The role of Parliament has been fundamentally changed by the following factors : 1° the growing technicality of society, 2° the growing influence of administration and the executive, 3° the new forms of democratic practice, 4° the management of political parties.In practice, the legislative function turns more and more into a control of the general objectives of the law rather than of the technical and juridical aspects. Besides, it is important to examine, from a constitutional point of view, the different (...) forms of delegation.The control of both executive power and ombudsfunction remain the basic tasks of Parliament. The technical means, needed to perform these tasks, have therefore to be considerably improved. Beside the evolution of these two classical functions, it is vital to meet the growing power conflicts between government, parties, social partners and Parliament by creating new patterns of deliberation.To maintain the parliamentary system it is essential to carry through such constitutional reforms as will prevent arbitrary dissolution of Parliament. The discussion about deep disagreement has gained significant momentum in the last several years. This discussion often relies on the intuition that deep disagreement is, in some sense, rationally irresolvable. In this paper, I will provide a theory of rationally irresolvable disagreement. Such a theory is interesting in its own right, since it conflicts with the view that rational attitudes and procedures are paradigmatic tools for resolving disagreement. Moreover, I will suggest replacing discussions about deep disagreement with an analysis of (...) rationally irresolvable disagreement, since this notion can be more clearly defined than deep disagreement and captures the basic intuitions underlying deep disagreement. I will first motivate this project by critically assessing the current debate about deep disagreement. I then detail the notions of rationality and resolvable disagreement which are crucial for a suitable theory of rationally irresolvable disagreement before sketching various instances of rationally irresolvable disagreement. Finally, I argue for replacing theories of deep disagreement with theories of rationally irresolvable disagreement, an approach that has significant advantages over existing theories of deep disagreement which focus on hinge propositions or fundamental epistemic principles. There are two general views that social ontologists currently defend concerning the nature of joint intentional action. According to ‘non-normativists’, for a joint action to be established, we need to align certain psychological states in certain ways. ‘Normativists’ argue that joint action essentially involves normative relations that cannot be reduced to the intentional states of individuals. In two ground-breaking publications, Javier Gomez-Lavin and Matthew Rachar empirically investigate the relation between normativity and joint action in several survey studies. They argue that (...) people's intuitions support neither current normativists nor current non-normativists. They suggest that there is a need for a ‘new normativism of joint action’. I first explore what a new normativism could amount to and conclude that the authors’ findings cannot support a demand for such a view. Finally, I suggest some ideas about how to move the field forward. (shrink)

In research involving patients with implantable brain–computer interfaces (BCIs), there is a regulatory gap concerning post-trial responsibilities and duties of sponsors and investigators towards implanted patients. In this article, we analyse the case of patient R, who underwent non-voluntary explantation of an implanted BCI, causing a discontinuation in her sense of agency and self. To clarify the post-trial duties and responsibilities involved in this case, we first define the ontological status of the BCI using both externalist (EXT) and internalist (INT) (...) theories of cognition. We then give particular focus to the theories of extended and embedded cognition, hence considering the BCI either as a constitutive component of the patient’s mind or as a causal supporter of her brain-based cognitive capacities. We argue that patient R can legitimately be considered both as an embedded and extended cognitive agent. Then, we analyse whether the non-voluntary explantation violated patient R’s (neuro)rights to cognitive liberty, mental integrity, psychological continuity and mental privacy. We analyse whether and how different mental ontologies may imply morally relevant differences in interpreting these prima facie neurorights violations and the correlational duties of sponsors and investigators. We conclude that both mental ontologies support the identification of emerging neurorights of the patient and give rise to post-trial obligations of sponsors and investigators to provide for continuous technical maintenance of implanted BCIs that play a significant role in patients’ agency and sense of self. However, we suggest that externalist mental ontologies better capture patient R’s self-conception and support the identification of a more granular form of mental harm and associated neurorights violation, thus eliciting stricter post-trial obligations. Invariantists argue that the notion of concept in psychology should be reserved for knowledge that is retrieved in a context-insensitive manner. Contextualists argue that concepts are to be understood in terms of context-sensitive ad hoc constructions. I review the central empirical evidence for and against both views and show that their conclusions are based on a common mischaracterization of both theories. When the difference between contextualism and invariantism is properly understood, it becomes apparent that the way the question of stability (...) is currently investigated will not lead to a consensus. Instead of focusing directly on stability, we should turn our attention to other desiderata on a theory of concepts. In particular, I show that invariantism, but not contextualism, fails to account for compositionality and abstract concepts. (shrink)

Vogel argues that sensitivity accounts of knowledge are implausible because they entail that we cannot have any higher-level knowledge that our beliefs are true, not false. Becker and Salerno object that Vogel is mistaken because he does not formalize higher-level beliefs adequately. They claim that if formalized correctly, higher-level beliefs are sensitive, and can therefore constitute knowledge. However, these accounts do not consider the belief-forming method as sensitivity accounts require. If we take bootstrapping as the belief-forming method, as the discussed (...) cases suggest, then we face a generality problem. Our higher-level beliefs as formalized by Becker and Salerno turn out to be sensitive according to a wide reading of bootstrapping, but insensitive according to a narrow reading. This particular generality problem does not arise for the alternative accounts of process reliabilism and basis-relative safety. Hence, sensitivity accounts not only deliver opposite results given different formalizations of higher-level beliefs, but also for the same formalization, depending on how we interpret bootstrapping. Therefore, sensitivity accounts do not fail because they make higher-level knowledge impossible, as Vogel argues, and they do not succeed in allowing higher-level knowledge, as Becker and Salerno suggest. Rather, their problem is that they deliver far too heterogeneous results. (shrink)

Past decades have witnessed the growing success of branding as a corporate activity as well as a rise in anti-brand activism. While appearing to be contradictory, both trends have emerged from common sources – the transition from industrial to post-industrial society, and the advent of globalization – the examination of which might lead to a socially grounded understanding of why brand success in the future is likely to demand more than superior product performance, placing increasing demand on corporations with regard (...) to a broader envelop of socially responsible behavior. Interpretations that follow Everett's idea that the universal wave function contains a multiplicity of coexisting realities, usually claim to give a completely local account of quantum mechanics. That is, they claim to give an account that avoids both a non-local collapse of the wave function, and the action at a distance needed in hidden variable theories in order to reproduce the quantum mechanical violation of the Bell inequalities. In this paper, I sketch how these claims can be substantiated in two (...) renderings of Everett's ideas, namely the many-minds interpretation of Albert and Loewer, and versions of many-worlds interpretations that rely on the concepts of the theory of decoherence. This paper investigates under what conditions a good corporate social responsibility (CSR) can compensate for a relatively poor corporate ability (CA) (quality), and vice versa. The authors conducted an experiment among business administration students, in which information about a financial services company’s CA and CSR was provided. Participants indicated their preferences for the company’s products, stocks, and jobs. The results show that for stock and job preferences, a poor CA can be compensated by a good CSR. For product preferences, a (...) poor CA could not be compensated by a good CSR, at least when people thought that CA is personally relevant to them. Furthermore, a poor CSR could be compensated by a good CA for product, stocks, and job preferences. (shrink)

In his natural philosophy, John Buridan reinterprets Aristotelian conceptions of necessity using a framework derived from his logical writings. After a discussion of Buridan’s account of varieties of necessity, in this paper I shall approach some interpretative uses of that account where two natural philosophical concerns are involved. The first is connected with the relationship of modality and time in a question from the first book of his commentary to De Generatione et Corruptione addressing a consequence from possibilities of alteration (...) to possibilities of generation. The content of that question hinges on the metaphysical connection between alteration and substantial changes. In the third section, I shall explore a quasi-definition of causal necessity and contingency Buridan discusses in the second book of his commentary to the Physics. Buridan’s discussion of alternative descriptions of causal necessity and contingency in that context reveals competing pictures of the role of essences in causal explanation associated with Avicenna and Averroes respectively. An explanation of how we acquire concepts of kinds if they are socially constructed is a desideratum both for a successful account of concept acquisition and a successful account of social constructionism. Both face the so-called “mismatch problem” that is based on the observation that that there is often a mismatch between the descriptions proficient speakers associate with a word and the properties that its referents have in common. I argue that externalist theories of reference provide a plausible and attractive (...) account of concept acquisition, including the acquisition of concepts of social constructs, that avoids the mismatch problem. However, externalist theories are ontologically and psychologically highly demanding, which places strong constraints on accounts of the metaphysics of socially constructed kinds. In particular, they require a rather strong form of realism that is incompatible with some but not all theories of social constructionism. Finally, I show that these demands can be met by means of adopting a homeostatic property cluster view of natural kinds. (shrink)

In his logical treatises, John Mair develops a method and a set of rules for the verification of modal propositions, which is in the spirit of his predecessors Ockham and Buridan, but ultimately goes beyond them. He calls this method positio de inesse. It is also by this method that the truth conditions for divided modal propositions are set out. There is a standard interpretation of it as a form of reductionist method, and scholars have been tempted to think that (...) it was motivated by an implicit rejection of de re modal properties shared by Mair and other sixteenth- century nominalists. After presenting the background to Mair’s writings on the semantics of modal propositions, in this paper we revisit Mair's version of the method of positio de inesse. We argue that it is based on some basic semantic rules and contend that this procedure analyzes divided modal propositions into singular de re sentences referring to possible objects. Consequently, we conclude that this method does not reflect a reductionist approach to modal discourse. We instead provide an alternative interpretation. (shrink)

Heraclitus and Parmenides, far from being polar opposites, convey the same message: all is one, objects and entities are man made distinctions. Only God knows the whole truth, says Heraclitus, and the most learned man can only guess. For Parmenides the knowledge of being identifies with being itself, and things that mortals posit are only names given by men. Zeno apparent paradoxes give us an insight about the topics discussed in Parmenides entourage, but it was Melisso’s absurd version of Eleatism (...) that posterity regarded as the central tenet of the school. The last years have seen a surge of scandals in financial intermediation. This article argues that the agency structure inherent to most forms of financial intermediation gives rise to conflicts of interest. Though this does not excuse scandalous behavior it points out market imperfections. There are four types of conflicts of interest: personal-individual, personal-organizational, impersonal-individual, and finally, impersonal-organizational conflicts. Analyzing recent scandals we find that all four types of conflicts of interest prevail in financial intermediation.

I summarise some aspects of the relation between quantum mechanics and the macroscopic world in the context of the multiverse or Everett theory. I do so with particular reference to the results of the theory of decoherence, the notions of reduction and emergence, and agents' decisions.

We prove a generalization of Maehara’s lemma to show that the extensions of classical and intuitionistic first-order logic with a special type of geometric axioms, called singular geometric axioms, have Craig’s interpolation property. As a corollary, we obtain a direct proof of interpolation for (classical and intuitionistic) first-order logic with identity, as well as interpolation for several mathematical theories, including the theory of equivalence relations, (strict) partial and linear orders, and various intuitionistic order theories such as apartness and positive partial (...) and linear orders. In this paper I generalize the new approach to nonmonotonicreasoning that was presented in [6]. This generalization results in the inconsistency-adaptive logic PRL . I give proof theory, semantics, mention interesting properties,and comment on the reconstruction and amelioration of other nonmonotoniclogics and mechanisms.

This paper relates both to the metaphysics of probability and to the physics of time asymmetry. Using the formalism of decoherent histories, it investigates whether intuitions about intrinsic time directedness that are often associated with probability can be justified in the context of no-collapse approaches to quantum mechanics. The standard approach to time symmetry in the decoherent histories literature is criticised, and an alternative approach is proposed, based on two decoherence conditions within the one-vector formalism. In turn, considerations of forwards (...) and backwards decoherence and of decoherence and recoherence suggest that a time-directed interpretation of probabilities, if adopted, should be both contingent and perspectival. Definitions of time symmetry and examples of time-directed behaviour are discussed in the framework of discrete Markov processes. It is argued that typical examples of time-directed behaviour can be described using time-symmetric transition probabilities. Some current arguments in favour of a distinction between past and future on the basis of probabilistic considerations are thereby judged to be unjustified.

In this paper, I show that, although Husserl explicitly explains a kinetic theory of Leib already in § 83 of Raum und Ding, a real phenomenology of the distinction between Leib (living body) and Körper (corporeal object) is not conceivable without Scheler's contribution. It’s quite common to search for the origin of this distinction in Ideen II, in a work composed of texts written in different moments from 1912 on. Before 1912 Husserl dedicated himself to the theme of corporeality in (...) the first part of Göttinger Vorlesungen 1904/1905 as well as in the lectures in the Sommersemester of 1907 titled Ding und Raum [Hua XVI]. Both lectures, however, lack an explicit analysis on the distinction between Leib and Körper. Scheler instead mentions it already in an unpublished text from 1908/1909 and fully develops it in the years 1911 and 1912, where the issue is explored in a more organic and radical way than in the writings of Husserl. -/- In diesem Beitrag möchte ich darauf hinweisen, dass, obwohl Husserl bereits in § 83 von Raum und Ding eine kinetische Theorie von Leib erklärt, eine reale Phänomenologie der Unterscheidung zwischen Leib und Körper ohne Schelers Beitrag nicht denkbar wäre. Im Allgemeinen wird ihr Ursprung in den Ideen II festgestellt, einer Schrift, die aus den Texten verschiedener Zeiten nach 1912 besteht. Vor 1912 widmet sich Husserl dem Thema der Körperlichkeit in dem ersten Teil der Göttinger Vorlesungen 1904/1905 sowie in den Vorlesungen aus dem Sommersemester 1907 über Ding und Raum [Hua XVI]. In beiden Vorlesungen fehlt jedoch eine explizite Untersuchung zum Unterschied zwischen Leib und Körper. Bei Scheler hingegen ist sie bereits in einem Nachlasstext aus 1908/1909 auffindbar und wird in den Jahren 1911 und 1912 sehr ausführlich entfaltet. Die Auseinandersetzung mit dieser Thematik erfolgt bei ihm viel organischer und eingehender als bei Husserl. -/- In questo scritto dimostro che, sebbene Husserl espliciti una teoria cinetica del Leib già nel § 83 di Raum und Ding, una vera e propria fenomenologia della distinzione fra Leib (corpo vivente) e Körper (oggetto corporeo) è inconcepibile senza il contributo di Scheler. Generalmente tale distinzione viene ricondotta a Idee II, un testo che è il risultato di diverse versioni composte a partire dal 1912. Prima del 1912 Husserl si dedica al tema della corporeità nella prima parte delle Göttinger Vorlesungen del 1904/5, e nelle lezioni del Sommersemester del 1907 dedicate a Ding und Raum [Hua XVI]. In entrambi questi testi manca però un’analisi esplicita sulla differenza fra Leib e Körper. In Scheler invece tale distinzione è già rintracciabile in un inedito del 1908/09 per poi essere pienamente esplicitata nel biennio 1911-1912, dove è presente un’elaborazione di questa tematica ben più organica e radicale rispetto a quella presente negli scritti di Husserl. Keynes's A Treatise on Probability (Keynes, 1921) contains some quite unusual concepts, such as non-numerical probabilities and the ‘weights of the arguments’ that support probability judgements. Their controversial interpretation gave rise to a huge literature about ‘what Keynes really did mean’, also because Keynes's later views in macroeconomics ultimately rest on his ideas on uncertainty and expectations formation.

Drawing on the mood-behaviour model (Gendolla, 2000), two studies investigated informational effects of mood on effort-related cardiovascular response. Experiment 1 manipulated mood state (positive, negative) and task difficulty (easy, difficult, extremely difficult). Effects on cardiovascular reactivity were as expected: On the easy level, reactivity was weak in a positive mood, but strong in a negative mood; on the difficult level, reactivity was strong in a positive mood, but weak in a negative mood; on the extremely difficulty level mood had no (...) effect. Experiment 2 manipulated mood only. As predicted, subjective demand and cardiovascular response were both higher in a negative mood than in a positive mood and the mood effect on cardiovascular response diminished after statistically controlling for the demand appraisals. Neither study revealed any mood effects on cardiovascular response during the mood inductions. (shrink)

The concept underlying Prigogine's ideas is the asymmetric "lifetime" he introduces into thermodynamics in addition to the symmetric time parameter. By identifying processes by means of causal chains of genidentical events, we examine the intrinsic order of lifetime adopting Grunbaum's symmetric time order. Further, we define the physical meaning and the actuality of the processes under consideration. We conclude that Prigogine's microscopic temporal irreversibility is tacitly assumed at macroscopic level. Moreover, his "new" complementarity lacks any scientific foundation. Finally, we put (...) forward the fact-like origin of temporal irreversibility referring to classical thermodynamics. (shrink)

There have been innumerable attempts to characterize personal identity either in terms of psychological continuity or in terms of the linear and self-referential process of reproduction of one's self. I will defend the thesis according to which personal identity emerges mainly as a process of transcendence of one's own "minimal self". It is precisely by means of this critical distancing from his self, I contend, that the individual learns to see himself under a new perspective as far as to experience (...) his self as a surprise. Amazed at his own self, he lives a reawakening which leads him to a transformation of his way of living. This transcendence of the self cannot take place self-referentially but only through the force of an example provided by another person. Such act neither aims at the annihilation of the individual, nor does it contrast with self-love. It is in conlict merely with what Harry Frankfurt calls "selfindulgence". The idea of a transcendence of the self is already to be found in Plato, who fostered the overcoming of and puriication from amathia (in the sense of a "not knowing but pretending to know") and from an excessive love of oneself. Indeed, these latter would be the two grave diseases which render formless the soul of a human being, for they stand in the way of the cura sui. The same theme will reappear in Max Scheler's phenomenological reduction, which endeavours to bracket egocentrism (construed as excessive love of oneself) in order to give a form to the personal identity. Studies link involuntary outpatient commitment with improved patient outcomes, fueling debate on its ethical justification. This study compares inpatient utilization for committed outpatients in the 1990s with those who were not under outpatient civil commitment orders. Findings reveal committed outpatients had higher utilization of inpatient services and restraint episodes prior to their commitment compared with a control group. Committed outpatients also were more likely to have been on discharge status at the time of admission, have been admitted involuntarily under emergency (...) legal procedures, and have had a greater number of admissions and hospital days prior to their commitment. Following commitment, patients had fewer hospitalizations, shorter lengths of stay, fewer seclusion episodes and hours, and fewer restraint episodes and hours. Findings are discussed within the context of parens patriae and therapeutic jurisprudence, and support medical and public policy justifications for ethical uses of outpatient civil commitment laws for seriously mentally ill patients. Scheler, like Jaspers, gives a key importance to the relations with alterity and grounds both the individual formation and social ontology on the practices of “sharing emotions”. My work attempts to interpret the impairments related to the capacities of communication – that Jaspers places at the roots of psychopathology and that the Japanese psychiatrist Bin Kimura has more recently argued to be the core of schizophrenia – as impairment of what Scheler calls ordo amoris, that is the “order of feeling” (...) of a person: like a "Psychopathology of the Ordo Amoris". In this commentary I focus on similarities, discrepancies, and problems in the four large theoretical perspectives on emotions presented in this issue. Focusing on the approaches’ ideas about the functionality of emotions, I will discuss limitations that call for (additional) smaller and more focused theories.

This article discusses possible ways to account for how solidarity comes to be constituted. Beyond accounts tying solidarity either to identity, or to the adherence to a common normative framework, recent scholarship has underscored the role played by collective action in bringing about solidarity. In this paper, I agree that collective action has been often overlooked as a fundamental element in constituting solidarity but warn against the risk of conceptualizing the source of solidarity exclusively in terms of action. Instead, I (...) propose to understand solidarity as resulting from the continuous interaction between two different dimensions of solidarity: constitutive solidarity that centres on collective action, and constituted solidarity which centres on given identities. My paper begins by distinguishing the two meanings of solidarity – constituted and constitutive. The first referring to an (instituted) set of mutual obligations applying to a given group, the second referring to solidarity as underlying social bond, which establishes the solidarity group in the first place. The paper then goes on to discuss three different accounts of constitutive solidarity: identity-based, obligations-based and action-based. I argue that only the action-based account can conceptualise the coming about of new forms of solidarity and the changing scope of the solidarity group. Yet, such accounts are unable to conceptualise how constitutive solidarity can come to ground constituted forms of solidarity, able to endure through time. On this basis, I propose to interpret constitutive and constituted solidarity as two ‘moments’ of solidarity, one symbolically grounding the other, even if not through linear causation. Rather, constitutive solidarity is constantly evolving and constantly contributes to remap the identities depicting social reality, which ground constituted forms of solidarity. (shrink)

In Max Scheler il concetto di spirito (Geist) è particolarmente instabile: come il pennino di un sismografo è capace di registrare ogni minimo mutamento del suo pensiero. L'oscillazione più spettacolare avviene nel 1923. Il problema è che invece le diverse interpretazioni su Scheler, ancora oggi, procedono come se avessero a che fare con un termine univocamente definito. Ancora nel 1922, nella seconda edizione di Vom Ewigen, Scheler esprimeva la tesi che «lo spirito è infinitamente più potente (mächtiger) di tutta la (...) natura insieme», già nel 1924, in Probleme einer Soziologie des Wissens, scrive esattamente il contrario: «originariamente lo spirito non ha in sé una qualsiasi traccia di forza o di efficacia». Inoltre mentre nel periodo intermedio i termini "persona" e "spirito" risultano rigorosamente correlati-nel Formalismus si arriverà a sostenere che «l'idea di uno spirito impersonale è insensata» - dopo il 1923 il concetto di "spirito" viene gradualmente riferito a tutta la natura, per cui la persona diventa una delle tante espressioni dello spirito. Che cosa succede nel 1923 per spiegare un rovesciamento di posizioni di tale portata? (shrink)

I identify two kinds of failure in joint action. First, we can fail to ‘do our part’, that is, fail to contribute to fulfilling the joint intention. Second, we can fail to respect our collaborators. Recognizing the distinct natures of both normative relations helps us overcome a key challenge to a reductionist theory of collective intentionality posed by Margaret Gilbert. According to this objection, we have obligations towards others even in immoral joint actions – a claim that was recently supported (...) experimentally. Except for a handful of experimental papers, work on the normativity in joint intention has stagnated. I hope the distinction breathes fresh air into the theoretical and empirical debate. (shrink)

Was ist Wert? Des Öfteren hat man bei der Beantwortung dieser Frage den Wert als etwas einer Qualität oder einem Attribut Ähnliches konzipiert. Meines Erachtens muss die Antwort hingegen in der Verbindung des Wertes mit der Erfahrung gesucht werden. Der Wert ist nichts, was dem Phänomen von außen zugeschrieben würde, sondern etwas, was dem Phänomen die Möglichkeit gibt, sich zu offenbaren und sich zu konstituieren. In dieser Richtung behauptet Scheler, dass der Wert keine „Eigenschaft“ eines Dinges neben seinen anderen Eigenschaften (...) sei. Der Wert gehört demnach einem Teilbereich der Erfahrung an, jedoch nicht als einfaches Phänomen, sondern vielmehr als Urphänomen. Daraus folgt, dass der Wert nicht – wie eine Wertqualität oder ein Attribut – auf die Gegebenheit eines Phänomens zurückgeführt werden kann, da er der Erscheinung des Phänomens selbst vorangeht. Als Urphänomen ist der Wert Element der Vorgegebenheit, nicht der faktischen Gegebenheit. (shrink)

Wie bekannt hat Scheler den Begriff der "phänomenologischen Reduktion" ausdrücklich von Husserl übernommen1, dennoch behauptet in der letzten Schaffensperiode ebenso deutlich, den Terminus "Phänomenologie" vermeiden zu wollen, und tatsächlich verwendet er entweder den Ausdruck "phänomenologische Reduktion" in Anführungszeichen oder den Begriff "Techne der Reduktion". Die These, die ich zu entwickeln versuchen werde, ist, daß es bei Scheler nicht nur eine einzige Theorie der Reduktion gibt und daß, ebenso wie verschiedene Realitätstheorien zu unterscheiden sind, ebenso viele Versuche zu erkennen sind, die (...) das Thema der Reduktion behandeln. Diese Versuche sind in großen Zügen auf zwei "Varianten" zurückzuführen: Die erste Variante ist jene, die wir alle kennen und die Scheler selbst in seiner mittleren Schaffensperiode als "phänomenologische Reduktion" bezeichnet. Die zweite Variante der Reduktion wird von ihm nicht eindeutig bestimmt, und es ist auch schwierig, dafür eine Bezeichnung zu finden. Auf jeden Fall verbindet sie Scheler mit Begriffen wie Sublimierung, Ekstase, Askese, "moralischer Aufschwung", etc.. O presente artigo investiga a conexão entre modalidade e tempo em dois mestres de artes Parisienses ativos na primeira metade do século 14, João Buridan (c.1290-c.1361) e João de Jandun (c.1286-c.1328). Busca-se elucidar a abordagem de ambos acerca da natureza dessa relação em um conjunto de textos pouco explorados nos debates sobre a interpretação de modalidades medievais, a saber, os comentários ao fim do primeiro livro do De Caelo de Aristóteles. A interpretação da relação entre o ‘necessário’ e o que (...) ‘sempre é’ nesse texto recebera interpretações divergentes sobre a controversa assimilação de necessidade e omnitemporalidade em concepções pré-modernas das modalidades. Por meio da análise do debate em torno das passagens Aristotélicas do De Caelo, posto por ambos os filósofos pertencentes ao milieu da Faculdade de Artes em Paris, o artigo demonstra que tal assimilação não era consensual. Através do contraste entre as análises de Jandun e Buridan, conclui-se que, embora Buridan acomode a necessidade temporal pressuposta no De Caelo enquanto necessidade condicional, ele desenvolve uma crítica da validade geral dos argumentos de Aristóteles no que tange a modalidades absolutas. In questo lavoro si dimostra che l'opinione comune, secondo cui è Heidegger a introdurre Jacob von Uexküll nel dibattito filosofico è scorretta, in quanto è Scheler, due decenni prima, a scoprire e valorizzare la portata filosofica di Uexküll. -/- Pure la distinzione fra mondo (Welt) e ambiente (Umwelt), come quella fra apertura al mondo e chiusura ambientale, non è introdotta da Heidegger nel 1929 (cfr. l'Introduzione di Marco Mazzeo al testo di Uexküll, Ambienti animali e ambienti umani, p.18 e seg.) (...) ma è già presente in Scheler negli scritti del periodo 1909-1913. (shrink)

In Platons Apologie des Sokrates zeichnet sich eine auf menschliche Art weise Person durch ihre Fähigkeit aus, den epistemischen Status und den Wert ihrer Meinungen über Sachverhalte korrekt zu beurteilen. Sie weiß, ob es sich bei ihnen um Wissen oder bloß um Meinung handelt, aber auch, ob sie etwas nicht weiß. Es ist zudem eine breit geteilte Auffassung, dass intellektuelle Bescheidenheit, obwohl nicht dasselbe wie Weisheit, ein bedeutender Aspekt der Weisheit ist. Doch wenn die hier vorgestellten Überlegungen triftig sind und (...) das Spektrum der relevanten Deutungen abdecken, ist das für Sokratische Weisheit nicht haltbar. Denn die Bedingungen für korrekte Urteile über den epistemischen Status der eigenen Meinungen sind so anspruchsvoll, dass fehlbare Wesen, die ein entsprechendes Wissen zweiter Stufe beanspruchen, nicht anders als epistemisch unbescheiden sein können. Wenn Sokratische Weisheit epistemische Bescheidenheit verlangt, ist Sokrates nicht weise. (shrink)

It is often stated that joint actions are linked to so-called _directed duties_. It is not just that we should “do our part” in a joint action simply because it is the right thing to do or because it is in our best interest. Instead, we “owe” it to the other participants. Despite its _prima facie_ plausibility, this claim is not well understood. Is it true that duties in joint action are directed? Which notion of directedness is relevant to understanding (...) the normativity of joint action? I first argue that we can characterize the notion of directed duties in joint action in terms of a network of inferentially related normative relations and practices. I apply this analysis to show that duties in joint action _are_ directed. This analysis supports the view that the normativity in joint action is special as it involves what Stephen Darwall calls “individual authority” without entailing “representative authority”. A perhaps surprising conclusion derived from this account is that actions in joint action are owed to everyone involved in the group equally. This supports Margaret Gilbert’s joint commitment account of joint intention. (shrink)

Oltre che per la giovane età del condannato, l’esecuzione è insolita anche per il luogo e il metodo scelto dall’Inquisizione: anziché le solite fascine, per alimentare il fuoco viene approntato un pentolone di pece, olio e trementina, nel quale viene immersa la povera vittima.

Phenomenological reduction as a philosophical conversion (periagoge) -/- Während Husserl in den Ideen I die Reduktion als eine neue „Methode“ des Denkens, d. h. als eine „epistemologische“ Reduktion versteht, schlägt Scheler eine Reduktion als eine „Tèchne“ der Umbildung vor, durch die der Mensch seiner exzentrischen Stellung in der Welt Gestalt zu geben sucht. Mich interessiert an diesem Zitat vor allem der Gebrauch des griechischen Terminus „Tèchne“. Was Scheler damit bezeichnet, hat offensichtlich nichts mit dem zu tun, was wir heute unter (...) dem Begriff der Technik verstehen. Er spricht eben von einer Kunst „des inneren Handelns“. Meines Erachtens verweist Scheler durch diesen griechischen Begriff auf Platons Gedanken. Für diese These kann man sich bereits auf eine Stelle aus der mittleren Phase im Denken Schelers stützen, in der er nämlich die phänomenologische Reduktion als den moralischen Akt darstellt, dem der „platonische Aufschwung“ (Vom Wesen der Philosophie, GW V, 67) zugrunde liegt. Es ist nun geradezu dieser „platonische Aufschwung“, der im Nachlass ausdrücklich als eine „Tèchne“ (Nachlass, GW XI, 118) beschrieben wird. Was heißt nun in diesem Kontext tèchne bei Platon? Schelers Gebrauch des griechischen Terminus tèchne für die Bezeichnung der phänomenologischen Reduktion erinnert sehr an die tèchne tês periagogês im Höhlengleichnis Platons, durch die die Gefangenen aus der Höhle hinausgehen können. Diese tèchne versteht Platon als einen Bildungsprozess des Menschen; er lernt dadurch, seinen Blick auf das Gute hin zu lenken, damit seine Seinsweise in der Welt zurechtgerückt werden könne. Es geht also um eine conversio oder Umkehrung der eigenen Positionalität in der Welt, die den Übergang vom Leben zum guten Leben zustande bringen kann. Diese tèchne ist grundlegend für das Verständnis der paideía bei Platon, die sich nicht mit einer bloßen Übertragung von Informationen begnügt, sondern vielmehr nach einer periagogé (Umkehrung) der ganzen Seele strebt. Es muss also – wie Sokrates sagt – eine besondere „Kunst der Umkehrung [tèchne tês periagogês]“ geben, die lehrt, auf welche Weise am leichtesten und wirksamsten die Seele umgewendet werden kann, und zwar unter Berücksichtigung dessen, dass sie bereits sehen kann, aber es alleine nicht schafft, das Gesicht zu wenden, „wohin es solle“ (Politeia, VII, 518 d).
