En este artículo, analizamos algunas de las causas que pudieron motivar que la traducción realizada por el «portugués» Diego de Cisneros de los _Ensayos_ de Montaigne entre 1634 y 1637 obtuviese la licencia eclesiástica, pero no la civil. Asimismo, se aclara el sentido de la nota_ caute lege_, que sirvió a Cisneros para orientar su labor como traductor. Para comprender la mentalidad desde la que efectuó su tarea, se ha llevado a cabo un estudio de su trayectoria biográfica e intelectual, (...) así como de su desempeño en la corte madrileña en defensa de los «hebreos cristianos». Nuestra investigación concluye que no fue el prólogo de Cisneros a su traducción lo que motivó la prohibición de los _Ensayos_, pues esta se había producido ya en 1632, sino el hecho de que la obra de Montaigne, según el _Index_ de libros prohibidos, había de ser expurgada previamente por los censores del Santo Oficio, lo que nunca sucedió. De Homero a Heráclito, este trabajo estudia las distintas caracterizaciones de la ley divina en la Grecia arcaica. Analiza la sustitución metonímica de la divinidad como fuente de derecho por el nómos ciudadano, y muestra la violencia simbólica y el olvido activo asociados a ese proceso de fundación política a partir del siglo V. Por último, reconstruye la axiología del marco oral de las antiguas teonomías e incide en el papel desempeñado por la escritura en la refiguración de la esfera (...) jurídica griega durante el período clásico. Este artículo aborda la problemática de la identidad en el mundo moderno apoyándose en las ideas de teóricos importantes de la sociología como Berger, Bauman o Beck. En primer lugar, se trata la cuestión general de cómo con el paso a la modernidad la identidad cambia de naturaleza y adquiere rasgos propios, que se analizan, junto a los descontentos y reacciones que genera este cambio. En segundo lugar, se distinguen dos etapas fundamentales en la modernidad que afectan de forma diferenciada (...) a la identidad. Así, intento mostrar cómo en la primera modernidad la identidad descansaba en unos pilares sólidos- trabajo, familia, nación y religión- que tienden a debilitarse en la segunda modernidad, por lo que la identidad se vuelve más frágil e inestable. Para escapar a este destino, concluyo, muchos individuos se adhieren a una identidad grupal, a veces de carácter monolítico, un fenómeno en alza que merecerá estudiarse detenidamente. (shrink)

Some have defended a Fregean view of perceptual content. On this view, the constituents of perceptual contents are Fregean modes of presentation (MOPs). In this paper, I propose that perceptual MOPs are best understood in terms of object files. Object files are episodic representations that store perceptual information about objects. This information is updated when sensory conditions change. On the proposed view, when a subject perceptually represents some object a under two distinct MOPs, then the subject initiates two object files (...) that both refer to a. My defense of this view appeals to its satisfaction of four constraints that I argue theories of perceptual MOPs should satisfy. Furthermore, I show that some existent accounts of perceptual MOPs fail to satisfy them. The defended constraints also indicate what is unique about perceptual, as opposed to linguistic or cognitive, MOPs. (shrink)

Ground offers the hope of vindicating and illuminating an classic philosophical idea: the layered conception, according to which reality is structured by relations of dependence, with physical phenomena on the bottom, upon which chemistry, then biology, and psychology reside. However, ground can only make good on this promise if it is appropriately formally behaved. The paradigm of good formal behavior can be found in the currently dominant grounding orthodoxy, which holds that ground is transitive, antisymmetric, irreflexive, and foundational. However, heretics (...) have recently challenged the orthodoxy. In this paper, I examine ground’s ability to vindicate the layered conception upon various relaxations of the orthodox assumptions. I argue that highly unorthodox views of ground can still vindicate the layered conception and that, in some ways, the heretical views enable ground to better serve as a guide to reality’s layering than do orthodox views of ground. In light of recent criticisms by Woodward (2017) and Rescorla (2018), we examine the relationship between mechanistic explanation and phenomenological laws. We disambiguate several uses of the phrase “phenomenological law” and show how a mechanistic theory of explanation sorts them into those that are and are not explanatory. We also distinguish the problem of phenomenological laws from arguments about the explanatory power of purely phenomenal models, showing that Woodward and Rescorla conflate these problems. Finally, we argue that the temptation to (...) pit mechanistic and interventionist theories of explanation against one another occludes important and scientifically relevant research questions. Perceptual learning is characterized by long-term changes in perception as a result of practice or experience. In this paper, I argue that through perceptual learning we can become newly sensitive to basic perceptual features. First, I provide a novel account of basic perceptual features. Then, I argue that evidence from experience-based plasticity suggests that basic perceptual features can be learned. Lastly, I discuss the common scientific and philosophical view that perceptual learning comes in at least four varieties: differentiation, unitization, attentional (...) weighting and stimulus imprinting (Goldstone 1998, Connolly 2019). Becoming newly sensitive to basic perceptual features, I argue, does not fit into any of these categories. This paper’s contribution to the literature is twofold. First, I present a novel view of basic perceptual features which can be used in subsequent theorizing. Second, I show that learning basic perceptual features, since it does not fit into this standardized taxonomy, constitutes an underappreciated form of perceptual learning. This result has important implications for recent discussions in the philosophy of perception and epistemology. (shrink)

Carnap’s seminal ‘Empiricism, Semantics and Ontology’ makes important use of the notion of a framework and the related distinction between internal and external questions. But what exactly is a framework? And what role does the internal/external distinction play in Carnap’s metaontology? In an influential series of papers, Matti Eklund has recently defended a bracingly straightforward interpretation: A Carnapian framework, Eklund says, is just a natural language. To ask an internal question, then, is just to ask a question in, say, English. (...) To try to ask an external question is to try, absurdly, to ask a question in no language at all. Finding that so trivial an I/e distinction can’t help to explain Carnap’s deflationary metaontology, Eklund is led to attribute to Carnap a view he calls ontological pluralism. In this paper, I show that Eklund misreads Carnap, and I argue that this misreading obscures fundamental features of Carnap’s philosophy. I then defend an account of frameworks as what Carnap called semantical systems, and I place this account in the context of Carnap’s philosophical program of explication. Finally, I discuss the role that frameworks and the I/e distinction play in ESO, showing that ESO provides no reason to attribute the doctrine of ontological pluralism to Carnap. (shrink)

ABSTRACT This essay has three goals. The first is to introduce the notion of fundamentality and to argue that physicalism can usefully be conceived of as a thesis about fundamentality. The second is to argue for the advantages of fundamentality physicalism over modal formulations and that fundamentality physicalism is what many who endorse modal formulations of physicalism had in mind all along. Third, I describe what I take to be the main obstacle for a fundamentality-oriented formulation of physicalism: ‘the problem (...) of abstracta’, which asks how physical can accommodate phenomena such as mathematics and universals, and which modal formulations do not face. I canvas three solutions: the inapt for ground solution, the concrete restriction, and the contingency restriction. (shrink)

This article seeks to contribute to a vision for leadership in business based on a recovery of virtue. The vision for leadership articulated here draws principally on the writings of the classical philosopher Aristotle and of the contemporary philosopher Josef Pieper. Without discounting the ever-increasing complexity of modern business, this essay will attempt to reconstruct Aristotle’s emphasis on virtue and moral character, and argues for the philosopher’s relevance to modern management and corporate leadership. The paper concludes that the message of (...) virtue is a message of hope and attempts to find plain language to articulate its value to those engaged in business or concerned with the formulation of government policy. This paper presents a new version of the democratic argument for the freedom of expression that has the resources to give a plausible reply to the perennial objection—ordinarily considered fatal—that such accounts fail to deliver protections for abstract art, instrumental music, and lots of other deserving nonpolitical speech. The argument begins with the observation that there are different things that a free speech theory might aim to accomplish. It will hope to justify a right to free speech, of course, with (...) a particular scope and shape, but that right might be a moral right, an ordinary legal right, or a specifically constitutional right. The new version of the argument—the refined argument from democracy—aims to justify a specifically constitutional right to political speech, administered by strong-form judicial review. The democracy theorist can accommodate the intuition that abstract art deserves protection by agreeing that we have a moral right, and probably ought to have an ordinary legal right, to produce and view abstract art. She must only insist that abstract art should not be protected by a specifically constitutional right administered by strong-form judicial review. Not because abstract art does not deserve constitutional protection, but because, on this view, whether a particular right ought to be enshrined in the constitution and administered by judicial review is not solely a matter of the importance of the right or the value of the interests it protects. To achieve impact, academics need to create personal impact development plans, focused on what and on whom to have an impact and the necessary competencies to do so. Profession and university leaders play a critical role in the successful implementation of such plans.

Sociologists often ask why particular groups of people have the moral views that they do. I argue that sociology’s empirical research on morality relies, implicitly or explicitly, on unsophisticated and even obsolete ethical theories, and thus is based on inadequate conceptions of the ontology, epistemology, and semantics of morality. In this article I address the two main problems in the sociology of morality: (1) the problem of moral truth, and (2) the problem of value freedom. I identify two ideal–typical approaches. (...) While the Weberian paradigm rejects the concept of moral truth, the Durkheimian paradigm accepts it. By contrast, I argue that sociology should be metaphysically agnostic, yet in practice it should proceed as though there were no moral truths. The Weberians claim that the sociology of morality can and should be value free; the Durkheimians claim that it cannot and it should not. My argument is that, while it is true that factual statements presuppose value judgments, it does not follow that sociologists are moral philosophers in disguise. Finally, I contend that in order for sociology to improve its understanding of morality, better conceptual, epistemological, and methodological foundations are needed. (shrink)

The study aims at expanding the idea of knowledge beyond the notion of descriptive knowledge. It examines a pluralism of scientific, philosophical, literary, and aesthetic forms of knowledge. This pluralism is not relativistic but complementary. Different ways of knowing enrich each other thus facilitating a more comprehensive and differentiated conception of the world.".

When does a model explain? When does it promote understanding? A dominant approach to scientific explanation is the interventionist view. According to this view, when X explains Y, intervening on X can produce, prevent or alter Y in some predictable way. In this paper, I argue for two claims. First, I reject a position that many interventionist theorists endorse. This position is that to explain some phenomenon by providing a model is also to understand that phenomenon. While endorsing the interventionist (...) view, I argue that explaining and understanding are distinct scientific achievements. Second, I defend a novel theory of scientific understanding. According to this view, when some model M promotes understanding, M makes available a distinctive mental state. This state is of the same psychological kind as when we grasp events in a narrative as bearing on some ultimate conclusion. To conclude, I show that, given this view, mechanistic explanations often provide a powerful source of understanding that many causal-historical models lack. This paper will be of interest to both philosophers of science and epistemologists engaged in the topics of explanation and understanding. (shrink)

Während die Bedeutung Freges für die Philosophie der Gegenwart, soweit sich diese der analytischen Philosophie verpflichtet fühlt, allgemeine Anerkennung gefunden hat, ist seine Stellung innerhalb der eigenen Zeit noch weitgehend unaufgeklärt geblieben. So herrscht die Auffassung vor, Frege habe seine Ideen ganz aus sich selbst oder geradezu im Gegensatz zur deutschen philosophischen Tradition seiner Zeit gewonnen. Bei genauerer Textanalyse weisen Freges Schriften dagegen vielfältige Beziehungen zur zeitgenössischen Logik, Erkenntnistheorie, Sprachphilosophie und Philosophie der Mathematik auf, so dass bei ihm von einem (...) Bruch mit der kontinentalen Philosophie nicht die Rede sein kann. Weil die historischen Voraussetzungen unberücksichtigt geblieben sind, ist ein unzutreffendes Bild von Freges Einsichten entstanden. Dieses Bild wird durch die Entfaltung des historischen Kontextes korrigiert. Bestimmend ist dabei ein problemorientierter Zugang, der sich systematischer Bewertungen und Weiterführungen nicht enthält. (shrink)

The Kohlberg Gilligan Controversy has received intermittent but inconclusive attention for many years, perhaps reflecting the difficulty of bridging the two positions. This article explores the published evidence for Gilligan's claims of gender difference, gender identity difference, and role of caring in people's ethics. It seems that the evidence for pronounced gender differences in ethical attitudes within business is weak, even if gender identity is used instead of physical gender. The main propositions of Care Theory and recent advances in its (...) thinking are discussed. Special focus emerges on the notion of Attachment which seems to be the Care Theory ingredient both most able to survive critical scrutiny and most promising for bridging the divide between the Kohlberg and Gilligan paradigms. The Social Bonding Model and other possible bridge building conceptual structures are introduced. Finally, Max Weber's division between ethics of conviction and ethics of responsibility provides an overarching perspective both of the gap still to be bridged and the need to keep trying to bridge it. El Estado de Hegel es el Estado de Derecho. Sin embargo en su Filosofía del Derecho se encuentran fundamentos decisivos para una teoría del Estado Social. Siguiendo el hilo de las Líneas fundamentales de la Filosofía del Derecho, se empieza por ver el derecho al bienestar, tal como se formula en la Moralidad (1). En la familia aparece el derecho de los hijos "de ser alimentados y educados" (2). El Derecho al bienestar se concreta en la sociedad civil (3), se (...) hace posible en el sistema de las necesidades (3.1.) y efectivo en la policía y la corporación (3.2 y 3.3), que ejercen funciones de suplencia de la familia. El mayor problema es la pobreza, tanto la que surge por contingencias subjetivas y sociales como por el funcionamiento mismo de la sociedad civil: la plebe. A este problema la sociedad es incapaz de darle una solución. (shrink)

The history of the field of business ethics in the U.S. remains understudied and misunderstood. In this article I begin to remedy this oversight about the past, and I suggest how it can be beneficial in the present. Using both published and unpublished primary sources, I argue that the business ethics field emerged in the early twentieth century, against the backdrop of the establishment of business schools in major universities. I bring to light four important developments: business ethics lectures at (...) the University of California and Yale University, Leon Marshall’s curriculum at the College of Commerce of the University of Chicago, and the William A. Vawter Foundation on Business Ethics at Northwestern University. Then, I consider the payoffs of my historical account for business ethics theory, pedagogy, and practice. Specifically, I present four implications of my account under these headings: business ethics as a public problem; the place of ethics in business schools; historicizing business ethics; and historical self-knowledge. In this article I ask what recent moral psychology and neuroscience can and can’t claim to have discovered about morality. I argue that the object of study of much recent work is not morality but a particular kind of individual moral judgment. But this is a small and peculiar sample of morality. There are many things that are moral yet not moral judgments. There are also many things that are moral judgments yet not of that particular kind. If moral things (...) are various and diverse, then empirical research about one kind of individual moral judgment doesn’t warrant theoretical conclusions about morality in general. If that kind of individual moral judgment is a peculiar and rare thing, then it is not obvious what it tells us about other moral things. What is more, it is not obvious what its theoretical importance is to begin with—that is, why we should care about it at all. In light of these arguments, I call for a pluralism of methods and objects of inquiry in the scientific investigation of morality, so that it transcends its problematic overemphasis on a particular kind of individual moral judgment. According to Frank Jackson’s famous knowledge argument, Mary, a brilliant neuroscientist raised in a black and white room and bestowed with complete physical knowledge, cannot know certain truths about phenomenal experience. This claim about knowledge, in turn, implies that physicalism is false. I argue that the knowledge argument founders on a dilemma. Either (i) Mary cannot know the relevant experiential truths because of trivial obstacles that have no bearing on the truth of physicalism or (ii) once the obstacles have been (...) removed, Mary can know the relevant truths. If we give Mary the epistemological capabilities necessary to draw metaphysical conclusions about physicalism, she will, while trapped in the black and white room, be able to know every truth about phenomenal experience. Apologizing for Socrates places some of the Platonic and Xenophontic writings in the context of contemporary controversies over Socrates, providing a perspective in which many of the philosophic and literary features of the text can be explained. In addition, it sheds light on the apologetic techniques used by Plato and Xenophon.

We give three counterexamples to the folklore claim that in an arbitrary theory, if a complete type p over a set B does not divide over $C\subseteq B$, then no extension of p to a complete type over $\operatorname {acl}(B)$ divides over C. Two of our examples are also the first known theories where all sets are extension bases for nonforking, but forking and dividing differ for complete types (answering a question of Adler). One example is an $\mathrm {NSOP}_1$ theory (...) with a complete type that forks, but does not divide, over a model (answering a question of d’Elbée). Moreover, dividing independence fails to imply M-independence in this example (which refutes another folklore claim). In addition to these counterexamples, we summarize various related properties of dividing that are still true. We also address consequences for previous literature, including an earlier unpublished result about forking and dividing in free amalgamation theories, and some claims about dividing in the theory of generic $K_{m,n}$ -free incidence structures. This paper offers a new version of a historically influential, yet today unpopular, neglected, and on the whole insufficiently developed argument for socialism: socialism makes it possible for people to really act together. This idea of socialist action, combining the claims that there is a particularly valuable form of joint action and that socialism is about making such action possible, played an important role in the history of the labor movement, going back to the early Marx and running through various (...) strands of socialist thought. I shall argue that socialist action should be seen as central to the socialist project, its critique of capitalism, and the institutional alternatives envisaged by it. (shrink)

This paper draws a distinction between the existential quantifier and the symbol ‘∃’ used to express it, on the one hand, and existence and ‘exists’, on the other. It argues that some popular arguments in metaphysics, including arguments against vague existence and arguments against deflationary metaontology (which views ontological disputes as lacking substance), are guilty of fudging this distinction. The paper draws some lessons for metaphysical debate about existence and highlights some heretofore ignored and attractive positions in logical space.

We present two studies investigating the impact of causal perceptions and the moral emotions of anger, shame, and guilt on the justification of deviant workplace behavior. Study 1 tests our conceptual framework using a sample of undergraduate business students; Study 2 examines a population of practicing physicians. Results varied significantly between the two samples, suggesting that individual and contextual factors play an important role in shaping the perceptual and emotional processes by which individuals form reactions to undesirable affective workplace events. The financial crisis has led to new interest in the ethics of financial markets. In this article, we further the debate on the nature of banking contracts by showing that the fundamental subjective purposes of loan and deposit contracts are irreconcilable. Any resultant mixture of the two contracts is a legal aberration. We consider a mutual fund as an important and legitimate alternative to the common demand deposit to provide high liquidity and some yield without offering full availability of a (...) nominal sum. Besides being a close substitute for how many deposit accounts function today, the mutual fund has the additional benefit of satisfying all legal and ethical requirements. Loan and investment contracts allow for the “bank” to make use of their clients’ funds while the intents of money owners are clearly classified without running into legal or ethical problems. O presente texto tem por objetivo compreender a pintura de Wassily Kandinsky a partir da metafísica do belo de Arthur Schopenhauer, especialmente a partir da relação entre pintura e música estabelecida pelo pintor.

Although stakeholder theory is widely accepted in environmental disclosure research, empirical evidence about the role of stakeholders in firms’ disclosure is still scarce. The authors address this issue for a setting of carbon disclosure. Our international sample comprises the Carbon Disclosure Project Global 500, S&P 500, and FTSE 350 reports from 2008 to 2011, resulting in a total of 1,120 firms with 3,631 firm-year observations. The authors apply Tobit regressions to analyze the relationship between carbon disclosure and the relevance of (...) the following stakeholder groups: government, general public, media, employees, and customers. Our results confirm that in addition to carbon performance, all stakeholders are associated with carbon disclosure. Only one stakeholder group acts as a moderator for the relationship between carbon performance and carbon disclosure. Furthermore, the authors find that carbon performance but not the affiliation to a carbon-intensive industry acts as a moderator between stakeholder relevance and carbon disclosure. (shrink)

How much personal partiality do agent-centred prerogatives allow? If there are limits on what morality may demand of us, then how much does it permit? For a view Henry Shue has termed ‘yuppie ethics’, the answer to both questions is a great deal. It holds that rich people are morally permitted to spend large amounts of money on themselves, even when this means leaving those living in extreme poverty unaided. Against this view, I demonstrate that personal permissions are limited in (...) certain ways: their strength must be continuous with the reasons put forward to explain their presence inside morality to begin with. Typically, these reasons include non-alienation and the preservation of personal integrity. However, when personal costs do not result in alienation or violate integrity, they are things that morality can routinely demand of us. Yuppie ethics therefore runs afoul of what I call the ‘continuity constraint’. (shrink)

Moral repair is an important way for firms to heal moral relationships with stakeholders following a transgression. The concept is rooted in recognition theory, which is often used to develop normative perspectives and prescriptions, but the same theory has also propelled a view of moral repair as premised on negotiation between offender and victim(s), which involves the complex social construction of the transgression and the appropriate amends. The tension between normative principles and socioconstructivist implementation begs the question how offending firms (...) should approach moral repair. Addressing this question, we develop a two-level conceptualization of moral repair, distinguishing between procedural and substantive levels of practice, which accommodate normativity and socioconstructivism, respectively. In so doing, we enrich the literature by 1) promoting conceptual clarity, 2) refining understanding of the moral repair process, and 3) suggesting the use of a unified, configurational approach to studying (nonlinear) relations between amends and moral outcomes. Many authors have argued that all studies of socially specific modalities of human action and experience depend on some form of “philosophical anthropology”, i.e. on a set of general assumptions about what human beings are like, assumptions without which the very diagnoses of the cultural and historical variability of concrete agents' practices would become impossible. Bourdieu was sensitive to that argument and, especially in the later phase of his career, attempted to make explicit how his historical-sociological investigations presupposed and, at (...) the same time, contributed to the elaboration of an “idea of the human being”. The article reconstructs Bourdieu's philosophical anthropology, starting with his genetic sociology of symbolic power, conceived as a form of critical theory, and concluding with an account of the conditio humana in which recognition appears as both the fundamental existential goal through which human agents strive to confer meaning on their lives and the source of the endless symbolic competition that keeps society moving. The agonistic vision of the social universe that grounds his sociological studies returns in his philosophical anthropology under the guise of a singular synthesis between Durkheim's thesis that “Society is God” and Sartre's idea that “hell is other people”.
