This paper examines how inner theories influence lexical choice. Subjects in one study completed auditorily presented sentence fragments, some of which contained nonhuman antecedents such as dog and cat. Subjects were more likely to use human pronouns rather than it for referring to pets rather than nonpets , and antecedents that were liked rather than disliked , familiar rather than unfamiliar , named rather than unnamed , rational rather than nonrational , and engaging in typically human rather than nonhuman activities (...) . The beliefs and attitudes underlying these pronoun choices intruded not just hypoconsciously , but contraconsciously . A second study examined rapidly generated inferences that influenced what pronoun subjects chose to complete visually presented sentences, such as "When a student practices basketball instead of studying" and "When a student practices ballet instead of studying." The results indicated that inferences from beliefs altered the choice of pronoun from predominately he to predominantly she. Other results indicated that pronouns have semi-autonomous functions of their own, and reflect beliefs and attitudes that vary with subject sex, and are context dependent, pragmatic in nature, and dynamic over time. Dans cet article, nous établissons d’une part que l’usage du concept de capabilité comme une simple « métrique » du développement humain est une vision réductrice de la proposition intellectuelle de Sen. D’autre part, nous montrons qu’il est vain d’attendre de la part de Sen une théorie de la justice en termes de droits à certaines capabilités. Notre démonstration passe par deux types d’arguments : 1) en reprenant l’hypothèse standard et originelle de la capabilité comme ensemble de vecteurs de fonctionnements (...) accessibles ( e.g., Sen 1987), nous mettons en évidence quatre implications théoriques de l’approche de Sen que la perspective du « welfarisme formel » (Fleurbaey 2003 ; D’Aspremont 2011) ne permet pas de saisir ; 2) nous confortons cette lecture en examinant l’hypothèse – sous-explorée jusque là – de la capabilité comme « pouvoir effectif » d’agir dans le sens de résultats que l’on valorise (Sen 2008, 2010). Dans les deux cas, il s’agit de montrer que la capabilité pour Sen est bien autre chose qu’une « métrique » de l’avantage personnel et de confirmer l’idée que Sen n’est pas un théoricien des capabilités tel que l’attendent la plupart des commentateurs (Baujard et Gilardone 2017). De surcroît, la seconde hypothèse amène à intégrer d’emblée la question de l’obligation morale dans le concept de capabilité. Dès lors, la capabilité non seulement n’est pas une métrique de l’avantage personnel, mais elle n’est même plus une représentation de l’avantage personnel. C’est ici qu’apparaît selon nous la véritable révolution conceptuelle de Sen qui, contrairement à ce que Ricœur (2004) avait cru lire, ne se trouve pas dans le couple droit-capabilité, mais dans le couple responsabilité-capabilité. Finalement, il ressort que Sen partage l’idée des tenants d’une économie de la personne (Ballet et al. 2014) selon laquelle une théorie de la justice en termes de droits à certaines capabilités resterait prisonnière d’une vision purement fonctionnelle de la liberté. Surtout, la mise en lumière de ce couple responsabilité-capabilité ouvre des perspectives nouvelles pour appréhender la liberté et la rationalité des personnes, au cœur notamment des questions de justice et de choix collectif. From its dissonant musics to its surrealist spectacles (the urinal is a violin!), Modernist art often seems to give more frustration than pleasure to its audience. In Untwisting the Serpent, Daniel Albright shows that this perception arises partly because we usually consider each art form in isolation, even though many of the most important artistic experiments of the Modernists were collaborations involving several media--Igor Stravinsky's The Rite of Spring is a ballet, Gertrude Stein's Four Saints in Three Acts is (...) an opera, and Pablo Picasso turned his cubist paintings into costumes for Parade. Focusing on collaborations with a musical component, Albright views these works as either figures of dissonance that try to retain the distinctness of their various media (e.g. Guillaume Apollinaire's Les Mamelles de Tiresias ) or figures of consonance that try to lose themselves in some total effect (e.g. Arnold Schoenberg's Erwartung ). In so doing he offers a fresh picture of Modernism, and provides a compelling model for the analysis of all artistic collaborations. Untwisting the Serpent is the recipient of the 2001 Susanne M. Glasscock Humanities Book Prize for Interdisciplinary Scholarship of the Center for Humanities Research at Texas A&M University. (shrink)

This contribution focuses on legal issues raised by the audiovisual broadcasting of performing arts, which has significantly increased due to the SARS-CoV-2 pandemic. First, we contextualize this practice and briefly present the emergence and evolution of the practice of “filmed theater”, as well as any other form of performances (e.g., concert, ballet, opera) originally conceived for the stage but subsequently diffused through other channels. Secondly, we address the current legal issues that have arisen because of the increase of such (...) practice due to the containment measures taken by government. Two axes are of particular attention: the matter of copyrights and related rights, on the one hand, and the question of public financing, on the other. Concerning intellectual property, audiovisual broadcasting leads to several legal consequences and issues: effectiveness of related rights, emergence of new modes of exploitation and new authors, recognition of the recording as an original work, etc. This new practice is, moreover, likely to disrupt the categories established by public funding legal mechanisms, which are often poorly adapted to hybrid artistic objects. The objective of this part is therefore to analyze the new legal issues raised by the audiovisual distribution of performances. Finally, we go beyond exclusively legal issues to examine the very specificities of performing arts and, more specifically, the possible loss that would result from a fixation of a production on a reproducible medium, making its diffusion possible beyond the stage. This article focuses mainly on (1) the policy of Delft University of Technology since 1992 as regards the university-wide introduction of a compulsory course on ethics and engineering, and (2) the ideal structure of such a course, including the educational goals of the course.

This paper forms an introduction to this issue, the contents of which arose directly or indirectly from a conference in May 2001 on Corruption of scientific integrity? — The commercialisation of academic science. The introduction, in recent decades, of business culture and values into universities and research institutions is incompatible with the openness which scientific and all academic pursuit traditionally require. It has given rise to a web of problems over intellectual property and conflict of interest which has even led (...) to corporate sponsors’ suppressing unfavourable results of clinical trials, to the detriment of patients’ health. Although there are those who see the norms of science developing to recognise the importance of instrumental science aiming at specific goals and of knowledge judged by its value in a context of application, none justifies the covert manipulation of results by vested interest. Public awareness of these problems is growing and creating a climate of opinion where they may be addressed. We suggest a way forward by the introduction of nationally and internationally-accepted guidelines for industrial collaboration which contain proper protections of the core purposes of universities and of the independence of their research. Some codes suggested for this purpose are discussed. We note that some universities are moving to adopt such codes of conduct, but argue the need for strong support from the government through its funding bodies. (shrink)

This paper introduces a generalization of Reiter’s notion of “extension” for default logic. The main difference from the original version mainly lies in the way conflicts among defaults are handled: in particular, this notion of “general extension” allows defaults not explicitly triggered to pre-empt other defaults. A consequence of the adoption of such a notion of extension is that the collection of all the general extensions of a default theory turns out to have a nontrivial algebraic structure. This fact has (...) two major technical fall-outs: first, it turns out that every default theory has a general extension; second, general extensions allow one to define a well-behaved, skeptical relation of defeasible consequence for default theories, satisfying the principles of Reflexivity, Cut, and Cautious Monotonicity formulated by D. The proliferation of computers in the business realm may lead to ethical problems between individual and societal rights, and the organization's need to control costs. In an attempt to explore the causes of this potential conflict, this study examined the varying levels of sensitivity 223 respondents assigned to different types of information typically stored in computer-based human resource information systems. It was found that information most directly related to the job — pay rate, fringe benefits, educational history — was considered (...) to be the most sensitive. Participants, however, were more concerned about certain types of individuals/groups accessing these systems than about the kinds of information contained in them. Environmental holism and environmental individualism are based on incompatible notions of moral considerability, and yield incompatible results. For Schopenhauer, every intelligible character--every irreducible instance of formative nature---defines a distinct moral patient, and for hirn both holistic entities and the individual members of higher species have distinguishable intelligible characters. Schopenhauer’s neglected metaethics thus can be used to generate an environmental ethics which is complete in the sense of synthesizing holism and individualism while simultaneously meeting TomRegan’s (implicit) demand that an environmental ethics (...) make moral patients of natural objects. Hanoch Ben-Yami has argued that the theory of the semantics of natural kind terms proposed by Kripke and Putnam is false and has proposed an allegedly novel account of the semantics of kind terms. In this article, I critically examine Ben-Yami’s arguments. I will argue that Ben-Yami’s objections do not show that Kripke and Putnam’s theory is false, but at most that the specific versions of it held by Kripke and Putnam have some weaknesses. Moreover, I will argue that Ben-Yami’s (...) account is not a novel account but it is only an unsatisfactory version of Kripke and Putnam’s theory. (shrink)
