This paper outlines the moral contours of human relationships with companion animals. The paper details three sources of duties to and regarding companion animals: (1) from the animal’s status as property, (2) from the animal’s position in relationships of care, love, and dependency, and (3) from the animal’s status as a sentient being with a good of its own. These three sources of duties supplement one another and not only differentiate relationships with companion animals from wild animals and other categories (...) of domestic animals such as livestock, but they also overlap to provide moral agents with additional reasons for preventing and avoiding harm to companion animals. The paper concludes that not only do owners and bystanders have direct and indirect duties to protect companion animals from harm, but also that these duties have the potential, in some circumstances, to clash with duties owed to the state and fellow citizens. The diagnosis of psychopathic personality disorder has salience for forensic clinical practice. It influences decisions regarding risk, treatability and sentencing, indeed, in certain jurisdictions it serves as an aggravating factor that increases the likelihood of a capital sentence. The concatenation of symptom that is associated with modern conceptions of the disorder can be discerned in early writings, including the book of Psalms. Despite its forensic clinical importance and historical pedigree the concept remains elusive and controverted. In this paper I describe (...) an attempt to map the concept of psychopathic personality disorder—the Comprehensive Assessment of Psychopathic Personality (CAPP). I outline the processes used to create the concept map; I summarise evidence in support of the content validity of the map and describe different operations designed to operationalise the construct. It is only when conceptual clarity is achieved that valid operations and measures can be created. I end with a plea for more carefully considered application of statistical methods; applications that better fit the theoretical questions being posed. (shrink)

The greatest threat faced by wild animals often comes from the destruction of their habitats by humans. Traditional environmental-conservation paradigms often fail to prevent this destruction. This paper claims that, where access to habitat is a necessary condition of their continued existence or wellbeing, wild animals have sufficiently strong interests in their habitat to generate rights to it. The paper argues that these rights should be instantiated in the form of collective usufructuary property rights, and, in cases of serious and (...) systematic violation of these rights, wild animals gain a remedial right of secession for their habitat. Critical social theory has an uneasy relationship with utopia. On the one hand, the idea of an alternative, better social order is necessary in order to make sense of its criticisms of a given social context. On the other hand, utopian thinking has to avoid ‘bad utopianism’, defined as lack of connection with the actual historical process, and ‘finalism’, defined as closure of the historical process. Contemporary approaches to critical social theory endeavour to avoid these dangers by way of a (...) post metaphysical strategy. However, they run up against the problem that utopian thinking has an unavoidable metaphysical moment. Rather than seeking to eliminate this moment, therefore, they should acknowledge its inevitability. The challenge is to maintain a productive tension between closure and contestability and between attainability and elusiveness. The paper outlines a strategy for meeting this challenge, a strategy that is based on a distinction between the metaphysical content of utopian projections and their fallible claims to validity. Artworks frequently are the objects of multiple and apparently conflicting aesthetic judgements. This commonplace of the artworld poses a challenge for realist metaphysics, because to assert conflicting judgements of an artwork seems to amount to asserting p & p. Critical pluralism is an ever-more frequently invoked solution to this impasse. What its varieties share in common is the claim that the disagreement between judgements is only an apparent one. I argue, however, that critical pluralism masquerades either as relativism or anti-realism. (...) I examine a number of pluralist proposals, including one that attempts to reconcile pluralism with critical monism, and argue that they are inadequate to their advertised task. Finally, I sketch a solution employing dialetheic logic that captures both intuitions about these cases: that sometimes, judgements about artworks can truly conflict and jointly be true. (shrink)

An apparent tension persists in Peirce’s philosophy between the purpose-driven nature of inquiry, destined to achieve truth in the long run, on the one hand, and, on the other hand, the fact that inquiry depends upon musement (or the free play of ideas), which is purposeless. If there is no purpose in musement then it would appear there is no rational self-control in musement, and thus, irrationality lies at the center of Peirce’s theory of inquiry. I argue that in musement (...) the individual sets off without a purpose, thereby opening herself to noticing novelty, and that noticing is itself a form of creative thought insofar as it allows the individual to discover new wonders and anomalies. Not all creativity in inquiry aims at solving problems or formulating new hypotheses. Some creative thinking is about noticing what is already there or possibly there. Such noticing in musement is purposeless, and yet the individual retains some rational self-control within this thought process. She controls the entry into the activity, and, prior to musing, she controls the adoption of the ideals which are inevitably employed in musement. This adoption of some ideals rather than others can explain why some people notice things while others do not. (shrink)

Contemporary critical social theories face the question of how to justify the ideas of the good society that guide their critical analyses. Traditionally, these more or less determinate ideas of the good society were held to be independent of their specific sociocultural context and historical epoch. Today, such a concept of context-transcending validity is not easy to defend; the "linguistic turn" of Western philosophy signals the widespread acceptance of the view that ideas of knowledge and validity are always mediated linguistically (...) and that language is conditioned by history and context. In Re-Presenting the Good Society, Maeve Cooke addresses the justificatory dilemma facing critical social theories: how to maintain an idea of context-transcending validity without violating anti-authoritarian impulses. In doing so she not only clarifies the issues and positions taken by other theorists--including Richard Rorty, Jürgen Habermas, Axel Honneth, and Judith Butler--but also offers her own original and thought-provoking analysis of context-transcending validity.Because the tension between an anti-authoritarian impulse and a guiding idea of context-transcending validity is today an integral part of critical social theory, Cooke argues that it should be negotiated rather than eliminated. Her proposal for a concept of context-transcending validity has as its central claim that we should conceive of the good society as re-presented in particular constitutively inadequate representations of it. These re-presentations are, Cooke argues provocatively, regulative ideas that have an imaginary, fictive character. (shrink)

Revisiting Taylor's 1992 account of the politics of recognition, I argue that he is right to discern a strand in contemporary politics that goes beyond the demand for recognition of dignity. Against Taylor I contend that this is best understood as a concern not for recognition of difference but for the value of something that is not universally shared, such as a particular ethical conception, cultural tradition or religious belief and practice. Using the examples of three social movements I show (...) the relevance of this for contemporary politics. My empirically based argument is supported normatively by a discussion of Hegel's critique of `morality as conscience' in his Phenomenology. Referring to Axel Honneth's theory of recognition I highlight the lack of attention to this kind of concern for recognition in contemporary political and social theory. I conclude by specifying the key features of the concept of recognition most appropriate for responding to it publicly under conditions of value-pluralism. (shrink)

In this article I propose a cosmopolitan approach to animal rights based upon Kant's right of universal hospitality. Many approaches to animal rights buttress their arguments by finding similarities between humans and non-human animals; in this way they represent or resemble ethics of partiality. In this article I propose an approach to animal rights that initially rejects similarity approaches and is instead based upon the adoption of a cosmopolitan mindset acknowledging and respecting difference. Furthermore, and in agreement with Martha Nussbaum, (...) and Sue Donaldson and Will Kymlicka, I endorse the view that theories of animal rights need to be theories of justice and include a political component. Contra Donaldson and Kymlicka, however, I argue that the starting point for analysis of political theories of animal rights should be at the global rather than national level. Taking animals as strangers, I propose adopting a Kantian cosmopolitan mindset and ethic of universal hospitality towards them. I address how a ius cosmopoliticum that is hospitable to the interests of non-human animals can govern interactions with animals on fair terms, and I respond to concerns that cosmopolitanism cannot accommodate non-human animals because it is a democratic ideal, is grounded in logocentrism or rests upon ownership of territory by humans. Sometimes it is wrong to imagine or take pleasure in imagining certain things, and likewise it is sometimes wrong to prompt these things. Some argue that certain fictive imaginings—imaginings of fictional states of affairs—are intrinsically wrong or that taking pleasure in certain fictive imaginings is wrong and so prompting either would also be wrong. These claims sometimes also serve as premises in arguments linking the ethical properties of a fiction to its artistic value. However, even if we grant that it (...) might sometimes be wrong to imagine x or to take pleasure in imagining x, nothing follows about the ethical status of fictively imagining x, with or without pleasure. Prompting some fictive imagining is intrinsically wrong only when the fiction is a means to encourage for export from the fiction to the actual world some belief or attitude that it would be blameworthy to hold. The failure of arguments for the wrongness of certain fictive imaginings and their prompting lies in part in a failure to recognize that imagining x and fictively imagining x are distinct mental acts. This distinction blocks many arguments attempting to forge a link between a work's ethical properties and its artistic properties. (shrink)

Human resource management (HRM) is underpinned by, and contributes to, the business ethics of the organization. Opportunities available to men and women as managers, and the role of managers more broadly, are critical in shaping business ethics in contemporary organizations. Research on women in management therefore provides an important lens through which to understand the institutional and cultural context of HR ethics as part of the business ethics of a country. To date, women in management in China remains an under-charted (...) topic of research in the HRM field. Extant research and recommendations on the improvement of the position of women in management in China focus primarily on women themselves from a traditional, gender norm angle, instead of challenging the political and patriarchal system or any institutionalized discriminatory practice. This is, in part, due to the absence in China of a critical feminism approach or feminist movement, as found in Western societies, and the continuing strong influence of the state and media in portraying women’s (stereotypical) image. There is significant room for research capacity building in scholarship on women in management research, for example, and through cross-fertilization of different disciplines and more rigorous research design and execution. This paper provides a critical analysis of extant literature on women in management and the ideologies underpinning it, and offers some suggestions for future research and conceptualization. This essay explores the nihilistic nature of the idea of postmodern aesthetics in the Western world by highlighting its historical and cultural specificity in contrast with non-Western postmodernities, in particular in East Asia, and this in spite of their formal similarities. We then have to question the nature, possibility and implication of Western postmodern aesthetics overcoming itself within the context of globalisation.

Felicia Ackerman argues that it is often wrong to use real people in fiction because it harms them. I argue that even when drawing from life is wrong, the unethical use of real people as literary material may nonetheless be rationally justified, and not in purely self-interested, instrumentalist terms. Either ethical considerations are always overriding, and much of our creative and appreciative practices are morally corrupt, or ethical and aesthetic values are incommensurable. I defend the plausibility of the incommensurabilist alternative, (...) and indicate how creative and appreciative choices might be rational even when the values in play are incommensurable. (shrink)

In replying to Steven Wall’s and Andrew Lister’s thoughtful essays on my account of justificatory liberalism in this issue, I respond to many of their specific criticisms while taking the opportunity to explicate the foundations of justificatory liberalism. Justificatory liberalism takes seriously the moral requirement to justify all claims of authority over others, as well as all coercive interferences with their lives. If we do so, although we are by no means committed to libertarianism, we find that that many of (...) our cherished values, moral intuitions, and political aspirations no longer ground the range of authority over others many of us would claim. In this sense, justificatory liberalism is a theory of limited authority and limited government — which is what a genuinely liberal theory must be. (shrink)

J. St. Mill's System of Logic (1843) is reexamined from the perspective of present-day analytical philosophy of the social sciences. His naturalistic epistemology, "state", "general/universal laws", "social statics/dynamics" are discussed, as well as his four methods. His nomological-behavioral position is analysed, along with his theoretical approach.

This book is an extensive survey and critical examination of the literature on the use of expert opinion in scientific inquiry and policy making. The elicitation, representation, and use of expert opinion is increasingly important for two reasons: advancing technology leads to more and more complex decision problems, and technologists are turning in greater numbers to "expert systems" and other similar artifacts of artificial intelligence. Cooke here considers how expert opinion is being used today, how an expert's uncertainty is (...) or should be represented, how people do or should reason with uncertainty, how the quality and usefulness of expert opinion can be assessed, and how the views of several experts might be combined. He argues for the importance of developing practical models with a transparent mathematic foundation for the use of expert opinion in science, and presents three tested models, termed "classical," "Bayesian," and "psychological scaling." Detailed case studies illustrate how they can be applied to a diversity of real problems in engineering and planning. (shrink)

Michael Moehler’s Minimal Morality is a wonderful and important book, from which I have learned a great deal. It reinvigorates rational choice moral theory in the process of confronting what I see as the most important issue in social and moral philosophy today: can those in a deeply morally divided society endorse a common moral framework to structure social cooperation? Is a rational moral order possible under conditions of deep and wide moral diversity? Minimal Morality’s answers are thoughtful and innovative. (...) I am not, however, entirely persuaded that Minimal Morality can fulfil its promise of grounding a cooperative order when ‘traditional’ modes moral justification cannot. (shrink)

Can the institutional systems that prepare Black nurse researchers question the ways their systemic pathways have impacted health equity knowledge development in nursing? We invite our readers to keep this question in mind and engage with our conversation as Black nurse researchers, scholars, educators, and clinicians. The purpose of our conversation, and this article, is to explore the transactional impact of knowledge development pathways and Black faculty retention pathways on the state of health equity knowledge in nursing today. Over a (...) series of conversations, we discuss the research exploitation of communities of color, deficit research funding, knowledge capitalization, the marginalization of diversity as a continuous process, a lack of sociocultural authority, and our thoughts on solutions.
