (shrink)

Higher‐order evidence can make an agent doubt the reliability of her reasoning. When this happens, it seems rational for the agent to adopt a cautious attitude towards her original conclusion, even in cases where the higher‐order evidence is misleading and the agent's original reasons were actually perfectly good. One may think that recoiling to a cautious attitude in the face of misleading self‐doubt involves a failure to properly respond to one's reasons. My aim is to show that this is not (...) so. My proposal is that (misleading) higher‐order evidence can undermine the agent's possession of her first‐order reasons, constituting what I call a dispossessing defeater. After acquiring the higher‐order evidence, the agent is no longer in a position to rely competently on the relevant first‐order considerations as reasons for her original conclusion, so that such reasons stop being available to her (even if they remain as strong as in the absence of the higher‐order evidence). In this way, an agent with misleading higher‐order evidence can adopt a cautious stance towards her original conclusion, while properly responding to the set of reasons that she possesses–a set that is reduced due to the acquisition of higher‐order dispossessing defeaters. Geometric statements are expressions of natural language with descriptive meaning, since they refer to things such as triangles, and to their characteristics. It is shown, following statements by authors such as Carnap (Philosophical foundations of physics) that geometric meanings are not factual, but mathematical, so that it is not geometric theories that apply, but geometrically interpreted factual theories. Under the Euclidean paradigm, the object of study of geometry was space, but the theoretical pluralism that replaced it resulted in the creation (...) in the discipline of a new plural ontology according to which there are different spaces: Euclidean, hyperbolic and elliptic. Thus, geometrical knowledge no longer seems to be a knowledge of the universal (of universal characteristics of space), but of the particular: of individual spaces. If geometrical theories are mathematical, these questions constitute obstacles both to the thesis that mathematical knowledge is universal, and to the thesis that it is universally applicable. Perhaps the hottest topic in the philosophy of chemistry is that of the relationship between chemistry and physics. The problem finds one of its main manifestations in the debate about the nature of molecular structure, given by the spatial arrangement of the nuclei in a molecule. The traditional strategy to address the problem is to consider chemical cases that challenge the definition of molecular structure in quantum–mechanical terms. Instead of taking that top-down strategy, in this paper we face the problem (...) of the reduction of molecular structure to quantum mechanics from a bottom-up perspective: our aim is to show how the theoretical peculiarities of quantum mechanics stand against the possibility of molecular structure, defined in terms of the spatial relations of the nuclei conceived as individual localized objects. We will argue that, according to the theory, quantum “particles” are not individuals that can be identified as different from others and that can be reidentified through time; therefore, they do not have the ontological stability necessary to maintain the relations that can lead to a spatially definite system with an identifiable shape. On the other hand, although quantum chemists use the resources supplied by quantum mechanics with successful results, this does no mean reduction: their “approximations” add certain assumptions that are not justified in the context of quantum mechanics or are even inconsistent with the very formal structure of the theory. In times of climate change and public debt, a concern for intergenerational justice should lead us to have a closer look at theories of intergenerational justice. It should also press us to provide institutional design proposals to change the decision-making world that surrounds us. This book provides an exhaustive overview of the most important institutional proposals as well as a systematic and theoretical discussion of their respective features and advantages. It focuses on institutional proposals aimed at taking the interests of (...) future generations more seriously, and does so from the perspective of applied political philosophy, being explicit about the underlying normative choices and the latest developments in the social sciences. It provides citizens, activists, firms, charities, public authorities, policy-analysts, students, and academics with the body of knowledge necessary to understand what our institutional options are and what they entail if we are concerned about today's excessive short-termism. Our goal in this paper is to articulate a precise concept of at least a certain kind of disease-mongering, showing how pharmaceutical marketing can commercially exploit certain diseases when their best definition is given through the success of a treatment in a clinical trial. We distinguish two types of disease-mongering according to the way they exploit the definition of the trial population for marketing purposes. We argue that behind these two forms of disease-mongering there are two well-known problems in the (...) statistical methodology of clinical trials (the reference class problem and the distinction between statistical and clinical significance). This paper examines the link between political liberties and social equality, and contends that the former are constitutive of, i.e. necessary to secure, the latter. Although this constitutive link is often assumed in the literature on political liberties, the reasons why it holds true remain largely unexplored. Three such reasons are examined here. First, political liberties are constitutive of social equality because they bestow political power on their holders, leaving disenfranchised individuals excluded from decisions that are particularly pervasive, coercively enforced, (...) hard to avoid, monopolistic, and final. Second, they are constitutive of social equality due to their positional value, such that those who are denied such liberties are socially downgraded because and to the extent that others enjoy them. Third, they are constitutive of social equality due to their expressive value, in the sense that, by disenfranchising some individuals, the state publicly fails to recognize their equal moral agency. While unpacking these reasons, we address some criticisms of this constitutive link recently raised by Steven Wall and Jason Brennan. (shrink)

La primera sostiene que las divisiones del conocimiento científico expresan o reflejan divisiones estructurales de la realidad a la que se refieren, en tanto que la segunda considera que toda división o estructura atribuida por la ciencia a la realidad se encuentra sólo en las representaciones mismas. In this paper, I defend a non-mechanistic interpretation of Kant's philosophy of nature. My interpretation contradicts the robust tradition of reading Kant as a mechanist about nature – or as someone who endorses the view that we can know the internally purposive causality characteristic of organisms has no place in nature. By attending closely to Kant's remarks about the possibility of internal purposiveness in nature and to key premises from Kant's arguments in the Antinomy of Teleological Judgment, we shall see (...) that it is not only plausible, but preferable, to believe that internally purposive things (i.e., organisms) exist in nature. Making room for such a belief leaves Kant with a philosophy of nature that simultaneously aligns with and surpasses the philosophies of nature offered up by his Early Modern predecessors. (shrink)

Workplace democracy is often defined, and has recently been defended, as a form of intra-firm governance in which workers have control rights over management with no ownership requirement on their part. Using the normative tools of republican political theory, the paper examines bargaining power disparities and moral hazard problems resulting from the allocation of control rights and ownership to different groups within democratic firms, with a particular reference to the European codetermination system. With various qualifications related to potentially mitigating factors, (...) such as workforce and shareholder composition or risk aversion and reallocation, the paper contends that forms of workplace democracy in which workers control and own the firm, such as cooperativism, are preferable to other forms, such as codetermination, in which ownership and control rights are formally separated. This book develops a philosophico-methodological analysis of prediction and its role in economics. Prediction plays a key role in economics in various ways. It can be seen as a basic science, as an applied science, and in the application of this science. First, it is used by economic theory in order to test the available knowledge. In this regard, prediction has been presented as the scientific test for economics as a science. Second, prediction provides a content regarding the possible future (...) that can be used for prescription in applied economics. Thus, it can be used as a guide for economic policy, id est, as knowledge concerning the future to be employed for the resolution of specific problems. Third, prediction also has a role in the application of this science in the public arena. This is through the decision-making of the agents - individuals or organizations - in quite different settings, both in the realm of microeconomics and macroeconomics. Within this context, the research is organized in five parts, which discuss relevant aspects of the role of prediction in economics: I) The problem of prediction as a test for a science; II) The general orientation in methodology of science and the problem of prediction as a scientific test; III) The methodological framework of social sciences and economics: Incidence for prediction as a test; IV) Epistemology and methodology of economic prediction: Rationality and empirical approaches; and V) Methodological aspects of economic prediction: From description to prescription. Thus, the book is of interest for philosophers and economists as well as policy-makers seeking to ascertain the roots of their performance. The style used lends itself to a wide audience.. (shrink)

I reconstruct 20th-century Mexican philosopher José Vasconcelos’s answers to two important aesthetic-political questions: (1) Can aesthetic judgments bind community? and (2) Can aesthetic judgments drive political, social, and cultural change? My objectives are twofold: one, to show that Vasconcelos’s responses make original contributions to an important aesthetic-political tradition that begins with Kant, and two, to offer key ideas from Vasconcelos’s aesthetics to a wider audience, as an invitation to engage with his work in their research and teaching. In section I, (...) I argue that Kant’s remarks suggest that aesthetic judgments bind the community. In section II, I explain that Kant sometimes appears to suggest that aesthetic judgments promote political, social, and cultural change. Section III discusses two bridge figures—Schiller and Arendt—that help us better understand how Kantian aesthetics binds community and serves political purposes. In section IV, I argue that Vasconcelos aligns with the Kantian tradition exemplified by Schiller and Arendt when developing a plan for aesthetically-guided social and political progress. I also show that, during his time in various positions of power in the Mexican government, Vasconcelos brought ideas from the Kantian tradition to life. I conclude by reflecting on how Vasconcelos reveals new possibilities for the Kantian tradition. (shrink)

This paper aims to contribute to the existing literature on normative cognition by providing a lineage explanation of human social norm psychology. This approach builds upon theories of goal-directed behavioral control in the reinforcement learning and control literature, arguing that this form of control defines an important class of intentional normative mental states that are instrumental in nature. I defend the view that great ape capacities for instrumental reasoning and our capacity (or family of capacities) for shared intentionality coadapted to (...) each other and argue that the evolution of this capacity has allowed the representation of social norms and the emergence of our capacity for normative guidance. En segundo lugar, se aborda el papel que debería jugar, según Aranguren, una verdadera izquierda política en toda democracia y, a partir del concepto clave de heterodoxia –en este caso en cuanto des-identificación–, se abre una reflexión acerca del propio ser de la izquierda y de (...) las llamadas políticas de la identidad. The marketplace has seen significant growth in the demand for ‘ethical’ behavior, and banks are seeking to leverage customers’ perception in order to build a sustainable competitive advantage. In consequence, the concepts of corporate social responsibility and corporate reputation are of vital concern for academics and managers in terms of their potential impact on customers. This study seeks to contribute to the literature by examining the mediating role of corporate reputation on the relationship between perceived corporate social responsibility and customer (...) loyalty. The study also takes into consideration the role played by bank type in the mediation effect. To achieve this aim, a study was performed comprising 572 personal surveys in the Basque Country. The results showed that corporate reputation partially mediated the relation between corporate social responsibility and customer loyalty. On the other hand, bank type is shown not to moderate the mediation effect. The results have important implications for practitioners wishing to manage their relations with customers. (shrink)

Typically, existentialist analyses of “America” have been limited to North America (more specifically, the United States). I argue that developing an adequate framework for existentially analyzing America requires a turn to Mexican existentialism. In Emilio Uranga’s and Jorge Portilla’s writings, we discover new conceptual tools for understanding Americanness as such. These thinkers help us imagine an account of American being that does not restrict itself to the United States by using the concepts of existentialism to describe the crises their neighbors (...) to the north as well as they themselves face. American existence has been historically characterized by a convergence (oftentimes clash) of disparate races, ethnicities, languages, cultures, religions, and identities. As history unfolded, this convergence led to various existential crises across the Americas. Whereas the US American way of life is marred by a blustering, naïve, and purposeless misuse of freedom that disregards the other, the existential crisis the Mexican lives is characterized by “accidentality” and “zozobra.” Despite these important differences, all existentialists, and the Mexican existentialists of the Hyperion Group especially, remind us that there is a common way to overcome the various existential crises plaguing the Americas, and that is to exercise freedom in a purposeful, communally conscious manner. In this article, I argue that, contrary to scholarly consensus, Antonio Caso draws inspiration from important principles and ideas from Kant’s philosophy in his critique of positivism. I first examine the prima facie textual reasons why someone might believe that Caso and Kant are philosophical enemies. To contradict this notion, I proceed by noting and developing three core ideas that the two share in common. First, Caso and Kant are both ardent critics of dogmatic philosophizing. Second, both Caso and Kant (...) carve out special room for intuition in their respective accounts of cognition, resisting the idea that the understanding has a more prominent role in the formation of knowledge. Third, Kant’s doctrine of aesthetic judgment paves the way for Caso’s de-intellectualized aesthetics. In the end, we see that Kant and Caso are closer to being philosophical friends than enemies. Several objections against the morality of researching or employing mitochondrial replacement techniques have been advanced recently. In this paper, I examine three of these objections and show that they are found wanting. First I examine whether mitochondrial replacement techniques, research and clinical practice, should not be carried out because of possible harms to egg donors. Next I assess whether mitochondrial replacement techniques should be banned because they could affect the study of genealogical ancestry. Finally, I examine the claim that mitochondrial (...) replacement techniques are not transferring mitochondrial DNA but nuclear DNA, and that this should be prohibited on ethical grounds. (shrink)

Self-employment merits protection and promotion, we often hear, because it confers independence from a boss. But what, if anything, is wrong with having a boss? On one of the two views that this chapter inspects, being under the power of a boss is objectionable as such, no matter how suitably checked this power may be, for it undermines workers’ agency. On a second view, which republican theorists favor, what is objectionable is subjection not to the power of a boss as (...) such but to their arbitrary power. The first view is unconvincing, I argue, as it entails (implausibly) that being under the power of others in realms like the family or the state is likewise objectionable as such. And although the second view yields compelling reasons for self-employment, it only does so when employers’ power is not suitably checked. When it is, such reasons are more easily outweighed by competing considerations, like those stemming from the further forms of dependence—on suppliers and purchasers—that self-employment may prompt. Are norms of inquiry in tension with epistemic norms? I provide a (largely) negative answer, turning to a picture of epistemic practices as rule-governed games. The idea is that, while epistemic norms are correctness standards for the attitudes involved in epistemic games, norms of inquiry derive from the aims of those games. Attitudes that, despite being epistemically correct, are inadvisable regarding the goals of some inquiry are just like bad (but legal) moves in basketball or chess. I further consider cases (...) in which the aims of inquiry recommend breaking epistemic norms. I compare them to strategic infractions, which are common in many coherent games. Finally, I explore the connections between rules and aims in games and in inquiry. I show that in both cases respecting the rules is constitutively required for satisfying the aims of the practice. Although during the last decades the philosophy of chemistry has greatly extended its thematic scope, the main difficulties appear in the attempt to link the chemical description of atoms and molecules and the description supplied by quantum mechanics. The aim of this paper is to analyze how the difficulties that threaten the continuous conceptual link between molecular chemistry and quantum mechanics can be overcome or, at least, moderated from the perspective of BM. With this purpose, in “The quantum-mechanical challenges” section (...) the foundational incompatibility between chemical and SQM descriptions will be briefly recalled. “Bohmian mechanics” section will be devoted to explain the main features of BM. In “Empirical equivalence and underdetermination” section, the consequences of the empirical equivalence between SQM and BM will be discussed. Finally, in the Conclusion, we will stress the scope of the obtained conclusions and the philosophical difficulties that still remain even after adopting BM for foundational purposes. (shrink)

Despite renewed interest in work, philosophers have largely ignored self-employment. This neglect is surprising, not just because self-employment was central to classic philosophizing about work, but also given that half of the global workforce today, including one in seven workers in OECD countries, are self-employed. We start off by offering a definition of self-employment, one that accounts for its various forms while avoiding misclassifying dependent self-employed workers as independent contractors, and by mapping the barriers to becoming and remaining self-employed (section (...) 2). We then examine five arguments why governments ought to promote self-employment, despite the forgone opportunities to promote employee work instead that this often entails (sections 3-7): the argument from job creation, the argument from job satisfaction, the argument from independence, the argument from occupational freedom, and the argument from subsistence under non-ideal circumstances. Some of these are unconvincing, we argue, but others are not. Although the strength of the latter arguments hangs on various context-dependent conditions, such that they need to be carefully weighed against considerations of efficiency and equality, they nonetheless offer compelling pro tanto reasons to promote, and not just to protect, self-employment. Representing unborn generations to more suitably include future interests in today's climate policymaking has sparked much interest in recent years. In this review we survey the main proposed instruments to achieve this effect, some of which have been attempted in polities such as Israel, Philippines, Wales, Finland, and Chile. We first review recent normative work on the idea of representing future people in climate governance: The grounds on which it has been advocated, and the main difficulties that traditional forms of (...) representation have encountered when applied to this particular case. We then survey existing institutional means to represent generations to come. We separate out representation in courts, in parliament, and by independent bodies, and review specific instruments including climate litigation, parliamentary commissions, future representatives, youth quotas, and independent offices for future generations. We examine the particular forms whereby each of these may suitably represent future people, including audience representation, surrogate representation, and indicative representation, and discuss the main challenges they encounter in so doing. Certain dialogism is generally recognized in the founding moments of Western philosophy, and it is possible to see various forms of intertextuality in our philosophical tradition. In spite of certain monological temptations, philosophy is not a self-demonstrative system; it has woven its texts quoting other discursive voices and through the invocation of borrowed words. This article aims to outline a discontinuous overview of quotation rhetorical functions at different moments of Western philosophy. The philosophical quote has contributed to discursive authorization or (...) to provide shared discursive repertoires, but also to invocate other intertextual voices discursive or integrate other texts in the meta-discourse of the philosopher. Nowadays the disciplinary regulation of citation practices and the bibliometric economy of impact indices threaten that dialogic and intertextual legacy. (shrink)

The study of Plato's dialogues has traditionally oscillated between two paradigms: one that portrays the dialogues as treatises expounding doctrines and one that sees them as purely skeptical, rhetorical, or literary. This collection of new essays by twelve noted Plato scholars illustrates the fruitfulness of breaking away from those paradigms, which have divided Platonic scholarship and led it to a number of dead ends. While the essays are diverse in their approaches, each seeks to find a 'third way' to understand (...) Plato, reading him as neither a dogmatist nor a skeptic but as a philosopher capable of reconciling the content and form of his writings. (shrink)

Selected-effects theories provide the most popular account of biological teleology. According to these theories, the purpose of a trait is to do whatever it was selected for. The vast majority of selected-effects theories consider biological teleology to be introduced by natural selection. We want to argue, however, that natural selection is not the only relevant selective process in biology. In particular, our proposal is that biological regulation is a form of biological selection. So, those who accept selected-effects theories should recognize (...) biological regulation as a distinctive source of biological teleology. The purposes derived from biological regulation are of special interest for explaining and predicting the behavior of organisms, given that regulatory mechanisms directly modulate the behavior of the systems they regulate. This explanatory power, added to the fact that regulation is widespread in the biological world, makes the idea that regulation gives rise to its own form of teleology a substantial contribution to the debate on biological teleology. [Recipient of the 2024 Inter-American Philosophy Award] Philosophers have recently debated whether the social identity category "Latinx" picks out a race (Alcoff 2006), an ethnicity (Gracia 2008), or something else altogether (Arango and Burgos 2021). Rather than defending one or several of these ways of understanding US Latinx as a political or social group, my paper focuses on the personal social identity turmoil young US Latinx people feel and explores the history of inter-American thought to seek a remedy for it. (...) Three prominent American philosophers – José Martí, Alain Locke, and Emilio Uranga – combine to teach us that, while the US Latinx strives for belonging, they find themselves in a situation of unbelonging. The tension that results from the desire to belong but the reality of unbelonging produces a deep-seated anxiety that has come to characterize the US Latinx condition. I suggest that an effective tool for coping with this anxiety, affirming our identity, and building community is the activity of doing inter-American, Latin American, and Latinx Philosophy. (shrink)

AI systems are bringing an augmentation of human capabilities to shape the world. They may also drag a replacement of human conscience in large chunks of life. AI systems can be designed to leave moral control in human hands, to obstruct or diminish that moral control, or even to prevent it, replacing human morality with pre-packaged or developed ‘solutions’ by the ‘intelligent’ machine itself. Artificial Intelligent systems (AIS) are increasingly being used in multiple applications and receiving more attention from the (...) public and private organisations. The purpose of this article is to offer a mapping of the technological architectures that support AIS, under the specific focus of the moral agency. Through a literature research and reflection process, the following areas are covered: a brief introduction and review of the literature on the topic of moral agency; an analysis using the BDI logic model (Bratman 1987); an elemental review of artificial ‘reasoning’ architectures in AIS; the influence of the data input and the data quality; AI systems’ positioning in decision support and decision making scenarios; and finally, some conclusions are offered about regarding the potential loss of moral control by humans due to AIS. This article contributes to the field of Ethics and Artificial Intelligence by providing a discussion for developers and researchers to understand how and under what circumstances the ‘human subject’ may, totally or partially, lose moral control and ownership over AI technologies. The topic is relevant because AIS often are not single machines but complex networks of machines that feed information and decisions into each other and to human operators. The detailed traceability of input-process-output at each node of the network is essential for it to remain within the field of moral agency. Moral agency is then at the basis of our system of legal responsibility, and social approval is unlikely to be obtained for entrusting important functions to complex systems under which no moral agency can be identified. In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. First we make an approach to the concept of religion. We present a historical perspective of the concept. An atheistic religion is possible depending on the definition of religion we use. Although US and European research has documented improvement in earnings quality associated with corporate governance characteristics, the situation in Latin America is questionable, given the business environment in which firms operate, which is characterized by controlling family ownership and weak legal protection. The purpose of this study is to examine the relation between the internal mechanisms of Corporate Governance and Earnings Management measured by discretionary accrual. We use a sample of listed Latin American non-financial companies from the period 2006–2009. Our (...) results show how in the Latin American context the role of external directors is limited and that Boards which meet more frequently take a more active position in the monitoring of insiders, so showing a lower use of manipulative practices. In addition, we find a non-linear relation between insider ownership and discretionary accruals, also pointing to the fact that ownership concentration may be a manipulative practices constrictor mechanism only when the ownership of main shareholders is moderate. The findings have important policy implications since this is, to the best of our knowledge, the first study to analyze the relation between the effectiveness of the government and the earnings management behavior. As policy implications, we document how when a country implements controls aimed at reducing corruption, strengthening the rule of law or improving the effectiveness of government, this leads to a reduction in firm earnings management. The contemporary confluence of globalization and ethical pluralism is at the origin of many ethical challenges that confront business nowadays, both in practice and in theory. One of the challenges arising from the development of globalization has to do with respect for cultural diversity. It is often said that the success of economic globalization tends towards social and cultural homogeneity. To the extent that cultural diversity is usually seen as a valuable reality, that global trend seems to contradict our efforts (...) to respect ethical pluralism, both personal and cultural, within society. In this paper I argue that (a) ethical minimalism, despite its emphasis on tolerance and justice, does not take pluralism seriously into account in present-day society, and (b) ethical minimalism is not suited to balancing the homogenizing trend of globalization. Certainly ethical norms are necessary, but by no means are they sufficient in themselves to encourage either justice or tolerance; nor are they sufficient to inspire and encourage good practices and sound regulations. Instead, virtue-based ethics has the capacity of inspiring and encouraging good practices. Particularly, virtue-based ethics is able to inspire a serious dialogue about ethical and legal issues both in the public arena and within organizations. (shrink)

The paper makes a twofold contribution. Firstly, it advances a preliminary account of the conditions that need to obtain for constitutional rights to be democratic. Secondly, in so doing, it defends precommitment-based theories from a criticism raised by Jeremy Waldron—namely, that constitutional rights do not become any more democratic when they are democratically adopted, for the people could adopt undemocratic policies without such policies becoming democratic as a result. The paper shows that the reductio applies to political rights, yet not (...) to non-political rights, such as reproductive, environmental, or privacy rights. The democratic status of the former is process-independent. The latter, by contrast, are democratic precisely when they are adopted by democratic means. (shrink)

El Realismo Especulativo, Nuevo Realismo o Realismo Postcontinental es una corriente ecléctica que viene a superar las aporías e insuficiencias de la filosofía continental desde una perspectiva a la que se le podrían achacar los mismos problemas que la perspectiva idealista y constructivista de los filósofos continentales. Para el desarrollo de la filosofía es importante entablar conversación los autores de este movimiento. En el presente artículo se presenta una aproximación a los aciertos e insuficiencias de las ontologías de dos autores (...) de la corriente como son Markus Gabriel y Graham Harman. Se presentan los aciertos e insuficiencias del realismo neutro de Markus Gabriel y de la Ontología Orientada a los Objetos, en este orden. En el último epígrafe, a modo de conclusiones, se señalan los puntos en común de las ontologías y se aporta la idea de acontecimiento como línea de investigación que supere las aporías que emergen de la contraposición entre el idealismo y realismo.
