The focus of this article is to explain why there is still no qualified digital signature in Denmark as defined by the EU eSignatures Directive nor any other nationwide eID even though Denmark had an early start in eGovernment, and a high level of e-readiness compared to other nations. Laying out the technological, organizational and legal dimensions of eID in Denmark, and comparing these with a number of other European countries made it possible to explain this paradox. Thus, the three (...) main reasons for the special route development has taken in Denmark seems to be concerns over privacy, lack of intergovernmental coordination and lack of cooperation between public and private sector. However, with the recent tender on digital signatures won by the PBS and the roll-out of the NemID it seems that Denmark will finally—after twenty years of delay—have an eID which can be widely used in the public as well as the private sector. This paper discusses the Uniqueness Thesis, a core thesis in the epistemology of disagreement. After presenting uniqueness and clarifying relevant terms, a novel counterexample to the thesis will be introduced. This counterexample involves logical disagreement. Several objections to the counterexample are then considered, and it is argued that the best responses to the counterexample all undermine the initial motivation for uniqueness.

The aim of this paper is threefold. Firstly, §1 and §2 introduce the novel concept logical akrasia by analogy to epistemic akrasia. If successful, the initial sections will draw attention to an interesting akratic phenomenon which has not received much attention in the literature on akrasia (although it has been discussed by logicians in different terms). Secondly, §3 and §4 present a dilemma related to logical akrasia. From a case involving the consistency of Peano Arithmetic and Gödel’s Second Incompleteness Theorem (...) it’s shown that either we must be agnostic about the consistency of Peano Arithmetic or akratic in our arithmetical theorizing. If successful, these sections will underscore the pertinence and persistence of akrasia in arithmetic (by appeal to Gödel’s seminal work). Thirdly, §5 concludes by suggesting a way of translating the dilemma of arithmetical akrasia into a case of regular epistemic akrasia; and further how one might try to escape the dilemma when it’s framed this way. While the epistemic significance of disagreement has been a popular topic in epistemology for at least a decade, little attention has been paid to logical disagreement. This monograph is meant as a remedy. The text starts with an extensive literature review of the epistemology of (peer) disagreement and sets the stage for an epistemological study of logical disagreement. The guiding thread for the rest of the work is then three distinct readings of the ambiguous term ‘logical disagreement’. Chapters 1 and (...) 2 focus on the Ad Hoc Reading according to which logical disagreements occur when two subjects take incompatible doxastic attitudes toward a specific proposition in or about logic. Chapter 2 presents a new counterexample to the widely discussed Uniqueness Thesis. Chapters 3 and 4 focus on the Theory Choice Reading of ‘logical disagreement’. According to this interpretation, logical disagreements occur at the level of entire logical theories rather than individual entailment-claims. Chapter 4 concerns a key question from the philosophy of logic, viz., how we have epistemic justification for claims about logical consequence. In Chapters 5 and 6 we turn to the Akrasia Reading. On this reading, logical disagreements occur when there is a mismatch between the deductive strength of one’s background logic and the logical theory one prefers (officially). Chapter 6 introduces logical akrasia by analogy to epistemic akrasia and presents a novel dilemma. Chapter 7 revisits the epistemology of peer disagreement and argues that the epistemic significance of central principles from the literature are at best deflated in the context of logical disagreement. The chapter also develops a simple formal model of deep disagreement in Default Logic, relating this to our general discussion of logical disagreement. A key question in the philosophy of logic is how we have epistemic justification for claims about logical entailment (assuming we have such justification at all). Justification holism asserts that claims of logical entailment can only be justified in the context of an entire logical theory, e.g., classical, intuitionistic, paraconsistent, paracomplete etc. According to holism, claims of logical entailment cannot be atomistically justified as isolated statements, independently of theory choice. At present there is a developing interest in—and endorsement of—justification holism (...) due to the revival of an abductivist approach to the epistemology of logic. This paper presents an argument against holism by establishing a foundational entailment-sentence of deduction which is justified independently of theory choice and outside the context of a whole logical theory. Default logic has been a very active research topic in artificial intelligence since the early 1980s, but has not received as much attention in the philosophical literature thus far. This paper shows one way in which the technical tools of artificial intelligence can be applied in contemporary epistemology by modeling a paradigmatic case of deep disagreement using default logic. In §1 model-building viewed as a kind of philosophical progress is briefly motivated, while §2 introduces the case of deep disagreement we (...) aim to model. On the heels of this, §3 defines our formal framework, viz., a refined Horty-style default logic. §4 then uses the framework to model deep disagreement, and finally §5 provides a critical discussion of the result. This paper argues for the reasonableness of an inclusive conception of default reasoning. The inclusive conception allows untriggered default rules to influence beliefs: Since a default “from φ, infer ψ” is a defeasible inference rule, it by default warrants a belief in the material implication φ → ψ, even if φ is not believed. Such inferences are not allowed in standard default logic of the Reiter tradition, but are reasonable by analogy to the Deduction Theorem for classical logic. Our main (...) contribution is a formal framework for inclusive default reasoning. The framework has a solid philosophical foundation, it draws conclusions non-trivially different from non-inclusive frameworks, and it exhibits a host of benchmark properties deemed desirable in the literature—e.g., that extensions always exist and are consistent. The predictive processing literature contains at least two different versions of the framework with different theoretical resources at their disposal. One version appeals to so-called optimistic priors to explain agents’ motivation to act (call this optimistic predictive processing). A more recent version appeals to expected free energy minimization to explain how agents can decide between different action policies (call this preference predictive processing). The difference between the two versions has not been properly appreciated, and they are not sufficiently separated in (...) the literature. They constitute two different theories with strikingly different accounts of motivation and action. By reducing all desire-like constructs to belief-like constructs, optimistic predictive processing entails a substantial revision of standard accounts of motivation and action in philosophy and cognitive science. By contrast, preference predictive processing introduces desire-like constructs that play Humean motivational roles in the explanation of action. In this Humean iteration, predictive processing resembles other prominent computational frameworks implementing a distinction between beliefs and desires, such as reinforcement learning and Bayesian decision theory. Ultimately, predictive processing faces a dilemma between parsimony of mental constructs and completeness of its explanations of agency and the mind. (shrink)

John Bell showed that a big class of local hidden-variable models stands in conflict with quantum mechanics and experiment. Recently, there were suggestions that empirically adequate hidden-variable models might exist which presuppose a weaker notion of local causality. We will show that a Bell-type inequality can be derived also from these weaker assumptions.

Two different concepts of iconicity compete in Peirce's diagrammatical logic. One is articulated in his general reflections on the role of diagrams in thought, in what could be termed his diagrammatology — the other is articulated in his construction of Existential Graphs as an iconic system for representing logic. One is operational and defines iconicity in terms of which information may be derived from a given diagram or diagram system — the other has stronger demands on iconicity, adding to the (...) operational criterion a demand for as high a degree of similarity as possible and may be termed optimal iconicity. Peirce himself does not clearly distinguish these two iconicity notions, a fact that has caused some confusion. By isolating them, we get a clearer and more refined conceptual apparatus for analyzing iconic signs, from pictures to logic. (shrink)

Recent studies on mind‐wandering reveal its potential role in goal exploration and planning future actions. How to understand these explorative functions and their impact on planning remains unclear. Given certain conceptions of intentions and beliefs, the explorative functions of mind‐wandering could lead to regular reconsideration of one's intentions. However, this would be in tension with the stability of intentions central to rational planning agency. We analyze the potential issue of excessive reconsideration caused by mind‐wandering. In this chapter we explore the topic of logical disagreement. Though disagreement in general has attracted widespread philosophical interest, both in epistemology and philosophy of language, the general issues surrounding disagreement have only rarely been applied to logical disagreement in particular. Here, we develop some of the fascinating semantic and epistemological puzzles to which logical disagreement gives rise. In particular, after distinguishing between different types of logical disagreement, we explore some connections between logical disagreements and deep disagreements over fundamental epistemic (...) principles; we discuss several semantic puzzles that arise on various accounts of the meanings of logical terms; we investigate how such disagreements relate to Kripke’s so-called “Adoption Problem”; and we probe epistemological puzzles that arise from disagreements about logic in the light of central principles from the peer disagreement literature. In a recent paper, Jeanne Peijnenburg and David Atkinson [ Studia Logica, 89:333-341 ] have challenged the foundationalist rejection of infinitism by giving an example of an infinite, yet explicitly solvable regress of probabilistic justification. So far, however, there has been no criterion for the consistency of infinite probabilistic regresses, and in particular, foundationalists might still question the consistency of the solvable regress proposed by Peijnenburg and Atkinson.

This article sets out to research and resolve the conceptual lag between the family as defined and recognised in law and the multiplicity of queer constellations of ‘intimate citizenship’ in which families are actually done. The focus is on adult unions outside of conjugal coupledom. The family law practices, and awareness and expectations of adults in such unions were analysed through 21 interviews and the content analysis of 40 documents and were projected against the applicable legal mould. The article then (...) proposes to resolve the existing conceptual lag by advancing a conception of the family as a malleable, open-ended assemblage, in lieu of the current rigid status approach in family law, which is both under- and overinclusive. The proposed conception does justice to the increasing fluidity of family formations, which are not always already domestic, dyadic and sexual. (shrink)

In Critique of Judgment, Kant introduces a foundational theme in modern aesthetics by identifying the judgment of taste as a particular mode of attention. In distinction to the mode of attention in mundane experience that works by determining how an intuition can be subsumed under a concept, aesthetic attention celebrates the pleasure associated with the “unison in the play of the powers of the mind” confronted with “the manifold in a thing.” Aesthetic attention, in other words, is an aesthetic subject’s (...) attention to itself and to the pleasures derived from flexing the power of imagination. In this respect, Kant’s aesthetics reaffirms its cartesian core, the primordial positing of the thinking and reflective I as the necessary preposition for experience. This strict distribution of attention toward the secure epistemological architecture of object and subject seems to vacillate, however, in Kant’s brief discussion of artworks as purveyors of “aesthetic ideas.” This article discusses the de-limitation of attention instigated by the aesthetic idea. The aesthetic idea is associated with the artwork as an object, but it immediately transgresses the limits of the object through an array of analogical instantiations of “spirit.” On the other hand, aesthetic ideas are subjectively appreciated, but this appreciation similarly transgresses subjective cognition in an inexhaustible ramification of associative thinking. Developing these characteristics of the “aesthetic idea,” the article proposes to excavate from Critique of Judgment a mode of aesthetic sensibility that eventually challenges the Cartesian architecture of subject and object and thus reposits aesthetics in a field of relational interdependency. The overall aim of this article is to reorient the contemporary debate about epistemic consequentialism. Thus far the debate has to a large extent focused on whether standard theories of epistemic justification are consequentialist in nature and therefore vulnerable to certain trade-off cases where accepting a false or unjustified belief leads to good epistemic outcomes. We claim that these trade-offs raise an important—yet somewhat neglected—issue about the epistemic demands on inquiry. We first distinguish between two different kinds of epistemic evaluation, (...) viz., backing evaluation and outcome evaluation, and then go on to outline and discuss a consequentialist metatheory about the right combinations of decision procedures to adopt in inquiry. Note that the piece is exploratory in the following sense: we try to explore epistemic evaluation in consequentialist terms, which involves stating a form of epistemic consequentialism, but also pointing to what non-consequentialist alternatives might be. Rather than trying to argue decisively for a particular conclusion, we aim to outline various intricate issues in an underexplored area of theorizing. In the course of doing this, we’ll transpose some well-known themes from discussions of consequentialism in ethics to the current debate about consequentialism in epistemology, e.g., agent-neutrality, options, and side-constraints. We propose simple nonlinear mathematical models for the legal concept of balancing of interests. Our aim is to bridge the gap between an abstract formalisation of a balancing decision while assuring consistency and ultimately legal certainty across cases. We focus on the conflict between the rights to privacy and to the protection of personal data in Art. 7 and Art. 8 of the EU Charter of Fundamental Rights (EUCh) against the right of access to information derived from Art. 11 EUCh. These competing rights are denoted by ( \(i_1\) ) _right to privacy _ and ( \(i_2\) ) _access to information_; mathematically, their indices are respectively assigned by \(u_1\in [0,1]\) and \(u_2\in [0,1]\) subject to the constraint \(u_1+u_2=1\). This constraint allows us to use one single index _u_ to resolve the conflict through balancing. The outcome will be concluded by comparing the index _u_ with a prior given threshold \(u_0\). For simplicity, we assume that the balancing depends on only selected legal criteria such as the social status of affected person, and the sphere from which the information originated, which are represented as inputs of the models, called legal parameters. Additionally, we take “time” into consideration as a legal criterion, building on the European Court of Justice’s ruling on the right to be forgotten: by considering time as a legal parameter, we model how the outcome of the balancing changes over the passage of time. To catch the dependence of the outcome _u_ by these criteria as legal parameters, data were created by a fully-qualified lawyer. By comparison to other approaches based on machine learning, especially neural networks, this approach requires significantly less data. This might come at the price of higher abstraction and simplification, but also provides for higher transparency and explainability. Two mathematical models for _u_, a time-independent model and a time-dependent model, are proposed, that are fitted by using the data. (shrink)

Otfried Höffe is one of the foremost political philosophers in Europe today. In this major work, already a classic in continental Europe, he re-examines philosophical discourse on justice - from Classical Greece to the present day. Höffe confronts what he sees as the two major challenges to any theory of justice: the legal, positivist claim that there are no standards of justice external to legal systems; and the anarchist claim that justice demands the rejection and abolition of all legal and (...) state systems. Höffe sets out to continue the 'philosophical project of modernity', the legitimation of human rights, and their guarantee by the state, while at the same time rehabilitating the classical theory of political justice represented by Plato and Aristotle. He questions the success of the positivists in avoiding extra-legal normative claims, and casts doubt on the plausibility of their criticism of the Natural Law tradition. Most anarchists, he argues, rely on an uncritical assumption that social institutions other than states and legal orders do not coerce. In Höffe's view, some coercion is unavoidable, and the grounds for its justification must be examined. Principles of justice will be those principles which define fundamental rights, and which must be enforced if rights are to be respected. (shrink)

This book investigates a number of central problems in the philosophy of Charles Peirce grouped around the realism of his semiotics: the issue of how sign systems are developed and used in the investigation of reality. Thus, it deals with the precise character of Peirce's realism; with Peirce's special notion of propositions as signs which, at the same time, denote and describe the same object. It deals with diagrams as signs which depict more or less abstract states-of-affairs, facilitating reasoning about (...) them; with assertions as public claims about the truth of propositions. It deals with iconicity in logic, the issue of self-control in reasoning, dependences between phenomena in their realist descriptions. A number of chapters deal with applied semiotics: with biosemiotic sign use among pre-human organisms: the multimedia combination of pictorial and linguistic information in human semiotic genres like cartoons, posters, poetry, monuments. The rejection of an infinitesimal solution to the zero-fit problem by A. Elga ([2004]) does not seem to appreciate the opportunities provided by the use of internal finitely-additive probability measures. Indeed, internal laws of probability can be used to find a satisfactory infinitesimal answer to many zero-fit problems, not only to the one suggested by Elga, but also to the Markov chain (that is, discrete and memory-less) models of reality. Moreover, the generalization of likelihoods that Elga has in mind is (...) not as hopeless as it appears to be in his article. Immanuel Kant hat wie kein anderer Denker die Philosophie der Neuzeit geprägt. Aufgrund seiner überragenden Bedeutung liegen inzwischen auch schon mehrere Bände zu seinen Schriften in der Reihe Klassiker Auslegen vor. This paper gives a fIrst overview over the role of mereology the theory of parts and wholes - in semiotics. The mereology of four major semioticians - Husserl, Jakobson, Hjelmslev, and Peirce is presented briefly and its role in the overall architecture of each of their theories is outlined - with Brentano tradition as reference. Finally, an evaluation of the strength and weaknesses of the four is undertaken, and some guidelines for further research is proposed.

This paper aims to show that Selim Berker’s widely discussed prime number case is merely an instance of the well-known generality problem for process reliabilism and thus arguably not as interesting a case as one might have thought. Initially, Berker’s case is introduced and interpreted. Then the most recent response to the case from the literature is presented. Eventually, it is argued that Berker’s case is nothing but a straightforward consequence of the generality problem, i.e., the problematic aspect of the (...) case for process reliabilism (if any) is already captured by the generality problem. Artifacts are probably our most obvious everyday encounter with technology. Therefore, a good understanding of the nature of technical artifacts is a relevant part of technological literacy. In this article we draw from the philosophy of technology to develop a conceptualization of technical artifacts that can be used for educational purposes. Furthermore we report a small exploratory empirical study to see to what extent teachers’ intuitive ideas about artifacts match with the way philosophers write about the nature of artifacts. The problem of how to rationally aggregate probability measures occurs in particular when a group of agents, each holding probabilistic beliefs, needs to rationalise a collective decision on the basis of a single ‘aggregate belief system’ and when an individual whose belief system is compatible with several probability measures wishes to evaluate her options on the basis of a single aggregate prior via classical expected utility theory. We investigate this problem by first recalling some negative results from preference and judgment (...) aggregation theory which show that the aggregate of several probability measures should not be conceived as the probability measure induced by the aggregate of the corresponding expected utility preferences. We describe how McConway’s :410–414, 1981) theory of probabilistic opinion pooling can be generalised to cover the case of the aggregation of infinite profiles of finitely additive probability measures, too; we prove the existence of aggregation functionals satisfying responsiveness axioms à la McConway plus additional desiderata even for infinite electorates. On the basis of the theory of propositional-attitude aggregation, we argue that this is the most natural aggregation theory for probability measures. Our aggregation functionals for the case of infinite electorates are neither oligarchic nor integral-based and satisfy a weak anonymity condition. The delicate set-theoretic status of integral-based aggregation functionals for infinite electorates is discussed. (shrink)

This paper formally explores the common ground between mild versions of epistemological coherentism and infinitism; it proposes—and argues for—a hybrid, coherentist–infinitist account of epistemic justification. First, the epistemological regress argument and its relation to the classical taxonomy regarding epistemic justification—of foundationalism, infinitism and coherentism—is reviewed. We then recall recent results proving that an influential argument against infinite regresses of justification, which alleges their incoherence on account of probabilistic inconsistency, cannot be maintained. Furthermore, we prove that the Principle of Inferential Justification (...) has rather unwelcome consequences—formally resembling the Sorites paradox—as soon as it is iterated and combined with a natural Bayesian perspective on probabilistic inferences. We conclude that strong versions of foundationalism and infinitism should be abandoned. Positively, we provide a rough sketch for a graded formal coherence notion, according to which infinite regresses of epistemic justification will often have more than a minimal degree of coherence. This survey report is a follow-up to the survey done by the Center for Business Ethics in 1984/85 which was published in the Journal for Business Ethics under the title of 'Are Corporations Institutionalizing Ethics?' (Volume 5, 1986, pp. 85-91). This 1989/90 survey was again sent to Fortune 1000 industrial and service companies to find out what they have done to build ethical values into their organizations. It reveals some interesting comparisons with the 1984/85 survey with regard to expanding efforts, (...) objectives, progress, and methods of implementation, along with some new information on their perception of public pressure for ethics programs and the need for ethics education. The survey shows where some progress in building ethics into corporations seems to be occurring and where much more work needs to be done. (shrink)

Following Lauwers and Van Liedekerke (1995), this paper explores in a model-theoretic framework the relation between Arrovian aggregation rules and ultraproducts, in order to investigate a source of impossibility results for the case of an infinite number of individuals and an aggregation rule based on a free ultrafilter of decisive coalitions.

In the current world of education, politics and public opinion, musical experience is increasingly threatened. It is designated ever more as an expendable luxury. This kind of general trend has hardly left the thinking in the field of music and music education untouched. Inspiration comes from the technical rationality of our time. This rationality affects an oblivion of ontology. In this article we discuss this trend related to Martin Heidegger’s thinking concerning the human existence in the world, artworks and notions (...) like “being” (Sein) and “oblivion-of-being” (Seinsvergessenheit). We think that it is possible to see this “oblivion-of-being” in relation to the trend in cultural and educational politics as well as in music educational thinking to focus on the instrumental usefulness of learning music. Zu einer der vordringlichsten, von der Philosophie aber häufig vernachlässigten Aufgaben der Politik stellt sie bis heute den wichtigsten klassischen Text dar. Kant entfaltet in ihm die philosophischen Grundlagen für eine internationale Rechts- und Friedensgemeinschaft. Gleichzeitig stellt er sich aber auch die Frage nach einer Vermittlung von normativer Theorie und politischer Praxis. In 12 Beiträgen wird Kants Text in diesem Band "entschlüsselt" interpretiert, auf seine systematische Überzeugungskraft und auf seine politische Tragweite (...) hin untersucht und in seinen und unseren sozialgeschichtlichen Kontext gestellt. This article establishes the existence of a definable , countably saturated nonstandard enlargement of the superstructure over the reals. This nonstandard universe is obtained as the union of an inductive chain of bounded ultrapowers . The underlying ultrafilter is the one constructed by Kanovei and Shelah [10].
